Attorneys Criticize The Protest Against Local Justice Courts Over-Incarceration

F

ive attorneys invited to speak before Tompkins County’s task force on court consolidation came down firmly on the side of abolishing the town and village courts run by lay justices and in favor of creating a district court overseen by judges who have graduated from law school. One by one at the Oct. 15 meeting the lawyers politely noted that there are some capable and hardworking lay justices, but that in the end it was not possible to administer justice consistently without a nuanced and extensive knowledge of the law.

Ray Schlather, a local attorney, chairs the task force. He asked Steve Shiffrin, a professor emeritus at Cornell Law School, to give his remarks first. Shiffrin admitted that he had little criminal law experience; his specialty had been constitutional law, especially the First Amendment. But he has examined thousands of pages of testimony, some of it from justice courts.

A state action plan, Shiffrin noted, has recommended that judges should be former lawyers, and many organizations— he listed several, including the American Civil Liberties Union (ACLU)—agree. “In my experience, it takes two years for [law] students to catch on to the legal culture,” Shiffrin said. “You have to be in practice for five years before you are allowed to be a city court judge, which is the same docket as you find in the town and village courts.”

The law professor said that he didn’t believe that most lay justices had the resources at hand to provide them with legal advice. “Even if that is the case,” he said, “the responsibility then shifts to the resource center.” This, he argued, goes against the argument that a virtue of the lay justices is that they are “close to the people.”

He concluded by stating that he favors state legislation to move to the appointment of lawyer judges, as is recommended by the Dunne Commission.

In July 2006, former Chief Judge Judith S. Kaye appointed Carey R. Dunne as chair of the Special Commission on the Future of New York State Courts. The commission issued its report in February 2007. The first report suggested that the town and village courts were a problem that would require further study. A second report addressed this topic and was issued in September 2008.

on’t expect the Cayuga Inlet waterfront around the Ithaca Farmers’ Market to become something completely different overnight.

But ideas are in the air to transform a space that was once a dumping ground for construction outfits into a place where people can work, play, and get themselves goodies all year-round.

The last option is “preferred” because there’s more green space and less need for parking, according to Bill Price of Fisher Associates. Since a hotel in that location wouldn’t have “strong connections to the schools or downtown,” Fisher said, it’s perhaps not the most ideal place for that use either.

All of these proposed development options on the waterfront are limited to three stories because driving piles in the loose alluvial soils isn’t cost-efficient with a 60-foot height restriction. Developers could build to five stories by zoning right, but that’s not enough space to make the numbers work, in planners’ opinions, so conventional foundations it is.

likely, though, that the building would go up well before any sort of development happens on the DOT yard. In the long term, the vision is to be a waterfront destination “seven days a week, yearround,” Munzer said.

“We see ourselves as a pretty integral part of the waterfront as a destination,” Munzer said. “We think we add a lot of value to the waterfront as a development site and neighborhood. They’ve centered the development around the concept of having one of the best markets in the country there.”

With the plan for the DOT yard—plus the development of Johnson’s boat yard across Cascadilla Creek—the vision for this stretch of the waterfront is a far ways away from what it was when the farmers’ market began its tenure there in 1988.

“When we were first offered that parcel, there was nothing there other than weeds, concrete, and rebar,” Norman said.

According to Jan Rhodes Norman of Ithacamade and a member of the farmers market board, there’s been at least a decade of discussions over what to do with the state Department of Transportation (DOT) yard that adjoins the city-owned farmers’ market property.

Those discussions are manifesting themselves now in renderings and designs, with the release of a study performed by Trowbridge Wolf Michaels Landscape Architects, BCK/IBI Group, HR&A Advisors, and Fisher Associates, and funded with about $90,000 from the city, county, and state.

Results from the study were presented to the farmers’ market board at their Wednesday, Oct. 14 meeting and shown off to the public at the Tompkins County Public Library that Thursday.

There are three designs. One features a 124-room hotel, 10 townhouses, and 52 multi-family residential units in threestory buildings ranging from 850 to 1,200 square feet in size. The “highest density” option has 137 multi-family housing units of the same square footage, and the “preferred” option has 46 townhouses and 84 multi-family units. The plans are certainly not set in alluvial soils yet—they’re a “sort of sales pitch for developers,” according to Joan Jurkowich, the county’s planning administrator. She was telling interested visitors to the library open house that NYSDOT has long talked about a new yard in Dryden, but it won’t happen for “maybe 20 years” if the funding isn’t there to pay the state for the yard.

What all three of the plans do feature is an enclosed building at the farmers’ market. The market’s city-owned property has been carefully considered as a centerpiece for any development in the area.

“Everybody you would speak to would probably say that eventually having a four-season market space would be fairly crucial,” Norman said. “That has been the understanding and the vision for the market for a very, very long time.”

The growing popularity of the winter market at The Space @ GreenStar has reinforced that view and vision, Norman said.

Farmers’ market manager Aaron Munzer says that development of an indoor space is in “a little bit of a holding pattern,” as they await word of state agricultural development funding. It’s

New York City, but has practiced law in Tompkins County for the past 21 years. She has focused on criminal law with a special emphasis on helping indigent litigants.

Because her remarks were informed by own direct experience with the courts in question, McCarthy’s address to the task force was more acerbic than Shiffrin’s.

McCarthy described the facilities of town and village courts as inadequate.

There is no confidentiality, no area for inmate holding, no separation from the public, a general lack of security (no metal detectors), and no access to court itself by litigants without their own transportation.

McCarthy ended her remarks by stating that the recordings of proceedings in town and village courts were inadequate and difficult to get hold of. Also, ex parte communication between the judge and various parties in the case was common (and therefore not recorded at all).

Attorneys usually refuse to engage in such communication, said McCarthy, “because they can get into trouble.”

Kelly Damm repeated several of McCarthy’s criticisms of the justice courts, but also went further to say that she had witnessed routine sexism and racism. Peter Salton has practiced law in the local courts in the county since 1997. He said he agreed with the comments made by the previous three speakers, saying, “Tompkins County already has a gold-standard assigned counsel system. ver the last two years writer Brad Edmondson, in the employee of the Class of 1950, interviewed 67 members of the class in advance of their 65th reunion. Edmondson was brought in

by John Marcham, a member of the class and the long-time editor and publisher of the Cornell Alumni News. There will be an event at the History Center on Saturday, Oct. 24 at 4 p.m to acknowledge the publication of the resulting book, Post-war Cornell. Members of the Cornell Class of 1951 Jane Marcham, Robert “Rip” Haley, and Bill Kaye and Edmondson will form a panel that will tell stories about post-war Cornell.

Two themes emerged from the conversations. The first was the clash of cultures that came as a result of the huge influx of World War II veterans, many of whom where not from the traditional Cornell social demographic. The second was the place of women in the late 1940s at Cornell; they were still decades away from liberation.

Brad Edmondson: One of the most interesting things that anyone said to me was … a woman named Sonja Fuentes.

She was one of the founding members of the National Organization for Women, a feminist in the ‘60s. She was in the class of 1950, and she said that when she was an undergraduate there was a curfew, she couldn’t play sports, and there were all kinds of constraints on her behavior and she just accepted it as the way of the world.

If you had come up to me then and said that there was something wrong with this, it would have been as if you walked up to me and said, “It’s a horrible thing that dogs are walking around without clothes on.” I would have said to you, “That’s nuts.

Dogs don’t where clothes, and this is just the way of the world.” She didn’t realize it at the time, but then something happened in society that made it all seem like an injustice to her.

Jane, you were probably the person I talked to who was the most clued into it at the time.

Jane Marcham: I looked like a real fusspot, but I didn’t think I was at all.

BE: I think you looked like a trendsetter, like someone who was way ahead of her time, because you knew what was going on at the time it was going on.

Ithaca Times: Unfortunately those two are usually the same thing.

JM: [laughs] BE: Most of the women that I talked to, they were just like, “Oh this is just how it is.” But this thing that makes Jane think she looked like a fusspot was this great story about how she was involved in the

JM: No. I began writing editorial about WSUA [the organization that enforced the women’s curfew], about how they ought to doing something positive and not just dwell on the “hours thing,” and the fact that some women leaders were able to go into Collegetown and stay at all night parties.

IT: So there started being a double standard?

JM: Yes. BE: Jane wrote editorials [in the Cornell Daily Sun] that were critical of the curfews and the organization that was enforcing it. And the dean of women called Jane into her office and basically started yelling at her for writing these editorials.

JM: She decided that I had a problem, a problem with my father. She was trying to scare me out of writing any more editorials. It was really obnoxious.

IT: The average age of college students was considerably older at this time.

BE: Because they were veterans.

Right.

JM: … but not the girls.

IT: Were there women veterans?

BE: There were a few.

JM: … but not many. Not many at all.

BE: They did have GI benefits, but there weren’t many. I think it the Class of 1950 there were eight.

JM: I was never aware of knowing any in my class.

BE: They were very low-key people.

A lot of the veterans said that they got to Cornell and they put their heads down and did their jobs. And they just wanted to get their Cornell degree and go home.

IT: That’s not exactly how it’s recorded in the Cornell history by Kramnick and Altshuler. They lived off campus, they were older, they had picked up habits in the military that they continued. It was a

pretty rowdy time.

BE: That was something that I went into in more detail in the second edition of the book than the first. The new ending that I mentioned is more or less about Collegetown life during that era. It wasn’t really appropriate for the first edition because nobody in that story is from the Class of 1950.

What I found was … I don’t know to what extent you were aware of this … that there were this small group of people that were really passionate about jazz.

And going along with that they were really passionate about alcohol. A lot of people were really passionate about alcohol, but these people were linking alcohol and jazz because they were going after some sort of ecstatic state of self-awareness. So they were going down the same road that produced the beatniks and the hippies, but they were before the beatniks and the hippies. I was never aware of that, that that group had existed. On the Road came out in 1958 …

IT: But it all happened in ‘47 and ‘48 …

BE: Exactly. These were the people that the Beat writers were writing about.

Dean Moriarty was at Columbia in the late 1940s. He was a neighborhood guy. He wasn’t enrolled, but he drank with Kerouac and Ginsberg in the bars around Columbia in the 1940s. And the same thing happened here on a smaller scale, even to the extent that some of the people who were exposed to it wrote novels. This was a story that John tipped me off to pretty soon after I got started. Three novels were written about what Cornell was like in the late 1940s and early 1950s. They were all published in the late 1950s, 10 years after the events. In all three novels there is one character who is based on a real person.

Merchant Dubious About Dev’t How Ya Doin’, Sport?

I I n response to the three articles in last week’s Ithaca Times [Oct. 7 issue] heralding the benefits of allowing an out-of-state corporation to change the entire character of downtown and implying that those of us (the majority) who disagree are out of touch with reality or old fashioned in our thinking, I can only ask: what happened to representatives reflecting the wishes and values of those they are supposed to be representing?

As to “Density Explained,” I don’t think those of us who have been in business 35 to 50 years (many of whom have more advanced degrees than those who “represent” us), need to have density explained to us.

As for “Hugging A Student,” we have not only been students, we sell to students, rent to students, and many of us have taught students. Do we really need a “Collegetown West” with $900 to $1,600 per bed rental rates downtown?

If so, we should prepare for a return to a pre-Commons economy with a preponderance of bars, head shops, and student-oriented restaurants.

Being preached to by someone who was in business thirty years ago saying that we merchants are complaining that the contested new high-rise “will bring too many people downtown” is ridiculous and inaccurate. Have our officials even bothered to try to understand the implications of what they are proposing or consult with the people most affected by their one-sided decisions? At every meeting that I have attended, the public and the merchants have been ignored,

trivialized, and treated as though we are superfluous to the governmental process.

No one is against development because there will be too many customers.

What is needed is affordable housing for families, the elderly, and professionals.

If Cornell and Ithaca College need more student housing, they can afford to provide it. You don’t see them giving tax abatements, tax caps, and waivers for parking requirements to large out of state corporations, which is why Campus Advantage Corporation is coming downtown.

The costs of just one 11-story building, given all of these benefits, will result in higher taxes, less access, and an even greater parking nightmare for all of us. How will all of the extra traffic be accommodated with only two small, one-way streets, serving the downtown area—not to mention the cars which will have to be accommodated in already overburdened parking garages, which are the same age as the three in nearby cities which collapsed? If the city could not afford to provide free parking for downtown businesses at the height of the construction, when the need was greatest, so that the already overtaxed business owners were forced to pay for the “free” customer parking, then how can it afford to allow more cars from private corporations to use our publicly subsidized parking lots? We will all be the ones footing the bills for upgraded infrastructure, roadwork, police continued on page 7

thaca, quite a self-aware place, defines itself various ways, but sports allegiance is not among them, even when big things are happening with New York teams, such as now with the New York Mets.

The Mets are New York’s junior baseball team, second always in everything to the Yankees, but succeeding mightily right now, competing in championship postseason play for the first time in almost a decade, while the season is over for the Yankees and 25 other teams. Only four still stand.

The Mets’ success is a big deal downstate. In Ithaca, one would hardly know.

The New York Times recently did a study on geographical allegiance to various sports teams across the U.S. (yes - even the paper’s sports section is scholarly). The Boston Red Sox have a singularly broad regional reach, claiming five entire (New England) states as fervid supporters, plus the northern half of Connecticut. The southern half belongs to the Yankees, who likewise capture fans throughout their home state, which they technically share with the Mets, but not an even share. The study indicates that Yankee fans outnumber Met fans throughout New York by local ratios as high as 19 to 1.

As a lifelong Met fan, born in Brooklyn but living in Ithaca on-and-off for almost 30 years, I can back this figure’s accuracy.

But I can also say Met fans don’t mind. It would be like minding that Donald Trump has more money than you. It doesn’t do any good, plus he actually has to be Donald Trump, while you get to be you.

There are probably more Red Sox fans, even, than Met fans in Ithaca. It’s part lateral geographic reach, part college town similitude, part historic charm of the Red Sox as star-crossed losers, for almost

seventy years, who suddenly became big winners a decade ago, without turning haughty about it. But as they’ve slipped into mediocrity the past few seasons - the Yankees have, too - the Mets, in ascendance, might win over some fans.

As I say, however, it’s not really an issue for Met fans, who wouldn’t know how to handle twists and turns of mass popularity.

(I remember a press conference with Bob Dylan at the beginning of his stardom.

A reporter asked, “How do you explain your sudden attraction?” He looked a little startled and said, “Attraction to what?”)

Still, I will admit to pleasant surprise this summer when, after a rain-out of a Binghamton Mets game (the B-Mets are a minor league affiliate of the major league Mets), friends and I decided to head back to Ithaca but stop for dinner at Aiello’s in Whitney Point, which we’d all passed a hundred times, but only one had ever entered. We figured they’d have the Yankee game on in the bar, and that would be good enough baseball entertainment while we ate, talked, and had fun together. But the game they had on, to our great surprise, was the Mets. Go know. (We expressed our appreciation, and tipped good.)

Ithaca might lag behind progressive Whitney Point in its sports thinking because Ithaca just doesn’t care that much about sports. Elsewhere in upstate New York, one can hardly think of Buffalo without the Bills, or Syracuse without the Orange, but Ithaca has no sports counterpart.

Ithaca defines itself other ways. One well-known slogan says “Ithaca Is Gorges.”

In Defiense of Ithaca’s Character

In response to Gary Ferguson’s opinion piece on October 7, “Downtown Ithaca: The Role of Urban Density,” Historic Ithaca would like to offer a deeper examination of this critical issue, especially as it pertains to the redevelopment of the Trebloc site.

All advocates of smart growth are in agreement that urban sprawl must be curtailed and energy must be directed to creating walkable, sustainable, and equitable cities. But as writers like Kaid Benfield have pointed out, “not all urban density is created equal.” This is the point that Mr. Ferguson glosses over when discussing the proposed Campus Advantage proposal for the Trebloc site.

density, but it’s important to understand that density as a tool cannot be applied in an identical fashion to any given site without due consideration of several important elements, chief among them being a site’s existing context and scale. Simply put, the crucial design issue is appropriate density for each particular urban site. When we consider the issue of appropriate density, this is precisely why the proposed 11-story project is too large for its site.

protection, parking, etc. The corporation’s claim that they will be bringing extra tax dollars to Ithaca, fails to take into account the true long-term costs, which are not balanced out by tax abatements for ten years and a permanent tax cap thereafter, which can never be raised! And, this is only one of the seven to eight planned, multistory buildings—without parking, in the same small downtown area.

If these buildings go up, neither Ithaca residents residing outside of downtown, nor out of area visitors, will be able nor willing to drive, park or shop downtown. So much for “core density.”

Other cities, such as Corning and Binghamton, are giving free parking to customers to stimulate business. Our officials raise parking rates and install more expensive and inconvenient meters, which drive away customers, while refusing to require parking for these new, expensive, high-rise, high-density residences, whose corporate owners go home with the profits.

As for the Commons “crowds being back, bigger than ever,” I beg to differ. With all of the hype for the Grand Opening of the “new” Commons, how about a few facts from the actual merchants? We experienced about two weeks of increased business (although not even close to regaining the 50 percent or more per week in lost business during the protracted construction), followed by a return to a level almost as bad as during construction—perhaps because construction, congestion, traffic and no parking continue. Have you failed to notice the huge number of empty storefronts?

Our government refuses to provide the actual numbers of businesses that went out of business during the two and one half years of needless and badly managed construction. Fifty? More?

With the continuing construction of seven or more planned high-rise buildings and the accompanying lack of access, parking, and drivability, how many more of the barely surviving businesses will be left?

What about all of those lost jobs and tax revenue the city desperately needs?

Most people who move to or visit Ithaca, do so for the ambience, uniqueness, and livability—not for just another over crowded, poorly planned city you can find in abundance anywhere.

How about a little “Commons Sense” and foresight and respect for the needs and desires of the tax paying citizens who call Ithaca home.

stories. In December 2010, the Downtown Ithaca Alliance, the very organization for which Mr. Ferguson serves as executive director, presented their Downtown Ithaca 2020 Strategic Plan. On page 29 of this document, an image of a 6-story building is shown on the same

site under discussion—the Trebloc site.

This proposition was reasonable, with a building of appropriate size and scale to its neighbors. Why now would Mr. Ferguson not see this six-story building as “appropriate density” and instead advocate for 11 stories?

Seattle developer and urban policy consultant Liz Dunn (Hon. AIA) has written that reductions in vehicle miles traveled are “achieved at densities of 50 units per acre and above,” and our urban sites with existing two-and three-story buildings “already have the capacity for 50100 units per acre if converted to housing above the street.” Given these numbers, it is possible for a six-story building on the Trebloc site to address concerns about sprawl and promote reasonable urban density.

Let’s have a more thoughtful and considered discussion of what urban density is and how it can be best achieved for Ithaca at the Trebloc site and elsewhere downtown. To be clear, we support the appropriate redevelopment of this site and believe it is possible with a six-story building or a mixed-height, six- and seven-story building. We also support the addition of new and affordable housing units in Ithaca. This prominent triangular site demands a well-designed building that fits with the urban context and fabric of the city.

Our New Common Space

The openness from Cayuga Street to Aurora Street is undeniably more pleasant than the previous overbuilt and congested space. One can spot a friend from a distance away and arrange to have a good cup of coffee and chat. This is where the charm ends.

The casually arranged metallic chopsticks at the entrances next to highly erect vertical lampposts have gained sufficient criticism from others, so I would like to address some of the “finishing touches” throughout.

If the devil is in the details, the new Commons is destined for a satanic cocktail party. Since when does one attach thin, already cracked pressure-treated slats on top of thousand dollar slabs of carved granite? Who would expect a 2 ½-inch caulk joint in some areas to safely separate and waterproof the Commons pavers from storefront entrances? The crowning touches are the suspended lights looking much like drones, dangling from convoluted zigzagging wires.

Ironically, while the new Commons project has once again, given us a renewed view of the classic lines of the handsome 19th and 20th century storefronts and upper stories, the preservation and highlighting of these buildings has been virtually ignored. If one of the millions spent on this project had been allotted for restoration of these facades, our Commons would be radiant and unique.

These buildings have survived now two Commons rebuilds. Historical architecture provides a sense of place, not dreary

I am one who, as a citizen of these United States, welcomes any news from Palestine and who went and saw Bassem Tamimi when he was in Ithaca recently. He is a part of a group of people, who like you in the group of blacks, have been exploited and prosecuted in the past. Like your progenitors, he is being prosecuted by the policies the United States, and in this case the U.S. support of Israel, in its nasty ways.

I suggest that you shall do well to support all education to all people who serve to educate what one government, Israel, is doing to another group of people, those of Palestine, against International Law and various declarations of the United Nations. Obviously stories of Palestine must be age-appropriate when dealing with youngsters, just as this needed to be age appropriate in the heyday of civil rights activism for blacks in these United States. Education needs be continued about blacks in these United States with regard to voting rights in every state, with certain groups hell bent on denying many the right to vote. So too, the rights of Palestine peoples needs to be taught against all of the well-bought-off politicians in this country, especially in this political climate in year 2015.

Voting For Rich John and Why

Until his recent abrupt and suspect resignation to switch legislative districts, I was proud to have Nate Shinagawa as my county legislator. In 2012, when he ran for the U.S. Congress, I was a volunteer with his campaign. I thought Nate a principled and trustworthy politician. I now feel that he has betrayed his constituents by his participation in a move that can only be described as machine politics at work.

For those who have not kept track of local Democratic Party tactics during the last month, here’s a synopsis. On Sept. 16, Kathy Luz Herrera resigns as the county rep for the 2nd District, which encompasses Fall Creek and part of East Hill. The next day, Shinagawa resigns his seat as county rep for District 4 and announces he’s moving to Fall Creek with his new wife and will run for Luz Herrera’s seat. And the day after that, Sept. 18, Elie Kirshner, a Cornell sophomore and Mayor Svante Myrick’s 19-year-old protégé, announces he’s running for Shinegawa’s vacated seat.

Rich John, a long-time Ithaca resident and experienced lawyer also announces for the District 4 county rep position.

With the filing deadline of Sept. 30 approaching, a Democratic Committee meeting to pick a nominee was delayed until Sept. 28. At this meeting they handed Kirshner the nomination. This was not made public until the next day, making it impossible for another candidate to gather signatures and file to be on the ballot

So people who say something perceived as racist are put through a public shaming—particularly on the Internet—but those activists who raise the issues “are dismissed as illegitimate, cynical, disruptive,” Rickford says. He is in favor of young BLM activists embracing the militancy and disruption; one of the movement’s slogans is “Shut It Down.”

“BLM is so important because it’s forcing the question of in what ways is white supremacy still a systemic problem.

That’s a question America doesn’t want to by and large want to have,” Rickford said.

“Mainstream America is not going to have that conversation if you simply publish an op-ed. America has shown time and time again it has no problem criminalizing the vast majority of black people.

“In the face of that kind of indifference and apathy, what you need is agitation,” Rickford said.

Ithaca’s skaters raised about $216,000 from funding sources like New York State parks ($66,000); Tompkins County tourism ($60,000); and Ithaca’s Urban Renewal Agency ($40,000). The city chipped in the remaining $61,000.

Then-local skateboard enthusiasts Jake Hascop and Mollie Devoe initially spearheaded the project.

“Everybody Skates” Once it was established that there was a need for a skate park due to outdated facilities and an increase in usership, another question that comes into play is, “Is having an active skateboard community a good thing?”

Some skateboard stereotypes do not lend themselves to painting a thriving skateboard scene as an asset to the city.

However, any concerns stemming from such stereotypes are likely nothing more than misconceptions. By all accounts, skateboarding is just one of the many elements that contribute to Ithaca’s diverse fabric.

“In a general sense,” Devoe explained, “the skate park functions as heterotopia—a space that exists outside or in-between our dominant institutions. There are no historical standards. The community is diverse, spanning race, age, and income.

Skating attracts everyone: artists, filmmakers, musicians, local business owners, professors, students, and young families. Globally, skateboarding has become a billion-dollar industry. At a local level, the diversity of the skateboarding community promotes an economy that’s not dependent on economic monocultures. Also, its a healthy alternative exercise.”

Douglas echoed Devoe’s testament to the natural, wide-ranging demographic skateboarding cultivates.

“Just for the city itself,” he said, “since skateboarding has ballooned in popularity in the last decade, it’s a really great thing to offer your community. It’s a good youthcenter activity, where you can give users independence. You don’t need to form teams or anything like that. You can just go learn something new to do. Having it in Ithaca is great for us, but also surrounding communities that don’t have this kind of facility. We get people from Elmira, Syracuse, Binghamton, Corning and Geneva—all over the place. It’s awesome for skateboarding in the region. Ithaca is showing other cities that it’s a good thing.

“Skateboarding is completely open to everybody,” Douglas continued.

“Everybody skates. White kids. Black kids. Poor people. Rich people. Those factors just don’t matter in skateboarding.

Everybody skates.”

As for the skating scene at Ithaca, it varies based on who is around.

“The skateboard scene in Ithaca is interesting,” said Douglas, “because we’re in a college town. It’s pretty cyclical, so we’ll have skaters [attending a local college], and they’ll be here for four years and usually move on. So it goes through periods. There will be a lot of kids skating real strong, and then a couple of years later it’ll be a downturn for a while. It fluctuates heavily, but it’s always there in one form or another.”

“I think because Ithaca is such a small community,” Erb continued, “there is a lot of overlap in people of the skateboarding and BMX community. People get along.

In certain situations, there might be competition for space, and in those instances, people might not get along as much. But I don’t see that too much in Ithaca.”

FBM Head of Sales John Lee said he hopes the new park helps create a bigger BMX scene in Ithaca.

“The park is an excellent park for a younger rider,” Lee said. “There’s nothing there that’s super tall or super intimidating. So I hope that gets more people into it. As you get older, you seek bigger obstacles and bigger transitions, and that’s where the park has a little limitation. You have to think a little creatively. Because of the tight space, and how many people are there, you might have to dodge traffic and pick your lines carefully. But having the new park, in general, is just great. Any addition is welcome. And the fact that the old park is still there, will help keep each park from overcrowding, which is great for skaters and BMXers.”

A New Era of Swimming

Staley steps down, Blakely Armitage dives in

W

hen Roy Staley stepped down last spring as the coach of the girls’ swimming team at Ithaca High, the incoming coach would have at least one thing going for him or her: Nobody would expect Staley’s successor to win 23 consecutive sectional titles.

Staley, who graduated from Ithaca High in 1963, was an icon on the pool deck for many years, as he started coaching in 1968 (after four years on the swim team at the University of North Carolina), took a break from ’76-’86, then stepped back in and built a dynasty.

The Little Red won 23 consecutive sectional titles from 1990-2012, turned out numerous All-State and AllAmerican swimmers, and took a group of very talented swimmers to the state championship in the mid-2000s. While the team’s dual-meet victories were so numerous they were difficult to tally, the number of losses was easier to remember.

Ithaca lost one dual-meet, to Johnson City in the late 1990s. Former Athletic Director Bill Bryant once astutely pointed out that

Staley’s real gift was not getting the most out of some of those highly gifted swimmers, but taking the more ordinary athletes to new and unexpected heights.

The powers-that-be at Ithaca High chose Mike Blakely-Armitage to replace Staley, and in terms of continuity and the proverbial path of least resistance, it seems a wise move. Mike has been coaching the Little Red boys’ team for several years; he knows the school, the conference, and the facilities; and he brings some very motivated young assistant coaches to the mix.

Ursula Kurman Browning has been around a few pools, and her daughter, Annika, spent her freshman and sophomore seasons swimming for Staley.

They are now adjusting to the Armitage way of doing things. “The program has a lot of tradition, and it has been that way for a long time,” Ursula told me. “Three quarters of the girls were on the team with Roy, and Mike is carrying on a lot of that.”

I’m not even privy to it.”

Ursula knows a bit about swimming, as she was a Division 1 swimmer at Cornell, and I am comfortable in approaching her, given I met her when she was a freshman in… Well, it was a while back. I asked her what Mike is doing differently, and she stated, “Well, there is less time in the pool. They were doing two-a-days last year, and now it’s once a day.” She is also pleased that BlakelyArmitage has brought in top-shelf alumni like John Nord and Kevin Nicholson to work with the athletes, saying, “It’s good to have more eyes on deck.”

Ursula pointed out several times that she as a lot of respect for Staley, and she said, “I think Roy set the team up for long-term success. There are some

good swimmers that are only in the seventh and eighth grade. There is a wide range—from state qualifiers to real beginners.” She added, “Everyone knows how many sectional championships they had, and about the state championships. Roy also coached the boys for a time, and he coached an Olympian in Alex Meyer.”

Ursula pointed out that while there is surely a big technical component to the sport, a lot of a team’s success depends on conditioning. In high school swimming,” she offered, “you have 14 weeks to get the girls in shape, and then you have the post-season.”

So far, the Little Red is unbeaten in dual meets, and Annika Browning and Indy Stratton have qualified as individuals by making the cuts for the state championships. The 200 and 400 Free Relay teams are also in, and that’s a very positive thing for the program. In Ursula’s words, “Mike is moving it forward while building on tradition. It’s a new era.”

• • • I learned of a fundraiser for the Wounded Warrior Project, and I am passing it along. “Hoops for Troops” will be held at the Ithaca High gymnasium on Saturday, Oct. 31 (starting at 9 a.m.), and it will be a 3-on-3 format with a maximum of six players on a team. Duo recall the past and look to the future

rowing up here in Ithaca, there were certain music acts that played in Ithaca in their infancy, so to speak. You could actually brag that “I saw them back when,” groups like Talking Heads and renowned folk-rock duo Aztec Two-Step. The pair, guitarists Rex Fowler and Neal Shulman, will play at The Dock on Saturday, Oct. 24 at 8 p.m.

Fowler and Shulman met at a Boston coffee house, the Stone Phoenix, in 1971.

Their moniker came from a line from a poem that appeared in A Coney Island of the Mind by Lawrence Ferlinghetti.

“Our signature song [“The Persecution and Restoration of Dean Moriarty”] is about Kerouac’s novel On The Road, which goes back before the ‘60s, but we were part of that milieu, the counterculture, and it was a very different time in terms of what people were made, it was certainly different in the way records were made and distributed and found its way to people.

It was still major labels … there was a time when the label you were on sort of said something about the music you were making. We were on a label that was the

home of The Doors and Judy Collins and Tim Buckley. And certainly Ithaca was a very enlightened place, and we kind of connected.”

Early in their careers, Ithaca was a regular stop for Aztec Two-Step. In 1971, before their major label debut on Elektra Records, Fowler and Shulman had a weeklong residency at Cornell’s Johnny Parsons Club, and they went on in the 1970s to perform countless shows at The Unicorn, a club housed in the Eagles Building on East State Street.

For weeks before I spoke to Shulman, I was wracking my brain trying to remember which show of theirs I had seen. Unable to figure it out on my own, Shulman and I put our heads together and figured out that I saw them open for The Roches at the late, lamented Strand Theater when I was in high school. As we talked, Shulman recalled the early days with his own unique context.

“When our first record came out on Elektra in 1972, the radio stations up in Ithaca were some of the first to get on it.

We came up there and did a residency up

Those Western Skies

Band still traveling that lonesome road

T

he spirited band the Old 97’s defies easy categorization, having marked two decades of playing a special mix of rock with hints of alt-country.

Lead vocalist and rhythm guitarist Rhett Miller in a recent interview noted that they consider themselves “to be a rock ‘n’ roll band first and foremost.”

The Old 97’s was formed by Miller in Dallas, Texas. Soon after releasing the group’s first record, Hitchhike to Rhome, they hit the road in support of the new album. The band continued to perform with Murry Hammond (bass guitarist and backup vocals), Ken Bethea (lead guitar and backup vocals), and Philip Peeples (drummer and backup vocals), and in 1997 they recorded the album Too Far to Care.

But it was when the hard-driving group released Satellite Rides (2001) that they broke past previous musical efforts and hit Billboard’s Top 200 at Number 121. Miller reflected on the music of the Old 97’s by saying, “We’ve been sort of lumped over the years with the alt-country theme, but in our heart we’re just a garage rock band that likes to jump around, likes to have fun, [and] we make sure our shows are a lot of fun.”

While Miller does most of the band’s songwriting, the group undertook another recording in 2013 on the EP record, Old 97’s and Waylon Jennings. The band had cut two songs with the country legend, and according to Miller, “Getting to meet and work with Waylon Jennings was a highlight of my career.” Jennings was friends with Buddy Holly, whom Miller grew up idolizing, and Miller wanted to have similar artistic friendships. Over time he has made friends and collaborated with many people, “and Waylon was really the first experience,” he Miller said. “He was so kind, and so generous, [and] it was a great experience.”

The band has survived the twists and turns in the music industry and currently has 10 records to their credit, four EPs, and a mix of television shows and movies, which have featured some of the group’s music. And with their recent energetic record, Most Messed Up, the group hit Billboard’s 2014 chart at Number 30.

When the band is not recording, they are touring and meeting their fans. Miller loves standing in front of an audience, getting feedback, and telling stories with the Old 97’s. “I love touring. I feel like I was born to be on the road,” he said. “I love the feeling of rolling into town after town with my little group of friends, and you know, we’re going to take over the town with our music.”

For Miller, the act of writing songs is solitary, but his experience of taking the stories to the people with the band is

communal. But things have changed for the Old 97’s, because everyone in the band has family and children at home. “It makes it a lot harder to leave and do this weird job,” Miller said. “But the nature of the [music] industry in the last two decades [has] changed such that the only way to

make a living is to go out on the road. There is no real value to recorded music anymore. But the good news for me is that I really do love [the touring].

And my kids understand, and they are proud of me for what I do. I love what I do. A lot of musicians only like making music in the studio, and the idea of standing on stage every night is burdensome or horrifying.” For Miller there are so few opportunities for people to connect with other people in the modern world, and he enjoys connecting with the audience and with the band as they perform. Because it’s not just about the

Guitar great brings chamber duo to town

as a multitude of possibilities—that is to say, a way to show many worlds. “We want to present a balanced experience,” he said, “as opposed to an intentionally abstruse presentation. We want to take everyone somewhere.”

I’ve always thought that jazz, more than any other style of music, bridges the gap between visual and non-visual art the clearest. The modal constructions of many of John Coltrane’s compositions from the early sixties have invoked actual visual representations to me—geometric patterns that have hung above my horizon as clear as day. Furthermore, many of the works of abstract painters of the ‘50s and ‘60s are closely tied to jazz improvisation. Many of those painters frequented the legendary Five Spot in Manhattan on a regular

he first time I heard Nels Cline was on Mike Watt’s 1997 album Contemplating The Engine Room.

The guitar sound on the record was an angular, minimalistic punk rock onslaught that raged in a Primus/John McLaughlin sort of way. I saw the picture of Cline in the booklet and thought, “This guy’s the man,” and then kind of forgot about him.

In a record store in Seattle some years later, I saw the record The Giant Pin by the Nels Cline Singers, remembered the name, and picked it up. It was a straight-up jazz group to my surprise, and quite a remarkable and challenging one at that. Cline has been playing on records since the late ‘70s. He’s played on everything from jazz, free jazz, punk, and experimental, to avant-garde and country albums, and continues today to push the limits of taste. After an appearance with Wilco this summer at the State Theatre, he’s returning this Friday, with his two-man chamber project with Juilan Lage.

H

ave you been at a memorial gathering and found yourself racked with laughter at some story about the deceased? Along with inexorable sadness, the often fierce anger at the unfairness of it all, laughter tumbles in, unexpected, uninvited, yet immense, another strand of that long journey of grief.

Some griefs are national. Some wounds remain open a half-century later. Katori Hall’s brilliant play, The Mountaintop, takes us to a specific undistinguished motel room in Memphis, Tennessee, on a stormy early April night in 1968.

Already our breath is clenched, our guts tightening. We know this place: the Lorraine Motel; we know this tired man who is loosing his tie, calling out to his friend to pick him up some Pall Malls, dropping his briefcase, and kicking off his shoes, grimacing at their smell. We know his fate: to die on this very balcony the following evening.

“I have been to the mountaintop …” he preached that very day at Mason Temple.

He was there to support a sanitation workers strike; he was laying plans for the Poor People’s March. The speech rings with eerie premonition.

Hall extends this premonition to that evening: what if the man foresees his death. What if he has a dark night of the soul, wrestling with his God? And what if providence sends him a young hotel maid (her first day) to flirt, cajole and argue with him through this strange evening?

In the play’s early moments, Hall uses deft comedy, sexual tension, and plain old normalcy to knock King off the pedestal we have allotted him. The saucy maid, Camae, who can curse a blue streak, mockingly addresses him as “Preacher King.” He’s lonely. He’s attracted. Yet that’s not the dance that is in the cards this evening, King’s Gethsemane.

With an extraordinary mixture of comedy, fantasy, and painful reckoning, Hall sketches a different song for MLK, a song of homecoming. Her strategies are rooted in a tradition of the metaphysical comedy (for instance, Philip Barry’s

Holiday) and folk tales (Zora Neale Hurston, Langston Hughes, or the white-authored all black musical, Cabin in the Sky.) It makes for a tricky, beautiful work that requires deft direction and acting to truly catch fire. The Kitchen Theatre’s current production is easily a three-alarm fire of theatre genius under the careful ministrations of director Nicole A. Watson, actors Landon G. Woodson and Angel Moore and Landon G. Woodson in The Mountaintop (Photo Provided) Angel Moore along with a top-notch design team.

Woodson threads the some of which could easily fall flat, but needle between ordinary and greatness, not under Watson’s direction. Vermont Filmmaker Returns

T

he knock on Guillermo del Toro’s new film Crimson Peak is that it isn’t scary. All those knockers are wrong. Crimson Peak is a scrupulously faithful telling of an Industrial Age-era ghost story, and it honors the genre with plenty of well timed jump-out-and-boo! scares and lots of elegant tracking shots up and down stairs and down eerie, dusty hallways. But if you’re a fan of del Toro and you’ve been paying attention to films like Pan’s Labyrinth and Mimic, you know that he’s the kind of monster maker who sympathizes utterly with his monsters. It’s the people who say they’re your friend who are the real fiends.

Pale, shivering and put-upon Mia Wasikowska plays an aspiring ghost story writer who gets a taste of the real thing when her father is brutally murdered and she marries a tall, dark stranger played by Tom Hiddleston. She moves into a spooky mansion in England with Hiddleston’s weird sister, played by Jessica Chastain.

The roof has huge gaps, so leaves and snow are always piling up and blowing around, and of course there are locked doors and places one must not go.

Crimson Peak is a seriously beautiful scary film, where the house is a legitimate character in the tale. It’s like the most opulent Poe picture Roger Corman never made.
