Conditions of Sale

1. Highest bidder to be purchaser subject to reserve price. If any dispute arises between two or more bidders, the lot to be put up again and resold or auctioneer may declare the purchaser.

2. The pedigree, history and description of each animal shall be guaranteed and warranted to be correct in all particulars, by the person whose name appears as Vendor but such animal shall be sold, subject to all faults. No liability whatsoever shall be undertaken by the Auctioneer, for the statements appearing in the catalogue. The Vendors who supply such statements are alone responsible for any error or misrepresentation.

3. All animals are sold as they stand and the purchaser is deemed to have examined each animal and fully satisfied himself/herself as to the correctness of any animal for which they have bid, which shall be their responsibility at the fall of the hammer.

4. Service dates are indicated in the catalogue but no guarantee can be given as to the absolute accuracy of these dates or sires used. Also, ewes which are scanned in-lamb on the day of sale cannot be guaranteed in lamb beyond the sale date nor can the number of lambs which they carry be guaranteed whatsoever.

5. All lots to become the absolute property of purchaser at the fall of the hammer.

6. The auctioneer acts as agent for the vendors and any action taken by a purchaser must be against the vendors and not the auctioneer or livestock mart committee.

7. Sheep will be sold in the order in which they appear in the catalogue.

8. Ewes will be sold in Euro guineas and all cheques must be advised to AIB, Ballybofey, Co. Donegal.

9. All purchases are made on the distinct and clear understanding that no warranty or guarantee whatsoever is given and shall be in the risk of the purchaser at the fall of the hammer.

10. Purchasers not complying with these conditions will be liable to have their lots resold by public auction.
