The HSAS and SAHO Bargaining Teams have met May 20 and 21 and June 10 and 11. Additional dates have been scheduled for July 27, 28 and 29 and August 17, 18 and 19.

The first four (4) days of meetings were devoted to reviewing one another’s proposal package and exchanging counter proposals. We are pleased to report SAHO has not put forward any significant take-aways, however, they have made it clear they must negotiate within the government’s mandate of 0%, 1%, 1%. As a result, proposals with financial implications will not be discussed until all non-monetary items are dealt with.

We can report progress has been made on the following: ▪ Seniority calculation for standby hours ▪ Professional provisions ▪ Provision for those members who are disabled ▪ Language improvements to several non-monetary articles throughout the Collective Agreement including; disciplinary documentation, request for leaves of absence and access to the Federal Compassionate Care Benefit Program.

Major issues that are contentious and where agreement is outstanding include; wage parity with nurses, classification issues, professional development, vacation leave, precepting students, Family Responsibility Leave, access to benefits for standby workers, meal and transportation allowances to name a few.

Preview of Proposed Amendments to the HSAS Constitution and By-Laws The Constitution and By-Laws of the Health Sciences Association of Saskatchewan (HSAS) were originally approved by the HSAS membership on April 8, 1973 (with subsequent minor amendments being approved over the years).

Given the age of the current Constitution and By-Laws, and in view of apparent procedural inadequacies, HSAS’s Executive Council decided to conduct a review of the Constitution and By-Laws to determine whether those documents adequately reflect the current needs and intentions of HSAS and its members.

The review demonstrated a need to revise and modernize HSAS’s Constitution and By-Laws. The number of HSAS members has grown significantly over the past 30 years and the Constitution and ByLaws do not provide processes suited for an organization with a large membership. Further, the Executive Council also found that the fragmentary nature of the amendments over the years has led to inconsistencies. Accordingly, the Executive Council has undertaken an extensive revision of by-laws with a view to coherence, consistency and modernization.

What Role do the Constitution and By-Laws Play in an Association?

Broadly stated, an association’s constitution and by-laws are a type of ‘contract’ which sets out: (a) members’ rights and responsibilities in relation to each other and their organization; and (b) The policies, principles and rules that will govern the operation of their organization.

Essentially, the ‘constitution’ describes an association’s reason for existence and usually sets out the primary purposes and objectives of an association. Other things, such as the name and head office of the association, are also normally included in the constitution. No changes are being proposed to the Constitution of HSAS. An association’s by-laws are usually more detailed than the association’s constitution. Generally, bylaws set out an association’s organizational structure and decision-making procedures. An association’s by-laws also normally include provisions relating to membership eligibility, the conduct of meetings and elections, the responsibilities of elected or appointed officials and financial affairs. In this manner, by-laws provide operational guidance to the elected officials and the members who comprise the association.

Summary of the Substantive Amendments (a) The Move to Representative Democracy and Proportional Representation The current by-laws provide that all active members of HSAS can attend the Annual Convention and Special Meetings to vote on resolutions. Further, the current by-laws require 10% of the membership be present at such meetings in order to conduct a vote. Unfortunately, we have not attained quorum at Annual Conventions as 10% of our membership would be around 250 members.

The proposed by-laws do not eliminate the right of any HSAS member to attend meetings. However, only the delegates elected by the members of each Health Region, on a proportional basis, will be allowed to vote at meetings.

It is common for associations of this size to move towards delegate voting systems. Such a system should ensure greater representation and attendance at meetings and greater ease of conducting votes. (b) Making the Executive Council More Accountable to the Membership The current by-laws do not place explicit duties on members of the HSAS Executive Council. In contrast, the proposed by-laws will place express duties on such members to help facilitate accountable leadership which balances the interests of HSAS as a whole with the interests of the particular groups comprising HSAS. (c) Effective Management of Vacancies on Executive Council During times of vacancies on the Executive Council, the proposed by-laws empower the remaining members of Executive Council to appoint a member to represent the group whose seat on Executive Council has been vacated. This procedure provides a speedy and effective method of ensuring continued representation of the interests of all members in the Executive Council until the next annual election.

The proposed by-laws also ensure that a full nomination and election process is undertaken where more than one year remains in the term of a vacant position. (d) Moving to Coherence, Consistency and Modernization The proposed by-laws clarify and add conceptual and thematic consistency to the subjects covered under the current by-laws. For instance, in the current by-laws, the constitutional amending procedure is compiled by piecing together the contents of two separate clauses located in different sections of the by-laws. By placing the entire amending procedure under one specific heading, the proposed by-laws create greater consistency and certainty. Since the attempts at consistency and certainty are combined with clear, modern language, an HSAS member does not have to be a lawyer to decipher the propsed by-laws. The move to consistency, clarity and certainty is followed throughout the proposed by-laws.

The ‘notice’ provisions of the current by-laws also demonstrate the need for modernization. As it currently stands, the by-laws only contemplate the ability to send notices to members by ordinary mail.

The proposed by-laws make it possible to send notices by facsimile or other means of electronic communications, such as e-mail. The possibility of electronic notification was not contemplated when the original Constitution and By-Laws were drafted in the 1970’s. (e) Restructured Disciplinary Process The proposed by-laws do not change the offences that a member can be disciplined for. However, they do change the procedure for laying, investigating and hearing a charge. The proposed by-laws clarify the required factual basis required to lay a charge by making it necessary for a member to have “reasonable grounds to believe that another member has committed” one of the acts outlined above prior to laying charges. Further, the proposed by-laws clarify that the President, acting on behalf of HSAS can lay a charge and, once a charge has been laid against a member, the proposed by-laws empower the Executive Council to appoint an investigator, who may be a member or non-member of HSAS, to conduct a preliminary investigation into the charges.

The Opportunity for Change As noted above, the existing Constitution and By-Laws were originally approved over 30 years ago.

Since then, membership in HSAS has grown. A new decision-making structure which contemplates representative democracy and proportional representation for all Health Regions could prove more efficient, effective and democratic.

In August, the HSAS membership will receive the full text of the proposed amended by-laws and can expect informational meetings to be held between September 9 and October 6 with a view to submitting

the proposed new Constitution and By-Laws to the fall Annual Convention on November 20 for approval by the membership. Given the importance of HSAS’s Constitution and By-Laws, members should carefully consider the opportunity for change that now falls before them.

Note: In accordance with the current HSAS Constitution and By-Laws, Executive Council approved the above-noted changes by the required three-fourths [3/4] of those present at their June 8 & 9, 2004 meeting. Additionally, the Board of Governors approved the changes by the required simple majority.

In order for these changes to take effect, two-thirds [2/3] of those attending the November 20th Annual Convention must approve them.

Saskatchewan Budget Cuts Affect HSAS As a result of the Saskatchewan Government’s budget cuts to Health Regions, HSAS positions are being impacted either through vacancy elimination, hour reductions or position abolishment. The magnitude of the impact is not known at this time but is expected to be no more than approximately fifteen (15) positions province-wide.

For example, in Saskatoon, two (2) full-time HSAS vacancies are being eliminated, two (2) full-time HSAS members are being laid off and one (1) HSAS member is having her hours reduced for a total reduction of 4.14 FTE’s.

Reductions in the Saskatoon Health Region for other groups are as follows: SEIU—25.33 FTEs SUN—2.5 FTEs Out-of-Scope—11.20 FTEs. The HSAS Collective Agreement has comprehensive lay-off language (Article 26) which ensures the most senior HSAS members will maintain employment. HSAS Labour Relations Officers will be contacting those affected by lay-off to assist them through the process.

Our next edition of Dispatches will have a province-wide breakdown of HSAS positions impacted by budget cuts.

Are Reductions in Extended Health and/or Enhanced Dental Benefits a Possibility?

The six (6) health care unions [HSAS, SUN, SGEU, CUPE, SEIU AND RWDSU) have been notified that benefit reductions to our Extended Health and Enhanced Dental Plans will take effect October 1, 2004 unless more money is put into the Plans.

As a result, the unions have requested a meeting with Premier Calvert to discuss the situation and hopefully develop a plan to deal with the funding shortfall.

In 1999, the health care unions negotiated funding for the Plans based on 2.1% of straight time payroll paid by the employer. From the Plans’ inception, funding and usage have been tracked separately for each union. These statistics have demonstrated that both HSAS and SUN contributions have exceeded their membership’s usage creating a surplus; whereas CUPE, SEIU, SGEU and RWDSU usage numbers have exceed their contributions creating a deficit.

If government refuses to provide additional funding to maintain current benefit levels, HSAS and SUN have requested SAHO not to reduce benefits for their memberships as both unions have sufficient contributions to cover their usage.

To date, SAHO has not responded. We will keep you informed of any developments.

Continuing Education Fund The Continuing Education Fund was established at the October 1990 Annual General Meeting with the purpose of promoting continuing education in areas directly related to one’s present position.

A lottery system is used to select applicants with five (5) names drawn on October 1st and five names on May 15th of each year. Successful applicants are eligible for a maximum of $500.00.

25th Silver Anniversary Scholarship Award The 1997 Annual Convention established two (2) $500.00 scholarships to mark the 25th Anniversary of our union. The scholarships are awarded annually to a spouse or dependent of an HSAS member enrolled in full-time studies at a post-secondary institution leading to a degree or diploma in an area of study currently represented by HSAS. Completed application forms must be received at the Saskatoon or Regina office no later than July 31st for the upcoming school year.

Upcoming Events HSAS Constitution and By-Law Amendments The HSAS Constitutional Committee will be mailing HSAS members their proposed changes to the HSAS Constitution and By-Laws in August 2004. The Committee will follow the mail out with a series of membership meetings throughout the province from September 9, 2004 to October 6, 2004 to explain the changes.

The meeting schedule will be mailed out in August along with the proposed Constitutional and By-Laws amendments.

HSAS Annual Convention The HSAS Annual Convention will be held on Saturday, November 20, 2004 at the Delta Bessborough Hotel in Saskatoon commencing at 1:00 p.m.

HSAS Regional Council Training / Orientation A Regional Council Training/Orientation session will be held at the Delta Bessborough Hotel in Saskatoon commencing 1:00 p.m. Thursday, November 18, 2004 and concluding at noon on Saturday, November 20, 2004.

This training/orientation will be open to HSAS members active in their Regional Council or HSAS members in Regions where no Regional Council exists but who have an interest in establishing one.

Additionally, members who attended the first orientation session and are still active in their Regional Council are encouraged to attend.

More information on this training/orientation opportunity will be available in our Fall 2004 edition of Dispatches.

Member Resolutions and the Annual Convention You will note under Upcoming Events that our Annual Convention will be held Saturday, November 20, 2004.

The HSAS By-Laws provides for members attending the Annual Convention to accept or reject resolutions by a simple majority. (This excludes proposed changes to the Constitution and By-Laws—see Note below.) To ensure the whole HSAS membership is aware of what resolutions will be discussed and voted on at the Annual Convention, Executive Council requests members to mail, fax or email the Saskatoon HSAS office with their resolutions and rationale no later than September 3, 2004.

Resolutions so received will be placed in the Dispatches mailed out prior to the Convention.

Note: Special protocol for proposed changes to HSAS Constitution and By-Laws: Any resolution proposing a change to the HSAS Constitution or By-Laws must first be approved by three-fourths of Executive Council and by a simple majority of the Board of Governors. Upon being approved by both bodies, notice of the proposed change to the Constitution or By-Laws is then provided to the membership fourteen (14) calendar days prior to the Convention.

In order for the resolution to come into effect, those attending the annual Convention must pass it by two-thirds.

The Role of Regional Councils In consideration of the history of HSAS, the idea of Regional Councils (formerly District Councils) is relatively new. What would be the significance and role of Regional Councils if they did not exist earlier? A quote from the March 21, 2003 minutes of the District Council Development Committee stated that: “Some of the historical factors that necessitated the creation of smaller local councils responding to local need included: the formation of Health Districts, an increasing desire expressed by employers for local HSAS representation on union/management committees and an increasing expectation from HSAS members for representation at the local level. In the year 2000, tentative terms of reference were first put together. From the onset the intention of those supporting District Councils was to create system of local representation that would complement rather than detract from Executive Council and Labour Relations Officers. Central to this notion was the democratic selection of District Council representatives and ultimately the creation of a democratically selected system of workplace representatives.”

Further considerations to the above would be the tremendous expansion of HSAS as a result of the Dorsey Commission. The Commission’s recommendations adopted by government in January 1997, increased the number of professions in HSAS and expanded its representational rights from Prince Albert, Saskatoon and Regina to the entire province. Furthermore, the attempt to educate, implement and regulate the HSAS Collective Agreement through at least 12 major employers (Health Regions) is vastly challenging.

Implementation of Collective Agreement Without ongoing review and appraisal by HSAS the implementation of the Collective Agreement is therefore entrusted to the respective employer. The need for a delegate(s) or presence of Executive Council is therefore needed to represent HSAS at the local level. With the development of the local Regional Council this presence of the union is defined. Article 27 of the Collective Agreement defines the structure and terms for Management-Union Committee meetings. Once established by the Regional Council such meetings provide a forum for problem resolution presented by either management or an HSAS member. Challenges that can affect a Region’s membership can be an interpretation in the issue of the Collective Agreement, Regional policies and protocols, communication systems, and miscellaneous problems.

Communications and Structure The Regional Council through ongoing sharing of meeting minutes to Executive Council, the Labour Relations Officer, and the President maintains communication within the overall organization. Therefore the role of the Regional Council can very much complement the role of the Labour Relations Officer. The Regional Council through its network of members can acknowledge, appraise and in turn consult the Labour Relations Officer for direction, planning or follow up. Furthermore, the Regional Council can maintain a vigilance for the proper implementation of the Collective Agreement and other issues affecting the membership of a certain region. This defines a presence of HSAS in a region, The capacity of a Regional Council to advocate on behalf of Executive Council and the Region’s membership is greatly enhanced by the structure defined in Article 27. It is through such positive dialogue and consultation that our presence in not only defined but also who we are. The respect and integrity of our Union is not defined in Collective Agreements but in the day to day front line interaction of our members with the employer. Through the forum of Regional Councils and the capacity to resolve local issues with consultation and dialogue overall credibility and integrity is developed. This is the presence that is essential.

Regional Council News Five Hills Regional Council The SEIU Hall has been booked for Thursday, September 9, 2004 for the HSAS Five Hills Regional Council Annual General Meeting (AGM). There will be a supper followed by a social either at the hall or at Dooley’s. The AGM and supper are for HSAS members and spouses are invited to attend the social following.

The meal will be catered by Super Meats and we will need numbers confirmed by late August. The supper and AGM will begin at approximately 5:30 p.m. More information to come by late August. Please mark your calendars for this important and fun event.

Prince Albert Parkland Regional Council Highlights of the most recent HSAS –Management Meeting that took place on June 14 2004 would be concerns and details regarding the Attendance Support Policy, the EFAP Program, Communication via PAPHR network and HSAS Orientation.

In regard to the Attendance Support Policy, the letter submitted by our Regional Council was taken to Management Council of PAPHR and the policy was supported. A recently developed committee in our region called Workplace Advisory Group (WAG) also recently reviewed this policy and there was general support by this group. To date there have been no grievances on policy or its application. The policy had minor wording changes as a result of the Workplace Advisory Group suggestions/recommendations.

HSAS indicated concern with the 56 hour standard for sick leave use. Management will continue to monitor the program.

In regard to the EFAP development, the selection committee (for potential service providers) and unions requested that if the employer would commit to a higher level of funding, unions would be willing to cost share (but less than 50-50). Employer has agreed to commit $40,000 annually from the Wellness Fund.

Management is committed to the EFAP to support Attendance Support and other ventures (OH&S).

Participating unions are HSAS and CUPE and at present it is hoped that SUN can fully participate in the region’s EFAP. The idea of using the Region’s Email network to communicate with HSAS members gained approval from management with certain conditions. An Email network developed directly to HSAS members and also to HSAS supervisors/managers could be developed for relaying common information such as HSASManagement meeting minutes, Collective Agreement interpretations, policy updates, etc. HSAS to review with Human Resources any information to be sent via this network.

In regard to HSAS orientation upon new hire, management reported that a pilot session pertaining to general orientation took place in April with a revised orientation procedure to be developed and expected to be in place by fall. This orientation will include time for unions to meet with new members and go through the Collective Agreement, membership information, etc.

As for other highlights of our Regional Council, one would be that a new meeting time has been tried. A July 2004

meeting time of 4:30 p.m. has been successful in allowing our Regional Council to meet and not be pressured to return to the work place after the past noon hour meeting times. The next date for our Regional Council to meet will be on September 16, 2004 in the Addiction Services office small boardroom. Prominent on the agenda for that meeting will be planning for the Annual General Meeting that will take place October 6, 2004.

Saskatoon Regional Council The next meeting of the Saskatoon Regional Council will take place Thursday, September 9, 2004 in the 2nd floor Boardroom at Saskatoon City Hospital commencing at 7:00 p.m.

Members of the HSAS Constitution Committee will be in attendance to discuss proposed changes to the HSAS By-Laws.

Executive Council Changes A. Changes to Two (2) Composite Seats At their June 8 & 9, 2004 meeting, Executive Council approved changes to the composition of two (2) seats to ensure a more equitable number of members are represented by each. These changes will take effect November 2004.

Prior to the change, the seat for Dental Hygienists/Therapists, Dietitians, Health Educators and Nutritionists represented 235 members. Commencing November 2004, this seat will represent 134 Dietitians and Nutritionists. Additionally, prior to the change 85 Public Health Inspectors and Infection Control Practitioners are represented by one (1) seat. However, in November 2004, this seat will also represent Health Educators and Dental Hygienists/Therapists for a total of 185.

Both of these seats will be up for election this Fall.

The vacancies resulting from the departure of Dianne Lieffers and Roger Piatt will be filled through Executive Council elections held this fall.

On behalf of Executive Council and the members Brenda, Dianne and Roger represented, we thank them for taking on the duties of an Executive Council member and for their many contributions to Council and the committees they were involved with.

Attention All HSAS Members Hired From Outside the HSAS Bargaining Unit On page 110 of the HSAS Collective Agreement is the heading entitled “Special Provisions for Retention and Recruitment”.

Item #2 delineates what entitlements earned outside the HSAS bargaining unit an employee can bring with them upon gaining employment with an employer covered by the HSAS Collective Agreement. In order to qualify for this transfer of entitlement, two (2) conditions must be met: 1. The previous employment must be relevant to the position obtained within the HSAS Bargaining Unit and 2. The employee must have obtained employment with an employer covered by the HSAS Collective Agreement within ninety (90) days of terminating from their former employer.

If these two (2) conditions are met, the employee may be eligible for: (a) Transfer of unused sick leave credits up to a maximum of thirty [30] days, [two hundred and forty (240) hours] (b) Recognition of most recent vacation accrual rate, up to the maximum allowed by the SAHO/HSAS Collective Agreement.

Verification of entitlements from previous employers shall be the responsibility of the employee.

In any event, all new employees will be credited with an initial five [5] days [forty (40) hours] of sick leave credits.

HSAS Paramedic Recognized On Sunday, May 16, 2004, Her Honour the Honourable Dr. Lynda Haverstock presented Anthony Huckaby, a Paramedic in Melville, with the 2004 Stars of Life Award and the Governor General of Canada’s Emergency Medical Services Exemplary Service Medal.

The Stars of Life Award and the Governor General of Canada’s EMS Exemplary Service Medal represent the accomplishments of Emergency Medical Services professionals who have excelled in community relations, over coming adversity or just going that extra mile with their community or colleagues.

HSAS is proud to call Anthony one of our members and on behalf of the HSAS Executive Council, Board of Governors and staff, we extend our congratulations on your achievement.

The Executive Officers are elected from and by Executive Council for a one (1) year term except the President, who is elected for a two (2) year term by the general membership.

The Board of Governors provide guidance and counsel to Executive Council on all matters regarding administration of the Union. Any member having served at least four (4) years on Executive Council, at least two (2) of which as an officer, shall be eligible for election to the Board of Governors for a seven year term.
