Successfully handled a multi-milliondollar lawsuit involving breach of contract and tortious interference claims against a former employee and their new employer. After defeating a motion to dismiss, the team secured a highly favorable settlement, preserving key contractual protections and delivering a strong outcome for the client.

Successfully defended against a nationwide wage and hour collective action under the Fair Labor Standards Act. By applying recent appellate precedent, the team secured dismissal of all out-of-state putative collective members at the motion to dismiss stage. This significantly narrowed the scope of the litigation, reducing the potential exposure by approximately 90 percent. (Tecomet)

Represented a company and its owner in litigation brought by a former executive claiming entitlement to a substantial equity stake during a sale transaction. Achieved dismissal of the executive’s claims on jurisdictional and substantive grounds, and pursued a multi-million-dollar countersuit for breach of employment obligations. Defended against multiple wage and hour class and representative actions over an extended period. Implemented a strategic defense that led to early dismissal of one case with a settlement paid by the plaintiff, removal of remaining actions to federal court, and dismissal of all class claims based on enforceable arbitration agreements— reducing potential exposure by 75 percent. Provided strategic counsel to a company’s Board of Directors during the departure of two senior executives. Led the negotiation and preparation of key separation documents under a compressed timeline to ensure completion ahead of the public announcement. (Avertix Medical)

Represented automotive supplier before the U.S. Court of Appeals for the Sixth Circuit, which affirmed the dismissal of a USERRA claim based on a shortened contractual limitations period; Oswald v. BAE Industries, Inc., 2012 WL 1700704 (6th Cir. 2012).
