People not paying their bills is not a new problem, but the pandemic may have caused more folks to fall into this category than normal. This month’s feature gives you some great information and resources that you can use in your business. The article will

give you insight into what you can do about the problem, and when it is time to “cut your losses.”

The Propane Education & Research Council approved a comprehensive national marketing plan at the recent February 2022 meeting. The approved programs are listed on page 18 of this issue.

We had a great meeting in College Station, and we are very appreciative of our dinner sponsor the City of College Station. Also, we want to thank the folks at Exosent for giving the group a tour of

Feature Dealing with Pandemic Debtors

Patience is essential. But that that doesn’t mean to wait for them to call. You should take the initiative. You want them to understand that you are in the same boat that they are in. You incur debt to service them, and you want them to understand how you are connected.

The Four Types of Creditor

When a business or person finds themselves in a hole, one of the things they do as they triage, is divide their creditors into four different categories.

It’s good for you to know about these different “buckets”, because you want to be in the bucket that gets paid!

1. People who are “essential to the operation of the business” (almost always get paid) 2. People who make such a nuisance of themselves that debtors pay them just to get them off their backs (most get paid).

3. “Friends and Family” (sometimes get paid) 4. Everyone else (they have to wait) Your goal, Ennrico said, is to be in category number one or number two. If it’s a smaller debt and you make a nuisance of yourself, they might want to pay you just so they don’t have to hear from you anymore. Sometimes the squeaky wheel does get the grease.

People not paying their bills is not a new problem. But the pandemic might be pushing a new kind of client into the collections funnel, said Cliff Ennico, an attorney, author and columnist who speaks frequently on small business topics.

In a recent presentation he gave with the National Federation of Independent Businesses (NFIB), he said, “A lot of good people are having trouble paying their debts these days.”

Ennico’s talk on “Collections 101: Getting What You are Owed” was the second part in the Small Business Reset and Recovery Series.

Being “Ruthless”

Feature 2. Get an airtight contract that leaves the client with no “wiggle room”. Be crystal clear on when payment is due. Don’t use fuzzy language in your contract that may be interpreted in different ways.

Additionally, it is very difficult to have an attorney write a collection letter if your contract is vague. You must have it signed by the client. Make sure to include a statement that interest will be accrued on overdue payments.

3. Stop working or hold back product the MINUTE bills become overdue (as allowed by law). If you find yourself in a hole, stop digging. You may not get out of the hole, but at least you can better manage the loss.

4. Don’t do business with crazy people! Your gut is a lot smarter than your brain sometimes. Do some background checks and ask around if a new client sets off any alarm bells.

Steps to Collecting Debt

Step 1: Make a Demand for Payment. You cannot legally enforce a debt unless you first make a “formal demand” for payment.

Have your attorney draft and send this via certified mail – it has more impact (most attorneys will do this for a 1-hour fee). Make sure to include a phrase such as: “Interest shall accrue from the date of this letter at 12% per annum or the highest rate allowed by law if less.” Additionally, it should say something to the effect of: “if I do not hear from you within a certain amount of time (10-15 days is standard), I will have no choice but to retain legal counsel and pursue my legal remedies against you.” Ennico says that while you can draft these letters yourself (templates can be found online), the letters have more impact if they come from an attorney. “When a debtor sees that you’ve lawyered up, they tend to take it more seriously. Your first battle with any debtor is to get their attention.”

Step 2: Try to Negotiate a Solution. There are only two ways to work out debt. “Compromise” – offer to forgive part of the debt if the client pays the rest quickly. “Extension” – offer to a payment schedule (many small claims courts will rule against you if you haven’t at least offered this). You can combine these two tools as well. If the client agrees to a compromise or extension, GET IT IN WRITING! Stop working/deny service until the problem is resolved to your satisfaction (as the law allows).

Step 3: Mediate/Arbitrate If You Can. Mediation is a “brokered agreement”. Arbitration: a “mini-court case”. There are some wonderful online mediation and arbitration services, such as www.adr.org. This only works if both parties agree to manda-

tory mediation/arbitration. This should be included in the initial contract, as well. Mediation and arbitration can cost as much as litigation, especially for smaller claims.

Step 4: Sue in Small Claims Court. You always sue where the client is located, not where you are located. You do this because courts are required to enforce judgments from other states, but not “default” judgments. It also sends a strong signal to the client that you mean business.

If your budget does not allow for you to hire an attorney, Ennico says there are lots of great forms available online for either free or a small fee. For instance, on www.uslegalforms.com/ smallclaims you can search for “[your state] small claims” and pull down current applicable forms. You fill those forms out and send them with the filing fee to small claims court.

Ennico also suggests that to get ready for your court date, you watch lots of TV. “Whatever you might think about Judge Judy, it’s a great way to prepare for what you’ll be doing. … What you are watching is actually small claims court.” Small claims judges will almost always side with the party that is more prepared. Prepare, prepare, prepare!

During your day in court, make sure to be on time, show respect for the process, keep it simple and stay away from lawyers (and lawyer speak). Talk plainly and simply.

Enforcing Your Small Claims Judgment

The moment the court issues a judgment, walk over to the court clerk’s office for an “execution” to be issued against the party’s wages, property, or bank account. The bad news is that you will have to do the “legwork” to enforce your judgment.

There is a new controversial market where you MIGHT be able to sell your judgment online (for example, see http://judgmentmarketplace.com). There are some ethical questions about selling your judgment, but it’s something you might want to explore.

Feature Knowing When to “Cut Your Losses”

Managing your emotions is the key to successful debt collection. A lot of small debts aren’t worth the effort – remember that “time is money”.

Additionally, you can write worthless debts off on your taxes, as long as you’ve made a reasonable effort to collect them.

Using a Collection Agency

There are pros and cons to utilizing a collection agency. In the pros column: They are unemotional, and know the rules a lot better than you do. Also, they are usually more (ahem) aggressive than you might want to be. In the con column: They cost money, and the minute the client says they “dispute” the debt, the collection agency ceases their efforts and tells you that you need an attorney.

Things You CAN’T Do

The Fair Debt Collection Practices Act (FDCPA) protects consumers and says you: can’t call before 7 am or after 10 pm; can’t say you are a government employee; can’t say you are a lawyer (unless you are); can’t threaten client with jail or criminal penalty if he only owes you money; and you can’t misrepresent or embellish the facts. Basically, you cannot harass the debtor.

If the Debtor Files Bankruptcy

The minute you get notice that a client has filed for bankruptcy they are issued an “Automatic stay”, which means all debt collection activities must stop! You will need to file a claim in bankruptcy court.

If the debtor reorganizes, you will be asked to restructure the debt. If debtor liquidates, you will receive X cents on the dollar.

Gas Leak/Odor Response TECHNICAL GUIDANCE

The technical guidance provided in this article by the Propane Education & Research Council (PERC) is designed for trained and qualified propane professionals responding to a reported leak or odor call.

This article is intended as technical guidance for companies to use in the creation of their own leak response procedure.

Companies may consider creating a leak response procedure that provides instruction to employees on their steps to determine if entry is safe into the suspected leak area.

This article provides two options for consideration, which are outlined on the following pages: one option involves the use of a combustible gas indicator (CGI) and the other involves a situation in which a CGI is not available.

Atmospheric Testing

Area Entry

All gas leak calls should be treated as emergency calls until proven otherwise.

Personnel should obtain adequate CGI gas concentration readings to evaluate the hazard and take appropriate action during these incidents. It is critical to remember that propane vapor is heavier than air, so it may accumulate in low-lying areas or in the lower portions of structures. Remember, propane will move around with air currents present and therefore may also be in other than lowlying areas.

If your employees are equipped with a combustible gas indicator (CGI), this device should be capable of sampling and displaying detectable gas-in-air readings and will identify if the building structure or outside leak area is safe to enter. If this device is not available, employees responding to these calls should wait for emergency response personnel to arrive before entering a building or leak area.

CGIs are complex air-monitoring devices that can detect both the presence and level of combustible gases present in an area. CGIs must be set up and calibrated for the specific gases suspected and anyone who uses a CGI must receive specialized training on the specific instrument being utilized. These units must be properly operated, stored, maintained, and calibrated per the manufacturer’s instructions.

A combustible gas detector (CGD) is not the same as a CGI. A CGD will detect propane and other combustibles, but they do not have the ability to identify the actual percentage of gas in the air to determine if the mixture is flammable or not. A CGD is generally equipped with indicator lights only and therefore should not be used in place of a CGI to investigate if a building or area is safe to enter or not. A CGD is useful in locating leaks when conducting a leak check, but only after a building or area has been determined safe to enter.

If leaking gas is suspected, a qualified technician must assess the nature of the problem, determine the extent/source of the odor, the potential danger to life or property, and the actions required to bring the situation under control. Actions taken will depend on the assessment of the situation. A propane professional should not enter a building or a leak area with an audible gas leak, gas detector alarm, or strong odor of gas until emergency response personnel arrive and/or air-monitoring equipment has been used to determine that the building or area is safe for entry.

Some companies will rely on the fire department to respond for the purposes of air monitoring and determine if the building or area is safe or if further action is needed.

A minimum number of trained and qualified personnel should be allowed to enter the area to evaluate the situation. Any additional resources should remain in a location out of the potentially dangerous zone. As soon as the presence of gas is detected, only properly trained personnel with adequate personal protective equipment (PPE) should enter an area where there could be a potentially flammable atmosphere. All other personnel must stay out of the area until there is no longer a danger of ignition.

GENERAL GUIDELINES USING A CGI CAUTION: If, at any point, the CGI alarms, immediately evacuate the building and call 911 for help. All personnel should remain outside and at a safe distance until the structure has been determined to be safe.

1. Ensure the propane container(s) gas supply source to the building is OFF/CLOSED. 2. Check CGI readings around the building perimeter as you approach the building.

WARNING: The operation or activation of any electrical device, such as light switches or doorbells, or a discharge of static electricity can spark a fire or explosion. Precautions should be taken to eliminate any potential sources of ignition when entering or walking through a building.

GENERAL GUIDELINES WHEN A CGI IS NOT AVAILABLE 1. Call 911 for assistance to ensure the building is safe for entry.

2. Ensure the propane container(s) gas supply source to the building is OFF/CLOSED. 3. Always remain outside of the building and a safe distance away.

4. Ask any personnel inside the building to evacuate to a safe area outside and remain at a safe distance from the building.

5. WHEN emergency response personnel have determined the building is safe to enter, THEN proceed with conducting a leak check and investigate the leak according to your company policy.

3. Open the door to the building and immediately check CGI readings at the floor level.

5. IF CGI readings indicate that the atmosphere is safe, THEN proceed into the building and monitor the air continuously.

7. IF nothing is detected OR only low readings are identified AND you have determined the building is safe for you to continue the investigation, THEN proceed with conducting a leak check according to your company policy.

4. WHEN emergency response personnel have determined the area is safe to be near, THEN proceed with finding the leak and conduct a leak check according to your company policy.

5. Proceed through the entire area and identify any detectable propane in the leak area.

6. IF nothing is detected OR only low readings are identified AND you have determined the area is safe for you to continue the investigation, THEN proceed with finding the leak and conduct a leak check according to your company policy.

Restoration Upon completion of leak response procedures, ensure any follow-up actions are taken based on your company policies.

This may include: • Document or record findings • Follow local, state, and federal reporting requirements • Record lessons learned for future guidance

SAFETY ALERT

Conversion of Anhydrous Ammonia Containers to Propane Service Limited availability of steel products and supply chain issues may tempt the conversion of anhydrous ammonia containers to propane use,. Due to the dangers inherent in those conversions, PERC has issued a safety alert to detail that the conversion of small storage containers is not allowed by National Fire Prevention Association and National Board Inspection codes. The purpose of this alert is to advise those who may be considering conversion of containers from ammonia to propane that NFPA 58 and the NBIC are clear on the subject.

Although containers used for anhydrous ammonia storage are Since 2008, both NFPA 58 and the National Board of Boiler and Pressure Vessel Inspectors through their National Board Inspection Code (NBIC) are very clear about converting containers from anhydrous ammonia service to propane service: NFPA 58, Section 5.2.1.5 states: Except for containers used in cargo tank vehicle service, ASME containers of 3000-gal (11.4m3) water capacity or less used to store anhydrous ammonia shall not be converted to LP-Gas fuel service.

The NBIC Section S7.8.6 states almost the same language as NFPA 58 and adds the following second provision: Cargo tank pressure vessels less than 3000 gal. (11.4 m3) water capacity to be converted from ammonia to LPG service shall be wetfluorescent magnetic particle tested (WFMT) on all internal surfaces (see NBIC Part 2, 2.3.6.4).

essentially manufactured the same as a propane container and are built to the same standard as propane containers, there are some significant issues to be aware of: Anhydrous ammonia (NH3) is corrosive, while propane is noncorrosive.

Anhydrous ammonia is toxic, while propane is nontoxic.

Under similar release conditions, inhalation of NH3 can be deadly.

A propane container contaminated with ammonia: • May be subject to an independent pressure build called “stacking.”

• May affect appliance operating systems.

• Under certain conditions, may create a dangerous toxic gas when burned within appliances.

Anhydrous ammonia containers are susceptible to stress corrosion cracking in areas of high stress such as welds and seams.

Anhydrous ammonia valves and fittings must be steel while propane valves and fittings are typically brass. Brass is subject to severe stress corrosion cracking when subjected to NH3 and is evidenced by a blue-green stain on the brass when contaminated by ammonia.

The flow requirements for the relief device in an ammonia tank are not nearly what is required for a propane container; the opening in the container may not be large enough to accommodate the relief device necessary for propane service.

The manufacturer of the NH3 tank may have marked the data plate “For NH3 Only.”

Cargo tanks and ASME containers larger than 3,000 gallons water capacity must go through rigorous conversion procedures by a qualified vendor/contractor/manufacturer to successfully make their way from NH3 to LPG service.

This ALERT has detailed that the conversion of small storage containers is not allowed by codes and outlined the dangers involved if ANY conversion is performed improperly. The primary consideration here is SAFETY. Safety of the container, safety of the product, safety of the propane system, and safety of the customer being supplied. The risk is just too great.

People in Propane Kittie Jane Speer, 76, of Rio Frio, passed away on January 1, 2022, at her residence.

She graduated from Uvalde High School in 1963 and moved to South Dakota after marrying due to her husband serving in the U.S. Air Force. The family returned to Uvalde and Kittie helped operate their propane businesses (A-Town Propane and Country Propane) until her retirement in 2009. Our thoughts and prayers go out to the family.

Jack Adrian Fox, 100, passed away on January 26, 2022, at his home in Ola, Texas. He farmed and raised cattle the majority of his life. For 32 years Jack became a familiar face delivering propane first for Reliance Gas, then later for Penny’s Gas Company. Jack gave much of his time and effort to support the work of Morrow Chapel Cemetery in Ola and the Fox Cemetery in Rand. In his later years, he volunteered with VNA Hospice. Our thoughts and prayers go out to the family at this time.

The Propane Education & Research Council (PERC)’s newest safety curriculum, which covers the transfer of liquid propane from one container to another, is now available to take online under the Safety & Technical Training tab in The Learning Center on propane.com.

Transfer, the six video modules provide an overview of liquid transfer equipment, how the equipment operates, and how individual components relate to each other. An illustrated workbook for trainees to follow while taking the course accompanies the program and includes a Troubleshooting Guide: Liquid Pump Operations as well as Vapor Compressor Operations.

Portable DOT cylinders must be kept at least three feet horizontally away from the building opening below the level of discharge of the pressure relief valve, while ASME containers of less than 125 gallons w.c. must be kept at least five feet away. In both cases, containers can be located against the building to avoid a tripping hazard created by running the hose across an open area.

NPGA State Director’s Report from the Recent Meeting

The NPGA Winter Meeting was held January 30 – February 1, 2022 in Palms Springs, CA. Several topics of were discussed throughout the meetings. One was the state of the global propane market as it remains relatively tight, and what risks remain in relation to U.S. demand and

production. PERC President and CEO Tucker Perkins provided an overview of renewable propane. He summarized eight pathways that are being pursued, with additional possibilities, but noted that most are not economically feasible. A panel was composed of industry leaders who provided information about the cannabis industry relative to the propane industry.

The Marketers Section is now soliciting applications to serve on NPGA’s Executive Committee for the upcoming association year.
