It wasn’t that long ago one could hear Louis Armstrong or another singer belt out the famous ballad What A Wonderful World. It’s a beautiful tune, a gentle two-step, with lyrics full of hope and wonder. A man of color singing about his wonderful life in a wonderful world, with nature, beauty, babies and love all around him.

Today, in our own wonderful community, an 84-yearold woman going door to door and sharing with neighbors about the worst ballot proposal the world has ever seen, gets shot in the shoulder. Why? Just because that neigh bor didn’t agree with her viewpoint on Proposal 3. What could have been a wonderful discussion, became a near death experience. So, what is behind Proposal 3 and why is it causing all this violence? It’s just politics and rheto ric, right? What’s the wonderful big deal?

Let’s examine Proposal 3, deceptively termed “Right to Reproductive Freedom Initiative”, which will forever change our Michigan Constitution, with no hope of any legislator altering it in the future. It overrides parental rights, giving super-rights to anyone who would like to exercise vague freedoms over any individual, minors included, in relation to reproductive organs, process es, transgender surgeries, abortions, sterilizations, cas trations, etc. The list is long with what it includes, like anytime abortion (after birth), by anyone (not a doctor), in any clinic or room or whatever, without oversight or question, with no parental consent or knowledge, deleting all current state laws and protections that might challenge any part of these new rights…this is evil!

Can you smell the aroma of people at the top of this food chain controlling victims and making a whole lot of money? What is the purpose of this proposal? Is it to promote childhood sexual anarchy? Every not-wonderful thing you can think of from pedophilia to sex-trafficking to rape to abuse of minors…all these included, without the benefit of current state laws that protect women, chil dren, and parents from these evils. Michigan Board of Canvassers states plainly that if this proposal passes, it will “invalidate all state laws that conflict with it” (which

are the current legal protections against it).

Additionally, Planned Parenthood’s multi-billion-dol lar industry, the ACLU, and Jane’s Revenge (a militant pro-abortion group) partner together to threaten any who would question their flow of revenue. In light of the chal lenges to this Proposal 3, pregnancy centers in Michigan found notes like this on their doors: “Warning: this is a fake clinic. If abortions aren’t safe, neither are you. Next time we will visit your homes, your churches, and your sponsors. Expect us.” And how interesting it is that the groups that claim they want abortion to be “safe and rare”, are the ones now threatening everyone’s lives and attempt ing to bully us all into submission. Who could possibly trust them?!

If you knew nothing at all about the topic of Proposal 3, but were aware of all the threats, the violence, the gun shots, and the hate, you might just be okay concluding that you would certainly vote NO on it. Who wants all that drama and violence?! Whether we are Christian or not, we all know good from evil. It is evil to encourage children to make decisions that will impact their lives irreversibly.

Enough said – it’s not wonderful!

Proposal 3 is actually simple. It turns parents into weak, powerless bystanders while enabling the government/ school to change and mold their children into physical ly unfit and abnormal barren young people. And there’s a whole lot of money in sex-trafficking, abortion, transgen der surgeries, and the sale of puberty-blocking drugs. The only thing stopping this flow of MONEY is us and our votes! Those of us who are committed to being informed are going to vote our consciences and emphatically say NO to this and the other two bad proposals on the Novem ber 8th ballot. Proposal 3 is actually the worst proposal the entire world has ever seen.

Satan has planted his flag in Michigan and thinks he will lead destruction of America right here in our home state. You might say he is trying to connect New York to Cali fornia via mid-American Michigan. Are we going to stop this movement? Are we going to admit this is wrong? Ardith J Cosart, age 95, of Port Charlotte, Florida passed away October 4, 2022 in Port Charlotte, Florida. She was born October 2, 1927 in Bowne Twp., Michigan the daughter of Ralph and Bernice (Dukes) Kyser. Ardith married Sherman D Cosart June 18, 1949 in Detroit, MI. Together they raised two children.

Ardith is survived by her daughter, Delynn (John) Kerr of Troy; grandchildren, Kynda Myers of Clarkston and John (Mary) Kerr of Troy; great grandsons, Landen and Dalton Myers; sister-in-law, Phyllis McKenzie of Arizona; half brother-in-law’s, Don Ard of Texas and Terry Ard of Illinois; half sister-in-law, Joann of Illinois and several nieces and nephews.

She was preceded in death by her parents, husband and son, Sherman and Dale K Cosart.

Ardith worked as a third grade teacher in the Troy School District and won several honors of recognition.

Funeral services for Ardith were on Tuesday at 1:00 pm October 11, 2022 at the Lake Funeral Home 158 Mill St, in Saranac with Pastor Becky Poor officiating. Interment Saranac Cemetery. Visitation was held at the Funeral Home on Tuesday 11:00 a.m. until 1:00 p.m. Those wishing may make memorial contributions to Tidewell Hospice. † GRAHAM William Arthur Graham “Bill” was born in Laporte County, Indiana on June 11, 1950 to his parents, Elery and Wilma Graham. William started to have unexpected health issues on Monday, October 3rd and passed away with his family by his side October 7, 2022.

William was very proud of his family and often times shared stories with coworkers. He was a talented carpenter and enjoyed making things for his grandchildren and great-grandchildren. His grandchildren described him as a family oriented man, silly, funny, kind-hearted, caring, dependable, faithful and made holidays so special.

William served in the United States Navy as an Aviation Mechanic from 1969-1975. He was preceded in death by his parents, Elery and Wilma Graham; his sister, Myrtle Grace Graham; and Mother and Father in-law, Carl and Helen Snyder.

He is survived by his wife, Diane Graham of Lyons; Children: Scott & Shannon (Mier) Graham of Ionia, Brett and Dia (Barber) Graham of Orleans, Tammy and Dane Thelen of Westphalia; Grandchil dren: William Graham, Kayla Graham, Tyler Graham, Brettany (Graham) Arambula, Megan Graham, Natalie Graham, Kendall and Carmen Thelen; and seven great-grandchildren.

Family and friends will be celebrating the life of William Arthur Graham on October 15, 2022 at Ionia Moose Lodge from 2pm-6pm. † HOPKINS Nathaniel P. “Neal” Hopkins Jr., age 87 of Ionia formerly of Saranac passed away October 11, 2022. He was born on January 26, 1935, in Lyons the son of Nathaniel P. and Ruth K. (Mestemaker) Hopkins Sr. Neal attended Lyons High School graduating in 1954. He would go on to marry Doris L. Reeder in 1963 in Lyons.

Neal worked for Mitchell Bentley and would later move on to General Motors as a Metal Finisher where he worked for over 35 years. He loved going to auctions and was an avid hunter and fisherman. He was especially proud of his children and grandchildren.

Surviving is his wife of 59 years, Doris Hopkins of Ionia. Children: Denise Hopkins of Grawn, MI, Brian (Ellen) Hopkins of Barrington, IL, Tammy (Chris) Forney of Canton, MI, Bruce (Heather) Hopkins of Otsego, MI and Jason Hopkins of Dallas, TX. Grandchildren include Justin Czamanske, Emma Hopkins, Matt Hopkins, Jordan Forney, Elizabeth Forney and Hailey Prater. Also surviving is sister-in-law Sharon Brandt of Ionia. He was preceded in death by his parents.

Funeral Services for Neal will be held 1:00 p.m., Saturday October 22, 2022 at Lake Funeral Home in Ionia. A visitation will be from 11:00 AM until time of service at the funeral home. Online condolences may be made at www.lakefuneralhomes.com

† MEYERS On Sunday October 9, 2022, Jacqueline Rae (Chrisman) Meyers, beloved wife, mother, sister, and grandmother went to be with the Lord in her home with family beside her. She was 80 years young, born in Lake City to Ray and Wilda (Fenton) Chrisman. She lived most of her childhood in the city of Ionia, where she graduated with the class of 1961. She married the love of her life, Keith Meyers on August 18, 1961, and moved to Saranac. They later moved with their three sons building their life and farm in Belding. Jackie had the most challenging and difficult job being a farm wife and raising her three sons, she loved every moment of her time with her family. Jackie’s favorite thing in life was spending time with her family and hosting big gatherings. She attended church and was a firm believer that she would one day meet the Lord and live an eternal life. Jackie is preceded in death by her parents Ray and Wilda (Fenton) Chrisman, brother Bob Chris man, brother and sister-in-law Cecil and Marty (Martin) Chrisman, sister Sharon (Chrisman) Meyers, and niece Trisha (Chrisman) Stine. She left behind: her husband Keith Meyers, son Stan and Mary (Gee) Meyers, son Bruce and Jorel (Davis) Meyers, son Richard and Cherlene (Tayong) Meyers, 12 grandchildren, 9 great-grandchildren, sister and brother-in-law Kathy (Chrisman) and Norman Denny, brother-in-law Jeff Meyers, sister-in-law Ginny Chrisman and many sister-in-law and brothers-in-law with many nieces and nephews.

Jackie touched many on her journey through life, loving and nurturing all who came through her door. It is with great sorrow that those left behind will feel her loss deeply but will cherish her deep within their hearts. She is gone but will never be forgotten.

Funeral Services will be held Saturday, October 15, 2022, at Green Corners Baptist Church, Johnson Road, Belding, at 11 am, with Pastor Paul Leslie and Pastor Ken Martin officiating. Visitation Friday, October 14, from 4 – 8 pm at Johnson-Feuerstein Funeral Home, Belding, and one hour before the service at the church. Internment will be at Easton Township Cemetery. Memorials may be given to The Belding Area Community Fund. Envelopes will be available at the funeral home and the church. LAFFERTY Gregory Dean Lafferty age 76 of Orleans passed away October 10, 2022. He was born September 3, 1946 in Ionia the son of Walter and Lenore (Kerhing) Lafferty. Greg went on to honorably serve in the Army during the Vietnam War. He loved all types of vehicles, shooting guns and riding bicycle. Surviving Greg are his children; Debbie (Robert) Hawley of Woodland, Patrick (Jennifer) Lafferty of Sunfield and Brad Lafferty and Jessica Fritz of Ionia. Grandchildren; Tylor Starks, Tayven Cahill, Carlie Cahill, Blair Lafferty and Grant Lafferty. He was preceded in death by his parents and Sister Donna Lafler. Cremation has taken place with Graveside services with Military Honors at Easton Cemetery Thursday, October 20th at 1:00 p.m. with a Celebration of Life and Luncheon to follow at the Ionia Moose Lodge. Shirley Ann Weeks age 80 of Saranac passed away October 7, 2022. She was born July 21, 1942 in Escanaba, Michigan the daughter of Lenni and Evelyn (Lorenson) Kolli. Shirley went to Rapid River High school graduating with the class of 1960. She was born and raised in the Stonington, and would meet her future husband Ron while he was on a hunting trip in the Upper Peninsula. They were married August 17, 1968 together would raise 2 daughters.

She is survived by her daughters Tanya (Joe) Smith of Lake Alfred, Florida and Jana (Andy) Baylis of Alto. Grandchildren; Tamirra (Randy) Hanning, Kirk Wright and fiance’ Angela, Victoria Smith and fiance’ Tom, Caroline Smith, Danielle Smith and Alexandra Baas. 8 great grandchildren. Sister-in-law Bea Bowen.

Shirley was preceded in death by her husband Ron in 2008, her parents, brother Clifford Kolli, brother and sisters in law Fred Bowen, Gladys and Dean McLeod, June and Bob Smith, Crystal Taylor, Joy Raimer and Alberta and Paul Allen and her good friend Jim Schrauben.

Memorial Services for Shirley will be at the Saranac Community Church, Saturday October 15th at 10:00 a.m. with Pastor Tim Gage officiating. A luncheon will follow at St. Anthony’s Catholic Church in Saranac, 6070 David Hwy., Saranac, MI 48881. Less than four weeks remain until Nov. 8 general election

Under four weeks remain until Michigan’s Nov. 8 general election and voters have already cast 155,142 absentee ballots, marking a 171 percent increase compared to four weeks ahead of the 2018 general election. More than 1.6 mil lion absentee ballots have been requested by Michigan voters. A breakdown of absentee ballot numbers by jurisdic tion can be downloaded online.

All regis tered voters can vote by mail with an absentee ballot, vote early in person with an absentee ballot at their local clerk’s office, or at their polling place on Election Day. Michiganders who are eligible to register to vote but have not yet done so can register online through Oct. 24 or in person at their local clerk’s office

through 8 p.m. on Election Day.

Voters can check the status of their absentee application or ballot online at Michigan.gov/Vote or by calling their local city or township election clerk. Vot ers who already received an absentee ballot should sign the back of the envelope and mail it or drop it off at their local clerk’s office or drop box as soon as possible.

ELECTION DAY Tuesday, November 8th Polls open from 7 a.m. to 8 p.m.

Voters can also vote in person at their polling place on Election Day, Nov. 8. Polls will be open from 7 a.m. to 8 p.m. Michiganders can find election information at Mich igan.gov/Vote, including a sample ballot, information about how to use voting equipment, where to find a local drop box, and how to contact their local clerk.

The Keene Township Board adopted a temporary moratorium at their October 11th meeting to not accept any applications for commercial solar energy projects for 6 months to allow the Planning Commission to finish amendments to the commercial solar ener gy zoning ordinance section, to hold a public hearing and to send the recommendation to the Board.

The moratorium ordinance can be viewed in the Township Hall notice box or on the Township website at www.keenetownship.org.

NOTICE IS HEREBY GIVEN, pursuant to Public Act 110 of 2006 and the requirements of the Michigan Department of Natural Resources, that a public hearing will be held by the Village of Muir Planning and Zoning Commission on December 19, 2022 at 6:30 pm.

The purpose of the public hearing is to hear and consider a planning document including the following elements:

• A Master Plan for the Village of Muir, including the elements necessary for the Village to adopted a Zoning Ordinance at a future date.

• A Downtown Plan for the Village of Muir, to focus investment for the redevelopment of Superior Street and other areas of Downtown Muir.

• A Parks and Recreation Plan for the Village of Muir, meeting the requirements of the Michigan Department of Natural Resources.

The Meeting will be held at Muir Village Hall located at 122 W. Superior Street, Muir, Michigan 48860.

Prior to the meeting, a draft of the plan will be available for review at Village Hall and at villageofmuirmi.gov. The draft will be available from October 12 to December 19, a period of 68 days. Thus, the draft availability will exceed the required 63 days for a Master Plan and 30 days for a Parks and Recreation Plan.

Written comments or questions on the proposed plan can be emailed to Village Planning Consultant Chris Khorey at ckhorey@mcka.com until 4:30 p.m. the day of the meeting.

AN ORDINANCE

WHEREAS, the Village of Muir, County of Ionia, State of Michigan (the “Village”), has determined that certain groundwater underlying areas including Village of Muir is currently, or may be in the future, the sole source of the Village's drinking water supply; and

WHEREAS, groundwater aquifers are integrally connected with the surface water, lakes, and streams that constitute significant public health, recreational and economic resources of the Village and surrounding area; and

WHEREAS, Spills and discharges of hazardous substances threaten the quality of the groundwater supplies and other water related resources, posing potential public health and safety hazards and threatening economic losses; and

THEREFORE, the Village has enacted this Groundwater Protection Ordinance to protect existing and potential groundwater supplies, aquifers, and groundwater recharge areas of the Village and to preserve the natural resources of the Village and the surrounding area.

63.1 DEFINITIONS

1. ABANDONED OPERATIONS: Any property that is unoccupied for at least thirty (30) days and to which one or more of the following applies:

a. Is open to casual entry;

b. Has one or more windows boarded;

c. Has utilities disconnected;

d. Is unsafe for occupancy or the general public, or is a visual blight adversely affecting the general welfare of the area;

e. Is under notice for being in violation of Article 5 of the Village of Muir Ordinance.

f. Is the subject of indebtedness to the Village for more than one year;

g. Because of disrepair or lack of maintenance, is in a condition that makes it apparent to the public that the structure is in fact unoccupied. Abandoned operations do not include a property that is actively listed by a licensed real estate broker.

2. AQUIFER: A subsurface water-bearing layer of soil, sand, gravel, or rock that will yield usable quantities of water to a well.

3. CHEMICAL ABSTRACT SERVICE (CAS) NUMBER: This is a unique number for every chemical which indexes information published in “Chemical Abstracts” by the American Chemical Society.

4. CONTAMINATION: An impairment of water quality by hazardous substances, whether or not it affects the potential or intended beneficial use of water.

5. HAZARDOUS SUBSTANCE: A chemical or other material that is or may become injurious to the public health, safety, or welfare, or to the environment. The term "hazardous substance" includes, but is not limited to, any of the following which are stored or generated in quantities greater than 100 kilograms (approximately 220 pounds or 25 gallons) per month, and which require site plan review under provisions of this ordinance.

a. Hazardous Substances as defined in the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) of 1980, Public Law 96.510, 94 State. 2767;

b. Hazardous Waste as defined in Part 111 of the State of Michigan Natural Resources and Environmental Protection Act, 1994 Public Act 451, as amended;

c. Regulated Substance as defined in Part 213 of the State of Michigan Natural Resources and Environmental Protection Act, 1994 Public Act 451, as amended;

d. Hazardous Substance as defined in Part 201 of the State of Michigan Natural Resources and Environmental Protection Act, 1994 Public Act 451, as amended;

e. Polluting Material as defined in Part 5 rules promulgated pursuant to Part 31 of the of the State of Michigan Natural Resources and Environmental Protection Act, 1994 Public Act 451, as amended;

f. Used oil;

g. Raw sanitary sewage;

h. Biohazards; and

i. Radiological materials.

6. POLLUTION INCIDENT PREVENTION PLAN (PIPP): A PIPP includes a polluting material inventory, a site diagram depicting the locations of the polluting materials, emergency response procedures, and secondary containment details. Sites are subject to Michigan’s Part 5 Rules if they store oils and other polluting materials above established threshold management quantities (TMQs), which are:

a. Salt in solid form at quantities of five (5) tons (10,000 pounds) or more.

b. Salt in liquid form at 1,000 gallons or more.

c. Petroleum products in an aboveground storage tank (AST) or container with a capacity of 660 gallons or greater or an aggregate aboveground storage capacity of 1,320 gallons.

d. All other polluting materials specified in Part 5 that are used, stored, or otherwise managed in a discrete outdoor location, with a total storage quantity of 200 kilograms (kg) (440 pounds) or more.

e. All other polluting materials specified in Part 5 that are used, stored, or otherwise maintained at a discrete indoor location, with a total storage quantity of 1,000 kg (2,200 pounds) or more.

7. PROPERLY PLUGGED ABANDONED WELL: A well that has been closed in accordance with regulations and procedures of the Michigan Department of Environmental Quality and the local Health Department. A permit is required to bring a properly plugged abandoned well back into service.

8. PROPERTY OWNER: A person, public corporation, authority, or a political subdivision of the State or a combination of any of these entities, that holds an ownership interest in land, whether recorded or not. An ownership interest means ownership by one person or by different private entities if the land is owned in joint interest or by members of the same immediate family.

9. SECONDARY CONTAINMENT: A second tank, catchment pit, pipe, or vessel that limits and contains liquid or chemical leaking or leaching from a primary containment area; monitoring and recovery are required.

10. SPILL PREVENTION CONTROL AND COUNTERMEASURE (SPCC) PLAN: As detailed in 40 CFR Part 112, sites are subject to the SPCC rules if (1) they store either more than 1,320 gallons of petroleum products aboveground and (2) they present a reasonable risk to a navigable water of the United States (including via storm water and groundwater). An SPCC Plan details site oil storage, spill potential, and emergency response and notification procedures. The SPCC Plan is required to be certified by a registered Professional Engineer.

11. STORM WATER POLLUTION PREVENTION PLAN (SWPPP): As detailed in 40 CFR Part 122, sites that are required to have a storm water permit are also required to have SWPPPs that detail hazardous substances exposed to storm water as well as controls to prevent releases.

12. UNDERGROUND STORAGE TANK (UST): A tank or combination of tanks, including underground pipes connected to the tank or tanks, which is, was, or may have been used to contain an accumulation of hazardous substances, as defined in Part 211 of the State of Michigan Natural Resources and Environmental Protection Act, 1994 Public Act 451, as amended.

13. UNPLUGGED ABANDONED WELL: A well which has not been used for one year or more.

14. WASTE OIL: Any oil that has been (a) refined from crude oil, (b) used, or, as a result of such use, (c) contaminated by chemical impurities.

15. WELL: As defined in the Michigan Water Well Construction and Pump Installation Code, Part 127, Act 368 of the Public Acts of 1978, as amended, and rules; or a permanent or temporary opening in the surface of the earth for the purpose of removing water, testing water quality, measuring water characteristics, measuring liquid levels, oil and gas exploration or production, waste disposal, dewatering purposes, or for geothermal heat exchange purposes, or for a cistern of a depth of 4 feet or more and with a top width of 12 inches or more.

16. WELLHEAD PROTECTION AREA: The area which has been approved by the EGLE or succeeding agency in accordance with the State of Michigan Wellhead Protection Program, which represents the surface and subsurface area surrounding a water well or well field, which supplies a public water system, and through which contaminants are reasonably likely to move toward and reach the water well or well field within a ten year time of travel.

63.2 APPLICABILITY

1. USES SUBJECT TO SITE PLAN REVIEW: Except as provided in Section 63.6, “EXEMPTIONS AND WAIVERS”. This ordinance applies to all building permit re quests.

63.3 PROHIBITIONS WITHIN TEN (10) YEAR TIME-OF-TRAVEL (TOT) WELLHEAD PROTECTION AREA

1. For any parcel of land that has a portion within a ten-year Wellhead Protection Area, the following are prohibited at any location on the parcel:

a. Operations of a scrap and recycling yard.

b. Operations of a sanitary/solid waste landfill.

c. Use of oil, waste oil, or similar liquid petroleum-type products for dust suppression. The use of plant-based oil, such as soybean oil, is not prohibited.

d. Installation of a private well if, in the determination of the Village Council upon recommendation of the Village’s Water Operator, public water service is reasonably available.

Excavation, extraction, or mining of sand, gravel, bedrock, or any other type of earth if a permit or site plan review is required.

Unplugged abandoned wells.

The process of fracking or otherwise drilling for natural gas or petroleum, whether for exploration or production.

Drilling, direct-push and other earth penetration beyond 15 feet deep from surface grade unless

borehole(s) are sealed with grout, or with soil material exhibiting lower hydraulic permeability than the native soil, to within 2 feet of surface grade.

63.4 SITE PLAN REVIEW

1. SITE PLAN REVIEW PROCEDURES: Applicable projects under this Ordinance shall include:

a. Existing and proposed deed restrictions, if any.

b. Location and outline of all existing septic tanks and drain fields.

streams, lakes, ponds, and wetlands.

b. Storm water detention, retention, transport, and drainage facilities shall, insomuch as feasible, be designed to use or enhance the natural storm water system on-site, including the storage and filtering capacity of wetlands, watercourses, and water bodies, and/or the infiltration capability of the natural landscape. Storm water facilities shall be designed so as not to cause flooding or the potential for pollution of surface or groundwater, on-site or off-site.

c. Sites that at any time use, store or generate hazardous substances shall be designed to prevent spills and unpermitted discharges to air, surface of the ground, groundwater, lakes, streams, rivers or wetlands.

d. If required by state or federal law, properties using hazardous substances are required to have a Spill Prevention Control and Countermeasure (SPCC) Plan, a Pollution Incident Prevention Plan (PIPP), and/or a Storm Water Pollution Prevention Plan (SWPP).

e. General-purpose floor drains that discharge to groundwater are generally prohibited.

f. Hazardous substances stored on the site before, during or after site construction shall be stored in a location and manner designed to prevent spills and unpermitted discharges to air, surface of the ground, groundwater, lakes, streams, rivers, or wetlands. Secondary containment facilities shall be provided for above ground storage of hazardous substances in accordance with state and federal requirements. Aboveground secondary containment facilities shall be designed and constructed so that the potentially polluting material cannot escape from the unit by gravity through sewers, drains, or other means, directly or indirectly, into a sewer system, or into the waters of the State (including groundwater).

g. Secondary containment facilities shall be provided for aboveground storage of hazardous substances in accordance with state and federal requirements. Aboveground secondary containment facilities shall be designed and constructed so that the potentially polluting material cannot escape from the unit by gravity through sewers, drains, or other means, directly or indirectly into a sewer system, or into the waters of the State (including groundwater).

h. Unplugged abandoned wells and cisterns shall be plugged in accordance with regulations and procedures of the State of Michigan and the County Health Department.

i. Completion of the Village of Muir Environmental Permit Checklist.

63.6 EXEMPTIONS AND WAIVERS

1. Village parcels inside or outside of the Wellhead Protection Area that cannot obtain public water with a pressure of at least 35 lbs are excluded from the Section 63.3 Prohibition of a private well.

2. A limited exclusion from this ordinance is hereby authorized as follows:

a. The site plan review criteria of Section 63.5 do not apply to hazardous substances packaged for personal or household use or present in the same form and concentration as a product packaged for use by the general public. The total excluded substances containing hazardous substances may not exceed the lesser of two hundred (200) gallons or one thousand (1000) pounds at any time.

b. The site plan review criteria of Section 63.5 do not apply to products held in containers with a volume of less than 40 gallons and packaged for retail use.

3. Residential family dwellings proposed for development outside of the “DESIGNATED” wellhead protection areas are exempt from the site plan review criteria of Section 63.5.

63.7 ABANDONED OPERATIONS

1. This section applies to residences, businesses or other operations. Those who own or control abandoned operations shall do the following:

a. Within seven (7) days of becoming an abandoned operation, take such steps as necessary to secure the site such that vandals and all other persons cannot gain access to the hazardous substances.

b. Within thirty (30) days of becoming inactive, provide to the Village and the Fire Department a document that identifies the site, the date of inactivity, the haz ardous substances that exist on site, and the name, address, and telephone number of both the owner and the person in control of the site.

c. Within six (6) months of becoming inactive, remove all hazardous substances from the site. This does not include those substances used for heating, cool ing, and/or electrical lighting or systems.

63.8 ENFORCEMENT

a. Any person violating any provision of this Ordinance shall be deemed responsible for a civil infraction, and upon an admission of responsibility or a finding of responsibility, shall be subject to payment of a civil fine of not less than $50.00 or more than $500.00, plus costs and other sanctions, including but not limited to injunctive relief, for each infraction.

b. Repeat offenses shall be subject to increased fines in accordance with this section.

c. The increased fine for a repeat offense under this section shall be as follows: 1. The fine for any offense which is a first repeat offense shall be no less than $75.00 or more than $500.00, plus costs and other sanctions; and, 2. The fine for any offense which is a second repeat offense or any subsequent repeat offense shall be no less than $100.00 or more than $500.00, plus costs and sanctions.

63.9 EXCEPTION/ALTERNATIVE MEANS OF COMPLIANCE

1. The Village may allow exception from the strict enforcement of the ordinance if an owner of property believes the requirements of the Ground Water Protection ordinance pose an unreasonable burden and if the owner submits in writing to the Village alternative means that comply with the intent of the provisions of the or dinance. The material, method or work offered must be, for the purpose intended, at least the equivalent of that prescribed in this ordinance in effectiveness for the protection of ground water resources.

63.10 INJUNCTIVE RELIEF

1. If a person has violated or continues to violate the provisions of this Ordinance, the Village may petition the appropriate court for injunctive relief restraining the person from activities that would create further violations or compelling the person to perform necessary abatement or remediation.

63.11 APPEALS

Any person who has been cited for a violation of this chapter or has been ordered to take action to comply with the provisions of this chapter may appeal in writing to the village council of the Village of Muir not later than 30 days after the action or decision being appealed. Such appeal shall identify the matter being appealed and the basis for the appeal. The village council shall consider the appeal and decide whereby the action being appealed is affirmed, rejected or modified. In considering any such appeal, the village council may consider the recommendations of the authorized enforcement agency and the comments of other persons having knowledge or expertise regarding the matter. In considering any such appeal, the village council may grant a temporary variance from the terms of this chapter so as to provide relief, in whole or in part, from the action being appealed, but only upon finding that the following requirements are satisfied:

a. The application of the ordinance provisions being appealed will present or cause unnecessary hardship for the property or premises owner appealing; provided, however, that unnecessary hardship shall not include the need for a property or premises owner to incur additional reasonable expenses in order to comply with the part; and, b. The granting of the relief requested will not prevent accomplishment of the goals and purposes of this chapter, nor result in less effective management of groundwater.

In order that the provisions of this article may be reasonably applied and substantial justice done in instances where unnecessary hardship would result from carrying out the strict letter of these sections, the village zoning board of appeals shall consider appeals from the decision of the village council and to determine, in particular cases, whether any deviation from strict enforcement will violate the intent of this article or jeopardize the public health or safety or environment.

Appeals from orders of the village council may be made at the zoning board of appeals of the Village of Muir, within 30 days from the date of any citation, order, charge, fee, surcharge, from the date of any citation, order, charge, fee, surcharge, penalty or other action. The appellant shall file a notice of appeal with the zoning board of appeals, specifying the grounds therefor. Prior to a hearing, the village council shall transmit to the zoning board of appeals a summary report of all previous action taken. The zoning board of appeals may, at its discretion, call upon the village council to explain the action. The final disposition of the appeal shall be in the form of a resolution, either reversing, modifying, or affirming, in whole or in part, the appealed decision or determination.

The decision of the zoning board of appeals shall be final, except that the board or the members thereof may be required, under proper mandamus proceedings, to show cause why certain actions were taken or decisions rendered.

All charges for service, penalties, fees, or surcharges outstanding during any appeal process shall be due and payable to the village. Upon resolution of any appeal, the village shall adjust such amounts accordingly.

If an appeal is not demanded within the periods specified in this section, the administrative action shall be deemed final. In the event of an appeal, action shall be suspended until a final determination has been made, except for immediate cease and desist orders or any emergency or judicial action.

Appeals from determinations of zoning board of appeals may be made to the circuit court for the county as provided by law. The appeals shall be governed procedurally by the Administrative Procedures Act of 1969 (MCL 24.201 et seq.). All findings of fact, if supported by the evidence, made by the board shall be conclusive upon the court. "

63.12 SEVERABILITY

1. If any provision, paragraph, work, section, or article of the ordinance from which this article is derived is invalidated by any court of competent jurisdiction, the remaining provisions, paragraphs, words, sections, and chapters shall not be affected and shall continue in full force and effect.

Section 14. Effective Date

This ordinance must be published and recorded as provided in the Village Charter and takes effect on the date of publication, but not less than twenty (20) days after its adoption by the Village Council.
