I’ll Sleep When I’m Dead Mike Harnett

President, Solaris Fatigue Management & Director of Operations for WorkSMART Ergonomics

Twice you've dozed off at the wheel, only to wake up as you're entering the ditch. You manage only 6 hours of sleep, if you're lucky. You have the energy of a slug, you're arguing more and more with your family, and there's a small nuclear reaction bubbling up in your stomach again. It never used to be this bad... what's going on? When our body and mind are out of balance, chaos ensues and results in damaging fatigue. Come and hear the latest advances in fatigue science and what you can do to put your world back in balance and regain your sanity. Mike Harnett specializes in optimizing worker health, safety and performance. She has over 25 years of experience consulting with various government agencies including NASA, the Canadian Standards Association, and Transportation Safety Boards in both the US and Canada. She has assisted with both ergonomic and fatigue management program development for a variety of organizations including nuclear, airline, oil & gas, municipal, health care, first responder, and film & entertainment industries. With a background in human factors and sleep neurobiology, Ms. Hartnett is recognized for her ability to take complex subjects and deliver their content in a simplified and innovative manner for all to understand. An award-winning speaker, she is known for her sense of humor and is an internationally sought-after presenter and educator.

Personal Cybersecurity Joshua Crumbaugh

Cybersecurity Expert & Chief Hacker, PeopleSec

Joshua Crumbaugh is one of the world’s leading security awareness experts and internationally renowned cybersecurity speaker. He is the developer of the Human Security Assurance Maturity Model (HumanSAMM) and Chief Hacker at PeopleSec. He is also an expert social engineer who has talked his way into bank vaults, Fortune 500 data centers, corporate offices, restricted areas of casinos and more. Mr. Crumbaugh’s presentation will review a series of real-life stories about cybercriminals and online predators as well as lessons learned and what could have been done to avoid these scenarios in the first place. The internet is an amazing resource, but just like driving a car, it can be very dangerous without appropriate precautions. Attendees will also learn non-technical and simple ways to protect themselves against cyber attacks.

Also, the Board of Governors are responsible for the review of the performance and duties of the Executive Director and make recommendations to the Executive Council regarding the Executive Director. The Board of Governors carry out review and guidance functions relating to budgetary matters in accordance with the Bylaws. For a full review of the duties and responsibility of the Board of Governors, please review Article 10.04 of the Bylaws. Rati onale: • The new language is intended to expand criteria for consideration of individuals who have not served on Executive Committee positions (such as President, VicePresident, Secretary, Treasurer), but who have served on Executive Council and other standing Committees of Executive Council. • The current language prevents other individuals (who may have served on Executive Council and standing committees of Executive Council) from being considered for

11

appointment to the Board of Governors, and who may be excellent individuals to serve on the Board of Governors, because of their experiences on Executive Council and standing committees. • The Board of Governors is a very important governance body and requires well rounded, experienced individuals who are willing to commit to the work of the Union and specifically, the Board of Governors. • The new language is an additional option to the current language for the Executive Council to consider for Board of Governors appointments. • Additional new language in (c) simply allows Executive Council to consider current members of the Executive Council, or those individuals not currently on Executive Council, to the Board of Governors.

HSAS MEMBERSHIP

report to annual convention 2018-19 The Health Sciences Association of Saskatchewan (HSAS) is a union representing more than 4,000 Health Care Professionals, who work within the Saskatchewan Health Authority, several privately-owned ambulance services in Saskatchewan and at the Canadian Blood Services in Regina. We were founded in 1972, by a group of dedicated professionals who believed that the unique interests of the varied and specialized professions would be best represented by a separate, independent union.

PRESIDENT’S

report to annual convention 2018-19 It has been an honor to serve as your President over the past year and a privilege to work with the dedicated members of your Executive Council, the Committees of Executive Council and the HSAS staff. Please take time to review the reports of the work completed by your Union in the 2018-2019 fiscal year. This year, your union continued to face the challenges of the 12 regional health authorities move to a single health authority. At the beginning of the year we learned that the Health Authority was moving to a single payroll system and also, moving to an electronic time card system. We anticipate that this initiative will be an expensive one and not without implementation hurdles. The Employer has indicated that the electronic time card system is to be fully implemented in the spring of 2020. With continued demands for Member services and the ongoing challenges of the transition to a single health authority, HSAS faced the need for an expansion of those services and resources. Over the years, Executive Council has relied on input from the membership and Labour Relations staff when considering the current capacity for delivering services and when planning for future operations. This input has been critical. During Executive Council’s annual strategic planning, areas of improvement were identified as needed and necessary. These improvements would ensure that HSAS could run at full capacity in the delivery of service to the Membership, including the provision of Labour Relations staff resources necessary to serve the Membership in a responsible and principled way. Increased resources needed were identified in the areas of Records Management, Communications, Finance and Payroll, Market Supplement Program support, Benefits and Labour Relations. New staff positions were created to meet the challenges of the current state and for future growth and expansion. Our Executive Director has worked diligently in the planning and execution of services, reorganization and reallocation of the resources. There are number of new staff joining HSAS this year, and this promises to be a significant milestone in the history of HSAS as we approach 50 years as a health care union, now representing over 4,000 Members province-wide. We continue to foster relationships with other public sector unions and attend meetings of mutual concern. In the past year we attended meetings with representatives from public sector unions, Faculty Associations of both Saskatchewan Universities, Saskatchewan Teachers’ Federation (STF), as well as health care unions. Meetings focused on information sharing with respect to bargaining and the state of bargaining within the province. The meetings were informative and provided a greater understanding of what other unions were facing in the process of negotiating new collective bargaining agreements. Community engagement has once again been a prominent theme for HSAS this year. Many HSAS professionals see the direct and indirect consequences of a lack of appropriate nutrition firsthand in their daily work, HSAS continues to support and promote the critical work which food banks fulfill. HSAS continues to support the Saskatoon and Regina Food Banks and Learning Centres as part of its community engagement program.

36

We are aware that HSAS Members also contribute as individuals in community engagement within their local community. The Community Engagement Volunteer Fund allows individual HSAS Members who are involved with a recognized charitable or humanitarian event, to apply for funding for that event. Some HSAS members across the province have already applied to the Fund for their respective initiatives. Continuing education is valued by all of the members in HSAS. In response to ongoing and increased demand for education dollars, Executive Council approved the 2019-2020 budget which will see an increase in the allocation to the Continuing Education fund. On behalf of HSAS members, I have addressed issues of concern in health care in Saskatchewan. This has occurred through media such as radio and television interviews, as well as in local newspapers. When opportunities arise, meetings occur with Ministry officials and politicians to discuss issues pertaining to health care and working conditions in our workplaces. Our communications/media strategies are important, and you will learn more about our activities through the Communications Committee report. We must continue to invest and dedicate our energy and resources to a strong Communications/Media plan. This is an important aspect of a union as it plays an integral part in the campaigning and advocating for our Members and health care services provided in this province. HSAS also participated in external regional/provincial committees with representation from Executive Council. Maureen Kraemer, HSAS Vice-President and Social Worker, represented HSAS on the provincial Employee Family Assistance Plan (EFAP) Committee, and Bill Fischer, Advanced Care Paramedic, represented HSAS on the Saskatchewan Association of Safe Workplaces in Health (SASWH) Board. The Saskatchewan Health Authority regularly requests for input on job descriptions/postings which our Executive Council members are involved in reviewing and providing input to the Labour Relations staff. This has been positive for the Labour Relations staff to understand and verify the content included in the job description/posting. The Occupational Health and Safety (OH&S) Committee is a standing committee, and plays a very important role in the work of our union. This Committee’s work is to monitor and track the many OH&S committees across the province, and to communicate and serve as a resource to HSAS Members serving on local OH&S committees. Members are encouraged to get involved in their local OH&S Committee. It is very important for Members to be actively involved at their worksite and on OH&S Committees as HSAS representatives. Since 2003, HSAS has been a member of CHPS (Canadian Health Professionals Secretariat). CHPS was established by the National Union of Public and General Employees (NUPGE) to meet the challenges Canadian Health Professionals face. The Secretariat has three (3) main goals: • To raise the profile of health professionals across the country. • To deal with issues of public policy that impact health professionals. • To enhance gains in collective bargaining by sharing information, identifying collective strengths and developing common strategies and tactics. CHPS meetings are held twice yearly. HSAS is represented at these meetings by the President, another elected representative and/or the Executive Director. Unions from across the country attend and each prepares and presents a report outlining their organization’s activities, including bargaining, communication, labour relations and political climate. These reports offer an excellent opportunity for information sharing and problem solving.

37

Since 2012, I have served on the SHEPP Union Partner Committee, representing HSAS. Other Union Partner Committee members include representatives from SUN, SEIU, CUPE, and SGEU. This past year, I was appointed by the Union Partner Committee Members to chair this Committee. This past year, I also chaired the HSAS Governance Committee. The Governance Committee has presented to Executive Council a bylaw amendment, to consider expansion of the eligibility criteria for appointment to the HSAS Board of Governors. The Executive Council reviewed and approved the bylaw amendment to be presented to the Delegates at this AGM. The Executive Council is recommending acceptance of this important bylaw amendment. I wish to welcome the newly elected members of Executive Council. These individuals have been elected to serve the HSAS Membership. They will assume the responsibility of representing members of their professional group or composite group and will participate fully in the decisionmaking process of HSAS – as advocates for the Saskatchewan public and for the specialized health care services our members deliver on a daily basis. I wish to thank and acknowledge the dedication and hard work of the outgoing and ongoing Executive Council members, Committee members, and staff. They have worked diligently, serving the membership of HSAS. Going forward, we must continue to embrace opportunity when it arises and meet the challenges of the future head on as HSAS has done in the past, and will continue to do so, into the future. Thank you for your support. Respectfully submitted, Karen Wasylenko HSAS President & Speech Language Pathologist Union Region 7 - Saskatoon

EXECUTIVE DIRECTOR’S

report to annual convention 2018-19 The Executive Director report provides an overview of topics and issues related to the operational or labour relations aspect of the organization that have transpired during the September 1, 2018 to August 31st, 2019 fiscal year. Bargaining Our main Collective Agreement with SAHO expired March 31, 2018. Information pertaining to the bargaining of this Collective Agreement is covered within the Negotiating Committee report. The bargaining activity within our private groups over the past year is in this report. Canadian Blood Services Bargaining has taken place on the following dates, January 15, 16, 17 and July 8, 9, 2019. There are still some outstanding issues on the written proposals and there has been no movement from the Employer with regards to monetary issues. Crestvue Ambulance Services LTD. Staff meeting took place to discuss a bargaining agenda on June 25, 2019. The bargaining survey was sent out to the membership on July 9, 2019 and the results were returned to the office by August 9, 2019. The membership will be met with again at the end of September to finalize a bargaining agenda as dates with the Employer have been set for October 10 and 11, 2019. La Ronge EMS A new Collective Agreement was ratified by the membership and signed in October 2018. North-East EMS Bargaining took place on December 6, 2018 and again on March 19, 2019. The Employer then utilized a clause in the Saskatchewan Employment Act to force a vote with the membership on their last offer presented. The voting took place in July 2019 with the results being tabulated on August 6, 2019. The members rejected the Employer’s offer allowing the LRO assigned to the file to request that the Employer return to the table to negotiate. Labour Issues My optimism that labour relations issues would become easier to manage within a single entity as opposed to twelve is slowly beginning to wane. The management structure within the new SHA is still a work in progress almost two years into this venture and has made minimal progress in streamlining any practices on the labour relations front. The reality is that although a new name is in place (SHA), the Employer is still operating under the umbrella of the old twelve “kingdoms” format. This has been frustrating and difficult to navigate for our Labour Relations Officers due to having to deal with similar issues multiple times depending on whether the “former” regions wish to accept the decisions or settlements that have taken place outside of their own region on a given topic or take a second kick at the can. The new “Business partner” model which has been rolled out in Saskatoon and then slowly across the province has been met with numerous problems. The employer is now using these individuals

39

who have limited experience in labour relations to deal with many of our membership labour issues. For the most part, the “Business partners” are being looked at by the Employer as a jack of all trades when it comes to providing human resources servicing. This does not bode well for our members or LROs when dealing with Collective Agreement related questions or issues. As an organization, we emphasized at numerous meetings that this new model would create much more work for both parties and it certainly has with regards to the amount of grievances we have needed to file over the course of this year. The other major SHA project coming down the road is the world-changing Administrative Information Management System or as it is being touted “AIMS”. Most of you have undoubtedly spotted the fancy new laminated flyers peppered throughout many of our workplaces featuring the different aspects of the “AIMS” system that will apparently make our members’ lives easier. HSAS has not taken a sip of that Kool-Aid to date and numerous questions have been brought forward to the Employer concerning this new system that, for the most part, seems to be nothing more than a glorified punch clock. We will continue to question this project as we move forward into the new year. Finally, as an update, last year the Ministry had announced that SAHO would cease to exist and be absorbed into the SHA. However, in a meeting held in July we were informed that SAHO would continue to exist for at least another year with the goal of stabilizing the bargaining that is currently taking place. Grievances & Arbitration Our tracking of grievances continues to be a vital part of our Labour Relations strategy. As can be seen in the chart it is quite evident that we are moving in the wrong direction with regards to overall grievances being filed. This can easily be attributed to the lack of any sort of clear direction on the part of the Employer when dealing with labour issues within the SHA to date. Date 2015 2016 2017 2018 2019 (9 months)

Grievances 53 63 69 106 90

Active 6 5 18 134 155

Arbitrations 1 0 11 51 74

Settled 47 58 51 77 34

The most notable arbitration victory this year was our grievance concerning “Field Hours”. The Employer was of the position that Employees deemed to be “Field Hours” must work defined core hours and would be limited in their ability to have flexibility to govern their own hours. Based on the language in our Collective Agreement being quite clear regarding field hours, HSAS did not agree with the Employer’s interpretation at all and filed a grievance on the issue. Below is an excerpt of the written decision on the file from Arbitrator Allen Ponak: “Field hours employees are governed by their own specific provision, article 15.01C. These employees work (if full time) 224 hours in a six week cycle. Within this cycle, the contract states that “an employee will have flexibility to govern her hours of work .... to meet client and essential program needs”. The wording confers a right on the employee, using imperative language, to flexibly govern her hours of work. The word “govern” connotes a degree of control attached to the person entitled to do the governing, in this case the field hours employee. According to the

40

Merriam-Webster dictionary, synonyms of “govern” include “control”, “direct” and “determine”. The Free Legal Dictionary defines “govern” to include “control”, and “exert authority”. The wording in article 15.01C does not include the need for pre-approval from management, mutual agreement between the employee and her supervisor, or even advance notification of management. In contrast, use of time off in lieu of overtime (TIL) under article 15.05 requires mutual agreement between the employee and management. There is no such requirement in article 15.01C, either expressly or implicitly, suggesting none was intended. It is the Board’s conclusion that the right to flexibly govern working hours is conferred unambiguously and exclusively on employees who hold field hours positions.” Staff Updates A few changes have taken place at HSAS over the past fiscal year. On the unionized staff front there are three new full-time LRO positions, a new full-time Membership Records Coordinator position and a new full-time Administrative Assistant position. The Membership Records Coordinator position was taken by Kelly Sluth, who previously held a .5 position as an Administrative Assistant in our Regina Office, which was then converted into the full-time Admin position outlined above. Robyn Selinger was the successful candidate chosen to fill this full-time Administrative Assistant position working out of the Regina office. Two full-time LRO positions were created for our Regina office and one full-time LRO position was created for our Saskatoon office, which will bring our total to eight LROs (four in Regina & four in Saskatoon). So far, one of the Regina LRO positions has been filled and that successful candidate was Braden White. The two remaining LRO positions are currently in the posting/interview process. Our out of scope staffing complement has also grown by one full-time position. A new Communications/Membership Benefits Manager position was created in July of this year and the successful candidate for this position was Natalie Horejda, who has also held the positions of Board of Governor, President, and Chair of Communications throughout her years of service within HSAS. In closing, I would like to thank the Executive Council and Board of Governors for supporting me in the position of Executive Director for the organization over the past year. As always, I look forward to working with the elected representatives and HSAS staff to ensure that our members are provided with the best possible service when contacting their union. Cheers! Respectfully submitted, Dean Job HSAS Executive Director

The Governance Committee met twice in the 2018-2019 fiscal year. The mandate of the Governance Committee is to assist the Executive Council in all matters pertaining to the HSAS Constitution and Bylaws, and resolutions. The Governance Committee reviewed the Terms of References for all Committees, and recommended the use of a standardized format for Terms of Reference documentation. The format of the template would include the composition of Committees, Terms of Membership, Duties and Responsibilities of Committees, and Role of Committee Chairs. In addition, the Governance Committee recommended a policy on Information Management to ensure safeguarding and confidentiality of sensitive information. For example, all committee members serving on HSAS standing committees will be provided a HSAS email account to receive and share information related to committee work, avoiding the use of personal emails. A draft bylaw amendment regarding eligibility criteria for appointment to the Board of Governors was presented to and approved by Executive Council, and the Board of Governors. The Board of Governor appointments are made by the Executive Council, according to Article 10 of the HSAS Constitution and Bylaws. The approved amendment allows for the consideration of candidates for appointment to the Board of Governors who have a well-rounded background and experience on the Executive Council and extensive experience on standing committees of HSAS. These are 43

candidates who may not have served on Executive Committee as one of the Executive Committee positions of President, Vice-President, Secretary and /or Treasurer. The appointments to the Board of Governors includes a nomination and election process by the Executive Council. The Bylaw Amendment is being presented to the Delegates at this Annual General Meeting for consideration, and approval is recommended. Internally, the Committee works to ensure that the membership of HSAS is provided with accurate and timely information and externally, the Committee works to ensure that the public, the media and other stakeholders are made aware of the concerns of the HSAS membership. Since the launch of the current HSAS website, the Communications Committee has continued to evolve the website into a more functional and meaningful tool and source of information for all HSAS members, and visitors to the site. Through analytics, it continues to be confirmed that the HSAS/SAHO collective agreement is a frequently searched page. Last year, resources were allocated to improve the ease of use of that collective agreement- specifically the search functions. This year, an initiative was undertaken to improve the functionality of the other collective agreements which HSAS has negotiated on behalf of members, with the completion anticipated in the 20192020 fiscal year. To increase public awareness, the Communications Committee has continued to build upon the Blue/Green branding campaign. This included profession specific advertisement placement on public transit buses in Regina, Saskatoon, and Moose Jaw. Static and electronic ‘boards’ found within public buildings around the province also showcased HSAS professions. All of the profession

49

‘posters’ can be found on the HSAS website “Look for Us” section under News and Media. The television commercial profession awareness campaign was launched in late fall 2017 with the production of four profession-focused commercials. In the 2018-2019 fiscal year, 4 new professionfocused television commercials were produced. They highlighted Assessor Coordinators, Public Health Inspectors, Dietitians, Pharmacists, and Occupational Therapists. The commercials have been shared on Facebook, YouTube, movie theatre pre-shows, and on the HSAS website. Communications also trialed a new Public awareness initiative in this fiscal year. Static billboards were added to the overall communication strategy. Nine communities across the province displayed the HSAS.ca logo for a one-month duration. In recent years, HSAS members had identified the need for new members of HSAS to make a connection with their union soon after their hire within healthcare. As reported in previous years, training sessions for new member orientators were held in 2013, 2014, 2016, and 2018 for those member volunteers from several union regions. An additional training session was held in May of 2019. Now, many new members are welcomed to HSAS at their union region orientation with a structured and member-delivered orientation. The information they receive assists in understanding their rights under the HSAS Collective Agreement and provides them with critical contact information.

HSAS continues to use a non-work email system to communicate directly with the membership, and social media, such as Facebook, to communicate HSAS messaging to a mix of members, public, government and media. Connecting directly with the membership on a consistent basis assists with the successful delivery of pertinent collective bargaining updates, important announcements, promotion of HSAS hosted events, such as the Annual Convention. An email delivered eBulletin has provided another vehicle for providing relevant and current information to HSAS membership. In the 2018-2019 fiscal year, 3 eBulletins were produced and distributed to the membership as well as numerous bargaining updates. Timeliness and quality of information will remain critical factors in the future delivery of information to our members. In closing, I would like to thank all members of the Communications Committee for their contribution and work over the 2018-2019 fiscal year. Respectfully submitted, Natalie Horejda HSAS Communications Committee Chair

OCCUPATIONAL HEALTH & SAFETY committee report 2018-19 OCCUPATIONAL HEALTH & SAFETY COMMITTEE MEMBERS Bill Fischer, Committee Chair HSAS Executive Council, Advanced Care Paramedic, Union Region 11 - Regina Krishna Vegunta HSAS Executive Council, Physical Therapist, Union Region 11 - Regina Haley Oshowy HSAS Executive Council, Dietitian, Union Region 10 - Moose Jaw In the 2018-2019 fiscal year, the OH&S Committee focused on determining the state of the OH&S as it pertains to HSAS members in the SHA. Early in the year, HSAS contacted the SHA for a list of OH&S committees in the province. The list we received was incomplete and out of date. A different approach was tried and HSAS requested a list of all HSAS members by work site. Obtaining this information would allow HSAS to compile a database of members, their worksites and OH&S Committees at those worksites. Completion of this initiative would allow HSAS to ensure that all members are represented by an OH&S committee, and that all worksites have appropriate committees in place. The SHA agreed with this request and instructed managers to comply with our request. We did receive a few lists in July but certainly have not received all of the lists, as of this writing. In addition to ensuring representation, the Committee has developed and distributed a process to be followed by the SHA when worksites require HSAS representation on OH&S committees due to vacancies or establishment of a new worksite OH&S Committee. The process includes how to properly recruit to those worksites and the role HSAS plays in the process as determined by the OH&S government regulations. OH&S regulations require that the Union is involved and that the Union’s own policies on the selection and appointment of members to OH&S committees are followed. The committee is also involved in an advisory group to the SHA in developing a Safety System Management plan and participates on the board of Saskatchewan Association for Safe Workplaces in Health (SASWH). Additionally, the OH&S Committee has acted as a resource for resolving conflicts between Employer co-chairs and the members of the committees in regards to meeting times and time away from work to perform OH&S functions. Questions regarding OH&S can be directed to ohs@hsas.ca. Respectfully submitted, Bill Fischer HSAS Occupational Health & Safety Committee Chair
