THE DIFFERENCE WASN’T THE TANK. IT WAS THE PARTNER. Every project has a turning point. This was theirs. They tried what everyone else offered. Standard designs. Standard limitations. But GAS Equipment needed dispensing systems built around their operation, not a one size fits all approach. Most manufacturers weren’t willing to customize the design.
Let’s Talk Tanks.
A custom approach changed everything. Metsa listened to the application, reviewed the requirements, and helped engineer a custom solution built specifically for their systems.
The result: Improved safety Greater operational efficiency

OSHA’s Heat Initiative Expands: What the Current NEP Requires and What the Proposed Heat Standard Could Mean for Businesses
For propane companies operating in the Texas heat, protecting employees from heat illness has always been part of doing business. Whether delivering propane, installing tanks, servicing appliances, filling cylinders, conducting leak checks or working in shops and warehouses, employers routinely take steps to reduce heat-related risks. What many employers may not realize, however, is that OSHA’s focus on workplace heat has already expanded—and an even broader federal heat regulation could still be on the horizon. 8
Texas Propane • www.txpropane.com
Today, employers should understand there are two separate OSHA initiatives involving workplace heat. First, OSHA is actively enforcing heat hazards through its National Emphasis Program (NEP), which was renewed in April 2026 and will remain in effect through April 10, 2031. Second, OSHA is proposing a new nationwide Heat Injury and Illness Prevention in Outdoor and Indoor Work Settings standard that would establish the first comprehensive federal heat regulation if finalized. Understanding the difference between these two initiatives is important because one is already affecting employers today, while the other would create entirely new compliance obligations if adopted.
Who Is Affected Today?
The National Emphasis Program is not limited to large employers. It applies to employers covered by OSHA in general industry, construction, maritime and agriculture where employees may be exposed to indoor or outdoor heat hazards. OSHA specifically targets industries where heat-related illnesses and fatalities are more likely to occur, including construction, transportation, warehousing, manufacturing, agriculture and many service industries. Many small business owners mistakenly believe OSHA cannot inspect companies with fewer than 10 employees. That is not entirely accurate. While Congress has placed certain limitations on OSHA’s programmed inspections for some employers with 10 or fewer employees in specific low-hazard industries and qualifying small farming operations, those exemptions are limited. Employers of virtually any size may still be inspected following employee complaints, referrals, hospitalizations, fatalities or when OSHA observes hazardous working conditions. Programmed health inspections also remain permissible in many situations. For propane marketers, there is no blanket exemption simply because a company is small.
The National Emphasis Program: What OSHA Is Already Enforcing
OSHA originally launched its National Emphasis Program for heat hazards in April 2022. The program was scheduled to expire after five years, but instead OSHA updated and renewed the initiative on April 10, 2026, extending it for another five years through April 10, 2031. According to OSHA, the revised NEP directs enforcement resources toward industries and workplaces where heat hazards are most likely to occur. The agency also updated target industries using newer Bureau of Labor Statistics and OSHA injury data while expanding outreach and compliance assistance efforts. Unlike the proposed Heat Standard, the NEP is not a new regulation. Instead, it provides OSHA compliance officers with detailed procedures for identifying and enforcing existing workplace heat hazards under the Occupational Safety and Health Act’s General Duty Clause. In practical terms, that means OSHA inspectors are already evaluating employers’ heat illness prevention efforts.
What Can Trigger an OSHA Heat Inspection?
Under the current NEP, OSHA may initiate or expand inspections in numerous ways, including: • Employee complaints alleging heat hazards. • Heat-related hospitalizations or fatalities. • Referrals from other government agencies. • Programmed inspections in targeted industries during National Weather Service heat warnings or advisories. • Expansion of another OSHA inspection when heat hazards are observed. • Compliance officers observing workers exposed to heat hazards while traveling between job sites. For example, if an OSHA compliance officer drives past a construction project during a heat advisory and observes employees performing strenuous work in direct sunlight without apparent access to water, shade or rest, the officer may stop and initiate a heat-related inspection.
What OSHA Inspectors Are Looking for Today
During a heat-related inspection, OSHA compliance officers are instructed to evaluate whether employers have implemented reasonable measures to protect employees from heat illness. Inspectors may review: • OSHA 300 and 301 injury and illness records. • Heat-related emergency room visits or ambulance transports. • Employee interviews regarding dizziness, headaches, dehydration or fainting. • Access to cool drinking water. • Availability of shade or cooling areas. • Heat illness training. • Acclimatization procedures for new and returning workers. • Emergency response procedures. August 2026 • Texas Propane
9
• Physical work demands and exposure duration. • Whether employees wear heavy protective clothing or work near radiant heat sources. If OSHA determines an employer failed to adequately protect workers from recognized heat hazards, citations may be issued under the General Duty Clause.
The Proposed Heat Standard: A Much Different Approach
How the Proposed Rule Differs from the Current NEP
Current National Emphasis Program (Already in Effect) Enforcement program Uses OSHA’s General Duty Clause Focuses on inspections and enforcement Evaluates existing heat safety practices OSHA determines whether reasonable protections exist Targets high-risk industries and worksites Heat hazards evaluated case-by-case

No specific federal written heat program While the National Emrequired phasis Program focuses on Current enforcement authority enforcement of existing law, OSHA’s proposed Heat Injury and Illness Prevention in Outdoor and Indoor Work Settings standard would create entirely new nationwide requirements. • Increased monitoring for signs of heat illness. • Provide appropriate cooling areas. • Maintain certain required records, including some indoor heat monitoring records where applicable. Contrary to some reports circulating online, the proposal does not require employers to maintain employee break logs. Small Business Concerns
While OSHA’s revised National Emphasis Program (NEP) is already in effect, the proposed Heat Injury and Illness Prevention standard continues to draw concern from small business and industry groups. The National Propane Gas Association (NPGA) supports practical, scalable heat safety measures tailored to propane operations. OSHA’s revised NEP, effective April 10, 2026, continues enforcement under the General Duty Clause by targeting approximately 55 high-risk industries for outreach and inspections during high-heat conditions. The updated NEP does not create new compliance requirements for employers. NPGA opposes OSHA’s separate proposed Heat Standard. Through the Coalition for Workplace Safety, NPGA urged OSHA to significantly revise or withdraw the proposal, arguing it would impose overly prescriptive mandates rather than allowing employers flexibility to implement heat safety programs appropriate for their operations. The National Federation of Independent Business (NFIB) has expressed similar concerns, saying the proposal could create significant paperwork, administrative burdens and compliance costs for smaller employers.
As of this writing, OSHA’s proposed Heat Injury and Illness Prevention standard has not been finalized. What This Means for Propane Companies
For propane marketers, the most important takeaway is that OSHA’s heat enforcement is already underway. The renewed National Emphasis Program means OSHA will continue inspecting workplaces for heat-related hazards through at least April 2031. Employers should review their current heat illness prevention practices and ensure employees have access to cool drinking water, cooling opportunities, training, acclimatization procedures and clearly defined emergency response plans. While the proposed Heat Injury and Illness Prevention standard remains under review, companies should become familiar with its requirements now. Understanding how the proposal differs from the current National Emphasis Program can help employers identify potential gaps in their existing heat safety programs and prepare for possible future compliance obligations. Regardless of whether the proposed rule is finalized, workplace heat safety will remain an OSHA enforcement priority. For Texas propane companies whose employees routinely work in extreme summer temperatures, maintaining an effective heat illness prevention program is both a sound safety practice and good business.

Organization Name Encourages Community Members to Make a Power Play for National Propane Day Celebrate propane, a reliable and affordable energy option, on October 7, 2026
(MONTH DAY, 2026) – Organization name and the Propane Education & Research Council (PERC) recognize National Propane Day on October 7, 2026. National Propane Day is an opportunity to celebrate the many benefits of propane and all the ways it keeps Community Name running. “From delivering prime or backup power to homes and businesses, to powering school buses that safely transport children to and from school—propane increases resilience in our community,” said First and Last Name, Title of Your Organization. “We are proud to support our customers with dependable energy solutions that meet their daily needs.” Millions of Americans rely on propane for heat, hot water, cooking, power generation, and more. As a reliable, safe, affordable, and low-carbon energy source, propane supports a wide range of uses, including vehicle fleets, farms, ports, hospitals, and other commercial and residential applications. “Propane is uniquely positioned to solve many of the energy issues our country is facing today,” said Tucker Perkins, president and CEO of PERC. “As power outages become more frequent and energy costs remain a key concern for many families and businesses, propane provides a practical, attainable solution for consistent and affordable power. Propane can also work alongside other energy sources like solar and wind to reduce our dependence on the electric grid.” As demand on America’s aging electric grid continues to increase, propane offers a reliable energy solution. Because propane is stored on-site, it provides energy independent of the electric grid or natural gas lines, giving home and business owners peace of mind that they will always have power for essential operations. Propane is also supported by a strong supply. Each year, America produces over 800 million barrels of propane, helping to meet domestic needs while also supporting global energy markets. This abundant, domestic supply has contributed to propane’s historical price stability compared with gasoline and diesel, which are more directly tied to global oil market volatility. “As we continue working toward greater energy resilience, efficiency, and healthier communities, propane has an important role to play,” Perkins said. “On National Propane Day, and every other day, propane offers a reliable, affordable, and cleaner energy option. It truly is the Energy for Everyone.” More information can be found at propane.com. ### Organization Name Write a brief paragraph highlighting your company and its core business information, i.e. how long you’ve been servicing the community, service area, number of customers, etc. Propane Education & Research Council (PERC)
