Mall retailers are hoping that Black Friday and the festive season will help them out of the financial hole left by the lockdown.

Retail is counting on holiday spending

RETAIL property owners are hoping Black Friday and the festive season will inject some much needed consumer spend into the industry as the impact of the Covid-19 pandemic continues to plague tenants and affect shopping malls.

Many tenants are in arrears with their rents and are asking for further payment relief from landlords while lease renewals are also strained, says Theresa Terblanche, divisional director at Broll Retail Leasing.

However, the easing of lockdown regulations has seen a pick-up in the number of shoppers returning to malls and retailers are adapting their business models to suit the current environment.

This includes offering lay-byes, credit and discounts, and creating innovative and interactive stores to attract customers and improve their experience.

“However, there are still huge challenges facing tenants to overcome the ripple effect of the lockdown and try to bring in enough sales to improve cash flow,” she says.

“Landlords are still faced with the challenge of tenants requesting further rental relief, even though turnovers are marginally impacted, and arrears remain a problem as tenants are faced with cash-flow issues following the hard lockdown.”

While some landlords have offered payment plans to assist tenants, lease renewals are “taking strain” with shorter lease terms introduced and rental increases reduced. Foot traffic and turnover continue to improve for

supermarkets and pharmacies, but there has been a decline in foot traffic across other trading categories, due to consumers visiting stores less frequently, the convenience of online shopping and financial strain.

“Independent line shops have taken the biggest knock which has affected rent collection in this regard as landlords are not giving further rental relief. Landlords are carrying high arrears and have appropriated deposits to offset arrears and create some cash flow in some convenience centres.”

Despite the situation, Terblanche says there has been “minimum closure of shops at the malls” in Broll’s portfolio, apart from Edcon. There are, however, some independent and familyowned stores in malls that have closed down. Cosmetic/fragrance/ beauty, jewellery and speciality shops have also taken a knock.

“While some stores have closed their doors this has provided an opportunity for tenants (especially anchors) that do trade well to expand their premises and national chains have used the opportunity to roll out stores.”

In general though, Terblanche believes we are seeing only the early effects of the lockdown.

Looking six months ahead she says: “As tenants are no longer receiving relief and financial assistance, they now have to carry their full overheads with challenged turnovers. I believe we will continue to see an increase in arrears until such time as the economy regulates itself. We will also see an increase in vacancies as more shops go online or just have

to close their businesses.

“Landlords are going to be under pressure to review their rents downwards, perhaps more than currently.”

FNB’s large retail customers are “indeed struggling” in light of consumer behaviours and changing buyer patterns, says Preggie Pillay, commercial property finance chief executive. However, most of its retail business is concentrated in neighbourhood and community shopping centres and these have been “quite resilient” through this crisis.

Across commercial property sectors, he says, most customers took out Covid-19 relief to create some extra liquidity and there has been a “relatively small surge in arrears”.

“Customers who were experiencing difficulties were offered additional relief.

“The bank further considered balance sheet financing options to help customers create some liquidity and continue their business operations.”

Pillay also notes that “relatively few” commercial property customers approached FNB for assistance.

“The bank had geared for huge volumes of customers seeking a second round of relief, however, this has not been the case. Larger customers have been pre-paying their facilities with surplus cash that they had. Also, lower interest rates have also helped provide some much-needed relief.”

He says the next six months will provide a better view of the situation although the tourism, hospitality and entertainment

sector is likely to take longer to recover.

“This sector may only start turning in the next 18 to 24 months,” Pillay says.

The bank is also receiving “a lot” of commercial property loan applications but this is about half of pre-Covid volumes.

Louis van Rooyen, commercial property broker for Rawson Helderberg, says there has been an upswing in the industrial property market but more office spaces are being listed for sale.

These are slowly being “picked up” by buyers.

“Companies that invested heavily in tech and thought they would work remotely on a permanent basis are now finding it not to be that easy to run in the long term. They now prefer to have their staff back at the offices due to the upkeep of corporate culture, training and mentoring staff members, and daily management of core staff.”

He says companies might now look to move from larger office spaces into smaller, more suitable, spaces to host core staff, as during lockdown some companies may have retrenched staff so the number of employees has dropped.

“There is an uptick in people inquiring about property rents and sales. Listings are stabilising.

“With regards to financial strain it is highly unlikely that those who haven’t caved in due to the financial impact of Covid will do so now. They have found ways to manage their monthly payments and will do so until they are stable again.”

Last week, I went with a friend to view a bachelor’s apartment on the Atlantic Seaboard in Cape Town. The flat was going for at least R200 000 less than bachelor flats were selling in the area preCovid.

It was a complete fixer-upper, but was in a well-established and well-run building. However, it did not have a parking bay.

What I found interesting was the agent’s confidence the flat would sell quickly. “These small flats under R1.7m are flying off the shelf,” he said.

Who are the buyers, I asked?

“Anyone who wants to use the bank’s money and make use of the low interest rates.... not so many cash buyers anymore... many first-time home buyers, and even some older single people

close to retirement.”

And the sellers? “Some are people looking for liquidity, who may have had a second apartment and want to sell it.”

It is good to see the movement of property as it bodes well for the economy.

It is also good to see the big agencies who have survived one of the worst times in their history return to print advertising in our national property supplements, bolstering hope that even though things may seem bleak, life goes on.

After we viewed the flat last week, my friend and I went to a local coffee shop and I picked up our weekend newspaper. The joy of having the property section fall out and she and I fighting over who could read it first brought back some semblance of a time before Covid-19.

It made me think that after every winter, a summer must come.

Hang in there, summer is still coming.

IX MONTHS on from the start of the hard lockdown, South Africans are clawing their way through a new reality that does not include payment holidays and Covid-related exemptions.

So far, they seem to be doing better than expected but the circumstances are still too fresh to know how severe their stress is and how long it will last.

Many homeowners are behind on their bond repayments, some are selling their properties for various reasons, and more are turning to renting, yet the overall situation does not appear as dire as it sounds.

As at the end of last month a “small percentage” of Absa home-loan clients whose payment relief had expired were late or in arrears with their payments, says home loans managing executive Geoff Lee. The figure is, however, expected to “significantly reduce” as the bank takes further measures to reach out to them and further help through its distressed customer assistance programme Siyasizana – which translates to “we are helping each other”.

Tiffany Singh, head of collections at FNB home finance, says generally its customers who were offered debt relief are “performing well”.

“We’ve been tracking their debit orders and payment behaviour. There are still customers who require assistance, who have been helped with extended relief or payment breaks but, due to the lockdown reducing to level 1, we have noticed that more customers are returning to work and are able to make repayment arrangements.”

Lee notes though that the percentage of Absa customers making payment arrangements is in line with the numbers prior to the lockdown period.

And customers who have come under financial distress due to Covid-19 are not yet losing their homes through repossession.

He adds: “A significant portion of customers who are not coping with their bond repayments indicated that they are experiencing once-off or short-term stress.

On that basis, we believe it is premature to assess the full impact of the stress the customers are feeling.

“The rest of 2020 will provide more data points on the impact and the duration of the stress, especially as the assistance packages that customers are receiving from the government and businesses expire.”

Some FNB customers who are employed in industries negatively impacted by Covid-19 have fallen into arrears and need assistance to repay their loans. This, Singh says, may take longer than typical repayment arrangements before Covid-19. “In those instances, we are assisting with special arrangements such as longer-term arrangements to assist customers to rehabilitate.”

Since March, the bank has seen an increase in the number of special arrangements being made compared to prior to lockdown.

However, since the re-opening of the real estate industry in June, FNB has seen a “significant increase” in interest from property buyers, with the number of loan applications increasing by approximately 40% compared to pre-lockdown levels. Absa is also experiencing an increase in the number of home loan applications month on month from June 2020 – to levels higher than pre-lockdown, although Lee says is too early to say whether this sustainable.

Alexa Horne, managing director of Dogon Group Properties, says the market has been “very buoyant” and sellers are not necessarily listing their homes for financial distress reasons.

“Plenty of the movement is attributed to downscaling where sellers are going into a different cycle of their lives... Many second homes are being sold as the owners aren’t

using them enough to justify the expense.”

She does acknowledge that sellers are feeling the pinch due to Covid-induced reduced earnings but says the low interest rates are helping ease some financial pressure.

“However, those who bought properties with a view to generating income via short-term rentals are really feeling pressure and I imagine more and more of this stock will be coming onto the market should short-term rentals not resume their previous activity levels.”

Data from HouseMe, an online property letting agency, shows that “fewer than 25%” of leases had some form of payment amendment through hard lockdown. While some negotiations included rental reductions (which diminished the remaining contractual rental obligation due), Ben Shaw, founder and chief executive, says rental relief – where landlords offered a payment holiday but maintained rights to pursue full rent over the following months – was more common. This acted as liquidity for the tenant market.

“By making use of rental relief and/or reductions, tenants have mostly met their obligations over the past six months. We are now, however, seeing spikes in default rates and a slew of early termination requests...

“Tenants who have lost their jobs have in some cases also moved out of rental accommodation (downsized, moved into digs, back home or in with friends).”

The macro-economic situation, including job losses, will “haunt” consumer tenant profiles for the next 12 months at least, he believes. On the other hand, tenants who retained their jobs and whose income is unaffected are in “stronger positions than before” as the market has corrected itself to price in the now low-affordability threshold of the average tenant. Shaw also feels many homeowners may be forced to become tenants in the short term.

WHY A DEPOSIT IS IMPORTANT Experts respond to questions such as why landlords should protect themselves from potentially defaulting tenants and tenants who might damage their property Q: I AM a new landlord and was thinking of not asking for a rental deposit to help tenants.

What is its main purpose?

A: A rental deposit exists largely to protect the landlord against defaulting tenants and the lengthy, expensive process that is involved to evict them. If the correct eviction procedures are followed, it can take eight to 10 weeks for an eviction order to be granted, during which time the landlord is out of pocket. Besides the fact that the landlord is not getting a rental income from the defaulting tenant during that period, they will also have to pay legal costs.

An unopposed eviction could cost between R12 000 and R20 000 in legal costs plus disbursements, while the cost of an opposed matter will be substantially more.

pays the deposit, the landlord is required by the Rental Housing Act to place the money in an interest-bearing account held with a financial institution. The tenant is within their rights to request a statement of the interest earned on the money at any time during their tenancy.

Even though the deposit is paid to the landlord, it remains the tenant’s money. The landlord is merely holding the money as a security measure, should the tenant default or breach the rental agreement.

If the tenancy runs its normal course, the deposit, along with all interest earned on the money, must be repaid to the tenant at the end of the lease period. Significant delays can be caused when sellers do not have approved plans. When the submission of the plans becomes a condition of the sale of the property, or a pre-registration condition of the buyer’s bank, which is an increasingly frequent situation, irregularities are detected that could ultimately result in the cancellation of a transaction.

There may also be additional compliance issues unique to the particular municipal area or property type that need to be dealt with, such as a gas installation certificate of conformity, electric fence certificate, regulations relating to the safety of swimming pools or a lightning conductor on thatched properties. – Gerhard van der Linde, managing director of Seeff Pretoria East.

maintenance and sale to others while still maintaining their lifestyle. Essentially, it affords the retired individual the right to occupy a unit in a lifestyle estate for the remainder of their life while ownership of the property is retained by the developer.

This “right” is paid for with a capital investment and on relocation or death the unit is ceded back to the development, usually for the initial invested price, and this payment becomes part of the deceased estate.

With a life right comes a list of continuous services as the developer doesn’t bow out upon completion as happens with freehold and sectional title retirement schemes. CYBERCRIMINALS ARE REAL! STAY VIGILANT WHEN MAKING REAL ESTATE TRANSACTIONS Cybercrime has become a major, global problem, and South Africa is far from exempt from this growing scourge.

According to Tony Clarke, MD of the Rawson Property Group, real estate transactions can be particularly attractive to cybercriminals since they tend to involve large sums of money transferred electronically. For this reason, he urges buyers and sellers to exercise extreme caution before actioning any electronic payments.

“Without the right security in place, cybercriminals are able to intercept electronic communications between agents, conveyancers, buyers and sellers,” says Clarke. “They can then use that information to impersonate one of the parties involved in the transaction and redirect payments into their accounts.”

Once this happens, it can be complicated to freeze or reverse the transaction, particularly since the funds will likely have been moved onwards immediately on receipt.

Clarke says fraudulent emails from impersonators can be extremely convincing, with authentic-looking documentation and electronic delivery details giving targets little reason to suspect foul play.

Thankfully, there are ways to avoid falling for this type of cybercrime.

“The best strategy is always to check and double-check all the details before making a payment,” says Clarke. “Don’t rely one hundred percent on any information received via email. Rather look up the phone number for your estate agent or conveyancer independently, call that – and confirm any banking or transaction details with them before proceeding with the transaction in real-time.”

If possible, Clarke says it’s also a good idea to visit your conveyancer and real estate agent’s offices in person to sign any documentation face-to-face.

“This provides an ideal opportunity to familiarise yourself with the business’s

corporate branding – making it easier to spot fake communications in future – and request hard-copies of verified bank account details,” he says.

Using a more established service provider can also be a good safety measure, as Clarke says smaller operators seldom have the budget for toptier digital security solutions and best-practice cyber-security training for employees.

“Strong business processes, secure email servers and protections that extend to communications sent from employees’ mobile devices make it much more difficult for cybercriminals to get that first foot in the door,” says Clarke. “Unfortunately, these measures are often expensive to set up and maintain, putting them out of reach for a lot of smaller players in the property industry.”

Of course, even the best security cannot guarantee 100% prevention of unauthorised access or interception of communications by cybercriminals.

This makes constant vigilance essential for buyers, sellers, agents and conveyancers, no matter how stringent their digital security may be.
