Trump’s ‘Gold Card’ citizenship plan – A legal, political, and ethical dilemma

President Donald Trump’s newly proposed $5 million “Gold Card” citizenship initiative has reignited debates on U.S. immigration policy. His administration claims the plan, which would grant fast-track citizenship to 200,000 wealthy investors, could generate $1 trillion in revenue to help reduce the national debt. However, this proposal faces major legal and ethical concerns—particularly regarding the president’s authority to unilaterally introduce new immigration pathways, the likelihood of Congressional approval, and whether it prioritizes foreign elites over meritbased immigration.

Congress holds the power over immigration While the executive branch enforces immigration laws, it does not have the constitutional authority to create new citizenship pathways without legislative approval. Article I, Section 8 of the U.S. Constitution vests this power in Congress. The Supreme Court has consistently upheld this principle, making it highly unlikely that Trump could establish such a program without Congressional backing.

Trump’s plan seeks to replace the existing EB-5 visa program, which was created by Congress in 1990 and reformed in 2022 to ensure stability for foreign investors. This program currently allows individuals to

obtain a green card by investing between $800,000 and $1.05 million in U.S. businesses that create jobs. Any attempt to dismantle or replace it would require formal legislation, which cannot be enacted by executive order alone.

Who gains from the Gold Card?

If implemented, the Gold Card scheme would primarily benefit ultra-wealthy foreign investors, particularly from countries with strong economic ties to the U.S., such as China, India, and the Middle East. While proponents argue it could inject significant funds into the economy, critics warn that it essentially turns American residency into a commodity for sale, favoring the rich while disregarding skilled immigrants who contribute through education and innovation.

Political and legislative hurdles

Even with a Republican-controlled Congress, this plan is far from guaranteed. Immigration policy remains a contentious issue within the GOP, and many conservative lawmakers have historically supported the EB-5 program for its job creation potential. Replacing it with a new, untested program could face

resistance, particularly if concerns arise about transparency, national security risks, or potential favoritism toward certain investors. Additionally, any legislative attempt to overhaul the system would require bipartisan negotiations, which remain unlikely in today’s polarized political landscape.

Reality check: Will this plan survive? Trump’s Gold Card proposal appears more like a bold political statement than a practical policy. Without Congressional approval, it remains legally unviable, and even if Congress were to consider it, the legal challenges would likely delay or block its implementation.

The fundamental question persists: Should American citizenship be up for sale? While attracting foreign capital has economic benefits, tying it directly to citizenship raises profound ethical concerns. Trump’s proposal may grab headlines and energize his base, but its path to becoming law is uncertain at best.

The story of the first meeting between Ram and Sita is described in the Bal Kand of Ramcharitmanas.

When King Janak decided on Sita’s Swayamvar, he sent invitations to all the great kings of the land, including even Ravan, the King of Lanka. Along with the kings, King Janak also sent invitations to prominent sages. One such invitation reached the hermitage of Sage Vishwamitra, where Ram and Lakshman were residing at that time.

Upon receiving the invitation, Sage Vishwamitra took both princes to Mithila. There were still a few days left before the Swayamvar. So, with their guru’s permission, Ram and Lakshman decided to explore the city.

As soon as they stepped onto the royal road, the people of Mithila were enchanted by their presence. Ram then led his younger brother towards the Yagya hall and began explaining its architecture:

Everyone admires the beauty according to their own understanding, and both brothers move ahead with love.

The next morning, before their guru awoke, both brothers went to the royal garden to collect flowers for his worship. They asked the gardeners and happily began gathering flowers:

Looking around in all directions, they asked the gardeners and joyfully started collecting flower garlands.

While they were busy picking flowers, Sita arrived in the same garden with her friends. The garden housed a temple dedicated to Goddess Parvati, and Sita’s mother, Sunayana, had instructed her to pray there before her wedding, seeking the blessing of an

Sita’s friends accompanied her, assisting her in the worship. One of her friends, however, wandered off in another direction to explore the garden. There, she caught sight of the two handsome princes:

She was so mesmerized by the beauty of Ram and Lakshman that she ran back to Sita to describe them:

Seeing the two brothers, overwhelmed with love, she rushed back to Sita.

She excitedly told Sita: Two young princes have come to the garden, they are youthful and supremely charming.

How can I describe their beauty? Words fail where eyes can only see, and eyes have no voice to express.

She described that two divine princes had arrived in the garden. They were in the prime of their youth, their divine jata (matted locks) adding to their splendor.

Their beauty was indescribable, as words could not capture what the eyes beheld.

Tulsidas beautifully expresses this paradox: the eyes that witness beauty cannot speak, and the words that describe it lack the vision to see it. As Sita listened, her curiosity grew immensely.

Hearing this, all her wise friends rejoiced, understanding Sita’s deep eagerness.

As they continued talking, Sita and her friends started moving towards Ram and Lakshman. Sita was adorned with bangles on her hands, anklets on her feet, and a waist belt. As she walked, these ornaments created a mesmerizing melody. When Ram heard this sweet sound, he turned to Lakshman and said:

Hearing the sound of bangles, anklets, and waist belts, Ram, deep in thought, said to Lakshman: It seems as if Kamdev himself is marching forward to conquer the world.

The next moment, Ram beheld Sita’s divine beauty. Tulsidas describes this enchanting scene:

Seeing Sita’s radiance, Ram felt immense joy, and his heart was filled with admiration, yet words failed him. It seemed as if Lord Brahma had displayed all his artistic mastery by manifesting the supreme beauty of the world before him.

Sita’s beauty was truly captivating. Ram was so mesmerized that his eyes remained fixed on her, and his voice fell silent. For a moment, he was lost in this divine beauty.

It seemed to him as if Lord Brahma had poured all his creative genius into sculpting this goddess-like figure. She was the epitome of divine grace, and her beauty filled Ram’s heart with an indescribable bliss. The poet Tulsidas was overwhelmed:

Sita’s beauty enhanced beauty itself, like a lamp illuminating a serene home.

All comparisons fell short before her; she surpassed every poetic description.

Sita’s presence was like a radiant lamp brightening up a peaceful abode. Her beauty transcended all metaphors and comparisons.

When Ram finally recovered from this divine trance, he turned to Lakshman and said, “Brother, this is King Janak’s daughter, Sita, for whom the Swayamvar is being arranged.” Then he introspected, realizing the profound affection he felt for her. His heart blossomed like a flower, filled with love for this supreme beauty. But he was puzzled—he had never felt this way before.

The nature of the Raghu dynasty is inherently righteous; their minds never wander onto unrighteous paths.

Yet today, my mind is deeply drawn toward her, though I have never even dreamt of another woman before.

The minds of the Raghu dynasty were naturally pure, never straying into thoughts of worldly desires. But today, something was different. Ram had never even dreamed of another woman, yet now he found himself lost in Sita’s beauty. What was happening? He could not comprehend. With these thoughts, Ram and Lakshman moved to another part of the garden.

On the other hand, when Sita realized the princes were no longer in sight, she grew anxious and started looking for them.

Sita looked around in all directions, astonished and worried about where the young princes had gone.

Finally, one of her friends spotted Ram and Lakshman behind a cluster of trees and pointed them out to Sita.

Through the gaps in the vines, the beautiful dark and fair-skinned princes were visible.

Seeing them again, Sita’s eyes were filled with longing. She felt as if she had found a priceless treasure.

Her eager eyes could not have enough of Ram’s form; she even forgot to blink.

Her heart overflowed with love, and her body felt heavy, as if a chakori bird was gazing at the moon in deep devotion.

Then, as if emerging from a canopy of trees, Ram and Lakshman stepped into the open:

From behind the vines, the two brothers appeared, as if two pure moons had emerged from behind the clouds.

Tulsidas marvels at this divine scene, depicting the beginning of the eternal bond between Ram and Sita.

Indian stocks are in a correction (-12.4% drop from late-09/2024 high); the US investors in India funds have suffered more (-15.4%) due to rupee devaluation. Stock ownership represents partial ownership of businesses & that should keep up with inflation & currency depreciations. So, the Indian stock market rally to late-09/2024 has been eye-catching in nominal terms, but not in real terms. Not surprisingly, gold in rupees has done well too.

IT/TECH

US AST SpaceMobile/ASTS provides

SATELLITE mobile service in the US via regular smartphones. Its partners for direct-to-smartphones include T, VZ, VOD (UK). Consumers may have to pay additional fees for satellite services. ASTS satellites are bigger, so fewer will be needed, & it plans to use SpaceX, Blue Origin or ISRO (India) for launches. Huge subscriber growth will be needed to achieve profitability. Competing partnerships in the US are SpaceX & TMUS, AAPL & GSAT (emergency use).

After the recent MODI-MUSK meeting in DC, plans are progressing for Starlink (US SpaceX) satellite phone services & Tesla EV (US) showrooms in India. However, OneWeb (UK, France) & Airtel (India) may start offering satellite mobile services in India before Starlink. The cheapest delivered price for Tesla in India may be $40,000+ (35+ lakhs) & it may not hurt the local EVs. The Indian EV manufacturers include Tata Motors, Mahindra & Mahindra, etc, & they are planning special promotions.

ECONOMY

India will be affected by the US general TARIFFS & reciprocal tariffs. After the recent MODI-TRUMP meeting in DC, there would be push to increase bilateral trade & increase Indian purchases of US oil/gas & defense equipment. But India may also be interested in technology transfers along with the defense equipment purchases & that would require deeper negotiations beyond press releases.

A potentially big trade deal may be for the US LNG exports to India. The US has excess natural-gas, so it’s very

cheap in the US compared to its global or European spot prices. The US is building new LNG terminals for LNG exports. The delivered price of the US LNG to India may be quite reasonable under long-term contracts. India may also need more LNG terminals.

RETIREMENT

Elon MUSK’s DOGE is going after Medicare. The plan may be to privatize Medicare, i.e. Medicare Advantage (MA) default for all new participants; the existing traditional Medicare participants (Parts B, D & private Medigap) may be grandfathered. It’s hard to go back from MA to traditional Medicare in many states as medical underwriting for Medigap may be required. Advance planning is necessary as the premiums (including IRMAA) depend on income 2 years prior; limited Roth conversions may help (tradeoff is current tax liability vs no RMDs or no taxes on withdrawals in future). Keep in mind that even at the highest IRMAA levels, there is some subsidy.

New Study Reveals Genetic Basis of Gout

Gout has long been associated with dietary habits and lifestyle choices, but a groundbreaking study suggests genetics play a more significant role in developing this painful arthritic condition than previously believed.

A recent study conducted by an international team of scientists analyzed genetic data from 2.6 million individuals

across 13 different DNA cohorts, including 120,295 people diagnosed with gout. Researchers identified 377 specific DNA regions linked to gout, with 149 of these regions previously unrecognized as risk factors for the condition.

While environmental influences and lifestyle choices still contribute to gout, the findings highlight genetics as a major determinant. According to epidemiologist Tony Merriman from the University of Otago, “Gout is a chronic disease with a genetic basis and is not the fault of the sufferer – the myth that gout is caused by lifestyle or diet needs to be busted.”

Gout develops when high levels of uric acid in the bloodstream lead to the

formation of sharp, needle-like crystals in the joints. The immune system’s response to these crystals causes severe pain and inflammation. The study indicates that genetic factors influence the immune response and the body’s ability to transport and process uric acid efficiently.

The widespread misconception that gout is solely a result of lifestyle choices has led many sufferers to avoid seeking medical treatment. As cases of gout continue to rise globally, researchers emphasize the importance of addressing these myths to ensure more people receive proper treatment. “This widespread myth causes shame in people with gout, making some people more likely to suffer in silence and not seek preventive treatments that could lower urate levels and alleviate their pain,” Merriman explained.

Beyond improving our understanding of gout’s genetic basis, the study opens new possibilities for treatment. Scientists are exploring existing medications that could be repurposed to better manage the immune response to uric acid buildup. Although the study’s data primarily consists of individuals of European ancestry and some self-reported cases, it marks a significant step in redefining how we approach gout treatment and prevention.

“We hope that, in time, better and more accessible treatments will become available with the new targets we identified,” Merriman added. “Gout deserves more health resources and greater prioritization in the healthcare system.”

The research has been published in Nature Genetics.
