cknowledging the past several months of turmoil, hardship and great loss, we begin again with our lives, post lockdown and adapt to what many are calling the “new normal.”

Whilst the hospitality industry, particularly in Phuket and across Thailand has been hugely affected, I am one, perhaps in the minority, who firmly believes that the “new normal” is in fact, at least for our industry, somewhat of a misnomer. Travellers still want what they

wanted before lockdown. Whilst it will undoubtedly be a considerable length of time for business to return to the levels previously experienced, we still seek hotel stays that delight and food that tantalises our taste-buds. I am confident Phuket will continue to prosper and conversations at high level of re-focusing on the luxury market whilst discarding mass tourism, for me, are pure folly.

Stepping down from my soapbox, I thought it would be fitting for this

article to feature two chefs, one prelockdown and the other post-lockdown.

So I recall my most recent visit to The Surin, where General Manager, the devilishly handsome, Claude Sauter, whose personal brand tagline is “managing one of the nicest hotels in Phuket and enjoying it immensely”, kindly invited me over for an evening to enjoy his Thai cuisine, prepared by Chef Saroch – Roj for short. As we sat down for dinner, Claude shared with me that

this would be the last couple of weeks before they would close for an extensive refurbishment and reopen 1st October.

Claude has been at the helm of this luxury resort since 2014 and is proud of many achievements, not least that during high season, all guests are known to Claude by name and returnees request the same dates annually and even the familiarity of the same villa. Claude assures me they are also recognised by name by staff – and welcomed back as old friends!

American architect Edward Tuttle who had truly unique vision. Claude continues, “Throughout this, it has maintained an elegant and stylish exterior with dramatic interiors combined with truly comfortable villas.” Coincidently, FB reminds me as I write this article, that I stayed in one almost exactly one year ago.

Chef Roj sends out several signatures, Sen Mee Nua Poo, thin rice noodles with poached crab meat in yellow curry, a true southern dish, grilled tiger prawns Samunprai, with crispy aromatic herbs, and Gang Phed Ped Yang, a red curry of roasted duck, cherry tomatos, grapes, pineapple and kaffir lime. He joined the hotel in 2017 and has been a mainstay of The Beach restaurant since then.

accommodate. Our repeat clientele is like family.” Continuing with his philosophy, he says, “Whilst how dishes look is important, the presentation for me is not number one; flavour is foremost.”

Based on what I have experienced, from October onwards, The Surin is definitely worth a visit; authentic dishes prepared with love!

Chef Roj is not a newcomer to Phuket, so I thought it might be interesting to get a different take from the just-arrived, Executive Chef Andrew Dickie, who has joined the uber luxe Kata Rocks; the

host of the exclusive annual Superyacht Rendezvous – where the owners of the world’s largest yachts gather, perfectly matching the vision of owner Richard Pope. I have been fortunate to previously meet and dine with both Richard and his General Manager, Phuket hotel veteran, Gordon Aeria.

Gordon introduces me to Andrew and we discuss his new menu plans over a mid-morning coffee. Andrew is not new to Thailand, having previously run a prestigious hotel signature restaurant in Bangkok and has worked for several luxury chains across Asia and Europe as

well as counting high calibre restaurant experience in his background. It would seem like a perfect fit!

Andrew shares, “I believe in quality ingredients, simply prepared, flavour first!

I am not a fan of wagyu, more leaning towards US prime ribeye or a Rangers Valley Black Angus ‘Aussie’ striploin.

I like to let the ingredients sing.”

Both Roj and Andrew do not fit the stereotypical slightly aggressive and ego driven chefs typified by the TV variety;

these two are in contrast, unassuming and talented, but both expressing their love for what they do. In this alleged “new normal”, I would suggest that you make visits to both to enjoy the current normal, high quality ingredients, confidently prepared in luxury surroundings – just the same as before!

Online learning is challenging, not only for students but for their parents and teachers too. With many schools and families now learning online, it may feel difficult – if not impossible – to ensure that students maintain a good balance of activities and learning without being constantly glued to screens.

In addition to creating structure to the day so that students are able to stay engaged and can maintain a routine, here are five ways that UWC Thailand helps students maintain balance while learning from home.

1. Practice mindfulness daily Encouraging children to take pauses to check in with themselves throughout the day works best as part of a family or school culture of mindfulness. Stopping as a family to practice together at a designated time each day can be really helpful. This gives you the opportunity to check in with your thoughts, emotions, and body and to discuss everyone’s needs as a family. Connecting to things that you all appreciate and are grateful for can also boost your mood each day and can be a welcome addition to your routine. 2. Seek out sustainable options and service opportunities As a school, UWC Thailand focuses on hands-on service, but in changing times we have to look at alternative ways to support our local and global communities.

With more time at home comes more takeaway meals and midnight shops online for things that we really can do without. What is the environmental impact of all those orders? Think just about the packaging involved, then add on the wider carbon footprint. Consider giving your business to local restaurants, markets, and companies that use biodegradable or easily recycled packaging.

While face-to-face volunteering may not be possible during lockdown or social distancing, there are still a number of ways to help. Many organisations need assistance with writing, online translation and developing social media advocacy campaigns. Of course, a nominal donation from the money saved from not going to the cinema will also be welcome! If it’s time for a spring clean, consider donating toys and clothes that haven’t been used over the last few months to local organisations.

3. Turn daily activities into learning opportunities Learning doesn’t begin and end with ‘school’. Here are some ideas of how you may transform daily activities into natural learning opportunities: 1) Conversations at home about health, nutrition, exercise, wellbeing and hygiene help children learn about their bodies. Consider working as a family to create healthy meal plans, tracking daily exercise, plant a garden and learn what the plants need to grow.

reliability or accuracy is a great way to encourage your children to be critical thinkers and users of language. Symbolic language is also important—mathematical numbers and symbols surround us in everyday life. Why not bake together and discuss what the measurements mean? Placing your grocery order? Have your child help; adding up the costs of items, sticking to a budget, etc.

3) Having children engage in chores around the house is a great starting point for conversations about work and income.

Build or make something together to develop a sense of production and craftsmanship rather than just consumption.

The more we can have children ‘hands-on’, the more ‘heads on’ and ‘hearts on’ they will be as well.

4) Dance, music, painting, sculpture and architecture are languages understood around the world. Listen to music together and talk about the meaning behind the lyrics, or how the instruments make you feel. Go on a virtual tour of many of the world’s museums and discuss the artwork, then try to recreate it at home with materials you have available.

4. Get outside As we spend more time indoors than many of us have done before, now more than ever, it is important to take deliberate action to step outside and allow ourselves to be in a ‘green space’. There is a catalogue of evidence that spending time in nature (even small green spaces) can positively affect our mood and psychological well being. While that may be limited to our gardens and local neighbourhoods, it may surprise you how much there is to explore. How much do you know about the wildlife outside your front door?

Taking time to walk in these green spaces regularly, either individually or as a family, can help us create a sustainable routine that allows us to get our bodies moving and experience gratitude for nature.

There are also a number of activities available and wilderness skills to develop while we continue with home learning. Some of the tasks our students have been working on in recent weeks have been focused on knotwork, compass building, water filter making and nature journaling. There are a number of online tutorials that you can follow, as well as the video series Kru Rob, UWC Thailand’s Outdoor Youtube channel Education Teacher, has on his Youtube channel.

5. Take a brain break In addition to the necessity of daily activity, brain breaks are energising bursts of activity that boost blood flow, send oxygen to the brain and help us retain information.

To facilitate brain breaks at home before the lock-down began, UWC Thailand’s primary school students decided on a sporting item like a tennis ball, skipping rope or badminton racket to play with at home, periodically throughout the day.

By now, it’s you who has been staring at a screen, likely for much longer than just to read this article, so why not try a brain break yourself? A dozen push-ups and jumping jacks?

A quick walk? 10 minutes of yoga? Afterward, when you return to your device, take a moment to reflect on how your capacity to concentrate has changed.

Phromthep Cape - Yanui Beach

R

emember the times when mum or dad would say, “Come on kids, let’s all go for a nice drive”?

It may have been a long while ago but you can bet your last baht that those memories are as fresh as yesterday. Well the good news is that Phuket’s west-coast routes, and some east-coast drives, are fantastically beautiful to explore. Having said that, let’s get real here and state that Phuket’s main roads are most certainly not the ideal roads along which to enjoy a relaxing day out.

roads as much as possible, but the route inevitably heads inland from time to time. You’ll eventually get to Surin Beach, which has changed dramatically in recent years; in the ‘Covid 19’ era, you’ll find the beach sparsely populated. There are now no beachside restaurants, once loved by tourists and locals alike, so for lunch you’ll need to head south to Kamala Beach.

Layan, Cherngtalay

Unsurprisingly, the first step in enjoying a mobile day out here is to get yourself some wheels. It’s not recommended to hire a motorbike yet thousands of visitors do; so to use a well-worn Thai/English expression, it’s really ‘up to you’ although we’d certainly lean towards the ‘four-wheels-good’ attitude as the driving in Thailand can sometimes be erratic (read dangerous) to say the least.

Kamla - Kalim Beach

The drive south to Patong – Phuket’s 'Party Central' town – comprises lots of photogenic views, so don’t rush things and don’t be afraid of pulling over to take snaps and selfies. Just before Patong you’ll eventually come to a flat coastal road flanking Kalim Beach then straight after, because of Patong’s one-way system, you’ll be obliged to drive through erstwhile ‘Sin City’. Follow the bend heading into town then take the first right and stay on the route out of town up the hill towards Karon Beach. This elevated winding and dipping road has some outstandingly picturesque views over the Andaman Sea. Eventually you’ll descend to a flat six-kilometre stretch flanking Karon Beach. It’s worth stopping along the way here simply to jump up and down because, believe it or not, Karon Beach’s sand actually squeaks when you walk on it!

At the end the road will rise a little then swiftly dip into Kata Centre. At the following three-way intersection take the right-hand turn and you’ll come to Kata Beach. This is still quite a busy spot, but worth a stop as one of the islands most beautiful beaches. Take advantage of the fact that parking spaces are easier to come by than they were pre-Covid. Heading further south, take a right turn at the T-junction and pass the swank Boathouse hotel, then a sharp left up what seems like an almost suicidal gradient and you’ll soon be way above the coastline from Kata to Nai Harn.

popular ‘Three Beaches’ viewpoint, from where you can gaze back on where you’ve just come from at the surf-lined Kata, Karon beaches with Kata Noi Beach just below. If you follow the main road down from here towards Nai Harn, on a clear day as the route descends left you can see the Phi Phi islands some 40km away. Pass a few elephant camps then drive through Nai Harn village. Follow the signage and you’ll get to one of the most natural beaches on the island. Largely undeveloped because of the Buddhist temple owning the beach’s hinterland, Nai Harn is a delight.

From Nai Harn itself you’ll spot three windmill-like structures in the nearby southern hills. Drive up to this spot through the verdant national park at about six o’clock in the evening and you’ll get the best sunset views in the south of Phuket. Forget crowded and touristy tawdry Phromthep Cape further to the south: this is where it’s at: Happy motoring!

How law can

be used as a business tool to persecute foreigners in Thailand

T

he law can be a deceptive illusory concept for innocent businesspeople who are not immersed in legal interpretation on a daily basis. Many businesspeople will rely upon legal advisers to assist with risk-analysis decisions relating to a desire to pursue profits, through investment, risk and reward activities in Thailand.

What can be a surprise for the uninitiated or unprepared is the huge gulf between common practice, enforcement methods and the strict codified laws that exist in the body of law generated over lifetimes. Of further surprise, may be the use of law and alleged, but even unproven, breach as a method to extort, leverage or financially undermine an investor, by a partner or co-investor.

Although laws were written for the purpose of bringing order to society, for protecting economic, social and cultural interests, under a legal constitution, and in accordance with the domestic framework set up for formulation and enactment of laws, the incontrovertible fact – that is not unique to Thailand – is that there are many bad faith market participants.

Admittedly, this article focuses on a negative aspect of investment when, arguably, there are just as many – or maybe more – potential upsides to taking risk. However, for a market participant to make good investment decisions and calculate risk/reward, potential capital/income and other financial ratios, good quality information on market risks is better than none, or better than a polished unrealistic portrayal of how a market actually operates in practice. It must be noted first of all, that there are high profile cases of foreigners being persecuted and “judicially harassed” (this means harassment through the law, not by the judiciary itself ), but who ultimately have been found by the Supreme Court to have been justified in the actions which formed the subject of harassment. So, justice can prevail, but unfortunately often years after huge personal damage on participants and their families has already been imposed.

So, to the examples of how business partners in Thailand may typically use bad faith persecutory tactics through law, to exact damage and manoeuvre for leverage: Use the Labour Law or Immigration Act to find a breach or violation unconnected to the business dispute, but which will jeopordise and harm the foreigner’s sense of wellbeing, family and living security, including right to earn income and right of abode – temporary or otherwise, in the country.

Often, upon the first signs of a dispute over a business arrangement, a partner will approach their legal advisor, and strategise to ‘investigate a work permit’, ‘contact the authorities to check compliance’ and/or investigate declarations made in relation to a visa. This is designed to humiliate and scare a foreigner into conceding on the business issue, whether wholly or partially right or wrong, and is a lateral manoeuvre requiring the least effort. Many foreigners are unaware of the limitations of law on the complainant, namely that the complainant must be very careful not to illegally obtain private information from a government department and that the officials must not collude with any information disclosure. Unfortunately, in practice, due to foreigners feeling uncomfortable and not familiar with

checks and balances and any ‘safe havens’, the complainant will achieve some degree of success with these socially and morally low harassment tactics. Many legal letters sent on completely unrelated topics contain references to “investigating work permits and visas”. We have also seen extensive use of misinterpretation of salary and benefit declarations as a method to inflict damage on foreign parties who previously relied upon the very party making the complaint, to advise them on compliance.

Use the Computer Crime Act’s broad provisions to trigger spurious legal proceedings to try and provoke confiscation and holding of a foreigner’s passport, restricting rights to travel, visit family overseas, while causing stress and damage through the instigation of criminal proceedings.

Reading the Computer Crime Act in Thai or English, it is easy to see how a breach can occur. Simply entering false information into a computer can give rise to a violation – with limited exceptions. This is almost like asking someone who drives a car if they have ever violated the speed limit. There is so much false information in the world of ‘computers’, or should we say ‘technology’, that is very easy to forward or share something which is partly false, with innocence. Business partners and aggrieved parties will often look to this law to try and file a private criminal complaint to harass a foreigner.

Trick a foreigner into signing a false document, or a wrong document, in relation to an application, then save or ‘store’ the violation and later use it against them as a violation of the criminal code for providing false information to an official. Due to the fact that Thai language is used for all official documents, it is exceptionally easy to wear down a foreigner with the volume of paperwork that they have to churn through for many everyday tasks, applications or business duties. In the face of this bureaucracy, businesspeople will often delegate the translation, completion and submission of these documents and processes to internal staff or external agents.

The common trick for a party seeking to persecute the foreigner, is to identify any technical discrepancy in the paperwork, or even – in more ‘friendly times’ – encourage the foreigner to take a shortcut or make a small violation, only to then use it against him later, with full access to the breach made. A seemingly laissez-faire and relaxed business partner can very quickly turn into a slavish obsessive, determined to privately and publicly enforce everything ‘strictly in accordance with the law’.

When applied very strictly, the law can be a very dangerous societal tool, especially if read literally with no interpretation of intention or balance. It is almost laughable, if it were not for so many fatalities per year, that there is a law against driving through a red traffic light or along a roadway in the wrong direction; such a law does exist, but is not ‘strictly enforced’ if one observes the roads carefully. Likewise, a business mistake on a document is easily made but when dealing with a bad business partner, not easily forgiven.

Encourage the foreigner to commit to an investment structure which is legally flawed, then use the flaw against him so that they dispose of assets at a discount or lose the assets altogether under a dispute or through fraud. The most common example of this is in a joint venture commercial investment, or an investment relating to a property acquisition involving land, whereby one partner will promote a structure, or even recommend an adviser to set up a structure, which they actually will later allege is an illegal structure and challenge it to gain or exploit commercial advantages over their actual or former coinvestors. Law Used As a Business Tool • Persuading an investor to take short cuts on ‘paid-up’ share capital, and later ‘calling up’ unpaid capital or denying investor rights – voting and control through evidencing unpaid capital • Persuading an investor to enter into false or risky investments with ‘nominee’ shareholders who are simply put forward to place their names into an investment to superficially satisfy the requirements of Thai majority or Thai participation in a particular enterprise. Obviously one investor aware of such a short cut can easily whistleblow and provoke an investigation to exploit and exert pressure, at a time when it suits them.

• Persuading an investor to sign documents, contracts, or become involved in a business with a ‘land purchase’ element, and then later accuse them of violating the Land Code which restricts foreigners from purchasing land directly or indirectly.

This will often be confusing for an investor, who may be investing not to purchase land, but to do something else, but where land is a necessary part of an investment. Grey areas of interpretation, practicalities of a business and an initial friendly approach from co-investors can lead a foreign party into a false sense of security, until it is too late to mitigate risk • Persuading an investor to sign a document which doesn’t have any legal effect under Thai law, knowing that if a dispute arises the foreign party cannot rely upon the validity of a document or agreement. There are many instances where a foreign party attempts to exploit a domestic party, and this would warrant a separate article and list.

However, in an economic environment where Foreign Direct Investment will presumably become much more needed, and perhaps wanted, (notwithstanding the world’s gravitation towards anti-‘foreign’ sentiment and nationalism) and where foreign parties will be tempted with discounts and restructuring transactions, it is important to recognise these risks when calculating potential rewards in transactions. Further, for any market participants that are feeling the ‘pinch’ of lack of foreign investment, some self-reflection on policy, enforcement and use of the law to harass foreign parties may be a worthy investment of time, if reform to a more positive framework would be the outcome.

Will Covid-19 really lead to a phuket property ‘Crash’ Potential buyers all want to know how the coronavirus will impact the market for real estate for sale in Phuket. While a prolonged economic downturn will almost certainly lead to lower prices, we actually remain cautiously optimistic and don’t believe any slowdown in Phuket real estate will be as destructive as others have suggested.

Phuket is unique among major global holiday destinations in that foreign buyers are the real drivers of the property market, and the houses and condos are almost exclusively bought for cash. A crash in the property market is almost always caused by a liquidity crunch in the banking sector, but foreigners are not allowed to get mortgages from Thai banks (and most foreign banks will not lend against Thai property).

A mortgage/liquidity crisis in the banking sector would therefore have no direct impact on foreign owners in Phuket because there are no mortgages.

At the same time, developers in Phuket predominantly finance construction with off-plan sales (units sold prior to construction). Any developer using advanced sales rather than bank loans to finance their project will not face pressure from the bank to “fire sale” units.

We agree that anyone hunting a bargain will find attractive deals on both villas and condominiums across the island. However, we believe that the cheaper condominiums for sale in Phuket is where most bargains will be found. Those individuals most vulnerable to a “COVID-19 downturn” will be buyers of entry-level condos struggling to make their next payment.

At least 51% of the unit area of every condominium must be Thai owned but, unlike foreigners, Thai nationals can use mortgages to finance their property. That said, it is more likely that a Thai property investor would be using a mortgage to buy a villa, rather than a condo.

While Thais are active in the condo market in Bangkok, very few of the prime west coast condos in Phuket are owned by Thais (whether or not they have a mortgage). As mentioned above, the Phuket condo market is dominated by foreigners, and this also applies to “the 51%.”

Quite often the management company or developer will continue to own the Thai freehold/foreign leasehold units for the rental income they can generate. If financial circumstances pressure a developer to sell off a few units, the 51/49 ownership rules must still be strictly adhered to. Foreigners hunting a bargain among “the 51%” may either settle for the leasehold, or establish a Thai company to buy Thai freehold units.

But this does not always work out as planned. A Thai company has establishment and running costs which immediately erode the supposed savings. And should the company set-up not be done properly (e.g. you must avoid using nominee shareholders), you and your company could fall afoul of the law.

In addition, the company must also file income and property taxes (and pay both!). Finally, if you’re a company director who lives in the unit, your accommodation is deemed a benefit in kind. You are then liable for income tax on the fair market value of the rent, which is an expense as well as a nuisance.

It is not easy to do things properly, but this creates opportunities for savvy investors. We already know that Thai freehold units cost less than their foreign freehold equivalents, so if a desperate developer, management company, or owner needed to sell, it is possible that those units could hit the market at bargain basement prices.

Just as the foreign owner of a Phuket luxury condo is unlikely to be forced by this economy to sell their unit, the same is similarly improbable for a villa owner. Again, with no borrowing, the only pressure to sell would come from personal finances, and the current downturn is hardly going to bring someone to their knees financially if they had US$500,000 to $1 million in cash to spend on a Phuket villa in the first place.

But what if this “Covid Crisis” leaves the aforementioned Thai national unable to pay the mortgage on their villa? While they may be forced to put the villa up for sale at a discount, a rather small percentage of villas in Phuket’s tourist areas are currently owned/mortgaged by Thai nationals.

The real estate market in Phuket is not homogenous, and that can even be seen within individual developments.

Condominium units are either foreign freehold or Thai freehold, which is one reason for disparities in price. But what may appear on the surface to be an attractive “Covid discount” may just be a Thai freehold unit being sold to a foreigner as a 30year leasehold. If titled ownership is your goal, please ensure that you are getting a foreign freehold unit.

Foreigners are only allowed to own 49% of the unit area of any given condo development, so fewer than half the total units on the island are foreign freeholds. The idea that the market will therefore be awash in massively discounted luxury condominiums is a little unrealistic.

Many people remain convinced that we will soon see a plethora of deeply discounted Phuket properties. This may yet transpire, but if taking advantage of these deals means foreigners need to use Thai companies - with all of the associated responsibilities and liabilities - those once attractive discounts may not prove deep enough.
