STÉPHANE GRENIER

Retired Lieutenant Colonel and Mental Health Innovator In today’s modern workplace, mental health problems have become the leading cause of disability claims, accounting for 70% of workplace disability management costs in Canada. As a former posttraumatic stress disorder sufferer, Lieutenant-Colonel (Retired) Stéphane Grenier knows the toll mental health issues can take on individuals firsthand. Grenier offers audiences pragmatic advice designed to foster workplaces that support an open, non-stigmatized approach to mental health.

Grenier has challenged society’s traditional outlook regarding mental health for much of his career by redefining how we should care for and support those affected by mental health problems.

His body of work began in his very own workplace, the Canadian Military, where he created and managed numerous employee driven mental health programs that have proven effective over the years and have been sustained since his departure.

He is a regular keynote speaker at major workplace focused and labour conferences and more recently some of his conferences have been recognized by Continuing Medical Education Departments. In 2012, he retired from the military and created Mental Health Innovations consulting (MHI) in order to dedicate his full attention to developing non-clinical mental health interventions as a complement to traditional clinical care and also co-founded Peer Support Accreditation and Certification (Canada), a non- profit organization dedicated to the advancement of peer support. In 2015, he was awarded an honorary degree of Doctor of Laws honoris causa by the University of Guelph.

AVINASH MANIRAM

Partner and Senior Consultant, PBI Actuarial Consultants Ltd. Avinash is a senior consultant with PBI Actuarial Consultants Ltd., consulting to negotiated cost trusteed clients with regard to the provision of group benefit programs. He has over 20 years of insurance and consulting experience. Avinash has a broad range of experience in employee benefits and technical expertise in the design, funding, pricing and valuation of group benefit programs in a negotiated contribution environment. He serves multi-employer clients in the construction, telecommunications, retail and service industries. Mr. Maniram has also served on the faculty of the actuarial sciences program at Simon Fraser University.

Avinash is a member of the IFEBP and has become a frequent speaker on health and welfare topics.

Through this experience with the IFEBP and his work with clients on member education issues, Avinash has developed and made numerous presentations to unionized groups covering technical actuarial and benefits issues.

Avinash attended the University of Manitoba on scholarships from the IBEW and Canadian Federation of Labour. While there, he earned a Master’s degree in Actuarial Mathematics after obtaining a Bachelor of Science (Honours), with a major in Actuarial and Management Sciences.

MARCUS DAVIES

Legal Counsel, Bainbridge Jodouin Cheecham Marcus Davies is a lawyer with the law firm Bainbridge Jodouin Cheecham in Saskatoon. He is a former journalist and political advisor who focuses his law practice on representing employees and unions across Saskatchewan.

He has appeared at all levels of court and has conducted a number of labour arbitrations. He was part of the legal team which successfully argued against the Public Services Essential Services Act at the Supreme Court of Canada.

He is a trained mediator who also performs workplace harassment investigations.

MEETING PROCEDURES FOR THE ANNUAL GENERAL MEETING GENERAL RULES 1. Once recognized by the Chair, delegates wishing to speak shall state their name and Health Region.

2. Debate or comments shall be limited to two minutes for each speaker. A speaker shall not speak more than once on the same question unless everyone who wishes to has spoken.

No member may speak more than two times on any one motion.

3. Only one speaker speaks at a time.

4. Debate is limited to the motion.

5. No person shall interrupt a speaker, except to make a point of order. At the request of the Chair, a speaker shall be seated until a point of order is decided.

6. All comments shall be directed to the Chair. No comments should be directed to or at another delegate.

7. Side conversations are discouraged, as it can be distracting to other delegates.

8. All votes require a simple majority, except in special circumstances or outlined in the Bylaws. Here are some special circumstances where a simple majority is required: a.

To amend the Bylaws

b.

To close debate when it appears some people still want to debate.

MOTIONS 1. A motion is not debatable until a motion has been made, seconded and restated by the Chair.

2. The maker of the motion has the right to be the first speaker on the motion if he chooses.

3. The maker of the motion is prohibited from speaking against the motion.

4. For the AGM, a resolution cannot be postponed beyond this AGM.

CONSTITUTION & BYLAWS REFERENCE ARTICLES ARTICLE 3 - ASSOCIATION MEETINGS 3.01

Annual Meeting

The Annual Meeting shall be held within seventy (70) days after the end of each Fiscal Year of the Association.

3.03

Notice of Meeting

(a)

The President shall give Members notice of the time and place of an Association Meeting at least fifteen (15) days before the proposed Association Meeting.

(b)

The notice of an Association Meeting shall: (i)

be given in the manner provided in article 14;

(ii)

specify the nature of the matters to be presented to the Association Meeting;

and (iii)

include the full wording of resolutions to be considered at the Association Meeting.

(c)

The fact that a Member does not receive notice of an Association Meeting shall not invalidate the proceedings or the business transacted at that Association Meeting.

3.04

Delegates

(a)

Only Delegates, or in their absence, alternate Delegates, selected in the manner described in this section 3.04, are entitled to vote at Association Meetings.

(b)

Each Union Region with up to and including one hundred (100) Active Members is entitled to elect one (1) Delegate to attend each Association Meeting.

(c)

Each Union Region with more than one hundred (100) Active Members is entitled to elect one (1) additional Delegate for each additional one hundred (100) Active Members or portion of one hundred (100) Active Members to attend each Association Meeting.

(d)

In addition to the Delegates elected in accordance with subsections 3.04(b) and 3.04(c), each member of the Executive Council is automatically a Delegate to each Association Meeting.

(e)

Only an Active Member employed within a Union Region is eligible to be elected as a Delegate in the Union Region in which she is employed.

(f)

An Active Member who is employed in more than one Union Region is eligible to be nominated and elected in only one Union Region.

(g)

Only an Active Member employed within a Union Region is entitled to nominate an individual to the position of Delegate for that Union Region.

(h)

Where a ballot is required to elect one or more Delegates, Active Members shall vote for Delegates by mail-in ballot, handled in the manner described in article 4.

(i)

A nominee not elected as a Delegate for a Union Region shall be deemed to be an alternate Delegate for that Union Region, and, where there is more than one, they shall be ranked in order of the number of votes received.

(j)

Except as set out in the Bylaws, the procedures for electing Delegates and alternate Delegates shall be as established by the Executive Council, and the Executive Council shall notify all Members of those procedures annually before the Annual Meeting.

(k)

An alternate Delegate, when attending and voting in place of the Delegate she is replacing, is deemed to be the Delegate.

(l)

Each Delegate shall: (i)

attend the Association Meeting for which she has been elected as a Delegate;

and (ii)

act in the best interests of the Association.

(m)

A Delegate holds office as a Delegate for the Association Meeting for which she was elected a Delegate.

3.06

Chair of an Association Meeting

(a)

The President, or in her absence, the Vice-President, or, in the absence of both the President and the Vice-President, the President’s designate, shall preside as Chair at every Association Meeting.

(b)

If there is no Chair for an Association Meeting, or if a Chair is not present within thirty (30) minutes after the time appointed for holding the Association Meeting, or if the individual described in subsection 3.06(a) is unwilling to act as Chair, the members of the Executive Committee who are present at the Association Meeting shall appoint one of their number to be Chair of the Association Meeting.

3.07

Resolutions

(a)

The rules relating to resolutions to be considered at an Association Meeting are set out in this section 3.07.

(b)

Subject to subsection 3.07(f), a resolution shall be considered and voted on at an Association Meeting only if either of (i)

the Executive Council, or

(ii)

a group of at least ten (10) Active Members,

has given written notice of the resolution to the Secretary at least sixty-five (65) days before the Association Meeting at which the Executive Council or the group of at least ten (10) Active Members intends for the resolution to be considered. (c)

When the Secretary receives a resolution that has originated from a group of at least ten (10) Active Members, the Secretary shall forward the full text of that resolution to the Executive Council for its consideration.

(d)

When the Executive Council has received a resolution from the Secretary in accordance with subsection 3.07(c), it shall consider the resolution and specify the details of its support or lack of support for the resolution, including reasons.

(e)

The notice from the Secretary of an upcoming Association Meeting shall include:

(f)

(i)

the full text of all resolutions the Secretary has received in accordance with subsection 3.07(b); and

(ii)

the details, including reasons, of the Executive Council's support or lack of support for each resolution.

If, in the opinion of the Executive Council or the group of at least ten (10) Active Members putting forward a resolution, circumstances have prevented the Executive Council or the group of at least ten (10) Active Members from giving written notice of its resolution to the Secretary at least sixty-five (65) days before the Association Meeting at which it is proposed the resolution be considered, the following rules will apply to the resolution: (i)

Those proposing to expedite the resolution as provided in subsection 3.07(f) shall forward it in writing to the members of the Executive Committee in attendance at the Association Meeting at which it is proposed the resolution be considered.

(ii)

If at least a Simple Majority of the members of the Executive Committee, present and voting at a special meeting of the Executive Committee, determines that the resolution should be expedited and presented to the Delegates for their consideration, the resolution shall be presented at that Association Meeting.

(iii)

The decision of at least a Simple Majority of the Executive Committee, as contemplated in paragraph 3.07(f)(ii), is final and there is no appeal from it.

(g)

A resolution affecting the Constitution or the Bylaws shall be handled in the manner provided in article 20.

(h)

A resolution regarding a proposed budget, when required to be brought before an 14

Association Meeting, shall be handled in the manner described in subsection 16.04(b).

3.08

Voting

(a)

Only Delegates are entitled to vote at Association Meetings.

(b)

Each Delegate is entitled to one (1) vote on each question that comes before the Association Meeting for which that Delegate has been elected.

(c)

No Delegate is entitled to vote by proxy.

(d)

Voting at an Association Meeting shall be by show of hands, except where a motion to have a ballot vote is passed by at least a Simple Majority vote of the Delegates.

(e)

The Chair is entitled to seek the assistance of the scrutineers to ascertain whether or not a motion by a show of hands has been carried or lost.

(f)

Subject to subsection 3.08(g), a ruling of the Chair that a resolution has been carried or lost is conclusive evidence of that fact without proof of the number or proportion of votes recorded in favour of or against the motion, and the result of the vote so taken and declared shall be the decision of the Members, through their Delegates, upon the question.

(g)

The Delegates at an Association Meeting are entitled to appeal any ruling of the Chair and, in doing so, must follow the provisions of Robert's Rules of Order.

(h)

Except for those to which article 20 applies, all resolutions require the support of at least a Simple Majority of the Delegates present and voting at an Association Meeting.

ARTICLE 16 - FINANCIAL AFFAIRS 16.02 Budget (a)

Before the end of each Fiscal Year, the Finance Committee shall provide to the Executive Council a proposed Association budget for the next Fiscal Year.

(b)

At its last meeting in each Fiscal Year, the Executive Council will consider the Finance Committee’s proposed budget for the next Fiscal Year and, by at least a Simple Majority of those present and voting, will also:

(c)

(i)

approve it;

(ii)

approve it with amendments; or

(ii)

reject it and request the Finance Committee to prepare a new proposed budget.

After the Executive Council approves a proposed budget, or a proposed budget with amendments, it will forward it to the Board of Governors for its consideration.

(d)

The Board of Governors will consider the Executive Council’s proposed budget and, by at least a Simple Majority of those present and voting at a Board of Governors meeting, will also: (i)

approve it;

(ii)

approve it with amendments; or

(iii)

reject it.

16.05 Financial Statements (a)

The Executive Council, by at least a Simple Majority, shall, approve the quarterly unaudited and annual audited financial statement of the Association.

(b)

The Treasurer or her designate shall present to the Delegates at every Annual Meeting: (i)

the financial statements for the most recent Fiscal Year ended before that Annual Meeting;

(ii)

the report of the auditor on the financial statements for the most recent Fiscal Year ended before that Annual Meeting; and

(iii)

any further information respecting the financial affairs of the Association.

(c)

The Delegates at the Annual Meeting, by at least a Simple Majority of those present and voting, shall receive the annual audited financial statements of the Assocation.

(d)

Following the Annual Meeting, any Member may request and the Association will deliver to that Member a copy of the Association’s most recently approved annual audited financial statements and the report of the auditor.

ARTICLE 19 - PROCEDURE 19.01 Robert’s Rules Except where otherwise provided in the Bylaws, all matters of procedure at any meeting of the Association or the Executive Council shall be decided in accordance with Robert’s Rules of Order.

ARTICLE 20 - CONSTITUTION AND BYLAW AMENDMENTS 20.02 Presenting Resolutions Affecting the Constitution and Bylaws A resolution affecting the Constitution or the Bylaws may be presented to an Association Meeting only if: (a)

it has been put forward by:

(i)

the Executive Council; or

(ii)

a group of at least ten (10) Active Members who have given written notice of their resolution to the Secretary at least sixty-five (65) days before the Association Meeting at which those Members intend for their resolution to be considered;

and (b)

there has been full compliance with the rules set out in section 20.03.

20.03 Rules for Resolutions Affecting the Constitution or Bylaws (a)

(b)

If a resolution affecting the Constitution or the Bylaws comes to the Secretary from the Executive Council, the following rules apply: (i)

Before the Executive Council sends the resolution to the Secretary, the resolution must have received the support of at least two-thirds (2/3) of the members of the Executive Council present and voting at a meeting of the Executive Council, and in this subsection 20.03(a), when a such a resolution has been so approved, it shall be called an “Executive Council approved resolution.�

(ii)

If a resolution has not received the support of at least two-thirds (2/3) of the members of the Executive Council present and voting at a meeting of the Executive Council, the resolution shall die.

(iii)

The Executive Council shall forward its Executive Council approved resolution to the Board of Governors for its consideration.

(iv)

If the Board of Governors ratifies the Executive Council approved resolution by at least a two-thirds (2/3) majority of those present and voting at a meeting of the Board of Governors, the Board of Governors shall notify the Executive Council of its approval and the Executive Council will ensure that the resolution goes to the Members with the notice of the Association Meeting.

(v)

If the Board of Governors does not ratify the Executive Council approved resolution by at least a two-thirds (2/3) majority of those present and voting at a meeting of the Board of Governors, the Board of Governors shall notify the Executive Council of its decision and the Executive Council and the Board of Governors shall meet to attempt to reach agreement on the resolution.

(vi)

If the Executive Council and the Board of Governors cannot reach agreement on the Executive Council approved resolution, the Secretary shall forward the full text of the resolution to the Members with the notice of the Association Meeting along with the details of the disagreement between the Executive Council and the Board of Governors.

If a resolution affecting the Constitution or the Bylaws comes to the Secretary from a group of at least ten (10) Active Members, the following rules apply: (i)

The Secretary shall forward the resolution to the Executive Council for its Health Sciences Association of Saskatchewan

consideration. (ii)

If the Executive Council does not approve the resolution by at least a two-thirds (2/3) majority of those present and voting at a meeting of the Executive Council, the resolution shall die.

(iii)

If the Executive Council approves the intent of the resolution by at least a two thirds (2/3) majority of those present and voting at a meeting of the Executive Council: (A)

the Executive Council may make amendments to the resolution if, in the view of the members of the Executive Council, the amendments are in keeping with the spirit of the resolution, and may do so by at least a Simple Majority of the members of the Executive Council present and voting at a meeting of the Executive Council; and

(B)

it shall forward the resolution, as amended, if applicable, to the Board of Governors for its consideration.

(iv)

If the Board of Governors ratifies, by at least a two-thirds (2/3) majority of those present and voting at a meeting of the Board of Governors, the resolution it receives from the Executive Council, the Board of Governors shall notify the Executive Council of its approval and the Executive Council will ensure that the resolution goes to the Members with the notice of the Association Meeting.

(v)

If the Board of Governors does not ratify, by at least a two-thirds (2/3) majority of those present and voting at a meeting of the Board of Governors, the resolution it receives from the Executive Council, the Board of Governors shall notify the Executive Council of its decision and the Executive Council and the Board of Governors shall meet to attempt to reach agreement on the resolution.

(vi)

If the Executive Council and the Board of Governors cannot reach agreement on the resolution, the Secretary shall forward the full text of the resolution, as amended by the Executive Council, if applicable, to the Members with the notice of the Association Meeting along with the details of the disagreement between the Executive Council and the Board of Governors.

ARTICLE 21 - CODE OF ETHICS 21.01 Code Each of the following acts shall constitute conduct unbecoming a Member of the Association: (a)

crossing a picket line established by the Association;

(b)

obtaining or soliciting membership by misrepresentation;

(c)

knowingly failing to comply with the Constitution or the Bylaws;

(d)

knowingly publishing or circulating false reports or misrepresentations among the Members;

(e)

working in the interests of another union to the detriment of the Association;

(f)

without proper authority using the name of the Association to solicit funds or to advertise;

(g)

misappropriating assets belonging to the Association;

(h)

furnishing to anyone, without proper authority or for any purpose not in the best interest of the Association, a list or a portion of a list of Members of the Association;

(i)

failing, without reasonable excuse, to pay initiation fees, membership dues, or assessments of the Association;

(j)

slandering or libelling, that is, spreading defamatory comments, either verbally or in writing, which would tend to injure the reputation of a Member or an officer of the Association or any of the component parts of the Association;

(k)

failing to follow the lawful order of the Chair of any Association Meeting or its component parts to the point where business of the Association Meeting may not be fairly and reasonably conducted;

(l)

interfering with the performance of the duties of any officer of the Association or its component parts;

(m)

engaging in conduct detrimental or prejudicial to the best interest of the Association;

(n)

wilfully neglecting the duties of an elected Association position;

(o)

failing to follow the lawful directions and ruling of the Executive Council;

(p)

filing frivolous, unnecessary or vindictive charges against a Member of the Association;

(q)

harassing any Member or staff member of the Association; and

(r)

violating the published policies of the Association.

ANNUAL CONVENTION Committee

COMMUNICATIONS Committee

The Annual Convention Committee is responsible for making arrangements for the Annual Convention within the budget approved by the Executive Council.

The Communications Committee is responsible for developing and implementing a communications strategy regarding internal and external communications.

GOVERNANCE Committee The Governance Committee is responsible for assisting Executive Council in all matters pertaining to the HSAS Constitution and Bylaws.

GRIEVANCE Committee The Grievance Committee is responsible for ensuring that all HSAS members are represented in a fair, consistent and reasonable manner.

This Committee will hear a member’s appeal of a decision by the Labour Relations Staff not to advance the member’s grievance to arbitration.

MEMBERSHIP ENGAGEMENT Committee

The Membership Engagement Committee strives to engage members in union related and union sponsored activities.

NEGOTIATING Committee The Negotiating Committee is responsible for bargaining the Collective Agreement for the membership.

FINANCE Committee The Finance Committee is responsible for managing the finances of HSAS. Duties include: • Preparation of the annual budget • Monitoring revenue and expenditures • Presenting the approved budget at the Annual Convention • The Finance Committee also has the following portfolios: • Education: set up to administer the various funds the Association offers • Charitable Donations: established to evaluate charitable donation opportunities • Professional Contributions: established to review sponsorship of professional conferences • Emergency Fund

The OH&S Committee develops and implements a process approved by Executive Council for the selection and tracking of HSAS Members to local OH&S Committees, and serves as a resource for HSAS Members serving on local OH&S Committees.

REPORT TO ANNUAL CONVENTION

It has been an honor to serve as your President over this past year. This year has been a busy one for your Executive Council, Committees and staff. Please take time to review the reports of our Executive Director, our Committees and the work completed by many dedicated members and staff.

On December 4, 2017, the 12 regional health authorities transitioned into a single health authority. This transition also resulted in changes for HSAS with regards to Labour Relations and Governance. At AGM 2017 the delegates approved a bylaw resolution converting the use of the 12 Health Regions for AGM delegate selection and other specially called association meetings into 12 Union Regions.

The amalgamation of the health authorities led to a review of existing Letters of Understanding (LOU) in the spring of 2018.

This task was undertaken to identify LOUs which were no longer relevant, those that would be impacted by the transition to the new provincial health authority and those which were not in compliance with the Saskatchewan Employment Act. During the Saskatchewan Party Leadership race, I corresponded with each of the leaders via letter, outlining HSAS concerns regarding the 2017 Budget, the impact of layoffs and their resultant effect on the health care of the Saskatchewan residents. The role of HSAS specialized health care professionals

was highlighted with attention drawn to the reality that their work is an investment in our province, not a burden to health care budgets. Copies of the letter were also sent to the Ministers of Health and Rural and Remote Health.

During the early stages of amalgamation, meetings were held with the transition team for the new health authority, and SAHO. Meeting goals included discussion of concerns and identification of issues which needed to be addressed, including Seniority calculations under the new health authority.

Agreement on calculation of Seniority was reached and included an appeal process for Members who wished to challenge the reported Seniority.

We continue to foster relationships with other public sector unions and attend meetings of mutual concern. In the past year we attended two meetings with representatives from public sector unions, Faculty Associations of both universities, Saskatchewan Teachers’ Federation (STF), as well as health care unions. These meetings were facilitated by the Saskatchewan Federation of Labour (SFL), and all SFL affiliates and non-affiliates were invited. Meetings focused on information sharing with respect to bargaining and the state of bargaining within the province. The meetings were informative and provided a greater understanding of what other unions were facing in the process of negotiating of new collective bargaining agreements.

Community engagement has been a prominent theme for HSAS this year. As many HSAS professionals see the direct and indirect consequences of a lack of appropriate nutrition firsthand in their daily work, HSAS chose to support and promote the critical work which food banks carry out. HSAS and its members participated in the fundraising for two major Food Banks – Saskatoon and Regina. All proceeds from the two HSAS sponsored steak nights were donated to the food banks.

A second initiative also focused on community engagement. The Community Engagement Volunteer Fund was implemented and allows individual HSAS Members who are participating in a recognized charitable or humanitarian event to apply for funding for that event. Some of our HSAS members across the province have participated in this initiative.

On behalf of HSAS members, I have addressed issues of concern in health care in Saskatchewan. This has occurred through media such as radio and television interviews. Our communications/media strategies are very important, and you will learn more about our activities through the Communications Committee report. We must continue to invest and dedicate our energy and resources to a strong Communications/ Media plan. This is an important aspect of a union as it plays an integral part in the campaigning and advocating for our Members and health care services provided in this province.

HSAS also participated in external regional/ provincial committees with representation from Executive Council. Colleen Howe represented HSAS on the provincial Employee Family Assistance Plan (EFAP) Committee, and Rob Snell, EMT, represented HSAS on the Saskatchewan Association of Safe Workplaces in Health (SASWH) Board.

Bill Fischer was appointed the new HSAS representative to the SASWH Board. Natalie Horejda continued to represent HSAS on the Saskatchewan Healthcare Employees’ Pension Plan (SHEPP) Board as a Trustee.

Executive Council has established the Occupational Health and Safety (OH&S) Committee as a standing committee to monitor and track the many OH&S committees across the province, and to communicate and serve as a resource to HSAS Members serving on those local OH&S committees.

Since 2003, HSAS has been a member of CHPS (Canadian Health Professionals Secretariat).

CHPS was established by the National Union of Public and General Employees (NUPGE) to meet the challenges Canadian Health Professionals face. The Secretariat has three (3) main goals: 1.

CHPS meetings are held twice yearly. HSAS is represented at these meetings by the President, another elected representative and/or the Executive Director. Unions from across the country attend and each prepares and presents a report outlining their organization’s activities, including bargaining, communication, labour relations and political climate. These reports offer an excellent opportunity for information sharing and problem solving.

Since 2012, I have served on the SHEPP Union Partner Committee, representing HSAS. Other Union Partner Committee members include representatives from SUN, SEIU, CUPE, and SGEU. This past year, I also chaired the HSAS Governance Committee.

five positions affected, three Directors, one Specialist, and one Consultant. The timing of this decision was questionable as there were already three unions who were well into bargaining at this point, and the former regions were struggling to figure out the new labour relations landscape.

The loss of experience from the retirements put many files into disarray such as our market supplement program and of course our negotiation process. The Employer addressed the holes left behind by adding portfolios to individuals who already seemed to be stretched. It was late May before a meeting could be booked to discuss our upcoming bargaining process and in a meeting with the new individual handling the market supplement program, it was evident that this program was not a high priority for the Employer while transitioning to the new SHA. One file that did proceed on the Market Supplement front was for our EMS classification.

HSAS challenged the Employers decision not to provide the 3.43% market supplement increase to our entire EMS group of classifications based on point #4 of LOU #12 which reads:

“In the event a market supplement wage increase is applied to a classification, the existing percentage wage differential between the said classification receiving the market supplement increase and any level above, in the same classification series, shall be considered and maintained where appropriate.”

The Employer position was that it was only appropriate to provide the increase to the

EMT and EMTA classifications. The parties argued the interpretation of the language above before Arbitrator Beth Bilson on December 15, 2017. Unfortunately, we were unsuccessful in our attempt to secure the 3.43% market supplement for all EMS classifications. The following excerpt is from the decision Arbitrator Bilson provided on the matter in early January 2018.

“I have determined that clause 4, properly understood, does not have the effect of automatically bumping up wages in higher classifications once a market supplement is awarded, but leads instead to a consideration, as part of a decision-making process, of whether the gap in wages between classifications should be maintained.”

Over the last six months our LROs have been dealing with many meetings regarding attendance management. These meetings take place once a member has exceeded the provincial average of sick time taken by our members. The provincial average seems to fluctuate depending on the former region and does not seem to be based on numbers that the Employer is willing to provide. For the most part these meetings seem to be an attempt to pressure and dissuade some of our members from using the sick time which they are entitled to, regardless of the reasons or need. This will be one of the topics discussed at our annual LRO strategy meeting in September so that our LROs are all dealing with this issue consistently. Another interesting development that has taken place within the new SHA is the increase in multisite positions. In Regina alone management has included all classifications working within the primary health care network as

being multi-site work, even though it seems that the only movement between sites will be to fill vacancies related to sick leave, vacation and other short-term leaves. This is clearly not what our language on multisite was meant to be used for so grievances have been filed and are set to be heard in February 2019.

On a final note, HSAS met with the five new SHA Executive Directors and the Chief Human Resources Officer for Human Resources on August 22, 2018. We were given a power point presentation outlining the different portfolios that each new Executive Director would be responsible for and each introduced themselves with their backgrounds. HSAS took this opportunity to provide information concerning some of the growing pains we have had to endure so far with the new SHA. This information was well received. We were told that now with the SHA Executive Director positions filled, the next step was to fill over fifty Director positions across the province that would fall under each of the five new portfolios. The timeline presented for filling of the positions was late fall 2018. We also discussed the “AIMS� (Administrative Information Management System) project that that was

officially announced on July 24, 2018 and will get underway this fall. This will be the new system put into place to bring all former regions under one provincial information management system. The Employer is hoping to have this accomplished within a twenty-four month period, but it was stated at our meeting that this might be a very aggressive timeframe.

Grievances & Arbitration Since implementation in October of 2015 the tracking of grievances continues to be a key part of our Labour Relations strategy.

In the 2017 calendar year we filed sixty-nine (69) grievances, eighteen (18) of which are still active and eleven (11) of those eighteen (18) grievances have been forwarded to arbitration. As of August 31st, of 2018 we have filed seventy (70) grievances. Fiftytwo (52) are active and eighteen (18) of these active files have been forwarded to arbitration. The chart below shows our grievance numbers since 2015.

The most notable arbitration decision this year was a grievance that was filed on behalf of a member who was on an extended sick leave and was limited to 119 days of paid sick

leave even though her sick bank stood at 190 days. The Employer claimed that 119 days was the maximum that would be paid by the Employer regardless of the duration of the Employee’s absence.

Below is an excerpt of the written decision on the file from Arbitrator Daniel Ish:

“The collective agreement does not structure sick leave and LTD as an integrated progression that moves an employee from shorter term income protection to long term income protection, as does some other collective agreements which have been the subject of arbitration.

(E.g.: SaskTel and Unifor (Extended Sick Leave) (March 10, 2014) (Ish)). Although Appendix B makes reference to the sick leave provisions in paragraph (d), the two sets of benefits are structured in the collective agreement as appearing independent of each other. The employer placed considerable weight on the third paragraph of Appendix B (d) which provides:

paragraph that any balance of sick leave credits remaining at the end of 119 days remains to the employee’s credit until she returns to regular work. The employer urges that this sentence be interpreted to disqualify an employee from receiving sick leave pay after 119 days. However, because it is contained in Appendix B which is dedicated to long term disability and in paragraph (d) which deals with the qualifying period, rather than being contained in the sick leave provision section of the collective agreement (Article 12), I cannot conclude that it is language that was clearly intended to limit sick leave to 119 days when there are credits remaining and where an employee would still qualify for sick leave. The sentence relied upon by the employer clearly would prevent an employee from losing her sick leave credits beyond 119 days while receiving LTD benefits. However, I do not interpret it as going further to deny an employee of sick leave credits where she was not receiving LTD benefits. The language of the collective agreement, in my view, would have to be more clear and specific to yield that result.

It is my conclusion that the language and structure of the agreement cannot be interpreted to deprive the grievor of earned sick leave credits in the situation where she does not qualify for LTD benefits. If the paragraph relied upon by the employer was contained in the sick leave article of the collective agreement (Article 12) the argument that it was intended to limit sick leave to 119 days would be compelling. However, Article 12 is silent with respect to limits placed on an employee’s right to access sick leave credits that have been earned and accumulated. There is nothing in Article 12 that requires the discontinuance of sick leave after 119 days.

The 46th Annual Convention will take place at the Sheraton Cavalier Hotel, 612 Spadina Crescent, Saskatoon, SK. It is anticipated there will be approximately 55 delegates from across the province in attendance.

The Convention will begin on October 25, 2018 at 11:00 with registration and lunch. Our President will welcome all Delegates before introduction of this year’s speakers.

The first speaker is Stéphane Grenier. Lieutenant Colonel Stéphane Grenier CM MSC CD is a French-Canadian military officer known for his work on psychological war trauma and posttraumatic stress disorder.

The second speaker is Avinash Maniram. Avinash is a senior consultant with PBI Actuarial Consultants Ltd. He will speak on today’s sedentary lifestyle and associated risks to health.

To close off Thursday, we will have a members’ social in the evening providing members the opportunity to renew old friendships and connect with new delegates and members across the province.

Friday morning will begin with breakfast followed by the Annual General Meeting (AGM).

Following the AGM, we will have HSAS legal counsel provide us with a labour relations update, lunch, the Members’ Forum and closing remarks.

We at HSAS have planned for and looked forward to seeing everyone in Saskatoon for the 46th Annual Convention.

Internally, the Committee works to ensure that the membership of HSAS is provided with accurate and timely information and externally, the Committee works to ensure that the public, the media and other stakeholders are made aware of the concerns of the HSAS membership.

Since the launch of the current HSAS website, the Communications Committee has continued to evolve the website into a more functional and meaningful tool and source of information for all HSAS members, and visitors to the site. Through analytics it was confirmed that the HSAS/ SAHO collective agreement is a frequently searched page. Resources were allocated, and enhancements were made to improve the ease of searching and accessing collective agreement information. In addition, updated New Member Orientation materials for the HSAS/SAHO, Crestvue, and North East EMS members were added to the website.

To increase public awareness, the Communications Committee has continued to build upon the Blue/Green branding campaign. This includes profession specific advertisement placement on public transit and within public buildings. In addition, a profession awareness campaign was launched in late fall 2017 with the production of four profession-focused television commercials.

The commercials have been shared on Facebook, YouTube, movie theatre preshows, and on the HSAS website. In conjunction with the commercials, the HSAS President was interviewed for several weekend radio time slots on CJME’s ‘Talk to the Experts’ radio program. Once again, HSAS informed the listening public about the positive impact HSAS professionals can make in delivering an appropriate level of quality services when needed by the province’s residents.

The information they receive assists in understanding their rights under the HSAS Collective Agreement and provides them with critical contact information.

The mandate of the Governance Committee is to assist the Executive Council in all matters pertaining to the HSAS Constitution and Bylaws, and resolutions.

This year the Governance Committee reviewed the Terms of Reference for “General Terms Governing Committees”. The Terms of Reference document was expanded to outline Committee Chair Duties and Responsibilities and Committee Member Duties and Responsibilities. This document was approved by Executive Council, and going forward will be helpful in providing guidance for the roles and expectations of Committee Chairs and Committee Members.

The Governance Committee also concluded a Review of Unique Classifications/Job titles for Representation. The list of unique classifications/job titles that do not appear in the Collective Bargaining Agreement was reviewed with the goal of assigning the representation of these classifications/job titles to the most appropriate Executive Council seat. The suggested assignment was made using the members’ community of interest as criteria. Executive Council approved the recommended assignments.

There were no resolutions submitted to be considered at this Annual General Meeting.

Each of these non-profit organizations strives to build an engaged, inclusive, healthy and empowered community for all. We also hoped to get our members involved in the giving.

In both Regina and Saskatoon last year we held Steak nights with silent raffles and 50/50s.

This was a chance for our members to connect to the union while doing what we do best‌. supporting our community! Last year Potash Corp. matched HSAS’s donation to make an even bigger impact for people of Saskatchewan.

We would encourage all members to check our new Community Engagement Fund. HSAS believes in giving back to the community and we know each member has something near and dear to them. Continuing Education Fund

The Education Fund was established at the October 1990 Annual Convention. The purpose of the fund is to provide financial assistance to members who have paid registration for attendance at an educational event directly related to their present position.

A lottery system is used to select successful applicants. Names are drawn from those eligible on the following dates: twenty-five (25) on January 15, 2018 and twenty-five (25) on June 15, 2018. Successful applicants are eligible for a maximum of $500.00 of financial assistance.

In 1984, the Health Sciences Association of Saskatchewan established a Scholarship Foundation. One of its objectives is to promote educational achievement, particularly in post-secondary areas of study or training in a post-secondary educational institution. Ron Currie Award

Established in 1985, this $500.00 scholarship is awarded to a Pharmacy student in the College of Pharmacy at the University of Saskatchewan. The award recognizes Ron Currie’s leadership as HSAS’s first president, guiding the formation of our union. The recipient is chosen by a committee representing the Faculty of Pharmacy, HSAS and the Pharmacy Students Society.

Silver Anniversary Scholarship

The 1997 Annual Convention established scholarships to mark the 25th anniversary of the Health Sciences Association of Saskatchewan. Twenty-five (25) five hundred dollar ($500) scholarships are awarded to a spouse or a dependant of a Health Sciences Association of Saskatchewan member. The spouse or dependant must be enrolled in full-time studies at a post-secondary educational institution leading to a degree, diploma or certificate. There were thirty-eight (38) applicants in the 2017-2018 fiscal year.

Roberta Ekberg Award

This award was established at the 2003 Annual Convention to recognize former HSAS President and Board of Governor Roberta Ekberg for her contributions and long standing commitment to HSAS. An award of five hundred dollars ($500.00) is provided to an HSAS activist, HSAS employee or HSAS legal counsel who has contributed to furthering the visions and interests of HSAS. Nominations for this award are accepted no later than August 31 of each year. No nomination was received for the 2017-2018 fiscal year.

This award honors the memory of Warren Chykowski as a valued Member of HSAS for his contributions and accomplishments during his years involved with the Union. In his memory, a $500.00 annual award has been established. The funding is intended to be used for one (1) Respiratory Therapist to attend the Canadian Society of Respiratory Therapists Annual Education Conference.

The recipient of the Warren Chykowski Award for the 2017-2018 fiscal year is Anil Sarkar.

Community Engagement Volunteer Fund

Established in 2017, the purpose of this fund is to support member engagement in their community and volunteer activities. Members are eligible to apply for a maximum of $500.00 per fiscal year.

If HSAS Labour Relations has decided to not advance a member’s grievance to arbitration, that member may ask for an appeal of that decision. The appeal would then be heard by the Grievance Committee.

The Chair of the Grievance Committee and members of the Grievance Committee are appointed yearly following the Annual Convention. The experience held by members of this committee is a valuable asset.

The Grievance Committee met on two separate occasions to hear and deliberate on four appealed grievances.

COMMITTEE REPORT

COMMITTEE MEMBERS Brent Vanin, Chair, Pharmacist, Union Region 7 Bill Feldbruegge, Speech Language Pathologist, Union Region 7 The Member Engagement Committee was developed to identify, facilitate and organize opportunities to enhance engagement with HSAS members.

The Chair of the committee is appointed yearly following the Annual Convention and is responsible for the forming, organizing and the meeting of the committee.

In the 2017-2018 fiscal year, the Membership Engagement Committee followed through on the previous year’s planning for steak night fundraisers to raise funds for the Regina and Saskatoon foodbanks. A Saskatoon steak night was held at the Sutherland Bar & Grill on September 13, 2017 and raised $2251.00 for the Saskatoon Food Bank and Learning Centre. In Regina, a steak night was held the Press Box Sports Bar on October 13, 2017 and raised $1875.00 for the Regina Food Bank. Funds were raised through ticket sales, 50/50 draw and raffle of donated prizes.

HSAS also participated in the Queen City Pride Parade on June 16, 2018 and the Saskatoon Pride Parade on June 23, 2018. HSAS members walked under a banner of “HSAS Celebrating Equality, Diversity & Solidarity in the Workplace” and handed HSAS frisbees and stress balls to the large crowd along both parade routes.

SAHO provided HSAS with a notice to bargain on January 29, 2018. Three days later it was announced that SAHO would be absorbed by the SHA and cease to exist as its own entity by the spring of 2019. This did not come as a big surprise, but it did cause some initial delays in the bargaining process. We finally were able to secure a meeting for May 30, 2018 with the individuals who would be representing the Employer for this round of bargaining. We met the new interim Director of Bargaining for SAHO and the individual named to be the lead negotiator for the Employer at the HSAS table. At this meeting, in an attempt by both parties to save time at the main table, it was decided that we would review the following terms at a side table: “Regional Health Authority”, “Employer”, and “SAHO”.

Where appropriate, these terms could be dealt with as “housekeeping” issues.

After identifying all instances where

these terms are used, we are now in the process of determining which instances will be dealt with at the side table and which will have to go to the main table.

We are targeting to have this work done before November 2018. The exchange of main table bargaining proposals was also discussed at this meeting and if all goes as planned we will be looking at dates in mid to late November. However, no dates have been confirmed.

Committee work Our Negotiating Committee has been preparing for this round of bargaining.

The top ten list of topics that came out of our bargaining conference in May 2017 has been the focus of the Committee’s work.

We have identified the relevant articles of our current Collective Agreement that would fall under each of the topics and are putting the finishing touches on our proposal package that will be approved by Executive Council prior to presentation to the Employer.

OCCUPATIONAL HEALTH & SAFETY COMMITTEE REPORT COMMITTEE MEMBERS Bill Fischer, Chair, Advanced Care Paramedic, Union Region 11 Krishna Vegunta, Physical Therapist, Union Region 11 Haley Oshowy, Dietitian, Union Region 10 The OH&S Committee was initially formed in January of 2018. The Committee was formed due to the Union needing a method to track and to ensure compliance with OH&S Legislation for its Members. The Committee had its first meeting in June to determine its terms of reference and to establish contact with OH&S for the new health authority. The health authority was forth coming with information and now the Committee is verifying the information provided.

With the help of Communications, the Committee is also developing a process for two-way communications between the Union and HSAS members serving on local committees. In the next year, the Union will be contacting members on local OH&S Committees to better determine training needs or additions to committees that are required by legislation.

Additionally, the committee developed a process for selecting new and/or replacement members for local committees.
