Let’s Talk Work Place Safety - and change it for the better!

Lori Johb, Saskatchewan Federation of Labour

Lori Johb, a long time advocate for safe workplaces, will lead a discussion around Occupational Health and Safety at work and your rights and responsibilities. She will touch on topics important to HSAS members such as; inclement weather, travel, working alone, violence and more. She will also speak to the important OH&S work being completed through Saskatchewan’s labour movement.

Included in her presentation, Johb will speak to the Saskatchewan Association for Safe Workplaces in Health (SASWH) and share some of the advances and challenges they have met over the past few years, including how OH&S legislation applies to committees and committee members.

In a Good Way: Putting the Truth and Reconciliation Commission Calls (TRC) into Action Erin Beckwell, Jason Jarotski & Neal Kewistep, Saskatoon Health Region

In 2015, the Truth and Reconciliation Commission (TRC) issued 94 Calls to Action. Saskatoon Health Region (SHR) is responding to the Calls as they relate to health through a range of strategies, including signing a Health Equity Position Statement and a Commitment to Reconciliation.

Using the approach adopted by Population and Public Health Services as an example, this session will share concrete tools and strategies to support health workers as they respond to the Calls to Action in their personal and professional lives.

Austerity and Collective Bargaining in Saskatchewan Charles Smith, University of Saskatchewan

Charles Smith will speak to the current collective bargaining climate in Saskatchewan, and explain how austerity will affect future negotiations for Unions in the Province.

LORI JOHB

Secretary-Treasurer, Saskatchewan Federation of Labour

As an SEIU West member Lori is proud to serve in her fourth term as Secretary Treasurer of the Saskatchewan Federation of Labour. Lori is Chair of the SFL Women’s committee and co-Chair of the SFL OH&S/WC committee.

Sister Johb is also currently the Chair of the Board of Directors for the Saskatchewan Association for Safe Workplaces in Health. In addition, Lori sat as the SEIU director on the previous Advisory Board through SAHO. Lori represents labour on the OH&S Council, a position she has held for 3 terms.

ERIN BECKWELL, BSW, MSW, RSW (SK)

Knowledge Transition Specialist & Policy Analyst, Saskatoon Health Region

Erin works as a Knowledge Translation Specialist and Policy Analyst with the Public Health Observatory in the Saskatoon Health Region. Her work with the Faculty of Social Work, University of Regina (Saskatoon Campus) and a range of community-based organizations ignited her passion for transforming the health system to achieve healthy equity and provide culturally safe care for all.

Originally from rural Southwest Saskatchewan, she has called Saskatoon (Treaty 6 Territory & Homeland of the Métis) home for over 20 years.

JASON JAROTSKI, B.A.

Public Health Inspector, Saskatoon Health Region

Jason Jarotski is currently employed as a Public Health Inspector with the Saskatoon Health Region’s Building Health Equity Department. He has worked as a Public Health Inspector with the Saskatoon Health Region since June of 2002.

Jason has a Bachelor of Arts degree in Sociology from the University of Saskatchewan, a Bachelor of Technology degree in Environmental Health from the British Columbia Institute of Technology and a Master of Public Health degree from the University of Saskatchewan.

NEAL KEWISTEP, M.P.A

Interim Director of Population & Public Health, Saskatoon Health Region

Neal is a proud member of the Fishing Lake First Nation and a residential school Survivor. Neal speaks to how his life has been impacted by the inter-generational effects of the residential school system and how he and his family have been able to recover from their experiences in the schools. He works with the Saskatoon Health Region as the interim Director of Population & Public Health.

Neal has an undergraduate degree in Indigenous Studies and a Master’s degree in Public Administration.

CHARLES SMITH, BA (UNBC), MA(York), PhD (York)

Associate Professor, Faculty of Political Science, University of Saskatchewan

Charles Smith (Ph.D York) is an Associate Professor in the Department of Political Science at St. Thomas More College, University of Saskatchewan. His research interests include Canadian and International political economy, public law, labour unions and federal and provincial public policy. He is the author of Transforming Provincial Politics (2015) and Unions in Court: Organized Labour and the Charter of Rights and Freedoms (2017). He has also authored numerous articles on Saskatchewan Politics, Labour in Court and Labour History. Charles is also co-editor of Canada’s foremost labour studies journal Labour/Le Travail.

MEETING PROCEDURES FOR THE ANNUAL GENERAL MEETING GENERAL RULES 1. Once recognized by the Chair, delegates wishing to speak shall state their name and Health Region.

2. Debate or comments shall be limited to two minutes for each speaker. A speaker shall not speak more than once on the same question unless everyone who wishes to has spoken. No member may speak more than two times on any one motion.

3. Only one speaker speaks at a time.

4. Debate is limited to the motion.

5. No person shall interrupt a speaker, except to make a point of order. At the request of the Chair, a speaker shall be seated until a point of order is decided.

6. All comments shall be directed to the Chair. No comments should be directed to or at another delegate.

7. Side conversations are discouraged, as it can be distracting to other delegates.

8. All votes require a simple majority, except in special circumstances or outlined in the Bylaws.

Here are some special circumstances where a simple majority is required: a.

To amend the Bylaws b.

To close debate when it appears some people still want to debate.

MOTIONS 1. A motion is not debatable until a motion has been made, seconded and restated by the Chair.

2. The maker of the motion has the right to be the first speaker on the motion if he chooses.

3. The maker of the motion is prohibited from speaking against the motion.

4. For the AGM, a resolution cannot be postponed beyond this AGM.

CONSTITUTION & BYLAWS REFERENCE ARTICLES ARTICLE 3 - ASSOCIATION MEETINGS 3.01

Annual Meeting

The Annual Meeting shall be held within seventy (70) days after the end of each Fiscal Year of the Association.

3.03

Notice of Meeting

(a)

The President shall give Members notice of the time and place of an Association Meeting at least fifteen (15) days before the proposed Association Meeting.

(b)

The notice of an Association Meeting shall: (i)

be given in the manner provided in article 14;

(ii)

specify the nature of the matters to be presented to the Association Meeting; and

(iii)

include the full wording of resolutions to be considered at the Association Meeting.

(c)

The fact that a Member does not receive notice of an Association Meeting shall not invalidate the proceedings or the business transacted at that Association Meeting.

3.04

Delegates

(a)

Only Delegates, or in their absence, alternate Delegates, selected in the manner described in this section 3.04, are entitled to vote at Association Meetings.

(b)

Each Health Region with up to and including one hundred (100) Active Members is entitled to elect one (1) Delegate to attend each Association Meeting.

(c)

Each Health Region with more than one hundred (100) Active Members is entitled to elect one (1) additional Delegate for each additional one hundred (100) Active Members or portion of one hundred (100) Active Members to attend each Association Meeting.

(d)

In addition to the Delegates elected in accordance with subsections 3.04(b) and 3.04(c), each member of the Executive Council is automatically a Delegate to each Association Meeting.

(e)

Only an Active Member employed by a Health Region is eligible to be elected as a Delegate in the Health Region in which she is employed.

(f)

An Active Member who is employed by more than one Health Region is eligible to be nominated and elected in only one Health Region.

(g)

Only an Active Member employed by a Health Region is entitled to nominate an individual to the position of Delegate for that Health Region.

(h)

Where a ballot is required to elect one or more Delegates, Active Members shall vote for Delegates by mail-in ballot, handled in the manner described in article 4.

(i)

A nominee not elected as a Delegate for a Health Region shall be deemed to be an alternate Delegate for that Health Region, and, where there is more than one, they shall be ranked in order of the number of votes received.

(j)

Except as set out in the Bylaws, the procedures for electing Delegates and alternate Delegates shall be as established by the Executive Council, and the Executive Council shall notify all Members of those procedures annually before the Annual Meeting.

(k)

An alternate Delegate, when attending and voting in place of the Delegate she is replacing, is deemed to be the Delegate.

(l)

Each Delegate shall: (i)

attend the Association Meeting for which she has been elected as a Delegate; and

(ii)

act in the best interests of the Association.

(m)

A Delegate holds office as a Delegate for the Association Meeting for which she was elected a Delegate.

3.06

Chair of an Association Meeting

(a)

The President, or in her absence, the Vice-President, or, in the absence of both the President and the Vice-President, the President’s designate, shall preside as Chair at every Association Meeting.

(b)

If there is no Chair for an Association Meeting, or if a Chair is not present within thirty (30) minutes after the time appointed for holding the Association Meeting, or if the individual described in subsection 3.06(a) is unwilling to act as Chair, the members of the Executive Committee who are present at the Association Meeting shall appoint one of their number to be Chair of the Association Meeting.

3.07

Resolutions

(a)

The rules relating to resolutions to be considered at an Association Meeting are set out in this section 3.07.

(b)

Subject to subsection 3.07(f), a resolution shall be considered and voted on at an Association Meeting only if either of

(i)

the Executive Council, or

(ii)

a group of at least ten (10) Active Members,

has given written notice of the resolution to the Secretary at least sixty-five (65) days before the Association Meeting at which the Executive Council or the group of at least ten (10) Active Members intends for the resolution to be considered. (c)

When the Secretary receives a resolution that has originated from a group of at least ten (10) Active Members, the Secretary shall forward the full text of that resolution to the Executive Council for its consideration.

(d)

When the Executive Council has received a resolution from the Secretary in accordance with subsection 3.07(c), it shall consider the resolution and specify the details of its support or lack of support for the resolution, including reasons.

(e)

The notice from the Secretary of an upcoming Association Meeting shall include:

(f)

(i)

the full text of all resolutions the Secretary has received in accordance with subsection 3.07(b); and

(ii)

the details, including reasons, of the Executive Council's support or lack of support for each resolution.

If, in the opinion of the Executive Council or the group of at least ten (10) Active Members putting forward a resolution, circumstances have prevented the Executive Council or the group of at least ten (10) Active Members from giving written notice of its resolution to the Secretary at least sixty-five (65) days before the Association Meeting at which it is proposed the resolution be considered, the following rules will apply to the resolution: (i)

Those proposing to expedite the resolution as provided in subsection 3.07(f) shall forward it in writing to the members of the Executive Committee in attendance at the Association Meeting at which it is proposed the resolution be considered.

(ii)

If at least a Simple Majority of the members of the Executive Committee, present and voting at a special meeting of the Executive Committee, determines that the resolution should be expedited and presented to the Delegates for their consideration, the resolution shall be presented at that Association Meeting.

(iii)

The decision of at least a Simple Majority of the Executive Committee, as contemplated in paragraph 3.07(f)(ii), is final and there is no appeal from it.

(g)

A resolution affecting the Constitution or the Bylaws shall be handled in the manner provided in article 20.

(h)

A resolution regarding a proposed budget, when required to be brought before an Association Meeting, shall be handled in the manner described in subsection 16.04(b).

3.08

Voting

(a)

Only Delegates are entitled to vote at Association Meetings.

(b)

Each Delegate is entitled to one (1) vote on each question that comes before the Association Meeting for which that Delegate has been elected.

(c)

No Delegate is entitled to vote by proxy.

(d)

Voting at an Association Meeting shall be by show of hands, except where a motion to have a ballot vote is passed by at least a Simple Majority vote of the Delegates.

(e)

The Chair is entitled to seek the assistance of the scrutineers to ascertain whether or not a motion by a show of hands has been carried or lost.

(f)

Subject to subsection 3.08(g), a ruling of the Chair that a resolution has been carried or lost is conclusive evidence of that fact without proof of the number or proportion of votes recorded in favour of or against the motion, and the result of the vote so taken and declared shall be the decision of the Members, through their Delegates, upon the question.

(g)

The Delegates at an Association Meeting are entitled to appeal any ruling of the Chair and, in doing so, must follow the provisions of Robert's Rules of Order.

(h) a

Except for those to which article 20 applies, all resolutions require the support of at least Simple Majority of the Delegates present and voting at an Association Meeting.

ARTICLE 16 - FINANCIAL AFFAIRS 16.02 Budget (a)

Before the end of each Fiscal Year, the Finance Committee shall provide to the Executive Council a proposed Association budget for the next Fiscal Year.

(b)

At its last meeting in each Fiscal Year, the Executive Council will consider the Finance Committee’s proposed budget for the next Fiscal Year and, by at least a Simple Majority of those present and voting, will also:

(c)

(i)

approve it;

(ii)

approve it with amendments; or

(ii)

reject it and request the Finance Committee to prepare a new proposed budget.

After the Executive Council approves a proposed budget, or a proposed budget with Health Sciences Association of Saskatchewan

amendments, it will forward it to the Board of Governors for its consideration. (d)

The Board of Governors will consider the Executive Council’s proposed budget and, by a least a Simple Majority of those present and voting at a Board of Governors meeting, will also: (i)

approve it;

(ii)

approve it with amendments; or

(iii)

reject it.

16.05 Financial Statements (a)

The Executive Council, by at least a Simple Majority, shall, approve the quarterly unaudited and annual audited financial statement of the Association.

(b)

The Treasurer or her designate shall present to the Delegates at every Annual Meeting: (i)

the financial statements for the most recent Fiscal Year ended before that Annual Meeting;

(ii)

the report of the auditor on the financial statements for the most recent Fiscal Year ended before that Annual Meeting; and

(iii)

any further information respecting the financial affairs of the Association.

(c)

The Delegates at the Annual Meeting, by at least a Simple Majority of those present and voting, shall receive the annual audited financial statements of the Assocation.

(d)

Following the Annual Meeting, any Member may request and the Association will deliver to that Member a copy of the Association’s most recently approved annual audited financial statements and the report of the auditor.

ARTICLE 19 - PROCEDURE 19.01 Robert’s Rules Except where otherwise provided in the Bylaws, all matters of procedure at any meeting of the Association or the Executive Council shall be decided in accordance with Robert’s Rules of Order.

ARTICLE 20 - CONSTITUTION AND BYLAW AMENDMENTS 20.02 Presenting Resolutions Affecting the Constitution and Bylaws A resolution affecting the Constitution or the Bylaws may be presented to an Association Meeting only if: 16

(a)

it has been put forward by: (i)

the Executive Council; or

(ii)

a group of at least ten (10) Active Members who have given written notice of their resolution to the Secretary at least sixty-five (65) days before the Association Meeting at which those Members intend for their resolution to be considered;

and (b)

there has been full compliance with the rules set out in section 20.03.

20.03 Rules for Resolutions Affecting the Constitution or Bylaws (a)

If a resolution affecting the Constitution or the Bylaws comes to the Secretary from the Executive Council, the following rules apply: (i)

Before the Executive Council sends the resolution to the Secretary, the resolution must have received the support of at least two-thirds (2/3) of the members of the Executive Council present and voting at a meeting of the Executive Council, and in this subsection 20.03(a), when a such a resolution has been so approved, it shall be called an “Executive Council approved resolution.�

(ii)

If a resolution has not received the support of at least two-thirds (2/3) of the members of the Executive Council present and voting at a meeting of the Executive Council, the resolution shall die.

(iii)

The Executive Council shall forward its Executive Council approved resolution to the Board of Governors for its consideration.

(iv)

If the Board of Governors ratifies the Executive Council approved resolution by at least a two-thirds (2/3) majority of those present and voting at a meeting of the Board of Governors, the Board of Governors shall notify the Executive Council of its approval and the Executive Council will ensure that the resolution goes to the Members with the notice of the Association Meeting.

(v)

If the Board of Governors does not ratify the Executive Council approved resolution by at least a two-thirds (2/3) majority of those present and voting at a meeting of the Board of Governors, the Board of Governors shall notify the Executive Council of its decision and the Executive Council and the Board of Governors shall meet to attempt to reach agreement on the resolution.

(vi)

If the Executive Council and the Board of Governors cannot reach agreement on the Executive Council approved resolution, the Secretary shall forward the full text of the resolution to the Members with the notice of the Association Meeting along with the details of the disagreement between the Executive Council and the Board of Governors.

(b)

If a resolution affecting the Constitution or the Bylaws comes to the Secretary from a group of at least ten (10) Active Members, the following rules apply: (i)

The Secretary shall forward the resolution to the Executive Council for its consideration.

(ii)

If the Executive Council does not approve the resolution by at least a two-thirds (2/3) majority of those present and voting at a meeting of the Executive Council, the resolution shall die.

(iii)

If the Executive Council approves the intent of the resolution by at least a two thirds (2/3) majority of those present and voting at a meeting of the Executive Council: (A)

the Executive Council may make amendments to the resolution if, in the view of the members of the Executive Council, the amendments are in keeping with the spirit of the resolution, and may do so by at least a Simple Majority of the members of the Executive Council present and voting at a meeting of the Executive Council; and

(B)

it shall forward the resolution, as amended, if applicable, to the Board of Governors for its consideration.

(iv)

If the Board of Governors ratifies, by at least a two-thirds (2/3) majority of those present and voting at a meeting of the Board of Governors, the resolution it receives from the Executive Council, the Board of Governors shall notify the Executive Council of its approval and the Executive Council will ensure that the resolution goes to the Members with the notice of the Association Meeting.

(v)

If the Board of Governors does not ratify, by at least a two-thirds (2/3) majority of those present and voting at a meeting of the Board of Governors, the resolution it receives from the Executive Council, the Board of Governors shall notify the Executive Council of its decision and the Executive Council and the Board of Governors shall meet to attempt to reach agreement on the resolution.

(vi)

If the Executive Council and the Board of Governors cannot reach agreement on the resolution, the Secretary shall forward the full text of the resolution, as amended by the Executive Council, if applicable, to the Members with the notice of the Association Meeting along with the details of the disagreement between the Executive Council and the Board of Governors.

ARTICLE 21 - CODE OF ETHICS 21.01 Code Each of the following acts shall constitute conduct unbecoming a Member of the Association: (a)

crossing a picket line established by the Association; 18

(b)

obtaining or soliciting membership by misrepresentation;

(c)

knowingly failing to comply with the Constitution or the Bylaws;

(d)

knowingly publishing or circulating false reports or misrepresentations among the Members;

(e)

working in the interests of another union to the detriment of the Association;

(f)

without proper authority using the name of the Association to solicit funds or to advertise;

(g)

misappropriating assets belonging to the Association;

(h)

furnishing to anyone, without proper authority or for any purpose not in the best interest of the Association, a list or a portion of a list of Members of the Association;

(i)

failing, without reasonable excuse, to pay initiation fees, membership dues, or assessments of the Association;

(j)

slandering or libelling, that is, spreading defamatory comments, either verbally or in writing, which would tend to injure the reputation of a Member or an officer of the Association or any of the component parts of the Association;

(k)

failing to follow the lawful order of the Chair of any Association Meeting or its component parts to the point where business of the Association Meeting may not be fairly and reasonably conducted;

(l)

interfering with the performance of the duties of any officer of the Association or its component parts;

(m)

engaging in conduct detrimental or prejudicial to the best interest of the Association;

(n)

wilfully neglecting the duties of an elected Association position;

(o)

failing to follow the lawful directions and ruling of the Executive Council;

(p)

filing frivolous, unnecessary or vindictive charges against a Member of the Association;

(q)

harassing any Member or staff member of the Association; and

(r)

violating the published policies of the Association.

COMMUNICATIONS Committee

The Annual Convention Committee is responsible for making arrangements for the Annual Convention within the budget approved by the Executive Council.

The Communications Committee is responsible for developing and implementing a communications strategy regarding internal and external communications.

GOVERNANCE Committee The Governance Committee is responsible for assisting Executive Council in all matters pertaining to the HSAS Constitution and Bylaws.

GRIEVANCE Committee The Grievance Committee is responsible for ensuring that all HSAS members are represented in a fair, consistent and reasonable manner.

This Committee will hear a member’s appeal of a decision by the Labour Relations Staff not to advance her grievance to arbitration.

MEMBERSHIP ENGAGEMENT Committee The Membership Engagement Committee strives to engage members in union related and union sponsored activities.

NEGOTIATING Committee The Negotiating Committee is responsible for bargaining the Collective Agreement for the membership.

FINANCE Committee The Finance Committee is responsible for managing the finances of HSAS. Duties include: • Preparation of the annual budget • Monitoring revenue and expenditures.

• Presenting the approved budget at the Annual Convention.

• The Finance Committee also has the following portfolios: • Education: set up to administer the various funds the association offers • Charitable Donations: established to evaluate charitable donation opportunities • Professional Contributions: established to review sponsorship of professional conferences.

REPORT TO ANNUAL CONVENTION

It has been a pleasure to serve as your President over this past year. It has been a full year for your Executive Council, Committees and staff.

Please take time to review the reports of our Executive Director, our Committees and the work completed by many dedicated members and staff.

The fiscal year of 2016-2017 began with the challenges and fallout of budget restraints.

In June of 2016, the Ministry of Health invited the five health care unions, to meet and discuss an initiative that they were calling Joint Opportunities. They wanted to find money to fix the province’s deficit, whether that was through a contribution holiday to member benefit plans, or perhaps through money-saving efficiencies.

Conversations with the health care unions and the Ministry continued through the early months of 2017. HSAS’ position was that for any consideration of a contribution holiday or suspension of employer contributions to the benefits plan, there would have to be language that ensured that the level of service delivery would be maintained and that no layoffs would occur during the time of suspension of contributions. Even though the Ministry would not assure that no layoffs would occur or that service levels would remain unreduced, they did propose a temporary contribution holiday of employer paid benefits for a period of three months to commence January 2017, which would be returned to the Benefit Plan if no agreement was reached. This proposal by the Ministry was met with a resounding response of “no agreement” by HSAS and no agreement was reached with the Ministry of Health.

In the New Year, the Government announced the outcome of the Panel Review on Health Region re-structuring. The decision was made that there would be one health authority governing the health care services delivery in the province. Premier Brad Wall also announced that Government would be looking at severe budget cuts, and a potential wage rollback to all in Public Service. During this time, the Finance Minister wrote a directive to all Employers in the province to meet with the Union leadership to find ways to save money and identify efficiencies.

We met with SAHO on a couple of occasions stating that HSAS was not prepared to open the contract since we are not in a bargaining year.

Discussions began in May with the governmentappointed Transition team to discuss issues and transitions to the new health authority. The Transition team consisted of representatives from SAHO, and the health regions.

The final initiative by the Ministry of Health was a review of EMS services in Saskatchewan. HSAS was invited to meet with officials at the Ministry of Health to share the HSAS perspective and suggested path for improving the delivery of EMS Services in Saskatchewan. In July, HSAS submitted a brief to the Ministry. It focused on the areas of Staffing, Communications Centres/ Transfers, Education, Fleet Management and the Saskatchewan Ambulance Act. This has occurred through media such as press conferences and news releases, radio and television interviews. Our communications/ media strategies are very important, and you will learn more about our activities through the Communications Committee report. We must continue to invest and dedicate our energy and resources to a strong Communications/ Media plan. A union’s communications strategy (internal and external) plays an integral part in campaigning and advocating for our Members and health care services provided in this province.

This year, HSAS held the Bargaining Conference in Saskatoon. The Conference was well attended and Delegates provided substantive information around working conditions, which will assist the Negotiations Committee in bargaining a new collective agreement in 2018.

Each year, HSAS conducts an online survey with members to gather information about their workplace and issues. Through the collection of such information, Executive Council plans goals to meet the needs of members. Since April 2012, I have served on the SHEPP (Saskatchewan Healthcare Employees’ Pension Plan) Union Partner Committee, representing HSAS. Other Union Partner Committee members include representatives from SUN, SEIU, CUPE, SGEU. This past year, I also chaired the Governance Committee.

I wish to welcome the newly elected members of Executive Council. These individuals have been elected to serve the HSAS Membership.

They will assume the responsibility of representing members of their professional group or composite group and will participate fully in the decision making process of HSAS – as advocates for the Saskatchewan public and for the specialized health care all of our members deliver on a daily basis.

I wish to thank and acknowledge the dedication and hard work of the outgoing Executive Council members, Committee members, and staff.

They have worked diligently, serving the membership of HSAS. I look forward to this coming year and the opportunity to serve our members. We must continue to embrace opportunity when it arises and meet the challenges of the future directly.

EXECUTIVE DIRECTOR’S

REPORT TO ANNUAL CONVENTION

The Executive Director report provides an overview of a range of topics and issues related to the operational or labour relations side of the organization that have transpired during our last fiscal year (September 1, 2016 to August 31st, 2017).

Bargaining Our main Collective Agreement with SAHO expires at the end of March 2018. Information pertaining to the bargaining of this Collective Agreement is covered within the Negotiating Committee report. The bargaining activity within our private groups over the past year is outlined below.

Canadian Blood Services Notice to bargain was sent to CBS on February 13, 2017. CBS responded with a request to negotiate an essential services agreement prior to beginning bargaining. Although the Saskatchewan Employment Act allows for the parties to negotiate essential services at any time, it is not considered a pre-requisite to bargaining.

The LRO involved with these negotiations is continuing discussions with CBS on this matter.

Crestvue Ambulance Services LTD. Notice to bargain was sent to the Employer on March 17, 2017.

La Ronge EMS Through nine bargaining dates within the last 38

fiscal year, the bargaining team has reached a tentative agreement. The tentative agreement was signed on July 25th and will be presented to the Executive Council for approval in our upcoming meeting in September. If approved at the Executive Council level, the tentative agreement will then be presented to the La Ronge membership for a ratification vote.

North-East EMS Notice to bargain was sent to the Employer on February 10, 2017.

Market Supplement News We are quite pleased to announce that the adjudication for the classifications of EMT, EMT Coordinator, EMTA and EMTA Coordinator that was scheduled to be heard by Adjudicator Beth Bilson was settled at the midnight hour only days before our August 24th hearing date. A 3.43% market supplement boost to the above titles was agreed upon by the parties with retro dating back to July 2014. Beth Bilson has been retained by the parties to deal with one remaining issue in this file which will be dealt with through the hearing process in mid-December 2017. HSAS is claiming that the 3.43% should be applied to ALL titles that fall under the EMS classifications in our Collective Agreement, as to not do so would be a contravention of Letter of Understanding #12 and it would alter the current salary rate percentage differentials that are in place for the group. The Employer is not in agreement with our position. In the coming weeks HSAS will be sitting down with the Employer to get a breakdown of

This recommendation inspired the Government to request feed back from all stakeholders involved in EMS within the province. HSAS being the representative of a majority of the employees in EMS within the province allowed us the opportunity to meet with Government representatives, as well as present a document outlining our position on many of the issues faced within EMS in July of this year. Unfortunately, to date, it remains shrouded in mystery as to whether or not, and to what extent, the Government intends to make changes to these services and how they are currently being delivered within the province.

Lastly, we have the topic of lay-offs. Lay-offs are not a positive for our members or for the residents of Saskatchewan who are expecting service. HSAS members have been significantly affected by layoffs since June 2017. To the end of August, thirty-nine of our members have received lay-off notices, five of which are within our private contract with Canadian Blood Services. An additional nine employees have been affected through the displacement process to date. The Health Educator classification has been hit the hardest with 85% of the total hours within fourteen positions being affected. Our LROs will continue to ensure that any member affected will have all of their rights respected as per the language in article 26 regarding lay-offs.

Grievances & Arbitration The tracking of grievances continues since being implemented in October of 2015. Currently, we have sixty-three grievances that are still unresolved from previous years and from

the fiscal year of 2016-2017. In the fiscal year between September 1, 2016 and August 31, 2017, we have filed sixty-three grievances and have resolved twenty-six of these files within the same time period. This gives us a resolution rate of 41% this year which is a 7% boost from last year.

The most notable arbitration decision that we can certainly claim victory on this year was a grievance that was filed on behalf of three employees alleging that the Employer had failed to pay them for time worked in excess to their regularly scheduled work day. In other words “Overtime”. I am including an excerpt below from the Arbitrator’s decision because it outlines what many of our members seem to be facing on a daily basis.

“The Board concludes that under this collective bargaining agreement the failure to obtain authorization does not, in itself, remove the obligation of the Employer to pay the overtime if the hours have been worked as long as the reason for working the additional hours are appropriate.

Certainly there may be circumstances under this contract in which an employee works overtime without pre-authorization and the Employer is justified in refusing to pay. Our conclusion is not an open-ended declaration that employees can self-direct overtime whenever they want. For example, the Employer might well be on solid grounds in declining to pay overtime if there is evidence that employees attempted to “game” the system by engaging in unnecessary make-work projects or consciously procrastinated during the regular work day to create unnecessary overtime. These are not the current facts. The Grievors worked beyond their

regular hours because that was the only way to complete their charting, an essential component of their obligations as health care professionals.

They were faced with a Hobson’s choice – work overtime even though they were led to believe they would not be paid or leave on time and neglect their professional responsibilities. They chose the former out of conscientious and professionalism. The lack of pre-authorization is no barrier to payment in these circumstances.”

COMMITTEE MEMBERS Braden White, EMS, RQHR The 45th Annual Convention will take place at the Hotel Saskatchewan in Regina, on October 26th and 27th, 2017. This year’s Convention is expected to have approximately 60 attendees.

Planning for the 2017 Annual Convention began late in 2016. The topics covered this year are differing in nature, however the diversity is welcome given the uncertainty we may face with the Health Authority Amalgamation.

Our speakers will be Lori Johb, Neal Kewistep, Erin Beckwell, Jason Jarotski, and Charles Smith. I would like to thank everyone who helped make this Convention a success.

This committee was an ad hoc committee formed to assist the Negotiating team with organization of the 2017 Bargaining Conference.

The convention was held at The Delta Bessborough Hotel in Saskatoon May 25 and 26. Forty-three members from across the province were in attendance, as well as members of HSAS Executive Council, the Negotiating Committee and HSAS staff.

Charles Smith, Political Science professor at the University of Saskatchewan, presented an “Environmental Scan” that examined the social, political and economic circumstances in which bargaining will take place. Those in attendance were also presented with an overview of the collective bargaining process and with the results of the HSAS members’ bargaining survey. Discussion and breakout sessions were facilitated by Jared Tabler. A dinner and social was held on the evening of May 25 at Boffins Public House.

Internally, the Committee works to ensure that the membership of HSAS is provided with accurate and timely information and externally, the Committee works to ensure that the public, the media and other stakeholders are made aware of the concerns of the HSAS membership.

In the late summer of 2016 the annual HSAS membership survey was conducted, which assisted in identifying areas of member satisfaction and concern and for future planning.

The annual membership survey has consistently rated the HSAS website as highly important.

Since the launch of the new HSAS website 2 years ago, the Communications Committee has continued to evolve the website into a functional and meaningful tool and source of information for all HSAS members, and visitors to the site.

In response to the need for increased public awareness, the Communications Committee has continued to build upon the Blue/Green branding campaign. This included profession specific advertisement placement on public transit and within public buildings In addition, an Understaffing awareness campaign which was initially launched in November of 2015 with the production of an Understaffing -focused television commercial was extended. The commercial has been shared on Facebook, YouTube, movie theatre pre-shows, and on the HSAS website. In conjunction with the Understaffing commercial, the President of HSAS was interviewed for 6 weekend radio time slots on CJME’s ‘Talk to the Experts’ radio program. Once again, HSAS voiced concerns about the effects that understaffing, program cuts and loss of services have on the ability of our members to deliver an appropriate level of quality services when needed by the public. The final two sessions of the program drew attention to program cuts and position layoffs, which followed the spring 2017 provincial budget.

A public perception survey was also conducted in the summer of 2016. It polled the Saskatchewan public on their awareness and prioritization of the services HSAS members deliver across the province. The Governance Committee met four times this fiscal year of 2016-2017.

When Government announced the amalgamation of 12 health authorities into one provincial authority, the Governance Committee reviewed the Constitution and Bylaws to assess the effect on the Bylaws.

There are references made to health regions within the Bylaws and the nomination and election of delegates to Association meetings by health region (Articles 3 and 9).

In conjunction with legal counsel, language was drafted which could address the move to a single health region. On October 27th, the recommended amendments were presented to the Executive Council for consideration and approval prior to presentation for approval, by the Delegates to the 2017 AGM. To ensure that opportunities continue to exist for fair representation at Association Meetings by delegates province-wide, the current geographic areas would remain (current health regions), but would be referred to as “Union Regions� with each Union Region assigned a number. The process of nomination and election of delegates would not change, but the geographical area name would change.

Clarification on wording as to who is eligible to attend Association Meetings was also recommended.

As such, the definition of Active Member was clarified.

The Resolution was approved by Executive Council to be presented to the Membership for consideration and approval. The Executive Council is recommending approval for the proposed Resolutions.

The Resolution outlining the amendments is to be presented at the 2017 AGM on October 27th.

Continuing Education Fund

The Education Fund was established at the October 1990 Annual Convention. The purpose of the fund is to provide financial assistance to members who partake in an educational event directly related to their present position.

Ron Currie Award

Established in 1985, this $500.00 scholarship is awarded to a Pharmacy student in the College of Pharmacy at the University of Saskatchewan. The award recognizes Ron’s leadership in guiding the formation of our union. The recipient is chosen by a committee representing the Faculty of Pharmacy, HSAS and the Pharmacy Students Society.

The recipient of the Ron Currie Award in 2017 is Taylor Raiche. ii)

Silver Anniversary Scholarship

The 1997 Annual Convention established scholarships to mark the 25th anniversary of the Health Sciences Association of Saskatchewan. Twenty (20) five hundred dollar ($500) scholarships are awarded to a spouse or dependant of a Health Sciences Association of Saskatchewan member enrolled in full-time studies at a post-secondary educational institution leading to a degree, diploma or certificate. This fiscal year we had thirty-eight (38) applicants.

Roberta Ekberg Award

This award was established at the 2003 Annual Convention to recognize Robert Ekberg’s contributions and long standing commitment to HSAS. An award of five hundred dollars ($500.00) is provided to an HSAS activist, HSAS employee or HSAS legal counsel who has contributed to furthering the visions and interests of HSAS. Nominations for this award will be accepted no later than August 31 of each year. Maureen Kraemer was nominated in the 2016-17 fiscal year.

Emergency Fund

Two (2) members received funding from the Emergency Fund this year. They received $500.00 each.

F.

Warren Chykowski Memorial Award

This award is to honor the memory of Warren Chykowski as a valued Member to HSAS for all that he accomplished during his years involved with the Union. In his memory HSAS would like to encourage Respiratory Therapy students to stay in or relocate to Saskatchewan, and become a Member of HSAS to follow in Warren’s footsteps. One (1) $500 award winner is chosen per year.

The Chair of the Grievance Committee and members of the Grievance Committee are appointed yearly following the Annual Convention.

The Grievance Committee met in February 2017 for a brief presentation and review of the terms of reference. The committee met again in April 2017 for a deliberated and appealed grievance.

The wheels were set in motion in January to begin preparing for our next round of bargaining. On January 20th, 2017 HSAS sent out a call to the membership, inviting any active member interested in serving on the Negotiating Committee during the next round of bargaining, to submit their application. As the Chief Negotiator/Negotiating Committee Chair, I had the difficult task of reviewing the applications, granting interviews and determining the makeup of our team, based on the parameters set out in our terms of reference. The Negotiating Committee for our next round was finalized at the end of February 2017 and is composed of myself and the members as listed above.

With our Committee in place, it was then time to survey the membership to identify members’ issues within their workplaces and to obtain their opinions on multiple articles within the current Collective Agreement. Our Bargaining Survey was emailed to the membership on March 10th, 2017 and garnered close to six hundred responses.

Results gathered from the Bargaining Survey were analyzed and then presented to the Delegates at our Bargaining conference which took place on May 25th and 26th at the Delta Bessborough in Saskatoon. The members who attended also had the opportunity to hear speaker Charles Smith who provided an environmental scan of Saskatchewan’s political climate and the current bargaining environment. Conference delegates participated in a number of group discussions topics that were moderated by facilitator Jared Tabler. This process allowed HSAS to create a list of ten priorities that the Negotiating Committee will be able to concentrate on when formulating

Later in July of this year all of the appointed Negotiating Committee members took part in a three day training session called “Union Contract Negotiations�. The session was delivered by Canadian Professional Management Services who, for twenty years, have been in the business of creating training programs for union related business. All of our Committee members who attended had rave reviews of the training as it gave them insight into what they may experience at the table within the next year.

In closing, I would like to thank all those who applied to be on the Negotiating Committee this year as well as all the members who took the time out of their busy schedules to answer our bargaining survey and attend the bargaining conference.
