Many banks will grant 100% loans but it is a good idea to pay a deposit.

WHAT DO ALL THE LAWYERS DO? Property experts answer your questions about the ins and outs of buying property, why so many legal professionals are needed and why you should try to pay a deposit on a home Q: WHAT EXACTLY do transferring and conveyancing attorneys do? And what process should I, as a seller, expect once a sales agreement has been reached?

A: Many are unaware the change of ownership of the property does not happen when the offer to purchase is signed or even when the purchase price is paid to the seller.

A property being sold will go through the conveyancing process and a new title deed will be issued in the name of the new owner, removing the property from the seller’s name.

Three different attorneys handle various parts of the deal, namely, the registering attorney, the cancellation attorney and the transferring attorney. The transferring attorney is appointed by the sellers and represents them, keeping the seller updated with progress.

Once the offer to purchase is signed, and all the relevant documents are ready, the transferring attorney will lodge them with the Deeds Office. This attorney will be in contact with the sellers’ bank and tell the sellers once their bond has been settled and cancelled. It is then the conveyancing attorney’s job to do everything in their power to expedite the registration of the property, bearing in mind they are heavily dependent on several external parties, such

as banks, and municipalities.

Once everything has been concluded, and the home has been successfully registered, the attorney will account to the seller for any fees that relate to the transaction. Sellers can expect to receive this account within two days of the property’s date of registration. – Adrian Goslett, chief executive of Re/Max of Southern Africa Q: We are looking to buy our first home and are being told by so many people that we should buy in an estate. What are the benefits of this and are estate homes worth the higher price tags?

A: There are many benefits of estate homes.

One of the major perks of estate living is that the body corporate usually handles maintenance with regards to roads, gardens and overall landscaping. Maintenance inside your property boundaries can also be taken care of with minimal fuss.

The body corporate usually has a list of preferred suppliers who not only meet the level of workmanship required, but who are also able to work within the style guidelines of the estate.

Security estates are also going above and beyond to ensure that they provide as many amenities as possible to residents.

Estates boast everything from tennis courts

to laundromats, pools and even walking trails. All of this is maintained by the body corporate, so you never have to worry about the pool being green or the park turning into a health hazard for the children.

Security estates come standard with features such as 24-hour security, including electric fencing, cameras that provide thermal imaging at night, guarded entrance booms, as well as guards that patrol the estate.

Many, if not all, gated communities, have the benefit of access control, security patrols and properly maintained walls and fences. – Mike Greeff, chief executive of Greeff Christie’s International Real Estate Q: Have the values of coastal properties been impacted at all by Covid-19 and the lockdown?

Are these homes still at an advantage, when it comes to their values and appeal, compared to inland properties?

A: As the tourism hub of South Africa, the Western Cape has been hard hit by the Covid-19 lockdown. With no international travel permitted, properties in sought-after areas such as Camps Bay and the Atlantic seaboard are now listed at a steal.

Unsurprisingly, coastal areas such as Cape Town, Port Elizabeth and KZN are outperforming Gauteng in terms of sales,

with majority of home loan applications received for properties between of R750 000 to R2 million, according to home loan aggregator, Ooba.

There is also a load of Airbnb units now up for sale. In comparison to our business hub, Gauteng, properties in the Cape Town CBD and Atlantic seaboard average R20 000 more per m² and would usually welcome foreigners and corporate travellers throughout the year. – Grant Smee, managing director of Only Realty Q: Is a deposit absolutely necessary when buying a home? And, if I can buy without a deposit, is this a good idea?

A: It is still possible for a bank to grant clients a 100% home loan, which does not require a deposit, but we strongly encourage first-time home buyers to consider putting down a deposit of at least 10% of the value of the property to ensure that their home loan repayments are reduced and more manageable.

A deposit also demonstrates that clients have the financial means to make the purchase and are comfortable in taking on some level of risk until the deal closes.

It’s an excellent way to further prove that you are ready to take on the costs and responsibilities that come with home ownership.

Paying a deposit will improve your chances of having your home loan application approved and will place you in a better position to negotiate more favourable terms. The benefit is that you will be seen as providing equity into the deal, thus reducing the bond amount required.

Putting down a deposit will also place the client in a better position to negotiate a more favourable interest rate which will further reduce the interest rate and monthly instalments, allowing you to repay before the term completes.

In addition, saving for a deposit is a great practice run for the commitment that will be required to ensure that you have the required funds and mindset to fulfil the obligations of monthly repayments in the long term. – Mfundo Mabaso, FNB Home Finance growth head

Stokvels increasingly used to buy property Many investment club members pool money to build or extend their own homes but others buy to generate rental income

are working on reduced salaries, some may have lost their homes ... pandemics are not by nature fun moments in history.

And yet many are still out there making a plan.

In my quest to investigate how locals are surviving the pandemic I have come across some really innovative things they are doing to stay afloat – and some involve using their land and property to make ends meet.

One such woman from Khayelitsha, Cape Town, lost her job as a cleaner when the business she worked for folded because of the pandemic. With the payout she received, she is building two flats on her property.

She already has tenants who will be moving in when the flats are complete, and the income she will receive will, in fact, be more than she earned monthly as a cleaner, she says.

“I had to think how I was going to take care of myself. I had seen others before this problem make money from ‘backyarding’.”

She has gone from being a cleaner at a business to being a landlord and businesswoman.

These are the types of stories that keep our office buoyant during the week and that are shoots of green during some tough times. Many people are renting out spare rooms or even their homes while moving into the granny flats on the property.

I think this clearly shows how property is an asset that can be utilised when the usual ways of making money run dry.

It also shows the resilience and tenacity of South Africans and humans in general.

Stokvels give their members opportunities to own property and thereby leave legacies for their children.

ROPERTY stokvels continue to gain momentum in South Africa with members now using this option to branch out as property investors.

Most stokvel members investing in property still use the funds to buy, build or extend their own homes but increasingly they are using surplus money to buy affordable property to invest for rental income.

In some parts of the country, groups that have helped each other extend and build their homes are now setting up new properties used for migrant workers and students, says Neo Mohlatlole, co-founder of the country’s first Stokvel exhibition, StokvelEx. Going forward, he says there will definitely be an increase in stokvel group purchases in the entry-level property market and in townships.

“Most stokvels struggle to get good rates when they apply for bond applications and, through their collective contributions, they are able to get the properties. Some are national groups that have recruited members from all the provinces and are using the bought properties as holiday homes, yielding a higher return than monthly rents.”

Many stokvels have purchased properties in central business districts and townships.

Also popular are agricultural smallholdings and small-scale student accommodation.

“The areas they buy into have high rental demands and the properties are fairly priced which allows them to purchase more.”

Most corporate stokvels have been able to grow their investment property portfolios due to the successes of their initial projects and the concept is proving so beneficial that the notion is slowly starting to attract interest outside black African culture.

Mohlatlole says similar models are being seen in the Muslim community where members pool money and invest in business properties and factories.

However, as most people in other demographic groups have historically had access to credit and earned slightly higher salaries, the stokvel trend “will not be as big” as among African groups.

Andrew Lukhele, chairman of the National Stokvel Association of South Africa is aware of one “white” stokvel but says the more “privileged” race groups generally do not need the survival strategies that are popular in the townships and rural areas.

“South Africa is still plagued by massive inequality and one of the best ways to level the economic playing field is to encourage access to land ownership...

“And this is where collective property buying – the only alternative for many black South Africans – comes in.”

He says in recent times, stokvel members have been encouraged either to develop their own group property portfolios and rent the properties out or invest in already established property businesses that let property to locals.

Another scheme sees stokvel members owning shares in property investment companies which earn rental income each month, accruing in value each year as the properties appreciate.

Mohlatlole says property stokvels get to see the success of other stokvels and are inspired to leave legacies for their children.

These groups have evolved from being just about groceries and school fees to building each other comfortable houses and now investing in properties that they normally would not qualify for.

For these reasons property stokvels are becoming increasingly popular as more people realise the benefits of pooling capital to purchase assets, says Vuyiswa Mutshekwane, chief executive of the South African Institute of Black Property Practitioners.

While there is no data to portray this growth she says there is “significantly more interest than even five years ago”.

“It is certainly an exciting avenue for those who have previously not been able to access property ownership, to become homeowners and also for those who do not have access to equity to participate in commercial ownership and development.

“Internationally, property crowd funding is an area that has also started to gain traction.”

Mutshekwane says Stokvels that invest in property – otherwise known as investment clubs – usually decide to do so with properties that fit their risk and return profiles – or even look at making social investments like collectively contributing to the building of a school.

“Stokvelling has always been more prevalent in the African community and in other communities where access to traditional forms of credit and social insurance were limited. The principle of pooling capital to invest or earn annuity income however is not new or unique to us and is done in some shape or form and with varying levels of sophistication in all financial markets.

“The untapped opportunity in South Africa is in converting the vast stores of pooled capital in stokvels into productive capital that can be used for social investment, to generate returns and drive development,” Mutshekwane says.
