Amendments to the Bermuda Immigration and Protection Amendment Act 2012 By Dale Young, President of the Chamber of Commerce - Real Estate Division


Recent changes have been made to the Bermuda Immigration and Protection Amendment Act 2012. As president of the Real Estate Division of the Chamber of Commerce and a realtor for over 25 years, I thought it important to share with you what the Amendment relates to.

person who does possess Bermudian status (within the meaning of the Act);

First is the removal of the provision for spousal licenses for a family home where one spouse is a non-Bermudian. A license is no longer required in these circumstances.

(b) if the mixed status couple acquire an interest in land and the non-Bermudian spouse only subsequently becomes aware that he already holds another interest in land; or

Second the Act makes provision for a Code of Practice. This provision deals with situations whereby the Minister will permit a ‘mixed couple’ (Bermudian with non-Bermudian spouse) to have an interest in more than one property without the requirement for a license.

(c) if the mixed status couple acquire an interest in land and the non-Bermudian spouse honestly believed that an interest previously held by him or them had been sold or transferred, but the sale or transfer is subsequently found to be defective or void (requiring rectification).


2.2 In such other circumstances as the Minister considers appropriate, the Minister may approve the holding or acquisition of more than one interest in land by a non-Bermudian spouse without obtaining a licence under Part VI of the Act.

SETTING OUT THE CIRCUMSTANCES IN WHICH THE MINISTER WILL GRANT APPROVAL FOR A NONBERMUDIAN SPOUSE TO HOLD OR ACQUIRE MORE THAN ONE INTEREST IN LAND, AND THE TYPES OF CONDITIONS WHICH THE MINISTER MAY ATTACH TO HIS APPROVAL 1. Introduction (a) This Code of Practice must be read in conjunction with the Bermuda Immigration and Protection Act 1956 (“the Act”), and expressions used in the Act apply to this Code. (b) In this Code— “land” (as defined in the Act) refers to land in Bermuda; “mixed status couple” means a married couple, only one of whom possesses Bermudian status (within the meaning of the Act); “non-Bermudian spouse” means a person who does not possess Bermudian status who is married to a

2. Relevant circumstances 2.1 On an application made in such form as the Minister may require, the Minister will approve the holding or acquisition of more than one interest in land by a nonBermudian spouse without obtaining a licence under Part VI of the Act, if the Minister is satisfied as to any of the following circumstances: (a) if the mixed status couple hold an interest in land and are in the process of selling it, but wish to acquire another interest in land before the sale is completed;

Conditions The Minister may attach the following conditions to approval: (a) that the non-Bermudian spouse must divest himself of one of the interests in land within the period of 12 months beginning with the date of the Minister’s approval (“the initial period”), or such longer period as the Minister may grant under paragraph (b); (b) that an application setting out reasons for the need to extend the initial period for a period not exceeding a further 12 months must be made before the expiry of the initial period; and (c) such other conditions as the Minister considers necessary. 4. Commencement This Code of Practice comes into effect on 14th September 2012.
