Hotel Siesta Key Plans Advance Plans for the Hotel Siesta Key, a new boutique hotel in Siesta Key Village, are moving ahead. As the Siesta Sand reported in July, a PreApplication Development Review Request was submitted to the Sarasota County Planning Department in May. As described in the PreApplication, the proposed hotel would be an eight-story, 80-foot high, 170-room structure. “We will submit a formal application to the Planning Department in approximately 6090 days,” Robert T. Anderson, one of four owners of the venture, told the Siesta Sand. “That application,” Anderson advised, “will be preceded by neighborhood meetings and continued personal interactions with business and community groups.” As of late July, Anderson told the Siesta Sand, his group has completed “about 42 individual presentations.” Meetings have been held with local area organizations such as the Siesta Key Chamber of Commerce, the Siesta Key Association and the Conservation Foundation. “We’ve been very pro-active with community involvement,” he stated, noting that “the majority of the feedback has been very positive and we have been applauded on the look and

style of the structure.” Anderson went on to say that “we’re trying to get as many eyes on the project as possible.” In discussing design, construction and other future plans for the project that he noted, is still at a very early stage, Anderson said that the group is committed to working with local Sarasota businesses to build and manage the project. “We are keenly in-tune with supporting local businesses on the Key and in the Sarasota area.” Although reviews of potential construction firms, as well as the many other supporting businesses that go along with the development of a large new hotel have yet to be finalized, Anderson spoke enthusiastically of the project’s architect, Sarasota-based architect Mark Sultana, of DSDG Architecture. Sultana, Anderson said, “understands what fits Siesta Key. He has impeccable attention to detail and a good eye for placing the right products in the right places.” The hotel’s initial design plans reflect the Sarasota School of Architecture’s modern style, which Sultana’s own design embraces. Court of Appeal rules for Sarasota County in Siesta Promenade case

Each proposal calls for major changes to the Sarasota County Unified Development Code (UDC), which contains all the land development and zoning regulations. Florida’s Second District Court of Appeal has upheld a 12th Judicial Circuit Court judge’s ruling that the Sarasota County Commission did not violate any county regulations or procedures in approving the Siesta Promenade mixeduse project. The unanimous per curiam decision was issued by the three appellate court judges who conducted June 25 oral arguments in the case. As Cornell Law School’s Legal Information Institute explains it, “A per curiam decision is a court opinion issued

in the name of the Court rather than specific judges. Most decisions on the merits by the courts take the form of one or more opinions written and signed by individual justices. Often, other judges/justices will join these opinions. Siesta Key Village’s Only Medical Facility Closes… By Jane Bartnett Siesta Key Village’s only medical office has closed their doors. For the past six years, the Sarasota Medical Center, in Davidson’s Plaza, at 5132 Ocean Blvd., has served the Siesta Key community. A walk-in urgent care medical clinic and a primary care center, the office was staffed by Dr. Joaquin J. Aristimuño, Dr. C. John Mason, and Dr. Pierre Nedelcovych. A sign on the office door states that the office is permanently closed and notes that patients may see Dr. Aristimuño and Dr. Mason at the Sarasota Medical Center’s primary office, located at 2830 Bee Ridge Road, Sarasota. The lease on the 2, 904 foot square space will terminate at the end of August, Davidson Properties’ Deborah Pruitt told the Siesta Sand. The office space will be available to lease as of September 1, 2020. She noted that the property is a “very good place” for a small medical practice. Fully renovated in 2014 when the Sarasota Medical Center moved in, the facility is equipped with a waiting room, patient examination rooms, as well as doctors’ offices.

Davidson Plaza, in the heart of Siesta Key Village, has been the home of a doctor’s office since 1968, when the plaza was built. At that time John Davidson, a young pharmacist and his physician friend, Dr. Freeman Epes, worked together to develop the land at 5124 Ocean Blvd. John Davidson opened what would be the first Davidson Drugs, and Dr. Epes’ opened his medical office next door. “It was very convenient for patients to have a drug store right next door to the doctor’s office,” said Pruitt, as she shared a piece of Siesta Key history. Although for the first time in 52 years, there is no medical office in the Village, Siesta Key residents and visitors do have close access to urgent medical care should they need it. Within approximately three miles, the Siesta Sand found that by Google search there are three medical offices nearby. All however, are

The Emergency Room is open 24 hours-a-day, seven-daysa-week. An acute-care hospital with 839-beds, Sarasota Memorial offers a full line of outpatient services. In June 2020, it was named as one of the nation’s 100 Top Hospitals by IBM Watson Health. Each year, SMH cares for more than one million patients. A regional referral center, SMH also has the distinction of being the only hospital in the state of Florida to have “consistently earned the federal Centers for Medicare & Medicaid Services’ highest five-star quality rating, since the evaluation system launched in 2016.” Like many other small communities, Siesta Key faces strong competition for attracting a small primary care physicians group to the Village. According to

a report in The New York Times, primary care and pediatric practices are among the least profitable to operate. Covid-19 has also made it harder for small medical practices to remain financially viable. In April, as a result of Covid-19’s impact, a group of associations representing major physician’s organizations wrote an open letter to the US Secretary of Health and Human Services requesting financial support for practicing medical doctors. The associations listed in the letter included the American Medical Association, the Florida Medical Association, and many more. “We are writing to request immediate financial assistance for physicians across the country who are taking heroic action to treat patients with the novel coronavirus, providing ongoing care for patients with chronic conditions and urgent needs, and incurring significant financial losses due to postponing nonessential procedures and visits,” the letter stated. The question now remains, will a new medical office find a home in the heart of Siesta Key?

Financial Focus The investment world is full of colorful terms, but perhaps none is better known than “bull” or “bear.” As an investor, you’re typically rooting for the bull market, when prices are rising. But you also want to protect yourself for periods when prices are falling. Now that we’ve entered a bear market – typically defined as a market in which stock prices have fallen 20 percent or more from their recent highs – how concerned should you be? First, consider where we’ve just been. For 11 years, from 2009 to early 2020, stock prices kept rising, with some interruptions, resulting in one of the longest bull markets on record. During this time, stock prices rose around 400 percent – which means we entered bear territory from an extremely high point. This doesn’t mean the recent losses are insignificant, but market pullbacks present more of a pothole, rather than a complete detour, on the road to your financial goals. If you’ve

been investing over time – at least a decade – you still have likely made significant progress toward your goals. Here’s another point to keep in mind: Bear markets are a normal occurrence in the stock market. There have been eight previous bear markets since 1945, not including the current one, which have lasted an average of less than one year. The good news is bull markets have, on average, lasted five times longer. Of course, as you’ve no doubt heard, the past performance of the markets can’t guarantee how they will perform in the future. While we can’t predict how long this bear market will last, given the ongoing uncertainty of the coronavirus health crisis, it’s highly likely a rebound will eventually emerge, as has happened before. So, given all this, how should you respond to what’s happening? When market volatility rises and the value of

your investments declines, you might feel tempted to abandon your long-term strategy in favor of one you perceive to be lowerrisk. But instead, ask yourself some questions: • “ Have my long-term financial goals changed?” You’ve probably had your long-term goals for quite some time. For example, perhaps you’ve always wanted to retire at a certain age and spend part of the year in a different location. Do you still have this goal today, despite all that’s happened in the markets? The answer is likely yes. If that’s the case, you probably don’t want to abandon the investment strategy you’ve been following, especially given the unique nature of the current market volatility. • “ Am I comfortable with my risk tolerance?” Some investors know that markets will go through occasional shocks, and can live with

this knowledge, but others worry to the point that it negatively affects their quality of life. If you are in this second group, you may need to re-evaluate your risk tolerance and, at some point, adjust your portfolio accordingly. These are challenging times for all of us, as we think about the health of our loved ones and our ability to achieve our financial goals. But it’s important to have confidence that the current health crisis will eventually pass, and that normalcy will return. Plovers apparently bid ‘adieu’ to Siesta

Just before the midpoint of July, it appeared snowy plovers no longer were making efforts to nest on Siesta Key this season, Kylie Wilson, coordinator of the Audubon Florida’s Bird Monitoring & Stewardship in the county, reported. In a July 12 email blast to volunteers and the news media, Wilson wrote that it seemed that “all the plovers have migrated from Siesta to Lido.” “We started the season with 6 nesting pairs,” she explained, “so 12 birds, on Siesta. One of those females was banded (Ms. Sanibel) and she has not been [re-sighted] here since just after [the passage of Tropical Storm] Cristobal [in early June]. So, excluding her and her mate, we now have 10 plovers consistently in the Sarasota area. This past week I sighted all 10 together on North Lido. I sighted no Snowy Plovers on Siesta …” Wilson added that she would continue to survey conditions on Siesta; however, unless she found new nesting activity, she would not provide any further Siesta report in her weekly updates. “The plovers have had a lot to overcome on Siesta in recent years,” she pointed out. “Most likely causes of nest failures are disturbances from dogs and predation from crows and ghost crabs. It is very sad that the birds are no longer successful at Siesta. When the birds have multiple failed seasons, they will go off in search of new territory where they may have better luck. Hopefully we will see them succeed at Lido and perhaps, with some more predation management and education, the nesting potential of Siesta can be restored.” Although a county ordinance forbids dogs on Siesta’s public beaches, through the years, residents and visitors alike have flouted the regulation. Sheriff’s Office personnel and Florida Fish and Wildlife Conservation Commission staff have documented such incidents. Wilson pleaded last year for the public to be mindful of the fact that dogs scare snowy plovers into abandoning their nests; she renewed her campaign this year. Nonetheless, as she has indicated, some people refuse to abide by the county ordinance and continue to allow their dogs on the beach.

The last time the USLA conducted its Southeast Region Lifeguard Championships on Siesta was in July 2016, the News Leader learned, based on online reports. The event also was held on the island in July 2011. However, the event planned on Siesta this year was the Florida State Surf Lifesaving Championships. On June 23, the USLA Southeast Region posted an announcement on its Facebook page about the decision to cancel that competition, “in light of the recent resurgence of COVID-19 cases, deaths, and hospitalizations.” It added, “[W]e believe it would’ve been impossible to host a safe event.” One person who commented on the post wrote, “It’s hard to run with your mask on. Stay safe, everyone!” Mike Holderness, who owns Siesta Beach Resorts and Suites in Siesta Village, sent a June 23

email to County Administrator Jonathan Lewis, complaining about the cancellation. Holderness noted that county representatives had been working on the planning for the event for more than a year. His employees, he added, were counting on the reservations of participants to provide a boost amid the economic downturn brought on by the pandemic. The USLA “is America’s nonprofit professional association of beach lifeguards and open water rescuers,” its website explains. “The USLA works to reduce the incidence of death and injury in the aquatic environment through public education, national lifeguard standards, training programs, promotion of high levels of lifeguard readiness, and other means,” the website adds.

Siesta Chamber encouraging display of ‘Mask Up’ poster In a July 9 email blast,

the Siesta Key Chamber of Commerce distributed a copy of a “Mask Up” poster provided by Sarasota County staff “to help stop the spread of COVID-19 in any setting where social distancing is not possible.” The email asked members to please print the poster and put it on display. At the bottom, the poster says, “The Board of County Commissioners endorses recommendations from the Florida Surgeon General regarding face coverings in any setting where social distancing is not possible.”

Demolition set at former wastewater treatment plant

With the unanimous approval of its July 7 Consent Agenda of routine business items, the Sarasota County Commission authorized a $1,101,998.75 contract with Cross Construction Services Inc. of Lutz for the demolition of structures at the site of the former Siesta Key

Water Reclamation Facility, located on Oakmont Place. That total includes a 5% contingency, the contract notes, “for unanticipated work within the scope of the project,” and the county must authorize any such expenses. The initiative was expected to get underway in late July, with substantial completion in November, “weather permitting,” a county staff memo said. Another 30 days would be accorded to Cross Construction for completion of “punch list” items, the contract points out. Ethan Tyler Lillibridge, vice president of the company, signed the contract on June 25, the county document shows. “Residents in the immediate area will be notified by postcard of upcoming demolition activities at least two weeks prior to the start of work,” a staff memo added. Lifeguard competitions another ‘victim’ of pandemic

The SNL recently learned that another installment of U.S. Lifesaving Association (USLA) competitions had been scheduled to take place on Siesta Public Beach in July. It was cancelled because of the COVID-19 pandemic. Sara Nealeigh, the media relations officer for the county’s Emergency Services Department, explained that the decision was a collaborative one, involving Sarasota County Lifeguard Operations, the U.S. Lifesaving Association and the Florida Beach Patrol Chiefs Association. The USLA events afford an opportunity for camaraderie as well as participation in a variety of events that showcase the skills of lifeguards. Sarasota County team members have proven

County commissioners plan workshop to assess shoreline hardening By Rachel Brown Hackney  SarasotaNewsLeader.com On May 5, Sarasota County Commissioner Charles Hines renewed a suggestion he offered last year: He and his colleagues need to engage in an in-depth discussion about whether to amend county policies and regulations regarding shoreline hardening. The impetus for his proposal has been the threat that worsening erosion on the county’s barrier islands could result in homes collapsing into the Gulf of Mexico. In May, Hines asked County Administrator Jonathan Lewis to direct staff to undertake research and then issue a report on how the county’s environmental regulations match those of the state, and, especially, whether the county measures exceed state requirements. Staff completed that report on June 2; Rachel Herman, manager of the county’s Environmental Protection Division, reviewed the findings for the board on July 8. Hines voiced more frustration, though, after that presentation. He stressed his belief that the commission ideally needs side-byside documents, showing staff’s positions on specific regulations and the views of the members of the barrier islands’ homeowner associations on those same regulations.

Then, Hines pointed out, he and his colleagues could debate potential changes in county policies and requirements. A public hearing should be conducted, Hines said, during which property owners could offer their views and then the board members could make their decisions. “I don’t like beach hardening at all,” Hines emphasized. “But

right now, for somebody to do it, it’s pretty difficult, and we need to have that policy decision on this board.” Staff has reiterated that it prefers beach renourishment to shoreline hardening, Hines continued. Yet, “We struggle every time to find funding sources for [renourishment initiatives].” He reiterated his view that the commissioners need to debate whether to allow other options for property owners on the keys. “Then we can put [the issue] to bed for a while and people know where they stand.” As he did in May, Commissioner Alan Maio underscored the need to conduct such a public hearing prior to Hines’ stepping down from the board, in late November, as a result of term limits. Lewis voiced concern that when staff pays to publish legal advertisements of upcoming public hearings, those notices provide specific details about the proposed changes. Therefore, Lewis asked, would a workshop be appropriate first instead of a public hearing? That workshop could be conducted in September, Lewis added. Commissioner Nancy Detert asked Matt Osterhoudt, director of the county’s Planning and Development Services

Department — which includes the environmental divisions — whether staff ever had conducted a workshop with representatives of all the barrier island associations — those from Siesta, Manasota, and Casey keys — to discuss shoreline hardening. “No,” Osterhoudt responded. “That would be helpful for us,” Detert told him. Such a session could be held,

Osterhoudt explained, and then staff could advertise a public hearing on the basis of those persons’ proposed changes to the County Code. He also pointed out that the county’s Coastal Advisory Committee (CAC) could hold a discussion on the issues after that workshop, indicating that the advisory board could fine-tune the issues for the commission’s public hearing.

“I’d like the interested parties, the affected parties, to have a meeting first [and] come up with their suggestions,” Detert replied. Their information, she added, “is going to be more valuable to me.” “I would have thought that that would have occurred with our staff,” Hines said, before the shoreline hardening report was completed for the board. “We’re not typically going to

go out and debate [facets of the County Code with members of the public],” Lewis replied, unless staff has indicated “something is broken.” However, Hines countered, referring to property owners with threatened structures, “These folks deal with it every day. … At least hear it out from the other folks, face-to-face,” and provide the commissioners a report, Hines told Lewis. Maio suggested that a stakeholder workshop, such as Detert had proposed, could be conducted, with the involvement of the CAC, and then the commissioners could hold a workshop prior to a public hearing. “Just don’t leave us hanging, and Commissioner Hines is gone,” Maio emphasized to Osterhoudt. Lewis proposed scheduling time on an agenda in late September for the commissioners to talk about any changes recommended by the barrier island association members. “I’m OK with that as long as public input is part of that process,” Chair Michael Moran responded. Lewis finally indicated that a workshop for the board members could be scheduled on Sept. 22 or Sept. 23. That would allow staff time, he noted, for “listening sessions — for lack of a better word.” That schedule also would enable the board members to talk with barrier island homeowners, Hines replied, as well as with Charlotte County commissioners, who have allowed hardening on their shoreline. Additionally, he and his colleagues could discuss the issues

with their counterparts in counties where no hardening is allowed, Hines said.

The staff’s position

On July 8, Herman, the Environmental Protection Division manager, reviewed for the commissioners the findings of staff’s analysis — and its position — on the county’s regulations and policies regarding shoreline hardening. The report explained that longstanding county policies and standards have “resulted in the unique and desirable characteristics of Sarasota County sandy beaches and dunes, which Continued on next page

[draw] visitors and residents from around the world. The county’s Comprehensive Plan, Herman pointed out, “encourages beach nourishment as an alternative to shoreline hardening,” as that makes continued recreational access possible while providing storm protection to upland properties. Along with the recently completed project on Manasota Key, she noted, two renourishment initiatives have been completed on south Siesta Key. Shoreline hardening measures lead to accelerated erosion on adjacent beach property, hinder public access and do not prevent wind and waves from affecting a beach, Herman said. The staff recommendation, she told the commissioners, is to maintain the existing Comprehensive Plan policies and Coastal Setback Code regulations relating to shoreline hardening.

Policy change catalyst to approval of Avenida Leona residents petition for parking prohibition By Rachel Brown Hackney  SarasotaNewsLeader.com All told, it took about 19 months. In the end, residents of a Siesta Key neighborhood not only won Sarasota County Commission approval for a parking prohibition on their street, but they also achieved a policy change regarding petitions submitted to the county’s Traffic Advisory Council. In late December 2018, Avenida Leona resident Dr. Edward Braun submitted a petition to the Traffic Advisory Council

(TAC), explaining, “During tourist season our street is used extensively for parking by tourists.” Although neighboring streets have signs prohibiting parking on both sides, he continued, Avenida Leona has no such provision. “Cars are constantly parking on both sides of the street endangering pedestrians and bicyclists, making it difficult for our service vehicles to travel, and no doubt obstructing emergency vehicles if

such were needed.” Because of a lack of quorum in June 2019, when the petition was scheduled for a TAC hearing, no action could be taken. Then, on March 10, Commissioner Alan Maio brought up a related issue during a regular commission meeting: Braun had informed him in an email, Maio said, that a change in county regulations had made it impossible for the TAC to address the Avenida Leona petition.

Braun’s original petition had five signatures on it, which is what Braun had been told was necessary. Later, Braun learned that he would need 61, or 20% of the number of residences within 1,500 feet of Avenida Leona. Braun had noted in his March 9 email to Maio that Braun had appeared before the TAC that day, only to be told the extra signatures would have to be secured. After the meeting, Braun

continued in the email to Maio, Becky Ayech, the TAC chair, “advised me that although the members of the Committee felt that one-sided parking on our street was justified, a sentiment shared by Captain John Donovan of the Florida Highway Patrol, what was needed was a ruling by the County Commissioners that in this particular instance the petition rules be altered to allow the signatures of 20% of the Continued on page 35

because the judges have offered no grounds on which to pursue a further appeal. The plaintiff in the case was Sura Kochman, a resident of Pine Shores Estates, which is the neighborhood immediately adjacent to the approximately 24-acre Siesta Promenade site at the intersection of U.S. 41 and Stickney Point Road. Kochman led a group called the Pine Shores Neighborhood Alliance. Not only did she represent residents of the community located just east of Siesta Key, but she also had numerous supporters throughout the county — many of whom filled the County Commission Chambers on Dec. 12, 2018, when the board members conducted the public hearing on Benderson Development’s petitions for the project. As planned, Siesta Promenade would have 414 apartments/ condominiums, a 130-room hotel standing about 80 feet tall, 133,000 square feet of retail space and 7,000 square feet of office space. Kochman and her allies made it clear during numerous public meetings that they were not opposed to a development on the site; instead, they contended that the plans were too intense for that specific location. In January 2019, Kochman filed a Petition for Writ of Certiorari in the Circuit Court, which sought to overturn the County Commission’s decision to approve all of Benderson’s

applications for Siesta Promenade in a solitary hearing. In her Dec. 2, 2019 order, Circuit Judge Andrea McHugh wrote that she was unable to address some of the issues Kochman had raised, because they were of a legislative nature, not quasi-judicial. Certiorari petitions, McHugh pointed out, pertain only to quasi-judicial proceedings. County attorneys and the commissioners have explained that quasi-judicial proceedings are so called because they involve the consideration of evidence and testimony — similar to the process of a court proceeding — to determine whether requests for specific actions would comply with county policies. In contrast, a legislative hearing establishes a policy for

future application. For example, the adoption of an ordinance is considered a legislative matter. Referring to the Second District Court of Appeal decision, Kochman wrote in a July 1 statement that she had communicated via emails — and in a Facebook post — her thanks to “all of those who contributed monetarily, those who showed up to the many hearings and neighborhood workshops, who wrote letters/ emails to both the Planning and County Commissioners and who signed the petition [opposing the project as planned]. It was a good 6 year fight and we gave it our all, with no regrets.” “Here is hoping that the County will be diligent in monitoring Benderson throughout the development process. I will certainly be

keeping an eye on things,” Kochman concluded the statement. Although it made multiple attempts to seek comments from Todd Mathes, director of development for Benderson Development, or another representative of the company, the SNL never received a response. Sarasota County Attorney Frederick “Rick” Elbrecht announced the Appeal Court decision as the county commissioners were conducting a budget workshop on July 1. In a statement county staff provided to the SNL, Elbrecht said, “We are very pleased with this decision that confirms that Sarasota County acted properly throughout the approval process. Assistant County Attorney David Pearce did an excellent job representing the county during this litigation.” The oral arguments in the case During the June 25 oral arguments, Ralf Brookes of Cape Coral, Kochman’s attorney, told the three-judge appellate panel that county staff and the commission did not follow the county’s regulations for approval of a Critical Area Plan (CAP) for Siesta Promenade. For example, he pointed out, the boundary of the CAP should have been established well before the final hearing, when the County Commission considered multiple facets of the mixed-use development. “Only by first approving the CAP boundary impact area can

we logically develop a scope of work for the studies on the impacts of the development,” Brookes maintained. In this case, he added, the CAP boundary “was not approved until the very end of the process ... [in] one massive, consolidated public hearing …” If staff and the board had followed the procedure outlined in the CAP regulations, Brookes said, then a separate public hearing would have been held — as required by those regulations — to consider the effects on all the areas surrounding the site. Among those areas, he said would have been Siesta Key, for which Stickney Point Road is the south access. Further, Brookes told the judges, another claim in Kochman’s complaint dealt with the county’s requirement for an applicant to apply for Special Exceptions in regard to increased height and density in a project. However, Siesta 41 Associates LLC — the Benderson affiliate that is the developer of Siesta Promenade — did not seek those Special Exceptions, even though “these are very clear procedural requirements that are built into the [County] Code,” Brooks contended. At one point, Brookes also noted the 2003 Florida Supreme Court opinion in Allstate Insurance Co. v. Kaklamanos. In that opinion, the court held that the Second District Court of Appeal “had been perhaps too narrow in its interpretation of what is clearly established law…”

Believe it or not, in North America it’s canine obesity, a condition brought on by—much like in humans—a deadly combination of poor diet and lack of exercise. In fact, if your pup’s weight exceeds its ideal mark by even as little as 10%, they’re at a greater risk for disease and their life expectancy can be shortened by nearly two years.

At that level, they can develop issues like diabetes mellitus, heart disease, and osteoarthritis. So, it’s best to avoid the worry, and try to maintain their weight as close to their ideal number as possible. Keep in mind, unusual canine weight gain can also be caused by chronic conditions like Cushing’s disease or hypothyroidism, issues that can be identified by your vet. Barring those, here are a few ways you can ensure your pup stays in tip-top shape.

When looking at food labels, focus on the low end of the listed weight range and work from there, making adjustments for the above factors. As for exercise, regular walks are still a great way to get your dog moving. Even at a reasonable pace for just 20 minutes a day, low impact neighborhood strolls can have a major positive effect on the physical health and mental well-being of dogs—and their pet parents, too. If you and your pup have access to water or wide-open spaces, a good swim or a rousing game of fetch can also go a long way. Though canine obesity is a common problem, fortunately prevention is easy to achieve with a few simple changes. Consult your vet about your dog’s weight, take advantage of local pet store resources with knowledgeable team members who can help you find the right food for your dog, and put your pup on the diet and exercise plan they need to get fit for a long, happy, and healthy life.

Additionally, the memo said, the undertaking is featured on the Projects In My Neighborhood webpage on the county website. That July 7 staff memo explained, “With the decommissioning of [the water reclamation facility], formerly known as the Siesta Key Advanced Wastewater Treatment Plant, and construction of the new Siesta Key Master Pump Station, the majority of the remaining infrastructure on the plant site is no longer needed and can be demolished.” The project will include the removal and demolition of tanks, buildings and aboveground structures “that were associated with the wastewater treatment plant,” the memo added. The Siesta Key Master Pump Station began sending wastewater to the mainland on April 10, 2018. At that time, county staff members reported that they hoped to advertise the demolition work for bid by early 2019. The contract the commission approved on July 7 calls for minor improvements to the site, as well, the staff memo continued: construction of new fencing at the entrance to the facility, a new asphalt driveway and sodding of the area after the demolition has been completed. The expense will be covered by utility rate payments, the memo said. The funding already has been allocated.

On Feb. 17, the memo noted, staff advertised for bids for the initiative. A Procurement Department document provided in the July 7 meeting packet says two other firms besides Cross Construction bid on the job. They were Environmental Holdings Group LLC of Tampa ($1,303,410.28) and Forristall Enterprises Inc. of Bradenton ($1,844,732). A public meeting about the plans was conducted on Jan. 16 at St. Boniface Episcopal Church, the memo noted.

Sewer pipelines to be rehabilitated on north Siesta

A second item on the County Commission’s July 7 Consent Agenda also dealt with an upcoming project on the Key. The board unanimously approved a $145,721.18 contract with Insituform Technologies LLC to “rehabilitate the gravity main in the Mangrove Point Basin by lining the existing vitrified clay pipe (VCP) using the Cured-in-Place (CIPP) methodology,” a staff memo said. The fee covers all the labor, equipment and materials, the memo added. The trenchless process will be used for the work, the memo said. The initiative is set to begin in August, with completion anticipated in November, the memo pointed out. In this case, according to the contract, company would be fined $100 per day for failing to reach the “substantial completion” of the initiative within 120 days of starting work. “Substantial completion” refers to finishing up work except for “punch list”

items. Insituform is to line approximately 1,968 linear feet of pipeline with a diameter of 8 inches, plus 1,850 linear feet of vitrified clay pipe of 10-inch diameter. The work will satisfy the requirements of in-kind penalties imposed on the county in conjunction with a Florida Department of Environmental Protection (FDEP) Consent Order the County Commission agreed to last summer. That order dealt with measures designed to improve the operations of infrastructure associated with the county’s three water reclamation facilities, the memo also noted. The primary goal is to reduce the level of nutrients entering county waterways, as nitrogen, especially, is a source of food for the red tide algae. After the Mangrove Point basin work has been completed, the memo noted, the life of the pipelines will be increased by more than 50 years. The basin encompasses property on the east and west sides of Higel Avenue, starting just north of the Little Pond Lane intersection. It also includes a section of Boyd Park, which stands in the triangular intersection of Higel Avenue and Midnight Pass Road. The contract shows an expense of $2,644.50 for Insituform staff to ensure that traffic flow can proceed smoothly while the project is underway. That contract notes that Higel is a major route on Siesta Key. Two smaller phases of the initiative will run along North Shell road and Cedar Park Circle.

Save Our Siesta Sand 2 Temporary Restraining Order denied by federal judge By Rachel Brown Hackney  SarasotaNewsLeader.com In July, the federal judge presiding over the Save Our Siesta Sand 2 lawsuit against the U.S. Army Corps of Engineers (USACE) denied a motion for a Temporary Restraining Order (TRO) to prevent the removal of sand from Big Sarasota Pass to renourish about 1.56 miles of Lido Key Beach. Chief Judge Steven D. Merryday of the U.S. District Court for the Middle District of Florida, in Tampa, pointed out in his July 6 order that Save Our Siesta Sand 2 (SOSS2) filed its original complaint against the USACE in January 2019, and the final documents were submitted in the case in December 2019. “SOSS2 remained free to request a preliminary injunction at any time [to ensure the project could not proceed until after a ruling had been handed down in the litigation]. Instead,” he continued, “SOSS2 waited until three business days (and the intervening Fourth of July weekend) before filing an amalgamated request for a temporary restraining order and a preliminary injunction. The absence of an explanation for this tardiness suggests either an inexplicable obliviousness or a calculated attempt to secure by force a delay of the project.” David Ruderman, spokesman for the USACE District Office in Jacksonville, told the SNL that the USACE would decline from commenting other than to note that the Lido initiative would proceed as planned. Mark Smith, chair of SOSS2, did not provide a formal statement to the SNL. During the July 6 regular Sarasota City Commission, City Attorney Robert Fournier reported the ruling, adding that City Engineer Alexandrea DavisShaw told him she expected the work on Lido to get underway as of Wednesday, July 8. A graphic the city released in June showed that the first sand would be placed on the southern end of Lido beach, with the renourishment effort moving north from there. Early in the morning of July

15, the dredge Rockbridge, owned by Cottrell Contracting Corp. of Chesapeake, Va. — which won the $12.7-million USACE contract for the Lido Key Hurricane and Storm Damage Reduction Project — finally appeared in Big Pass. Jan Thornburg, senior communications manager for the City of Sarasota, told the SNL the same day that Cottrell had “some final preparations to make” and anticipated actual dredging would begin on July 17 or July 18. Throughout his July 6 order, federal Judge Merryday scolded SOSS2, especially for failing early on to request a preliminary injunction. In January 2019, when the nonprofit filed its complaint, he pointed out, the USACE already had issued one solicitation for the Lido Key initiative. (The USACE ultimately cancelled that solicitation because the two bids it received came in at levels that it characterized as “unreasonably high.”) Then, in October 2019, Merryday continued, in a summary judgment memorandum in the SOSS2 case, the USACE reported its “expectation ‘to award a contract [for the project] by midFebruary [2020],’ but SOSS2 failed to request preliminary injunctive relief.” In March, he added, the USACE awarded the Lido contract to Cottrell Contracting, and that contract was available not only on a federal government website but also “was widely reported in the media …” Yet, “SOSS2 failed to request preliminary injunctive relief.” “Instead,” Merryday wrote, “on June 30 2020, three business days (the three-day, Fourth of

July weekend, intervenes) before the Army Corps plans to begin the project, SOSS2 claims an ‘emergency’ and requests an order immediately [preventing the work from going forward] without affording the usual time within which to respond and to conduct a hearing.” Merryday also explained that under Rule 65(b) of the Federal Rules of Civil Procedure and Local Rule 4.05(b)(2), a temporary restraining order can be issued only if the party seeking it “‘is threatened with irreparable injury … so imminent that notice and a hearing on the application is impractical if not impossible.’” Citing a 2016 decision of the U.S. District Court for the Middle District of Florida — Kotori Designs LLC v. Living Well Spending Less Inc. — Merryday made it clear that “any emergency” of a plaintiff’s own making “warrants denial of the request for a temporary restraining order.” He added, “SOSS2’s silence about the day

on which SOSS2 learned about the start of the project, the Army Corps’ publicizing the award of the contract to Cottrell, and SOSS2’s waiting until three business days before the start of the project to request a temporary restraining order collectively compel the conclusion that the reported ‘emergency’ is primarily SOSS2’s own creation.” Moreover, he wrote, to the extent that the nonprofit’s June 30 motion sought a preliminary injunction, “the motion warrants denial.” Such an injunction should be issued, he continued, only if the entity filing it “enjoys a substantial likelihood of success on the merits” and if the harm to that entity would outweigh the harm to the defendant.

More criticism Moreover, Merryday wrote in his order, SOSS2 violated court rules requiring a TRO motion and an accompanying memorandum in support of the motion to appear in the same document.

The nonprofit’s attorney split the request “between a twopage motion and an eleven-page memorandum of law in support of the motion.” The attorney is Jane West, whose firm is located in St. Augustine. He also pointed out that the USACE demonstrated that delaying the Lido project would “cause the Army Corps to incur ‘at least $48,000 in costs’ per day” and that the USACE “fairly claims surprise at the sudden request for a temporary restraining order. … The relief requested in SOSS2’s motion subjects the Army Corps to extensive, ongoing, and unnecessary expense, and SOSS2 fails (1) to describe the incremental harm that SOSS2 might suffer if the project continues [while the lawsuit is pending] or (2) to explain how this incremental harm exceeds the loss of $48,000 per day to which an injunction would subject the Army Corps.”

It was fading into obscurity when taken over by TJ Vincent in 2014, who came in, redid the shop, and kept it all going. TJ Vincent is a lady barber in a field usually dominated by men. At the time she got her first license, she was the first female in Florida to be tested for barbering. TJ—also known as Teresa—first graduated from Beauty School before deciding that becoming a barber would be even more appealing. She attended Barber College in Ft. Lauderdale, passed stringent state tests with flying colors, and—before long—was a full-fledged barber with three shops in Orlando and one in Old Englewood Village. She had but one goal: to provide first-class barber services. TJ soon went back for additional studies. “I wanted to know it all and become well-rounded,” says this entrepreneurial woman. She took a course in the Roffler method of hair design. The program was designed by Edmond “Pop” Roffler in 1958. Sarasota Based Men’s Swim Suit Line Making Waves! By Jane Bartnett In this land of endless summer, one thing that no man can have enough of is a pair of comfortable, great looking swim trunks. Island Chatter “Residents and businesses in the immediate area will be notified by postcard of upcoming construction at least two weeks prior to the start of work,” the staff memo pointed out. “Further, the contractor is responsible for providing door hangers on affected streets 2-5 days prior to construction,” the memo continued. Construction updates will be provided via the Construction — One Week Look Ahead Report, which is posted on the county website, www.scgov. net. The county has hired Insituform for past projects of this nature, including several on the Key. The company’s headquarters is in Missouri. The company says on its website that it has more than 45 years of experience in rehabilitating pipelines “all around the world using its flagship cured-in-place pipe.” The work restores structural integrity, reduces infiltration of rainwater, eliminates leaking joints, improves water quality and increases pipeline flow capacity, the website points out.

Yet a third item of business on the County Commission’s July 7 agenda that involved Siesta pertained to a proposed amendment to the county’s Unified Development Code (UDC). That document combines all the county’s land development and zoning regulations. As county Zoning Administrator Donna Thompson explained it, the amendment would enable merchants to erect A-frame signs to direct visitors to available parking locations, either at businesses or those handled by valets. The modification would

apply only to the Siesta Key Overlay District, which governs all the zoning issues on the island. Regular readers may recall that, last year, architect Mark Smith, a long-time leader of the Siesta Key Chamber of Commerce, proposed the private amendment, as allowed during the regular, annual cycle for County Commission consideration of changes to the UDC. Smith sent Thompson a letter from the Chamber in August 2019. In his correspondence, he wrote, “Parking is at a premium on Siesta Key. Visitors to Siesta Key need help finding both parking spaces and valets. These [A-frame] signs would be an aid in navigation and a public service to help get drivers off the road and safely parked. There are plenty of ‘No Parking, Tow Away’ signs on Siesta Key. Staff supports this proposed amendment.” During Thompson’s July 7 presentation, she noted that the UDC went into effect on Jan. 1, 2019. On Nov. 6, 2019, she continued, staff presented the commissioners a summary of proposed amendments, which included four that had been privately initiated. No board vote was required on July 7, Thompson added.

SKA raises alarm over statement about jetty on Lido Beach

Leaders of the Siesta Key Association (SKA) have told the SNL they became alarmed when they read part of a legal declaration that the president of the contractor handling the Lido Key Hurricane and Storm Damage Reduction Project recently wrote. In a July 1 filing, in response to Save Our Siesta Sand 2’s motion for a Temporary Restraining Order (TRO) to prevent the dredging of Big Sarasota Pass, Benjamin G. Cottrell V noted several subcontracts he had awarded for the Lido project. Among them, he cited “$1.9 million to Earth Tech for jetty construction.” On July 2, after reading a copy of that declaration, SKA President Catherine Luckner emailed Brad Johnson, assistant Sarasota County administrator, who oversees the Parks, Recreation and Natural Resources (PRNR) Department, among other responsibilities. “There are no Permit documents that cover ‘Jetty construction,’” Luckner wrote. A jetty, she pointed out — quoting a coastal engineering document — is defined thus: “On open seacoasts, a structure extending into a body of water, which is designed to prevent shoaling of a channel by littoral materials and to direct and confine the stream or tidal flow. Jetties are built at the mouths

of rivers or tidal inlets to help deepen and stabilize a channel.” Again, quoting coastal engineering materials, Luckner added that groins are “shore perpendicular structures, used to maintain updrift beaches or to restrict longshore sediment transport. By design, these structures are meant to capture sand transported by the longshore current; this depletes the sand supply to the beach area immediately down-drift of the structure.” As county leaders have explained, on the west coast of Florida, sand drifts from north to south. When the U.S. Army Corps of Engineers (USACE) designed the Lido project, it originally planned on three groins on the southern part of the beach to try to hold new sand in place between subsequent renourishment efforts. One of those groins was planned very close to the county’s Ted Sperling Park, on the southernmost tip of Lido Key. Later, the USACE removed that structure from its proposal. Luckner then pointed out in her July 2 email to Johnson that she had been in contact with Gregory W. Garis, administrator of the Beaches, Inlets & Ports Program of the Florida Department of Environmental Protection (FDEP). Garis had stressed to her in an email, she continued, that groins have been authorized for the Lido Key Hurricane and Storm Damage Reduction Project, not jettiess. She included a statement from Garis’ reply to her, which said, “Any significant changes from those activities would require a permit modification.” Additionally, Luckner told Johnson in the email that the

USACE had not submitted to FDEP any engineering documents for the construction of either groins or jetties on Lido. “The impact could be quite different to the [Ted Sperling] Park and [Big] Pass,” she added, if the USACE has decided to proceed with jetties instead of groins. “We could expect severe erosion,” including the lost off the Gulf beachfront in the park. “We ask you to clarify with Mr. Garis what the Contractor is building,” Luckner continued. “Would you let us know your findings as soon as possible?” After apparently receiving no response from Johnson, Luckner sent another email on July 8. That went to him and Nicole Rissler, director of Parks, Recreation and Natural Resources. “We are requesting a response from you and Brad Johnson regarding your outreach and results,” Luckner added in her July 8 email. “Also,” Luckner wrote, “We’d appreciate hearing from our [county] Commissioners, Alan Maio and Christian Ziegler.” With the implementation of new County Commission district lines last year, Siesta is split between District 2, whose seat Ziegler holds, and District 4, which is Maio’s district. Luckner finally received a reply on the afternoon of July 8 from Shawn Yeager, senior manager of PRNR. He wrote, “We confirmed with both Cottrell Contracting and with the City of Sarasota this afternoon that no jetties are being installed as part of this project. Only the permitted groins are being installed. [City Engineer Alexandrea DavisShaw] may be better able to assist with additional questions about this project.”

Island Chatter The SKA remains engaged in litigation with the City of Sarasota over the Lido project, contending that the city should have applied for a Sarasota County permit to allow the USACE contractor to remove sand from Big Pass. SKA leaders have stressed for years that Big Pass never had been dredged. Rocks relocated, at last, on shoreline at Beach Access 1 Regular readers will recall that controversy ensued early this year over the efforts of the owners of a home near Beach Access 1 — on North Shell Road — to keep the public off their property. Greg and Michelle Olson of 3935 N. Shell Road had erected a rope-and-post barrier that county staff advised them was in violation of county regulations. In investigating that situation, county Environmental Protection Division staff members also found rocks parallel to the shoreline, which — staff acknowledged — were installed by a previous owner of the property. During a staff review of historic aerial images,” a county letter to the Olsons continued, “it also became clear that shoreperpendicular rock/concrete has been present at this location since at least 1974 in the vicinity of both your northern and southern property boundaries.” In response to the staff concerns, the Olsons agreed to apply for a county permit to move the rocks landward of the county’s Barrier Island Pass Twenty Year Hazard Line (PHL). In late June, the News Leader learned from county Planning and Development Services Department staff that the rocks finally had been relocated. The After-the-Fact Minor Work Permit was issued to the Olsons on April 13 and then modified on April 16, according to

a copy of the document the News Leader received after making a public records request. That permit explained that the Olsons’ property on Big Pass “has not been historically hardened by a rock revetment. There are scattered rocks running perpendicular to the shore along the northern property boundary near the Shell Road right-of-way that have been present since at least the 1970s. There is also a scattering of rocks offshore and closer to the southern property boundary that have historically been at this location since at least the 1970s. The footprint of the scattered rocks and the shore-perpendicular configuration of rocks … are not very well consolidated and no longer appear to serve as a functional shoreline protection structure or groin. Many are buried in the sand. These rocks are not to be enhanced or moved elsewhere on the beach as part of this permit.” The document added, “The previous owner installed rock along the shoreline sometime between 2011 and 2013. This afterthe-fact permit addresses compliance issues related to county regulations. Several rocks will require relocation landward of the PHL to address compliance with the [county’s] Coastal Setback Code, while the issuance of this after-the-fact Minor Work Permit addresses compliance with the WNCA [Water and Navigation Control Authority] Code for authorization of a shoreline protection structure within the WNCA jurisdictional area. A specific stipulation has been included which requires the existing seagrapes to be protected and preserved. Furthermore, the Sarasota County Environmental Protection Division shall require dune vegetation plantings at the toe of the rock revetment as a shoreline softening mitigation measure.” Continued on page 22

Thanks to its bright pink plumage, the spoonbill might be mistaken for a short, oddlooking flamingo from a distance. However, that’s where the similarity ends. The spoonbill is a full-time resident of South Florida’s coastal areas, like Siesta Key, and prefers wetland marshes with tree cover. Shallow waters—salt or fresh— teeming with small crustaceans and fish are prime feeding grounds for the spoonbill. Its unique style of hunting will have you tapping your toe! With a steady upbeat rhythm, the bird sweeps its head side-to-side; its spoonshaped bill, slightly open, trawls just below the water’s surface. Attuned to the slightest touch of a tasty tidbit, the bill snaps and traps its prey in a flash. The spoonbill owes its pink panache to the types of aquatic delicacies it eats. This bald adult spoonbill lost the once-feathered crown of its youth and, in the process, gained mesmerizing ruby eyes that were previously dull and dark brown.

Several desirable native dune plants are present at the top of the rock revetment.” Thus, the document continued, “Staff agreed to modify the issued permit to remove the requirements to plant at the toe of the rock revetment and encourage the installation of native vegetation at the top of the revetment in areas that remain bare following the relocation of the rock landward of the [Pass Hazard Line].

As modified, the permit also said, “The Sarasota County Comprehensive Plan also recognizes the importance of removing all nuisance/ invasive species as they are a continual threat to the health of Sarasota County’s native habitats and shoreline areas. These fast-growing species grow densely and crowd or shade out desirable native plants that are important for long-term shoreline management. Further, the Sarasota County Invasive Plant Species Code (Sarasota County Code, Chapter 54, Article XIX) prohibits the importation, transportation, sale, propagation, and planting of six nuisance/ invasive plant species. “Therefore, if any nuisance/ invasive species … are located within 30 feet of the shoreline, they are required to be removed pursuant to a stipulation within this permit. “With adherence to the conditions and stipulations contained herein, no long-term adverse ecological impacts are anticipated,” the permit said. Upon completion of the relocation of the rocks, the permit noted, the revetment would be limited to a maximum elevation of 4 feet NAVD [an abbreviation that pertains to Federal Emergency Management Agency base elevations in regard to flooding] and will remain within the landward footprint of the existing rock revetment on the [Olsons’] property. The overall length of the revetment structure is approximately 110 feet, while the width varies (between 4 ft. and 9 ft. wide).” Finally, the permit required the Olsons to use “[c]lean, local, quarry rock … in construction of the rock revetment,” and it said they would have to maintain the revetment in good condition “so as to create no hazard or nuisance to surrounding properties or the public at large.” Howard Berna, who manages of the Environmental Permitting Division and serves as administrator of the WNCA ordinance, signed the permit. Fire Department comes to rescue of grounded sailboat Just before 8:30 p.m. on

Monday, July 6, the Sarasota County Fire Department received a call about a sailboat that had gone aground on the sandbar in Big Sarasota Pass. The Sarasota County Sheriff’s Office’s Air-1 helicopter crew kept an eye on the vessel as firefighters set out by boat to assist the stranded sailors. The Air-1 crew noted that the couple had set off a flare, indicting the vessel was in distress. In releasing a copy of the Air-1 video to the public, the Sheriff’s Office reported that the sailboat “was being battered by the waves” when Fire Boat 3 approached it. The Fire Department noted in its report that its boat maneuvered as close to the sailboat as possible, and then two firefighters set out on foot across the sandbar to help the man and woman leave the sailboat and make their way to the Fire Department boat. “The water is too shallow,” a person on Fire Boat 3 reported, as heard in the Air-1 video, explaining why the rescue vessel could not move in closer to the sailboat. Air-1 recorded video as the firefighters assisted a man, a woman and two dogs. All made it safely aboard the Fire Department vessel, as that crew reported to Air-1. After the rescue, the couple and their pets were transported to Marina Jack in downtown Sarasota, the Fire Department report noted. There, the couple met with Sea Tow personnel to discuss options about getting their sailboat off the sandbar, the report added. Firefighters estimated the length of the sailboat at 20 to 25 feet. Sheriff’s Report 6/15/20 Theft

arrest and became combative before being taken into custody. The case is being prosecuted.

Police were called to a store for a report of a man attempting to steal Lagunitas IPA beers. When he was confronted by a store employee, the employee was able to retrieve two of the beers before the man left the store before police arrived. A thorough review of available video surveillance yielded evidence of similar illicit activity when the same individual apparently stole beer by hiding it in his trousers on at least one prior occasion and then exiting the store after bypassing all points of payment. The case remains open.

06/16/20 Burglary - Residential On 6/14/20, the complainant activated his self-guiding vacuum cleaner and left his condo. When he returned on 6/16, the vacuum was gone. The condo was locked when he exited, and the base for the vacuum was still present in his living room when he returned. Complainant and police doublechecked under every piece of furniture in attempt to locate a stuck or hiding Rumba, to no avail. There were no signs of forced entry or anything else stolen or disturbed. The condominium office confirmed that no one had been granted access for maintenance or any other reason. The case remains open.

06/29/20 Larceny/Grand Theft/ Resisting Arrest The victim and her daughter were staying at a local motel when they accidentally left some belongings in a grocery bag near the pool. When the victim’s daughter went to retrieve it, the bag was gone. She remembered seeing the defendant at the pool and knocking on her door. When the door opened, she saw the defendant sitting on the bag trying to hide it. The victim’s daughter retrieved the bag and confirmed that it contained her mother’s belongings but was missing some cash. After the police were called, video footage confirmed that the defendant took the bag from the pool area. The defendant resisted

7/7/20 Burglary - Vehicle

The victim, an Uber driver, called 911 from outside of a bar when he arrived to pick up the defendant passenger. The defendant entered the vehicle without a face covering, in violation of Uber’s mandate that all occupants inside their vehicles wear face coverings in furtherance of public health guidelines during COVID-19. After the driver explained the policy and requested multiple times that the defendant wear a mask or exit the vehicle, the defendant refused to do either. The driver canceled the ride and called 911. While on the phone with 911, the driver reported that the defendant grabbed the driver’s arm. When the police arrived, the victim claimed that the defendant struck him in the face before exiting the vehicle. Police reported that the defendant was uncooperative, refused to answer any questions, and would only keep repeating that not wearing a mask was not a crime, despite being told that businesses can require masks. The defendant was placed under arrest for simple battery.

The victim and his family arrived at the beach and parked two vehicles in the front two parking spaces around noon, leaving them locked and secured. When they were returning to their vehicles at approximately 5:30pm, they saw a man reaching into the front passenger window of one of their vehicles. When the victim yelled at the man, he ran to a silver Honda Civic and fled. The victim discovered that his vehicle window had been broken and his wallet, with Florida driver’s license and debit card, stolen. Police immediately collected fingerprint and DNA evidence at the scene, as well as witness statements. The case remains active.

7/2/20 Theft The victim reported that on 6/28, an unknown male approached her in front of her house looking for work. He subsequently followed her onto the pool deck where he removed three fiberglass art deco deck chairs before leaving the property. Police are attempting to secure area video footage, and the case remains open.

7/5/20 Battery The victim states that he was watching the suspect dance on the public beach, but when the suspect noticed him watching him, the suspect “charged” the victim and hit him in the shoulder. The suspect then began methodically circling the victim, threatening to beat him up. The victim videotaped the altercation and showed it to the

The complainant contacted the police because she believed she may have been the victim of a burglary at her residence. She left her condominium to walk her dog for approximately one hour in the evening and did not lock her door, per her usual habit. She left a stack of packages to go to the post office inside her door, and her debit card was on top of the stack. When she returned from her walk, she could not locate her debit card. After searching for the card to no avail, she concluded that someone entered her residence and stole the debit card. She confirmed that nothing else was missing, and she specifically noted that her medical marijuana and jewelry were visible and untouched. Upon further questioning, she speculated about the existence of a person in the building who could be a potential suspect, based on rumors of other clandestine behavior, however she could not provide any identifying information such as name, description, or details of prior incidents. The case remains open.

Funny How that Works...

When Sarasota stopped charging for parking downtown back in March as the lockdown began, many kept paying since the city never really publicized the change. In fact, it wasn’t until weeks later at a press conference that word finally leaked out after a reporter’s question on the matter. But when the parking charges returned in early July, well, there was no missing the change as the city made sure the message got out pronto.

Phone Spoofers Jump the Shark...

I’m one of the dozen or so area residents who still happen to have a land line. Why, I’m not quite sure since I haven’t answered the phone connected to that line since oh, 1986 or thereabouts. That was around the time phone solicitations began to outnumber legitimate calls by an ever widening margin. Perhaps the reason I hang on to it is the whiff of nostalgia it brings; but there’s also a certain entertainment value in listening to some of the breathless messages left on the answering machine from all manner of scammers and scofflaws telling me what I must do IMMEDIATELY to avoid CERTAIN financial DOOM or impending CRIMINAL prosecution or to not miss out on the money I’ve won in a LOTTERY I never entered. And since the scammers figured out how to hijack the caller ID message that shows up on the phone itself, that too has become a source of continuing entertainment. One such read-out last week gave me a good chuckle and a sense of just how much these folks must want to get me on the line. The message read: “IMPORTANT CALL.” Funny though, the caller didn’t leave a message.

Don’t Hold Your Breath Waiting for this Refund...

I was mildly surprised when my power bill went down after

Both gestures, though modest, are nonetheless appreciated, especially since they were implemented without any prodding on my part. I was thinking about this the other day while reading about the back-and-forth over if and when schools will open in the fall... (August here in Florida). So, here’s the question that popped into my head: since schools have been closed for months do you think there will be a refund from our local school districts retroactive to last March and forward to whatever date is finally agreed upon for reopening in the near (or far) future? Ha! Of course not. The very idea is utterly ridiculous to any cogent taxpayer. Instead a referendum to extend the district’s increased millage rate for Sarasota County taxpayers is still in the works. That last increase was approved in 2018 and expires in 2022. If a refund proposal was made, school board members would likely crow that costs for the district still remain. Teachers were still teaching this past spring and kids still learning, albeit remotely. And yes, that’s true. But what about savings to the district on utilities like power and water? There are certainly real savings there even beyond the temporary FPL rate refund. Just turning up the thermostat from 76 to 82 for all the district’s shuttered buildings has to have generated sizable savings. And then there are reduced costs associated with maintenance, like janitorial services, lawn mowing, and school bus repairs. And of course, with kids not going to brick-and-mortar schools, fuel costs to run those busses has dropped to zero, no? The truth is, government agencies and the bureaucracies behind them rarely if ever offer refunds to the taxpayers funding them, even when they spend less than anticipated when their budgets were approved. And this serves as an abject, real world lesson on the differences between capitalism and socialism that has been simmering in the news lately and will likely continue

to do so as this year’s presidential race draws ever nearer. Private enterprises have to ‘earn’ the business of their customers every day. Government agencies like school districts have to reach out to their ‘customers’ much less frequently…perhaps just once every two or four years when there’s an election. And as the bureaucracies behind those bodies grow, the unelected, unaccountable officials manning them seem to exert an ever greater impact on policy matters, rendering those elected officials supposedly accountable to the public less in charge of things than perhaps they should be. That seems to be the trend anyway, both locally and nationally. Perhaps our local school district will shock me and pass along a small refund in the near future. Think of the goodwill that would provide? And I would certainly remember the gesture when the renewal of additional funding initiative returns to the ballot. I will also remember the more likely outcome: that any thought of such a refund is utterly ridiculous.

Be careful if you’re approached by someone asking to borrow your phone because their own is dead or they forgot it when they left the house that morning; they might say something akin to needing to text a friend because of some emergency like car trouble or saying they have to call a Doctor’s office or some other professional to explain why they will be late for an appointment. The scam comes if you have financial links on your phone that you use to either pay bills or transfer funds to kids at college or to others for any number of sundry reasons. In less than a 20 seconds, a scammer can text funds from any linked account on your phone to an untraceable ghost account of his or her own. And once the transaction is made, your chances of recovery are virtually nil. Law enforcement says you should offer to make a call or type out a text for someone, but never let them do so themselves.

It is actually part of the Wrasse family and is closely related to a parrot fish more than a snapper. 2. Hogfish uses its elongated pig like snout to rummage and graze for crustaceans that are buried in the ocean floor. Because it has such a healthy shellfish diet the fish tastes clean with a hint of crab flavor. 3. Juvenile Hogfish start out as female and then become male as they mature. 4. Males tend to be more intensely colored with a signature black spot behind the pectoral fins and females are pale grey or brown in color. 5. Hogfish have been recorded to live up to 11 years.

EASY HOGFISH PICCATA RECIPE: Heat 2 tablespoons of olive oil in a large sauté pan over medium-high heat. Season your 4-ounce Hogfish filets (total of 2 pounds of fish) with Deli Dust (available at Big Water Fish Market) and dredge in flour. Sauté the fish in oil for about 4 minutes, flipping half way through. Remove the fish to a platter. Deglaze the pan with ¼ cup white wine, whisking for about 1 minute. Add 2 juiced lemons and 2 tablespoons of capers and stir. Add 2 tablespoons of butter and whisk away to incorporate and bring the sauce together. Pour your sauce onto the fish and garnish with fresh chopped parsley and a lemon wedge. Bon appetite.

Going from bad to worse: Sweltering - in one place - with the same people/no people. There must be a solution here in Sarasota to this ongoing, and re-occurring, dilemma - and, thankfully, there is. The Beaches. And, praise be, there are lots of them from which to choose with most signposted once you are near. First, and foremost in the minds of many, is Siesta Beach, located on Siesta Key. Two bridges lead to that lovely spot. From downtown, the first bridge is just 10 minutes south on route 41. The second is just 6 minutes further south. Once on the key Siesta Beach is an equal distance between them - just southeast of Siesta Key Village. While this beach is not Disney World, it does have lots of amenities - snack bars, tennis and volleyball courts, a really nice, age-segmented playground, walkways and restrooms, lots (but not nearly enough during normal times) of parking, and that lovely crushed quartz crystal sand which is cool

to the bottom of your feet. If you approach from the southern bridge, there is a small parking/access area just a few yards south of where you arrive on the key. This leads to Crescent Beach - not much parking nearby, but not so crowded either. It really is just the extreme south end of Siesta Beach, so it has the same sand, but no amenities except for what you bring with you or purchase from the nearby stores. When coming off the bridge, take a right for Siesta Beach, but turning left leads to a real treat - Turtle Beach. While less well known, locals like it because the sun sets directly out from the beach, over the Gulf of Mexico, not between the heads of those sitting to the right of you, like on other beaches. It used

to have the same quartz crystal sand as Siesta Beach but, a couple of beach re-nourishments back, the county commissioners deemed that it was OK to overlay the white crystal sand with courser sand made from old sea shells from further out in the gulf. There are lovely flowers growing right in clusters throughout the beach area and fishing takes place on the southern end. Walk, if you wish, during low, low tide, down to Casey Key.

And now for something completely different

Well, not completely different. Did you ever notice that, while beaches are on the same body of water, like the Gulf of Mexico, and just a couple of miles apart, one can actually have quite a different ambiance from another? Directly west of Sarasota, over the Ringling bridge and causeway, lies, Ta Da, Lido Key and Lido Beach. When you dead-end at the gulf, there is a paid (sometimes) parking area and a boardwalk access with outdoor shower for removing sand. However, as most all beaches are linear in nature, one can just turn left and park anywhere along Ben Franklin Boulevard as there are multiple access points to the beach. As you drive, be sure to look through the median divider for parking spots on the other side of the boulevard. Drive far enough and you will find a large parking lot with restrooms and (sometimes) a snack bar. Once past that large parking lot, there is not much beach access until you reach the South Lido Beach Park which is

where Ben Franklin Blvd. ends. There is plenty of parking there and, nicely, fewer people. The one thing to remember is not to go swimming too far to the left on the beach, as the tides at Big Pass can be a bit powerful. For some, there is an additional reason to go to Lido other than the cooling breezes that are at all of Sarasota’s beaches, and that is the SHOPPING at St. Armands Circle. While once as exclusive as Rodeo Drive in Beverly Hills, St. Armands still has its charm. From shops with children’s clothing and fun things, like Little Bo-Tique to more adult female clothing and bling in so many other stores, to quite a few eateries. The latter ranges from ice cream and candy shoppes to old-line fine cuisine like Crab & Fin and Ybor City style Spanish dining at the Columbia. There are also unique niche shops like the Bennington Tobacconist, Clyde Butcher’s art gallery, the Spice and Tea Exchange, and the Pepper Palace. In need, between the heat of the beach and the St. Armands shopping, of a little meditation, then stop in at St. Armands Key Lutheran Church or Les Ciseaux Salon and Day Spa. There is also an ATM on the circle in case you need more than your spirit recharged, and a charging station in the new off-street parking garage as well. Of course, there are a few sensible do’s and don’ts for all these beaches: do remove all of your own litter, leave the turtle nests alone, don’t chase the birds, don’t

smoke or bring any animals (dogs really are animals), do drink your beverages from plastic or metal containers (no glass please), and play music so you can hear it, but not someone 20 feet away. Beware of the sunsets, they are addictive.

And really different

Remember drive-in movie theaters? Well, they are back. Sort of. The Music Compound is an outfit where young (usually) people can try out their chops to see if they have the music ability they would like to believe they have. Fruitville Grove is a family owned farm-fresh market located on, of all places, Fruitville Road. This is where, every weekend in October they hold the Fruitville Grove Pumpkin Festival. They are right here is Sarasota, east of I-75 just beyond Stottlemyer’s Smokehouse (great place for BBQ after a concert). What happens when you mix

a group of young musicians and a Farmers Market? You wind up with the Music Compound Concert at Fruitville Grove. August is expected to be hot (Come on, it’s August in southeast Florida, it’s supposed to be hot) and what better way to cool down after a hard day at the office or beach than to attend a drive-in concert. On August 21st you can attend a Live and Loud music concert - free. As social distancing is being observed you will need to register beforehand at the Music Compound’s Facebook page, “Events” tab, and stay in or close to your car (bring folding chairs). Sounds like old-timey kind of fun. They open the gates at 5:30 PM and the concert is from 6 - 7:30 PM. Music will be performed by Los Rojos (not “those” Los Rojos, but the ones shown in the photo). A Kona shaved ice truck will be there to help you cool down faster.

Avenida Leona residents of our street to suffice on our petition rather than 20% of the residents within 1500 feet.” “What do we need to do as commissioners to get our Traffic Advisory Council some leeway in this signature rule?” Maio asked his board colleagues on March 10. “We don’t need a fire truck and ambulance not fitting down the street.” Ultimately, the commissioners approved direction for staff to research the issue and provide the board with a report on the findings. Because of staff’s efforts to contend with the early stages of the novel coronavirus pandemic, County Administrator Jonathan Lewis explained, it probably would be July before that staff report could be issued.

Resolving the petition issue As it happened, the County Commission ended up addressing the two related Avenida Leona items on its July 7 Consent Agenda of routine business matters. The first called for adoption of a resolution “amending the procedures for the submission of petitions to the Traffic Advisory Council,

repealing Resolution No. 2014040.” A PowerPoint presentation prepared for the board on that issue said, “Current signature requirements are a hardship for petitioners in self-contained communities and dead-end streets.” The second item called for adoption of a resolution “prohibiting parking on the south side of Avenida Leona from Calle Minorga to the eastern end of the road, including cul-de-sac.” The board members unanimously approved the Consent Agenda. The resolution proposed for amending the TAC petition process included two new sections, as noted below: “B. For matters impacting local roads confined within a selfcontained community without a Homeowners Association, the Petition must be signed by: “i. The greater of 5 unrelated individuals or 20% of the residents within the self-contained community. A ‘self-contained community’ is defined as a community that has a single or few focused points of access from several internal, intersecting, local residential roads to adjoining arterials or collectors. “C. For matters impacting local roads that are dead-end streets without a Homeowners Association, the Petition must be signed by: i. The greater of 5 unrelated individuals or 20% of the residents on the street from the beginning of the street to the dead-end.” A county staff memo explained that the TAC considered those proposed changes during a meeting on June 8. By a vote of

6-0, the members approved a recommendation that the County Commission adopt the changes. When the SNL contacted Dr. Braun about the board actions, he responded in a July 15 email: “The main purpose of pursuing this [parking] restriction was to make sure that emergency vehicles always had access to homes on our street, especially during the peak of the season. The fact that in the process of obtaining our own approval we were able to provide for changes that will make it easier for others in similar situations, who may have been dissuaded in the past, is an added bonus.” Braun also pointed out, “Perseverance was the key to success and our residents feel more secure with the parking restriction and thank all who helped achieve its passage.” During the June 8 TAC meeting, the draft minutes said, Amjid Hussain, an engineer with the county’s Traffic Engineering & Operations Division, explained that Avenida Leona has no sidewalks or bike lanes, and the speed limit is 25 mph. “Vehicles have been parking in the 11-foot travel lane on both sides which hinders emergency response vehicles,” he added, according to the minutes. A staff PowerPoint presentation provided to the commission in its July 7 meeting packet further pointed out, “Nearby streets Avenida Madera and Avenida Milano have no parking on the south side.” None of the commissioners — including Maio — commented on the agenda items before the vote that morning.

The proposed text amendment would allow no hotel room within such transient accommodations to contain a kitchen. Moreover, it would add that “in calculating the maximum number of hotel rooms allowed within an individual transient accommodation use” on property zoned CG/SKOD within that “South Bridge Area,” each hotel room without a kitchen would be counted as one-quarter dwelling unit, instead of half a dwelling unit. Finally, the amendment would allow no transient accommodation to “contain more than 120 hotel rooms.” The county’s CG district allows for up to 13 dwelling units per acre. Among notes provided by members of the county’s Development Review Committee (DRC) when they reviewed Kompothecras’ preliminary proposal on May 21 was the following: “Proposed text amendment is site specific, rather than applicable to either the entire County or only the Siesta Key Overlay District, which would be preferred. Additionally, it will need to be demonstrated how the proposed density calculation is not an increase in density which is prohibited on the Barrier Islands.”

Density Calculations have prompted numerous discussions in recent years during Siesta Key Association (SKA) meetings. Residents — including SKA directors — have complained especially about the increasing number of new houses constructed near Siesta Public Beach for rental to tourists. Advertised via online accommodations platforms such as Airbnb and Vrbo, some of those homes are marketed as being able to sleep 25 or more people. SKA members have raised concerns about additional traffic congestion associated with those big new homes, pointing particularly to potential problems if hurricane evacuations become necessary. On May 19, an attorney for the Icard Merrill law firm in Sarasota filed the first proposed county Comprehensive Plan amendment to Future Land Use Policy 2.9.1.
