Plaintiffs Steering Committee Responsibilities

1~ Gibbs and Mark Crawford’ shall be members of the Plaintiffs Steering Committee (“PSC”). Co16 Lead Counsel shall authorize and direct the work of the Plaintiffs’ Steering Committee (“PSC”).

17 At Co-Lead Counsels’ direction, the PSC shall have the following duties and responsibilities: 18

PRETRIAL DISCOVERY. a. Conduct pretrial discovery on behalf of Plaintiffs in all actions coordinated with

the instant JCCP 4775;

b. Cause to be issued in the name of Plaintiffs the necessary pretrial discovery

22 requests, discovery motions, and subpoenas or other third-party discovery pertaining to any 23

witnesses and documents needed to properly prosecute this coordinated matter on behalf of

24 Plaintiffs; and,

Mark Crawford from the Skikos, Crawford, Skikos & Joseph firm is added as Co-Liaison

Counsel to work in tandem with his partner Gregory Skikos. Together they shall only occupy one

position on the PSC and only be entitled to one vote.

c. Conduct pretrial discovery in a coordinated manner on behalf of and for the 2 benefit of Plaintiffs, in a fashion in keeping with current practice guidelines or those established in 3 4

subsequent discovery plans or orders of this Court.

PRETRIAL MOTIONS, HEARINGS AND CONFERENCES. a. Initiate proposals, suggestions, schedules, motions or briefs, and any other

6 appropriate matter(s) pertaining to pretrial proceedings; 7 8

b. Examine witnesses and introduce evidence at pretrial hearings on behalf of Plaintiffs;

c. Appear and argue any pretrial motions on behalf of Plaintiffs; and

d. Appear on behalf of Plaintiffs at pretrial conferences or other pretrial

proceedings.

MISCELLANEOUS. a. Perform any task necessary and propel

for the PSC to accomplish its

14 responsibilities as defined 01. authorized by the Court’s orders; and, 15

b. Maintain adequate files of all pretrial matters, including establishing and

16

maintaining a document or exhibit depository, in either real or virtual format, and having those

17 documents available, under reasonable terms and conditions for examinations by all JCCP 18 Plaintiffs or their attorneys.

Compensation for work performed and the approved costs incurred by Co-Lead, Co-

20

Liaison Counsel, the PSC and any subcommittee approved by Co-Lead Counsel, will be paid by

21

the Common Benefit Funds which shall be covered in a separate Case Management Order.
