End of an era The end of March saw the end of an era at IMAGE asia (publishers of Window on Phuket, Where to Eat in Phuket… and more). Peter Smith, who joined the company in its infancy, 15 years ago, and was a major factor in its growth, has retired and gone to live in the northeast of Thailand. Many clients knew Peter as the ‘face’ of IMAGE asia and he will be sorely missed by the company and clients alike. “I’m not sure what would have happened had I not been able to convince Peter to join our – at the time – very small team. But I do know that life would have been different over the past decade and a half,” said IMAGE asia’s founder and MD, Grenville Fordham. Joining IMAGE asia as an advertising salesman came as a bit of a surprise to Peter. At his interview, he thought he’d applied for a different kind of job; when he discovered what it was, his reaction was, “I can’t sell advertising.” No doubt the hundreds of people who have bought advertising from Peter over the years would disagree. We certainly do! Peter’s idea of a salesman was the brash, aggressive stereotype. What he came to understand was that it is much more about building relationships and trust – something for which Peter was perfectly suited. Another anomaly is that, although he’s worked for all the past 15 years, and some before, Peter actually came to Phuket to retire on the ocean waves, having been inspired by the predecessor of IMAGE asia’s Southeast Asia Pilot book at the Southampton Boat Show. He realised his dream and became Lee Marine’s first customer, first buying a second had sailing yacht from the newly set up yacht brokerage and later returning to them for an easier-tohandle motor yacht.

As often happens with dreams, reality intruded and the famous ‘black hole’ so well known to the yachting community obliged Peter to give up the boat and return to work. And that brings us full circle to today, when Peter has finally settled into his carefully designed and purpose-built ‘container home’ in a field in Isaan, taking with him the sincere well wishes of his former employers and colleagues.

Visiting the Phuket Elephant Sanctuary Recently opened, the Phuket Elephant Sanctuary is a new experience that allows visitors to walk amongst the giants and gain firsthand knowledge of why it’s so important to let elephants roam in their natural habitat.

An introduction to the Phuket Elephant Sanctuary The Phuket Elephant Sanctuary is a wonderful initiative brought to Phuket in partnership with Elephant Nature Park, an elephant rescue and rehabilitation centre in the northern province of Chiang Mai. The Phuket Elephant Sanctuary is pioneering ethical elephant tourism on the island by offering retired elephants the chance to live out the rest of their days being well looked after and roaming free.

Essentially, the sanctuary is a retirement home for sick, injured, tired or old elephants who’ve spent their lives working long, exhausting hours in the tourism or logging industry. Although not uncommon in Southeast Asia, this type of work is not only difficult but often conducted under abusive and cruel conditions. The combination of these factors makes the life of an elephant quite unbearable, and more times than not, unbelievably sad.

The relationship between an elephant and its mahout (caretaker) is a special one that revolves around mutual respect, love and trust. It’s a wonderful bond to witness

Constructing the Phuket Elephant Sanctuary In the north of Phuket, in the Cherng Talay neighbourhood, the Phuket Elephant Sanctuary is located on an undeveloped land parcel that stretches far and wide. Lush, tropical trees line the open grassy fields that now comprise the natural habitat for the elephants at the sanctuary. The grounds of the sanctuary feature a charming treetop reception area and observation platform as well as constructed night shelters for the elephants. A dam has been built, and there are shallow lagoons for the elephants to swim and play in. As the sanctuary continues to expand, more construction will take place in order to accommodate more elephants.

Prior to coming to the sanctuary, these elephants were often traumatized by harsh working conditions. However, those days are far gone now and the resident elephants are being shown love and kindness and are finally understanding what it means to be truly happy and free. travel.Phuket Elephant Sanctuary Experience the morning tour at the Phuket Elephant Sanctuary Joining the morning tour is a wonderful way to get up close and personal with the elephants. The best way to sign up for the morning tour is to book online at phuketelephantsanctuary.org The meeting point for the morning tour is at Monkey Pod Cafe, a charming little coffee shop located on the road to Ao Por Marina on the east of the island. Once there, representatives load participants into various modes of transport and make their way to the sanctuary. The tour begins in the treetop reception area where the breathtaking views are further enhanced by watching the elephants roam around the grounds. After an introduction from the project managers, a short video is shown that highlights not only the good work that Elephant Nature Park in Chiang Mai is doing, but also explains the darker side of the tourism entertainment industry that many of Thailand’s elephants are a part of. It’s an eye-opening video that tactfully highlights why ethical elephant tourism is so very much needed. After the video the tour really rolls into action, and it’s amazing just how quickly the 90-minute visit goes; it’s an outstanding educational experience. The opportunity to get up close and personal with the elephants, ranging from their feeding to

A true highlight of the tour is watching the elephants splash and play in one of the shallow lagoons not far from the reception area. Elephants do indeed like to swim, and watching as they throw water at one another and do a bit of customised elephant snorkeling truly is delightful. It’s heartwarming to see the elephants comfortable and carefree in their natural habitat. At the tour’s conclusion, a tasty vegetarian lunch is served and it’s during this time that you get the chance to pose further questions to the project managers, or the very engaging tour guides and other staff, regarding the sanctuary itself and the continued wellbeing of the elephants.

Pramookpisitt Achariyachai Above and beyond the norm

I

t has been a long journey since Khun Pramookpisitt first arrived in Phuket 36 years ago. A native of Nakhon Si Thammarat, he came to Phuket after working for a bank in Bangkok. With two university degrees and a keen commercial eye, he quickly sensed the touristic potential of the island’s golden beaches, and – armed with a bank loan – created Ka-Kata Inn, at the southern end of Kata Beach. A bold move, it was an aspirational moment in the success story both of Pramookpisitt, and of Phuket’s tourist industry. His flagship resort has gone from strength to strength.

heading Phuket Town Football Club, an onerous position which became “a headache”. It’s no coincidence that since his departure, the club has been relegated to the fourth division.

Kata Beach Resort and Spa (its subsequent title) has long been associated with the Phuket King’s Cup Regatta. After Pramookpisitt rescued it from possible oblivion in the 1990s, his resort became the focal point for the regatta’s activities. The opening night party was, and still is, held there. Maybe Kata Beach’s Resort’s iconic sculptured elephants are emblems of their owner’s wisdom and enterprise

He was awarded, in 2015, the prestigious ‘Tourism and Sports Industry Quality Person of the Year Award’. Khun Pramookpisitt’s empire has since grown apace. His Kata Group owns and operates six other resorts in southern Thailand. In 2012, it launched the Beyond Resorts. Now established at Khao Lak, Krabi and Karon, the innovative brand caters particularly to the high-end couples’ market. Kandaburi Resort and Spa in Koh Samui was also added to the portfolio.

He also acts as Honorary Consul-General of Finland in Phuket, and, without public fanfare, funds scholarships for deserving students, conscious that a good education can unlock so many career doors. He should know: he possesses two degrees himself: a BA in Business Administration and an MA in Public Administration from the University of Manila.

This public concern has seen Khun Pramookpisitt become a prime mover in the initiative to overhaul transport on the island. As coinvestor in the Phuket City Development Company (PKCD), he is a key player in plans to create a viable public transport system with smart buses and a light rail system. Not straightforward. In “Honda City” – as he describes Phuket – the motorbike is king, so too the tuk-tuk. The transport waters here, as we all know, are muddied; Pramookpisitt is all too aware there are no easy solutions. That he is on board is a huge plus. An enthusiastic advocate of Phuket’s tourist potential, Pramookpisitt argues passionately that its seafront resorts offer unmatched facilities – at a fraction of the cost of comparable venues elsewhere, such as the Caribbean. Moreover, he is acutely aware of the changing demographics of tourism.

As president of the company, he was awarded, in 2015, the prestigious ‘Tourism and Sports Industry Quality Person of the Year Award’. In conversation, he modestly bypasses the topic, but it is given to those who “lead by example and make a major contribution to Thai society”. As he observed: “The company is in many ways an extension of my own family who I would like to thank for their great support and encouragement”.

Pramookpisitt is upbeat about Phuket’s future. He clearly has a devoted team whom he encourages to talk over problems. 1/2 kg prawns | 1 red sweet pepper | 1 yellow sweet pepper | 5-10 garlic cloves to taste | 1 scallion (green or spring onion) Seasoning 1 tbsp oyster sauce | 1 tsp soy sauce | 1 tsp sugar | vegetable oil | tempura flour

Put a comprehensive, mulঞ-page, mulঞmedia, content rich prole of your restaurant or other business in front of potenঞal clients.

Preparation Wash and drain the prawns. Lightly sprinkle-coat them in tempura flour and deep fry until the skins open. Finely chop the sweet peppers, garlic and scallions and pan fry until aromatic. Regular visitors to Thailand know it to be a devoutly Buddhist nation – the glittering temples and colourful festivals are testament to this. But scratch beneath the surface and you’ll find traditions and beliefs that pre-date even Buddhism – customs that still play their part in the everyday lives of people around the country.

One of the most distinctive of these ancient traditions is the festival of Phi Ta Khon, which takes place every year between March and July in the Dan Sai district of Loei. Sometimes called ‘The Ghost Festival’, the event is known for its cavalcade of locals dressed in distinctive and wildly colourful masks and headgear. Revellers head for the local Wat Pho Chai Temple, accompanied by bells, music and laughter. Along the route, the masked and merry pranksters dash into the crowd, teasing blushing maidens and frightening and thrilling the children. It’s all great fun and one of Loei’s biggest draws for visitors seeking a little taste of ‘Thainess’ off the kingdom’s better-known travel paths.

To make the characters appear larger than life, the masks are topped with wickerwork (usually a sticky rice steamer) painted in the same vibrant colours, or finished with an intricate piece of art.

Phi Ta Khon is just one element in a three-day event called Bun Phawet. On the first day, the people of the district seek protection from the spirits of Phra u-Pakut, believed to live in the nearby Mun River. The parades take place on the second day with the final day being given up to Buddhist sermons on Vessantara Jatarka – a popular morality tale about the Buddha’s final incarnations as the charitable King Vessantara. This is why Phi Ta Khon is seen as a Buddhist celebration where locals make merit. But the rites, processions and costumes on display also evoke fertility festivals and hark back to times when people would appease local gods and spirits to ensure a good harvest. In a region such as Loei, where agriculture is the mainstay of the economy, the fertility of the soil and favourable weather is crucial, especially in June and July when the allimportant rice crop is being planted. At first of course, it’s the colourful masks of the Phi Ta Khon revellers that draw the eye. Impressive, vivid and fierce, the masks are made from shaped rice husk which has been elaborately painted and decorated with grinning, shark-toothed mouths and long, elaborately carved and curved noses.

But when you look beyond the mask you’ll see how the Phi Ta Khon celebrations are all about paying homage to the spirits of nature and the countryside. Among the standout groups are staff-carrying farmers, not wearing masks, but smeared from head-to-toe in fresh dripping, fertile mud and clearly enjoying every minute of it as people flee from their sticky embrace. Alongside these representations of life-giving soil are wicker models of the traditional beasts of Thai agriculture – buffalos. These are ‘ridden’ through the procession in front of ploughs which have been hoisted onto wheels to trundle down the roads.

Fake news and fake property promises An ever-changing world The state of our world is clear for many to see, but all of us have different points of view. Generally speaking, through positive eyes, we have developed medicines and medical care so that many live longer, we have amazing transport networks allowing budget travel on airlines to destinations domestic and international that were previously completely inaccessible to most – allowing mobility of labour and leisure, which has directly affected tourist hubs such as Phuket. We have amazing technology allowing, in theory, people in impoverished areas access to educational information to allow them to better themselves. Which App today? And then we have Instagram, Pinterest, Snapchat, Facebook, Google+, Renren (China’s leading Facebook clone), Wechat, Whatsapp, Twitter and YouTube. As a result, we have better information sharing and better access to a an incredibly wide scope of information; but we also, as a consequence, have… Fake News. Here in Phuket, we also have ‘Fake Property Promises’ . Phuket is great overall To ensure we have balance in an article about unreal things, I must strongly emphasise – we also have ‘real property news’, real developers, real projects, real excellent international schools, a real expanding airport, real new road infrastructure, real beaches, real new shopping malls, real local markets, real supermarkets – from Supercheap to super-expensive – and really regular super-horrific road traffic accidents, which significantly contribute to the reported average 66 deaths per day on the roads in Thailand. We have lots of real things here in Phuket. ‘Fake News’ phenomenon We are all susceptible to the issue of fake news. On news panel shows, participants have been found referring to fake news they have seen that day in an attempt to make a point, politicians have re-tweeted fake news, we have probably discussed fake news with our friends, not realizing the news we refer to is fake. This is a natural reaction to the greedy consumerism of all information without the correct use of testing sources, analysing neutrality or bias, fact checking and avoiding oft-used ‘click bait’ techniques that allow marketeers to charge their customers for your browsing activities. Property news and ‘trends’ I am very impressed with some of the new marketing techniques employed by property developers in Phuket, and more widely – in Thailand. These days a property project, even un-built, can be presented through the eyes of drone camera footage showing every angle of the magic sea or mountain views and surrounds, ‘Go Pro’ style walking or quick time footage of walk throughs of

the property, filtered Instagram snaps of people enjoying coffee and croissants and wheatgrass shots before posing for their yoga sessions. A property project can now take on a Millenial style shallow, but attractive, personality of its own. You can find versions of the project in completely different formats on Facebook, WeChat and the website. There will be super wide highly enhanced photo images that draw you into your media device with HD gravitational pull. This is the trend now. Property is being presented as all our consumer style goods and services are now being presented – more perfect than it actually is. Back to basics What is not evident on any of these new platforms is the fundamental information that is of great importance to a property investment, in Phuket or elsewhere. There is no sign in the video footage, or glossy photography, as to whether or not a project is legally compliant, or whether your property investment will be secure. I wonder how Instagram or another application would present the following: 1. Is the land title legal from when it first came into being, until now? 2. Does the property have legal registered access from each plot or property to a public road? 3. Are the companies selling the property properly capitalised and do they have cash in the bank? 4. How much of the project is leveraged by loan finance and is the level of financing sensible or speculative?

The said building has also to be free of any debt, charge or other restriction of private or public laws other than the usual easements. To avoid future legal litigation, the construction must correspond to the correct permit issued. In condominium projects, rules and regulations are even stronger, and some developers use the word ‘condominium’ only for marketing purposes with the result that at the end of negociations the condominium license won’t be issued and the unit will not be registered under your name. In the case of land and building, the owner of both can differ, in this case, one of the assets can be subject to checks made for each particular owner as to his/her criminal and civil background which could impact on the legal process of acquisition. A Thai company can also be the owner of the whole asset. In this case, the buyer can purchase shares and become director of the company. The due diligence procedure will request specific verification in accounting and tax domains. For the above reasons, the first step of your real estate investment should be followed through with due diligence. It makes perfect sense.

n some western countries, during the process to transfer ownership of real estate, the law obliges the interested parties to use the services of a public body or representative to protect the buyer by making ‘due diligence’ compulsory. In Thailand however, parties can directly go to the relevant administration to register the ownership or rights in immovable property transfer. But some choose not to. Consequently, some buyers take the risk to be engage (in a purchase) without performing a competent and comprehensive due diligence process and unfortunately stand to lose a lot of money if they don’t comply.

In Phuket, land use restrictions are encompassed under three laws with the relative ministerial regulations. • The Building Control Act • The City Planning Act • The National Environmental Control and Maintenance Act All of these have been enacted within the last 40 years. Due diligence is implemented basically on the title deed, the building, the owner or holder of the immovable rights and legal relations between them and third parties. The title allows certain private use and grants rights to use, possess, own, or to transfer rights by freehold and leasehold. There are three titles to be considered: the Nor Sor Sii Djor (chanote), the Nor Sor Sam Gor and the Nor Nor Sam. The due diligence report regarding the title deed will show all historical transactions and any encumbrances as servitude or mortgage.

Wat Koh Siray, with its golden reclining Buddha, sits on a hilltop from which there are spectacular views of Rassada Harbour and adjacent islands on the one side and views of rubber plantations on the other. It also overlooks the picturesque Sea Gypsy village of Laem Tuk-Kae. From the road you climb up a staircase flanked by huge dragons. The outside temple hall is surrounded by other Buddha images that you can walk around.

This is a public park located by the sea at the end of Phuket Road. There’s an old dredger-shaped monument called (somewhat unimaginatively) the ‘60 Year Mine Monument’, which was built on the headland at the southern end of Phuket Road in 1969. This monument commemorates one Captain Edward Thomas Miles, an Australian who brought the first metal ore-dredger to Phuket in 1909, hence the ‘60 year’ bit. In former times, Sapan Hin was regarded as the gateway of Phuket because the promontory was the chief trading port for freighters. As time went by, more land was reclaimed and developed into parks and public facilities, which now include a sports centre, large playing fields, restaurants and the island’s main boxing stadium. It’s also the site of two colleges – Phuket Community College and Phuket Vocational College.

Every day many Phuket residents visit Sapan Hin to jog or just to enjoy walking along the mangrove-lined paths. In the evenings people turn out to play tennis, basketball, volleyball, soccer, lawn bowling and takraw. Others come to picnic and enjoy snacks and drinks available from the small market. At the south end of Sapan Hin is the Kiew Tian Shrine, which plays a significant role in the annual Phuket Vegetarian Festival; all the street processions end here. To get to Saphin Hin just hop in a Tuk- Tuk or taxi; they all know it.

Muay Thai (Thai boxing) If you prefer a quiet gym, then Rawai Muay Thai Camp or Tiger Muay Thai & Mixed Martial Arts on Chaofa West Road, in the south of the island, might suit you. Go-karting offers a behind-the-wheel adventure using specially designed vehicles to race around a track. Kids love the thrill of becoming a mini F1 driver for the day, while children not ready to take the wheel may ride along with an adult on a two-seater kart. The most elaborate go-kart track is in Kathu, while another track is next to Phuket Shooting Range in Chalong.

Monkey Hill (Khao To Sae) view point. This hill towers over Phuket City and is easily spotted as it’s topped with wireless masts. The narrow approach road allows views of Phuket’s eastern beaches and at the top, there’s a jogging track. This is a favourite place for locals who come here to exercise or just to chill out. There are no specific facilities, but the Khao To Sae shrine makes a pleasant interlude. Don’t forget to bring a bag of peanuts to feed the monkeys, but watch out! Don’t get too close.
