The arrival of winter forces everyone to confront the changes synonymous with the season, and local wildlife is no exception. Low temperatures, harsh winter storms and a scarcity of food can make it challenging for wildlife, including birds, to thrive throughout the winter.

Even though several species of birds are migratory and travel to warmer climates to wait out winter, many others stay put. The Audubon Society says that keeping close to home helps some species of birds maintain their territories.

Some birds will puff up to retain heat; others will seek shelter in dense foliage or cavities to avoid the elements.

Many birds will huddle together to share warmth.

and energy source. The Audubon Society says more than 10 percent of some birds' winter body weight may be fat. That can be challenging to maintain when common sources of food, such as insects and berries, disappear as winter wears on. This is when some human intervention can prove handy, advise ornithologists. A few simple efforts may benefit birds and other wildlife that may not hibernate winter away or escape to the tropics. · Have a supply of food, bird feeders, houses, and any other bird-related gear at the ready before the storms really rev up. · Invest in nutritious food, such as black oil sunflower seeds or blends that are high in black oil sunflower seeds.

You also can make available more foods that are high in fat, such as suet, peanut butter or

even whole peanuts. Mother Nature Network also suggests adding meal worms if they can be found. · Choose feeders that will keep seed dry; otherwise, it will be prone to bacterial and fungal growth. · Don't discard fallen leaves or any downed twigs or pruned boughs from trees. This will give birds material for creating shelter or hiding away when the weather gets especially brutal.

When the Christmas tree is finished for the season, place it in the yard as a windbreak for birds. · Put shallow water sources around so birds can drink.

Replace them frequently if water freezes.

Wild birds can benefit from some help when the temperatures start to drop in winter.

Thank you to the many that were here for me and our family during the loss of my best friend, and husband, Douglas Laney. John Henry Homan, age 71 of Lowell, passed away Wednesday, December 11, 2019 after a battle with cancer. He is preceded in death by his parents, Robert and Norma Homan; sisters, Peggy Allen and Nancy Hobert. John is survived by his wife of 35 years, Donna Homan; children, Gary (Chasity) VanderMark, Robin (Jeff) Kyburz, Michelle (Tony) Stepek; grandchildren, Courtney and Bailey VanderMark, Josh, Haley and Nate Kyburz, Gage Stepek; nieces and nephews; as well as brothers and sisters-in-law. He served in the United States Army during the Vietnam Conflict. John loved a his son Gary racing on dirt tracks, watching Nascar racing and going to casino’s. He also enjoyed his career trucking throughout the country. The family will be having a private militaary service at Ft. Custer National Cemetery, 15501 Dickman Rd,

† HOWORTH Roy Gene Howorth age 91 of Ionia, MI passed away Wednesday, December 4, 2019. He was born on August 6, 1928 in Ionia the son of Joseph and Beatrice (Stoddard) Howorth.

Roy graduated from Ionia Public Schools. He served in the Army during the Korean War. He married Patricia Schafer on October 22, 1955 she passed away December 28, 2015. Roy was a life member of Knights of Columbus and Sheridan VFW; he was also a member of SS Peter & Paul Church. He loved fishing, playing cards and bingo.

Surviving are his children Michael (Marcia) Howorth of Ionia, William (Kim) Howorth of Lowell, Beth (David) Mellinger of Ionia, Gerri Howorth of Gig Harbor, WA, David (Melanie) Howorth of Denver, CO and Roy (Holly) Howorth of Ionia. Several grandchildren and great grandchildren.

Brother Charles (Joan) Howorth of Orleans and many nieces, nephews and cousins.

He was preceded in death by his parents, wife Patricia and sister Barbara Schafer.

He loved his family and they came first in his life. Fred enjoyed life and had an infectious smile that he bestowed on everyone he met. He believed in getting along with almost everyone and felt he was easy going. He was quite the jokester, everyone was his “favorite”.

Fred was a graduate of Ionia High School Class of 1986 and went on to have a career in the Food industry. In his last years he was best known as the “Fire Oven Pizza Guy” at the Wagon Wheel. Many will remember him as the Trivia DJ, both at the Wheel and Renucci’s . He also held many different roles throughout his life; former member of the Elks- Exulted Ruler & former Secretary, worked for the Grand Ledge Meadows Charity Poker Room and he was an avid bowler.

Fred leaves to cherish his memory, his parents, Boyd and Barb Meyers, Brothers: Eric Meyers, Greg (Tina) Wolbers, Jerry (Rhonda) Wolbers, Sister, Tammy Friddle , his sole surviving Grandma, Dorothy Lenneman, along with many Nephews, Nieces, Aunts, Uncles and Great Nieces and Nephews.

Fred is preceded in death by his Grandparents: Fred I. and Lucille Meyers, Ronald Lenneman Sr., Uncle Edwin (Spike), cousins: David Huhn, Jamie Huhn, and Daron Page.

Celebration of Fred’s Life will be held on December 23, 2019 from 3-8 p.m. in the Oak Room at the Wagon Wheel, 7888 E. Grand River Avenue, Portland.

2020 SMaRT Soybean On-Farm Research Meeting The results from the 2019 SMaRT (Soybean Management and Research Technologies) on-farm research projects will be presented at six programs conducted around the state in January. All programs will begin at 9:00 a.m. and end with a complimentary lunch. The dates and locations for the six programs are listed below: ·January 7, Wagon Wheel American Grill, 7888 E. Benson announces beginning of online voter registration and availability of eNotary services in Michigan LANSING – Secretary of State Jocelyn Benson announced on Cyber Monday that Michiganders can now register to vote or update their voter registration online at Michigan.gov/VoterRegistration.

In another major announcement, Benson said that offering electronic (eNotary) and remote notarization services is now an option for the state’s more than 113,000 notaries public.

Both programs represent steps forward for Michigan in using technology to provide modern and convenient services to residents.

Online voter registration begins The secure, web-based online voter registration tool is available to citizens with a valid Michigan driver's license or state ID card.

Michigan residents without these documents can learn more about how they can register to vote by visiting the site. All other methods of voter registration, including registration by mail, will remain available. Michigan also began implementing automatic voter registration in September as part of driver's license and

state ID card transactions.

“This fast, convenient, cost-effective and secure option to register to vote will enable many more people to participate in democracy, and help Michigan’s clerks maintain complete, accurate and up-to-date voter rolls,” said Secretary Benson.

Residents who know they're not registered to vote at their current address can access the voter registration tool directly by visiting Michigan.gov/VoterRegistration. Users will then be asked to verify their eligibility and provide identifying information including their driver's license or state ID card number. After they verify their identity, users will have the opportunity to register to vote or update their voter registration if they are already registered.

If residents are not sure whether they are registered to vote, they can visit Michigan.gov/Vote to find out. If they are not registered, the site provides a link to the online voter registration tool.

They are officers appointed by the Secretary of State to attest to the authenticity of a person’s signature, administer oaths and witness acknowledgements.

Notarization on a document certifies that the person named on it appeared before the notary, displayed valid identification and was in the presence of the notary at the time of execution.

In an electronic notarization, the document being notarized is digital and the notary uses electronic signatures (a digital representation of a person’s actual handwritten signature executed by that individual with the intent to sign). A remote notarization is conducted through audio and visual equipment; the signer is not in the physical presence of the notary public.

IONIA — In the midst of the holiday rush, the community is invited to relax with a steaming cup of cocoa, tea or coffee and enjoy a reading by area authors at "Ioniabokaflod: A Night of Imagery and Storytelling,” from 6-8 p.m. Friday, Dec. 20, at Sozo Coffee Roasting.

A new, and free, holiday event, Ioniabokaflod is a play on the Icelandic tradition, Jolobokaflod, or “Christmas Book Flood.”

On Christmas Eve, people in Iceland exchange books as presents, then spend the rest of the night in bed reading and eating chocolate.

At Ioniabokaflod, pajamas are optional, but everyone is welcome to rest by the fireplace and listen to poetry and stories read by the individuals who wrote them. Area artists will also be on hand to discuss what sparks their imagination. And there will be chocolate.

Mindy Hensley, who owns Sozo with her husband, Rodney, came up with the idea for the holiday event to celebrate creativity. She reached out to the Mid-Michigan Word Gatherers, an Ionia County-based writers group which meets every Thursday at Sozo.

“I wanted a night of artists and authors sharing their passions from different creative places, and feeling the embrace and support from each other and the community,” she said.

Rep. Calley is looking out for patients with eye drop prescriptions Moneysaving legislation signed into law State Rep. Julie Calley’s legislation requiring insurers to cover early prescription eye drop refills was signed into law this week.

Calley said that more than two-thirds of people, especially seniors and young children, have trouble administering prescription eye drops, which causes them to run out of the prescribed medication sooner.

Because prescription eye drops are written for the precise amount of drops, this can pose a significant problem. Patients are faced with going without their eye drops, which endangers their vision, or paying full retail price for an early refill that may cost hundreds of dollars.

Calley’s legislation requires that

insurers cover eye drop prescription refills if 21 days have passed from the most recent refill or prescription distribution or if 70 percent of the dosage has been utilized.

“Prescriptions are expensive, and without this change many people will go without their necessary prescriptions because they can’t afford to pay for them without insurance,” Calley said.

“Insurers must step up to ensure patients have regular access to the prescriptions they need.”

The legislation is part of House Republicans’ greater effort to reduce health care costs in Michigan.

House Bill 4451 is now Public Act 139 of 2019.

Rep. Calley: Plan finalized to end budget impasse, reverse governor’s cuts State Rep. Julie Calley today voted to reverse the governor’s cuts to initiatives helping the state’s most vulnerable residents – ending a budget impasse.

Calley, of Portland, joined the Legislature in restoring funding to public safety, education, veterans’ services and several other programs. A measure sponsored

by Calley – restoring more than $1 million for the Autism Navigator program – was also incorporated into the final plan.

made at the start of the budget year that began Oct. 1.

“I’m glad both sides of the aisle are finally coming together to pass a solution and end this manufactured budget crisis,” Calley said. “This plan puts people before politics and restores funding for programs people in our communities rely on every day.”

The plan approved today restores support for: Public safety. The plan reverses the governor’s $13 million in cuts to the program allowing sheriffs to hire patrols for secondary

roads and $15 million for a statewide fund that reimburses county jails for holding state prisoners.

The measure also restores $10 million Whitmer eliminated for school safety grants.

Education. The House vote would restore funding for transportation in isolated school districts, dropout recovery programs and literacy programs.

The Michigan Tuition Grant program, which helps nearly 17,000 college students statewide, will be funded.

Health care. The plan restores $7.9 million for rural hospitals

providing obstetrician care, $16.6 million for rural hospitals serving relatively high rates of Medicaid and low-income patients, $10.7 million to improve pediatric psychiatric services, roughly $1.5 million to help children with autism, and roughly $2 million statewide to fight opioid drug abuse.

Calley also voted to restore grants Whitmer vetoed to ensure military veterans can get access to services they need at the county level, along with several other veto reversals.

FREE Community Injury Clinics at AL!VE prove a regional success, and still building momentum CHARLOTTE, MI – Nearly 200 local residents have attended free weekly injury clinics held

by AL!VE and its partner, Playmakers, since March 2019, stopping in to discuss ailments both big and small with a health professional.

Clinics are conducted from 5:30-7 p.m. Tuesdays at AL!VE, 800 W. Lawrence Ave., Charlotte, and are geared toward those suffering from a variety of injuries, from muscle pulls to knee injuries to back pain.

“This offering has been extremely rewarding for us not just in illuminating solutions to nagging injuries but in having meaningful dialogue with patients and building relationships with them in a proactive way,” says John Sauchak, D.O., Medical Director of Sparrow Eaton Hospital Orthopedic Services.

These free-to-the-community injury clinics are offered on a first-come, first served basis.

They provide a free assessment, explore solutions, and sometimes include referrals for further treatment to a clinical specialist.

AL!VE’s clinics enlist the support of a variety of Sports Medicine clinicians, including Sparrow Eaton Hospital physicians, physical therapists and athletic trainers.

“It’s been great to expand on our ‘typical work day’ to see patients who might not have otherwise come in had they had to schedule an appointment,” says Jacob Brown, PT, DPT from EMPOWER, the rehabilitation department at AL!VE. “As a marathon runner with a

stubborn case of muscle inflammation (piriformis syndrome), I realized substantial relief after my treatments at AL!VE – which is quite different than anything I have previously experienced with a healthcare facility,” said Jamey Fitzpatrick, resident of Grand Ledge who recently attended the injury clinic. “The staff are very friendly, knowledgeable and demonstrate a genuine commitment personalized care, while the facility has such an inviting culture filled with talented professionals who demonstrate a holistic approach to personal health and vitality.”

ORDINANCE 59

An Ordinance to provide a title; to define words; to authorize the operation of and provide regulations for recreational (adult use) marihuana establishments in the Village of Muir pursuant to Michigan Regulation and Taxation of Marihuana Act, Initiated Law 1 of 2018, MCL 333.27951, et seq., as may be amended; to provide for an annual fee; to provide penalties for violation of this ordinance; to provide for severability; to repeal all ordinances or parts of ordinances in conflict therewith and to provide an effective date.

Section 1. Title This chapter shall be known and cited as the Village of Muir Commercial Marihuana Establishment Ordinance.

Section 2. Purpose The purpose of the ordinance is to regulate recreational ( adult use) marihuana establishments in the Village in order to protect the public health, safety and general welfare of the Village’s residents, to provide reasonable regulations regarding Village licensing of recreational (adult use) marihuana establishments, to provide a method to defray administrative costs of such establishments and to coordinate Village regulations and license approval with laws regulations enacted by the State of Michigan. It is not the intent of this Ordinance to restrict or abrogate the protections for recreational ( adult use) marihuana found in the Michigan Regulation and Taxation of Marihuana Act, Initiated Law 1 of 2018, MCL 333. 27951, et seq., as may be amended.

Section 3. Definitions A. As used in this chapter, the following terms shall have the meanings indicated: 1. “Act” means the Michigan Regulation and Taxation of Marihuana Act, 2018 IL 1, MCL 333.27951 et seq.

2. “Village” means the Village of Muir.

3. “Clerk” means the clerk of the Village of Muir.

4. “Council” means the Village Council of Muir.

5. “Department” means the Michigan Department of Licensing and Regulatory Affairs.

6. “Marihuana Establishment” means a Marihuana Grower, Marihuana Safety, Compliance facility, Marihuana Processor, Marihuana Microbusiness, Marihuana retailer, Marihuana Secure Transporter, or any other type of business licensed by the Department to operate under the Act. 7. “Marihuana Grower” means a person licensed by the Department to cultivate marihuana and sell or otherwise transfer marihuana to Marihuana Establishments.

8. “Marihuana Microbusiness” means a person licensed by the Department to cultivate not more than 150 marihuana plants; process and package marihuana; and sell or otherwise transfer marihuana to individuals who are 21 years of age or older or to a Marihuana Safety compliance Facility, but not to the other Marihuana Establishments.

9. “Marihuana Processor” means a person licensed by the Department to obtain marihuana from Marihuana Establishments; process and package marihuana; and sell or otherwise transfer marihuana to Marihuana Establishments.

10. “Marihuana Retailer” means a person licensed by the Department to obtain marihuana from Marihuana establishments; process and package marihuana; and sell or otherwise transfer marihuana to Marihuana Establishments.

11. “Marihuana Safety Compliance Facility” means a person licensed by the Department to test marihuana including certification for potency and the presence of contaminants.

12. “Marihuana Secure Transporter” means a person licensed by the Department to obtain marihuana from Marihuana Establishments in order to transport marihuana to Marihuana Establishments.

13. “Ordinance” means this corpus and any amendments thereto.

14. “Person” means any firm, person, partnership. Association, corporation, company, or legal entity of any kind.

Section 4. Recreational (adult use) Marihuana Establishments The following recreational ( adult use) marihuana establishments may be authorized to operate within the Village by the holder of a state operating license, and the Village may issue a Village license for the same subject to compliance with the Michigan Regulation and Taxation of Marihuana Act, MCL 333.27951, et seq., as may be amended, the Rules promulgated thereunder and this ordinance: 1. No more than one (1) grower shall be authorized in the Village.

2. No (zero) processors shall be authorized in the Village.

3. Not more than one (1) retailer shall be authorized in the Village.

4. Not more than one (1) micro businesses shall be authorized in the Village.

5. No (zero) secure transporters shall be authorized in the Village.

6. No (zero) safety compliance facility shall be authorized in the Village.

7. No (zero) special licenses shall be authorized in the Village. A special license shall include a designated consumption establishment license, an excess marihuana grower license, a marihuana event organizer license and a temporary marihuana event license.

8. No other license types as my be established by the Rules promulgated pursuant to the Michigan Regulation and Taxation ofMarihuana Act, MCL 333.27951, et seq., as amended, shall be authorized by the Village.

Section 5. Operation without a License.

A. All applicants for Village recreational (adult use) marihuana establishment license shall be pre-qualified by the State of Michigan Marihuana Regulatory Agency and shall provide proof of such approval from the State prior to or upon applying to the Village of Muir for a Village of Muir license.

B. Once the requirements in Section 5 (A) are met, all applicants are to obtain a License from the Village Clerk.

C. The Council may establish, by resolution, an appropriate nonrefundable license application fee, not to exceed five thousand dollars ($5,000.00) to help defray application and administrative costs.

D. The Village shall only issue a license for no more than one (1) Marihuana Microbusiness and no more than (1) marihuana retailer.

Section 6. License Application Submission A. Applications for a license shall be made in writing to the Clerk. All completed applications submitted to the Clerk shall be considered for issuance of a license. Completed applications shall be considered in the order in which received by the Clerk.

B. An application for a license required by this Ordinance shall be made under oath on forms provided by the Village, and shall be deemed to be complete only if it contains all of the following: 1. The appropriate nonrefundable permit fee in the amount set by Council resolution pursuant to Section 5; 2. If the applicant is an individual, the applicant’s name, date of birth, mailing address, email address, and one or more phone numbers; 3. If the applicant is an entity, the names, dates of birth, mailing addresses, email addresses, and one or more phone numbers of each individual with an ownership interest, including designation of one such individual as the primary point of contact; 4. The name and physical address of the proposed Marihuana Establishment; and 5. One of the following: (a) proof of ownership of the entire premises wherein the Marihuana Establishment is to be ordered; or (b) written consent from the property owner for the use of the premises in a manner requiring licensure under the Act along with a copy of the lease for the premises.

C. Nothing in this Ordinance shall be read as prohibiting a person from

obtaining multiple licenses under this Ordinance. An individual or entity must apply for a license for each Marihuana Establishment that the individual entity intends to operate in the Village.

D. Nothing in this Ordinance shall be read as prohibiting a Marihuana Retailer from operating at the same location as a medical marihuana facility operating pursuant to the Medical Marihuana Facilities Licensing Act, 2016 PA 281, MCL 333.27101 et seq.

E. To the extent permissible, all information submitted in conjunction with an application under this Ordinance is confidential and exempt from disclosure under the Michigan Freedom oflnformation Act, 1976 PA 442, MCL 15.231 et seq.

Section 7. License Application Evaluation A. Upon receipt of a completed application meeting the requirements of this Ordinance and confirmation that the number of existing license does not exceed the maximum number established by this Ordinance, the Clerk shall refer a copy of the application to each of the following for their approval: the Building Inspector, the Electrical Inspector, and the Mechanical & Plumbing Inspector.

B. No Application shall be approved unless: 1. The Building Inspector, Electrical Inspector, and the Mechanical & Plumbing Inspector have inspected the proposed location for compliance with all laws and ordinances for which they are charged with enforcement.

C. If written approval is given by each individual identified in subsection B, the Clerk shall issue a license to the applicant.

D. Licenses issued under this ordinance may not be transferred to another person without the approval of the Clerk. For purposes of this subsection, a change in, transfer of, or acquisition of control of the licensee is not considered to be a transfer. In Order to receive approval to transfer a permit to a different person, the licensee must make a written request to the Clerk, indicating the current licensee and the proposed licensee. The Clerk shall approve the transfer of a license to a different person if the Department approves the transfer. Transfer fee is $500.00.

E. Licenses issued under this Ordinance may not be transferred to a different location without the approval of the Clerk. In order to receive approval to transfer a license to a different location, the licensee must make a written request to the Clerk, indicating the current location and the proposed location. The Clerk shall refer a copy of the application to each of the following for their approval: The Building Inspector, the Electrical Inspector, and the Mechanical & Plumbing Inspector. The Clerk shall approve an application to transfer a license to a different location if: 1. The Building Inspector, the Electrical Inspector, and the Mechanical & Plumbing Inspector have confirmed that the proposed new location for compliance with all laws and ordinances for which they are charged with enforcement.

Section 8. License Generally.

A. No consumption of marihuana shall be permitted on the premises of a Marihuana Establishment, and a sign shall be posted on the premises of each Marihuana Establishment indicating that consumption is prohibited on the premises.

B. A licensed recreational (adult use) marihuana establishment shall only be operated within the Village by the holder of a state operating license issued pursuant to Michigan Regulation and Taxation ofMarihuana Act, MCL 333.27951, et seq., as may be amended and the Rules promulgated thereunder. The facility shall only be operated as long as the state operating license and Village license both remain in effect.

C. The license required by this Ordinance shall be prominently displayed on the premises of the Marihuana Establishment.

D. A Marihuana Establishment receiving a permit under this Ordinance shall be subject to inspection by the Village Law Enforcement Agency at any time.

E. All necessary building, electrical, plumbing, and/or mechanical permits shall be obtained from the Village or other applicable governmental authority.

F. All persons working in direct contact with marihuana shall conform to hygienic practices while on duty, including, but not limited to: 1. Maintaining adequate personal cleanliness.

2. Washing hands thoroughly in adequate hand-washing areas before starting work and at any other time when the hands may have become soiled or contaminated.

3. Refraining from having direct contact with marihuana if the person has or may have an illness, open lesion, including sores, or infected wounds, or any other abnormal source of microbial contamination, until such condition is fixed.

G. Litter and waste shall be properly removed and the operating systems for waste disposal are maintained in an adequate manner so that they do not constitute a source of contamination in areas where marihuana is exposed.

H. Floors, walls, and ceilings shall be constructed in such a manner that they may be adequately cleaned and kept clean and in good repair.

I. There shall be adequate screening or other protection against the entry of pests. Rubbish shall be disposed of so as to minimize the development of odor and minimize the potential for waste becoming an attractant, harborage, or breeding place for pests.

J. Any buildings, fixtures, and other facilities shall be maintained in a sanitary condition.

K. Marihuana that can support the rapid growth of undesirable microorganisms shall be held in a manner that prevents the growth of those microorganisms.

L. Marihuana Establishments shall be free from infestation by insects, rodents, birds, or vermin of any kind.

M. A Marihuana Establishment shall continuously monitor the entire premises on which they are operated with surveillance systems that include security cameras. The video recordings from such systems shall be maintained in a secure, off-site location for a period of fourteen (14) days.

N. No Marihuana Establishment shall be operated in a manner creating noise, dust, vibration, glare, fumes, or odors detectable to normal senses beyond the boundaries of the property on which the Marihuana Establishment is operated.

Disposal of marihuana shall be accomplished by a manner that prevents its acquisition by any person who may not lawfully possess it and otherwise in conformance with the Act and the rules promulgated thereunder.

P. It shall be prohibited to display any signs that are inconsistent with this Ordinance, local ordinances, the Act, or rules promulgated thereunder.

Q. It shall be prohibited to use advertising material that is misleading, deceptive, or false, or that is designed to appeal to minors.

R. No Marihuana Establishment shall be located within an area zoned exclusively for residential use or within 1,000 feet of a pre-existing public or private school.

S. All distances under this Ordinance shall be measured along the center line of the street or streets of address between two fixed points on the center line determined by projecting straight lines, at right angles to the center line, from the part of the school building nearest to the contemplated location of the Marihuana Establishment and from the part of the Marihuana Establishment nearest the school building.

T. Any Marihuana Secure Transporter who has been granted a license under the Act may transport marihuana or money associated with the purchase or sale of marihuana through the Village, but may not store marihuana or money associated with the purchase or sale of marihuana in the Village.

U. In addition to the License application fee established in Section 5, the Council may establish, by resolution, an appropriate nonrefundable annual permit fee, not to exceed five thousand dollars ($5,000.00), to help defray application, administrative, and enforcement costs associated with the operation of Marihuana Establishments in the Village.

V. An applicant or permittee shall notify the Clerk of any changes in the information submitted in Section 6(B) within two (2) business days of such changes occurring.

Section 9 License Renewal A. The term of each license shall be one year. Within thirty (30) days of the expiration of a license, the licensee shall apply to renew its license.

Applications to renew a license shall be made in writing to the Clerk. If a licensee fails to file an application to renew a license prior to the date that license expires, the license shall be deemed forfeited.

B. An application to renew a license required by this Ordinance shall be made under oath on forms provided by the Village, and shall contain substantially the same information as required in Section 6(8), as well as the appropriate nonrefundable annual license fee in the amount set by Council resolution pursuant to Section 8(V).

C. Unless the Clerk finds that denial of a renewal application is warranted pursuant to Section 14, the Clerk shall grant a renewal license to a licensee as long as the licensee has a valid state license issued by the Department to operate that Marihuana Establishment.

Section 10.Marihuana Retailer.

A. A Marihuana Retailer shall be limited to the Local Business District pursuant to the Zoning Ordinance of the Village.

B. No Marihuana Retailer shall be open between the hours of 10:00 p.m. and 8:00 a.m.

C. A Marihuana Retailer shall not permit a person under twenty-one (21) years of age on its premises.

Section 11. Marihuana Microbusiness.

A. A Marihuana Microbusiness shall be limited to the Local Business District pursuant to the Zoning Ordinance of Village.

B. A Marihuana Microbusiness may operate twenty-four (24) hours a day, seven (7) days a week, but may only be open to the public between the hours of 8:00 a.m. and 10:00 p.m.

C. A Marihuana Micro business shall not permit a person under twenty-one (21) years of age on its premises.

Section 12. Denial and Revocation.

A. An initial or renewal license application shall be denied if it does not meet the requirements of this Ordinance.

B. A license issued under this Ordinance may be revoked after an administrative hearing at which the Clerk determines that any grounds for revocation under subsection C of this section exists. Notice of the time and place of the hearing and the grounds for revocation must be given to the licensee at least seven (7) calendar days prior to the date of hearing, by first class mail, to the address given on the license application.

C. A license issued under this Ordinance may be revoked for violation of this Ordinance. If a license issued under this Ordinance is revoked, the Clerk shall notify the Department of the revocation within seven (7) calendar days.

Section 13. No Vested Rights A property owner, lessor, license applicant, or permittee shall not have vested rights or nonconforming use rights that would serve as a basis for failing to comply with this Ordinance.

Section 14. Penalties Any person in violation of any provisions of this Ordinance or any provision of a license issued under this Ordinance is responsible for a civil infraction, punishable by a fine of up to five hundred dollars ($500.00) for each violation. Each day that a violation continues to exist shall constitute a separate offense. Any criminal prosecutions hereunder shall not prevent civil proceedings for abatement and termination of the activity complained of.

Section 15. Severability Nothing in this Ordinance is intended to limit an individual or entity’s rights under the Act. The Act or the rules promulgated thereunder supersede this ordinance where this is a conflict between them. This Ordinance and various parts, sections and clauses thereof, are hereby declared severable.

If any parts, sections, paragraphs or clauses are adjudged invalid, it is hereby provided that the remainder of this Ordinance shall not be affected thereby.

Section 16. Repeal All ordinances or parts of ordinances in conflict herewith are hereby repealed Section 17. Effective Date This Ordinance shall be effective the day after publication after adoption, December 14, 2019.

LANSING, MI – The men of Sparrow helped to change the face of male health by participating in the hospital’s inaugural WhoGrew-It-Best contest, designed to bring attention to Movember.

More than 1,600 Caregivers cast ballots for 37 of their colleagues who entered in two categories, Old Growth (for existing facial hair) and New Growth (for whiskers grown during November’s Men’s Health Awareness Month).

The hairy winners were Samuel Vsetula, an X-ray Technician in the Radiology Department, for his impressive existing beard, and the men of the Neurology Intensive Care Unit for their “fabulous beards.”

Participants were asked to grow a Mo (or a beard, goatee, or Van Dyke) and submit a photo for voting by Caregivers. Men played for pride, and their health.

Movember is a worldwide movement that takes place every November to emphasize the importance of healthy habits for men, who are sometimes

hesitant to share their health concerns. Sparrow stepped up its efforts this year for men to take control of their health, not only sponsoring the Who-GrewIt-Best contest but providing regular health tips for our male Caregivers.

“We do a great job here at Sparrow taking care of Patients and family members. However, many Caregivers, especially

men, don’t put their health on as high of a priority,” said Alan Vierling, President and Chief Nursing Officer, Sparrow Hospital.

“Movember provides an opportunity to start a conversation about the importance of talking more openly about men’s health.”
