Shiurim are focused on giving over a derech haLimud based on lomdus and clarity in the sugya. Vaadim are also offered on Halacha, Mussar, Chassidus, and Machshava. HBM is the yeshiva where serious bnei Torah can become talmidei chachamim.

To that end, we encourage talmidim to find the right time to take off one seder a day to pursue a college degree at Farleigh Dickenson University (1 year), Touro University (2yrs) or Columbia University (2yrs). FDU courses are offered in the Heichal building. Heichal maintains a special partnership with Touro, which affords Heichal talmidim special scholarships to Touro University.

Talmidim come from various backgrounds, but join together to form one unified yeshiva. The yeshiva coordinates amazing special programs to create a sense of chevra among the talmidim. These include: in-Shabbosim, Rosh HaShanah, Yom Kippur, Simchas Torah and Shavuos as a yeshiva as well as concerts and kumitzs with Eitan Katz, Beri Webber, Zusha, Yosef Karduner and so much more. The yeshiva regularly goes away for extended weekends at camps and hotels. In addition, the yeshiva also coordinates fun ski and waterpark trips to give the boys exciting times and much needed breaks throughout the zman.

A dream to establish a small and passionate makom Torah in the heart of Teaneck where talmidim can strive to reach their full potential in learning and avodas Hashem. A Bais Medrash with learning on the highest level, shiurim that transmit a derech haLimud, with sincere davening and refinement of character at its core. A place where serious bnei Torah can become true talmidei chachamim. A PLACE WHERE SERIOUS BNEI TORAH CAN BECOME TRUE TALMIDEI CHACHAMIM.

Building on the incredible success of Heichal HaTorah High School, we welcomed 20 talmidim to begin the Bais Medrash. A small student

body came together from various yeshivos across Eretz Yisroel, afforded the talmidim an opportunity to forge lifelong relationships with their rebbeim and chaverim. Now 50 talmidim joined the Bais Medrash. As Heichal grows, we remain a place where your rebbeim know where you are holding. The yeshiva has regular Elul, winter, and summer zmanim, and bi-monthly in-Shabbosim. Heichal HaTorah Bais Medrash is located on the Heichal HaTorah campus in Teaneck, NJ, with over 200 high school talmidim. Talmidim of the Bais Medrash learn in the newly renovated Rozehzadah Bais Medrash and have access to all the wonderful facilities of Heichal HaTorah, including beautiful shiur rooms, an Olympic sized swimming pool, basketball court and workout gym and our brand new dorm opening Elul of 5753. Rav Aryeh Stechler Rav Stechler founded Heichal HaTorah of Teaneck, NJ in 2013 and currently serves as the Rosh Yeshiva and Dean. Heichal is home to over 200 high school students and 60 talmidim in its Post-Israel Institute for Yeshiva and College Studies. Rav Stechler received his BA in Philosophy from Yeshiva College, semicha from RIETS under the guidance of HaRav Hershel Schachter and Rav Michael Rosensweig, and holds a certificate in School Leadership from Harvard Business School and Harvard School of Education. During the summers, Rav Stechler is the Rosh Kollel of Camp Shoko, the summer program affiliated with Heichal HaTorah. He offers lectures in Business Leadership in the Petrocelli School of Fairleigh Dickinson University in Teaneck, NJ. Prior to founding Heichal, Rav Stechler served as rabbi in Ahavath Torah in Englewood, NJ and Anshe Chessed in Linden, NJ. Rav Stechler also served as Executive Vice President of the RCBC and was a Gemara rebbe in High Schools for over a decade.

Our goal in the Heichal HaTorah Bais Medrash is to help the talmidim continue to grow in their limud haTorah and avodas Hashem. These two goals are intertwined as Chazal say, (:‫תורה מביאה לידי זהירות וכו’ (מס’ ע”ז דף כ‬ Although this is true for all forms of limud haTorah, there are specific forms of learning that are more effective than others. Rav Yisroel Salanter writes in his Iggeres Hamussar ‫הנשגב והעיקר בשימוש רפואות התורה‬ ‫ דיני‬,‫ הוא ללמוד בעוז ועיון עמוק היטב‬,‫לתחלואי היצר‬ ‫ ההלכה עם כל סעיפיה‬,‫העבירה עצמה‬. Why is this true? R Yisroel explains, ‫כי השתנות הטבע תולד‬ ,‫ ולכן היסוד העקרי והעמוד הנכון‬,‫רק מלימוד והרגל רב‬ ‫ הוא‬,‫להכין את עצמו לשמירה מהעבירות ועשיית המצות‬ ‫רק הלימוד הרב בהלכה זו הנוגעת לעבירה זו או למצוה‬ ‫ כי זה הלימוד עושה‬,‫ ובפרט בעיון הדק היטב‬,‫זו‬ .‫ להיות העבירה מרוחקת ממנו בטבע‬,‫קנין חזק בנפש‬

Why is ‫ לימוד בעיון‬the only way to make a strong ‫ קנין בנפש‬that will make a person naturally averse to the ‫ ?עבירה‬The answer can be found in the ‫ מהר”ל‬in his ‫ חידושי אגדות‬in (‫מסכת סוטה‬ .‫)דף כב‬

The Gemara there says, ‫קרא ושנה ולא שימש ת”ח‬ ’‫ ר‬- ])‫[ללמוד סברת הגמרא בטעמי המשנה (רש”י‬ ‫ הרי זה עם הארץ‬:‫אלעזר אומר‬. What is the reason for this? Why is someone who is proficient in the whole Tanach and Shisha Sidrei Mishna

considered an ‫ עם הארץ‬for not having spent time with a rebbe to teach him the ‫ סברות‬of the underlying reasons? The ‫ מהר”ל‬explains, ‫ והרי זה לא‬,‫כי עם הארץ נקרא מי שלא קנה תורה‬ ‫ כי קנין התורה כאשר ידע אותה בשכלו‬,‫קנה התורה‬ ‫ וזה שלמד המשנה ולא‬,‫ואז התורה עומדת עם האדם‬ ‫הבין אותה [על עומקה] אין קונה התורה רק בדבור‬ ‫בלבד ואין הדבור קנין האדם רק השכל והחכמה שהיא‬ ‫ ולפיכך נקרא עם‬,‫שייכת לאדם [והוא] קנין האדם‬ ‫הארץ שלא קנה דבר‬. The essence of a person is his thinking mind. As Rashi says in the beginning of Bereishis (‫ להבין ולהשכיל‬- ‫כדמותנו‬ ‫ כו‬,‫(א‬. Learning Torah with understanding is a mitzvah but is not changing the essence of the person. Only through deep understanding is the Torah connecting to his essence and becoming truly his. This is why Rav Yisroel says that ‫ לימוד בעיון‬is the way to change your nature. In the Heichal HaTorah Bais Medrash, we emphasize this ‫ עיון עמוק הדק היטב‬and ‫שימוש‬ ‫תלמידי חכמים‬. The rebbeim are always available and are constantly working with each bochur to bring him to the precise understanding of the depth of the sugyos. Overview Morning seder will be the most important part of your day at Heichal. It is the seder where you will acquire the skills necessary to become a lamdan. Under the guidance of world-class maggidei shiur and mechanchim, you will learn your way through the yam haTalmud. Talmidim often write up their notes from iyun seder and take tests on what they are learning to solidify the limud and remember it far beyond that zman. Rav Yitzchak Reichman is a preeminent talmid chacham with years of experience teaching talmidim “how to learn.” In his shiur, you will be carefully guided through each sugya, understanding every point in the Gemara and Rishonim until you have complete ownership of the sugya. You will be able to develop a real “geshmak” in learning. On Friday mornings, Rav Yitzchak gives a very popular Chumash shiur on the Parshas Hashavua. Our mashgiach, Rav Moshe Don Kestenbaum, gives the other Iyun shiur in the morning. Rav Kestenbaum starts off the morning with a vaad discussing topics that talmidim encounter in their day-to-day lives including dating, middos, and shalom bayis. Rav Kestenbaum gives a very interactive shiur where each talmid is encouraged to participate and ask questions during shiur. We are fortunate to have two outstanding Shoel U’meishivim, Rav Nechemia Spitz and Rav Yitz Wagner. They are available throughout morning seder to learn with talmidim individually or to ask any question you may have in the sugya being learned. Of course, all rebbeim and meishivim are available outside of seder to review, take on an extra limud, or just to shmooze.

RAV YITZCHAK REICHMAN Rav Reichman is a talmid of Yeshiva Shaar HaTorah in Queens, where he developed a close relationship with the roshei yeshiva, Rav Kalman Epstein, shlit”a, and Rav Sholom Spitz, shlit”a, his father in law. In Eretz Yisroel, he learned in Yeshivas Brisk under the leadership of Rav Avrohom Yehoshua Soloveitchik. For 14 years, he learned in kollel in Bais Medrash Govoha in Lakewood, New Jersey, including, 6 years as a rosh chabura. This chabura focuses on the combination of classical lomdus and halacha, attracted a large number of outstanding avreichim interested in the derech haLimud as well as the hadracha they would receive in formal chaburos and oneon-one discussions. Rav Yitzchok also collaborated with his father, Rav Herschel Reichman of Yeshiva University, on a number of volumes of Reshimos Shiurei HaGrid Soloveichik, the shiurim of Rav Yosef Dov Soloveitchik, Rosh Yeshiva of YU.

Our main goal at Heichal is your success as an eved Hashem. Your years spent in yeshiva are a critical time to develop your skills in learning to last you for the rest of your life. Some of the most important skills will be attained in the afternoon seder. In the afternoon, the main purpose is to cover ground with your chavrusa in the mesechta being learned. There is nothing sweeter than struggling through a Gemara and ultimately coming to a correct pshat. That is how you will gain the skills you need to become an independent learner and talmid chacham. I also offer a bekius shiur in the beginning of seder to get the talmidim started on what we will be learning that day. In addition to the chavrusa learning, there are lots of chabura options during the afternoon seder. These include: Pnimius with Rabbi Schwechter, Hilchos Shabbos with Rabbi Steinhart, Gemara Bekius with Rabbi Genack and Parsha with the Radziner Rebbe. Coming to Heichal will be one of the best decisions of your life. There will be a rebbe to help you every step along the way.

Overview Afternoon seder is of utmost importance in Heichal HaTorah. While during morning seder, talmidim are taught how to learn by their rebbeim, in afternoon seder, the talmidim put those skills into practice. The yeshiva learns the part of the mesechta which will not be learned in the morning THE AFTERNOON SEDER with aspirations to AFFORDS TALMIDIM complete the entire THE EXPERIENCE OF mesechta at the end LEARNING ON THEIR of the year. There is OWN AND DEVELOPING a festive and joyous THEIR OWN SKILLS. WITH seudas siyum at LOTS OF ADDITIONAL the end of the year CHABUROS AND SHIURIM celebrated with the OFFERED, EACH TALMID high school. CAN FIND THEIR OWN CHELEK IN TORAH AND Afternoon seder WHAT INTERESTS THEM. begins at 3:45. Talmidim are paired up into chavrusos and learn together during most of the seder. At 5:30, a variety of shiurim and chaburos (chugim) are offered. On Monday and Thursday, Heichal Mashgiach Rav Daniel Schwechter gives a Pnimius chaburah on a topic related to the parshah and personal growth. Additionally, every day at 5:45, Rav Raphi Steinhart gives a Hilchos Shabbos Chaburah on the 39 melachos and modern day applications. Before the Yamim Tovim, there are shiurim offered on inyanei d’yomah by Rav Moshe Genack and Rav Ephraim Weller. Rav Englard, the Radziner Rebbe, often gives chaburahs on Chassidus during afternoon seder or night seder. Those who go to college in the afternoon often are able to move around their learning schedule to learn part of the seder every day, or the full seder on some days of the week. We encourage talmidim to take their college courses seriously, and whenever they are not in class, they can easily return to the bais medrash. The afternoon seder affords talmidim the experience of learning on their own and developing their own skills. With lots of additional chaburos and shiurim offered, each talmid can find their own chelek in Torah and what interests them. They can always reach out to one of the many rebbeim for guidance and chizuk.

R A BBI SKU L NIC K ’ S AF T E R NO ON SE D ER CHABURA Rabbi Pesach Skulnick is the 9th grade Senior Ram at Heichal HaTorah. He is renowned for his bekius in Shas and taking the Dirshu bechinos on all of Shas with Rashi and Tosafos numerous times. Rav Skulnick was a pillar of the Bais Medrash in Ner Yisroel for many years before coming to Heichal. There he ran a chabura of highly motivated talmidim who finished the yeshiva mesechta and took bechinos on it. For those talmidim in the Bais Medrash who are motivated to have a “kinyan” on the mesechta, Rav Skulnick gives special chaburos and bechinos enabling them to reach this tremendous accomplishment. He leads an elite afternoon seder in the Heichal Bais Medrash that masters the yeshiva's mesichta cover to cover.

RAV MOSHE GENACK Rav Moshe Genack has been teaching Torah in formal and informal settings for over ten years. His shiurim have become known for their clarity of thought and presentation, as he is able to make complex sugyos comprehensible and coherent. HILCHOS SHABBOS CHABURAH Rav Raphi Steinhart, afternoon Shoel U'Meishiv, is known for his warm personality and open home, where the talmidim are always welcome for a Shabbos meal. Rav Steinhart offers a daily chaburah at the end of afternoon seder. He learns through Hilchos Shabbos in a complex, but clear style, explaining the lomdus behind the halacha.

PNIMIOS CHABURAH Rav Daniel Schwechter, famed mashgiach of the Heichal High School, is always available to meet with Heichal Bais Medrash bochrim. He hosts small chaburahs in his office with Bais Medrash talmidim, usually in Seforim HaKedoshim. In addition, he gives a weekly chaburah in Pineemus in the Rozehzadeh Bais Medrash, exclusively for Heichal Bais Medrash talmidim.

CHASSIDUS CHABURAH Rav Nosson Englard, known the world over as the Radziner Rebbe (Teleporter Rebbe), can often be seen in the Heichal Bais Medrash schmoozing with the bochrim. One of the highlights of the year is the Shabbosim the rebbe spends at Heichal. The Rebbe offers weekly chaburahs in Ishbitz/ Radzin seforim and shares his family stories, traditions and approach to Yiddishkeit with the Heichal Bais Medrash talmidim. Rav Spitz is the Rosh Yeshiva of Yeshivas Shaar HaTorah-Grodno and one of the preeminent maggidei shiur of our generation. Rav Stechler founded Heichal HaTorah of Teaneck, NJ in 2013 and currently serves as the Rosh Yeshiva and Dean. Heichal is home to 181 high school students and 40 talmidim in its Post-Israel Institute for Yeshiva and College Studies. Rav Stechler received his BA in Philosophy from Yeshiva College, semicha from RIETS under the guidance of HaRav Hershel Schachter and Rav Michael Rosensweig, and holds a certificate in School Leadership from Harvard Business School and Harvard School of Education. During the summers, Rav Stechler is the Rosh Kollel of Camp Shoko, the Torah and fun summer program affiliated with Heichal HaTorah. He offers lectures in Business Leadership in the Petrocelli School of Fairleigh Dickinson University in Teaneck, NJ. Prior to founding Heichal, Rav Stechler served as rabbi in Ahavath Torah in Englewood, NJ and Anshe Chessed in Linden, NJ. Rav Stechler also served as Executive Vice President of the RCBC and was a Gemara rebbe in high schools for over a decade.

Rav Skulnick is the Senior Ram and 9th grade rebbe and the first rebbe who partnered with Rav Stechler to form Heichal. Rav Skulnick learned in Ner Yisroel in Baltimore for 17 years and offered an afternoon chaburah to advanced students. Hundreds of Ner Yisroel talmidim consider Rav Skulnick their Rebbe Muvhak. He has spent the last 15 summers at Camp Romimu, where he teaches the ninth grade shiur. He completed his undergraduate degree and CPA studies at the University of Maryland. He studied in Kerem B’ Yavneh for two years. Rav Skulnick’s warm and personable character, coupled with his deep concern for the religious and emotional development of each talmid, make him one of the most sought-after rebbeim in the country. Rav Skulnick enjoys playing basketball with the talmidim and often invites them over to his home to enjoy the rebbetzin’s baking. Rav Reuven Tzvi (Daniel) Schwechter learned in Yeshivat Reishit for one year under Rav Chaim Soloveitchik, and at Y.U. under Rav Baruch Simon. Rav Schwechter has an undergraduate degree in psychology. He received semicha from Rav Schachter, having learned in his kollel for three years, two of which he spent in the satellite kollel in the DRS bais medrash with Rosh Kollel Rav Shmuel Marcus. After receiving semichah, he became a rebbe at Westchester Day School, and eventually became the mashgiach ruchani. He is a close talmid of Rav Judah Mischel and can often be found in the Bais Medrash Ishei Yisroel in Woodmere, learning from Rav Naftali Tzvi Weitz. Rav Schwechter is renowned for his commitment to, and connection with, all types of talmidim, and gives shiurim both in the high school and bais medrash. He is available to meet with talmidim, one-on-one, to help guide them along their personal path in avodas Hashem. He lives with his wife and children in Woodmere. Rav Rafi Steinhart oversees the Heichal Bais Medrash Bekius program where every talmid is encouraged to finish the mesechta the yeshiva is learning that year. In addition to finishing the mesechta, Rav Steinhart encourages the talmidim to delve into the sugyos they are learning, by looking at the Rishonim and Achronim. Rav Steinhart taught at Yeshiva Gedolah of Teaneck and Heichal HaTorah High School. Rav Steinhart also offers a Hilchos Shabbos Chabura where he goes through the modern day applications to the 39 Melachos. Rav Steinhart lives in Teaneck with his wife and children and often can be found hosting the talmidim for Shabbos meals.

Rav Ephraim Weller is a product of Yeshiva of Far Rockaway, where he learned under Rav Moshe Brown and Rav Yechiel Perr. He learned in Eretz Yisroel in Yeshivas Ner Moshe under Rav Sholom Schechter. After getting married, he returned to Eretz Yisroel to learn in Yeshivas Mir under Rav Asher Arieli, who he still has a close connection with. A prolific mechaber seforim, Rav Weller is the author of Bnei Binah and Shashuey Ephraim which are seforim on the moadim. He also gives shiurim on various Halacha topics throughout the year. Rav Reichman is a talmid of Yeshiva Shaar HaTorah in Queens, where he developed a close relationship with the roshei yeshiva, Rav Kalman Epstein, shlit”a and Rav Sholom Spitz, shlit”a. In Eretz Yisroel, he learned in Yeshivas Brisk under the leadership of Rav Avrohom Yehoshua Soloveitchik. For the past 14 years, he has learned in kollel in Bais Medrash Govoha in Lakewood, New Jersey, including, most recently, 6 years as a rosh chabura. The chabura, which focused on the combination of classical lomdus and Halacha, has attracted a large number of outstanding avreichim interested in the derech haLimud as well as the hadracha they would receive in formal chaburos and one-on-one discussions. Rav Yitzchok also collaborated with his father, Rav Herschel Reichman of Yeshiva University, on a number of volumes of Reshimos Shiurei HaGrid Soloveichik. He currently lives in Lakewood with his wife and children.

Rav Reiss grew up in Flatbush, where he attended Yeshivas Chofetz Chaim for elementary and high school. He attended Philadelphia Yeshiva for bais medrash where he learned under Rav Shmuel Kaminetsky shlit”a and earned a BA in Talmudic Law. He then learned in Eretz Yisroel in the yeshiva of Rav Dovid Soloveitchik zt”l where he spent two years learning Kodshim. He then went on to learn in Bais Medrash Gavoha for a number of years, earning a masters in Talmudic Law. Rav Reiss currently resides in Passaic, where he was a member of the Passaic Clifton Community Kollel for three years. He gives a weekly Halacha shiur at Rabbi Halberstam’s shul in Passaic, as well as numerous other shiurim in the Passaic and Bergenfield communities. Rav Reiss makes sure that every talmid understands their rebbe’s shiur clearly by reviewing with them at night seder. Lander College for Men Heichal talmidim who pursue a degree at Lander College for Men take Lander courses on Monday and Wednesday evenings. Most students drive to the campus in Queens, which is a 30 minute drive at that time of night. Others Zoom into classes or take the Heichal van to Lander College. The Lander BA is usually completed in two years, depending on the major.

Fairleigh Dickinson University Heichal talmidim who pursue a degree at Farleigh Dickinson University take FDU courses at 2pm or 5pm either Mondays/ Wednesdays or Tuesdays/Thursdays. This allows them to easily attend two, and sometimes three sedarim a day. These courses are sometimes offered online and sometimes offered in person in the Heichal classrooms. FDU degree consists of 10 FDU courses in your area of specialization and then allows for the transferring in of 72 Yeshiva credits, of which some or all can be earned at Heichal HaTorah. In addition, 6 exams are required.

DR. ELLIOT PRAGER Dr. Elliot Prager has worked in the field of Jewish education for over 30 years. Dr. Prager advises and guides talmidim regarding their best options for choosing a career and college education. Dr. Prager has lived in Israel where he taught at the Institute for Youth Leaders from Abroad, Hebrew University, and Yad VaShem. Upon returning to the U.S., he served on the faculty of the BrandeisBardin Institute, and held Head of School positions at the Reuben Gittelman Hebrew Day School in Rockland County, the Charles E. MOSHE SOKOL , DEAN Dean Moshe Sokol, who holds a Ph.D. from the University of Pennsylvania, where he was a Thyssen Foundation Research Fellow, received semicha from the Israel Torah Research Institute (ITRI) in Jerusalem after seven years of post-high school studies in yeshivos in Philadelphia, New York and Israel. He has taught at the University of Pennsylvania, New York University, and Touro College graduate and undergraduate schools. Dean Sokol has served Touro College in various administrative capacities, including founding and directing the Graduate School of Jewish Studies and a collaborative medical program with the Technion in Israel. He has also served as Senior Program Officer at the Memorial Foundation for Jewish Culture, where he traveled around the world organizing seminars and educational programs. Widely recognized in his field, Dean Sokol, who holds the rank of full professor, has written or edited four books and published some two dozen articles on ethics and Jewish Studies in major British, American and Israeli journals, and lectured at conferences around the world. The Lander Core Curriculum provides students a broad base of knowledge across the natural and social sciences and humanities, with an emphasis on writing, research, and analytical skills.

In addition to the core curriculum, all students must satisfy the following degree requirements to graduate: • Completion of 120 College-approved credits • BS Requirements: 60 credits of liberal arts and science • BA Requirements: 90 credits of liberal arts and science • Completion of at least 3 credits of Intensive Talmud each full-time semester • Completion of JSL 187 Contemporary Problems in Jewish Law course • Completion of a major • 50% of major courses should be completed at the college • 45 credits completed in residency at the College • Cumulative GPA of 2.0; at least a 2.3 GPA in an approved major • Some departments require examinations, additional course work, or a higher grade point average • SPLN 501 Succeeding after College: Communications Workshop (0 credits) Required for students who start LCM September, 2021.

Students may seek a waiver of college curricular requirements if they propose an alternative plan equal in academic breadth and depth to the stated requirements. Such a plan must receive prior written approval from the Dean of the College, Dr. Sokol.

The Yeshiva and Seminary Program has graduated hundreds of yeshiva and seminary students who have gone on to graduate and professional schools such as Harvard, Columbia, and Penn Law Schools, Johns Hopkins Medical School, the FDU Silberman College of Business MS in Accounting program, Rutgers Dental School, Wurzweiler and Touro Schools of Social Work, Wharton School of Business and various MBA Programs. Our students have also pursued various careers in business with their college degrees.

Program learning outcomes Each college program has identified outcome measures that indicate whether students are successful in meeting the specific outcomes for the program. The following are outcome measures that will be assessed for the Bachelor of Arts Degree Completion program:

• COMMUNICATION: An FDU graduate will demonstrate the ability to communicate effectively in written documents, when making oral presentations, and, when appropriate, by using graphic presentation software. This outcome is also aligned with FDU University learning outcomes for written communication, oral communication and information literacy.

• CRITICAL THINKING: An FDU graduate will demonstrate the ability to define problems; to use information resources such as libraries and computers; and to analyze and integrate knowledge, perspectives and techniques. This outcome is also aligned with FDU University learning outcomes for critical thinking.

• GLOBAL AND CULTURE UNDERSTANDING : An FDU graduate will demonstrate an understanding of the historic and global context of events and achievements over time as treated in subjects such as history, the arts and the humanities with an awareness of and sensitivity to global problems and social issues, including those involving ethnic and cultural differences. This outcome is also aligned with FDU University learning outcomes for Global Understanding and Cultural Understanding.

• SPECIALIZATION: An FDU graduate will demonstrate the mastery of a body of knowledge in one subject area or a group of related areas that will be considered the graduate’s specialization.

DEAN ERIC GOLDMAN Eric A. Goldman is the dean of the FDU Yeshiva program. Mr. Goldman is also an adjunct associate professor of cinema at Yeshiva University, as well as the founder and president of Ergo Media Inc., a New Jersey-based film distribution company specializing in Jewish cinema. Dr. Goldman serves as the film reviewer for Northern New Jersey’s “The Jewish Standard.”

Dr. Goldman is a known scholar and lecturer on Yiddish, Israeli and Jewish film and a noted film educator. He is former director of the Jewish Media Service, which was a national clearinghouse on film and television for the North American Jewish community and was curator of film for the YIVO Institute for Jewish Research. He has also curated several Jewish film festivals, including the Ring Family Israel Film Series at Y.U. in Spring 2012. Eric Goldman received a Ph.D. in Cinema Studies from New York University and was a fellow of the Max Weinreich Center for Eastern European Jewish Studies at Columbia University. He was also adjunct fellow in cinema at The Center for Advanced Judaic Studies at the University of Pennsylvania. In addition, Dr. Goldman holds graduate degrees in Contemporary Jewish Studies and Theater Arts from Brandeis University. He is the author of “Visions, Images and Dreams: Yiddish Film Past and Present” (Holmes and Meier Publishers, 2011) and a new book about the American Jewish encounter with cinema, “The American Jewish Story through Cinema,” published in April by University of Texas Press. Out of these 30 credits, the following must be taken at FDU: • 6 credits of Advanced English • 18 credits of the degree concentration • 6 credits of CORE courses (Global Issues and Cross-Cultural Perspectives) In addition, the following requirements must be fulfilled: • 6 credits of English (English Composition/Writing I & II) • 3 credits of Speech/Public Speaking • 6 credits of Natural Science • 6 credits of Math, 3 of which may be in Computer Science If you are seeking financial aid, you must provide proof of high school graduation or of having attained a GED. All transfer credits should be submitted prior to the beginning of coursework and before students complete their FDU studies. The programs must be completed with FDU credits; that is, your last class must be taken at FDU. If you are taking a break, you should apply for a leave of absence. If you are gone from the University without a leave of absence, you must re-apply. You cannot simultaneously be a student at FDU and at another institution of higher learning (not including your yeshiva/seminary).

FREQUENTLY ASKED QUESTIONS

Q: How many credits must I have before I may apply to the program? A: 30 transferable credits, or if you are currently enrolled for at least one semester in a post-secondary yeshiva or seminary program. Q: How many credits may I transfer into the program? A: 90 credits. Up to a maximum of 72 credits from yeshiva/seminary study and whatever is needed to reach 90 credits from other colleges, through CPEP or other standardized exams. Q: I have taken FDU Middle College credits and/or APs. How many may be transferred? A: Up to 24 middle college credits can be applied, plus all APs with a score of 4 or more. They count toward the 90 credits that a student may bring with them into the program. Q: What is the minimum number of credits that I must take “in residence” at FDU? Can they all be online? A: You must take at least 10 FDU courses (30 credits) once you have been admitted into the program. These courses may be any combination of in-classroom and/or online courses. Q: How do I choose classes? Know what courses to take to meet the requirements? A: You work with your advisor, who will assist in choosing what courses and/or exams will fulfill your requirements. Q: Should transcripts from my yeshiva, seminary or college be submitted prior to applying to the program? A: It is preferable to do so. In this way, you know how many credits may be transferred. These initial transcripts do not need to be official. However, in order to have credits officially transferred to your FDU records, we require that the institution of higher learning send an official transcript directly to the attention of Dr. Parra in our office. Q: The BA requires that you specialize in a subject or area of study. How many courses must be taken in that area? A: 6 courses (18 credits). Q: Is financial aid available? A: Our program already offers a 50% tuition reduction; However, there are many aid programs available to our students, like Federal Pell grants, NJ TAG grants, Work-Study and other government financial aid. FDU’s Financial Aid office assists our students in seeking assistance. Q: What specializations are available? A: Starting in Fall 2021, students may specialize in any of these areas Psychology, Business, Technology Management, Public Health Administration and General Studies (which covers a vast array of subject areas). You develop your specialization in consultation with your advisor. Some specializations may only be available online. Q: May I take courses at other colleges at the university? A: The Yeshiva/Seminary program is part of Petrocelli Center. You may take any online course at Petrocelli Center and the cost of the course remains the same. Other courses offered at Petrocelli will not be men or women-only courses. You may also take any course offered at any college at FDU, but the cost of the course will not have the reduced tuition that Yeshiva/Seminary courses enjoy. Note: Some courses require that prerequisites be completed before you can take a particular class. Q: What is the cost of each 3 credit course offered during 2021-2022? A: The cost for each course taken in the program during 2021-2022 is $1,926, plus a $36 technology fee. There may also be a small “offcampus” fee.

Q: Can the Yeshiva/Seminary program be completed fully online? How long should it take to complete? A: You may choose to take all of your classes online. We offer both Zoom synchronous online classes as well as asynchronous online classes. Some students are able to complete all exams and course work in 12-14 months. Others take longer.

Q: What degree do I receive upon graduation? A: Our graduates receive a Bachelor of Arts in Individualized Studies. This is a Bachelor degree like any other and is recognized as such across the world. Our students who choose to continue their studies on a graduate-level have been accepted into the finest institutions of higher learning in North America and Israel.

While some of our talmidim will be zoche to remain in the walls of the bais medrash the rest of their lives, many will need to go out and provide parnasah for their families. These months and years are critical for working on oneself and developing the tools towards become a successful person in all areas of his life.

Heichal is home to 181 high school students and 40 talmidim in its post-Israel Institute for Yeshiva and College Studies. Rav Stechler received his BA in Philosophy from Yeshiva College, Semicha from RIETS under the guidance of HaRav Hershel Schachter and Rav Michael Rosensweig, and holds a certificate in School Leadership from Harvard Business School and Harvard School of Education. During the summers, Rav Stechler is the Rosh Kollel of Camp Shoko, the Torah and fun summer program affiliated with Heichal HaTorah. He offers lectures in Business Leadership in the Petrocelli School of Fairleigh Dickinson University in Teaneck, NJ. Prior to founding Heichal, Rav Stechler served as Rabbi in Ahavath Torah in Englewood, NJ and Anshe Chessed in Linden, NJ. Rav Stechler also served as Executive Vice President of the RCBC and was a Gemara rebbe in High Schools for over a decade. Rav Schwechter has an undergraduate degree in psychology. He received semichah from Rav Schachter, having learned in his kollel for three years, two of which he spent in the satellite kollel in the DRS bais medrash with Rosh Kollel Rav Shmuel Marcus. After receiving semichah, he became a rebbe at Westchester Day School, and eventually became the Mashgiach Ruchani. He is a close talmid of Rav Judah Mischel and can often be found in the Bais Medrash Ishei Yisroel in Woodmere, learning from Rav Naftali Tzvi Weitz. Rav Schwechter is renowned for his commitment to and connection with all types of talmidim, and gives shiurim both in the high school and bais medrash. He is available to meet with talmidim, one-on-one, to help guide them along their personal path in avodas HaShem. He lives with his wife and children in Woodmere. DR. ARIEL KLEIN Dr. Ariel Klein serves as Heichal’s Director of Guidance. Dr. Klein has served in a variety of leadership roles in schools, community organizations, and summer camps. Most recently, he helped grow MTA’s academic support programs as the Learning Center Coordinator. Dr. Klein is a certified school psychologist. He earned a Master’s degree in School Psychology from Fairleigh Dickinson University and completed his doctoral course work at Rutgers Graduate School for Applied and Professional Psychology. Dr. Klein graduated from Yeshiva University and The Marsha Stern Talmudical Academy (MTA), and spent time learning at Yeshivat Shaarei Mevaseret Zion. His main role at Heichal is to help students navigate their socialemotional and academic challenges. He works hand in hand with parents and teachers to support the students’ needs. Dr. Klein’s warm, caring and fun personality make him easily approachable and his office a favorite hangout for students. Dr. Ariel klein is always available for questions at aklein@heichalhaTorah.org RAV NOSSON E NGL ARD Rav Englard was born in Brooklyn, New York, to Rabbi Yeshayahu Englard, who was one of the rabbonim of the Radomsker Shul in Brooklyn and the eldest son of Grand Rabbi Avrohom Yissochor Englard of Radzin. His mother is a daughter of Rabbi Tzvi Hirsch Tewel, a rav and rosh yeshiva in Poland and in the US. Englard studied at Yeshivas Novominsk under the leadership of Grand Rabbi Yaakov Perlow of Novominsk. He remained a very close disciple of Rabbi Perlow until the latter’s death in 2020. Rav Englard shared a very close and unique relationship with his grandfather, Grand Rabbi Avrohom Yissochor Englard, the previous Rebbe of Radzin, being that he was his oldest grandson. Avrohom Yissochor spent much time teaching and learning with his grandson, training him in the ways of his heritage. Rav Englard gives chaburahs in chassidus at the Heichal Bais Medrash. Throughout the year Heichal hosts many large events for our talmidim and the entire community, including the Kumzitz Selichos - a meaningful singing Selichos experience, Heichal Tehillim-a-thon - together Heichal talmidim recite and sing all of Tehillim, Heichal Simchas Bais HaShoeva and Summer Mega Siyum, the crazy and famous Heichal Purim Chagigah, and Tomchei Shabbos Pesach Packing Day - when our boys pack 1,000 boxes for those less fortunate to enjoy Pesach. Singers who have performed at Heichal include Zusha, Eitan Katz, Joey Newcomb, Karduner, Beri Weber, Uri Davidi, 8th Day, Yoni Z, Mordechai Shapiro, Dudi Knopfler, Melich Krohn, and Yosef Karduner. These events, from kumsitzes to chagigahs and concerts are powerful opportunities for the talmidim and rebbeim to bond while opening their hearts to Hashem. Most of the boys who complete the masechta during the past yeshiva year review the masechta again over the summer. During the yeshiva’s Simchas Bais HaShoeivah, the talmidim who chazered the masechta over the summer are invited to join the rebbeim on the dais to make their second siyum. All the boys who complete this second siyum have their names listed on a banner, which is hung in the Heichal Bais Medrash.

A New Dorm for the Heichal HaTorah Bais Medrash

Heichal HaTorah has recently closed on a building that will be transformed into a dorm for close to 60 Bais Medrash students this coming Elul. This announcement is an important milestone for the Heichal Bais Medrash program, now in its third year. The Bais Medrash, under Rav Aryeh Stechler’s leadership, is staffed with the highest caliber rebbeim who offer its nearly forty talmidim from across the United States and Canada an atmosphere of warmth and growth that Heichal’s high school is known for.

The Bais Medrash was started after a growing number of high school alumni approached Rav Stechler requesting a smaller Bais Medrash

and college option that would offer them the best features of their Heichal high school experience. In response to this demand, Rav Stechler invited several world-class talmidei chachamim and rabbonim to serve as the inaugural faculty of the new Bais Medrash program. Among the first to join were Rav Yitzchak Reichman, shlita former rosh chaburah of one of the largest halacha chaburos in Beth Medrash Govoha, as senior maggid shiur, and son of Rav Hershel Reichman, Rosh Yeshiva at YU and author of Rav Soloveitchik’s shiurim on Shas. Rav Moshe Dan Kestenbaum, shlita, the popular columnist, advisor and well-known author of many sefarim

on personal growth and parenting, joined as Mashgiach of the Bais Medrash program. Rounding out the stellar staff, the Bais Medrash includes young and dynamic talmedei chachamim such as Rav Moshe Genack, Rav Eli Zakutinsky, Rav Mordechai Reiss, and Rav Rafi Steinhart, all of whom contribute to the Bais Medrash’s vibrancy and warmth. Talmidim speak glowingly of their warmth and ability to guide their students in both learning and personal growth. “Finding a chevra at heichal was so easy. The Rebbeim care for each of the talmidim like we’re their own child”, says Bais Medrash talmid, Moshe Schmelzer from Monsey, NY.

Heichal is grateful to the Rozezahdeh family for beautifully building the Bais Medrash Zichron Baruch in a way that makes the talmidim feel comfortable and at home. “Everything about this represents who my father was and what he believed in. My father would have delighted in the chance to see young men learning Torah in an open environment where they are free to pursue their Judaism and spiritual growth”, Joe Rozehzadeh said. Students in the Bais Medrash program can choose to learn a full day with three daily sedarim, or they can learn two sedarim while taking classes with college programs, such as CUNY, FDU or Landers College for Men whose schedules are designed to match the yeshiva schedule so they can obtain Bachelor’s degrees while minimally infringing their learning.

Currently the talmidim dorm in houses and apartments throughout Teaneck. In order to allow the students to live together in a central location closer to the yeshiva, Heichal decided to build a dorm so the talmidim could be located near the yeshiva in one central location. To that end, Rav Stechler and Mr. Avrohom Forman, formed a Dorm Committee along with committee members Tzvi Zilberstein, Aaron Wertentheil, Aryeh Sheinbein, and Isaac Mirwis, all of whom worked tirelessly to bring this dream into a reality. Mrs. Suzy Littman ran a successful campaign to raise funds to purchase and renovate 133 Cedar Lane, a building located just one clock from the Yeshiva, for the future site of the dorm. After six months of hard work, the Dorm Committee, working with lawyers, architects and the seller, obtained

local zoning approval and closed on the site in December 2021. Construction is expected to start shortly in time for the dorm to open to 60 talmidim this coming Elul 5783. Heichal is optimistic that this next new step will have a positive influence on Teaneck and the wider Jewish community, expanding the options for young men who wish to pursue their yeshiva studies in a warm, growthoriented environment while also completing their college education. Heichal BM Learner Earner Isaac and Sophia Mirwis What Heichal means to me: Learning at Heichal has been a life-altering opportunity. Before Heichal, I had preached making Torah a pillar in our home and an integral part of my life. However, not until Rabbi Stechler and the Heichal Bais Medrash opened their doors to me did I truly live a life of Torah. I am proud and thankful that learning at Heichal has been my preoccupation as I strive to be a ben Torah for life.

Bio: Isaac grew up in Houston, Texas, and moved to Teaneck after learning for a year and half in Torat Shraga in Israel. He and his wife Sophia and their 3 kids - Shira, Leah and Elchanan - live in Teaneck. Isaac graduated YU’s Sy Syms School of Business’ Honors Program Cum Laude, and he currently works at Greystone as a mortgage banker. Isaac is dedicated to leading a Torah-oriented life and following ratzon Hashem.

Bio: Moshe attended Rutgers University before starting his career in finance. A survivor of the 9/11 attacks, Moshe’s unwavering emunah has always brought him closer to Hasham. Moshe is now an entrepreneur and owns Jump into Shape, a connected fitness program focused on jumping rope and leading a healthy lifestyle. He learns at Heichal in the mornings in Rabbi Kestenbaum’s shiur. He lives in Bergenfield with his wife Michele and four children.

On December 24, 2019, Dr. Joe and Lori Rozehzadeh dedicated the brand new Bais Medrash Zichron Dovid that the Bais Medrash talmidim learn in. Joe, a Torah visionary from West Orange, dedicated the beautiful Bais Medrash in memory of his father Dovid. “Everything about this represents who my father was and what he believed in. My father would have delighted in the chance to see young men learning Torah in an open environment where they are free to pursue their Judaism and spiritual growth,” Joe said. Lori was also involved in every aspect of the project and supervised every detail of the construction of the new Bais Medrash. e Rozehzadeh Bais Medrash provides a beautiful new learning space for Talmidim to focus on their learning. ‫ויש לומר בדעת הרמב"ם‪ ,‬דיש לו שיטה אחרת בהבנת‬ ‫המצוה של חרוסת‪ .‬דעיין בפרק ז' הלכה יא' ז"ל "חרוסת‬ ‫מצוה מדברי סופרים וכו' וכיצד עושים אותו וכו' ומביאין‬ ‫אותו על השלחן בלילי פסח"‪ .‬ויש לדייק בדבריו שלא כתב‬ ‫הרמב"ם כלל דיש מצוה לאכול החרוסת‪ ,‬אלא דיש להביאה‬ ‫על השלחן‪ .‬ויש לומר דסובר הרמב"ם דגם לפי ר' אלעזר ברבי‬ ‫צדוק אין המצוה לאכול החרוסת אלא דהמצוה נתקיימה בזה‬ ‫דהוה על השלחן‪.‬‬

‫ויש לעיין מה הגדר של המצוה של חרוסת לפי ר' אלעזר ברבי‬ ‫צדוק‪ ,‬ואם ההלכה כמותו‪.‬‬ ‫סתירה בדברי הרמב"ם‬ ‫ועיין ברמב"ם בפירוש המשניות שכתב דיש נ"מ בין הת"ק‬ ‫ור' אלעזר ברבי צדוק לענין הברכה‪ .‬דלפי ר' אלעזר ברבי‬ ‫צדוק דהוה מצוה‪ ,‬יש לברך על החרוסת "אקב"ו על אכילת‬ ‫חרוסת"‪ .‬אבל לפי הת"ק דאינו מצוה אין החרוסת טעון ברכה‪.‬‬ ‫וסיים שם על דברי ר' אלעזר ברבי צדוק "ואינה הלכה"‪.‬‬ ‫אבל עיין ברמב"ם הלכות חמץ ומצה (ז‪:‬יא) שכתב "החרוסת‬ ‫מצוה מדברי סופרים זכר לטיט שהיו עובדין בו במצרים"‪.‬‬ ‫דהיינו שפסק הרמב"ם כר' אלעזר ברבי צדוק דחרוסת הוה‬ ‫מצוה‪ .‬נמצא דיש סתירה בדברי הרמב"ם‪ .‬דבפירוש משניות‬ ‫פסק הרמב"ם כהת"ק וביד החזקה פסק כר' אלעזר ברבי‬ ‫צדוק‪. .‬‬ ‫ועיין בלחם משנה שביאר שחזר הרמב"ם ביד ממה שכתב‬ ‫בפירוש המשניות ופסק כר' אלעזר ברבי צדוק (וכן ביארו רוב‬ ‫המפרשים)‪ .‬ועיין שם בלחם משנה שהקשה "ומ"מ צריך לתת‬ ‫טעם למה אין מברכין עליו כמו שכתב בפירוש המשנה וכו'‬ ‫"‪ .‬דהיינו דבפירוש המשניות כתב הרמב"ם דלפי ר' אלעזר‬ ‫ברבי צדוק‪ ,‬יש לברך על החרוסת‪ .‬ובהלכות חמץ ומצה פסק‬ ‫הרמב"ם לפי ר' אלעזר ברבי צדוק‪ ,‬ומ"מ לא הביא דיש לברך‬ ‫על החרוסת‪ .‬והניח בצ"ע‪.‬‬ ‫אופן קיום המצוה ‪ -‬אכילה או להביאה על השלחן‬ ‫ויש להקדים דיש לעיין מה הוא אופן קיום מצות חרוסת‪.‬‬ ‫וכפשוטו המצוה בחרוסת הוא לאכלה‪ ,‬ודרך אכילתה הוא‬ ‫ע"י שטובלים המרור בה ואכלים אותם ביחד‪ .‬והבנה זו‬ ‫באמת מבוארת בהטור (ובכמה ראשונים)‪ .‬דעיין שם (ס'‬

‫ישוב לקושיית הלחם משנה‬ ‫ולפי זה יש ליישב קושיית הלחם משנה‪ .‬דזה דיש לברך על‬ ‫החרוסת הוא רק אם יש מעשה מצוה‪ .‬ובשלמא אם המצוה היא‬ ‫האכילה יש לברך על החרוסת "אקב"ו על אכילת חרוסת"‪.‬‬ ‫אבל אם המצוה מתקיימת בזה דיש חרוסת על השלחן אין‬ ‫שום מעשה מצוה ואינו טעון ברכה‪ .‬ושמחתי שמצאתי דכן‬ ‫ביאר השם יוסף בדעת הרמב"ם (מובא ב"מפרשי יד החזקה‬ ‫להרמב"ם") לתרץ קושית הלחם משנה‪.‬‬ ‫אבל עדיין צ"ע דאע"פ שיש סברא דאין לברך על החרוסת כיון‬ ‫דאין מעשה מצוה‪ ,‬מ"מ הרמב"ם בעצמו בפירושו למשניות‬ ‫כתב דלפי ר' אלעזר ברבי צדוק יש לברך ומבואר שהרמב"ם‬ ‫חולק על סברא זו‪.‬‬ ‫חזרת הרמב"ם‬ ‫ויש לאמר דחזר הרמב"ם משני דברים מפירוש המשניות‬ ‫ליד‪ .‬דכבר הבאנו דהלחם משנה כתב דחזר בענין ההלכה‪.‬‬ ‫דבפירוש המשנה פסק כהת"ק וביד חזר לפסוק כר' אלעזר‬ ‫ברבי צדוק ויש לאמר דהרמב"ם גם חזר בעיקר הבנת שיטת‬ ‫ר' אלעזר ברבי צדוק‪ .‬דעיין בפירוש משניות שכתב הרמב"ם‬ ‫דהברכה היא "אקב"ו על אכילת חרוסת"‪ ,‬ומבואר‪ ,‬דבפירושו‬ ‫למשניות סובר הרמב"ם דלר' אלעזר ברבי צדוק המצוה היא‬ ‫לאכול החרוסת‪ ,‬וא"כ יש מעשה מצוה ויש לברך עליו‪ .‬אבל‬ ‫ביד חזר מזה וסובר דהמצוה נתקיימת בזה דהוה על השלחן‬ ‫ולכן סובר הרמב"ם דאין לברך עליו‪.‬‬ ‫המנהג של ר' יחיאל‬ ‫ולפי יסוד זה יש להבין המנהג של ר' יחיאל‪ .‬דעיין בההגהות‬ ‫מיימוני (פרק ז אות ט') שכתב ד"בירושלמי אמרינן דצריך‬ ‫לקלושיה זכר לדם‪ .‬ופ' רבינו יחיאל דהא והא איתא בתחילה‬ ‫עושים אותו עב בשעת עשייתו‪ ,‬ובשעת טבול מקלשין אותו‬ ‫ביין או בחומץ ועושין אותו דק כמין דם"‪ .‬דהיינו דבירושלמי‬ ‫יש מחלוקת אם יש לעשות החרוסת עב זכר לטיט או דק‬ ‫זכר לדם‪ .‬ור' יחיאל כתב דיש לקיים שניהם‪ ,‬ומתחילה עושים‬ ‫אותה עב‪ ,‬ולפני האכילה מוסיפים יין ועושים אותה דק‪.‬‬ ‫(ומנהג זה מובא בתוס' בפסחים קטז‪ .‬ד"ה צריך‪).‬‬ ‫וכפשוטו קשה להבין מה מרויחים בזה דמתחילה עושים‬ ‫אותה עב‪ .‬הלא בשעת הזכר‪ ,‬דהיינו הטיבול והאכילה‪ ,‬הוה‬ ‫דק ומה הנ"מ דבסדר עשייתו היתה פעם עב‪ .‬גם יש לעיין‬ ‫‪heichalbm.org‬‬

‫למה הביא ההגהות מיימוני דמוסיפים יין דוקא באמצע הסדר‬ ‫הלא אפילו אם יש מעלה בזה דהוה פעם עב יש לעשות הכל לפני‬ ‫הסדר‪ ,‬דהיינו לעשותה מתחילה עב ואחר כך להוסיף יין ולהביאה‬ ‫להסדר דק (וכמו שבאמת משמע בהטור)‪.‬‬ ‫ולפי יסוד הנ"ל מובן שפיר‪ .‬דיש קיום בהזכר של עב דהיינו לטיט‬ ‫בזה דהוה על השלחן‪ .‬ולכן מתחילה עושים אותה עב והוה על‬ ‫השלחן ונתקיים הזכר לטיט לפי מ"ד אחד‪ ,‬ואחר כך מוסיפים יין‬ ‫או חומץ ומקיים המצווה לפי המ"ד דהוה זכר לדם‪.‬‬ ‫הטור והרמב"ם לשיטתם‬ ‫נמצא לפי דברינו דיש מחלוקת יסודית בין הרמב"ם והטור בהבנת‬ ‫מצות חרוסת‪ .‬דהטור סובר דהמצוה הוא אכילת חרוסת ולפי‬ ‫הרמב"ם המצוה הוא להביאה על השלחן‪ .‬ויש להוסיף דהטור‬ ‫והרמב"ם הם לשיטתם בזה בהרבה ענינים‪.‬‬ ‫כבר הבאנו דשיטת הרמב"ם היא דטובלים הכרפס בחרוסת‪.‬‬ ‫והקשה עליו הטור דאין לעשות כן דצריך אכילה לתיאבון‪ .‬ולפי‬ ‫הנ"ל מחלוקת זו היא לשיטתם‪ ,‬דלפי הרמב"ם אין בחרוסת מצות‬ ‫אכילה ולא שייך כלל אכילה לתיאבון‪ .‬אבל הטור קאי לשיטתו‬ ‫דיש מצוה לאכול החרוסת ולכן יש לאוכלה לתיאבון‪ .‬ולכן סובר‬ ‫הטור דאין לטבול הכרפס בחרוסת דא"כ אוכלים החרוסת לפני‬ ‫הקיום מצוה‪.‬‬ ‫ועיין עוד בטור ס' תעה שכתב טעם למה אין מברכים על החרוסת‪.‬‬ ‫וזה גם לשיטתו דיש מעשה מצוה של אכילה ויש לדון אם מברכים‬ ‫עליו‪.‬‬ ‫ועיין עוד שם שכשהביא הטור שיטת ר' יחיאל כתב "דהא והא‬ ‫איתא‪ ,‬מתחילה עושין אותו עבה ואחר כך מרככין אותה בחומץ‪".‬‬ ‫ולא הביא כלל דעושין זה מיד לפני הטיבול‪ ,‬ומשמע דרק בסדר‬ ‫הכנתו עושים אותה בב' שלבים‪ .‬ולשיטתו מובן שפיר דאין שום‬ ‫זכר של החרוסת לפני הטיבול ולכן אין נ"מ אם הריכוך נעשה‬ ‫לפני הסעודה או באמצע‪.‬‬ ‫חרוסת זכר לטיט או זכר למרירות‬ ‫ויש לפרש דמחלוקת זו בין הרמב"ם והטור תלוי' במחלוקת אחרת‪.‬‬ ‫דעיין בטור ס' תעג שכתב "וחרוסת הוא זכר לטיט שהיו אבותינו‬ ‫משתעבדין בו‪ ,‬לכך צריך לעשותו עב זכר לטיט ומדברים חמוצים‬ ‫זכר למרור"‪ .‬ומבואר מדבריהם דחוץ מהזכר לטיט יש ענין של‬ ‫זכר למרור בהחרוסת‪ .‬ועיין בדרישה שביאר דאע"פ שלא נמצא‬ ‫כן בגמרא‪ ,‬בהרי"ף‪ ,‬או בהאשר"י‪ ,‬מ"מ קשה ליה להטור דאם הוא‬ ‫רק זכר לטיט‪ ,‬למה צריך להחמיצה‪ .‬אלא מוכרח לאמר דיש גם‬

‫ענין בהחרוסת זכר למרור‪.‬‬ ‫אבל עיין ברמב"ם הנ"ל שאינו משמע דסובר דיש זכר למרירות‬ ‫בהחרוסת‪ ,‬שכתב רק דהיא זכר לטיט‪ .‬וזה דכתב הרמב"ם דצריך‬ ‫לשים חומץ בחרוסת יש לפרש על פי המרדכי בשם הערוך (מובא‬ ‫בב"ח או"ח ס' תעג אות ד') דיש להוסיף "כל מיני מתוקין ומרורין‬ ‫וחומץ כמו הטיט שיש בו כל דבר"‪.‬‬ ‫נמצה דיש מחלוקת בין הרמב"ם והטור בהזכר של החרוסת‬ ‫דלפי הרמב"ם הוא רק זכר לטיט ולפי הטור הוא זכר לטיט וגם‬ ‫למרירות‪.‬‬ ‫הטור והרמב"ם לשיטתם‬ ‫ולפי זה יש להבין למה הטור והרמב"ם חולקים באופן קיום המצוה‪.‬‬ ‫דעיין בהדרישה הנ"ל שכתב "ומשום הכי טובלים בו המרור שהוא‬ ‫זכר לוימררו"‪ .‬דהיינו דטעם דיש לטבל המרור בחרוסת הוא רק‬ ‫משום דסובר הטור דיש בחרוסת זכר למרירות‪.‬‬ ‫וא"כ מובן שפיר למה לפי הרמב"ם אין לטבול המרור בחרוסת‬ ‫ושלא כדעת הטור‪ .‬דהרמב"ם סובר דכל הזכר של החרוסת הוא‬ ‫לטיט ואין שום זכר למרירות‪ ,‬וא"כ אינה קשור להמרור ואין סיבה‬ ‫לטבול המרור בה‪( .‬וזה דבאמת טובלים המרור בה י"ל דהוא‬ ‫רק משום קפא גם לפי ר' אלעזר ברבי צדוק ואכמ"ל)‪ .‬משא"כ‬ ‫הטור סובר דיש זכר בחרוסת למרירות ולכן צורת המצוה בה הוא‬ ‫אכילתה עם המרור‪.‬‬ ‫הזכר לטיט הוא שנראה על השלחן והזכר למרירות לאכול‬ ‫הטעם המר‬ ‫ויש להוסיף הסבר בהמחלוקת‪ .‬דלפי הרמב"ם דהזכר הוא לטיט‬ ‫יש להבין בסברא דלא רק דאין צורת המצוה עם המרור אלא שאין‬ ‫שום קשר לאכילה כלל‪ .‬דהלא אין אוכלים טיט‪ .‬וכל הזכר הוא בזה‬ ‫שנראה כטיט ונתקיים הזכר בזה דהוה על השלחן‪ .‬אבל לפי הטור‬ ‫דהוה זכר למרור זה נתקיים ע"י הטעם המר וזה ע"י אכילה‪ .‬ומובן‬ ‫שפיר יסוד המחלוקת בין הרמב"ם והטור בגדר מצות חרוסת‪.‬‬

‫אדם מעיז‪ ,‬היה לנו להאמינו באותה טענה גופה שהוא טוען‪.‬‬ ‫ותירץ דתוס’ אזלי לשיטתם לעיל דסברי דפטור של כופר‬ ‫הכל אינו תלוי כל כולו במעיז ואינו מעיז‪ ,‬דהא אפי’ בבנו‬ ‫דמעיז פטור בכופר הכל‪ ,‬והסיקו שם התוס’ דפטור כופר בכל‬ ‫הוא מגזה”כ של “כי הוא זה”‪ ,‬ולכן בעי מיגו דאי בעי כופר‬ ‫הכל‪ .‬אך יש להעיר בדברי המהרש”א‪ ,‬דאפשר דסברי התוס’‬ ‫דחזקה אין אדם מעיז שפיר יכול לפטור‪ ,‬אלא בבנו דלא שייך‬ ‫האי טעמא בעי עוד טעם דמ”כי הוא זה” משמע דגזה”כ הוא‬ ‫דדוקא מודה במקצת הטענה חייב‪ ,‬ולא כופר הכל‪ .‬ועיין לקמן‬ ‫באות ז’ במה שכתבתי ביסוד החילוק בין כופר הכל ומודה‬ ‫במקצת‪.‬‬ ‫ה) בתוד”ה בכולה הק’ הא בכופר הכל נמי אשתמוטי‬ ‫כדאמרינן בפרק שבועת הדיינין ולכך התקינו שבועת היסת‪,‬‬ ‫ותי’ התוס’ דמ”מ העזה יש יותר בכופר הכל מבכופר חצי‬ ‫וליכא מיגו‪ .‬ונראה דתוס’ אזלי לשיטתם בזה דשייך סברת‬ ‫אישטמוטי אפילו בכופר הכל‪ ,‬דעיין לקמן דף ו‪ .‬שהק’ הגמ’‬ ‫מהא דרב נחמן דמשביעין לכופר הכל שבועת היסת‪ ,‬נימא‬ ‫מיגו דחשיד אממונא חשיד אשבועתא‪ .‬ופירש רש”י שם‬ ‫דחשיד אממונא דמעיז פניו לכפור הכל לאו לאשתמוטי‬ ‫בעי‪ ,‬והק’ התוס’ הא ודאי אשתמוטי כמבואר בפרק שבועת‬ ‫הדיינין‪ .‬ופירשו התוס’ דקו’ הגמ’ היא משבועת היסת על‬ ‫פקדון דליכא למימר מישתמט‪ ,‬דשייך מישטמיט רק בזוזי‬ ‫דלא הוו בעין‪ ,‬ואפ”ה התקינו רבנן שבועת היסת‪ .‬ומבואר‬ ‫דשיטת התוס’ הוא דכופר הכל שפיר איכא למימר מישתמיט‪.‬‬ ‫וצ”ע בדעת רש”י שסבר דליכא למימר מישתמט בכופר הכל‬ ‫(וכן הוא שיטת רש”י בדף ג‪ .‬ד”ה דליכא)‪ ,‬הרי מבואר דכל‬ ‫תקנת שבועת היסת הוא משום דבכופר הכל מישתמיט‪ ,‬ועי’‬ ‫ברמב”ן (ו‪ ).‬שתירץ דכשאמר הגמ’ דאשתמוטי הוא דקא‬ ‫משתמיט‪ ,‬אין הכוונה דהנתבע רוצה לפרוע לאחר זמן רק‬ ‫דעכשיו אין לו המעות‪ ,‬אלא הכוונה היא דיש עזי פנים דמתוך‬ ‫דוחקם אינם רוצים לשלם לבע”ח כלל‪ .‬וממילא החזקה דאין‬ ‫אדם תובע אלא א”כ יש לו אלימא מחזקה דאין אדם מעיז‬ ‫פניו בפני בעל חובו‪ ,‬ולכך נתקן שבועת היסת כי היכי דלודי‪.‬‬ ‫ולפ”ז באמת כל כופר הכל חשיד אממונא דאין כוונתו לשלם‬ ‫לאחר זמן‪ ,‬ע”ש בדברי הרמב”ן (וקצת צ”ע דרש”י גורס בגמ’‬ ‫בשבועות עד דהוו ליה זוזי ופרענא ליה)‪.‬‬ ‫ו) הנה נחלקו הקצות (לד‪:‬ד) ומהר”ן לב ביסוד דינא דהודאת‬ ‫בעל דין כמאה עדים דמי‪ .‬המהר”ן לב סובר דהפסול של‬ ‫נוגע בעדות הוא משום דאדם קרוב אצל עצמו ואינו יכול לא‬ ‫לזכות ולא לחוב לעצמו‪ ,‬וא”כ הא דמהני הודאת בעל דין הוא‬ ‫מתורת חיוב ומתורת מתנה כאילו אומר חייב אני לך מנה‬ ‫– מדין “התחייבות”‪ .‬והקצות סובר דאע”פ שנוגע ג”כ פסול‬ ‫משום קרוב‪ ,‬מ”מ פסול כשר להעיד היכא דהעדות שייכת‬ ‫רק לעצמו ולא לאחרים‪ .‬וא”כ יש לו נאמנות לחוב לעצמו‬ ‫דלא העיד על אחרים‪ ,‬והודאת בעל דין הוא מדין “נאמנות”‪.‬‬ ‫ושיטת הקצות מבוססת על דברי רש”י בקידושין סה‪ :‬ד”ה‬ ‫הודאת בעל דין כמאה עדים – “דכתיב אשר יאמר כי הוא‬ ‫זה‪ ,‬הרי שסמך על מקצת הודאתו”‪ .‬והקצות הקשה כמה‬ ‫קושיות על שיטת המהר”ן לב מתוך סוגיין‪ :‬חדא‪ ,‬דאיתא‬ ‫בגמ’ ופיו אין מחייבו ממון‪ ,‬והא הודאת בעל דין כמאה עדים‬ ‫דמי — וממילא פיו חמור כמו עדים‪ .‬ולפי שיטת המהר”ן לב‬ ‫צ”ע‪ ,‬באמת בפיו ליכא נאמנות כמו עדים אלא דיכול לחייב‬ ‫ממון מדין התחייבות אבל עדים עדיין יותר חמורים מפיו לענין‬ ‫נאמנות‪ .‬ועוד במהשך הגמ’ מה לפיו שכן אינו בהכחשה‬

‫ובהזמה תאמר בעדים שישנן בהכחשה ובהזמה‪ ,‬וממילא‬ ‫פיו יותר חמור מעדים‪ ,‬והק’ הקצות איך זה חומרא לפיו‪ ,‬הא‬ ‫כיון דפיו מהני מדין התחייבות‪ ,‬לא שייך הכחשה והזמה כלל‪,‬‬ ‫ולענין נאמנות אדרבא עדים חמירי מפיו‪ .‬ועוד הקשה הקצות‬ ‫מעיקר הדין של מודה במקצת‪ ,‬דהא דבר פשוט הוא אם אדם‬ ‫כופר הכל ורק מחייב עצמו בחמשים מדין מתנה ודאי ליכא‬ ‫שבועת מודה במקצת‪ ,‬וא”כ לפי המהר”ן לב דהודאת בעל‬ ‫דין הוא משום התחייבות‪ ,‬כל מודה במקצת הוי כאילו כפר‬ ‫בכל ורק מחייב עצמו בממון אחר‪ ,‬ואיך שייך שבועת מודה‬ ‫במקצת כל עיקר‪.‬‬ ‫ונראה להציע מהלך ליישב דעת המהר”ן לב איך שייך שבועת‬ ‫מודה במקצת אם הודאת בעל דין הוא משום התחייבות‪.‬‬ ‫דהנה כתב בתוס’ הרא”ש דף ג‪ :‬וז”ל‪“ ,‬מודה במקצת שיש לו‬ ‫אצלו ממון‪ ,‬אגב אותו ממון חייבתו תורה שבועה כעין גלגול”‪,‬‬ ‫ע”ש‪ .‬ונראה דלפי התוס’ הרא”ש איכא הבנה חדשה בשבועת‬ ‫מודה במקצת‪ ,‬והיינו דמחמת אותו ממון שהודה בו נעשית‬ ‫דררא ורגלים לדבר לחייבו בשבועה על השאר‪ .‬לשון התוס’‬ ‫הרא”ש הוא “כעין גלגול” דכיון שהודה קצת נראה דמשקר‬ ‫ולכך יש שבועה על מה שכפר (עיין תוד”ה הצד דף ד‪ .‬ולקמן‬ ‫אות ז)‪ .‬וא”כ היכא דמודה במקצת הטענה‪ ,‬אע”פ דהחמשים‬ ‫שהודה בו חייב משום התחייבות ולא משום נאמנות‪ ,‬אפ”ה יש‬ ‫לומר דחיוב זו‪ ,‬כיון דבא מחמת טענת התובע‪ ,‬נראה דטענתו‬ ‫היא טענה חשובה וחייבתו תורה לישבע על השאר‪.‬‬ ‫ז) בסוף הסוגיא מסקינן דחיוב שבועה של העדאת עדים‬ ‫נלמד מצד השוה מפיו ועד אחד‪ ,‬שעל ידי טענה וכפירה הם‬ ‫באין ונשבע‪ ,‬ובתוד”ה הצד השוה הק’‪ ,‬וא”ת כופר הכל יוכיח‬ ‫שע”י טענה וכפירה פטור‪ ,‬ותי’ דהצד השוה שבהן יש טענה‬ ‫חשובה דכשמודה במקצת או עד מכחישו נראה דמשקר‪,‬‬ ‫ולכך יש שבועה‪ .‬ושיטת התוס’ היא על פי דרך תוס’ הרא”ש‬ ‫הנ”ל שכתב דחיוב שבועת מודה במקצת הוא כעין גלגול‬ ‫שחייבתו תורה שבועה מחמת אותו ממון שהודה לו‪[ .‬וקצת‬ ‫צ”ע‪ ,‬דלפ”ז למה בעי תוס’ לעיל ג‪ .‬כשדנים בפטור כופר‬ ‫הכל כתבו דמ”כי הוא זה” משמע דגזירת הכתוב הוא דדוקא‬ ‫מודה במקצת חייב ולא כופר הכל‪ ,‬וצ”ע למה בעי גזיה”כ‬ ‫לפטור כופר הכל הא ליכא טענה חשובה‪ ,‬ויש ליישב‪ ].‬וידוע‬ ‫לדקדק בדברי רש”י ד”ה טענה וכפירה שכתב “זה טוען וזה‬ ‫כופר הן באין לדין”‪ ,‬משמע דלא בעי טענה חשובה רק זה‬ ‫טוען וזה כופר‪ .‬אמנם לפי זה חזרה קושית התוס’ למקומה‪,‬‬ ‫הא כופר הכל יוכיח דזה טוען וזה כופר ופטור משבועה‪.‬‬ ‫ונראה ליישב דהנה שיטת רש”י בב”ק דף קז‪ .‬הוא דכופר‬ ‫הכל בפקדון באמת חייב שבועה כיון דאדם מעיז בפקדון‪,‬‬ ‫רק במלוה פטור דאין אדם מעיז פניו בפני בעל חובו‪ .‬ושאר‬ ‫ראשונים חולקים על רש”י וס”ל דליכא שבועה בכופר הכל‬ ‫בפקדון‪ ,‬דכיון שלא הודה במקצת ליכא טענה חשובה‪ .‬וא”כ‬ ‫י”ל לדעת רש”י דאין הכי נמי מעיקר הדין‪ ,‬הטענה וכפירה‬ ‫יכולים לחייב שבועה על כופר הכל‪ ,‬ולכך כופר הכל בפקדון‬ ‫חייב שבועה‪ ,‬רק היכא דאיכא חזקה דאין אדם מעיז‪ ,‬זה פוטר‬ ‫משבועה‪( .‬אלא דלפ”ז צ”ע בדעת רש”י למה פטור משבועה‬ ‫היכא שכפר הכל בבנו של המלוה כמבואר בשבועות דף מב‪,.‬‬ ‫הו”ל להיות כפקדון דאיכא טענה וכפירה וליכא חזקה דאין‬ ‫אדם מעיז‪ ,‬ויש ליישב ואכ”מ‪).‬‬

‫בענין שבועת‬ ‫מודה במקצת‬

‫א) איתא בגמ’ (ב”מ ג‪-.‬ג‪):‬‬ ‫תני רבי חייא מנה לי בידך‬ ‫והלה אומר אין לך בידי‬ ‫כלום והעדים מעידים אותו‬ ‫שיש לו חמשים זוז נותן לו‬ ‫חמשים זוז וישבע על השאר‬ ‫שלא תהא הודאת פיו גדולה‬ ‫מהעדאת עדים מק”ו ותנא‬ ‫תונא שנים אוחזין בטלית זה‬ ‫אומר אני מצאתיה וכו’ והא‬ ‫הכא כיון דתפיס אנן סהדי‬ ‫דמאי דתפיס האי דידיה הוא‬ ‫ומאי דתפיס האי דידיה הוא‬ ‫וקתני ישבע מאי שלא תהא‬ ‫הודאת פיו גדולה מהעדאת‬ ‫עדי’ מק”ו שלא תאמר‬ ‫הודאת פיו הוא דרמיא רחמנא שבועה עליה כדרבה דאמר רבה‬ ‫מפני מה אמרה תורה מודה מקצת הטענה ישבע חזקה אין אדם‬ ‫מעיז פניו בפני בע”ח והאי בכוליה בעי דנכפריה והא דלא כפריה‬ ‫משום דאין אדם מעיז פניו והאי בכוליה בעי דלודי ליה והאי דלא‬ ‫אודי אשתמוטי הוא דקא מישתמט מיניה סבר עד דהוו לי זוזי‬ ‫ופרענא ליה ואמר רחמנא רמי שבועה עליה כי היכי דלודי ליה‬ ‫בכוליה אבל העדאת עדים דליכא למימר הכי אימא לא קמ”ל ק”ו‪,‬‬ ‫עכ”ד הגמ’‪ .‬מבואר בגמ’ דכמו דאיכא שבועה דאורייתא של מודה‬ ‫במקצת הטענה כך אם כפר בכל הטענה אלא שעדים מעידים‬ ‫שחייב במקצת ג”כ חייב שבועה על השאר‪ .‬ולמסקנת הגמ’ דין זה‬ ‫נלמד מצד השוה משבועת עד אחד ומודה במקצת (אמנם הר”ן‬ ‫כתב דבאמת נלמד משבועת גלגול דעד אחד ומודה במקצת‪,‬‬ ‫ע”ש)‪ .‬בתחילת הסוגיא איכא כמה דקדוקים ומחלוקות בדברי‬ ‫הראשונים בהבנת דברי הגמ’ ורציתי לבאר דבריהם ולהעיר כמה‬ ‫הערות‪.‬‬ ‫ב) מבואר בגמ’ דבעי ילפותא לדינא של ר’ חייא‪ ,‬דסד”א דדוקא‬ ‫מודה במקצת הטענה ישבע ולא העדאת עדים משום דרבא‪,‬‬ ‫דאמר רבא מפני מה אמרה תורה מודה במקצת הטענה ישבע‬ ‫– וכתב רש”י (ד”ה מפני) ולא חשבו כמשיב אבידה לפטרו שלא‬ ‫כפר בכולו‪ ,‬דהיינו כל מודה במקצת הו”ל להיות פטור משבועה‬ ‫כמו כל משיב אבידה‪ .‬והק’ הרמב”ן הא משיב אבידה פטור מפני‬ ‫תיקון העולם כדתנן בריש פרק הניזקין המוצא מציאה לא ישבע‬ ‫מפני תיקון העולם‪ ,‬והכא בדיני דאורייתא עסקינן — “מפני מה‬ ‫אמרה תורה”‪ .‬והפני יהושע כתב דרש”י לא רצה לפרש דהוי‬ ‫סתם מיגו דאי בעי כפר הכל דסבר דמיגו לאפטורי משבועה לא‬ ‫אמרינן‪ ,‬אבל עדיין קושית הרמב”ן במקומה עומדת דהפטור של‬ ‫משיב אבידה מהני רק מתקנת חכמים‪ .‬ובשיטה מקובצת הביא‬ ‫ממורו הרב דב’ מיני מוצא מציאה איכא‪ ,‬היכא דליכא דטעין ליה‬ ‫[כמו הגמ’ בגיטין נא‪ ,:‬מנה לאביך בידי והאכלתיו פרס‪ ,‬דחכמים‬

‫אומרים שפטור משבועה משום משיב אבידה דליכא דטעין ליה]–‬ ‫אז פטור משבועה מן התורה‪ ,‬והיכא דאיכא דטעין ליה חייב מן‬ ‫התורה ופטרוהו רבנן מפני תיקון העולם‪ .‬והק’ השיטה ע”ז‪ ,‬הא‬ ‫הכא מיירי בדאיכא דטעין ליה‪ ,‬ע”ש‪ .‬ונראה ליישב דקודם דידעה‬ ‫הגמ’ חזקה אין אדם מעיז פניו בפני בע”ח‪ ,‬היכא דאדם כפר‬ ‫בכולו נחשב כאילו ליכא תביעה כלל‪ .‬וביאור הדברים הוא דכיון‬ ‫דאדם מעיז פניו בפני בע”ח‪ ,‬מהיכא תיתי דצריך להתייחס כלל‬ ‫לטענת התובע‪ .‬והיכא דאדם טוען להד”ם לטענת התובע ליכא‬ ‫שום דררא ורגלים להתובע‪ ,‬א”כ בהו”א של הגמ’ היכא דמודה‬ ‫במקצת‪ ,‬נחשב כמשיב אבידה בלי שום טענה ממש כאילו מנה‬ ‫לאביך בידי והאכלתיו פרס דנחשב כמשיב אבידה‪.‬‬ ‫ג) לעומת שיטת רש”י‪ ,‬כתבו התוס’ דמודה במקצת יהא נאמן‬ ‫במיגו דאי בעי כפר הכל‪ ,‬ולא כתבו דמשום משיב אבידה הו”א‬ ‫דפטור‪ .‬ומבואר דשיטת התוס’ היא דאמרינן מיגו לאפטורי‬ ‫משבועה‪ ,‬וכן היא שיטת התוס’ לקמן דף צז‪ :‬שהק’ לשיטת רב‬ ‫ושמואל דלא אמרינן מתוך שאינו יכול לישבע משלם‪ ,‬מודה‬ ‫במקצת אמאי ישבע‪ ,‬יהא נאמן במגו דאי בעי אומר איני יודע‪,‬‬ ‫ובכה”ג פטור משבועה דאינו יכול לכפור טענת התובע‪ ,‬וגם לא‬ ‫אמרינן מתוך שאינו יכול לישבע משלם‪ .‬ותירצו התוס’ דאין אדם‬ ‫טוען ברצון איני יודע‪ .‬ומבואר דסברי התוס’ דאמרינן מגו לאפטורי‬ ‫משבועה‪ .‬על כל פנים מבואר לשיטת התוס’ דאע”ג דבעלמא מגו‬ ‫מהני לאפטורי משבועה הכא דהוי מגו דהעזה‪ ,‬דאין אדם מעיז‬ ‫פניו בפני בע”ח‪ ,‬לא מהני‪ .‬והנה איתא בגמ’ בבא בתרא דף לו‪.‬‬ ‫בסוגיא דהנהו עיזי דאכלו חושלא דיכול לטעון עד כדי דמיהן במגו‬ ‫דאי בעי אמר לקוחות הן בידי וטענת לקוחות הן בידי הוי העזה‪,‬‬ ‫דחבירו מכיר בשקרו‪ ,‬וא”כ מוכח דמהני מגו דהעזה ולמה לא‬ ‫מהני הכא מיגו דהעזה לפטור משבועת מודה במקצת‪ .‬ונאמרו‬ ‫בזה כמה תירוצים בראשונים‪ .‬וידוע לבאר החילוק על פי דברי ר’‬ ‫אלחנן זצ”ל דכתב דאיכא ב’ דינים במגו‪ ,‬א’ הוא בירור אמיתות‬ ‫הטענה דאנן סהדי דמה שאומר הוא אמת‪ ,‬וכלשון הגמ’ מה לו‬ ‫לשקר‪ .‬ב’ הוא מדיני זכותי הטענה ודין נאמנות היכא דאיכא‬ ‫טענה אחרת שיכול לזכות בו‪ ,‬ואז זוכה בטענה עצמה שהוא טוען‪.‬‬ ‫וא”כ במגו דהעזה ליכא הבירור של מה לו לשקר דהא אדם אינו‬ ‫רוצה לשקר בהעזה‪ ,‬אבל עכ”פ כיון דבטענה אחרת יכול לזכות‬ ‫בו עדיין איכא כח הטענה לזכות בדין‪ .‬וא”כ להחזיק ממון כמו‬ ‫בהנהו עיזי מספיק במגו דהעזה אע”ג דהוי רק כח הטענה‪ ,‬אבל‬ ‫לפטורי משבועה כיון דבעי בירור באותו טענה שהוא טוען להיות‬ ‫במקום השבועה‪ ,‬לא מספיק במגו דהעזה דליכא בירור דאנן‬ ‫סהדי שאומר אמת‪.‬‬ ‫ד) בהמשך הגמ’ “והאי בכוליה בעי דלודי ליה” נחלקו הראשונים‬ ‫במאי הוקשה להגמ’ דצריך לתרץ והאי בכוליה וכו’‪ .‬רש”י‬ ‫כתב דכיון דכפר במקצת אמרינן דמגו דחשיד אממונא חשיד‬ ‫אשבועתא‪ ,‬וע”ז תירצה הגמ’ דאשתמוטי הוא דקא מישתמט‪,‬‬ ‫וכוונת הנתבע לפרוע לאחר זמן‪ ,‬ולא חשיד אממונא‪ .‬והק’ בתוס’‬ ‫דהא מסקינן לקמן (דף ו‪ ).‬דחשיד אממונא לא חשיד אשבועתא‬ ‫(ועיין בראשונים על אתר שתירצו דרש”י קאי אליבא דשיטת‬ ‫אביי לקמן דסבר דסיבת שבועת המשנה הוא משום דחיישינן‬ ‫שמא ספק מלוה ישנה יש לו עליו‪ ,‬ודלא כר’ יוחנן דס”ל דשבועת‬ ‫המשנה הוא משום חשד של הולך ותוקף בטליתו של חבירו‪,‬‬ ‫ובאמת לפי אביי אמרינן מגו דחשיד אממונא חשיד אשבועתא‪,‬‬ ‫ע”ש)‪ .‬ותוס’ פירשו דהוקשה לגמ’ דאחר שידעה הגמ’ חזקה‬ ‫אין אדם מעיז‪ ,‬למה ישבע‪ ,‬והא נאמן במגו דאי בעי כופר הכל‪.‬‬ ‫כלומר‪ ,‬אין זה עדיין מגו דהעזה דשתי הטענות הוו העזה בשווה‪.‬‬ ‫ותירצה הגמ’ דאשתמוטי וכו’ וטענת מודה במקצת אינה העזה‪.‬‬ ‫והק’ המהרש”א למה בעי לאתויי עלה משום מגו‪ ,‬הא כיון דאין‬

‫בה כאחותך שאסורה לך (רש”י)] עכ”ל‪ .‬אלא שרב ספרא דורש‬ ‫עוד שעל תקרי ושננתם אלא אי קרינן נמי ושלשלתן שזה האופן‬ ‫להגיע להוראה ברורה כאחותו שאסורה‪.‬‬ ‫לפי”ז שיטת ר”ת מובנת בפשיטות‪ ,‬שאף שלא יהיה ‘בקי בתנ”ך‬ ‫ומשניות’ דרך לימוד הבבלי בלבד אבל עיקר חיובו של ידיעת‬ ‫התורה הוא להגיע לחידוד ההלכה ולזה צריך לדעת שורש הדין‬ ‫ומקורו במקרא ומשנה ולזה סגי בתלמוד בבלי הבלולה מכל‬ ‫ומפרשת כל הלכה ממקורה‪.‬‬ ‫ועיין ברמב”ם בהלכות ת”ת (פ”א הי”א – הי”ב) שכתב וז”ל וחייב‬ ‫לשלש את זמן למידתו‪ ,‬שליש בתורה שבכתב‪ ,‬ושליש בתורה‬ ‫שבעל פה‪ ,‬ושליש יבין וישכיל אחרית דבר מראשיתו ויוציא דבר‬ ‫מדבר וידמה דבר לדבר ויבין במדות שהתורה נדרשת בהן עד‬ ‫שידע היאך הוא עיקר המדות והיאך יוציא האסור והמותר וכיוצא‬ ‫בהן מדברים שלמד מפי השמועה‪ ,‬וענין זה הוא הנקרא [תלמוד]‪.‬‬ ‫כיצד היה בעל אומנות והיה עוסק במלאכתו שלש שעות ביום‬ ‫ובתורה תשע‪ ,‬אותן התשע קורא בשלש מהן בתורה שבכתב‬ ‫ובשלש בתורה שבעל פה ובשלש אחרות מתבונן בדעתו להבין‬ ‫דבר מדבר‪ ,‬ודברי קבלה בכלל תורה שבכתב הן ופירושן בכלל‬ ‫תורה שבעל פה‪ ,‬והענינים הנקראים פרדס בכלל [התלמוד]‬ ‫הן‪ ,‬במה דברים אמורים בתחלת תלמודו של אדם אבל כשיגדיל‬ ‫בחכמה ולא יהא צריך לא ללמוד תורה שבכתב ולא לעסוק‬ ‫תמיד בתורה שבעל פה יקרא בעתים מזומנים תורה שבכתב‬ ‫ודברי השמועה כדי שלא ישכח דבר מדברי דיני תורה ויפנה כל‬ ‫ימיו [לתלמוד] בלבד לפי רוחב שיש בלבו ויישוב דעתו עכ”ל‪ .‬הרי‬ ‫שהרמב”ם חולק על ר”ת ופוסק שיש חיוב בפנ”ע לדעת את כל‬ ‫התורה שבכתב ושבע”פ ולכן כתב לנהוג לשלש ממש עד שיהא‬ ‫בקי בהם‪ .‬וכבר הבאנו שהמחבר פסק כדברי הרמב”ם אבל‬ ‫הרמ”א הביא את דברי ר”ת ושכן מנהג הישיבות‪.‬‬ ‫ב‬ ‫אמנם יש להדגיש‪ ,‬שלפי”ז כל המחלוקת בין הרמב”ם ולבין ר”ת‬ ‫הוא בגדר החיוב מקרא ומשנה‪ ,‬שלרמב”ם הם חיובים בפנ”ע‬ ‫ולר”ת הם רק חלק ממה שצריכים להגיע להלכה הברורה בסוף‪.‬‬ ‫אבל בענין גדר תלמוד אין כאן מחלוקת‪ .‬והוא מש”כ הרמב”ם‬ ‫ושו”ע הנ”ל וז”ל ושליש יבין וישכיל אחרית דבר מראשיתו ויוציא‬ ‫דבר מדבר וידמה דבר לדבר ויבין במדות שהתורה נדרשת בהן‬ ‫עד שידע היאך הוא עיקר המדות והיאך יוציא האסור והמותר‬ ‫וכיוצא בהן מדברים שלמד מפי השמועה‪ ,‬וענין זה הוא הנקרא‬ ‫[תלמוד] עכ”ל‪ .‬הרי שגם הרמב”ם כתב שגדר התלמוד הוא ‘עד‬ ‫שידע האסור והמותר וכו’ כלומר ההוראה הברורה‪ .‬וכן מפורש‬ ‫בגמ’ ברכות (דף ה‪ ).‬וז”ל ‪ :).‬ואמר רבי לוי בר חמא אמר רבי שמעון‬ ‫בן לקיש מאי דכתיב ואתנה לך את לחת האבן והתורה והמצוה‬ ‫אשר כתבתי להורותם‪ ,‬לחות אלו עשרת הדברות תורה זה מקרא‬ ‫והמצוה זו משנה אשר כתבתי אלו נביאים וכתובים להורותם‬ ‫זה תלמוד וכו’ [פי’ רש”י (שם)‪ :‬סברת טעמי המשניות שממנו‬ ‫יוצאה הוראה] עכ”ל‪ .‬וכ”כ הג”ר חיים מוואלאזין בהקדמה לביאור‬ ‫הגר”א וז”ל ומכ”ש שלא להזניח ח”ו את לימוד התלמוד הקדוש‬ ‫המביא לידי מעשה וזה כל פרי לימוד הש”ס להוציא ממנו הלכה‬ ‫למעשה וכו’ עכ”ל ‪.‬‬

‫ד”ה גמרא כו’ עכ”ל‪ .‬וכוונתו לגמ’ קידושין (דף מט‪ ):‬וז”ל על מנת‬ ‫שאני חכם‪ ,‬אין אומרים כחכמי יבנה כר’ עקיבא וחביריו‪ ,‬אלא‬ ‫כל ששואלים אותו דבר חכמה בכל מקום ואומרה [פירש רש”י‬ ‫– דבר חכמה‪ ,‬מילתא דתליא בסברא] עכ”ל‪ .‬וכעי”ז ברש”י במס’‬ ‫סוכה (שם) שפירש ‘תלמוד’ של רבי יוחנן בן זכאי וז”ל תלמוד ‪ -‬זו‬ ‫היא סברא‪ ,‬שהיו התנאים אחרונים מדקדקים בדברי הראשונים‬ ‫הסתומים לפרשם וליתן בהן טעם‪ ,‬כמו שעשו האמוראים אחר‬ ‫התנאים שפירשו דברי התנאים שלפניהן וקבעו בהן גמרא‪ ,‬ואותו‬ ‫דיוק שבימי התנאים נקרא תלמוד עכ”ל‪.‬‬ ‫נמצאנו למדים שלמוד התלמוד הוא הסברא‪ .‬ואופן ברור הסברא‪,‬‬ ‫הוא על ידי ‘דקדוק בדברי הראשונים לפרשם וליתן בהן טעם’‬ ‫(כמש”כ רש”י) ו’להבין ולהשכיל אחרית דבר מראשיתו ולהוציא‬ ‫דבר מדבר וכו’ עד שידע עיקר המדות [ובטור ושו”ע כתבו עיקר‬ ‫המצות] והאיך יוצא האסור והמותר (כמש”כ הרמב”ם)‪ .‬והיינו‬ ‫על ידי דקדוק ופירוש דברי הקדמונים ועל ידי ברור הנושאים‬ ‫בשלמותם‪ .‬וכל זה בכלל מצות ושננתם‪ ,‬דהיינו ‘שיהו דברי תורה‬ ‫מחודדים בפיך שאם ישאל לך אדם דבר אל תגמגם ותאמר לו אלא‬ ‫אמור לו מיד’ (קידושין דף ל‪ .).‬שעל ידי שלוש הלמוד מהמקורות‬ ‫שבכתב ושבע”פ‪ ,‬ועל כולם הסברא הנכונה יכול להורות בלי‬ ‫גמגום‪ .‬וזה בדיוק הוא דרך העיון הנהוג הישיבות‪.‬‬ ‫והנה גרסינן בפ”ק דמגילה (דף יא‪ ).‬וז”ל במתניתא תנא‪ :‬לא‬ ‫מאסתים ‪ -‬בימי כשדים‪ ,‬שהעמדתי להם דניאל חנניה מישאל‬ ‫ועזריה‪ ,‬ולא געלתים ‪ -‬בימי יוונים‪ ,‬שהעמדתי להם שמעון‬ ‫הצדיק‪ ,‬וחשמונאי ובניו‪ ,‬ומתתיה כהן גדול‪ ,‬לכלותם ‪ -‬בימי‬ ‫המן‪ ,‬שהעמדתי להם מרדכי ואסתר‪ ,‬להפר בריתי אתם‪ - ,‬בימי‬ ‫[רומיים]‪ ,‬שהעמדתי להם של בית רבי וחכמי דורות וכו’ עכ”ל‪.‬‬ ‫הרי לקיום הברית המיוחדת שיש לכלל ישראל עם ה’‪ ,‬העמיד‬ ‫לנו הרבש”ע חכמי המסורה ללמדנו תורה ודרכי העבודה‪ .‬וזה‬ ‫בכלל הפסוק שאנו אומרים בכל יום ‘ואני זאת בריתי אותם אמר‬ ‫ה’ רוחי אשר עליך ודברי אשר שמתי בפיך לא ימושו מפיך ומפי‬ ‫זרעך ומפי זרע זרעך אמר ה’ מעתה ועד עולם (ישעיה נט‪ ,‬כא)‪.‬‬ ‫דבר זה נמשך בכל דור ודור – עד הדור שלנו‪ ,‬וכמו שמובא בשם‬ ‫החזו”א שהיה אומר ‘העמדתי להם של בית רבי וחכמי הדורות ‪-‬‬ ‫הא לכם קצות החושן הא לכם רע”א’‪ ,‬והג”ר שמואל אויערבאך‬ ‫זצ”ל היה עונה ואומר אחריו ‘הא לכם רבנו חיים הלוי הא לכם‬ ‫חזו”א’‪ .‬אלו הם חכמי המסורה שלמדו לנו דרכי לימוד התוה”ק‪,‬‬ ‫ודרך הישיבות מתנהל עפ”י רוחם‪ .‬החזו”א זצ”ל נטה יותר לדרך‬ ‫‘דקדוק בדברי הראשונים הסתומים לפרשם וליתן בהם טעם’‬ ‫וחיזק את הלומדים בזה‪ ,‬והגר”ח הלוי זצ”ל נטה יותר לדרך‬ ‫‘להבין ולהשכיל אחרית דבר מראשיתו ולהוציא דבר מדבר וידמה‬ ‫דבר לדבר’ וזה עיקר שיטת לימודו שכבשה את כל עולם התורה‪.‬‬ ‫ודוקא בדרך זה אפשר לבוא להלכה ברורה וקיום מצות ושננתם‬ ‫בשלימותה שיהו דברי תורה מחודדים בפיך שאם ישאלך אדם‬ ‫דבר אל תגמגם ותאמר לו אלא אמור לו מיד‪.‬‬

‫ג‬ ‫וליתר ביאור בענין דרך הלימוד והעיון‪ ,‬עיין בביאור הגר”א (שם‬ ‫סקי”ד) שהביא מקור דברי הרמב”ם בביאור ‘שליש בתלמוד’ וז”ל‬ ‫(יד) דהיינו שיבין כו’‪ .‬שם שאני חכם כו’ וערש”י בסוכה כ”ח א’‬

‫שבכה”ג אמרי’ דכבר נגמרה שליחות הכתיבה אחר הכתיבה‬ ‫ותו אין השליחות בעולם לבטלה למפרע‪ .‬ולכן נקט דוקא שליחות‬ ‫אחת של כתבו ותנו‪ ,‬בזה י”ל שכל שלא נתנו עדיין לא נגמר‬ ‫השליחות ויכול לבטלו‪.‬‬ ‫אבל צ”ע דלכאורה הם שני שליחויות נפרדות ומה נ”מ מזה שלא‬ ‫נתן עדיין הרי לכאורה שליחות הכתיבה כבר נגמרה ושליחות‬ ‫הנתינה שהוא לכאורה ענין בפנ”ע‪ .‬ואולי י”ל שבזה מודה לסברת‬ ‫התוס’ שהנתינה הוא גמר הכתיבה ולכן חשוב לשליחות אחת‬ ‫שעדיין בעולם‪.‬‬ ‫ועוד יל”פ עפ”י דברי הנתיבות הידועים (סי’ רמ”ג סק”ו) שהקשה‬ ‫איך שייך שליחות של כתבו ותנו למ”ד דלא שייך שליחות של‬ ‫כתבו וזכו דאין מינוי על דבר שלא בא לעולם‪ .‬וז”ל והא דמהני‬ ‫השליחות בגט לומר כתבו ותנו [גיטין ס”ה ע”ב] ועושה אותן‬ ‫שלוחין על הנתינה אף שעדיין לא נכתב‪ ,‬הוא מטעם דעשאן [ל]‬ ‫שלוחין להיות כבעל‪ ,‬דשלוחו של אדם כמותו ונעשה כבעל ממש‬ ‫לגרש האשה כאילו היא אשתו‪ ,‬והאשה היא בעולם עכ”ל‪ .‬וכן כתב‬ ‫בספרו תורת גיטין (ריש פ”ג) וז”ל במשנה קול סופרים מקרין‪.‬‬ ‫לכאורה תמוה להך דיעה דס”ל דבעינן שליחות בכתיבה דוכתב‬ ‫דקרא אבעל קאי אם כן למה נקט במשנה הטעם הפסול משום‬ ‫שנכתב שלא לשמה היה לו למינקט טעם הפסול משום שלא‬ ‫נכתב בשליחות הבעל וכו’ ונראה ליישב דמשכחת גוונא שיפסול‬ ‫משום שלא לשמה אף שנכתב בשליחות הבעל כגון שהבעל עשה‬ ‫שליח לסופר לגרש אשתו שיכתוב ויתן והרי נעשה הסופר כהבעל‬ ‫עצמו ובודאי אם הבעל עצמו כתב גט שלא לשמה ואח”כ נמלך‬ ‫לגרש אשתו בזה ודאי דהי’ כשר אלו הי’ שלא לשמה כשר בגט‬ ‫כיון שהבעל כתבו א”כ ה”נ אם כתב מי שהוא נעשה שליח לגרש‬ ‫אשת חבירו שנעשה ממש כהבעל עצמו ודאי דאפי’ כתב גט‬ ‫שלא לשמה ואח”כ גירש בו ג”כ כשר אי אמרי’ דא”צ לשמה בגט‬ ‫דכשכתבו כבר נעשה בעל ודינו כבעל עצמו ולכך נקט המשנה‬ ‫הטעם דשלא לשמה משום האי גוונא עכ”ל‪ .‬ולפי”ז בכתבו ותנו‬ ‫הוי שליחות אחת של עמידה במקום הבעל לגירושין‪ .‬ולכן אמרינן‬ ‫שכל שלא נתן עדיין השליחות קיימת ואפשר לבטלו למפרע‪.‬‬

‫בענין שליש‬ ‫במקרא שליש‬ ‫במשנה ושליש‬ ‫בתלמוד ומנהג‬ ‫לימוד הישיבות‬ ‫הרב יצחק רייכמאן‪ ,‬מגיד שיעור‬ ‫היכל התורה‪ ,‬בית מדרש‬

‫א‬ ‫גרסינין בפ”ק דקידושין‬ ‫(דף ל‪ ).‬וז”ל אמר רב ספרא‬ ‫משום ר’ יהושע בן חנניא‪,‬‬ ‫מאי דכתיב‪ :‬ושננתם‬ ‫לבניך? אל תקרי ושננתם‬ ‫אלא ושלשתם‪ ,‬לעולם‬ ‫ישלש אדם שנותיו‪ ,‬שליש‬ ‫במקרא‪ ,‬שליש במשנה‪,‬‬ ‫שליש בתלמוד‪ .‬מי יודע‬ ‫כמה חיי? לא צריכא ‪-‬‬ ‫ליומי‪ .‬עכ”ל‪ .‬וכתבו התוס’‬ ‫(שם ד”ה ליומי) דהיינו דכל‬ ‫יום ויום ישלש וכן נפסק‬ ‫להלכה ברמב”ם (פ”א‬ ‫מהל’ ת”ת הי”א) ובטור‬ ‫ושו”ע יו”ד (סי’ רמ”ו ס”ד)‪ .‬אמנם עיי”ש בסוף דברי התוס’ שכתבו‬ ‫וז”ל ור”ת פי’ שאנו סומכין אהא דאמרינן בסנהדרין (דף כד‪).‬‬ ‫בבל בלולה במקרא במשנה ובגמרא דגמרת בבל בלול מכולם‪.‬‬ ‫עכ”ל‪ .‬ומובא להלכה ברמ”א ביו”ד (שם) וז”ל וי”א שבתלמוד בבלי‬ ‫שהוא בלול במקרא‪ ,‬במשנה וגמרא‪ ,‬אדם יוצא ידי חובתו בשביל‬ ‫הכל‪( .‬טור בשם ר”ת) עכ”ל‪ .‬וכידוע שכן מנהג הישיבות שלומדים‬ ‫תלמוד בבלי כל היום‪ .‬ועלינו להבין יסוד הדברים‪.‬‬ ‫והנה כבר העירו רבים‪ ,‬איך שייך לקיים חובת מקרא ומשנה‬ ‫בתלמוד בבלי הרי פשוט שאין זה דרך לקנות ידיעה ברורה בכל‬ ‫התנ”ך ובכל המשניות אם רק לומדם פה ושם בתוך בלילת‬ ‫הבבלי‪ ,‬ונאמרו בזה כמה תירוצים ‪.‬‬ ‫ונראה לפרש עפ”י דברי הפנ”י בסוגיא‪ .‬שכתב וז”ל אמר רב‬ ‫ספרא משום ר”י בן חנניה מאי דכתיב ושננתם לבניך אל תיקרי‬ ‫ושננתם אלא ושלשתם כו’‪ .‬נראה לי לפרש לפי פשוטו משום‬ ‫דמלשון ושננתם ילפינן בסמוך שיהיו דברי תורה מחודדין בפיך‬ ‫והיינו מדלא כתיב ולמדתם אלא ושננתם שהוא לשון שינון ולשון‬ ‫משנה וא”כ תו לא מצינן למימר דלא איירי קרא אלא בתורה‬ ‫שבכתב כדכתיב לעיל מיניה והיו הדברים האלה דהיינו בהווייתן‬ ‫דלא שייך שינון וחידוד אלא בתורה שבעל פה שהיא משנה וגמרא‬ ‫דאין מורין הלכה מתוך המשנה וא”כ שפיר קאמר דאי אפשר‬ ‫לקרות ושננתם אלא אי קרינן נמי ושלשתם שאי אפשר שיהא‬ ‫הדבר ברור לו כאחותו אא”כ בקי במקרא ובמשנה ובגמרא עכ”ל‪.‬‬ ‫ומבואר מדבריו‪ ,‬שעיקר החיוב של ושננתם הוא הדרשה שבסוף‬ ‫הסוגיא שם וז”ל תנו רבנן‪ :‬ושננתם ‪ -‬שיהו דברי תורה מחודדים‬ ‫בפיך‪ ,‬שאם ישאל לך אדם דבר ‪ -‬אל תגמגם ותאמר לו‪ ,‬אלא‬ ‫אמור לו מיד‪ ,‬שנאמר‪ :‬אמור לחכמה אחותי את וגו’ [שתהא בקי‬

‫ועיין בתוס’ בגיטין שם (ד”ה רב ששת) שהקשו על רב ששת‬ ‫דסובר אינו חוזר ומגרש בו וז”ל תימה והא ריש לקיש ור’ יוחנן‬ ‫דפליגי בריש האומר בקידושין (דף נט‪ ).‬משמע דמודו דלא אתי‬ ‫דיבור ומבטל מעשה כמו שמוכיח שם ממתני’ דכל הכלים יורדים‬ ‫לידי טומאה במחשבה כו’ וכתיבת גט לשמה הוי מעשה דאם כתב‬ ‫אדם ס”ת לשמה אינו יכול לחזור ולבטל עכ”ל‪ .‬ומבואר בקושייתם‬ ‫דלא מקשים על עצם המושג של ביטול גט כשר שלא יוכל לגרש‬ ‫בו עוד אלא מקשים דזה הוי בגדר אתי דיבור ומבטל מעשה דכו”ע‬ ‫מודי כדמוכח ממתני’ בדכל הכלים ומהמשל בס”ת‪ .‬והיינו דאם‬ ‫היה מ”ד שיכול להוציא כלי מידי טומאה במחשבה ודיבור‪ ,‬היה‬ ‫ניחא דעת ר”ש דיכול להוציא גט מהכשירו במחשבה ודיבור‪.‬‬ ‫שכמו שמפקיע השם כלי יפקיע השם לשמה מהגט‪ .‬אבל מכיוון‬ ‫שמוכח במתני’ דכלים דאינן עולים מידי טומאתן במחשבה דלא‬ ‫אתי דיבור ומבטל מעשה (ולא מיבעי היכי דירדו ע”י מעשה אלא‬ ‫אפי’ בירדו ע”י מחשבה נמי לא‪ ,‬משום דרחמנא קרייה מעשה‬ ‫כדאיתא בקידושין נט‪ ):‬ה”ה איך שייך להפקיע השם לשמה מהגט‬ ‫אחר שכבר נעשה ע”י מעשה כתיבה לשמה‪ .‬וכמו שבס”ת שכבר‬ ‫נכתב לשמה א”א להפקיע את השם לשמה כיון שכבר נעשה ע”י‬ ‫מעשה כתיבה לשמה‪.‬‬ ‫ותירצו בתוס’ וז”ל וי”ל דכל זמן שלא הגיע ליד האשה לא חשיב‬ ‫גמר מעשה עכ”ל‪ .‬כלומר ששאני גט מס”ת‪ .‬בס”ת המעשה נגמר‬ ‫בכתיבה לשמה משא”כ בגט אין כאן גמר מעשה עד שינתן‪,‬‬ ‫ולכן עדיין יכול לבטל את הלשמה‪ .‬וצ”ב מה ענין הנתינה לחלות‬ ‫הלשמה‪ ,‬הרי אע”ג שאין כאן חלות גירושין עד שינתן אבל הביטול‬ ‫כאן הוא על הלשמה של הגט שלא יוכל לחזור ולגרש בו‪ ,‬ולכאורה‬ ‫אף בגט חלות השם לשמה כבר נגמרה בשעת הכתיבה‪ .‬ועל‬ ‫כרחנו אנו צריכים לומר בדעת התוס’ דחלות הלשמה בגט שונה‬ ‫מחלות הלשמה בס”ת‪ ,‬ובגט אין גמר לחלות הלשמה עד שינתן‬ ‫ולכן עדיין נחשב בגדר של דיבור ואפשר לבטלו‪ .‬וצ”ב‪.‬‬ ‫ולכאורה אפשר לפרש‪ ,‬שבלשמה דגט שמיוחד לגירושין של‬ ‫אשה זו י”ל שייחוד זה נגמר בנתינה והקנאה לה‪ .‬וכמו הלשון‬ ‫בכל מקום ‘הא גיטך’ – היינו הגט שלך‪ ,‬דבנתינה לה נעשה שלה‬ ‫לגמרי‪ .‬ובאמת זה חידוש לקשר את הייחוד של לשמה לייחוד‬ ‫של קנין ונתינה דמסברא הו”א שהם שני עניינים נפרדים‪ ,‬ומצד‬ ‫הלשמה הכל נגמר בכתיבה לבד‪ .‬אמנם עיין בירושלמי גיטין (פ”ו‬ ‫ה”א) וז”ל התורה זיכת אותה בגיטה והיא עושה שליח לקבל‬ ‫דבר שהוא שלה עכ”ל‪ .‬וכפשוטו משמע שהתורה זיכתה לה‬ ‫אף קודם הנתינה (ולכן זה מועיל שתוכל לעשות שליח לקבלה‬ ‫כבעל הממון) ומשמע שהכוונה לדין לשמה‪ ,‬אבל נאמרו עוד כמה‬ ‫מהלכים בירושלמי עיין בהערה ‪.‬‬ ‫ולפני כעשרים שנה (בקיץ תשס”א) בלמדי מסכת גיטין בישיבה‬ ‫שער התורה גרודנה אצל מו”ר הג”ר קלמן עפשטיין שליט”א‬ ‫שמעתי עוד שני צדדים בביאור דין כתיבה לשמה שלפיהם לכאורה‬ ‫אפשר להבין את דברי התוס’ כאן שהלשמה נגמר בנתינה‪.‬‬ ‫מהלך אחד אמר‪ ,‬שיסוד דין לשמה הוא שעצם מעשה הכתיבה‬ ‫הוא חלק מהמגרש‪ ,‬שהגירושין נעשה על ידי ‘וכתב לה ונתן בידה’‬ ‫ואין הכתיבה רק הכנת הגט בלבד‪ .‬לפי”ז ביאר את שיטת הרא”ש‬ ‫שכתב בסדר הגט וז”ל והסופר יתן הקלף והדיו במתנה לבעל‬ ‫דבעינן וכתב ונתן שיהא הגט שלו עכ”ל וביאר הב”י (סי’ ק”כ)‬ ‫וז”ל כלומר כדרך בני אדם שכותבין בדבר שהוא שלהם עכ”ל‪.‬‬ ‫וקשה להבין יסוד דין זה שיכתוב כדרך אדם הכותב בשלו אם לא‬ ‫שנאמר שזה כבר חלק מהמגרש ולכן זה צורת הגירושין שיהיה‬ ‫כדרכו‪ .‬עכ”ד‪ .‬ואם נאמר כן שכתיבה הוא חלק מהמגרש א”כ‬ ‫פשוט שזה מצריך לשמה ובודאי הנתינה הוא גמר הדבר שהוא‬ ‫סוף הגירושין‪ .‬ומבוארים דברי התוס’ לפנינו‪ .‬אמנם כל זה שייך‬ ‫רק לראשונים דוכתב אבעל קאי אבל הרי תוס’ עצמם כתבו לעיל‬ ‫(דף כב‪ :‬ד”ה והא) בשם הר”י דלא בעינן שליחות בכתיבה דוכתב‬ ‫לאו אבעל קאי אלא אסופר‪ ,‬וא”כ בודאי אין זה חלק מהמגרש‬ ‫אלא הכנת הגט בעלמא ורק הנתינה פועלת הגירושין והדרא‬

‫קושיין לדוכתא‪.‬‬ ‫עוד צד שמעתי ממנו‪ ,‬שיסוד דין לשמה הוא קביעות פירוש המלות‬ ‫של הגט‪ .‬שהכוונה לשמה בשעת הכתיבה קובעת הוראת הכתב‬ ‫ד’פלוני’ הוא הבעל הזה‪‘ ,‬ופלונית’ הוא האשה הזאת וכו’‪ .‬ועל‬ ‫פי זה ביאר את דברי התוס’ לעיל (דף יט‪ .‬ד”ה דיו) בשם הר”י‬ ‫דבנכתב שלא לשמה ומעביר עליו קולמוס שכתב הראשון היה‬ ‫שלא לשמה וכתב השני עושהו לשמה חשיב כתב לרבי יהודה‬ ‫ולרב אחא אפילו לרבנן חשיב כתב גבי גט‪ ,‬אבל בלא”ה אם אינו‬ ‫מתקן כלום אמרי’ דיו ע”ג דיו אינו כתב‪ .‬וצ”ב מה השייכות בין‬ ‫לשמה לעיקר שם כתיבה‪ .‬ולפי”ז ניחא שלשמה היינו שקובע‬ ‫דברים חדשים – מי הוא ‘פלוני’ וכו’ וזה עיקר ענין כתיבה שכותב‬ ‫דברים עם מובן מסויים‪ .‬עכ”ד‪ .‬ועפי”ז ביאר עוד כמה שיטות‬ ‫וחילוקים לעיל בפרק שני בסוגיא דכתב ע”ג כתב‪ ,‬ואכמ”ל‪ .‬ולפי”ז‬ ‫י”ל שהדברים נגמרים בשעת נתינתם‪ .‬לא מיבעי לפי מה דקי”ל‬ ‫עדי מסירה כרתי שרק נעשה שטר וסיפור דברים של כריתות‬ ‫בשעת נתינה‪ ,‬בודאי גמר קביעות המובן של הגט הוא בנתינה‪.‬‬ ‫אלא אפילו למ”ד עדי חתיחה כרתי שסובר שהספר כריתות נגמר‬ ‫בשעת חתימה מ”מ י”ל שגמר הדברים הם בנתינה‪ .‬שהרי הגט‬ ‫הוא דיבורו של בעל (אפי’ אם וכתב אסופר קאי אמנם בעי ציווי‬ ‫הבעל והכל כתוב בלשון הבעל אנא פלוני וכו’) והוא מדבר לאשתו‬ ‫(כלשון הכתוב בגט – הרי את מותרת) וזה מתחיל בכתיבה‬ ‫לשמה ונגמר בנתינתו שאז מדבר לה‪ .‬ומבוארים דברי התוס’ דעד‬ ‫הנתינה לא חשיב גמר מעשה ללשמה‪ ,‬שלשמה הוא גדר בדיבורו‬ ‫בגט שנגמר בנתינה לידה‪.‬‬ ‫ג‬ ‫ועיין בריטב”א בקידושין (דף נט‪ ):‬שהביא קושיא דומה לתוס’ בשם‬ ‫רבו הרא”ה‪ .‬וז”ל וקשיא ליה לרבינו נר”ו היכי קס”ד מעיקרא כלל‬ ‫לדמויי הא דרב נחמן שהגט נכתב ונחתם כראוי ואי אפשר לבטלו‪,‬‬ ‫לחזרת האשה שעדיין לא תפסו בה קידושין ולא נעשה בה שום‬ ‫מעשה אישות‪ ,‬הא לא דמיא הא דרב נחמן אלא לאשה שחזרה‬ ‫בה ואחר כך נתרצתה שיכול הלה לחזור ולקדשה בכסף ההוא‬ ‫בעצמו‪ ,‬ואף על פי שאמרה בפירוש שלא תתקדש לו בכסף ההוא‬ ‫לעולם לאו כל כמינה לבטל הכסף מדין ממון שלא תתקדש בו‬ ‫עכ”ל‪ .‬אמנם אין זה בדיוק קושיית התוס’‪ .‬שהתוס’ הבינו עיקר‬ ‫המושג של ביטול הלשמה ורק הקשו דלא אתי דיבור ומבטל‬ ‫מעשה‪ ,‬אבל הרא”ה מקשה איך בכלל שייך ביטול לשמה שאם‬ ‫כבר נכתב בהכשר אין הלשמה דבר שאפשר להפקיע אלא‬ ‫ממילא כל שנכתב לשמה סגי בזה‪ .‬ואין זה קביעות שם כמו ירידת‬ ‫כלים לטומאתן שיש לדון על הפקעתו אלא הוא מציאות ‪.‬‬ ‫ולתרץ כתב הריטב”א שם וז”ל ותירץ הוא נר”ו דאנן הוה ס”ד דכיון‬ ‫שאמר לעדים מתחלה כתבו וחתמו ותנו ובשליחותו עשאוהו והוי‬ ‫לשמה‪ ,‬דכל כמה דלא מטי גיטא ליד האשה יכול הוא לבטל הגט‬ ‫לומר שתבטל שליחותו למפרע והוי כאילו עשאוהו מדעתם ולא‬ ‫הוי לשמה ופסול‪ ,‬עכ”ל‪ .‬היינו שעיקר ביטול הגט לרב ששת הוא‬ ‫ביטול הציווי למפרע וממילא הוי שלא לשמה‪ .‬וזה חידוש נפלא‬ ‫דאתי דיבור ומבטל דיבור למפרע‪.‬‬ ‫ועיין בספר קובץ שיעורים במס’ ב”ב (אות תמ”א) שהעיר לפי”ז‬ ‫למה משהגיע ליד האשה תו אינו יכול לבטל (מתני’ בריש פירקין)‪,‬‬ ‫הא לפי”ז עיקר הביטול הוא למפרע‪ .‬וז”ל ואין להקשות לדעת‬ ‫[הראשונים] דאפשר לבטל למפרע אם כן יוכל לבטל השליחות‬ ‫גם לאחר שכבר עשה המעשה ונמצא שלא היה שלוחו מעיקרא‪,‬‬ ‫די”ל דלאחר שעשה שליחותו תו ליכא שליחות בעולם ולא שייך‬ ‫לבטל דבר שאינו עכ”ל‪ .‬ובאמת לשון הריטב”א מדוייק כדבריו‪.‬‬ ‫שכתב וז”ל דכיון שאמר לעדים מתחלה כתבו וחתמו ותנו עכ”ל‪.‬‬ ‫וצ”ב למה נקט שאמר לעדים כתבו ותנו ומי לא מצי איירי באמר‬ ‫לעדים כתבו ואמר לאדם אחר להוליכה וליתנה‪ .‬ולפי”ז מובן‪,‬‬ ‫‪heichalbm.org‬‬

‫נר תמיד‪.‬‬ ‫גדר הדלקת נרות דחנוכה‬ ‫אבל לפכ”ז‪ ,‬דנרות המקדש לא הוי הדלקה עושה מצוה אלא הוי‬ ‫דין בלהעלות נר תמיד‪ ,‬דביארנו דהוי דין המשכת הדלקה דאתמול‪,‬‬ ‫יש לעי’ למה נרות חנוכה תיקנו הדלקה עושה מצוה? ויתר על זה‬ ‫יש להקשות‪ ,‬דכל טעם תקנת נר חנוכה משום הנס שע”י שיעור‬ ‫שמן לילה א’ היה נס והמשיך הנרות דלוקים לח’ לילות‪ .‬א”כ היה‬ ‫לחז”ל לתקן נרות חנוכה ממש כעין דין הדלקת נרות המקדש‪,‬‬ ‫ר”ל דין המשכת הדלקה‪ ,‬דהיינו סימן לנס של חנוכה‪ .‬ומאיזה‬ ‫טעם תיקנו נרות חנוכה בדין כהדלקה עושה המצוה?‬ ‫הנה מצינו ב’ דינים בהדלקת נרות מקדש‪ .‬דהק’ המפרשים‬ ‫עוד ב’ קושיות על הרמב”ם דמותר זר להדליק בחוץ‪ .‬חדא‪ ,‬הק’‬ ‫התוספות ישנים והריטב”א ביומא‪ ,‬דאיך כשר הדלקת המנורה‬ ‫בזר‪ ,‬הא איתא בתורה ריש פרשת בהעלותך וז”ל דבר אל אהרן‬ ‫ואמרת אליו בהעלתך את הנרות‪ ,‬ע”כ‪ .‬מבואר דכהן חייב להדליק‬ ‫המנורה‪ .‬ועוד הקש’ המנ”ח (מצ’ צ”ח) וז”ל ובגוף הדין שכתבו‬ ‫הר”מ והראב”ד שאין קפידא שמדליקין חוץ להיכל‪ ,‬תמיה לי’‬ ‫מת”כ מפורש אמור בפ’ יערוך אותם לפני ד’ פ’ שלא יתקן בחוץ‬ ‫ויכניס בפנים והביאו הרמב”ן בפי’ על התורה ואיך חלקו על‬ ‫הברייתא דת”כ וצ”ע‪ ,‬עכ”ל‪ .‬חזינן דמבואר בתורה ובת”כ דבעינן‬ ‫הדלקה ע”י כהן ובעינן הדלקה במקומה בנרות המקדש‪ ,‬איך‬ ‫כתב הרמב”ם דמותר ע”י זר ובחוץ‪.‬‬ ‫ותי’ הצפנת פענח (במדבר עמ’ פ”ז ושו”ת סי’ נ”ב) דמודה הרמב”ם‬ ‫לענין חינוך המנורה דבעי כהן ובעי הדלקת המנורה בפנים‬ ‫במקומה בהיכל‪ ,‬ומש”כ הרמב”ם דמותר בחוץ וע”י זר בהדלקה‬ ‫בכל יום ויום לאחר שכבר מחונכת המנורה‪ .‬וכ”כ החזו”א הנ”ל‬ ‫דבחינוך המנורה אין לקוף לחנך המנורה‪ ,‬ועוד הציע דאפשר דזר‬ ‫חייב על חינוך המנורה דודאי שם ההדלקה הוי עבודה‪ .‬ונראה‬ ‫עוד לחדש דדין כבתה זקוק לה בנרות המקדש לא נאמרה לענין‬ ‫חינוך המנורה‪ ,‬ואם כבתה עדיין מחונכת המנורה‪[ .‬וע”ע רגמ”ה‬ ‫מנחות נ‪ .‬שחינוך המנורה אינו דוחה שבת‪].‬‬ ‫ובביאור הדבר‪ ,‬דאע”פ דנרות המקדש לא ההדלקה מעשה‬ ‫המצוה אלא המשכת ההדלקה דאתמול היא היא המצוה‪ ,‬אבל‬ ‫בחינוך המנורה של המקדש‪ ,‬דהיינו בהדלקה הראשונה של‬ ‫המנורה‪ ,‬ודאי עצם החינוך נעשית ע”י מעשה הדלקה שהיא היא‬ ‫עיקר המעשה עבודה המחנכת‪ .‬דכל עצם ענין של חינוך היא‬ ‫מעשה התחלה דהיינו הדלקה ולא המשכת הנרות של כל יום‬ ‫ויום‪.‬‬ ‫ולפ”ז יש לומר דבאמת מצות נרות במקדש דכל יום ויום אינו‬ ‫הדלקה עושה מצוה‪ ,‬ודוחה שבת ומדליקים מנר לנר לא מדין‬ ‫הדלקה עושה מצוה אלא מדין להעלות נר תמיד‪ ,‬ולכן בעי‬ ‫“תמיד” וממילא כבתה זקוק לה‪ ,‬ולא קפדינן אמקום המנורה‬ ‫בשעת מעשה הדלקה‪ ,‬דמכ”מ מקיים ביה תמיד‪ ,‬ויכול אינו בר‬ ‫חיוב להדליק‪ ,‬דהמשכת ההדלקה מכ”מ כשר‪ .‬אבל בחינוך‬ ‫המנורה ‪ -‬ודאי ההדלקה המעשה המצוה‪ ,‬וכל לילה ולילה אח”כ‬ ‫ממשיך ההדלקה של החינוך‪( .‬אא”כ כל הנרות כבות‪ ,‬וא”כ בעי‬ ‫חינוך או לכל הפחות מעשה הדלקה מחודשת מאש של מזבח‬ ‫העולה‪ ).‬ועפ”ז יש לומר‪ ,‬דלא תיקנו חז”ל מצות נרות חנוכה ע”פ‬ ‫דין נרות המקדש שבכל ערב בין הערבים דהוי דין בלהעלות נר‬ ‫תמיד‪ ,‬דהיינו להמשיך הדלקה דאתמול‪ ,‬אלא תיקנו נרות חנוכה‬ ‫כעין דין חינוך של המנורה‪ .‬הדלקת החשמונאים היתה מדין‬ ‫חינוך המנורה‪ ,‬ובחינוך המנורה ביארנו דמעשה ההדלקה עושה‬ ‫המצוה‪ .‬ולכן בהדלקת נרות חנוכה‪ ,‬בעינן הדלקה במקומה‪,‬‬ ‫בעינן הדלקת בר חיובא וכל שאר דיני הדלקה עושה מצוה‪.‬‬

‫א‬ ‫תנן בריש פרק השולח (דף לב‪ ).‬וז”ל השולח גט לאשתו‪ ,‬והגיע‬ ‫בשליח או ששלח אחריו שליח‪ ,‬ואמר לו גט שנתתי לך בטל הוא‬ ‫ הרי זה בטל; עכ”ל‪ .‬ובגמ’ (דף לב‪ ):‬נחלקו רב נחמן ורב ששת‬‫בביאור המשנה וז”ל חוזר ומגרש בו‪ ,‬או אינו חוזר ומגרש בו‪.‬‬ ‫[פירוש רש”י‪ :‬חוזר ומגרש‬ ‫בו ‪ -‬אם נמלך הבעל לחזור‬ ‫ולגרש בגט שביטלו‪ .‬או אינו‬ ‫חוזר ומגרש ‪ -‬מי אמרינן‬ ‫בטל גיטא והוה ליה כחספא‬ ‫או דילמא שליחותא דשליח‬ ‫הוא דבטיל ליה עד דהדר‬ ‫ומשוי ליה שליח אבל גיטא‬ ‫לא בטיל‪ ].‬רב נחמן אמר‪:‬‬ ‫חוזר ומגרש בו‪ ,‬ורב ששת‬ ‫אמר‪ :‬אינו חוזר ומגרש בו‪.‬‬ ‫והלכתא כוותיה דרב נחמן‪.‬‬ ‫איני‪ ,‬והא קי”ל הלכתא‬ ‫כוותיה דר’ יוחנן‪ ,‬דאמר‪:‬‬ ‫רש”י‪:‬‬ ‫[פירוש‬ ‫חוזרת‪.‬‬ ‫כר’ יוחנן דאמר חוזרת ‪-‬‬ ‫בקדושין בפרק האומר לחברו אמר לאשה התקדשי לי במעות‬ ‫הללו לאחר שלשים וחזרה בה בתוך שלשים בטלו הקדושין הואיל‬ ‫ובטלתן קודם שיהו חלין ה”נ ליבטיל גיטא‪ ].‬הכי השתא‪ ,‬התם‬ ‫דיבור ודיבור הוא‪ ,‬אתי דיבור ומבטל דיבור‪ ,‬והכא נהי דבטליה‬ ‫לשליחותא דשליח‪ ,‬גיטא גופיה מי קא בטיל‪[ .‬פירוש רש”י‪ :‬דיבור‬ ‫ודיבור הוא ‪ -‬מתחילה היתה מתקדשת על ידי הדיבור שנתרצתה‬ ‫בקדושין אתי דיבור של חזרה ומבטל דיבור ומיהו המעות לא בטלו‬ ‫שאם חזר וקדשה בהן מדעתה מקודשת‪ .‬והכא נהי ‪ -‬האי דאמר‬ ‫בטל הוא לשליח הוא דבטליה שלא יהא שלוחו לגרשה בגט זה‬ ‫דאתי דיבור ומבטל דיבור אבל גט שהוא בעין אינו נפסל‪ ].‬עכ”ל‪.‬‬ ‫וכה”ג גרסינן בקידושין (דף נט‪ ):‬וז”ל והילכתא כוותיה דר”י ואפילו‬ ‫בקמייתא‪ ,‬וכו’ אתי דיבור ומבטל דיבור‪ .‬קשיא הילכתא אהילכתא‪,‬‬ ‫אמרת‪ :‬הילכתא כרבי יוחנן‪ ,‬וקיימא לן‪ :‬הילכתא כרב נחמן‪.‬‬ ‫דאיבעיא להו‪ :‬מהו שיחזור ויגרש בו‪ ,‬רב נחמן אמר‪ :‬חוזר ומגרש‬ ‫בו‪ ,‬רב ששת אמר‪ :‬אינו חוזר ומגרש בו‪ ,‬וקיימא לן‪ :‬הילכתא כותיה‬ ‫דרב נחמן‪ .‬נהי דבטליה מתורת שליח‪ ,‬מתורת גט לא בטליה‪.‬‬ ‫עכ”ל‪.‬‬ ‫ב‬

‫גדר מצות נרות במקדש ‪ -‬להעלות נר תמיד‬ ‫ובביאור הדבר‪ ,‬יש לדחוק ראיית המנ”ח שהדלקה עושה מצוה‬ ‫בנרות המקדש משום דדוחה שבת‪ .‬יעויין בחידושי רבינו חיים על‬ ‫הרמב”ם (בביאמ”ק ט‪:‬ו) דדין הדלקה דוחה שבת אינו מדין דהוי‬ ‫עבודה הקבוע לו זמן‪ ,‬ואינו מדין המעשה מצוה של ההדלקה‬ ‫אלא הוי דין גזה”כ נפרד‪ .‬וז”ל הרמב”ם בתמו”מ (ג‪:‬יב) והדלקת‬ ‫הנרות דוחה את השבת ואת הטומאה כקרבנות שקבוע להן זמן‬ ‫שנאמר להעלות נר תמיד‪ ,‬עכ”ל‪ .‬לפ”ד הגר”ח כוונת הרמב”ם‬ ‫דהדלקה “כדין” קרבן שקבוע לו זמן בדין‪ ,‬אבל לא מאותו‬ ‫טעם‪ ,‬דאין הדלקה קרבן הקבוע לו זמן‪ ,‬אלא דנלמד מדין אחר‬ ‫מ”להעלות נר תמיד” שאע”פ שהדלקה אינו ממש קרבן הקבוע‬ ‫לו זמן‪ ,‬מדין גזה”כ ד”תמיד” מדליקין בשבת‪ .‬ובביאור דין זה‪,‬‬ ‫הוסיף הגר”ח‪ ,‬דקרבן הקבוע לו זמן‪ ,‬הכוונה שיש חיוב לעשות‬ ‫המעשה בזמן מפורט בכל יום וא”כ אפי’ בשבת‪ .‬אבל דין תמיד‬ ‫בנרות המקדש היינו שכיון דבעינן שהנרות תהיו מודלקים בכל‬ ‫שעה‪ ,‬ממילא אם כבה‪ ,‬צריך לתקן הדבר ע”י הדלקה אפי’‬ ‫בשבת מדין תמיד‪ .‬אבל אין חיוב בכל ערב ובוקר לעשות מעשה‬ ‫הדלקה‪ .‬עכ”ד הגר”ח‪.‬‬ ‫ונרל”פ כעין מש”כ הגר”ח דנרות המקדש דוחה שבת מדין‬ ‫“להלעות נר תמיד” ולא מדין קרבן הקבוע לו זמן‪ ,‬דאין חיוב‬ ‫מעשה הדלקה בנרות המקדש‪ .‬אבל נרל”פ דדין תמיד בנרות‬ ‫המקדש לא הוי מדין שצריך שתהיו הנרות מודלקים כמש”כ‬ ‫הגר”ח‪ ,‬אלא ביאור אחר‪ .‬יש לעיין בדין מדליקים מנר לנר‬ ‫בנרות המקדש‪ ,‬שהביאנו מהגמ’ לעיל‪ ,‬דדייק המנ”ח שהדלקה‬ ‫עושה מצוה בנרות המקדש‪ .‬ונרל”פ דבנרות המקדש אין היתר‬ ‫שיכולים להדליק נר מנר אלא דהוי דין דבעינן להדליק נר מנר‬ ‫וז”ל הגמ’ מאי עדות אמר רב זו נר מערבי שנותן בה שמן כמדת‬ ‫חברותיה וממנה היה מדליק ובה היה מסיים‪ ,‬עכ”ל‪ .‬ופרש”י‬ ‫ד”ה ובה היה מסיים וז”ל והכי תניא לעיל מיניה להעלות נר‬ ‫תמיד שתהא נר מערבי תמיד שממנו יהא מתחיל ובו יהא מסיים‬ ‫ומדלא כתיב להעלות נרות ש”מ הוקבע נר אחד להתחיל בו‬ ‫בכל יום וזהו נר מערבי‪ ...‬והכי תנן (תמיד לג‪ ).‬נכנס ומצא נרות‬ ‫מזרחים דולקות מדשן המזרחי ומניח את המערבי דולק שממנו‬ ‫מדליק את המנורה בין הערבים מצאו שכבה כגון משמת שמעון‬ ‫הצדיק מדליקו ממזבח העולה ‪ ...‬ובה היה מסיים ההטבה לפי‬ ‫שהשאר היה מטיב שחרית וזו מטיב בין הערבים ואוחז הישנה‬ ‫בידו או מניחה בכלי עד שנותן שמן ופתילה ומדליקה ומדליק‬ ‫ממנה את השאר‪ ,‬ע”כ רש”י‪ .‬וחולק הריב”א בתוס’ שם ד”ה ובה‬ ‫היה מסיים וז”ל אלא בעוד שהפתילה ישנה בנר מערבי דולקת‬ ‫היה מדליק ממנה השאר והיה מטיבה ונותן בה שמן ופתילה‬ ‫חדשה ומדליקה מן השאר ובה היה מסיים היינו ההדלקה‪.‬‬ ‫עכ”ל‪ .‬דעת רש”י שבין הערבים מסירים נר מערבי שדולקת‬ ‫ומשתמשים בו כשמש להדליק כל הז’ נרות‪ ,‬ודעת הריב”א‬ ‫שממקומה ע”י פתילות ארוכות מדליקים כל הו’ שאר הנרות‬ ‫מנר המערבי‪ ,‬ואח”כ מדשן הנר מערבי ומדליקה משאר הנרות‪.‬‬ ‫מבואר דדין “להעלות נר תמיד” הוי דין שמדליקים נרות‬ ‫המקדש דווקא ע”י נר מערבי שנשאר דולק מאתמול או ע”י נס‬ ‫או משום שהדליקה בבוקר שעברה לאחר שכבה‪ .‬אם כבה נר‬ ‫מערבי מדליקים אותה מחדש ממזבח העולה‪ .‬אבל לכתחילה‬ ‫אופן הדלקת הנרות מדין להעלות נר תמיד היינו להמשיך‬ ‫ההדלקה של אתמול שנשאר הנר מערבי דולקת משום נס‬ ‫דעדות ה’‪ .‬ודין זה נלמד מלהעלות נר תמיד‪ .‬בנרות המקדש‬ ‫לא אמרינן שמותר להדליק נר מנר משום חשיבות מעשה‬ ‫ההדלקה‪ ,‬דלא אמרינו דהדלקה הוי המצוה ואין בזיון בהדלקה‬ ‫מנר לנר‪ .‬אלא מחויב להדליק נר מנר במקדש‪ ,‬משום דכן עצם‬

‫מצות ההדלקה‪ ,‬דשאר הנרות הוי המשכת הדלקת אתמול‬ ‫ע”י הדלקה מנר המערבי שבנס או בהדלקה שניה שממשיך‬ ‫ההדלקה של אמתול‪.‬‬ ‫וכן משמע מהרמב”ם דאין דין מעשה הדלקה אלא דין הטבת‬ ‫הנרות להמשיך ההדלקה של אמתול‪ .‬דיעויין ברמב”ם הל’‬ ‫תמו”מ (ג‪:‬יב) וז”ל מהו דישון המנורה? כל נר שכבה מסיר‬ ‫הפתילה וכל השמן שבנר ומקנחו ונותן בו פתילה אחרת ושמן‬ ‫אחר במידה והוא חצי לוג‪ .‬וזה שהסיר משליכו במקום הדשן‬ ‫אצל המזבח עם דישון המזבח הפנימי והחיצון ומדליק נר שכבה‪.‬‬ ‫והדלקת הנרות היא הטבתם‪ .‬ונר שמצאו שלא כבה מתקנו‪,‬‬ ‫ע”כ‪ .‬ודייקו הגרי”ז (בחידושי ליומא כד‪:‬ו ואחרונים אחרים)‪,‬‬ ‫שדווקא כתב הרמב”ם חיוב הטבה והדלקה בנר שכבה‪ .‬אבל‬ ‫אם נר לא כבה‪ ,‬אין חיוב לכבותו לדשנו ולהדליקו מחדש‪ ,‬אלא‬ ‫רק לתקנו ולגרום שימשיך ההדלקה דאתמול‪ .‬ביאה”ד דמצות‬ ‫המנורה רק לגרום המשכת הדלקת אתמול‪ ,‬ולא הוי חיוב‬ ‫מעשה הדלקה בכל בין הערבים‪ .‬אם כבה הנר חייב להדליקו‬ ‫מנר מערבי‪ ,‬ואם כבה נר מערבי בעי הדלקה מחדש ממזבח‬ ‫העולה‪ .‬אבל כל זמן שלא כבה אין חיוב הדלקה‪ ,‬דממילא מקיים‬ ‫ביה דין להעלות נר תמיד‪.‬‬ ‫ועפ”ז יש לומר דנרות המקדש דוחה שבת‪ ,‬לאו משום מעשה‬ ‫הדלקה שבעינן בזמנו בשבת‪ ,‬אלא דא”א לקיים דין תמיד‬ ‫להמשיך הדלקה של אתמול בלי להדליק בשבת‪ .‬וז”ל הרמב”ם‬ ‫בתמו”מ הנ”ל והדלקת הנרות דוחה את השבת ואת הטומאה‬ ‫כקרבנות שקבוע להן זמן שנאמר להעלות נר תמיד‪ .‬דהיינו דין‬ ‫נר מערבי של להעלות נר תמיד שממנה היה מדליק גורם שבכל‬ ‫בין הערבים ממשיכים ההדלקה של אתמול ע”י הטבת והדלקת‬ ‫המנורה‪ ,‬וא”א למהשיך בלי הדלקה בשבת‪ .‬דאם ימתין לאחר‬ ‫שבת‪ ,‬יכבה הנר מערבי של אתמול ויבטל דין תמיד‪ .‬אפל”פ‬ ‫לפי הרמב”ם‪ ,‬דאם כל הנרות היו דולקים‪ ,‬אפשר דאין שום‬ ‫חיוב להדליק‪ ,‬וכל דין ההדלקה בשבת רק להמשיך ההדלקה‬ ‫דאתמול ע”י הדלקת שאר הנרות או להתחיל הדלקה מחדש‬ ‫אם כבה כל הנרות‪.‬‬ ‫ועפ”ז יש להבין ג’ מקורות שמשמע שבנרות המקדש הנחה‬ ‫עושה מצוה‪ :‬א) כבתה זקוק לה‪ ,‬ב) לא בעינן הדלקה במקומה‪,‬‬ ‫ג) ואפי’ קוף יכול להדליק‪ .‬בנרות המקדש כבתה זקוק לה דדין‬ ‫להעלות נר תמיד היינו שיש חיוב להמשיך ההדלקה של אמתול‪.‬‬ ‫דין תמיד בנרות המקדש מחייב להמשיך הדלקה של אתמול‬ ‫כדי להדליק ממנה בבין הערבים הבא‪ .‬ואם כבה‪ ,‬ודאי לא מקיים‬ ‫המצוה להדליק מהמנורה מנרות דאתמול‪ ,‬ע”כ צריך להחזיר‬ ‫ולהדליקה כדי שימשוך דלוק‪( .‬לפי רש”י כל הלילה כתבה זקוק‬ ‫לה‪ ,‬ולהרמב”ם כל לילה ויום‪ ,‬ולרמב”ן רק זקור לנר המערבי‪).‬‬ ‫ועי’ בשפ”א הנ”ל שכל דין כבתה זקוק לה בנרות חנוכה נלמד‬ ‫דין תמיד‪.‬‬ ‫וכן מבואר דעת הרמב”ם דאפי’ מדליק שלא במקומה מקיים‬ ‫מצות הדלקה‪ ,‬דחיוב להדליק לא הוי דין מעשה הדלקה בפנ”ע‬ ‫דבעינן מעשה הדלקה במקומה‪ ,‬אלא ההדלקה הוי קיום‬ ‫בהמשכת ההדלקה של אתמול‪ .‬ע”כ דאם מביא המנורה בחוץ‬ ‫וזר מדליק הנרות מנר המערבי ואח”כ מחזיר המנורה לפנים‪,‬‬ ‫מקיים ביה דין להעלות נר תמיד‪ ,‬המשכת הדלקה של אמתול‪.‬‬ ‫ולפ”ז אפי’ אם הדליקה קוף‪ ,‬עדיין המשיך הדלקה דאתמול‪,‬‬ ‫דלא בעינן בר דעת לעשות מעשה הדלקה‪ ,‬אלא בעינן‬ ‫שהמנורה ממשכת להיות דלוק ע”י הדלקה המנורה מנרות של‬ ‫אתמול‪ .‬וכ”ז שנעשית ההמשכה של הנרות‪ ,‬מקיים דין להעלות‬ ‫‪heichalbm.org‬‬

‫הדלקה עושה‬ ‫בנרות חנוכה‬ ‫איתא בגמ’ שבת (כב‪):‬‬ ‫וז”ל דאיבעיא להו הדלקה‬ ‫עושה מצוה או הנחה‬ ‫עושה מצוה? ומסיקה‬ ‫הגמרא וז”ל ועוד מדקא‬ ‫מברכינן אשר קדשנו‬ ‫במצותיו וצונו להדליק נר‬ ‫של חנוכה ש”מ הדלקה‬ ‫עושה מצוה ש”מ‪ ,‬עכ”ל‪.‬‬ ‫וכמה נפק”מ להלכה‬ ‫נאמרה מהא דגדר מצות‬ ‫נרות חנוכה הוי הדלקה‬ ‫ולא הנחה‪.‬‬ ‫‪1.‬איתא בגמ’ שם דבעינן הדלקה במקום מצוה‪ .‬וז”ל הדליקה‬ ‫בפנים והוציאה לא עשה כלום‪ ,‬ע”כ‪.‬‬ ‫‪2.‬עוד איתא בגמ’ שם דמדליקים מנר לנר וז”ל א”ר הונא‬ ‫בריה דרב יהושע חזינא אי הדלקה עושה מצוה מדליקין‬ ‫מנר לנר‪ ,‬ע”כ‪.‬‬ ‫‪3.‬עוד איתא בגמ’ שם דבעינן הדלקה ע”י בר חיובא‪ .‬וז”ל‬ ‫והשתא דאמרינן הדלקה עושה מצוה הדליקה חרש שוטה‬ ‫וקטן לא עשה ולא כלום‪ ,‬ע”כ‪.‬‬ ‫‪4.‬ויעויין בש”ע תרע”ג ס”ב וז”ל הדלקה עושה מצוה לפיכך‬ ‫אם כבתה קודם שעבר זמנה אין זקוק לה‪ ,‬ע”כ‪.‬‬ ‫‪5.‬עוד איתא בש”ע שם ס”ב‪ :‬וז”ל יש מי שאומר דכיון דהדלקה‬ ‫עושה מצוה צריך שיתן שמן בנר כדי שיעור קודם הדלקה‬ ‫אבל אם בירך והדליק ואח”כ הוסיף שמן עד כדי שיעור לא‬ ‫יצא ידי חובתו‪ ,‬ע”כ‪.‬‬ ‫סתירה בנרות המקדש בענין הדלקה או הנחה עושה מצוה‬ ‫לכ’ נרות חנוכה נתקנה כעין נרות המקדש‪ ,‬וכמש”כ הרשב”א‬ ‫(כא‪ ):‬ד”ה אמר רב ירמיה לענין איסור שימוש בנר חנוכה וז”ל‬ ‫טעמא דמילתא‪ ,‬משום דעל ידי נס שנעשה במנורה תקנו‪,‬‬ ‫והלכך עשאוה כמנורה שאסור להשתמש לאורה‪ ,‬ע”כ‪ .‬א”כ‪,‬‬ ‫לכאורה עצם תקנת חז”ל דנרות חנוכה הדלקה עושה מצוה‪,‬‬ ‫משום דבנרות מקדש הדלקה עושה מצוה‪.‬‬ ‫וכן הוכיח המנ”ח (מצוה צ”ח) מב’ דינים שנרות המקדש הדלקה‬ ‫עושה מצוה‪ .‬וז”ל דאי לאו לא הי’ דוחה שבת דאפשר לעשות‬ ‫קודם השבת להדליקה ובשבת יגביה ויניחנה ומבואר להדיא‬ ‫ברש”י שבת כ”ג ד”ה אי הדלקה עושה מצוה כו’ כדאשכחן‬ ‫במנורה‪ ,‬ע”כ‪.‬‬

‫‪1.‬כתב המנ”ח‪ ,‬חדא‪ ,‬הדלקת נרות במקדש דוחה שבת‪ .‬ואם‬ ‫הנחה עושה מצוה‪ ,‬איך מדליקים בשבת?‬ ‫‪2.‬והביא המנ”ח ראיה שנית מהא דבנרות המקדש מדליקים‬ ‫מנר לנר‪ .‬דאיתא בגמ’ דרב ס”ל דאין מדליקין מנר לנר‬ ‫בנרות חנוכה‪ ,‬וז”ל המשך הגמ’ מתיב רב ששת‪“ :‬מחוץ‬ ‫לפרוכת העדות יערוך וכי לאורה הוא צריך והלא כל‬ ‫ארבעים שנה שהלכו בני ישראל במדבר לא הלכו אלא‬ ‫לאורו אלא עדות היא לבאי עולם שהשכינה שורה בישראל‬ ‫מאי עדות אמר רב זו נר מערבי שנותן בה שמן כמדת‬ ‫חברותיה וממנה היה מדליק ובה היה מסיים‪ .‬ע”כ הגמ’‪.‬‬ ‫חזינן דבנרות המקדש מדליקין מנר לנר‪ .‬ולפמש”כ הגמ’‬ ‫דמדליקים נר מנר תלוי בהדלקה עושה מצוה‪ ,‬א”כ בנרות‬ ‫המקדש ודאי הדלקה עושה מצוה‪ .‬וכ”כ רש”י דנרות‬ ‫חנוכה הדלקה עושה מצוה ומדליקין מנר לנר “כדאשכחן‬ ‫במנורה‪”.‬‬ ‫אבל מצינו ג’ ראיות דהנחה עושה מצוה בנרות המקדש‪:‬‬ ‫‪1.‬יעויין בגמ’ מנחות (פח‪ ):‬דכבתה זקוק לה בנרות המקדש‪.‬‬ ‫ולפמש”כ הגמ’ לעיל‪ ,‬אם אמרינן כבתה זקוק לה ע”כ‬ ‫דהנחה עושה מצוה‪ .‬וכן דייק השפת אמת (שבת כב‪ :‬ד”ה‬ ‫ובגמ’ אר”ה)‪.‬‬ ‫‪2.‬עוד מצינו דרק הנחה עושה מצוה‪ ,‬דאיתא ברמב”ם דיכול‬ ‫להדליק את המנורה בחוץ‪ .‬כתב הרמב”ם פ”ט מהל’‬ ‫ביאהמ”ק ה”ז וז”ל וכן הדלקת הנרות כשירה בזרים‬ ‫לפיכך אם הטיב הכהן את הנרות והוציאן לחוץ מותר‬ ‫לזר להדליקן‪ ,‬עכ”ל‪ .‬והק’ המעשה רוקח דאיתא בגמ’‬ ‫שבת (כב‪ ,):‬דלמד”א הדלקה עושה מצוה בנורת חנוכה‪,‬‬ ‫הדליקה בפנים לא יצא‪ ,‬דבעינן הדלקה במקום מצוה‪.‬‬ ‫וא”כ איך כתב הרמב”ם דיכול להדליק נרות המקדש‬ ‫בעזרה‪ ,‬אם מקום קיום מצות הנרות היא בהיכל שהיא‬ ‫היא מקום המנורה? וז”ל המנ”ח (מצוה צ”ח) וזה כמה‬ ‫שנים הקשיתי עד”ז של הר”מ דאם הוציאן לחוץ מותר זר‬ ‫להדליק הא במנורה ודאי הדלקה עושה מצוה ולא הנחה‬ ‫‪...‬ושם בסוגיא מבואר דאי הדלקה ע”מ הדלקה במקומה‬ ‫בעינן ואי הדליקה מבפנים גבי נ”ח לא עשה כלום ע”ש א”נ‬ ‫כיון דמקום המנורה בהיכל בודאי צריך להדליק במקומה‬ ‫היינו בהיכל ושלא במקומה לא עשה כלום‪ .‬ואיך כתב‬ ‫הר”מ והראב”ד דהדלקתן בחוץ כשר הא הדלק’ במקומה‬ ‫בעינן? ואח”ז מצאתי קושיא זו בס’ מעשה רוקח לחכם‬ ‫ספרדי על הר”מ ה’ חנוכה הקשה קושיא זו‪ ,‬ע”כ‪ .‬וביארו‬ ‫כמה אחרונים (אבנ”ז תקה‪:‬ב‪ ,‬וכל”ח תצוה ב’) דע”כ ס”ל‬ ‫להרמב”ם דנרות המקדש אין הדלקה עושה מצוה‪ ,‬ומותר‬ ‫להדליק שלא במקום מצותה ולהניחה אחר כך בהיכל‪,‬‬ ‫דבנרות המקדש הנחה עושה מצוה‪.‬‬ ‫‪3.‬איתא בגמ’ יומא (כד‪ ):‬דהדלקה לאו עבודה ואינן זר חייב‬ ‫עליה‪ .‬וברמב”ם הנ”ל מבואר דזר יכול להדילק המנורה‬ ‫לכתחילה‪ .‬ועי’ בחזו”א מנחות (ל‪:‬ח) דכתב לפי דעת‬ ‫הרמב”ם קוף מדליק המנורה (דלא כמנ”ח צ”ח דאע”פ‬ ‫דכשירה בזר היינו משום דזר בר חיובא‪ ,‬אבל חשו”ק וכ”ש‬ ‫קוף פסולים)‪ .‬אבל לפי הגמ’ הנ”ל דאם הדלקה עושה‬ ‫מצוה בעינן הדלקה מבר חיובא וקטן לא עשה ולא כלום‪.‬‬ ‫ע”כ הדלקת נרות המקדש הנחה עושה מצוה‪ ,‬ולכן קוף‬ ‫כשר להדלקת המנורה‪.‬‬ ‫בסיכום‪ ,‬מצינו סתירה אם הדלקה או הנחה עושה מצוה‬ ‫בהדלקת נרות המקדש‪ .‬מצד א’ הדלקה עושה מצוה כדחזינן‬ ‫דהדלקה דוחה שבת‪ ,‬ומדליקין מנר לנר‪ ,‬אבל מצד שני הנחה‬ ‫עושה מצוה דמצינו דכבתה זקוק לה‪ ,‬ולא בעינן הדלקה במקום‬ ‫המצוה‪ ,‬ויכול להדליק ע”י זר ואפי’ ע”י קוף?‬
