WARRANTY AGAINST DEFECTS
Hustler Equipment Limited and its successors and assigns (“the Seller”) provides the following limited warranty against defects to: (“the Customer”) [Insert Customer’s Name In Box Above]
1 WHAT THIS WARRANTY RELATES TO
1.1 This warranty relates to any defect in any workmanship which becomes apparent and is reported to the Seller in accordance with clause 4.1. Manufacturing defects include structural failures and defective fabrication — faults that arise from how the machine was built, not from how it has been used.
1.2 The warranty shall not cover any defect or damage caused or partly caused by or arising through:
(i) the Customer failing to properly maintain or store any Goods; or
(ii) the Customer using the Goods for any purpose other than that for which they were designed unless specifically approved by the manufacturer; or
(iii) the Customer continuing use after any defect became apparent to a reasonably prudent operator; and
(iv) the Customer failing to follow any instructions or guidelines provided by the Seller;
(v) fitting, installation, repairs, modification or alteration carried out by an unauthorised agent without the Seller’s consent;
(vi) fair wear and tear (including paint damage), any accident, or act of God;
(vii) travel expenses.
(b) The Seller shall not be liable for any delay in replacing or remedying the workmanship or in assessing the Customer’s claim.
WHAT THE SELLER WILL DO TO HONOR THE WARRANTY
2.1 The Seller will repair any defect but is limited to supply of replacement parts or repair of faulty components damaged as a result of faulty workmanship. It does not extend to consequential loss or damage or loss to other property or persons.
2.2 Any works in addition to fixing the Defect, including disassembling and reassembling required to assess or rectify the defect, are the responsibility of the Customer.
3 WHAT THE CUSTOMER MUST DO TO CLAIM
3.1 To claim the benefit of the warranty, the Customer must:
(a) present the defective Goods to the Seller for inspection, or otherwise provide evidence of the claimed Defect; and (b) provide evidence of proof of purchase upon request.
3.2 At no time will a warranty be transferrable. It is made only to the original Customer who must produce the original sales invoice when submitting a claim.
3.3 The defective product must be returned to the accredited dealership for assessment and repair. On-farm assessments will incur a travel charge not covered by Hustler Equipment Ltd.
3.4 Claims may be made in person or sent to the address listed on this form, including the particulars required under 3.1(a) and 3.1(b).
3.5 The appropriate form for making a claim for warranty is attached and must be used whether the claim is being made in person or emailed to the address on this form.
3.6 All warranty claims are dealt with during normal business hours, Monday–Friday. Urgent out-of-hours services may attract additional labour costs (penalty rates apply), unless otherwise agreed.
3.7 The end user will need to contact the Accredited Dealer to complete an annual maintenance check and have a technician sign the maintenance log.
4 DURATION OF WARRANTY
4.1 The expressed warranty will Start from the date the Customer takes delivery of the Goods in accordance with clause 6 of the Seller’s Terms and Conditions of Trade, or at the time of purchase, whichever is agreed upon.
4.2 If a Defect does not materialise prior to the warranty end date, the Seller will have no liability to the Customer under this Warranty Against Defects and the Customer releases the Seller from all claims for loss or damage in any way connected with the Goods/Services from that date.
4.3 The standard warranty period is 5 years for structural manufacturing defects (including structural failures and defective fabrication). Selected components are covered for 2 years from the original retail purchase date. Paint and finish are covered for 1 year from the original retail purchase date (normal wear-and-tear from general use is not covered). All periods commence from the date of delivery or purchase, whichever is agreed upon.
5 RESPONSIBILITY FOR COSTS OF CLAIM
5.1 The Seller is responsible for the costs directly associated with repairing the Defect only.
5.2 Any works required under clause 2.2, in addition to those directly related to rectification of a Defect, will be at the cost of the Customer.
6 RIGHTS AT LAW
6.1 The benefits given to the Customer under this warranty are in addition to other rights and remedies of the Customer at law in relation to the Goods/Services.
6.2 The Seller’s Goods/Services come with guarantees that cannot be excluded under Consumer Law. The Customer is entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. The Customer is also entitled to have the Goods/Services repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
