HSAS Receives Two Favourable Arbitration Decisions First Decision Compensation for Working a Third Weekend Background On February 6, 2004, HSAS filed a grievance over the failure of Regina Qu’Appelle Health Region to compensate HSAS members working any third Saturday or Sunday as required by Article 15.04(b)(ii) of the HSAS/SAHO Collective Agreement (April 1, 2001 to March 31, 2004). Since no satisfactory resolution was put forward by the Health Region an arbitration hearing chaired by Dan Ish was held May 26, 27 and July 12, 2005 in Regina. Arguments The position put forward by the Employer was that a Letter of Understanding between the employer and CUPE dated from 1983 superseded the current language in the Collective Agreement. In addition, the employer argued that in order to be eligible for overtime rates for the third Saturday or the third Sunday a member would have to be “required” to work three weekends in a row. Where members “voluntarily” accepted overtime during the first or second weekend, the employer maintained that the member was not “required” to work three weekends and therefore not entitled to premium rates for the third Saturday and/or third Sunday.
