Cultural event @ Phuket Town The Phuket Vegetarian Festival is a colourful event held over a 9-day period in October, celebrating the Chinese community’s belief that abstinence from meat and various stimulants during the 9th lunar month of the Chinese calendar will help them obtain good health and peace of mind. Over the years the festival has grown and developed into a spectacular annual event attended by thousands, with participants flying in from China and other Asian countries.

There are also two very spacious open air living areas on board the Azimut 77S. The traditional aft cockpit with a sunbathing area of 8sqm, a dining table for as many as eight and a kitchen-bar area with a BBQ, fridge and icemaker. To enjoy all the shade you might require there’s also a very effective electrically powered soft-top. The fore cockpit is an eating and relaxation area that is utterly secluded even when docked and exciting during navigation. Here too there’s an eight-person sofa, a coffee table and all the space needed to relax in the sun, or in the shade thanks to an electrohydraulic bi-mini cover. All of the main deck is laid out on one level, from the cockpit right up to the staircase that leads into the night quarters. One is completely surrounded by

natural light thanks to the two large windows and the vast crystal entrance door, which is just short of 9ft wide and made out of three segments that fold away into the starboard bulwark, so that the living room and cockpit can become a single environment. The brightness is further increased and made utterly unique by the broad prow facing windscreen and especially by the sliding glass roof. The Design and décor created by Carlo Galeazziexploit gloss Zebranowood essences and leather details, all produced by the best Italian craftsmen. ‘Ocean Drive’ design decorative panels are effective: their uniqueness lies in its distinctive “embossed” structure, with three-dimensional effect.

On the lower deck the master suite is in the centre of the vessel and exploits to the full the maximum beam of the 77S. The luminous and breath-taking view over the water is guaranteed by the bulwark windows, characterisedby six squared glass panels in traditional Azimut S style. The furnishings highlight the colour contrasts between the Zebranowood essences, the pale ivory lacquering on the furniture and the sand coloured fabrics. The large exclusive bathroom on the right and the walk-in wardrobe complete the suite. The fore VIP cabin with a traditional lay-out and a private bathroom offers two guest cabins, both with separate beds and ceilings over 6ft 6’’ high.

The positioning of the kitchen, also on the lower deck, but set well apart from the night quarters, is extremely ingenious. Its facilities include a four-plate glass ceramic hob, microwave, grill, dishwasher and a 281 litre capacity fridge, best in class for dimensions and functionalities. All appliances are made by Miele. A fully equipped storage has been installed beneath the floor panels which can house all stores required for a medium to long range cruise Besides the main piloting station in the saloon, the Azimut 77S has a second open air piloting station on the sport fly. Integrated within the external sporting line of the craft there’s a 10sqm deck equipped with a cockpit with double seating and a sunbathing area that can be converted into a front facing sofa.

Ultimately, the new 77S is not just a study in excellence in terms of design and functionality, it is also a technological marvel, made possible thanks to the long standing experience and research that has gone into Azimut Yachts. The efficiency of the new high performance hull coupled with the three Volvo Penta IPS 1200 engines (900 HP each) guarantees top performance matched with excellent fuel consumption ratings. The top speed is 36 knots and at a cruising speed, 32 knots, consumption is reduced to 420 lt/hr. Our shipyard’s technical office, following comparisons between the Azimut 77S figures and those of a vessel with a traditional hull with driveline transmission and 1800 HP engines, reported savings, in terms of fuel consumption at cruising speed, of around 30 percent.

A

t 40 years old, and from a privileged Peranakan background, she would pass for 30 but even more astounding is that her metabolic age – an accurate gauge of physical wellbeing – is a staggeringly low 15 years.

She attributes much of this fitness to one of her less public passions – long-distance running. Phuket, with its triathlons, marathons, fun runs and trail runs, is a hub for these activities. Never one to shirk a challenge, Kiranee decided to embrace this arduous sport. With commendable marathons and ultramarathon runs, she then graduated to even greater distances – completing 66km south-to-north and 100km circuit of the island. She has also tackled sections of the Great Wall of China, New York City Marathon, Vietnam Mountain 70km and Madrid ‘Corre por Madrid 10,000’.

As if that’s not enough, Kiranee is an enthusiast of ‘trail running’, where participants run and hike, usually off road, through natural terrain. Support comes from Kiranee’s husband who, as a ‘sky runner’ confronts a different kind of challenge – in rarified Pyrenean airs and elsewhere. Running gives her, she says, an opportunity for meditation. It also means she can pass on her knowledge to other athletes via a few blogs aimed at the running community in Thailand. That desire to help and communicate is central to Kiranee’s compassionate philosophy. Education is a longstanding and abiding passion. It’s in her blood. She is the third generation of her family to own and head Thalang Wittaya Kindergarten and Primary School, a local private establishment which has now split into two separate entities. Very successfully. The kindergarten section, her cherished ‘baby’, has 300 pupils; the elementary school 500. With her passion to contribute to her hometown, she aims to develop the schools to become part of the community and integrate knowledge of the ‘Sufficiency Economy Philosophy of King Rama IX’ into all curriculum and learning activities. She is always concerned about selecting properly qualified and dedicated staff to develop healthy and happy children in the local community. For all her preoccupation with excellence, the school fees are extremely competitive. The profit motive is not all-consuming; ‘profit’ and ‘competition’ are not dominant words in Kiranee’s vocabulary – she’s much more concerned about co-operating and interacting with other schools in Phuket and to share ideas and experiences. In short to improve the learning experience of children. I was amazed to discover that she also plays a role in the Young Business and Professional Association of Thailand – Phuket Chapter to organise a three-year ‘Take Less Give More Camp’ project for 100 inter-high school students in Phuket. Supercharged heroine by Window Watcher After their small exhibitions at the end of the project, then their pieces of arts were given away asa souvenirs to other public schools in the community to create more social awareness about caring for the environment. Kiranee’s major ongoing projects reflect her extraordinary catholicity of interests and social conscience. A devotee of the late King’s ‘Sufficiency Economy’ and some Royal Projects, she is, for example, a consultant to the Ministry of Agriculture and Cooperatives, involved in promoting Cruelty Prevention and Welfare of Animals A ct B.E.2557 (2014). Her passion for animal welfare is reflected in her involvement with the Soi Dog Organisation as a Vice President. She’s also Chairman of the Private Education Association of Phuket – which means regular meetings with owners of the island’s other private educational institutions in order to improve standards and services. She’s also a head committee member of the Young Business and Professional Women’s Associations of Thailand – Phuket Chapter. As if that’s not enough for our supercharged heroine, Kiranee is a part-time lecturer at both the Prince of Songkla University and Phuket Rajabhat University, where she can pass on her extensive knowledge of promotional and business practice, an expertise honed during her past career of more than 10 years in hi-tech manufacturing and automotive industry background, plus intercultural experience working in global corporates in both USA and Asia. Kiranee now has come back and settled herself in her hometown – Phuket, for already eight years and giving back to the community has become a strong obsession.

But perhaps Kiranee’s best known contribution to Phuket society resides in her vaunted role both as public speaker and MC of many prestigious events nationwide. Everyone knows her as Khun Joiy. Not only is she the founder of Unique Organization Development & Consulting Co., Ltd., which specialises in organisational action research and human capital development to hi-tech industry and manufacturing clients, mostly in Eastern Seaboard towns of Chonburi and Rayong, she is herself a regular performer, an expert at forging links with her adoring audience. She remembers with affection such gatherings as 12,000 runners and audience at The National Stadium in Bangkok for the Thailand 10K Championship 2017, the Bangkok Triathlon 2016 and The International Gastronomy Symposium 2017, with candidates from all over the world. She is as also a news anchor for National Broadcasting Service of Thailand (NBT) Channel 11. Kiranee’s enthusiasm, social conscience and sheer zest for living is extraordinary. The island is indeed fortunate to have her on board. Little wonder, then, that in 2015 she was voted one of Phuket’s ‘seven most inspirational people and was recently recognised at national level by the Ministry of Social Development and Human Security as one of the 20 most inspiring people under the campaign: “Inspired Women, Inspiring Others” in August 2016.

Charming Old Town's Sino-Portuguese buildings with wooden shutters

Famous for its Sino-Portuguese architecture, pastel shophouses with wooden shutters and local charm, the Old Town district also plays host to an eclectic mix of unique coffee shops that draw on the days of yesteryear, filledwith worn family heirlooms and antiques. Gathering inspiration from the traditional kopitiams of the region, Phuket Old Town’s new breed of coffee shops are definitely worth exploring. Coffee culture is no stranger to Southeast Asia, and simple coffee shops known as kopitiams are still alive and well in the region. A kopitiam is a traditional coffee shop that serves easy meals and beverages. Kopi is a Hokkien word for coffee and tiam is a Hokkien word for shop; menu options often include a variety of coffees, teas and simple dishes such as eggs on toast. The coffee shops in the Old Town district have taken this tradition to heart and expanded upon it with an innovative twist.

As many of the coffee shops in the Old Town district are owned by local families, a good number of the photographs that line the walls are of original Chinese immigrants that settled on the island during the tin mining days, married into local Thai families and made Phuket their home.

Customers dine in a lush garden setting right at the sea’s edge with white sand underfoot and enjoy spectacular ocean and island panoramas during the day and a romantic atmosphere at night. Nikita’s boasts no fewer than 18 cocktails, but we settle for a traditional gin and tonic. A Tomato Bruschetta comes as appetizer, followed by an unusual dish, a spicy salad with glass noodles and peeled prawns. The wine list is well chosen – 12 whites and 15 reds, plus five choices available by the glass. A competitively priced Santa Alicia cabernet sauvignon from Chile – full bodied with supple tannins – provides a perfect complement to our meal. Seeking something distinctive for the main course, my friend orders a firm-fleshed and succulent Mahi-mahi (dorado). Served with a creamy white sauce laced with Thai herbs and mashed potato, it is pronounced superb. My choice is a whole, Deep-fried white snapper in fish sauce (sweet and sour sauce is also available) with a Thai inspired salad of crisp slivers of green mango and peanuts. Delectable. It is worth noting that many of the vegetables served here are sourced from Nikita’s own farm. Famous for its thin-crust pizzas – all cooked in a wood-fired oven – the choice includes classics such as Margarita with mozzarella, tomato and basil. All Nikita’s pizzas are celebrated for their lavish toppings. Then there’s English style fish and chips, coated in beer batter, a house speciality. Though Nikita’s emphasis is on seafood and international dishes, there is an impressive range of authentic Thai dishes. We finish in style with a slab of hot, dark chocolate mousse and a scoop of fragrant ice-cream. A sensational and contrasting mix of flavours, textures and temperatures. Beetroot & Licorise ideas by @ Tré at Banyan Tree Phuket Beet microwave sponge cake Ingredients 100g ground almonds | 90g boiled beets | 160g egg whites |100ml egg yolks | 55g sugar | 80g allpurpose flour Method Process all ingredients in a blender. Strain & pour in cream. Blend well & refrigerate for few hours. Make cuts in base of each plastic cup. Blend and fill 1/3 of plastic cup. Cook for 40 seconds in microwave; place cups upside down until cooled. Beetroot jelly Ingredients 600ml beetroot juice | 4 sprigs thyme | 10 tbsp sherry vinegar | 5g sugar | 15pcs gelatin leaves Method Add ingredients together & set aside in suitable tray and set. Cut in perfect cubes. Beetroot Sorbet Ingredients 10g liquorice powder | 200g sugar| 150ml water | 320ml beetroot juice | 60ml liquid glucose | 25ml sherry vinegar | 2 gelatin leaves | Method Place sugar & water into a medium sized pan to make syrup. Remove from heat. Add sugar syrup to beetroot juice, sherry vinegar, liquorice & glucose. Soften gelatin by soaking in cold water, squeeze excess water & add to beetroot mix. Sous vide endive Ingredients 300ml orange juice | 6 sprigs thyme | 50ml grape seed oil | 2 pcs crushed cardamom | ½tsp crushed coriander seeds | pinch salt Method Put endive flat in sous vide bag. Add the citrus liquor. Vac pack & cook at 80c until soft.

Imagine you’re a guest in a private home owned by a Thai aristocrat with royal connections and exquisite tastes in everything from fine wines and food to rare objets d’art. and mirror frames. The roofed, semi-circular balcony has matching sunbeds and lofty views above the treetops to the lush headland beyond the bay.

The overall effect is one of mellow warmth. Each interior, moreover, is lovingly furnished and decorated: a living space graced both by contemporary landscape paintings, antiques and Chinese-inspired images. Suite Four, for example, formerly Mom Tri’s home, is dominated by a huge, six-panelled painting above the bed. A range of residences are available, all offering total privacy. The Kata Suites have individual pools, while Pool Suites enjoy extra privacy with a spacious sitting room and – naturally – a private plunge pool. The resort has three communal pools, one with salt water and, if that’s not enough, the adventurous can experience one of the finest sand beaches on the island by following the winding steps down to Kata Noi Beach. Our penthouse suite, accessed by lift, is superbly appointed: a spacious bathroom with a Jacuzzi tub, luxurious initialed bathrobes, as well as shampoos and gels whose containers can be reused in a gesture to the environment. The sense of being at one with nature is palpable. Everywhere Mom Tri’s eco-friendly vision has meant the retention of mature trees – huge sea almonds, banyans and sand-loving stilt palms, supplemented by plantings of foxtail, Macarthur, fishtail and fan palms. Low growing plants: scheffleras, heliconias, polyscias, durantas, ginger, sea lettuce and even brugmansias flank the walkways and lawns. It’s entirely in character that Mom Tri should have invited his friend, celebrated botanist William Warren, to help landscape this rocky headland. The library, with its eclectic collection of books, bears his name. A short walk away, the Classic Ocean Wing offers yet more seclusion and luxury. Opened five years ago, the residences constitute the newest and most lavish addition to the resort. Like every Villa Royale suite, the six discrete living areas, all named after wines, and set amid lush greenery, have superb sea views and, wherever feasible, embody natural materials.

It’s hard to believe that any other Phuket establishment can vie with Villa Royale’s wine list.

On the terraced lawns, ‘objets trouvés’ bear witness to an artist’s vision – an ancient bronze telescope, coloured buoys suspended from trees, driftwood sculptures. Steps lead down through a virgin jungle to the last of a series of wooden sun-decks. Huge seas pound a rampart of rocks sculpted over time into massive round forms by the relentless assault. Catch the happy hour from 6pm to 7pm in the relaxing atmosphere of the wood-lined Seashell Bar or Veranda Lounge, and sip a pre-dinner drink while listening to soothing guitar or piano. I enjoy a glass of classic Chablis, my partner a Corona beer, in the calm surroundings. The contrast with the wild nautical scene outside couldn’t be greater, as huge foam-laden breakers crash on to the rocks below. It’s so dramatic, we stay for over an hour. Superb wine is a prominent feature at Villa Royale. The resort has repeatedly won ‘Wine Spectator Awards for Excellence’, an accolade in no small measure due to sommelier Georges Ciret. In his wine cellar, maintained at a constant 17 degrees centigrade, there are more than 400 labels: everything from Grand Cru Bordeaux

to increasingly popular organic, biodynamic and even vegan wines, altogether from 19 different countries. Many of Georges’ recommendations are highlighted in the menus. It’s hard to believe that any other Phuket establishment can vie with Villa Royale’s wine list. While five-star restaurants are invariably blessed with impressive menus, Mom Tri ‘s is extra special. Two specialist chefs, Darren and Sura, have created an unusually extensive range of western and Thai dishes, each one accompanied by an inviting photograph and a description of the ingredients. I’ve never encountered a menu before where I yearned to sample so many exquisite offerings. The signature dishes, with a pronounced French and Italian accent, include rich and creamy rock lobster ravioli, crab soufflé, a succulent crab cannelloni, coq au vin, Mediterranean fish stew, risottos, gnocchi and chevre roulade. The tempura snapper offers a delectable Japanese touch. The braised beef cheek passed my partner’s taste test with flying colours. Chef’s suggestions include creamy geang pu sen mee (crabmeat in red curry with betel leaves), lamb kaprow (chops in garlic and basil), tom klong pla gao (grouper soup) and geang pla tuna (tuna with ginger and red ‘jungle’ curry. All this without even mentioning the range of inventive takes on classic Thai dishes. It’s well worth making the effort for breakfast: a veritable cornucopia of delights ranging from excellent coffee, home-baked breads to made-to-order eggs. Smoked salmon, crispy bacon, cold cuts, hash browns and sausages are regular offerings. There’s even a daily Asian option: crab fried rice or phad Thai, plus an array of fresh fruit and juices.

Spa Royale, ‘a union of nature and luxury’, provides four different treatments. I opt for an essential oil-based massage, having chosen from four perfumed unguents. Chinese tea before and after completes a therapeutic experience which does wonders for my ancient frame. My partner enjoys a strong Thai massage called ‘Le Royale Release’. Naturally, the spa has private steam baths and soak tubs plus a well-equipped gym. Then there’s Wok Pagoda, Villa Royale’s sister restaurant, recently opened on a cliff side high above Chalong Bay, with panoramic views of Cape Panwa and verdant Andaman isles set in an azure sea. On a clear day one can see, if not for ever, all the way to distant Koh Phi Phi. A transfer service is provided for guests interested in a fresh dining experience with breathtaking marine vistas enjoyed from the restaurant’s two verandas. It’s not to be missed. Its teasing name, a conundrum I have managed to unravel, reflects the restaurant’s motif: a series of inverted bowls arranged on a pole to resemble the graduated storeys of a pagoda. Look closely and you realise that the bowls are real woks. Wok Pagoda. Hey presto! Wok Pagoda’s menu started life relatively small with the emphasis on shared dishes – Thai style. Now, reinvented by celebrated Chef Tummanoon, it is an ambitious affair – a delectable fusion of Thai, western and Asian recipes: 14 fish and seafood dishes, 12 meat and poultry, seven pasta, and four charcoal grill specials. Shared specials are still available. Try the superb pink snapper, pan-fried in white wine with tomatoes, capers and mushrooms. The crunchy signature salad with fresh greens, apple, grilled mushrooms, soft shell crab, smoked salmon and walnuts,

plus a ‘secret’ dressing is a must. Likewise, the stir-fried boneless Grouper sanumpral – with herbs, roasted cashews and mushrooms. The ambience at Villa Royale is unique. Island attractions are all within easy reach: The Big Buddha, Phuket Town’s Sino-Portuguese architecture, the hustle of Patong, the temples of Chalong or Promthep Cape, the spectacular shows at FantaSea, and Siam Niramit. But there seems no good reason to leave this haven; everything is here. The warmth of the décor extends to staff members who are, to a person, uniformly friendly and charming. Throughout our stay, Khun Nidnoi was a wonderful guide and host. No wonder Villa Royale has a high proportion of guests returning year after year. Watch out for the macaque monkeys on the lookout for your valuables and whatever goodies in your bag they can eat.

We’re not talking the Robinson Crusoe experience… but forget the rat race and fast food outlets (in fact, Lanta holds only a handful of well-known convenience stores). Catch it soon though; much like Phuket and its nearer environs, it’s inevitable that a faster paced way of life is around the corner. The 30km long and 6km wide Koh Lanta Yai or ‘Big Lanta Island’, is the largest of the 52-island archipelago known as Mu Ko Lanta National Park that falls under the jurisdiction of Krabi province, southwest of Phuket, which is the primary destination for tourists.

So what is there to do on Lanta? By all means, get your fill of the beautiful beaches. There’s Klong Dao, the most popular beach, but by most standards not busy, with restaurants and stalls of various cuisines, bars and nighttime entertainment. The 4km‑long Pra Ae (Long Beach), with plenty of accommodation is more tranquil. Pristine Kantiang Beach, home to the island’s first boutique hotel, Pimilai Resort & Spa, surpasses all in terms of its seclusion and tranquility, while at the southern tip, there are few souls kicking sand and disrupting your tanning sessions…

The small town of Saladan at the northern tip, where the ferry pier is, is the liveliest, while the further south you go, the atmosphere is conducive to long walks along the stretches of sand and for viewing the island’s spectacular sunsets. Beach bars and restaurants are ready to quench your thirst and offer quick bites, as well as family or intimate meals as the sun shines or as the evening sets in.

The end of the road on the southwest of Lanta holds a national park of which Ta Nod Beach and Lighthouse are prominent features. A photogenic area, the small beaches are pristine, the public grounds well-manicured around the rangers’ station and restaurant and the surrounding forest brimming with exotic vegetation and animal life under a rich, thick canopy. Walk the 2km along the nature trail and spend the night in a tent to appreciate the unspoiled expanse. Oh, just watch out for the macaque monkeys on the lookout for your valuables and whatever goodies in your bag they can eat. Even the park rangers are mindful and on the run from these cute but persistent thieves! Keen to scuba dive or learn / upgrade your skills? There are several reknowned sites to discover, among which Hin Daeng and Hin Muang are noted to be amongst the best in the world. Lessons and tours can be booked in Saladan. Koh Rok Nok to the west of Lanta offers the deserted island experience: overnight accommodation and facilities are available with the chance to appreciate the remoteness and, above all, the land and marine life of the area.

Escape into the magic of Lanta and CHILL on an island of natural beauty.

If you plan to travel to Koh Lanta in March, be sure to take in the Lanta Festival, which showcases traditional culture and features ceremonial demonstrations, performances, folk games and water sports competitions, as well as food booths serving local delicacies. Several services offer boat tours departing from the southern part of the east coast, thereby offering intrepid explorers the opportunity to discover areas even more off the beaten path. Lanta Longtail / Sun Island Tours, for example, offer unique tours by traditional longtail boat, including trips around Lanta and also to nearby islands, which include Koh Ngai and Koh Muk (with its absolutely stunning Emerald Cave, a sinkhole containing water that is flooded with sunlight and surrounded by jungle). Travel to other islands – Koh Ma, Koh Churk and Koh Kradan – can also be achieved by longtail boats and speed boats. On the main road that traverses the width of Lanta Island is the viewpoint that overlooks part of the east coast, the mainland and the channel separating the land bodies, as well as several smaller islands to the south. Stop and admire the view and get a fill of food and drink at one of the several restaurants perched there – then continue downhill through fields and farmland. Charming Lanta Old Town, on the east coast in the south of the island, was once Lanta’s port and commercial centre and is now the district capital. Stroll down the wide street and you’ll find waterfront buildings on stilts, constructed of dark timbers. This is the architectural style of the days several centuries ago when Chinese and Arab boats stopped enroute to trade goods with merchants in ports around the area, including Phuket to the northwest and destinations south such as the island of Penang in Malaysia. The area provides safe haven for boats from the high winds and seas during the monsoon season, while the long pier makes departure for, or arrival from, sea-going journeys possible at all-tides. Old Town has several fine restaurants and unique places to shop: Jumbo Hammock sells colourful and (very) comfortable cotton and waterproof hammocks suited for lying or sitting on, as well as storing stuff. These are woven by remote tribes in northern Thailand.

How to get to Koh Lanta Arrival to Koh Lanta is by boat to Koh Lanta Noi and by road bridge from there to Koh Lanta Yai. Ferries run from Krabi, Phi Phi and Phuket several times a day during the high season from November through April / early May. Speedboats are also available. Boat services may be restricted during the monsoon season if the sea state is too dangerous. Transport is also available by personal vehicle or mini van via the car ferry.

Most resorts have pickup trucks and mini vans that will transport passengers to and from the ferry pier or to prearranged destinations. Tourist services will provide a similar service. The best way to get around Lanta is to rent a motorbike. The going rate is 200 baht per day during the low season, but is slightly higher during the busier months between November and April. There are also tuk-tuks and motorcycle taxis, some of which have sidecars to transport more people. Note that it is advisable to agree on a price before setting off. Accommodation: Scores of places to stay that cater to tourists of all budgets scatter the beachfront of, or are within walking distance of, the nine beaches. There is also accommodation in Old Lanta Town and at the promontory on the southeast of the island. Check who you do business with... If you are a short or long term visitor to Phuket, you will discover that there isn’t a shortage of good opportunities for investment, but that there are also an abundance of scams too. Be cautious, take your time, observe, check, observe again – before making commitments. Hurry to say the least In a world where sound bites, short tweets, Facebook comments, We-Chat recorded voice instructions and emoticons are gradually permeating our lives both personal and professional at all levels, the basics of doing business can be forgotten. Using short form messages for all communications and business activities is also not advisable because – contrary to the principles of WhatsApp, Line, WeChat and Facebook Messenger – short and sweet is not always good.

The long con Recently in the news there has been a spate of ‘scam’ or, to use the legal term, ‘fraud’-based activities relating to business dealings. One such scam comprised a business person who used a Facebook page to sell fairly inexpensive products to a group of people. These products were reportedly marketed solely from the Facebook page and using Messenger. Following the build up of ‘trust’ by the purchasers of the products, the same business person then approached the group to ascertain if they would participate in a money lending scheme with attractive too-good-to-be-true terms. Having acquired their trust, the business person collected the monies, didn’t provide the returns, and simply disappeared. The victims were unable to identify the con artist, as they had all been communicating via Facebook and message systems only. They had not collected specific identification documents or address information on the person, yet they had sent monies – in aggregate a significant amount – to that person. Many con artists believe that what they do is not morally wrong, if people are greedy enough to make bad decisions...

The first successful project con Many developers who build a successful real estate project should be respected and rewarded for having gone through a difficult set of challenges. Unfortunately, in many packs of apples, there may be a bad apple or two. Some developers do not set out to scam their owners, but they become over-confident and over-extend themselves; then they may pass on their bad risk management decisions to buyers.

Many developers will set up their marketing on the basis of one completed project, which they will represent as ‘successful’. They may set up multiple similarly branded projects and then persuade buyers that they are ‘on a roll’. They may even pay a contractor to start some foundation works, or for land clearance and superficial preparations to be made to their land to demonstrate that ‘works are underway’. Many times we have seen this model collapse, and expensive luxury-car-driving developers are suddenly humbled and must give up all control and assets to the bank that amazingly decided to lend them money for speculative sale projects. This is of course at the worst end of a spectrum in which there are many successes but, nevertheless, this is a reality of the business environment and, wherever possible, must be avoided at all costs.

What does ‘due diligence’ really mean? If you ask different lawyers from different law firms, you may receive similar lists, some longer than others. However, it is worth conducting an inexpensive ‘preliminary’ due diligence on who you are doing business with, before you even spend time, resources and monies on exploring a business investment opportunity, of any nature whatsoever – be it real estate, a joint venture into a potentially profitable food and beverage outlet, a hotel or a travel business. Here are some very basic checks: 1.

Google Results – has the person extensively deleted Google information under the ‘Right to Be Forgotten’. What was forgotten...?

LinkedIn information – does this match up with other information provided, or are there conflicts? I remember some ex-staff of mine subsequently changing their profiles to represent they ‘managed’ the business I owned, when they were actually only junior employees. LinkedIn has no truth verification process.

n some western countries, during the process to transfer ownership of real estate, the law obliges the interested parties to use the services of a public body or representative to protect the buyer by making ‘due diligence’ compulsory. In Thailand however, parties can directly go to the relevant administration to register the ownership or rights in immovable property transfer. But some choose not to. Consequently, some buyers take the risk to be engage (in a purchase) without performing a competent and comprehensive due diligence process and unfortunately stand to lose a lot of money if they don’t comply.

In Phuket, land use restrictions are encompassed under three laws with the relative ministerial regulations. • The Building Control Act • The City Planning Act • The National Environmental Control and Maintenance Act All of these have been enacted within the last 40 years. Due diligence is implemented basically on the title deed, the building, the owner or holder of the immovable rights and legal relations between them and third parties. The title allows certain private use and grants rights to use, possess, own, or to transfer rights by freehold and leasehold. There are three titles to be considered: the Nor Sor Sii Djor (chanote), the Nor Sor Sam Gor and the Nor Nor Sam. The due diligence report regarding the title deed will show all historical transactions and any encumbrances as servitude or mortgage.

The said building has also to be free of any debt, charge or other restriction of private or public laws other than the usual easements. To avoid future legal litigation, the construction must correspond to the correct permit issued. In condominium projects, rules and regulations are even stronger, and some developers use the word ‘condominium’ only for marketing purposes with the result that at the end of negociations the condominium license won’t be issued and the unit will not be registered under your name. In the case of land and building, the owner of both can differ, in this case, one of the assets can be subject to checks made for each particular owner as to his/her criminal and civil background which could impact on the legal process of acquisition. A Thai company can also be the owner of the whole asset. In this case, the buyer can purchase shares and become director of the company. The due diligence procedure will request specific verification in accounting and tax domains. For the above reasons, the first step of your real estate investment should be followed through with due diligence. It makes perfect sense.

PHUKET, Thailand – The 12th Laguna Phuket Marathon welcomed almost 7,000 runners to the shores of Phuket for a record-breaking event. The sixth consecutive increase in participant turnout saw more than 50 countries taking part this year in what has become South East Asia’s leading destination marathon and Phuket’s largest annual sports event. Organised by Go Adventure Asia and hosted by Laguna Phuket, the run course is famous for its beauty, taking runners along quiet lanes in the North of the island, through Sirinat National Park and along Bang Tao beachfront before returning to Laguna Phuket and the finish line.

Following the successful two-day format introduced last year, organisers again held the event over two days allowing them to provide the best possible course for runners and maximise the runner experience for all. Sanctioned by the Association of International Marathons and Distance Races, the 12th Laguna
