By John Morton In early December, several members of the Sarasota County Legislative Delegation were greeted at a town hall meeting on Siesta Key by hundreds of enthusiastic residents who chanted “Let us vote!”

Less than a month later, they quickly exited a tense room to the chants of “Vote them out!”

On Jan. 4, before an overflow crowd in the county commission chambers in downtown Sarasota, the six-member delegation came to a 3-3 vote, killing Save Siesta Key’s eight-month effort to see its desire to make the island its own municipality come to fruition.

The no votes came from delegation members Will Robinson Jr., James Buchanan, and Tommy Gregory. Of those three state representatives, only Robinson’s territory includes Siesta Key -- in the form of a sliver of the north part of the island where several homes fall into the city of Sarasota’s turf.

State Sen. Joe Gruters and state reps. Fionna McFarland and Michele Rayner cast the yes votes. Siesta Key’s footprint is primarily represented on the state level by Gruters and McFarland.

hen a worldwide candy cane shortage threatened to make the region’s holiday season a bit less sweet, Siesta Key’s very own Fudge Factory saved the day.

“America is running out of candy canes,” CNN declared days before Christmas.

“Candy Cane Shortage, 2021,” trumpeted a USA Today headline.

Supply-chain shortages, a lack of workers, and even a shortage of peppermint itself were to blame.

During the month of December, as it has for the past five years, the Fudge Factory presented its customers in the Siesta Key Village with the delicious, handmade red-white-and-greenstriped peppermint candy canes for which they are known.

Peter Vrinios, a third-generation master confectioner, was a man on a mission to create the candy canes from enormous balls of sugary ingredients at the company’s larger Anna Maria Island shop, where the business expanded last spring.

“Peter saved the day for us with those candy canes,” said Maria Lygnos, the Fudge Factory’s Siesta Key manager and chocolatier.

Despite the shortage of peppermint elsewhere, Vrinios had a sufficient supply.

He learned the art of candy making from his father and Greek immigrant grandfather at their candy store in Continued on page 35

Annexation of Siesta Key on city’s radar

By John Morton In fewer than 60 hours after Siesta Key’s bid for incorporation was shot down by the Sarasota County Legislative Delegation on Jan. 4, city of Sarasota Mayor Erik Arroyo placed the topic of annexation of the Key on his city commission agenda.

On Jan. 18, he made a presentation to

his commissioners, and one significant comment centered around the notion the city’s charter review committee is considering a shakeup in structure where one of two at-large seats on the commission becomes a four-year mayor, elected by the residents. Currently, the five commission

members vote each year among themselves to select a mayor.

As a result, “There’s a possibility a separate district could belong to Siesta Key. It could have a seat on the commission,” Arroyo said.

Greetings from the Gulf

For something that wasn’t about you ...

P

erplexed. That may not be the first “P” word that comes to mind for those Siesta Key residents who wanted at least a chance to vote on whether or not the island should become its own municipality, but it will have to do in a family-friendly publication such as this.

And it does fit. I mean, what more could have been done?

It’s downright perplexing. The Save Siesta Key folks checked off each and every box during the application process, met every deadline, and consistently reminded a six-pack of state politicians, mysteriously known as the Sarasota County Legislative Delegation, that its role was to forward the bill to Tallahassee as long as things on paper seemed legit.

I can’t help but wonder if those reminders insulted them.

Still, the fateful vote needs be conducted by the residents -- not you folks. Not one of you even lives here.

And one lives as far away as Pinellas County!

The message? This is not about you.

But oh no, that’s not what happened. The members might have said “we hear you” at the rowdy town hall meeting in December, but you could easily argue much of it fell on deaf ears.

It felt like the classic “we are saying no because we can” routine.

Or how the baseball writers reject first-ballot Cooperstown candidates but vote them in later, fully aware the stats don’t change. Sure enough, the delegation said it was willing to revisit this again. Wow! How kind!

I mean, what will be different about the next Siesta Key application? A different font, perhaps?

By the way, what kind of voting body has six members? There’s a reason you should always have an odd number of members -- to avoid ties.

Kissing your sister, much?

Ties kill motions. They also minimize the impact of someone being blamed for a decisive vote.

Anyway, Siesta Key must feel like it’s on an island. And that wasn’t meant to get a chuckle.

A political prisoner, even.

Hey, it just hit me -- Alcatraz is on an island.

Same with Rikers.

Is it time to build a wall here and install guard towers?

No doubt, many residents would like that.

Self-imposed incarceration in paradise.

Conversely, some who oppose incorporation will say that locals are indeed trying to do just that -- become selfish and exclusive by becoming a municipality. As if to seal-off access.

Wanting to control land use doesn’t mean roping off Siesta Beach, folks. By the way, the county-owned Siesta and Turtle beaches will never be for sale. Nor affordable to any municipality that may want them.

Meanwhile, as the county continues to be an enemy in the minds of many, and now maybe the state as well, it’s the city of Sarasota that suddenly says it wants to be a teammate -- through annexation! It put the topic on its agenda just three days after the Jan. 4 delegation death vote.

Kind of feels like a wolf has come calling in sheep’s clothing.

Changing gears a tad, you may recall I wrote last summer about the frustration felt by resident Jean Cannon -- a superstar in all things stewardship. However, she was fed up with Sarasota County doing nothing about the illegal short-term rentals. There was one operating as party central across the street from her nifty Beach Road condo.

She was also distraught about the environmental pounding the island was taking with ongoing overdevelopment -- and the notion that much more was to come in the form of highdensity hotels. Since then, we all know two of them have been approved.

Well, we lost her. She moved to Venice. Even though she remains active with issues here, this was not a person Siesta Key could afford to lose.

Her response to the delegation vote?

“It was disappointing and typical that we got a 3-3 vote -- so no one can be held accountable,” Cannon said. “I believe this vote will be a final straw for some residents. Last week, I met a woman at the nail salon by the north end by Publix who told me she is moving off the Key. “If the real estate market is hot and people have a place to go, I believe they will move.

The quality of life on Siesta key is definitely changing. I am convinced the (county) commissioners and state representatives have made -- and continue to make -- mistakes and

are killing all the aspects that made Siesta Key a community and destination for many travelers.”

Back to the Jan. 4 meeting, I wonder if the delegation members feel they are gatekeepers for the Florida Legislature. After all, it was state Rep. Tommy Gregory who said at the Dec. 8 town hall meeting that the incorporation bill would likely be ignored at the upcoming session -- especially within the current political climate where increases in taxes and additional layers of government receive a frown.

Maybe the delegation members felt they were doing Save Siesta Key a favor by circumventing the inevitable. If so, that’s a bit presumptuous, no?

And while state Rep. Fiona McFarland -- whose territory is most representative of Siesta Key compared to the others -- did indeed endorse the bill, she seemed far from convinced and certainly not enthusiastic.

I can’t help but wonder if she wasn’t exactly thrilled with the idea of waving the Siesta Key flag in Tallahassee during what will be an intense and exhausting 60 days as a second-year legislator.

You should know that there was one other incorporation effort possibly headed to the legislature -- it was going on in Palm Beach County for a community called The Acreage that filed under the new name of Town of Indian Hills. Its local delegation, like ours, shot it down in December.

But The Acreage is hardly a world-renowned barrier island like Siesta Key-- and the largest in Florida that’s unincorporated. Far from it.

During the delegation vote, longtime Siesta Key steward Catherine Luckner spoke and noted that the Siesta Key Association -- the non-profit civic group of which she’s currently president -- has been in place since 1948 and has interacted with the county’s government all that while.

Clearly, she wanted to make it clear that Siesta Key was far from a start-up community.

“Seventy-three years of government and civic history doesn’t make us a newbie,” she said as an understatement.

Here is who are the are the political newbies: Of the delegation team, Gruters (yes vote) is the elder statesman with a 2016 election date.

James Buchanan (a former Siesta Key resident who voted no) is 2018, delegation chairman Will Robinson Jr. (no vote) is 2018, Gregory (no vote)

is 2018, Michele Rayner (yes vote) is 2020, and McFarland (yes vote) is 2020.

By the way, Gruters indicated months ago that a petition number of 2,000 should be a goal that will make an impression. The group achieved it -- and it wasn’t easy, considering hundreds of residents head north for the summer. Then, Gregory suggested during his no vote that at least half of the island’s voters (about 7,500) should be represented in petition form.

Had Save Siesta Key known this in advance, I’ll bet its members would have hunkered down and landed them.

Instead, they were asked to read Gregory’s mind?

Meanwhile, as Gregory says no to new taxes, Robinson scoffs at the proposed low mill rate and budget?

Talk about a mind game. It’s unfair.

Speaking of fairness, Anand (who has been very graceful with the setback) did voice some frustration the day after the vote.

“Why,” he said, “should North Port be a city? Or Venice? They (the delegation members) represent places that added a layer of government and more taxes.

“If they can vote no on us for those reasons, they can vote to dissolve those incorporations as well. Don’t talk out of both sides of your mouth.”

Poor North Port. And to think you just built a Spring Training complex for the Braves, and they won the World Series!

Back to the sticks of unincorporated life for you.

Same for you, Venice. And to think you were almost ready to become the most famous Venice in the world!

During that cringe-worthy Jan. 4 vote, you know who made the most sense? It was Rayner, who didn’t pry and poke at perceived issues that may or not play out. If they do, that’s Siesta Key’s problem, not that of the delegation. Don’t worry, we won’t blame you!

Rayner simply deferred to the American way and left it at that.

“You people are willing to pay for it and you’re demanding it,” she said. “Who am I to tell you I know more about your community?”

Precisely.

And we end on a better “P” word.

Lawsuits related to hotels scheduled for 2023 trials

By Phil Colpas The plaintiff in a lawsuit to fight construction of a proposed eightstory, 170-room hotel to be built at Beach Road and Calle Miramar in Siesta Village has set up a legal fund and is asking fellow concerned citizens to contribute.

Back on Aug. 19, longtime resident and former Siesta Key Association president Lourdes Ramirez urged the Sarasota County planning commissioners to deny the hotel proposal as “inconsistent with the comp plan,” which has limited density on the island to 26 units per acre since 1989. The planning commission instead recommended that the county commission approve the project, which it did at its Oct. 27 meeting.

After that decision, Ramirez was first to file suit in November, contending the county did not have the authority to grant exceptions that violated the County Comprehensive Plan, which capped the number of

rooms at 26 per acre of property on the barrier islands; and that this added density will also cause traffic and safety problems.

According to Ramirez’ lawsuit, the proposed UDC amendment No. 32 that will eliminate density limits for hotels on the barrier islands is inconsistent with the Comprehensive Plan. Zoning amendments that are inconsistent with the Comprehensive Plan are illegal under state statutes.

Long a community activist, Ramirez is concerned about the Siesta Key residents who have joined her to fight this encroaching development.

“They’re not giving up, but they feel beaten,” she said. “When I post something about community issues, I’m getting a lot of responses. But I don’t feel the energy. We’re doing this because we have hope. But we are discouraged.”

Their reaction is understandable, especially considering that the county commission has recently

greenlighted two large-scale hotel projects and a four-unit beach condo to be built on Siesta Key. What’s more, there are still two other proposed hotels that haven’t yet been approved. “The fact that those two other hotels are still possible means we really have to make sure we win these lawsuits,” Ramirez said.

“We need to make sure we get this done.”

Ramirez explained that it will not be a trial jury, despite briefly being listed as such on the county clerk’s website. The tentative schedule for the case has been released; it is as follows: Pre-trial conference Feb. 21, 2023; Docket sounding March 21, 2023; and the trial begins March 27, 2023, for a three-week trial term.

“Several people approached me thinking it was March of this year,” Ramirez said. “Unfortunately, the process takes longer than that.

Football family is tackling a busy life in paradise

Q A

The Haley family of football fame lives on Siesta Key. Tell us what brought you here.

Todd: We were leaving Ohio, and weren’t sure where we wanted to land. We had a couple of years to be able to semi retire from the NFL and came down to Siesta for a vacation.

Chrissy’s “second” family -- great friends from childhood -- are native to Siesta Key. Cindy Naughton of that family was born to a father named White -- as in White Lane -- and her mother is a Higel -- as in Higel Avenue.

Christine: My friend Cindy’s sister also married a Ringling. It’s amazing.

Todd: Chrissy started coming to Siesta Key as a child with Cindy and her family so was very familiar with the area.

We fell in love with Siesta Key as a couple in 2013 for a family wedding and started vacationing as family since then.

In 2019 on our vacation, we decided to permanently move to Siesta. We never looked back.

Seeing as it’s Super Bowl month, let’s get a couple gridiron-related questions out of the way. For starters, briefly share your family history with the sport of football.

Christine: Todd’s father, Dick, played for the Minnesota Vikings, the Washington Football Team (at that time the Redskins), and the Pittsburgh Steelers.

Once his playing career ended he started working as a scout for the Pittsburgh Steelers and eventually became director of player personnel.

Dick Haley is personally responsible for the drafting 13 Hall of Fame NFL players. Todd grew up in Upper St. Clair, Pennsylvania while his father worked for the Steelers.

Todd started his NFL career following in his father’s footsteps as a scout, then

transitioned into a coach for the Jets, then Chicago Bears as a position coach.

He then became an offensive coordinator for the Dallas Cowboys and then the Arizona Cardinals, for whom he coached the offense in Super Bowl XLIII. He then became the head coach for the Kansas City Chiefs from 2009 to 2011, winning the AFC West in 2010.

Todd then went on to become the offensive coordinator for the Steelers from 2012 to 2017.

He followed up his Steelers tenure as the offensive coordinator of the Cleveland Browns.

Q

Looking back, which team and/or season was most memorable? And why?

A

Todd: The Arizona Cardinals. I got to coach Kurt Warner and Larry Fitzgerald in the Super Bowl.

We played against the Pittsburgh Steelers in Tampa Bay. We were 35 seconds from winning.

The best game I’ve ever coached.

Christine: I started a staging and design business with my friend Brittan Chepak. We began our journey during the initial quarantine period in 2020. This gave us time to start up slowly and learn about the needs of the Sarasota market.

Our company is called New Wave Staging. We’ve met some incredible Realtors that we’ve partnered with some amazing design clients.

We truly enjoy what we’ve created and look forward to growing as a company.

You’ve got five active kids. What are they up to?

Christine: Our oldest daughter Taylor graduated from NYU and currently lives in Los Angeles, working for 90 Day Finance.

Our second daughter Peyton is a senior at the University of Florida (go Gators!)

Our third daughter Kady is a junior at Out-of-Door Academy on Siesta Key. Our fourth daughter Ella is a sophomore at Riverview High School.

Todd Jr. is in eighth grade at Sarasota Middle School.

Next, you were recently hired as coach of the Tampa Bay Bandits of the reborn USFL. How did that come about?

Todd: I received a call from Daryl Johnston (the former Cowboys great and Fox commentator). He’s part of the league’s management team.

I’m excited to be part of the new USFL.

Q A

Despite this hire -- and at least the team is close by -- do you two see Siesta Key as your forever home?

Christine: We love Siesta Key and love Florida. We plan on making this our permanent home.

After moving for so many teams -- seven states, seven teams -- it feels great to finally be able to call somewhere home.

2 more officers assigned to Siesta Key Beginning Jan. 6, two additional deputies from the Sarasota County Sheriff’s Office have been assigned to Siesta Key’s substation, Sgt. Arik Smith has reported.

The two will primarily work a 4 p.m. to 2:30 a.m. shift, he said, covering the entire island.

Regarding December calls, 332 of them were made and 7% were property crimes, he said during his Jan. 6 report to the Siesta Key

Association. Four involved vehicle break-ins, in which vehicles weren’t locked.

The month also involved two assault cases -- one in which a man attacked deputies during a response and another in which an individual threw an item at another person at the weekly Siesta Beach drum circle gathering.

Speaking of Riverview, Todd was named offensive coordintaor there in 2020. What’s the story?

Todd: My friend T.J. Nutter -- a Riverview alumnus -- and head coach Josh Smithers asked me to join the Rams, so I happily accepted. I had never coached high school football before, so this was quite the adjustment from the NFL. I’ve enjoyed working with the kids and the coaches.

That was the question that the non-partisan Sarasota Tiger Bay Club tackled in mid-January during the group’s monthly luncheon meeting at Michael’s on East.

The issue has become increasingly controversial, dividing waterfront land owners from those who believe that the beaches of Siesta Key and all the coastal areas of the state should be open to everyone. In Florida, Eger reported, 80% of the coastline is privately owned, including 60% in Sarasota County.

The questions of not only who owns the beaches but also who can access those sandy shores have been argued for centuries. The Romans, McCarthy noted, viewed all beaches as public domain.

Currently, Hawaii, North Carolina, and Texas are among the few states that allow public access to the sandy beach in front of a private property.

Here in the Sunshine State, according to Eger, public access is definitely not the case. Citing the controversial 2018 Florida Statute 163.035 that then-Gov. Rick Scott signed into law, known as the “Establishment of Recreational Customary Use” bill, Eger said that the legislation greatly diminished the ability of local governments to provide the public the right to area beaches. The rights of private property owners to establish ownership of beachfront property, he advised, has increased dramatically since the bill went

into effect.

“It’s all about the money,” said Luckner, speaking to the issue of public access and privately owned Siesta Key beaches. Confusion about public access, she noted, could have a negative impact on tourism.

“We are global now. We have people from around the world and cultures have different ideas about beach usage. These issues are going to be a clash of tourism, which benefits us economically. We have to find a way to balance it,” she said.

In late 2021, private land owners gained more strength when Sarasota County passed an ordinance that allows owners of private property to post no trespassing signs on their beaches without a permit. The only answer to allowing more public access

to the Siesta Key beaches and to beaches throughout the state, Eger said, is to acquire more public beach property.

Discussing the rights of waterfront property owners who in some cases have gone so far as to plant signs in the sand and rope off portions of the beach in front of their homes, Eger cited Siesta Key’s Shell Road, also known as Siesta Key Beach Access 1, as a beach that has been a source of controversy.

Better communication, Luckner noted, can improve relations between private beachfront land owners and visitors.

“We need to talk more to our tourists about what beaches are public and private,” she said.

Luckner praised the efforts of Visit Sarasota, the county’s tourism board, citing the organization’s campaign that promotes Sarasota County’s numerous public beaches found throughout the county. She noted that the Siesta Key Association and other local groups are working to increase communication within the community.

Public beach access, Luckner said, goes beyond allowing visitors enjoying a few hours on the sand. She said that private property owners face downsides that include instances of having to confront illegal activity and times when visitors leave trash and debris behind that the owner must clean up.

On Jan. 4, the non-partisan efforts of Save Siesta Key to achieve a referendum on incorporation were supported by Fiona McFarland and Joe Gruters, both of whom represent the voting residents of Siesta Key, and by Michele Rayner, who eloquently expressed her rationale for following the lead of her two colleagues.

Unfortunately, their support was nullified by the opposition of the other three delegates, none of whom represent a single resident of unincorporated Siesta Key. The reasons offered for their no votes were varied -- insufficient funds budgeted Lexow for infrastructure, failure to include Bay Island, proximity to the city of Sarasota, failure to obtain signed petitions from a majority of voting residents -and Save Siesta Key offered reasonable rebuttals to each of these arguments.

However, I suspect the real underlying reason for the three no votes are rooted in our current state politics.

When Save Siesta Key started our effort to achieve a referendum, one of the three consultants we hired was Jon Moyle, an experienced and respected Tallahassee attorney, municipal government expert and lobbyist, who spoke on our behalf Jan 4. Early on, we asked Jon to assess our chances for success, and he spoke to us at length about the prevailing political climate in Tallahassee. In a nutshell, our Florida state government is gradually asserting more power over local municipal governments, while reducing the powers of local governments. Jon cautioned us that our effort to reach a referendum on incorporation would be difficult in this current political climate, and I think the outcome on Jan 4. validated his prediction.

Recently, this political climate in Tallahassee has spawned a new potential obstacle to the concept of “home rule.”

According to the Florida League of Cities, “home rule” is a cherished concept, supported by an overwhelming majority of Florida citizens.

It is the foundation for local governments ... and is included in our

state’s Constitution (Article VIII, Section 2(b)).”

But Florida House Bill 1035, filed on Dec. 27, would require a non-binding referendum before a bill for incorporation can be filed in Tallahassee -- and incorporation would have to be supported by a supermajority of 60% of affected residents casting votes before the bill can be filed. This bill was introduced by representative Jayer Williamson, after a hearing in Santa Rosa County during which Mr. Williamson refused to support the Navarre community’s proposal for incorporation.

I would encourage Siesta Key residents who oppose this bill to convey their opposition to their elected representatives.

The process whereby a community like Siesta Key reaches a referendum on incorporation is a political process, but only one of our board members, Harry Anand, has real political experience; Harry was a three-term mayor of Laurel Hollow, New York.

Save Siesta Key is a “grass roots” group of Siesta Key residents united primarily by our common desire to preserve the quality of life on Siesta Key for residents, property owners, business owners, and visitors. None of us live in high-rise condos with views threatened by proposed giant hotels.

None of us have any political aspirations, and none of us wish to serve on our proposed town council. None of us are opposed to development, but we advocate development within reasonable limits, consistent with the carefully crafted rules and regulations of the Comprehensive Plan and Siesta Key Overlay District. None of us are opposed to the construction of “high-end” hotels on Siesta Key, but we agree with Mark Spiegel and the Siesta Key Coalition that new hotels should be boutique hotels, consistent with long-established codes.

Save Siesta Key hired professional consultants to create a “government lite” charter and budget for our proposed town of Siesta Key. Bill Underwood, who has 20-plus years of experience in local municipal government finances, is confident that the town can operate with a 0.25 ad valorem millage, with a significant revenue surplus.

Contrary to “facts” misrepresented in a recent op-ed, there are 20 municipalities

in Florida (out of 411 total municipalities) that have no ad valorem tax whatsoever.

(These municipalities obtain their funding from other sources, such as special assessments and utility fees).

The Town of Siesta Key could operate with a millage of 0.25 because of our total taxable property value of greater than $5.7 billion, and because of our government lite model, under which we would continue most of the services currently provided by Sarasota County – services that we are already paying for and would continue to pay for.

Save Siesta Key believes that Sarasota County has done a good job of providing many services, including fire, rescue, sheriff, water and sewer. (Contrary to the same recent op-ed, Sheriff Kurt Hoffman has committed in writing to continue the same level of service if Siesta Key becomes incorporated, and his letter to this effect was included in our feasibility study).

However, we also believe the county has failed to provide adequate land use, planning, zoning, code enforcement, and pedestrian/bicycle safety oversight for our barrier island.

In summary, the goal of Save Siesta Key has not been simply to create another layer of government for the residents of Siesta Key. Rather, we have advocated for a vote on incorporation -- which, if endorsed by a majority of our voting residents, would transfer (not duplicate) oversight of planning, zoning, and code enforcement to an elected Siesta Key town council.

Unfortunately, the current political climate in Tallahassee, which in my opinion is significantly fueled by developers and their financial contributions, is opposed to any strengthening of home rule and is opposed to creation of any new municipalities – and this climate has clearly influenced certain politicians in Sarasota County. In this political climate, Siesta Key may continue to be the largest unincorporated barrier island in Florida.

Unless democracy is allowed to prevail on Siesta Key, uncontrolled development will destroy our unique charm and quality of life.

New pie guy at the helm of Solorzano’s Pizzeria

By Jane Bartnett Fans of Solorzano’s pizza won’t notice any changes to that famous Hoboken, New Jersey pie. Despite changing ownership hands at the business’ Gulf Gate location, the legendary Italian sauce will remain the same and deliveries will continue to Siesta Key. The new man running the pizzeria on Superior Avenue is Kenny Palin, the Solorzano’s longtime general manager, who began working with Phil Solorzano as a delivery guy some seven years ago.

He also now owns the Long Boat Key Solorzano’s.

In November, the two men completed a license agreement.

“I’m proud of Kenny,” said Solorzano, whose pizzeria used to be located in Siesta Key’s Village.

“He’s running my business as he always did. He always ran the stores as though he owned them.”

And the two continue to talk every day, as they always have.

“Kenny’s going to make it better than it ever was,” said Solorzano with great pride. “I haven’t worked with an apron on for about four years thanks to Kenny.”

On Valentine’s Day, Solorzano’s will prepare heart-shaped pizzas for take-out or for in-store dining. For those dining-in at the restaurant, a Cupid’s Special will be on the menu featuring a bottle of red or white wine and a pizza with two toppings for $39.

“Eventually,” he said, “we’ll do an outdoor back patio with round two-top tables and seating for 16 to18 people. I also want to add TVs on the front.”

Palin, who grew up in south Boston, had his own e-commerce business before relocating to Sarasota.

“I’m naturally a business man,” he said. “After working with Phil for a while, Phil turned me into a manager, and then I went from co-general manager to general manager. I’ve been taking care of as many as four Solorzano’s restaurants for the past few years.

“We are moving forward,” Ramirez said. “There’s a lot that might happen in the next 14 months, but at least we have a court date. We will keep you informed on the progress of challenging the county for approving the mega

hotel on Siesta Key.” Ramirez is accepting donations to help support the lawsuit.

“We’re looking at a year’s worth of legal fees,” she said. “Anything can happen, so we need to secure experts. This is impacting all of Siesta Key, a lot of people. This is a communitywide effort that will help the entire community. It would be nice for the community

to continue to help.”

Siesta Sand reached out to the county attorney’s office for comment. Drew Winchester, county media relations officer, said that the county doesn’t speak on active lawsuits with which it is involved.

James Wallace, another concerned longtime resident, filed suit in late November. His case targets both the 170-room Siesta Village hotel and Dr. Gary Kompothecras’ 120-room hotel and parking garage project at Old Stickney Point and Peacock roads.

In his complaint, Wallace alleges that the Sarasota Board of County Commissioners acted

illegally and in violation of its own procedures by adopting the Land Development Code changes without first amending their Comprehensive Plan policy which limits hotel room density to a 26 units per acre maximum on Siesta Key. His trial is tentatively slated to begin in May of 2023.

Sheriff’s Report returning to her items after a walk on the beach, she found her black Lululemon fanny pack to be missing from her bag. A nearby witness was located and stated that a white male had placed a blanket next to the victim’s belongings and then sat in her beach chair, which he then broke due to his size. The witness saw the man remove something from the victim’s beach bag and after several minutes the man left the area. A search of the beach was conducted based on the witness’s description of the man and his clothes, but no suspects were found.

Dec. 13 theft The complainant claimed he noticed that one of three prescription medicine bottles was missing from the shelf in his kitchen.

According to the victim, the only other person in the house between when he last saw the prescriptions and when he noticed one missing was an employee servicing the house as approved by the homeowners. This employee rejected having any knowledge of the missing medicine bottle. The owner was replenished by a pharmacy for his missing medicine, which he claimed to be a bottle of about 10 to 12 pills of a 60-pill prescription.

Dec. 14 theft The victim stated that after she walked off the beach into the public outdoor rinse-off shower area of her resort, she placed her black Gucci sunglasses down next to the shower. A man then came up to her and began talking to her, and when he left, she noticed the sunglasses were gone. She confronted the man about her missing sunglasses, but he claimed not to have them.

The security cameras positioned above the incident location were out of service on the day of the scene.

Dec. 21 robbery A deputy responded to a caller who stated that he had been talking with two women in the parking lot at Beach Access 12 when a group of individuals in a Ford SUV and a Chevy Malibu pulled up and began to verbally confront him. He began walking from the parking lot and the group in the Malibu followed him and cursed at him. They then hit the victim in the head with a large wooden stick, knocking him unconscious for approximately 35 to 45 seconds.

When the victim woke up, he was across from the 7-11 down the road and his Samsung Galaxy Watch, iPhone 12, Samsung flip phone, and Golf PG backpack

were all missing. The victim had an injury to the back of the head, three injuries to his left leg, and an injury on his right leg when police arrived.

While the police were interviewing him about the incident, he became uncooperative and began threatening and aggressively swinging at an officer. He was then detained and placed in a patrol car until EMS arrived and transported him to Sarasota Memorial Hospital, where he calmed down and gave officers more information about the robbery.

Police have not yet been able to retrieve surveillance video from cameras near the incident location, and the investigation is still active.

Dec. 29 burglary The complainant reported a blue tricycle missing from the car port under which he had put it the night before. The tricycle is worth about $600, but the model and serial number are unknown. There are no suspects at this time and there was no surveillance footage near the location.

Dec. 30 battery, trespassing A patrol officer was notified that a subject was refusing to leave a nearby establishment after being asked multiple times. The complainant stated that the subject appeared

to be under the influence of alcohol and narcotics and had entered the bar without permission. After she was told to leave the bar, the subject began walking around outside of the bar and causing a scene with patrons and staff members. The subject tried to sneak into the bar again and, after being told to leave once more, she continued to walk towards a side entrance to the building.

The subject had an open can of alcohol in her hand, was slurring her speech, and had a strong odor of alcohol coming from her.

A police officer placed her under arrest for refusing to leave the bar when asked, and, while another officer was putting her into their patrol car, the subject became aggressive and began kicking the officers.

She was held to the ground and restrained by an officer for both of their safety, and then put into the patrol car once more.

One officer had several scratches and lacerations to their right forearm. The subject was brought to the hospital after claiming to have been sexually assaulted by the officers when they took her to the ground, but was returned to the jail upon receiving medical clearance.

Dec. 30 theft The complainant stated that upon

Dec. 30 vehicle burglary The victim claimed that after placing his backpack on the beach, he took his cellphone to the nearby pavilion to charge it. When he soon returned to his items, he noticed that the keys to his vehicle were missing from his backpack. Thinking he dropped the keys somewhere, he conducted a search of the area, but could not locate the keys. He then went to his vehicle to check for his keys, found that it was unlocked, and saw that his suitcase was missing from the trunk of the vehicle along with all of its contents.

There was no video footage of the incident and no suspects have been identified.

Jan. 5 grand theft The complainant stated that she had rented an electric bicycle and a kayak from a nearby business, and had locked the bicycle to her condo’s bike rack. A police officer reviewed video footage from the condo that showed an unknown subject enter the property on a bike with a fishing pole.

He parked his bike across from the stolen bike and then proceeded to cut the lock cable on the victim’s bike. He could be seen leaving his own bike and fishing pole and leaving the property on the stolen electric bicycle. The police officer was not able to get fingerprints off of the fishing pole or the bicycle.

Watch for changes in RMDs Sarasota Local Brings Experience & Trust to Siesta Key If you’re a certain age, you’ll need to withdraw money from some of your retirement accounts each year. But in 2022, the amount you must take out may be changing more than in other years – and that could affect your retirement income strategy.

becoming depleted. The longer these accounts can stay intact and remain an asset, the better for you.

Here’s some background: Once you turn 72, you generally must start taking withdrawals, called required minimum distributions, or RMDs, from some of your retirement accounts, such as your traditional IRA and your 401(k) or similar employer-sponsored plan. Each year, your RMDs are determined by your age and account balances. This year, the life expectancy tables used by the IRS are being updated to reflect longer lifespans. This may result in lower annual RMDs than you’d have to take if this adjustment hadn’t been made.

If you’ve started taking RMDs, what does this change mean to you? It can be a positive development, for a few reasons:

• Potentially lower taxes: Your RMDs are generally taxable at your personal income tax rate, so the lower your RMDs, the lower your tax bill might be.

• Possibly longer “lifespan” for retirement accounts: Because your RMDs will be lower, the accounts from which they’re issued – including your traditional IRA and 401(k) – may be able to last longer without

• More flexibility in planning for retirement income: The word “required” in the phrase “required minimum distributions” means exactly what it sounds like – you must take at least that amount. If you withdraw less than your RMD, the amount not withdrawn will be taxed at 50%. So, in one sense, your RMDs take away some of your freedom in managing your retirement income. But now, with the lower RMDs in place, you may regain some of this flexibility. (And keep in mind that you’re always free to withdraw more than the RMDs.) Of course, if you don’t really need all the money from RMDs, even the lower amount may be an issue for you – as mentioned above, RMDs are generally taxable. However, if you’re 70½ or older, you can transfer up to $100,000 per year from a traditional IRA directly to a

qualified charitable organization, and some, or perhaps all, of this money may come from your RMDs. By making this move, you can exclude the RMDs from your taxable income. Before taking this action, though, you’ll want to consult with your tax advisor.

Here are a couple of final points to keep in mind. First, not all your retirement accounts are subject to RMDs -- you can generally keep your Roth IRA intact for as long as you want.

However, your Roth 401(k) is generally subject to RMDs. If you’re still working past 72, though, you may be able to avoid taking RMDs from your current employer’s 401(k) or similar plan, though you’ll still have to take them from your traditional IRA. Changes to the RMD rules don’t happen too often. By being aware of how these new, lower RMDs can benefit you, and becoming familiar with all aspects of RMDs, you may be able to strengthen your overall retirement income situation.

Yep, our repetitive subconscious mind will repeat the same thoughts based on our own personal beliefs about all things in life.

If we are so inclined to begin to ask ourselves internally this question and have the awareness to get the running dialogue script, we would discover that much of our suffering is self-inflicted in our mind. What we say to ourselves is the most important thing we can begin to observe and then change.

When we begin to pay attention to our thoughts, we must be aware of what we are saying about our life.

These are the beliefs that we hold.

Do you believe you have the right to be happy? Do you trust yourself to make good decisions? Do you believe that you are doomed to genetic illnesses or that money is evil?

Do you believe there is a loving God that will support you?

Your beliefs create your habitual thoughts, and your thoughts create your emotions. So, if you want to feel good, think good positive happy thoughts. If you want to feel bad, you will most likely want to think self-defeating, negative, fear filled thoughts.

These very simple but new beliefs will have a drastic impact on one’s emotions and therefore their experiences when cultivated repetitiously in one’s life.

I know that some may have a hard time with the idea that our thoughts create our reality, but give it a few weeks in your life. Observe your judgments of life, your self-talk and your words that you speak freely. By doing so you will become more aware of the words that are manipulating your own emotions and most often creating suffering.

If we wish to master our own mind and live our best life, we must be willing to put in the work and intentionally begin to shift our thoughts.

Join Jane on her first parasailing adventure, courtesy of the seasoned pros at ParaSail Siesta

P

arasailing above the emerald green waters of the gulf, all by myself, watching people walking and playing along the shoreline of Siesta Key, I said out loud “This has got to be one of the coolest things I’ve ever done.”

With no one to disagree with me, I felt pretty good about this amazing adventure. I felt like a kid on a swing.

“It’s just like parachuting,” I thought as I drifted through the air. “Yeah, but I’m not jumping out of any airplane,” I said to no one. “I think I’ll stick to parasailing!”

When my editor asked me to write an article about ParaSail Siesta on Siesta Key, my plan was to head out with a group and observe other people as that beautiful parachute held them up in the air. After visiting the office, I learned that all of their boat captains hold United States Coast Guard licenses and all company vessels are Coast Guard certified. The next day, a text came saying that they’d had a cancellation. “Would I like to go out with a group the next morning?” it read. I sent back a quick “Yes!” Maybe, I thought, I’ll be brave, and try it.

After arriving at the ParaSail Siesta office, I met Capt. Bobby Powers. He led our group of 11 intrepid parasailers to our comfortably equipped open boat on the canal behind the building, with seating for 12. With the temperature in the low 70s and only a slight breeze, it was a perfect day to be on the water. As we headed out under the Stickney Point Bridge on our way to the Intracoastal Waterway, happy Calypso music floated through the air. We spotted a few playful dolphins enjoying their day, and as we entered the mouth of the gulf, we came upon our Air Force One motor boat crew, waiting to take us out to open waters. Capt. Markus Scott and first mate Max Paris, both veteran sailors, greeted us as they pulled alongside our boat. I had to remind myself that I was working.

“Welcome aboard,” said the captain as we transferred to Air Force One and Powers headed back to the Intracoastal. As we settled in, our first mate asked to put our sneakers under the seats and to stow any bags.

“How many of you have gone parasailing before?” he asked.

Only one woman in the group, who was onboard with her 10-year-old son, had parasailed before.

“I loved it,” she exclaimed. “It’s below zero in Wisconsin where we come from. How can you not love this!”

Her son looked uncertain about the whole situation.

Soon, we were underway. After cruising along for about 20 minutes, it was time for the first two passengers to parasail.

“Hey guys, you want to be the first to go?” Paris said to two teenage boys in the group.

“Ready,” they said.

The first mate helped the teens suit up in their parasailing gear and regulation lifejackets and then directed the pair to sit on the cushioned seating behind the captain. After hooking the parachute to their gear, Scott gradually increased the engine’s speed and called out “Have fun boys!”

Laughing and waving, the boys drifted up in the air as Paris snapped their photos.

About 15 minutes later, it was time to bring them in.

“Awesome” they said to each other, after their smooth landing on the deck.

As the boys took off their lifejackets, Paris said to me “Conditions are perfect today. The water is like glass and there’s no wind. Generally, we send up two people at a time, but since conditions are so calm, we believe Continued on page 28

Incorporation shot down municipality on Long Island who was among the presenters on Jan. 4, looked at the bright side of the disappointing outcome.

“No one has ever taken incorporation this far,” he said of effort that has been discussed off and on for years. “It came down to a 3-3 vote. I think we learned a lot and the community learned a lot.

“We’ll need to do better and hopefully get another shot.”

Had the delegation supported the bill, it would have gone to the Florida Legislature where it would have to be approved by the House, the Senate, and the governor.

Then, a local referendum needing majority vote would be the final requirement.

The three dissenters voiced concerns regarding the small .25 mill rate being proposed, the modest number of five employees being proposed, and the challenge of paying for improvements to the Key’s infrastructure -- identified by Anand as pedestrian and bicycle safety and beatification to the island’s entrances, per an online survey conducted by his group -- with a proposed budget of only $3.7 million.

“You are setting yourselves up for failure,” Robinson, the chairman of the delegation, said.

Added Gregory, “I am not convinced this is going to do what you think it is going to do -- not at .25.”

Further, Robinson considered the idea of five employees as “ridiculously low,” noting that Longboat Key has roughly the same amount of property value and is similar in land size and population but employees 130. It has a mill rate of slightly more than 2.

Noting that Longboat’s annual budget is about $17 million, he asked “Why can Siesta Key stand significantly alone?”

Robinson also pointed to a Dec. 1 memo from the state’s office of Economic and Demographic Research that said the Siesta Key financial plan seemed “deficient” -- a comment to which Save Siesta Key did offer a response with more detail, it reported.

six years later but had to establish a higher mill rate than the .25 mill suggested by Save Siesta Key. The difference, he said, is the that Siesta Key has about $6 billion in assessed property value that saw an 18% increase during the past year with no signs of dipping.

“The goose that laid the golden egg is our property values,” Hensey said.

Robinson also objected to the fact that Siesta Key is within 2 miles of an existing municipality -- referring to a buffer requirement the delegation acknowledged has been often waived elsewhere in the incorporation process.

Still, he said he didn’t like the idea of residents on the same island having two different mill rates -- with city residents on the Key currently paying more than 3 mills.

“We should get everyone in at the same time,” he said of an idea to bring the city residents on the north end -- mostly on Bay Island -- into the incorporation effort.

Anand responded by stating he found nothing in the state’s statutes that allowed for the merging of residents into an entity -- unincorporated Siesta Key -- that doesn’t exist.

Defending ‘government lite’ Save Siesta Key brought in consultant Bill Underwood from the east side of the state to discuss his feasibility study. He defended the low mill rate -- one that would require a tax increase of $96.75 for the owner of the assessed average value of a home on the Key, which is $440,062.

“None (of the other incorporation applicants in state history) have been able to meet our main objective of .25 mill. It’s a positive aspect,” he said.

It represents a “government lite” philosophy with an emphasis on dictating land use that features a few critical employees such as a town manager, clerk, and code enforcement officer. It then outsources many services it currently gets from the county, such as law enforcement and EMS/fire protection.

Despite a letter from Sarasota County Sheriff Kurt Hoffman in which he pledged his support, Robinson said he was worried that the county could limit it or strip it if the money isn’t there.

41 and Stickney Point Road at the gateway to the island, the dredging of neighboring Big Pass to renourish Lido Key’s beaches, and subsequently the approval of two high-density hotels with two more coming up for vote.

“It’s not about raising taxes or expanding government. It’s about returning the power to this community,” Gruters said.

Meanwhile, of the 20 public comments at the Jan. 4 meeting, only one expressed a view against incorporation.

Dozens more submitted written support to the delegation and were acknowledged by name.

Lobbyist Jon Moyle was also brought in from Tallahassee to discuss how he’d support the bill at the Capitol, saying he’d emphasize the fact that Gruters and McFarland were in support.

“There should be a level of deference to those who represent the area,” he said.

He also reminded the delegation that it’s important to let the people vote -- something Anand has voiced on numerous occasions in front of the delegation.

“I compare this to the (Sarasota) county becoming its own 100 years ago. Let the process continue to work,” Moyle said.

Gruters, who enthusiastically pledged his support for the first time at the Dec. 8 town hall meeting, did the same again.

“This is about a community organizing to take back control -- the control of what happens within their border, control of decisions that impact them on a daily basis, and control overall about their quality of life,” he said.

Siesta Key has always been governed by Sarasota County. Save Siesta Key was created in March in reaction to recent county decisions including the approval of the Siesta Promenade project at U.S.

More signatures, please But Robinson pounded home on the lack of support by petition -- noting that the 2,360 collected -- about 1,600 from which came from registered voters -- was inadequate in his mind.

Per the application process, petitions from only 10% of the voting community is required in an incorporation application. That threshold was easily met.

Siesta Key has about 7,500 registered voters within a population of 8,915, the feasibility study indicated.

“If it was close, I’d be willing to put it on the ballot,” Robinson said of a lack of a majority in the petition numbers. “But it’s not even close.”

As for Gregory, who at the town hall meeting said legislators at the state level would be against any kind of tax increase for residents of a community and thus would potentially not even entertain Siesta Key’s bill, did give Save Siesta Key some specific advice if it decides to try again. His three suggestions: 1. Collect petitions from 50%-plus-1 of the residents.

2. Include the north-end residents. “It’s not logical to divide the city residents with the rest of the Key.” 3. Cap the mill rate of .25 for the first few years.

“Put your money where your mouth is.”

Added Robinson in closing, “Something clearly is broken,” he said of Siesta Key’s relationship with the county. “But I don’t see this as a close call. And you’re dividing residents. There are also problems with the feasibility study.

Save Siesta Key: ‘... no intention of giving up’

By John Morton Certainly frustrated, but thoroughly undaunted.

That is how members of the Save Siesta Key incorporation group felt, and stood, after the tie vote (3-3) by the Sarasota County Legislative Delegation on Jan. 4 that killed, for now, the bill that many in the community hoped would progress to the state capitol for consideration and then to the local ballot.

Now, the earliest Siesta Key could become a municipality is Dec. 31 of 2023. If it again pursues that goal, it must start from scratch with the application process.

“We are disappointed with the outcome of last night’s vote, but we are not discouraged,” read a Save Siesta Key statement on Jan. 5.

“We are currently evaluating our next steps and have no intention of giving up. We are so grateful

for the support of our community and the volunteer neighborhood ambassadors.”

The Hon. Harry Anand, a Save Siesta Key board member and former mayor on Long Island who twice down the stretch made presentations to the delegation, shared optimism with his fellow board members and the ambassadors with an email the day after the vote.

“I am proud of the fact that this small community came together to take control of our island. This is true civic engagement,” he said, in part.

Anand also added, “This is by no definition a defeat. I agree that we have a road map for the future.

I am confident that this community will pick up from here and make it happen two years from now.”

How the board will look going forward is unknown. The seven members are currently Anand, Tracy Jackson, Lisa Choate, Chuck Byrne, Steve Lexow, Tim Hensey, and chairman John Davidson.

Original board member Rick Munroe stepped down in September.

As for Davidson, who first spearheaded an incorporation effort in the 1990s but dropped the pursuit when Sarasota County agreed to work more closely with Siesta Key, he said he will no longer serve as chairman.

“I just don’t have the time. I still work a regular job. And now I’m 90,” Davidson said. “But I still want to be involved.”

Meanwhile, Jackson said the group will still collect petitions and donations.

During the Jan. 4 delegation meeting, it reported it had collected 2,360 petitions, about 1,600 of which came from registered voters – plenty more than the 10% required by state statute in the incorporation application process.

Siesta Key has a population of 8,915, with about 7,500 registered voters.

However, the delegation during the vote voiced it wanted to see petitions of support from at least half of the registered voters if there is another incorporation attempt.

“We learned what we needed to do for next time,” Jackson said. “We’ll be addressing those concerns more thoroughly. We are not going away.”

Ways to do that, Jackson said, would be by recruiting more neighborhood ambassadors (about

30 are on board now) and adding more board members who possess sought-after areas of expertise that the board will soon be identifying.

“We’re looking from the cream of the crop to step up,” she said of potential additions to the board.

Regarding donations, Save Siesta Key as of Jan. 10 had collected $122,014 from 417 contributors.

Lexow, the board’s treasurer, reports that $77,944.52 has thus far gone out in the form of expenditures that include marketing, the hiring of consultant Bill Underwood to create a required feasibility study, for attorney Bob Pritt to write a required town charter, and for the hiring of Tallahassee lobbyist Jon Moyle, who was prepared to work with legislators during 2022 session.

that you’re good to fly alone. When you’re up there, it’s like meditating, it’s such a great feeling of freedom, you’ll love it.”

My bravery nearly left me. Paris must have sensed my hesitation.

“Come on Jane, you’re gonna love it,” he said.

As fast as any doubt came to my mind, it vanished. “OK,” I said. “Yes.” Paris smiled and went to help the young boy and his mother suit up. “It’s really fun,” said the mother to her son.

He was still unconvinced. As the parachute lifted them above the water the young boy began to smile and laugh. Away they went. Three more pairs of parasailers followed.

All 10 passengers agreed that they were glad not to be back home in Wisconsin, New York or Connecticut, where there was snow and ice and below freezing temperatures.

My mind flashed back to freezing days in New York City and Long Island.

“All right,” Paris said to me, “You’re up.” After stepping into my gear and lifejacket I was ready.

“Just scoot over here,” he said as I sat on the deck. Back straight, legs in front. Paris hooked the parachute to my gear.

“Have fun!” said the captain.

Within moments, I felt Air Force One gradually picking up speed and I was flying.

Waving, Paris gave me a thumbs up. The parachute lifted

me higher.

“Smile, wave for the camera,” I heard him say. Looking down, the people on the shore became smaller. A sense of peace and calm enveloped me. The next time, I thought, “I’ll bring someone along to talk to.”

When the gradual descent brought me closer to the boat, I realized that my time in the air was coming to a close. “Want to dip your toes in the water?” “I heard the captain say.

“Sure,” I yelled back as my feet grazed the water.

“Time to come in” I heard. “OK Jane, back to a seated position.” As I straightened my back and put my legs out in front of me, I glided effortlessly onto the deck.

Currently, Siesta Key’s population of 8,915 represents about 2% of Sarasota County, which governs the Key. If part of the city, that would increase to more than 16%, With or without a commission seat, it could have more say.

“If you incorporated into the city, you’d have a stronger voting block,” McFarland said.

Harry Anand, a board member with Save Siesta Key, informed McFarland that his group was not interested in that -- not only because it was still a small percentage of representation, but inheriting the city’s 3.13 mill rate would be a huge tax burden. Save Siesta Key was proposing a .25 mill rate to start a municipality.

Arroyo said the inclusion of Siesta Key, however, could drop the city’s millage rate down to around 2.0, thanks to its roughly $6 billion in assessed property value.

And the mayor said he’s feeling that Save Siesta Key could soften to the idea.

“At first I knew they wouldn’t be crawling to come to the city. It was at first an adamant no,” he said. “Now, I think they’re open to it.

I just wanted to start the conversation.”

When notified on Jan. 7 about the annexation topic being listed under “new business” on the city agenda, Save Siesta Key chairman John Davidson said it was the first he’d heard of it being a discussion item.

“That’s news to me,” he said, “and that’s not what we want to do.”

Regarding potential future talks, Sarasota commissioner Liz Alpert said “It’s an excellent idea. Why have them re-create all the things we already created in Sarasota?”

One Siesta Key resident, Lourdes Ramirez, was in attendance to speak on the topic. She recently sued the Sarasota County, which governs Siesta Key, over the approval of a high-density hotel.

“It’s interesting to hear it out,” she said of annexation, warning Arroyo that discussions with Siesta Key citizens will be challenging.

“You’re going to get a lot of angry residents. Like me.”

Commissioner Hagen Brody made note of Ramirez being alone. “It’s a little concerning that this was publicized, but there’s only one resident. This would require a referendum. So, there needs to be a little more excitement,” he said.

Added commissioner Jen Ahearn-Koch, “This can’t be against their will. I’m not interested in dragging Siesta Key in kicking and screaming.”

Arroyo said there was no hurry in trying to arrange dialogue with Siesta Key residents.

“We weren’t trying to force annexation

today,” he said, “or there would have been 100 people here.”

Instead of spending city money on putting together some sort of presentation or report, the mayor said he’d instead just encourage informal talks with Siesta Key leaders.

Robert Fournier, the city attorney, also suggested that the city wait to see if there’s any outreach from Siesta Key residents, now that they know there’s interest in annexation.

Any annexation process would go as follows: A feasibility study by Sarasota would be required, proving the ability to provide adequate services; two public hearings would be held; a commission vote would be held; and then a referendum would

take place that could be limited to just city residents or both city residents and the residents of the area subject to potential annexation.

The Sarasota commissioners said a referendum that would include both would be the likely scenario.

Currently, several hundred homes in the northern part of Siesta Key -- known as Norsota and most of which exist on Bay Island, just over the north bridge -- are already part of the city of Sarasota.

In a twist, Anand said that McFarland suggested to him the day after the unsuccessful delegation vote that Save Siesta Key should consider including them in any subsequent incorporation attempt.

in play on the same island, had Siesta Key become a town, did not sit well with state Rep. Will Robinson Jr., the delegation chairman, who represents the norther part of the Key. Because no statute allows for the inclusion of an incorporated area into a non-entity, Anand said, those residents were left out of the application.

However, if they secede from the city, they could be in play.

Anand has noted that many residents on the north end have voiced an interest in being part of a Siesta Key township, but the secession idea “would be a long, complicated process.”

He added, “We always thought we’d maybe bring them in after the fact.”

Arts on the Horizon By Rodger Skidmore Is this year 4 of COVID?

S

ure seems like it. But then time flies when you’re having fun.

And speaking of flying, wouldn’t it be fun to fly out of here and escape Sarasota’s freezing temperatures now that they’re way down in the 60s? But there are so many countries that won’t let us in, and that makes it hard to plan on where to take a vacation, or even just a quick get-away, from this, our winter of discontent. Peter Pan made his get away by jumping out of a window so he could fly to Never-Neverland -- not my cup of tea. Perhaps the best place to go would be the true land of Make Believe. Yes, the opera.

But where to go? Italy is not particularly warm right now, but in make-believe Rome it is just the place to go. Something really hot is going on there starting Feb. 12 and on seven other days through March 19. Specifically, the Rome of Giacomo, Luigi, and Giuseppe -Puccini, Illica, and Giacosa -- music and poetry by the experts.

And yes, music and poetry are just what we need.

For some unfathomable reason, the Sarasota Opera’s first offering of 2022 actually has a plot. And there is a lot of plotting going on. An escaped prisoner is trying to evade the clutches of an evil chief of police, Scarpia (Stephen Gaertner). Scarpia uses the love that sultryeyed Tosca (Ann Toomey) has for her lover, the painter Cavaradossi (Ben Gulley), to set a trap for two good guys, and to have his way with her. A not nice guy trying to do not nice things to a very nice girl. We know she is very nice because they named the opera after her --Tosca.

Is there a theme here? February has two operas about women (Tosca and Marie) with both operas taking place during the time of the Napoleonic wars. And both written by Italians. Well, all operas are about women, most are written

by Italians, and perhaps back then writing operas took one’s mind off war. So, no themes except the musical ones. and they are lovely.

Oh, and who is Marie (played

by Jessica Sandidge)? Why The “Daughter” of the Regiment? By daughter, the authors, on whose writings Donizetti’s opera is based, meant “mascot.”

So no, there was no hankypanky going on between Marie and the French soldiers. But being quite hotsy-totsy and in love with a Tyrolean peasant, things keep happening. But no fear, everything winds up being just hunky-dory.

Run away from home

Pity the residents of the Midwest and other strange places (and they know who they are), for they don’t have our land of make-believe -- the opera. Nor do they have our plethora of circus companies which we can run away with. That used to be the dream of many a young person across America, when so many circuses crisscrossed our 48 states. And we don’t have to actually run away with the circus to be with the circus these days, as they not only come here every year but actually are headquartered here. How can you run away with something when the place you might go to is where you are?

The big name in the land of big tops is Circus Sarasota, and it will be having its first 2022 event at the Ulla Searing Big Top at Nathan Benderson Park from Feb. 11 through March 6 (with 32 performances).

Who should go? Well, you, of course, but who else? Hate to say this old cliché, but here goes: “Children of all ages” -- especially those under 17. Also, people who don’t know that they like circuses because, after attending, maybe they will. And don’t forget to invite everyone with the letters L or T in their name -- they will love that you remembered them.

Big news, as Sarasota moves from February to March, it gets warmer. That’s not the news -- the news is that the Searing Big Top is air conditioned. Good to know now, and good to know during some summer attractions.

And what will you see? Tons of razzle, and an almost equal amount of dazzle -- or maybe the other way around -- as there is certainly going to be a lot of razzle dazzle.

There will be artists standing on things (at way too high a height), and then jumping up and down.

Or riding something while way up there. Or letting go of something while moving up there and being caught (perhaps) by someone else.

Artists tossing things at each other or climbing up on each other (wow, that high?).

And, everyone will be wearing different-colored costumes, all covered in glitter. So much glitter that your eyes will sparkle.

And, get this, they will be playing circus music. During intermission people called vendors will try to sell you some pink fluffy stuff. Don’t get it in your hair, it is supposed to go into your mouth. And then, magically, it disappears. All that will be left will be memories that you may keep forever. More info at circusarts.org.

Black-crowned night heron

Nycticorax nycticorax This stocky heron with its hunched-over appearance and menacing red eyes looks like it belongs in a suspenseful Hitchcock thriller!

However, the nocturnal activities of this statuesque blackand-gray bird are not as sinister as you might imagine. The night heron hunts at dark when there is less competition from other herons that have the advantage of reach owing to their long legs and necks. It employs two methods of hunting — ambush and bait fishing. Standing motionless on the shore, the heron waits patiently to ambush unsuspecting prey.

This clever bird may also toss a small object into the water to lure

a fish within striking range — a surprising example of tool use among birds.

This adept angler is also known as the “quark” bird for its nighttime call while flying high overhead.

These birds roost in colonies with nests built over salt or fresh water — including swamps, rivers, lakes, marshes, lagoons and mudflats.

The proverb “It takes a village to raise a child” is perhaps best illustrated by the night heron who does not distinguish between its own and another’s chick. For the good of the colony, it will brood any chick placed in a nest.

Petrea Volubills is in a genus of evergreen flowering vines native to tropical Americas.

For our ultra-fine sand, we thank our neighbors to the north

A

s someone who has lived on Siesta Key and Sarasota since 1980, and occasionally written about the area, I know a little something about the island’s history. But this one is new to me.

According to Dr. Philip Farrell and Thomas Philip Farrell in their 2018 book, “An Illustrated History of Siesta Key: The Story of America’s Best Beach,” our much-touted, powder-fine, quartz crystal beach sand is -- gasp -- not from here.

“Perhaps the most surprising aspect of Florida’s famous beaches in general, and the Gulf Coast barrier islands in particular, is that the sand is not indigenous,” Farrell wrote. “Not long after the Appalachian Mountain range was created, it began to experience inexorable erosion through chemical and physical weathering, reducing the chain’s peaks from as high 25,000 feet to their present maximum height of 6,684 feet, and generally much lower.”

The igneous and sedimentary rock comprising the Appalachians are some of the hardest and most durable minerals on Earth. Abundant rainfall led to huge rivers transporting an enormous volume of quartzrich sediment being transported over a period of more than 100 million years to the Atlantic Shore through the Georgia Seaway Channel.

“That long-term process filled that ancient rift to create a land bridge, Southern Georgia coastal plain and eventually carried the settlement to Florida beginning about 15 million years ago,” Farrell wrote. Sediment was transported by the 167-mile-long Apalachicola River and other rivers, bringing the sand to the Florida Panhandle, Florida platform, and ultimately to the barrier islands.

This begs a question: If our world-famous beach sand is really from the Appalachians, does this make us mountain people?

The book is chock full of Siesta Key history and photographs, and features a foreword by Sarasota County historian Jeff LaHurd.

Now that’s an Armageddon story Have you heard of the Thwaites Glacier?

Of all of our possible end-of-theword scenarios, Thwaites, the so-called “Doomsday Glacier” could have the most impact on the planet - and us - much quicker than some of the other grim predictions.

According to the MIT Technology Review, in December, researchers reported huge growing cracks in the eastern ice shelf of the Thwaites Glacier, a Florida-size mass of ice that stretches 75 miles across western Antarctica. They warn that the floating tongue of the glacier, which acts as a brace to sustain the Thwaites, could disintegrate

in five years and potentially cause more and more towering cliffs of ice to crumble and collapse.

According to scientists with the International Thwaites Glacier Collaboration, a complete collapse of the doomsday glacier could elevate ocean levels by two feet, or even by as much as 10 feet if surrounding glaciers collapse with it. Either way, it would flood coastlines around the world, threatening tens of millions of people.

Nice, huh? So, if this indeed is happening, is there any way for us to stop it?

Scientists have laid out several ways that people could intervene to preserve key glaciers. Some of the schemes involve building artificial braces through polar megaprojects, or installing other structures that would nudge nature to restore existing ones. A handful of engineering measures at the source of the problem could reduce the property damage and flooding dangers that all coastal cities and low-lying island nations will face, and also reduce the costs of the adaptation projects required to minimize them.

Researchers say that if it works, it could extend the lifespan of ice sheets for a few more centuries, giving humans more time to cut greenhouse gas emissions and stabilize the climate.

Here’s hoping. Can you imagine what 2 feet of water will look like on Siesta Key? Now imagine 10.

Champaign, Illinois, and makes his special candy cane recipe with the same kettles, tools and marble slab that his grandfather and father used.

“When I moved to Sarasota in 2004, I brought everything with me from my confectionary store in Illinois,” he said.

Creating handmade candy canes is a craft that requires the proper turn of the hand as the candy, made from water, sugar, oil, and a secret candy cane ingredient, cooks for 30 minutes in a large kettle on a hot stove at 400 degrees. When it reaches a taffy-like consistency, the thick liquid is the color of gold as it is poured onto a marble slab.

“It’s a physically challenging process,” Vrinios said.

As the candy cools and hardens, Vrinios sprinkles peppermint oil and blends it in. Wearing specially made gloves, he places the hot mixture on a large metal hook on the kitchen wall. For another 45 minutes, he pulls and stretches the candy while continuously looping it back on the hook. As it cools, the color gradually changes to a creamy white. When it reaches the right consistency, he places the heavy blob of candy canes to be onto the marble slab.

After separating the mixture into three separate pieces, Vrinios hands off two sections to his “candy cane elves.” One assistant adds red food die and the other adds green food die.

All three pieces are then kneaded like a loaf of unleavened bread. After rolling, stretching and kneading the three lumps together as one, the festive red, green and white stripes begin to appear. When the long roll of candy reaches the proper candy-cane width, it is cut into 100 separate pieces per batch and then shaped into canes.

“No two candy canes are alike,” Vrinios said.

Ben Kaminecki opened the Siesta Key Fudge Factory store in 2013 after establishing his first shop on the boardwalk in Wildwood, New Jersey, in 2002. He owns all three locations.

Now that the busy winter season is upon us, the Fudge Factory is bustling all day long. Customers drop in to take home one of the shop’s 12 different hand-whipped creamy fudge selections that it creates each day, or to enjoy a scoop of homemade ice cream -- although picking just one of the 45 ice cream flavors can be a challenge.

Customers also stare in awe at the glass cases filled with caramel apples, brittle, an endless array of candies, chocolate covered pretzels, and chocolate and caramel turtles that are also known in the Midwest as bear claws.

There is even a selection of chocolate-covered bacon.

“Candy makes people happy,” Lygnos said.

The smiling faces of those leaving the store with their sweet treasures proves her right.

Whether they’re already a part of your family, or if you’re considering adopting one, senior dogs still bring plenty of personality and can offer lots of love. Plus, unlike puppies, they’ve got a real handle on things: they’re house broken, more relaxed, and have fewer behavioral issues.

Got a senior pup? Here are a few things you can do to help them live their best life.

Meet Jesse

A Little Exercise Goes A Long Way While older dogs don’t require as much exercise to burn energy and stay healthy, you still need to keep them moving. Taking regular walks is one of the best ways to help your dog stay loose and limber – but remember, older dogs don’t have the same agility and stamina they used to, so avoid staying out too long or presenting challenges like big hills or uneven terrain.

Another alternative? Take them for a dip!

Swimming is an excellent activity for senior dogs as it’s easy on older joints, and can help maintain muscle while keeping weight stable.

Take Time to Stimulate the Senses Just like us, senior pets also need mental stimulation to keep the gears moving. From fresh toys to puzzles and games, there are a number of wonderful tools to help perk up your older pup.

Additionally, mixing up your destinations for walks or a quick swim can also help. By introducing unfamiliar sights, smells, and sounds you can keep things interesting and encourage engagement.

Still Recommended: A Balanced Diet While your dog may be getting up in years, it’s no time to indulge. Keeping your older pup at a healthy weight is vital as obesity can aggravate common problems like diabetes, heart disease, skin issues, and aging joints.

A healthy, senior appropriate diet remains essential, including more calories, highquality protein, and easily digestible foods.

A commercially prepared senior diet is a great place to start, but whole foods can also be extremely beneficial. These include foods high in Omega-3s like fish and egg yolks, bone broths for bone and joint support, and even high fiber options like pumpkin to aid digestion and reduce bowel issues.

Additionally, supplements offer further assistance in maintaining your older pup’s plan. For example, digestive enzymes and probiotics aid digestion and

nutrient absorption; vets and pet parents alike believe glucosamine to be effective against joint pain for improved mobility; antioxidants are believed to reduce inflammation and counteract aging issues like memory loss; and a component found in Omega-3 fatty acids called DHA can reduce canine arthritis and may also improve cognitive function.

In short, a dietary plan that helps prolong and enhance your older dog’s life is one that includes supplements.

Covering a lot of turf is nothing new for this pooch. Five years ago he was discovered online in Iowa by Jim, where he was purchased and then shipped to Miami, then to JFK in New York, before landing in Boston to connect with his new owner.

A few months ago, he hit the road again and relocated to Sarasota with Jim to join him for retirement life.

nshore fishing charters for the past month have been producing lots of great action.

Snook and big jack crevale have been keeping the rods bent with some redfish, sheepshead, and snapper to go with it.

We are catching most of our fish on live greenbacks while chumming, and hard plastic lures like Rapala X-raps.

Sheepshead will continue to come into our passes and hang to the structure over the next couple of months along with pompano.

Be sure to keep an eye on the weather radar before your next trip out as these fronts bring some pretty high winds.

The new year it brings the reopening of our red grouper offshore. Red groupers are a great fish to target, providing a great fight and even better table fare. We usually start to fish for red grouper in about 80 feet of water fishing around hard Swiss cheese-type of bottom.

While fishing for the red grouper you will encounter other great eating fish like lane snapper, mangrove snapper, porgies, and vermillion snapper. You can use a few different rigs when targeting them, but make sure to have heavy fluorocarbon leader at 60-plus pounds, large circle hooks, and a 4- to 6- ounce sinker.

Along with your variety of tackle, you will want to make sure to have plenty of live bait including pinfish, pigfish, and squirrel fish, along with frozen sardines, vertical jigs, and heavy bucktail jigs. My preferred method when grouper fishing is to find the best show of fish on your sonar and anchor as close to the spot as possible. When searching for new grouper spots, drift fishing can also pay off. Red groupers are 20-inch minimum in size and two per person.

Staying offshore, another fun species that provides for a great fight is amberjack. It can be found on the reefs and springs off of Siesta Key. Amberjack will eat a variety of baits and lures, similar to the bait you’d use for the red grouper. These fish will give you a run for your money, so be sure to have larger spinning and conventional rods that can handle these reef donkeys.

Amberjack like to school up, so when you find one you will more than likely find a bunch. If you can fill up your live well with live bait before your trip you can often get stubborn fish to fire up by tossing out a bunch of freebies to get them actively feeding. Where you find the amberjack, you will often find a variety of snapper species and Goliath groupers -- so make sure you are rigged up for a little bit of everything.

Land-based fishing will continue to get good as the pompano cruise the beaches, eating sand fleas and a variety of other baits. In addition to pompano, the sheepshead will continue to load up in our passes around the rocks and docks, where there are multiple access points for the land-based fisherman.

“Siesta Ready“ -- Eli, 4, wheels his favorite beach essentials onto the beach. He and his family just moved here a week ago from North Dakota after his father’s job transfer to Sarasota.

Currently staying at a hotel in North Port, his mom found Siesta Beach by looking online.

“Siesta Workout“ -- Former Fort Myers resident Brendan Cudire of Scottsdale, Arizona is focused on a vigorous game of beach paddleball.

His great hobby is birding and his favorite is the African shoebill stork. He was pleased to report they have a few in the Naples zoo.

“Shoreline Walk“ --Sisters Whitney and Hallie Bamblas of Chicago enjoy a good laugh as they walk the shoreline of Siesta Beach. They are here visiting their grandparents, who own a place right on the beach.

“Waiting for a Nibble” -- First-time visitor Gia, 8, a third-grader from Holmdel, New Jersey, patiently waits to reel in a few more fish from Patriot’s Point on Siesta Key. When at home she stays busy with design, art projects and gymnastics.

“Just the two of us“ -- Jennifer and Chad Hake of northern Indiana enjoy the warm sunshine on one of their multiple Siesta Beach vacation days.

They’ve been visiting here for about seven years and this time dropped their son off at Florida Gulf Coast University. Chad is a tool and die expert and Jennifer is a hair stylist.

“Sand City“ -- 5-year-old twins Olivia and Elodie of Billings, Montana, tower over their self-created city of sand on Siesta Beach.

Working the sand kept them busy for nearly 100 minutes.

Both love to swim, and Elodie wants to be a firefighter.

Olivia is unsure right now.

“Heavy Lifting” -- Jack, 4, of Sarasota fills his dump truck with wet sand. A fan of construction vehicles, Jack loves tractors and fire trucks as well. His favorite thing about the beach is the water. He said, “I like to slash inside the water.”

“Gulf Stroll”-- Greg and Molly of Ohio take a relaxing stroll along the Siesta Beach shoreline. Both are nurses who needed to recover from the stresses of the pandemic. When they are able to get away, this is where they visit. They consider themselves very blessed not to have come down with the virus.

“Chillin’ on Siesta“ -- From left, Brenna Grooms, Olivia Herbert, Kayla Nagle and Tazman Davis, all of southern Maryland, were here to celebrate Kayla;s 21st birthday. Brenna changes her hair color at least once a month, Olivia wants to own a Winery, and Kayla is a college psychology major.

“Stress-free Siesta“ --Fourth-grader Chloe, 9, lifetime Sarasota resident Candi Buchanan, and their cousin, Rihanna, 12, are happy to be on Siesta Beach. Chloe is an avid reader and loves the Gulf of Mexico water. Candi is a hair stylist and owns her own shop.

“The county doesn’t clean up those private beaches,” she said, recalling that when red tide was an issue, condominium owners in her building were responsible for cleaning up the many dead fish that landed on the shoreline.

As the topic turned to the mean highwater line, long accepted as the basis for determining where public land begins and private land ends, Eger stated that a major change may be coming shortly.

“In 2025, the NOAA (National Oceanographic and Atmospheric Administration) will come out with new data,” he said. “The lines that were used in demarcating private property could potentially be null and void because they no longer adhere to the kneehigh water line. Expect it will be significantly in-shore,” he said.

“The end result could mean a new highwater line.”

NOAA’s Center for Operational Oceanographic Products and Services is conducting the effort known as the National Tidal Datum Epoch. The process, the NOAA reports, “needs to be regularly revised to account

for long-term effects of land movement, sea level rise, and changes in tidal constituents.”

When a question was raised about the use of public funds for beach refurbishment, Luckner said

all three panelists agreed that protecting Florida’s beaches is everyone’s responsibility. Stressing the importance of maintaining Siesta Key and other west coast beaches, McCarthy said “We must

work together and when we do, good things happen. If we can take care of the beaches for ourselves, it will be there for the sea turtles, for the endangered birds. Shorelines equals life.”

A native of Columbia, Carolina started providing some housekeeping duties at Jamaica Royale four years ago, servicing just two units. Management was so impressed it hired the new comapny she had started -- Bright Klean -- and now her crew of 16 helpers is handling 75 units each Saturday during checkout.

“The Jamaica Royale is great. The staff members are great communicators,” Carolina said. “They say thank you to us when we do a good job and also pass along thank you messages from the owners and guests. It makes us feel appreciated.”
