NCDOT TO HOLD PUBLIC MEETING FOR THE EAST DURHAM RAIL SAFETY PROJECT DURHAM COUNTY TIP PROJECT NO. P-5706 The N.C. Department of Transportation will hold a public meeting regarding the East Durham Rail Safety Project which proposes approximately 2.4 miles of railroad improvements and the construction of new bridges carrying Glover Road and Ellis Road over the North Carolina Railroad. The project also proposes the closure of the Wrenn Road railroad crossing.

The meeting will be held on March 14 at the Hamner Conference CenterDogwood Room located at 15 T.W. Alexander Drive in Durham from 5 7 p.m. The public may attend at any time during the meeting hours.

At the meeting there will be maps of the proposed plans as well as project team members who will be available to answer questions and receive feedback Please note there will be no formal presentation. The opportunity to submit written comments will be provided at the meeting or may be done via phone, email, or mail by March 28. All comments received will be taken into consideration as the project progresses.

Ethical Failures On Tuesday, Leigh Tauss published a story about how Raleigh City Council member David Cox had tried to alter a sewer project and then, when the city’s public utilities director determined that Cox’s request wasn’t feasible, asked the city attorney to investigate and possibly discipline the director (see page 7).

Council member Stef Mendell, a Cox ally, weighs in with a lecture on journalism ethics: “I have always been a supporter of journalism and a free press,” she begins.

“In recent years, the ability of a number of media outlets to present objective and balanced reporting has been seriously compromised. It’s sad to see that happening now in our community. While it’s appropriate for a media outlet to have a point of view that they express in their editorial opinion pieces, it is not appropriate for that point of view to influence coverage of news pieces.

Increasingly, INDY Week has breached the wall between objective news reporting and opinion with their coverage of local government issues.

“What’s equally disturbing is their failure to acknowledge relationships that have the potential to influence not only their investigative reporting and news stories, but also their editorial coverage. I believe that every time INDY Week writes about local politics, they should openly disclose any business or personal relationships between family members of their owners/reporters and family members of local elected officials.

To do otherwise is an ethical failure.”

To which INDY editor Jeffrey C. Billman replied: “We don’t shy away from having a point of view—we stress transparency and fairness in our reporting, not objectivity—but, to my mind, there’s nothing in that story that constitutes an opinion. It seems to me you’re upset that it’s not the story you wanted to have told.

“And I’m not entirely sure what you’re on about in terms of conflicts of interest. Leigh Tauss has no family relationships in North Carolina, so I assume you’re referring to our company’s owner, Richard Meeker, whose brother used to be Raleigh’s mayor. We’ve never hidden that, and disclose it in every story in which it could remotely be relevant.

consulted, for example, when we endorsed you in 2017.) So what exactly are you implying by alleging an ‘ethical failure’?”

(In a subsequent Facebook post, Mendell said she was referring to David Meeker, Richard Meeker’s nephew and an owner of Trophy Brewing. One of David Meeker’s business partners is married to Nicole Stewart, a council member.)

“Freedom of the press has been under assault since Trump took office, and now that assault has made it normal behavior to watch our local elected officials shred investigative journalism whenever it suits their agenda,” writes Publius. “Shame on all enemies of the free press! That means shame on you, Stef Mendell, as well as all the other Trump-lite haters who seek to squelch the voice of a reporter and newspaper to suit your political agendas.”

S Bell argues that Cox was just doing his job: “Personally, I’m glad to see a city council member advocating for his constituents.

That’s, like, their job, right? David Cox has been an excellent champion, both compassionate and responsive, for our district.”

“Sure,” Kevin replies, “council members are supposed to advocate for their constituents. But they should also listen to qualified and professional city employees.

Cox can still be a good champion for the district while understanding that, sometimes, he and his constituents won’t get it exactly their way. I’m really glad to see a city employee advocating for cost-effective and environmentally friendly practices. We shouldn’t tear up plans that have been in the works for two years because one person complained. Hopefully, the city manager can act as more of an intermediary between the city council and city employees. We could soon find ourselves losing some highly regarded and smart employees because of the actions of uninformed, shortsighted, and overly emotional politicians.”

Storm the Castle

FIFTY YEARS AGO, BLACK STUDENTS TOOK OVER DUKE’S ADMINISTRATIVE OFFICES TO DEMAND A MORE INCLUSIVE UNIVERSITY. A NEW EXHIBIT REMINDS US WHY THAT EVENT MATTERED. BY ERIN WILLIAMS

uke’s Chappell Family Gallery, by the entrance to Perkins Library on the west campus, always has an exhibit, but usually, students rush by without noticing it. That hasn’t been the case over the last couple of weeks.

What’s there now is different—eyecatching, urgent, relevant. Vintage photos of chaos. Familiar gothic buildings engulfed in tear gas, surrounded by mobs of students.

Black Students Matter: Taking Over Allen in ’69—on display through July 14—commemorates the fiftieth anniversary of the Allen Building takeover of February 13, 1969.

That day, about seventy members of Duke’s Afro-American Society broke into the campus’s main administrative office, intending to hold the building hostage until the administration acknowledged their thirteen demands, including the creation of a Department of African and African American Studies, a black dorm on campus, and a black student population proportionate to the state’s.

The students’ decision to occupy the building was organized and highly democratic, and it followed years of failed efforts to negotiate. The night before, students met at the house of Charles Becton, a first-year law student, to strategize. They wouldn’t go through with the plan unless they had the unanimous support of black students on campus.

“No weapons of any kind,” Catherine LeBlanc recalled one of the group’s leaders saying during a talk at Duke for the exhibit’s opening. “We did not want to give the administration or law enforcement any reason to beat us.”

The next morning, the students rented a U-Haul, pulled up beside the Allen Building, and piled out in a hurry. “We were able to get in and lock the door very, very quickly,” said LeBlanc, a sophomore at the time. “We had practiced this thing.”

The students had prepared to occupy the building for days. They’d stocked groceries 6 | 3.6.19 | INDYweek.com

and playing cards. By that afternoon, however, they’d received word that then-university president Douglas Knight had called the police. They were warned there’d be tear gas. The students readied themselves by squeezing lemon juice in their eyes and putting cigarette filters in their noses.

More than a hundred law enforcement officials convened in the gardens behind the Allen Building. They were met by more

they released tear gas. Some twenty-three students were hospitalized, along with two law enforcement officials.

Knight blamed the violence on the black students.

But Wib Gulley, a former Durham mayor who was a student during the takeover, remembers things differently.

than two hundred mostly white students who surrounded the building to protect their black classmates.

The black student occupiers held a vote on whether to stay put or leave. Most voted to stay. Becton, the vote-keeper, lied about the tally. They vacated at 5:15 p.m.

“Good thing he did that,” said LeBlanc.

Fifteen minutes later, the police came in.

The cops clashed with student protesters, and the confrontation boiled over when

bringing Durham police on campus to teargas and forcefully remove the students,” he said during the opening. Gulley was next to the Allen Building when the confrontation occurred. “A Durham police officer drew his gun and pointed it at me and some of the students there, and I was very concerned about what was going to happen.”

from March 19, 1969, which explained how, after a nine-hour hearing, forty-seven students were charged with violating Duke’s “Pickets and Protest” policy.

“When many of us left here, there was quite a bit of ambivalence about Duke,” LeBlanc said. “It was not unusual to feel that folks didn’t want us here.”

Despite the administration’s reproach, the takeover was a galvanizing event “both in terms of how the students saw their role and in some of the changes that were made afterward,” Gulley said.

Duke still has issues surrounding race, some of which make news: In 2014, vice president Tallman Trask III allegedly called a black parking attendant a racial slur after he struck her with his Porsche. In December, outgoing vice president Larry Moneta deleted his Facebook account posting comments from China that some students considered culturally insensitive. And in January, the graduate director of the Duke medical school’s biostatistics program stepped down from that role after sending an email urging Chinese students to “speak English 100% of the time.”

But there’s also an African and African American Studies department at the school, a black cultural center on campus, and a far greater percentage of black students and faculty. In the past year, Duke has removed a statue of Robert E. Lee from its chapel, and the Board of Trustees voted to remove a white supremacist’s name from the erstwhile Carr Building.

And much of that progress can be traced to the actions of the Afro-American Society in 1969.

As Corey Pilson, the chief of staff of the Black Student Alliance, which grew out of the Afro-American Society, said during the exhibit’s opening: “You all started a culture of activism on campus that has kept the university accountable for the last fifty years.” backtalk@indyweek.com

IN 2017, DAVID COX CAST THE ONLY VOTE AGAINST UPDATING A CODE OF CONDUCT THAT A FORMER COLLEAGUE SAYS WAS DESIGNED TO KEEP HIM FROM ATTACKING CITY STAFFERS

I

n December, Raleigh City Council member David Cox fired off an email seeking an investigation into and possible disciplinary action against Robert Massengill, the director of public utilities. As the INDY first reported last week, at issue was a sewer project in Northeast Raleigh.

Cox wanted Massengill to relocate pipes to a wetland rather than dig up his constituents’ backyards. Massengill thought that wasn’t a viable option.

Cox did not return three phone calls seeking comment for that story. On Facebook this weekend, however, he denied that he was angry when he sent the email. “Nothing could be further from the truth,” he wrote.

While five high-ranking City Hall sources have told the INDY that Cox has berated staffers when he didn’t get his way, another high-level staffer says this feeling isn’t universal, and his interactions with Cox have been nothing but professional.

The Massengill email wasn’t Cox’s first time seeking recriminations against a city official. Six months earlier, he’d initiated an investigation into planning commissioner Eric Braun following a heated planning commission meeting involving a project in Cox’s district. The city attorney did not sustain misconduct allegations against either Braun or Massengill.

The emails that launched those probes may violate the code of conduct the council updated in 2017, says former council member Mary-Ann Baldwin. The code was updated to limit the council’s interference with staff and advisory boards, Baldwin says—and was designed with Cox in mind.

When it came up for a vote, Cox was the lone dissenter. He argued that it conflicted with the First Amendment.

“That’s why we formed a task force [to update the code of conduct]. It was really about managing this kind of behavior,” says Baldwin, who left the council at the end of 2017. “There have been instances where Mr. Cox had attacked staff on Twitter and on social media, and those are reasons why we

felt we needed some guidance with the creation of the code.”

The code says that “all comments about staff performance should only be made to the city manager’s office through private correspondence or conversation” and instructs council members to “not get involved in administrative functions.”

City attorney Robin Tatum Currin did not respond to a question about whether Cox’s emails violated these edicts. The code of conduct is toothless in any event. The council can censure members for violating it, but there are no penalties.

Cox’s decision to copy the entire council on his complaints could pose a different problem: It publicizes a personnel matter and potentially waives attorney-client privilege, making his complaint a public record, says attorney and open-government advocate Jonathan Jones.

“Sometimes a city council member is raising a concern that the public ought to know about,” Jones says. “But sometimes they are raising concerns that are frankly petty, so the city manager ought to be a buffer there.”

Cox declined to comment Monday.

On May 24, the planning commission met to review changes to the 2030 Comprehensive Plan for the Falls of Neuse corridor, which included a lot at the corner of Raven Ridge and Falls of Neuse Road. Residents who had previously opposed the development of the eighteen-acre site—and who helped kill a controversial Publix proposal down that street, an effort that catapulted Cox into office in 2015—attended the meeting. Eager to voice their perspectives, they became “boisterous,” says commission chairman Rodney Swink.

Swink says he and then-chairman Eric Braun, who declined to comment, tried to calm the crowd. John Purves, who was at the meeting, says Braun became “a little aggressive,” and his demeanor “was a little inappropriate, unprofessional.” But Purves, a former trial attorney, brushed off the incident and apologized to Braun afterward. A few days later, Cox asked him what happened.

On June 3, Cox emailed the entire city council, city manager Ruffin Hall, and interim city attorney Dottie Leapley to seek an investigation into Braun’s conduct.

“I have received a number of complaints regarding Mr. Braun’s conduct during Planning Commission meeting. How do you want to address them?” Cox asked.

Hall replied that he’d get back to Cox and said he was unfamiliar with any complaints.

Mayor Nancy McFarlane responded June 5 and asked Cox to disclose where the complaints were coming from and provide details about Braun’s alleged misdeeds.

“Your response is vague,” she wrote.

Cox replied that Purves and resident Tim Niles had complained. “I defer to those in attendance to explain their concerns.”

Subsequent replies were redacted.

Six months later, when Cox initiated the investigation into Massengill—accusing Massengill of misleading him “either accidentally or willfully”—McFarlane scolded Cox, saying that requesting immediate disciplinary action was “totally inappropriate.” Council members shouldn’t influence project management or tell staffers how to do their jobs, McFarlane wrote.

“All staff should be respected, and problems resolved without accusatory and

inflammatory comments,” McFarlane added. “If council members abuse this privilege, I would suggest to the [city manager] that he reconsider the methods by which the council members interact and communicate with our staff.”

A month later, Cox and Massengill organized a public meeting to address residents’ concerns about the sewer project, Cox wrote on Facebook this weekend. “Going forward,” he said, “I will continue to work with staff and the homeowners to facilitate communications and mitigate the impacts of this project as much as possible.”

Council member Corey Branch says he didn’t vote to change the code of conduct to police any one person’s behavior.

“It came out of a byproduct of everything you see across the country, across the board, how some elected officials have just been disrespectful with how they communicate and talk to staff as well as each other,” he says. “Councilor Cox did not vote for the code of conduct, so I guess he feels his emails were in his right. I personally would not have sent those emails. I would never ask for someone’s job blatantly. I know I wouldn’t have communicated in such a manner.” ltauss@indyweek.com INDYweek.com | 3.6.19 | 7

DEVILS’ BARGAIN Duke might kill light rail.

Its relationship with Durham will never be the same.

ou could argue that light rail was dying before Duke University killed it—that its demise was inevitable, a slow bleed that had played out over years of near-death experiences, the project lurching from one existential crisis to the next, hanging on for dear life until it could hang on no more. Duke merely put the period on an overwrought sentence.

You might not be wrong. But you’d be letting Duke off the hook.

The General Assembly, overtly hostile to mass transit, set the stage for last week’s drama in 2017, when it imposed an arbitrary deadline on the $3.3 billion Durham-Orange Light Rail Transit project, which, in turn, set in motion of a cascade of other deadlines. The legislature gave transit agency GoTriangle until November 30 to secure $1.2 billion in federal funding, or else lose up to $190 million from the state. To do that, GoTriangle had to submit its application to the Federal Transit Administration by April. To do that, it had to negotiate a dozen or so cooperative agreements with key local partners, including Duke, by the end of February.

Here, things went (sorry) off the rails.

his isn’t a defense of the DurhamOrange Light Rail. Any project of this scope warrants skepticism of its cost and ridership projections, of the notion that it’s the best use of mass-transit dollars.

That’s beside the point.

This is a defense of democracy.

In 2012, Durham and Orange County voters approved a sales tax hike to fund light rail. They haven’t changed their minds since. They’ve elected politicians who support the project, even as the price tag rose and the state’s share fell—from 25 percent at the outset to less than 8 percent of construction costs now. These politicians have, in turn, made light rail a centerpiece of long-term land-use and transportation planning.

All of that just came to a screeching halt.

Not because it’s unpopular. But because one wealthy institution decided that its needs matter more than everyone else’s.

“They [are basically] saying that they should have control of a public policy decision,” says Wendy Jacobs, a GoTriangle trustee who chairs the Durham County Board of Commissioners. “The decision to pursue light rail was a public policy decision made by the governments of Durham, and that’s a complete breach by Duke to say their interests are not aligned with the public interest of Durham.”

In a post on its website February 28, Duke said it supports “a comprehensive and sensible regional transit network for our dynamic and diverse area, one that serves all citizens and makes the best and effective use of all modes of transportation, including buses, commuter rail, and light rail. We recognize the transformative effect such a plan could have on our citizens, particularly those in underserved parts of the community.”

The day before, in its letter to GoTriangle spiking light rail, Duke offered similar bonhomie: “You have our personal pledge that Duke will maintain—indeed, deepen—our mutual partnership and shared engagement with the community. We are unwavering in our commitment to address our shared challenges. Together, we can be a force for even greater good.”

None of that quite squares with what happened. (It squares more closely with the $5 million the anti-transit Charles Koch Foundation gave Duke in September, if you’re feeling conspiratorial.) Far from engaging in a “mutual partnership” to address “shared challenges,” Duke dragged things out but refused to say yes.

Duke has its veto for one reason: The light rail line runs down Erwin Road, along Duke’s west campus and medical and research complex. For GoTriangle’s FTA application to proceed, the agency has to reach an agreement with Duke, and its nonprofit arm has to acquire a chunk of Duke property, worth $16.5 million, on which to build the line.

The DOLRT runs down Erwin Road for two reasons: One, it makes sense. Several of the 17.7-mile line’s nineteen stops are designed to service Duke students as well as employees and patients at its medical centers and at the nearby VA hospital.

Two, Duke agreed to it, or acquiesced to it. At least, it gave everyone the impression that it had.

On this point, Duke has engaged in some revisionist history of late.

In a letter to Jacobs and Durham Mayor Steve Schewel in November, Duke president Vincent Price said that “numerous and quite significant problems remain, in

Duke wasn’t the DOLRT’s only problem, just its most acute. GoTriangle also hadn’t inked a deal with the North Carolina Railroad Company and its operating partner, Norfolk Southern. The railroad informed GoTriangle that it wasn’t ready to play ball on February 27, during a Board of Trustees meeting.

Then there’s the money. As of January, GoTriangle’s nonprofit had only raised about $15 million of the $102.5 million in cash and land donations it needed to bring in by April 30, another legislative deadline. More important, last week the FTA told GoTriangle that it needed to find an extra $237 million to cover design changes, including a planned tunnel in downtown Durham, as well as other expenses.

These issues were difficult, but not insurmountable, officials believed. They could figure out the money. They could keep negotiating with the railroad. (The railroad’s letter made clear that it wasn’t a hard no—it just wanted to see more design work before signing off.) They just needed Duke.

With the clock ticking down, GoTriangle tried to shame the university. It released a timeline to The News & Observer that, in no uncertain terms, blamed Duke for the looming debacle and suggested that the school’s officials were erecting pointless obstacles and sabotaging the endeavor.

Duke wasn’t shamed. The N&O’s story came out Tuesday. On Wednesday, Duke told GoTriangle it was out.

The news was a gut punch. Twenty years of planning, $130 million already spent—all circling the drain. There was no good way to spin it. “It’s ninety-nine-percent dead,” Orange County commissioner and GoTriangle trustee Mark Marcoplos told me Friday.

The people of Durham voted for light rail.

They agreed to pay for light rail. But Duke ended up with a veto.

And at the eleventh hour, Duke used it.

particular, the proposal to route and then elevate the line along Erwin Road which was never agreed to by the university, and in fact was identified as unworkable in correspondence going back decades.”

The facts say otherwise.

Four years ago, Duke vice president Tallman Trask III, Duke’s point-person on the project, specifically asked GoTriangle to put a station on Erwin Road, a block east of Duke Hospital, because it will “reinforce the Campus gateway.” Later in 2015, when GoTriangle crafted a key Draft Environmental Impact Statement on the route, it received well over one thousand public comments. None came from Duke.

And the idea to elevate the line from LaSalle Road to Anderson Road, which would cost $90 million? That came from a Duke, too, so as not to disrupt the hospital’s emergency access and power supply.

By 2016, there was a Record of Decision, and the line’s route was set. Duke and GoTriangle signed a memorandum of understanding that December.

In other words, the university had a chance to weigh in before the alignment was finalized. It chose not to.

Duke’s president didn’t seem to realize that. Last April, Jacobs says, she visited Price, who’d taken over the university in July 2017.

“When I sat down and talked with him about the project, I got very concerned because it was very clear to me that he didn’t, first of all, know much about it, and that he did not seem to be very supportive of transit,” she says. “He was also talking about it as if it was some type of an option and didn’t seem to understand this was not an option—this was something we had Duke’s support on.”

In the end, several local leaders concluded that Duke’s upper echelon never wanted light rail to happen, not in their backyard.

They didn’t say anything earlier because “they thought someone else was going to kill it,” one area politician told me last week.

o be sure, Duke has legitimate concerns. The letter Duke sent GoTriangle last week outlined four “unresolved challenges” related to the rail’s alignment and construction: electromagnetic interference, or EMI, from the rail line, vibration from construction, disruption to power and utilities, and liability.

Of these, the most important is probably EMI, which has plagued light rail projects across the country, as the electromagnetic waves the rail generates can affect sensitive lab and medical equipment within a few hundred feet of the line. a light rail line away from a medical center. A line on the University of Minnesota campus has reportedly disturbed research in the chemistry and medical departments.

According to a January 25 GoTriangle memo, Duke is concerned that the DOLRT would run just 106 feet from the Global Health Research Center building, where the university conducts disease research.

According to the letter Duke sent GoTriangle last week, Duke is also worried that the line will sit 150 feet from “the most densely concentrated corridor of patient care and biomedical facilities in the state.”

GoTriangle says Trask didn’t mention EMI until November 2017. Trask—who in 2014 was accused of striking a black parking attendant with his Porsche and then calling her the N-word—suggested moving the line north and running it near the Durham Freeway, through the historically black Crest Street neighborhood, according to GoTriangle’s timeline. The logistics were impossible at that late stage, which is fortunate for Duke. Just imagine the optics.

GoTriangle tried to accommodate Duke.

It provided Trask with a list of the buildings it thought might be affected by EMI, and an analysis showing what types of equipment might be at risk and how close they’d have to be to the train to be damaged. It asked Trask to provide the locations of EMI-specific equipment. Trask, according to GoTriangle, was skeptical of the agency’s analysis and decided to shop the report around to other experts. He also worried that light rail’s EMI might get in the way of future expansion.

Last month, GoTriangle produced a new EMI modeling report. Of the sixteen buildings in the corridor GoTriangle calls Zone 3—along Erwin Road near Duke’s medical facilities—ten are at no risk of EMI impact, according to the report. Two face a potential low impact, and four, including Duke University Hospital, could see a moderate impact. The hospital’s eye center, meanwhile, contains two electron microscopes, which have a high likelihood of interference.

But all of this depends on where sensitive instruments—electron microscopes, MRIs, etc.—are inside of these buildings. The further away from the rail, the more degraded the magnetic wave. GoTriangle needed more information. It says it asked for it in late 2017, then again in 2018.

Duke didn’t provide it. Then time ran out.

In its letter last week, Duke said that “there have been inconsistencies in the information that has been generated to date” and “we are not yet able to determine with confidence whether the new study we received last week can adequately address this risk.”

The potential impact to Duke Hospital is nothing to sneeze at. But there are solutions. The equipment could be moved away from the rail line. The room it’s in could be shielded. The light rail system could impose operational constraints—i.e., slow the trains down—to reduce the current and thus the size of the magnetic field. In 2011, the Maryland Transit Administration used “atthe-receptor” technology to mitigate interference with the University of Maryland’s sensitive equipment.

If Duke wanted to work something out, several pro-transit sources told me last week, it could. The other problems—construction, liability, and so on—have similar workarounds. They’re only deal-killers if Duke wants them to be.

“I’m convinced they did not try to kill this light rail project because of all the things they mentioned,” Marcoplos told me. “They did not want this project for some reason.”

“They didn’t want the inconvenience,” added another source.

oTriangle had tried to accommodate Duke before, in elevating the line along Erwin. Last week, though, Duke cited this elevated line—which, again, Duke suggested—as the source of the vibration it could not abide: “The proposed elevated rail line … will require excavating at least nine 40-foot deep holes in Erwin Road. This excavation will cause vibrations over a construction period of years and is far beyond the acceptable levels we impose on any public or private construction project in the vicinity of our hospital and clinics.”

This sort of thing has GoTriangle officials flustered.

On Monday evening, GoTriangle sent a letter begging Duke to reconsider. The alternative, CEO Jeff Mann wrote, would mean “effectively nullifying two decades of work.”

GoTriangle doesn’t think EMI will be a major issue, Mann wrote. But if it is, the agency will pay to address it. It’ll take care of relocating utilities, too. It’s offered to cover Duke on its insurance. And building the rail will cause less vibration than other construction projects currently underway around Duke’s hospital, Mann argued.

“GoTriangle remains committed to working closely with Duke University to execute the cooperative agreement so we can work together in good faith during the remainder of the design and throughout construction to address any issues or concerns that may arise,” Mann wrote.

What he didn’t say: What the hell else do you want?

Mann asked Duke to enter mediated negotiations over the next four to six weeks—the same request Jacobs says she and Schewel

made two weeks ago and Price refused. Time is of the essence. The FTA reminded GoTriangle last week that “major delays” would be “cause for re-evaluation.”

The ball’s in Duke’s court. If the university won’t change course, GoTriangle has few options. It could try to take Duke’s land through eminent domain—hoping the FTA accepts the move, the General Assembly doesn’t freak out, and the agency isn’t bogged down in litigation—but that’s a long shot.

If DOLRT collapses, GoTriangle will still forge ahead with transit, just somewhere else.

Wake County is planning commuter rail, but it too will need an agreement with the North Carolina Railroad Company. “If we don’t get some support from the railroads, we’re not going to be able to do commuter rail,” says Commissioner Sig Hutchinson, a GoTriangle trustee. “It is a severe problem right now.”

Hutchinson’s also eyeing a high-speed rail corridor that could connect Wake Forest to downtown Raleigh’s Union Station in twenty-three minutes, alleviating traffic on Capital Boulevard, and then to Apex. That and commuter rail, he says, could be the basis for a regional system.

From there, you could restart talks with Durham and Orange Counties. But Durham and Orange would rather not wait.

Duke has done a lot for Durham, even when the crime-ridden Durham was a liability for Duke. Through loans and grants, Duke’s Office of Durham & Regional Affairs has invested millions into affordable housing over the last decade. The university was an early partner in the American Tobacco Campus, a co-investor in the Durham Performing Arts Center, and instrumental in creating Durham Central Park.

“Duke and Durham chose each other, and our destinies are still entwined,” former Duke president Richard Brodhead wrote in 2016, at the end of his tenure. “At Duke, we are grateful for the benefits of living in Durham, and we are committed to doing our part to increase those benefits for all.”

But that relationship changed last week, no matter how this ends. There’s no getting around that.

“Of course our fates are intertwined,” Jacobs says, “and we have to work together.

But it will be different going forward. In my view, this represents a turning point.”

On Twitter, Durham City Council member Charlie Reece put it more bluntly: “Duke’s decision to kill the light rail project sadly reinforces the worst fears of many Durham residents—that Duke University is an arrogant and elitist enclave with little interest in being the kind of partner this city needs.” jbillman@indyweek.com Additional reporting by Sarah Willets.

FOR CHINESE STREET FOOD, LOCAL AUTHOR FRANK KASELL TRAVELED BY TRAIN TO EAT THREE HUNDRED DISHES IN FIFTY-THREE CITIES IN THREE MONTHS BY LAYLA KHOURY-HANOLD

“U

sually, if I see internal parts on a menu, they’re worth trying,” says Frank Kasell, who I’ve invited to discuss his first book, Chinese Street Food (Blacksmith Books), over a lunch of dan dan noodles, spicy beef with soft tofu, and stir-fried pork intestines at Szechuan Garden in Morrisville. I’ve never had that last dish, but since the guy wrote a book bearing the sub-title “A Field Guide for the Adventurous Diner,” I dig in. (It tastes like richer, chewier pork belly).

Kasell spent three months traveling by train across China, sampling and photographing more than three hundred streetfood dishes, recording tasting notes and anecdotes, and cataloguing them according to province and city. And while several fall on the more adventurous end of the spectrum, such as Chengdu’s rabbit heads, or Changchun’s skewered deep-fried silkworm pupae, the book explores the gamut, including fried snacks, sweets, dumplings, noodles, soups, porridges, and more.

Whether you’re an intrepid foodie or an armchair traveler, the catalog of dishes is a fascinating look at the diversity of Chinese street food and its cultural nuances.

As often happens with discovering a new cuisine, all it takes is one bite to get you hooked.

“Biting into a yóu cí is like sinking your teeth into a greasy pillow of pure joy—not a brand-new fluffy feather pillow that is mostly just air, but a denser, worn-in one that has already conformed to the shape of your head,” Kasell writes in his book, describing the fried glutinous rice balls stuffed with tofu and scallions that he discovered while living in Jiujiang.

In 2006, after graduating from St. Norbert College with a philosophy degree, Kasell and his wife (then-girlfriend) Leslie, moved to Jiujiang, a town in the Southeastern province of Jiangxi, to teach English.

During his year abroad, he ate street food regularly, locally and in other cities, gradually building an affinity for it.

“I liked the culture of street food and how it’s integrated into the city life in a way that it’s not [in the U.S.],” Kasell says. “When you’re walking down a city street in China, in most cases, it’s not storefronts with walls and windows and a door. [Vendors] have a gate that they close at night but it’s pretty much just open to the street. You’re walking past vendors all the time— there’s no barrier between you and them—and you see people eating often on the street.”

Kasell left China in 2007, harboring a “someday dream” of writing a guide to Chinese street food. He moved first to Virginia, then D.C. to work at a non-profit called

the National Council for International Visitors (now called Global Ties). In September 2011, Kasell faced a now-or-never moment.

He and Leslie had discussed starting a family, and sensing that his free time would soon be limited, he quit his job and prepared for a research trip to realize his dream.

In January 2012, with no outside funding, no publisher, and no prior writing experience, Kasell embarked on a three-month, fifty-three city tour of China, averaging four cities per week. To minimize expenses, he traveled almost exclusively by train and relied on couchsurfing.com for accommodations. This tactic also proved a

Dān Dān Miàn Dan Dan noodles, one of Chengdu’s most famous dishes, features thin, flat yellow noodles with minced pork and a málà sauce made with chili oil and Sichuanese peppercorns.

At Szechuan Garden, the noodles are white and round but still boast the trademark tingly sauce.

Liáng Fĕn These slippery “noodles” made from jellified mung bean starch are served cold in a thin, salty broth with tofu and chili oil. It’s particularly popular in Northern China; Kasell tried it in Datong and can vouch for the rendition at Gourmet Kingdom in Carrboro.

Shāo Mài Look for Cantonese shumai at dim sum restaurants. At Raleigh’s Brewery Bhavana, the steamed dumplings are filled with pork and snow pea tips. In Durham, they are filled with pork at Hong Kong Chinese Restaurant, and with shrimp at East Coast Asian Bistro.

Xiăo Lóng Bāo Also known as XLB dumplings, these soup dumplings are the pride of Shanghainese cuisine. To avoid spilling any broth, eat them in one bite or bite off the pointed peak and then sip. Look for crab-and-pork XLB at Brewery Bhavana and Shanghai Dumpling in Chapel Hill.

great source of material—between his seatmates and hosts, Kasell discovered enough dishes to double the original length of the book, though he still ended up cutting forty dishes. It took two years to complete the manuscript while moving to Pittsboro in 2013, another year to find a publisher, and two more years until the book was released in December 2018 (on Amazon and on the publisher’s website; it’s also available at McIntyre’s Books in Pittsboro).

Looking back, it’s no wonder it took two years to write. Even a category such as dumplings required consideration to capture all the regional variations and proper categorization. In Shanghai, for example, you’ll find xiăo lóng bāo, or soup dumplings, but an hour away, Kasell discovered a namesake version in Wúxī, which have a thicker skin and sweeter aftertaste. And in Yinchuan, a Muslim-dominant area of China, guàn tāng bāo are filled with mutton instead of pork.

In Guangzhou, Kasell sampled shāo mài, a steamed dumpling with a frilly, open top, that’s often associated with dim sum. It came as a surprise to discover that shumai’s birthplace is actually Hohhot in Inner Mongolia. The shumai look the same, but here they’re stuffed with mutton rather than shrimp or pork. In Tianjin, locals insisted he try bāo zi, or steamed buns. They’re found all over China (typically filled with pork) but ultimately, he filed them under Tianjin because the buns are so revered locally due to their precise recipe and preparation.

Many of the dishes can only be found in specific cities, including Kasell’s favorite, Chengdu’s tián shuĭ miàn, rough-hewn wheat noodles with spicy chili oil and a sprinkling of sugar, or Lanzhou’s rè dōng guŏ, warm pear in a sweet red-date-tangerine-peel broth, a dish so important to the city that there’s a bronze sculpture to commemorate it. IT TOOK HALF A CENTURY FOR OUR CULTURE TO CATCH UP TO LAVENDER COUNTRY’S REVOLUTIONARY DEBUT

hen I messaged Patrick Haggerty on Facebook to ask if he had an opening slot for his March 13 Lavender Country show at the Pinhook, he wrote back saying the slots had been filled, but asked me, “Do you play anything?” I said I play guitar and sing, and he replied, “We may have a spot for you in the band.” This is how I, a semi-known queer songwriter, was welcomed into Lavender Country, the first openly gay country band.

This found family, ever-changing in lineup and size and always led by Haggerty, spent almost half a century in frustrating isolation after releasing its 1973 self-titled debut album, which mixes airy production and dusty Carter Family–style arrangements with queer politics that still blister and bluster to this day—as they should.

Pittsboro label Paradise of Bachelors were eventually clued into the album, long out of print, and prepared it for a wonderful remastered reissue, making it so generations of angry, big-hearted queers could holler along to now classics “I Can’t Shake the Stranger Out of You,” “Come Out Singing,” and “Cryin’ These Cocksucking Tears.”

I recently spoke with Haggerty about where he fits in the spectrum of queer music, now and then, and picked his brain about Lavender Country’s upcoming followup album, Blackberry Rose and Other Songs and Sorrows from Lavender Country.

INDY: I wanted to get your long view of your history as a gay musician.

PATRICK HAGGERTY: Well, let me start from the beginning. When we made Lavender Country in 1973, there were a few gay and out musicians among us. One of them was named Blackberry. I did my first show with him in 1975, and we’ve been co-travelers down this road of gay music for a lifetime. It was very different for lesbians because they had the women’s movement to back them up. But for gay men who were making music in the early seventies, it was an exceedingly lonely road for decades. Well, let me get political about it.

When the Democratic Party succeeded in coopting the lesbian/gay movement in the late seventies, their attitude was, “We’re going to mainstream this.” And gay music was not considered mainstream. To have a successful Gay Pride event, you didn’t pick up your local gay singers. You imported people from out of town. Folks who were up-and-coming and known and not gay! That was all an attempt by the Democratic Party to sideline any kind of radical gay politics, and of course, all that’s predictable. That’s what Democrats do to movements; they co-opt them and isolate their radical leadership.

This is going on right now with lots of people who are starting to push for more radical politics through the Democratic Party,

and their own party is trying to silence them. Alexandria Ocasio-Cortez is trying to do more, and it feels like her own party is smothering her.

Exactly! Down the slippery slope. The most well-intentioned people fall down this slope.

No matter how radical, it happens to all of them. You cannot maintain a radical, socialist mindset and be in the Democratic Party, because they’re a capitalist party, first and foremost. So that sidelined us a bit, and we were confined to the side stages and opening acts.

So when it came to the [album] of 1973, a radical gay revolutionary message cast on traditional country music form, it was seen by everyone, except those of us who made it and enjoyed it, as either hopeless or ridiculous. And when you add the song

title “Cocksucking Tears” to that, then it was apparent to everyone, certainly to me, that I was cast in a mold forever—that I was cast outside of the parameters of “legitimate” music.

Do you feel like you were being hired or cast as a gimmick?

I wasn’t being hired! I wasn’t even being allowed to perform Lavender Country. We had fun with it in the early days, when there was that radical push—I’m not the only one who persisted, there are thousands of us— but our voices were censored. As soon as the Democrats took over and decided, “OK, we’re gonna mainline you folks,” I was cast completely out of the pale. For thirty years, I was put in the sideline. Nobody wanted to work with me because I made Lavender

Country. Are you familiar with the term “dialectic”? It’s out of Marxism: Something turns into its opposite. And that’s what happened with Lavender Country. I haven’t changed my fundamental politics since I wrote it in 1973. Lavender Country has not changed. And “Cocksucking Tears” was the song that sank Lavender Country.

And then forty years intervened, and the culture changed, and a whole lot of people who weren’t capable of listening to the album because it has the word “Cocksucking” in it did listen to it. The song that sank it early on brought it back to life when someone put it on YouTube. And I didn’t even know that; I was singing “Your Cheatin’ Heart” to eighty-five-year-old Alzheimer’s patients, and I was thrilled that I was even working.

So that whole process was dialectical, and so are the times we live in. A whole lot of people who aren’t gay, like straight white men in the music industry, whether they were writers or performers or whatever, had to get over their fundamental [bigotry] before they got into music. Straight white men still run the industry, that hasn’t changed, but back in the seventies, they were completely homophobic. And those men who run the industry now have gotten past that shit, and say to me, “Oh, this is gold.” Lavender Country didn’t change. They changed.

City Light in the 1970s for her activist work and for integrating women into the workforce there, and it’s from the point of view of the man who fired her.

I can’t wait to hear it.

Lavender Country has hit its stride because of the time and place in history where we are.

The culture, in general, has gotten over its homophobia enough to listen to what we have to say. One really good example, and then I’ll let you go, is what happened at Hopscotch.

Paradise of Bachelors know the folks who are doing Hopscotch.

Hopscotch sent me an email and said, “Oh, we found out about you, and we were wondering if you were interested in coming.”

I sent an email back, saying, “Yeah, it’d cost a bunch of money, we’d have to fly out there, maybe we can, maybe we can’t.” And then North Carolina passed that ridiculous bathroom bill. The men who run Hopscotch, the straight white men, asked me to come play. Then the guy who runs Hopscotch called me on the phone and said, “We were interested before, now we have to have you.

Now we need you, and we know we need you.

What is it going to take to get you here?”

That’s exactly what I’m talking about. I’ve been here for years; I’m not the driving force here. Lavender Country’s been here for years; it’s not the driving force. The driving force has always been the desperate necessity, in this time and in this place, to present a new political message. And people are desperate for it.

It doesn’t have anything to do with me. Donald Trump has done wonders for my career!

The bottom line is that it’s grand to realize that it isn’t really about me. It’s about what Lavender Country was in the first place. I wrote it as a vehicle for social change and to induce radical ideas into the culture. I did that forty-five years ago, and it sat there, and finally, the culture caught up. And now I get to do Lavender Country for the very reasons I made it in the first place. It is so joyful; you can’t imagine. I could’ve watered myself down and gone back in the closet and gone to Nashville and blah blah blah. But I decided to stand my ground. And it worked! Y’all have a new album coming out. Could you tell me about it?

It’s a collection of stuff that I’ve written over the years that I’ve never had the opportunity to release. I have a song called “Gay Bar Blues” that was written during the Lavender Country era. There’s a couple of explicitly gay songs on the album, but it branches out further, and I’ve got some pro-feminist stuff I wrote, but women are singing, because it demands a woman. We have a parody of the song “Stand by Your Man” called “Stand on Your Man.” There’s a long, very dramatic ballad [about] the lynching of a black man and the murder of a white woman who fell in love in North Carolina in 1930, and that’s the title song of the album, “Blackberry Rose.” That was intimidating and hard to write. I struggled with it for a long time. There’s a very fun song about a radical feminist socialist named Clara Fraser, who was fired out of Seattle

R

aleigh lost a prominent advocate for the arts at the end of January when Lee Hansley, who ran his namesake gallery in Raleigh for twenty-five years, died at age seventy-one.

After graduating from high school in Roanoke Rapids, Hansley came to UNCChapel Hill to study journalism. He spent most of the 1970s working as a newspaper editor in various North Carolina towns.

Next, he became a curator at the Southeastern Center for Contemporary Art in Winston-Salem in the 1980s, a decade during which he also did public-relations work

at WUNC, earned a master’s degree in art history at UNC, and independently curated exhibits. In 1991, he left radio behind and devoted himself full-time to his passion for art.

Donna Clark, a longtime friend, met Hansley when they both worked in public radio. “Even back then, Lee was ambitious and had a clear vision of what he wanted to achieve,” she says, “to discourage what he considered frivolous art and establish a gallery that would engage artists of high quality that could make an enriching difference in people’s lives.”

In 1993, he opened Lee Hansley Gallery in the Capital Club Building in downtown Raleigh, promoting modernist art from North Carolina in particular and the Southeast in general—an area in which, he was not shy to tell you, he considered himself the preeminent authority. He championed the likes of Edith London, Gregory Ivy, and George Bireline. In 1999, Hansley moved the gallery to the bustling Glenwood South area, setting up shop in a small, intimate historic home with vintage charm. In 2016, Hansley moved again, this time to Dock 1053, a sleek contemporary space that would turn out to be the gallery’s final home.

Hansley was known for going beyond what was expected of a curator to enhance the value of his artists’ creations by supplying promotional materials for an exhibit or project at his own expense. It was not unusual for Hansley to drive all night to pick up a piece he liked.

“If Lee was on your side, he would go to bat for you,” Clark says. James Taylor and Carole King said it best. You’ve got a friend.

Everyone who met Hansley agreed that he was opinionated, outspoken, not afraid of conflict, and not without critics—or criticisms for those who did not share his tastes in art, music, fine dining, theater, and politics. Hansley knew who he was and who he wasn’t. He was a born-and-bred Tar Heel, a passionate yellow-dog Democrat, and proud of it. He didn’t mince words. There was no moral ambiguity about him, and he never apologized for anything.

“I admired his boldness and the way he stood up for what he believed in,” Clark says.

“His artists were lucky to have him represent them.”

Richard Marshall was a young artist straight off the boat from England when he met Hansley in 1993 and became an early exhibitor at the Capital Club Building. They became fast friends, and Marshall gave a provoking eulogy at Hansley’s funeral.

“Lee was a man of exquisite cosmopolitan tastes, a classic Southern raconteur

who spoke the truth whether you wanted to hear it or not, though his opinions sometimes clashed with traditional tastes,” Marshall said.

Ashlynn Browning, a local abstract oil painter, was also an early exhibitor—one of many new faces looking for representation to whom Hansley offered a first break.

“Lee Hansley was dedicated to his stable of artists, while always keeping an eye out for new talent to nurture,” she says. “He was brazenly opinionated, blunt, acerbic, kind, often shocking, and always hilarious. Lee believed in my work and took me on as a twenty-fiveyear-old novice straight out of grad school. I will miss his wit, his insights, his unwavering dedication to the arts, and all the flavor he added to Raleigh. They don’t make many Lee Hansleys, and his absence will be deeply felt, but his impact on the North Carolina art scene will live on.”

Ann Thomas was also an early exhibitor of Hansley’s, and they quickly became friends.

“Lee Hansley had an extensive knowledge of the art and artists of the Southeast, and he made it a mission to see that those artists who were alive were recognized, and that those no longer living were not forgotten,” she says. “It was my good fortune to be one of those artists, and I am deeply grateful for his support.”

Hansley also loved working with city planners, raising money, and drawing up plans and proposals for public art in urban spaces.

He was a member of almost every board and committee imaginable, including the Halifax

County Arts Council Board of Directors, the National Public Radio PR Council, and the Raleigh Arts Commission, to name just a few of the many organizations he worked with.

“Lee was an art warrior for artists, collectors, and the public,” says friend and colleague Betsy Buford. “He was committed to placing art in public places. Public service and improving the spaces where art was shown in Raleigh was more important to him than his gallery work. He believed that art called to the optimism within us and beckoned us to breathe. He invited us to feel, to wonder, to dream, to debate, laugh, resist, and imagine art as an antidote to our times.”

Beyond his public contributions, Hansley was proudest of working on the task force that led to the creation of Duke Energy Center for the Performing Arts as we know it today.

“We have lost a great resource in Lee,” Marshall says. “He was never a chair-padder.

If he was on a committee or board, things happened.”

Lee Hansley wanted to make the world better by making it more beautiful, and he believed that an appreciation of art could create a radical change.

“Lee Hansley has been a potent influence in the Triangle for more than thirty years, and I think he really helped change the way we look at art,” Clark says. “His greatest legacy, I think, is his effort to promote North Carolina artists and his sense of the possible.”

T

axonomy, known values, baselines, experiments: The terms are all part of a discourse associated more with science than the arts. Yet choreographer and performer Kristin Clotfelter and lighting and environmental designer James Clotfelter discuss On You, their first full-length dance work in the area, with a precise nomenclature that evokes lab coats instead of leotards.

“Scientific practices are almost [dance] scores in themselves: the way you set up an experiment as a series of steps, look at the outcome, and then try it again until you have all these outcomes that you can compare with one another,” Kristin says. James says that an experimental model seemed the best way to “capture what we’re interested in and organize our research in a way that can be analyzed and referenced.”

“So we can actually learn something,” Kristin adds, with a grin.

The approach differs from the couple’s three brief forays into regional dance after moving here less than two years ago. In New York, Kristin had an active career as a dancer with the Metropolitan Opera and Susan Marshall and Company; she played Lady Macduff in Punchdrunk’s immersive theater work Sleep No More. Meanwhile, James was creating lighting design for a broad range of companies, including Pig Iron Theater and Alvin Ailey American Dance Theater, and designing environmentally sustainable “offthe-grid” lighting and power systems for live performance.

But after the birth of their daughter in 2015, the couple needed an environment more personally sustainable than a fourthfloor walkup adjacent to the BrooklynQueens Expressway. A friend suggested they check out the dance scene in Durham. A visit during a Durham Independent Dance Artists event prompted a second visit. The couple moved here and began making inroads within weeks of their arrival.

Verses, Kristin’s pensive solo work in Tobacco Road Dance Productions’ 2018 showcase, asked what parts of a rural family’s legacy could be preserved, set against an instrumental and spoken-word ethnography by North Carolina composer Caroline Shaw. Then, in Tornow’s 2018 production, SHOW, Kristin haunted the basement of The Fruit with two colleagues as James’s lighting design altered the landscapes and relationships in Two. Over the last six months, you could say the couple has been rehearsing with musician Charles Chace and performers Pin-Han Lin and Matthew Young. But in the artists’ view, they’ve been carefully setting up an experimental protocol instead: a framework in which a carefully formulated set of research questions can be repeatedly posed during the production’s three-week run in the DIDA season. If the company has set up the experiment well, the biggest variable will be the title character: you, the audience.

“As a performer, I’m incredibly interested in choice-making, and doing that live, in response to other people who are making choices in the room,” Kristin notes. “I want audiences to have the same opportunity. There has to be some equitable exchange, where an audience member can have at least a part of the agency I have and the joy that I get from making those choices in front of people.”

Audience participation is often mocked for its awkwardness, its lack of spontaneity and grace. But Kristin and James believe that, under the right conditions, it can be nurtured and developed as an organic part of a shared artistic experience.

“We’re interested in deconstructing and disabling a lot of the assumptions and baggage we usually bring into a theater,” James says. “When you break those assumptions down, there’s no telling what all of our roles might be.”

But both are quick to reassure us that no one will be pressured to participate in any way that makes them uncomfortable.

Much of the exchange between the viewers and performance will come out of content the performers derive “from the physicality we see among the bodies that are observing us,” James says. “We can glean so much just by seeing them in the space.”

Affording audience members agency they’re normally denied also involves permitting them to respond to one another, and at points, they may be invited to participate more directly. These potentially liberating

strategies serve fundamental research questions: How do performers and audiences create the meaning of an artwork, and how might that value change if the relationships between the two change.

Instead of asking the audience to think or watch in a certain way, James says On You “asks you to listen to how you think or watch.” The goal is to answer a question Kristin poses: “If we can discern the kind of value that can exist in the space we inhabit together, can we take that value with us and let it inform our other value structures or the other places we seek meaning?” arts@indyweek.com

erman playwright Bertolt Brecht knew what American politics in recent years have proved beyond all doubt: the unique vulnerability of those who’ve realized they weren’t standing on the threshold of a new age after all.

Exertion is followed by exhaustion, and exaggerated hope by exaggerated hopelessness, as Brecht wrote in the foreword of Life of Galileo, after observing, “Glorious is the feeling of beginning, of pioneering … Terrible is the disappointment when men discover, or

think they discover, that … the old is stronger than the new… that their age—the new age— has not yet arrived.”

If there’s a taste of wormwood in Brecht’s stinging rebuke of scientific cowardice in the face of monstrous religious certainty and overweening political power, it’s partly because he retrofitted his 1938 script for the Atomic Age. In PlayMakers’ production, after Galileo (an incisive Ron Menzel) mercilessly indicts himself for recanting his heliocentric proof, the doomed astronomer confesses to his estranged protégé, Andrea (Alex Givens), “Had I stood firm, the scientists could have developed something like the doctors’ Hippocratic oath. … As things are, the best that can be hoped for is a race of clever inventors who can be hired for any purpose.”

Vividly costumed by Grier Coleman, in everything from Vatican drag (Ray Dooley’s sinister Cardinal Inquisitor) to mercenary black (guards Anna Longenecker and Ashlei Heffernan), characters from the 1600s skulk amid banks of network servers on Jim Findlay’s high-tech set. The montage of natural disasters on display panels and the quotes from climate-change deniers—including Rand Paul and Marco Rubio—on screens needlessly underline director Vivienne Benesch’s conceit: that some present-day people would be more than happy to take America back to the seventeenth century.

The proceedings are interrupted, if not derailed,

by Tristan Parks leading an out-ofnowhere danceclub troupe in a hip-hop “A Foretaste of the Future,” Brecht’s bleakly satirical ballad. But its hypothetical heat never nears the blistering reproof Galileo flings at Little Monk (Rishan Dhamija) when he rises to defend the indefensible.

“Your Campagna peasants are paying for the wars which the representative of the gentle Jesus is waging in Germany and Spain,” Galileo rails. “Why does he make the earth the center of the universe? So that the throne of St. Peter can be the center of the earth!”

When the monk persists in his apologia, asking, “But don’t you think that the truth will get through without us, so long as it’s true?” Galileo roars, “The victory of reason will be the victory of people who are prepared to reason. Nothing else.” Amen to that. arts@indyweek.com

IN SISSY, GENDERQUEER ACTIVIST AND MEDIA PERSONALITY JACOB TOBIA SHARES A SURPRISING STORY OF GROWING UP IN NORTH CAROLINA

“T

here’s something so queer to so much of Southern tradition,” Jacob Tobia says with a laugh.

“And when I say Southern tradition, I mean that in a kind of reclaimed way. For me, Southern tradition is resistance. Southern tradition is fighting back. Southern tradition is rebelling against the gentry while wearing pearls.”

The twenty-eight-year-old writer and gender nonconforming activist, who grew up in Raleigh and Cary, has gone on to capture the attention of the country.

Through their unique charm and sensibility, Tobia built a name and platform that, in many ways, has aided in shaping mainstream conversations around gender and nonbinary identity over the past several years. Now they’re reflecting on their life growing up in the Triangle in Sissy: A Coming-of-Gender Story, due out March 5 from Penguin Random House.

The memoir, which Tobia brings to Quail Ridge Books on March 7, has already been widely praised, with blurbs from Alan Cumming and Janet Mock.

Few people have queered Southern culture in such a public way as Tobia, who garnered national attention after moving to New York and being featured, in 2015, on MTV’s True Life: I’m Genderqueer.

Over the next few years, Tobia created and hosted NBC News' series Queer 2.0, moved to the West Coast and worked as a social-media producer for Jill Soloway’s Transparent, and became the spokesperson for trans-and-queer-inclusive makeup company Fluide Beauty.

But despite spending their young-adult life in bustling metropolitan hubs, Tobia still identifies the Triangle as the true source of the identity exploration that shaped who they are today.

“The Triangle is a radical place,” Tobia says. “I learned everything I know about

wrote much of Sissy at Cup A Joe, having come back to North Carolina to pen the majority of the book on a writer’s retreat.

Sissy begins with Tobia’s early experiences of gender and follows them through their life as a young, nonbinary person navigating the trials of adolescence and into the halls of Duke University.

“I honestly felt safer as a queer teenager in Raleigh than as a queer college student at Duke. It was really tough, especially freshman year, when everyone was rushing fraternities and sororities and everything was so gender normative,” Tobia says. Readers will experience raw, honest portrayals of Tobia’s teen years while being pushed to examine their own perceptions of gender identity. It’s a complex narrative of queerness that, in some ways, challenges the vehemently anti-LGBTQ image of North Carolina often painted by national media. Despite their decision to leave, Tobia rejects the notion that young, LGBTQ people must “escape” the South in order to self-actualize and find an accepting community.

The premise was good for an easy laugh in “Sure Thing,” a sketch in David Ives’s All in the Timing: The universe lets an awkward couple-to-be rewind, edit, and repeat an unsuccessful first encounter until they get to happily-ever-after. But in British playwright Nick Payne’s award-winning 2012 drama, the cosmos seems haunted by the parallel worlds in which a couple’s alternate versions play out as variations on crucial moments in their relationship.

As beekeeper Roland and physicist Marianne navigate multiple decisions—“Imagine rolling a dice six thousand times,” as Marianne says of their quantum status—the infinite possibilities dwindle to a narrowing set of available outcomes. It’s such a small untruth—a harmless, almost analgesic lie—that begins the Tony-winning musical Dear Evan Hansen. But when the title character takes the easy way out while explaining why a letter addressed to him was found in the pocket of a high school bully who’s just committed suicide, the falsehood is taken up and amplified, first by his family, then by his friends. It makes them feel better about themselves and the deceased. The falsehood somehow makes its way online, where it goes viral on social media, becoming irrevocably immortalized in a video. More lies are required to shore up the initial falsehood, as Evan realizes that the deception has grown much bigger than him and cannot be sustained. Masking heavy themes behind affable, danceable indie-pop, the Portland, Oregon-based STRFKR has followed an ascendant career trajectory akin to that of MGMT or Phoenix. The band is touring behind its 2016 release, Being No One, Going No Where, which, with its koan-like title, evokes the sort of philosophies driving front man Joshua Hodges’ songwriting. retaining the pop instincts that have driven the band to indie’s upper echelons.

Jake Fussell’s albums are wonderful gateways into American vernacular music and the music that ricocheted to and from it over time. As the son of two folklorists and educators, Fussell’s ear for selecting a tune comes from both lifelong encounters with

the genres, as well as fresh and palpable enthusiasm. He brings a distinctive voice to the songs of the Georgia Island Singers, Nick Lowe, and Lil’ McClintock, to name just a few, but also knows how to let the core power of the country standards shine through.

Fussell’s band includes Nathan Bowles, Libby Rodenbough, Casey Toll, and Nathan Golub.

TEEN’s new album, Good Fruit, sounds like it’s made for dancing, but the bright, layered synthpop covers a wide range of ground, from

lust to loss. The three sisters who make up TEEN have been making music together for years, but their sound is still evolving, and they’ve largely left behind the lo-fi harmonies that characterized their earlier albums. Their new sound is the most compelling yet.

Look Homeward reemerges in fine form on their sophomore LP, Gold Plated Dime, after largely lying dormant the past couple years: Rousing opener “Way Back Home” is a soaring sing-along that feels like an instant classic, while blithe, bluegrass-adjacent number “Kacey Musgraves” is hard to shake. Overall, though, the ruling force in the rootsy, trombone-studded record is tender ballads. Kate Rhudy opens, dazzling with lovely folk confessionals graced with a sharp sense of melody.

This well-curated American techno gig is helmed by Umfang, cofounder of tastemaking NYC techno collective Discwoman.

Though she banged out her idiosyncratic, razor-wire minimal techno in a key slot at Moogfest last year, this party presents a budget-friendly opportunity to observe her hyper-physical productions in close quarters. She spins alongside acid-caked electronic great Liquid Asset, plus selections from local head Alik Lynn Lyle aka Lady Fingers.

SECOND FRIDAY AT ATTIC 506 Heaven knows downtown Chapel Hill needs more places to see art exhibits, and though it’s only open to the public on Second Fridays, Attic 506—as the artist studios above Local 506 have been newly branded—is a welcome addition to the landscape of undergrad-bait chain restaurants pervading West Franklin Street. This month’s exhibit features Durham’s Brenda Goldstein, whose coolly geometric acrylic-pencil-and-crayon compositions stand in sharp contrast to the kitsch-besotted paintings (one features TV’s The Golden Girls) of Lump director April Childers. Other studio residents with work on view include Chapel Hill’s Jerstin Crosby and Carrboro’s Vanessa Murray and Lindsay Metivier; you can also peruse artist publications from Orvokki Crosby’s The Concern Newstand and underground comics from The Weakly Group. —Brian Howe

Choreographer Jerome Robbins and composer Leonard Bernstein were both twenty-five when they created Fancy Free, their chimerical 1944 ballet, which merged the precision and lush, symphonic sensibilities of classical European dance and musical forms with the passions of the era’s social An Evening of Bernstein and Robbins PHOTO COURTESY OF CAROLINA BALLET dances and Latin and American jazz. The storyline’s colorful center alludes to the darkness at its edges, as three sailors determine to make the most of a single day of shore leave in New York City before heading off to an uncertain fate at the height of World War II. JEFFERY BEAM “I turn the corner of my dream and there you are,” Hillsborough-based poet and songsmith Jeffery Beam writes in Spectral Pegasus/Dark Movements, a new book pairing Welsh artist Clive Hicks-Jenkins’s paintings with Beam’s responses in verse. Though the line occurs in the context of a collaborative work about the Mari Lwyd, a wassailing tradition in Wales, it also captures the feeling of Beam’s poetry in general, with its songful beauty and sense of dreamlike encounters, in nature and other mirrors, with oneself. Stark with rich blues and reds, at once erotic and reverent, Hicks-Jenkins’s equine paintings alternate with Beam’s poems in a sensuous rhythm of image and sound (especially when you play the accompanying CD). A long series of launch events begins on March 8 at the Orange County Public Library, where Beam will be joined by folk singer Mary Rocap. —Brian Howe

½ Glass—In the conclusion of Shyamalan’s sort-of superhero trilogy, the big reveal is that there was never much to reveal at all. Rated PG-13. ½ The Lego Movie 2: The Second Part—Though there’s a live-action subplot, the little plastic people and their incessant pop-culture references remain the heart and soul of the franchise. Rated PG.  Mary Poppins Returns— While charming, the new version of the beloved Disney film apes the original so much that it’s hard to see the point.

Rated PG. ½ Never Look Away—Loosely based on the biography of German painter Gerhard Richter, who condemned it, Florian Henckel von Donnersmarck’s film discards truth for sensationalism. Rated R ½ Spider-Man: Into the Spider-Verse—Not only is it a good Spider-Man story, this animated film introduces welcome diversity to the tale of Peter Parker. Rated PG.

NEVERMORE FILM FESTIVAL The real world is more than scary enough, but those who prefer their fears externalized can head to the Carolina’s Nevermore Film Festival, which highlights horror as well as sci-fi, dark fantasy, and suspense in a juried selection of global genre films from around the world. There will be esteemed ringers such as David Cronenberg ’s forty-year-old The Brood, featuring Oliver Reed and Samantha Eggar in a classic tale of Soundwave screens in Nevermore Saturday and Sunday. children who decidedly do not resemble their parents, rounded out with new features such as the “Friday the 13th meets Bridesmaids” satire Camp Wedding, where a wedding held at an ex-gay-conversion campsite turns very bad, with a “spirit-possessed Teddy Ruxpin” saying where to hide the bodies. Framed, a Spanish thriller from Marc Martínez Jordán, is about what happens when torture porn goes viral. Maggots is an homage to eighties horror about giant … well, guess. Long Lost is about what happens when you discover you have a half-sibling who might know you better than you know yourself. And there’s the usual gathering of international short films. Remember, no matter how rough the real world gets, you always have people on film dying horribly to take your mind off of it. —Zack Smith

The numbers can appear in any order and diagonals are not considered.

Your initial game board will consist of several numbers that are already placed. Those numbers cannot be changed. Your goal is to fill in the empty squares following the simple rule above.
