II. Plaintiffs Steering Committee Responsibilities Co-Lead Counsel, Robert Mosier and Daniel Robinson, and Co-Liaison Counsel Eric

Gibbs and Mark Crawford’ shall be members of the Plaintiffs Steering Committee (“PSC”). CoLead Counsel shall authorize and direct the work of the Plaintiffs’ Steering Committee (“PSC”).

6 At Co-Lead Counsels’ direction, the PSC shall have the following duties and responsibilities: 1.

PRETRIAL DISCOVERY. 7 8

a. Conduct pretrial discovery on behalfofPlaintiffs in all actions coordinated with the instant JCCP 4775;

b. Cause to be issued in the name of Plaintiffs the necessary pretrial discovery requests, discovery motions, and subpoenas or other third-party discovery pertaining to any

12 witnesses and documents needed to properly prosecute this coordinated matter on behalf of Plaintiffs; and, 13 14

c. Conduct pretrial discovery in a coordinated manner on behalf of and for the

15 benefit ofPlaintiffs, in a fashion in keeping with current practice guidelines orthose established in subsequent discovery plans or orders ofthis Court.

PRETRIAL MOTIONS, HEARINGS AND CONFERENCES.

a. Initiate proposals, suggestions, schedules, motions or briefs, and any other

19 appropriate matter(s) pertaining to pretrial proceedings; b. Examine witnesses and introduce evidence at pretrial hearings on behalf of

Plaintiffs;

c. Appear and argue any pretrial motions on behalf ofPlaintiffs; and

23

d. Appear on behalf of Plaintiffs at pretrial conferences or other pretrial

24 proceedings.

Mark Crawford from the Skikos, Crawford, Skikos & Joseph firm is added as Co-Liaison

27 Counsel to work in tandem with his partnerGregory Skikos. Together they shall only occupy one position on the PSC and only be entitled to one vote.

MISCELLANEOUS. a. Perform any task necessary and proper for the PSC to accomplish its

3 responsibilities as defined or authorized by the Court’s orders; and, 4

b. Maintain adequate files of all pretrial matters, including establishing and

5 maintaining a document or exhibit depository, in either real or virtual format, and having those 6 documents available, under reasonable terms and conditions for examinations by all JCCP

7 Plaintiffs or theirattorneys.

Compensation for work performed and the approved costs incurred by Co-Lead, Co-

9 Liaison Counsel, the PSC and any subcommittee approved by Co-Lead Counsel, will be paid by

10 the Common Benefit Funds which shall be covered in a separate Case Management Order.
