There’s no need to curb your enthusiasm -By Harvey Mackay

The old cartoon strip character Calvin, of Calvin and Hobbes, once said the difference between him and the rest of the world was that ... “Happiness isn’t good enough for me!

I demand euphoria!”

Calvin is right. You must live with enthusiasm.

It’s one of the most important attributes to success.

One of life’s greatest tragedies is that the curiosity, enthusiasm and excitement about life that we are born with seem to erode as the years go by. When the challenges of daily life get in the way, it is easy to spend more energy on putting out little fires than on sparking enthusiasm for overcoming those challenges.

Henry Ford once said, “You can do anything if you have enthusiasm ... Enthusiasm is the spark in your eye, the swing in the gait, the grip of your hand, the irresistible surge of your will, and your energy to execute your ideas. Enthusiasm is at the bottom of all progress.

With it, there is accomplishment. Without it, there are only alibis.”

You may recall Henry Ford’s early struggles to make his fledgling company successful. His enthusiasm for building mass-produced cars that many middle class Americans could afford to buy revolutionized transportation and American industry. Enthusiasm prevented him

from giving in to setbacks and pressure.

When my own enthusiasm wanes, and it sometimes does, I look for inspiration from three of my favorite resources. Their advice is timeless and farreaching. And it is well worth revisiting any time you feel your spirit flagging.

“Enthusiasm is the priceless quality that makes everything different. The men and women who achieve the most are invariably inspired by enthusiasm.

They approach life, its opportunities, and its problems with this vital characteristic,” said Dr. Norman Vincent Peale, author of “The Power of Positive Thinking.”

“Flaming enthusiasm, backed up by horse sense and persistence, is the quality that most frequently makes for success,” according to Dale Carnegie, one of the most successful inspirational writers of all time. Do you know his books “How to Win Friends and Influence People” and “How to Stop Worrying and Start Living”? They are great first steps to cultivating enthusiasm for living.

Napoleon Hill, another of my favorite authors, says in his classic work “The Laws of Success in 16 Lessons,” that enthusiasm in life is an essential ingredient for success. Enthusiasm energizes, refreshes and motivates the person endowed with it.

Hill says some people are born with a natural enthusiasm, and some people have to develop it. How? Simple, he says. Work at something you love.

That’s easier said than done, you might say. But you can be enthusiastic in practically anything you do, no matter how mundane. Perhaps the job has aspects that you truly hate. Maybe the

office is unattractive. But the people there are top-notch. You’re learning and contributing. And change is possible.

Attitude is key.

No matter what your situation, negative thinking will not improve it. Focus on the positive, even if it is a small thing.

Train your brain to look for the silver lining, and then be amazed at how your improved attitude leads to enthusiasm.

Let me tell you a story that my friend, the late Charlie “Tremendous” Jones shared with me about a guy who dreamed he inherited a million dollars.

He dreamed he went to take a shower that morning and the shower wouldn’t shower. He started to shave and the shaver wouldn’t shave. He went to get some coffee and the coffee wouldn’t perk, and the toaster wouldn’t toast. He Harvey Mackay continued to pg 3

Just then the man woke up. And he went and had a tremendous shower and a tremendous shave and a tremendous cup of coffee and a tremendous piece of toast. He read a tremendous newspaper and caught a tremendous bus to a tremendous job!

What a difference it makes when we are learning to get excited about the work we have today!

The Grey Eagle Senior Center is planning a “Halloween Pot Luck Party” for Tuesday evening, October 30th, at 5:00 p.m. Everyone who is 55 years of age or older are invited to attend.

Please bring a “dish to share” and, to add to the fun, you’re invited to come

Obituaries James A. “Jimmy” Hamann

Redeemer Lutheran Church in St. Cloud.

Jimmy farmed all his life. He enjoyed deer hunting, fishing and his dogs. He especially enjoyed spending time with his family and friends.

Jimmy was a member of Our Savior’s Lutheran Church in Albany.

Survivors include brothers, Gilbert (Gloria) Hamann of Cold Spring, Eldo (Marian) Hamann of Roberts, WI and Norman (Carol) Hamann of Albany; one niece; six nephews; and many cousins.

Jimmy was preceded in death by his parents; and wife, Shirley Hamann on October 6, 1994.

Serving as casket bearers were Justin Hamann, Jacob Hamann, Joshua Pelzer, Daniel Hamann, Dale Hamann, Glen Hamann, Galen Hamann, and Scott Hamann.

Arrangements were made with PattonSchad Funeral & Cremation Services of Melrose.

James A. “Jimmy” Hamann, age 71 of Albany, died unexpectedly on Tuesday, October 16, 2012 at his home in Albany, Minnesota.

F u n e r a l services were held at 11 a.m. Saturday, October 20 at Our Savior’s Lutheran Church in Albany with Rev. Bradley Pearson officiating. Interment was at Our Savior’s Lutheran Cemetery in Albany.

James Alvin Hamann was born January 25, 1941 in Farming Township, Stearns County, Minnesota to Otto and Linda (Klug) Hamann. He was united in marriage to Shirley Schultz on November 24, 1984 at

Force throughout the United States and Europe.

She was a 44 year resident of Victorville, California who loved traveling, baseball, bowling and bingo.

She was a member of the Ladies of the Moose, Hesperia Chapter, and the Elks Lodge 1877.

Mary Ann is survived by her daughters, Suzanne Maki and Joanne Rand of Victorville, California; son Steve Maki of Topeka, Kansas; grandsons Stephen Rand and Michael Maki and granddaughter Jennifer Rand. She is also survived by sister Catherine Weisbrich of Mountain View, California; brothers John Weisbrich of Las Vegas, Nevada, Richard Weisbrich (Marti) of McDonald, Tennessee and Robert Weisbrich of Blythe, California.

She is preceded in death by her husband of 56 years, George; her parents Anna and Carl; sister Irene Lee; brothers Anthony Weisbrich and Charles Weisbrich.

A celebration of life was held in Mary Ann’s honor with loving family and friends in attendance.

Mary Ann Maki, 82, was born in Norwood, Minnesota on December 29, 1929 to Carl and Anna Weisbrich.

She passed away on October 14, 2012 in Victorville. She was a devoted wife, mother, grandmother, and sister.

Mary Ann grew up on the family farm near Pine Lake in Upsala, Minnesota. She married her husband George in 1955 and became a proud military wife. Mary Ann and George were stationed with the Air

Dolores enjoyed sewing. She was into quilting, embroidery, and rug making.

Besides sewing, she loved spending her time gardening, playing cards, and volunteering at places like the Upsala Senior Center and the St. Cloud VA Hospital. Most of all, Dolores loved spending time with her family, especially her grandchildren. Dolores was a member of the Upsala Legion Auxiliary, the Christian Mothers, and St. Francis of Assisi Catholic Church.

Dolores is survived by her children Ronald (Mary) Pogatchnik, Casper, WY; Gary (Dawn) Pogatchnik, Swanville; Joyce (Mike Newell) Parish, Sauk Centre; Yvonne (Ronald) Lehrke, Sauk Rapids; her 10 grandchildren and 15 great-grandchildren; and her siblings Louis (Lillian) Mayer, Paynesville; Bernard (Irene) Mayer, Paynesville; Bernie (Willie Decker) Becker, Long Prairie.

She is preceded in death by her parents William and Helen Mayer; her husband Cyril Pogatchnik who passed in 1994; her brothers Albert, Raymond, Daniel, and Julius Mayer; her sisters Mildred Weller, Lucille Utsch, and LaVern Mayer; her son-in law Tim Parish and grandson Keith Pogatchnik.

Arrangements are being made with the Miller-Carlin Funeral Home of Upsala.

Mass of Christian burial celebrating the life of Dolores Olga Pogatchnik, age 86 of Upsala will be 11 AM, Friday, October 26th, 2012 at St. Francis of Assisi Catholic Church in St. Francis, MN. Father John O’Dero will officiate, and burial will take place in the parish cemetery following the service.

Dolores died peacefully in her sleep early Tuesday morning at the Good Shepherd Nursing Home in Sauk Rapids.

There will be a visitation from 4-8 PM, Thursday, October 25th, 2012 at St. Francis of Assisi Catholic Church, and again from 10 AM until the time of the service Friday morning again at the church. Parish prayers will take place at 6 PM followed by the Christian Mothers and Upsala Legion Ladies Auxiliary praying the rosary at 6:30.

Dolores was born December 6, 1925 to William and Helen (Feldhaus) Mayer in Rockville Minnesota. She married Cyril Pogatchnik on May 27th 1947 in Cold Spring. Dolores lived in the Upsala area where she not only helped her husband on

L o u i s e Loxterkamp, 84 year-old resident of Swanville, MN passed away Tuesday, October 16, 2012 at Diamond Willow Assisted Living in Little Falls, MN. Mass of Christian Burial was held at 10:30 A.M. on Saturday, October 20, 2012 at St. John the Baptist Catholic Church in Swanville, MN with Father Ronald Dockendorf officiating.

Burial took place in the St. John’s Parish Cemetery in Swanville, MN. Louise was born on November 16, 1927 in Melrose, MN to the late Joseph and Josepha (Middendorf) Hiltner. She grew up and attended Country School in the New Munich.

Louise was united in marriage to Anthony Loxterkamp on April 6, 1948 at Immaculate Conception Catholic Church in New Munich, MN. Louise and Anthony farmed one half mile south of Swanville, MN from 1948 until 1997 when they moved into the town of Swanville. She was a homemaker, taking great pride in caring for her children and the farm.

Louise was an avid quilter, coin collector and gardener. She was an active member of the Christian Mothers and St. John The Baptist Catholic Church in Swanville, MN. Louise also enjoyed her grandchildren and greatgrandchildren, which she spent many hours babysitting as they grew up. In 2008, she

Adeline M. Pratt

Adeline M. Pratt, age 89 of Melrose, died on Wednesday, October 17, 2012 at the Mother of Mercy Nursing Home in Albany, Minnesota.

F u n e r a l services were held Wednesday, October 24, 2012 at St. Paul’s Lutheran Church in Melrose with Rev. Kevin Mann officiating.

Interment followed in Oak Hill Cemetery in Melrose.

Adeline Magdalin Wolter was born August 10, 1923 in Barney, North Dakota to Richard and Mathilda (Drawz) Wolter.

She married Harvey Pratt on October 3, 1949 in Whapeton, North Dakota. Adeline and her husband lived in Abercrombie, North Dakota until 1970 when they moved

Ruth B. Kuhlmann

Ruth B. Kuhlmann, age 95 of Melrose, died Monday, October 22, 2012 at her residence in Wyoming, Minnesota.

Memorial Mass of Christian Burial will be held at 11 a.m.

Saturday, November 10 at St. Mary’s Catholic Church in Melrose with Rev. Marvin Enneking officiating. An inurnment will be held at a later date in Fort Snelling National Cemetery in Minneapolis.

Visitation will be one hour prior to the service at the church.

Ruth Bernadette Kuhl was born February 13, 1917 in Galena, Illinois to Frank and Edith (Lowling) Kuhl.

After graduating from the Immaculate Conception Academy in Dubuque, Iowa, she moved to Minneapolis and worked in cosmetics at Donaldson’s Department Store. She married her husband, Edwin, in 1950 and relocated to Melrose. Ruth and Eddie took over the Zuercher Drug Store in 1953, working side by side until his death in 1993. Ruth loved running her store and having conversations with friends and customers that came through the door.

She retired after 50 years in business and

to Melrose. She worked at the Jennie-O Turkey Store for over 25 years until her retirement in 1989. Adeline was a member of St. Paul’s Lutheran Church, American Legion Auxiliary Unit 101, Sauk Centre Seniors, and the St. Paul’s Ladies Aide.

She enjoyed reading, crossword puzzles, and taking care of her plants.

Survivors include her children, James Pratt of Melrose, Julie Pratt-Blenker of St. Joseph, and Joel (Rhonda) Pratt of Rice; grandchildren, Nathan, Kyle, Collin, and Samantha; and many nieces, nephews, relatives, and friends.

Upsala Jr. High School Student of the Month The faculty of Upsala Area Schools is proud to honor Rachel Prom as the September Junior High Student of the Month.

She is the eighth grade daughter of DJ and JoAnne Prom.

Rachel is an active individual both in and out of the school setting. Since entering junior high, she has participated in choir, band, student council, and knowledge bowl. She has taken roles in the school musicals and was elected as her class president. In her community, Rachel is active in her church as a mass server and choir member. She also volunteers at the public library. When she has free time, she enjoys playing music, singing, and

spending time with her family, friends, and dogs.

Despite maintaining a busy schedule, Rachel manages to consistently remain on the A honor roll. She says algebra is her most valuable class because she learns important skills for the future. Choir, however, is Rachel’s favorite class. It is new for her this year and “fun.”

Denise Cheney, Rachel’s choir and band teacher, says “Rachel is always extremely prepared. This very talented young lady sets high goals for herself and practices very hard to achieve them.

Rachel has played flute for church and weddings, yet she is only in 8th grade.

Her penchant for music is evident in her everyday performances. What a fine example for others to follow.”

When asked what advice she has for her classmates, Rachel said, “Don’t be afraid to get involved in your school and community.” It would seem that Rachel lives her own advice every day.

The Upsala School staff is proud to honor Anne Vos as the Senior High September Student of the Month. Anne is the sophomore daughter of Patty and David Vos. Anne has been active in various school activities, including volleyball, drama, band, and choir.

Anne’s band and choir teacher, Mrs.

Cheney, said “Anne is a joy to have in class. She works hard and enjoys herself.

Her determination to do well is evident.

As her teacher and coach, I have gotten to know her. She always has a smile and is very respectful.”

Anne has earned a place on the honor roll and enjoys all her classes. Math is valuable to her because she believes she will use it throughout her life. Digital Photography is Anne’s favorite class because she thinks it is fun to work with technology.

In her spare time, Anne enjoys crafting and decorating. Her motto is “Don’t stress about things you can’t change. Be happy.”

CentraCare Heart & Vascular Center recruiting patients for Research Study The CentraCare Heart & Vascular Center is seeking patients to participate in a clinical research study investigating the use of an investigational triglyceride lowering medication and how it works in reducing the risk of having a heart attack, stroke or other cardiovascular event in patients who are also taking a cholesterol lowering medication.

Eligible participants will be men and women with heart disease or diabetes that are 45+ years old, are currently taking a prescription medication to lower their cholesterol and have elevated triglycerides. Additional health criteria also will have to be met in order to be eligible for participation. All study-related care and

study medication will be provided at no cost.

by Jill Kurowski. She purchased and opened her business in November of 2007 at 115 State Street East after working for the previous owner for a year.

“I have a full service salon and also offer tanning, waxing, manicures, pedicures and acrylic nails,” said Kurowski, who completed cosmetology school and then later business management school at Alexandria Tech. Debbie Hollermann, a part-time employee specializes in acrylic nails. A spa pedicure massage chair is a unique feature of the business.

Health machines and Young Living Essential Oils are also offered.

“Making customers happy,” is Kurowski’s goal. She serves about an equal number of women and men, and would

like to serve more customers in the community.

Style ‘n Go’s business hours are Tuesday through Friday from 11 a.m. to 6 p.m. and on Saturday from 9 a.m. to noon.

On the side, Kurowski likes to sew and quilt. She is willing to custom make quilts, wall hangings and table runners and she also knits scarves.

Kurowski is married to husband Ray and is the mother of three sons: Casey, Brandon and Cody.

Deer safety: Tips for avoiding an accident

By Rich Sprouse, DNR information officer You’re driving home from work when you sense movement in the ditch next to the highway; you pump your brakes in time to avoid the two eyes now flashing in the darkness that have moved onto the roadway. You sigh in relief as the deer scampers off into the darkness.

The Minnesota Department of Transportation reports Minnesota averages about 35,000 deer-car collisions a year, and three to 11 fatalities.

So, what can you do to stay safe when Minnesota’s deer season gets underway Nov. 3? Read on to learn some of trends and statistics, as well as a few tips for making your drive through deer country as safe as possible.

Deer Trends and Statistics: • Dawn and dusk are the times you are most likely to encounter deer along the roadside.

• Deer-breeding season runs from October through early January, and during this time, they are highly active and on the move. This is when deer-vehicle collisions are at their peak.

• Although deer may wander into neighborhoods, they are more frequently found on the outskirts of town and in

heavily wooded areas.

• As pack animals, deer almost never travel alone. If you see one deer, you can bet there are others nearby.

Preventive Measures: • If you are driving through an area known for high deer populations, slow down and observe the speed limit. The more conservative you are with your speed, the more time you will have to brake if an animal darts into your path.

• Always wear a seatbelt. The most severe injuries in deer-vehicle collisions usually result from failure to use a seatbelt.

• Watch for the shine of eyes alongside roads and immediately begin to slow down.

• Use your high beams whenever the road is free of oncoming traffic. This will increase your visibility and give you more time to react.

• Deer can become mesmerized by steady, bright lights, so if you see one frozen on the road, slow down and flash your lights. NHTSA and other experts recommend one long blast of the horn to scare them out of the road as well.

• Pay close attention to caution signs indicating deer or other large animals.

• If you’re on a multi-lane road, drive in the center lane to give as much space to grazing deer as possible.

Encountering A Deer: • Never swerve to avoid a deer in the road. Swerving can confuse the deer on where to run. Swerving also can cause a head-on collision with oncoming vehicles, take you off the roadway into a tree or a ditch and greatly increase the chances of serious injuries.

• Deer are unpredictable creatures, and one that is calmly standing by the side of the road may suddenly leap into the roadway without warning. Slowing down when you spot a deer is the best way to avoid a collision, however, if one does move into your path, maintain control and do your best to brake and give the deer time to get out of your way.

• Don’t rely on hood whistles or other devices designed to scare off deer. These have not been proven to work.

• If you do collide with a deer or large animal, call emergency services if injuries are involved or local police if damage has been caused to your property or someone else’s. Never touch an animal in the roadway.

Local Municipality Minutes Burnhamville Township September 25, 2012 The regular meeting of the Town Board of Burnhamville Township was held September 25, 2012 at the Burtrum Community Center. The meeting was called to order at 7:00 p.m. by chair Mike Berscheit. Members present include Supervisors: Mike Berscheit, Bruce Johnson, and Louis Thompson; Clerk Shirley Hulinsky; and Treasurer Pam Throener.

Others present: Ervin Muellner and Erv Herdering.

Sup. Thompson made a motion to approve the minutes of the regular meeting August 28, 2012. Motion seconded by Sup. Johnson. Motion passed.

Sup. Berscheit made a motion to accept the fire contract with the Swanville Rural Fire Association as presented. Motion seconded by Sup. Thompson. Motion passed.

Motion was made by Sup. Berscheit to pay all bills numbered 4694 through 4706: Rev. $619.65 , R&B $18,670.90, Fire $14,576.55. Sup. Thompson seconded the motion.

Motion passed.

The board reported the stop sign on 170th St and State 28 was shot up. Supervisor will contact the state highway department to get it replaced.

Sup. Berscheit made a motion to appoint election judges for the November 6th general election as: Gary Allen, Brenda Schwanke, Pam Throener, Sharon Muellner, Terri Holmgren, Gloria Hobbs, Bonnie Alseleben, Mike Holmgren, and Shirley Hulinsky. Motion was seconded by Sup. Thompson.

The contractor was short on soybean oil dust control product, so he did not spray Explorer Drive.

Board advised him to cover as much as he can with a single application down the center. Board will evaluate effectiveness later. Also, the patch mix was unavailable from the county. They are waiting on the supplier from Wadena. When mix is available 184th St will be patched.

Contractor is waiting on wire locates to trim ditch by Lady Lake.

Treasurer’s report showed a balance of $175,648.63 before tonight’s bills. Treasurer’s report accepted on a motion by Sup. Johnson and seconded by Sup. Berscheit. Motion passed.

Motion was made by Sup. Berscheit to adjourn the meeting which was seconded by Sup. Thompson.

Motion passed. The meeting adjourned at 7:36 p.m. Next regular meeting will be on October 30, 2012 at 7 p.m. in the Burtrum Community Center.

Melrose City September 13, 2012 The Melrose City Council met in a Regular Meeting on Thursday, September 13, 2012 at 6:00 p.m. at the Melrose City Center pursuant to due notice being given thereof.

Present were Council Members Joe Finken, Tony Klasen, Dick Christenson, Mayor Tim Vogel, City Administrator/Treasurer Michael Brethorst, and City Clerk Patti Haase. Council Member Jenny Mayers was absent.

Mayor Vogel presided thereat. Also in attendance were several American Government students from the Melrose Area Public High School. The Council then recited the Pledge of Allegiance.

A motion was made by Mr. Finken, seconded by Mr. Klasen and unanimously carried to approve the agenda as amended.

Amanda Maus spoke supporting the replacement of Police Officer Swanson siting reasons of Police Officer safety and community protection.

The following items were considered for approval under the Consent Agenda: a. the minutes from the Council’s August 22 Special Meeting, the August 23 Special Joint Meeting with the Melrose Public Utilities Commission, and the August 23 Regular Meeting. b. list of bills in the amount of $136,582.51. The list of bills includes the membership dues for the League of Minnesota (LMC) in the amount of $3,421 plus an additional $30 for Minnesota Mayors Membership Association dues. The LMC provides consulting, professionals training and insurance service to the City of Melrose and the Melrose Public Utilities Commission. The cost share is 75% General Fund / 25% Utilities Fund. c. list of investments for the month of August. d. Donation Resolutions: 1) Resolution No. 2012-41, Donation in the amount of $2,816 toward the Sauk River Park Improvement Project, Olympic Flags; 2) Resolution No. 2012-42, Donation from Pat & Juliann Heller, Tony & Julie Klasen, Clyde & Virginia Tise, and the Senior Activity Center towards the TriCap bus service; 3) Resolution No. 2012-43, Donation in the amount of $15 from the Melrose Area Women of Today for Night to Unite. e. City Code Chapter 113 adopts M.S. Ch. 340A by reference which allows sales of intoxicating liquor between the hours of 1:00 a.m. and 2:00 a.m. after obtaining a permit from the State of Minnesota. The State provides the application form and collects the license fee. The City has the ability to also establish a fee, however, has chosen not to.

A motion was made by Mr. Christenson, seconded by Mr. Klasen to approve the consent agenda as submitted.

The Council held a Public Hearing to hear all persons present upon the petition received August 23, 2012 from Warrior Properties LLC for the vacation of the interior north-south and east-west utility and drainage easements located in Parcel 66.37010.0291, Lot 1, Block 1, Melrose I-94 Industrial Park excluding those which surround Block 6.

The purpose of the requested vacation is to allow construction of proposed expansion facilities by Warrior Properties LLC. When Warrior Properties LLC initially acquired all four of the lots located in Block 6, Melrose I-94 Industrial Park from the City of Melrose, the lots were combined into a single large parcel now known as a Lot 1. As part of the development plan of Warrior Properties LLC, it was understood that at such time as it became necessary, the City would vacate, at its expense, the north-south and east-west utility and drainage easements which separated the former four lots, now combined into Lot 1. To proceed with the proposed expansion, it is necessary that the interior east-west and northsouth easements be vacated.

City Administrator Brethorst presented the Affidavit of Publication of Notice of Hearing in the Melrose Beacon on August 29 and September 5, 2012, the Affidavit of Posting of Notice on August 29, 2012, and the Affidavit of Mailing of Notice to all property owners located within 350 feet of the property proposed to be vacated, which occurred on August 30, 2012.

Director Walz presented the petition and addressed questions presented by the Council and the public.

Joe Roelike spoke against the vacation of easements. He is requesting the City to install a drainage tile along County Road 186 to the culvert to address the storm water runoff. He is also requesting for restitution in the amount of $3,000 for the property damage that was caused by previous storm run-off onto his privately owned agricultural land and a letter from the City stating that the City would provide immediate compensation should, in the future, the water flow onto the privately-owned

agricultural land. If the City does not agree to Mr. Roelike’s conditions, he is in objection to the vacation of the easement. There being no further comments, the Public Hearing was closed at 6:12 p.m.

Police Chief John Jensen presented the Police Department’s August report. Chief Jensen noted that due to new updates to the Police Department’s Records Management System, the majority of the monthly reports were not available at this time. He stated there were 210 calls for service during this month compared to 249 for August of 2011. The year-to-date number of calls is 1,845 compared to 2,227 in 2011.

City Attorney Dymoke reported that during the period from August 12 through September 5, he has spent time reviewing documentation regarding the torrens titles for property at Rose Park/Melrose Community LLC. City Administrator Brethorst provided an update on the Sauk River Park Splash Pad/Skate Board Improvement Project. The Capital Campaign Committee, consisting of seven members, have met to discuss various fund-raising events. Administrator Brethorst is in the process of making application for a DNR Legacy Grant / DNR Trails Grant.

The grants are to help fund the improvements to the Sauk River Park and the implementation of the Sauk River Park Master Plan.

Mayor Vogel noted that earlier this evening, a Public Hearing was held on the petition received August 23, 2012 from Warrior Properties LLC for the vacation of the interior north-south and east-west utility and drainage easements located in Par-

From the onset of the start of Mr. Danzl’s restaurant project, it was anticipated that he would make the vacant commercial property located to the east of his proposed restaurant site available for development.

Mayor Vogel stated that in 1999, the City provided revolving loan fund (RLF) assistance to Carstens Industries, Inc. to facilitate with one of the company’s expansion. The balance of that Loan #1999-03-F, which is secured by a mortgage and financing statement, is $29,230.04. Carstens Industries, Inc. is currently in the process of completing another expansion containing approximately 10,000 square feet for which the City has agreed to provide tax increment financing assistance. This 2012 expansion is being financed by the Central Minnesota Credit Union (CMCU) which is requesting as a condition for the financing that the City’s outstanding Loan #1999-03-F to Carstens Industries, Inc. be subordinated to the proposed new debt, as well as the existing debt. The City had previously been in a subordinate position to the CMCU. Because of a favorable loan to value ratio, CMCU has elected to forego the need for an appraisal by an outside agency and conducted an internal market valuation.

MADA met earlier in the day to consider the request received from the CMCU to subordinate the City’s existing RLF debt, mortgage and financing statement to the proposed financing by the CMCU for the Carstens Industries, Inc. 2012 expansion project. It is the recommendation of MADA that the Council approve the request received from the CMCU to subordinate the City’s existing RLF debt, mortgage and financing statement to the existing and proposed financing by the CMCU for the Carstens Industries, Inc. 2012 expansion project.

A motion was made by Mr. Christenson, seconded by Mr. Klasen and unanimously carried concurring with the recommenda-

tion of MADA regarding the subordination request and authorizing the execution of the required documentation.

The Filming and Production Services Agreement with DiversiCom (now Arvig) expires at yearend. Staff has received the two-year proposed agreement from Arvig for filming and production services. A motion was made by Mr. Klasen, seconded by Mr. Christenson and unanimously carried approving the two-year agreement with Arvig.

The Council, at its August 23 meeting, gave approval to Resolution No. 2012-39, Resolution Opting to Join the Voluntary Statewide Lump-Sum Firefighter Retirement Plan and authorized the Melrose Fire Relief Association to enter into the State program. Therefore, the Relief Association’s Bylaws need to be revised to reflect this change. A motion was made by Mr. Christenson approving the revisions to the Fire Department Relief Association Bylaws. The motion was seconded

by Mr. Klasen with a roll call vote recorded as follows: For: Council Members Christenson and Klasen and Mayor Vogel; Against: None; Abstain: Council Member Finken due to a conflict of interest; Absent: Council Member Mayers.

Mayor Vogel stated that City Administrator Brethorst is writing a formal application for a DNR Legacy Grant / DNR Trails Grant.

The grants are to help fund the improvements to the Sauk River Park and the implementation of the Sauk River Park Master Plan. The funding requested will focus on trails, parking, bike racks, curb gutter, shelter.

The grant will not include funds for the Splash Pad nor Skate Park as those uses are not weighted highly in the rankings and would reduce our likelihood of an award. staff to submit grant applications for the DNR Legacy Grant / DNR Trails Grant and approve all resolutions as required to submit the formal application if needed.

City Administrator Brethorst presented the proposed 2013 Budget for the General Fund. State law requires that the City certify the proposed tax levy to the County Auditor by no later than September 15; therefore, it will be necessary to review the budget and take action on adoption of the proposed preliminary budget and the proposed tax levy at this meeting. The final levy adopted in December can be lower than the levy certified in September, but cannot be higher. The Council discussed the proposed budget and levy at a Special Meeting held on Wednesday, August 22.

Administrator Brethorst stated it is proposed that the preliminary property tax levy be certified at $1,000,000. Also included is a total debt levy of $295,000 for a total proposed tax levy of $1,295,000 and an estimated tax capacity rate of 69.167% which is slightly more than the final levy of 65.702% for 2012 taxes payable. The City must also provide the County Auditor with precise information on: 1) Time and place of a public hearing for the adoption budget and levy will be discussed; 2) The public must have the opportunity to speak and the meeting must not be held before 6:00 p.m.; 3) Date, place and time of the public hearing at which the final budget and levy will be determined, with this meeting to be scheduled after November 24 and before December 27. Staff recommended and the Council concurred that this hearing be scheduled for the December 13 at 6:00 p.m. at the Melrose City Center; 4) Phone number (320-2564278) that City taxpayers may call if they have questions related to the auditor’s property tax notice, which is generally delivered in November; 5) Address where comments will be received by mail. (225 1st Street NE, Melrose, MN 56352 ATTN: City Administrator) The above-noted items are part of the revised Truth in Taxation requirements. The information must be included in the minutes and the City must comply with existing publication requirements for minutes. Mayor Vogel noted that the Council during its deliberations on a final budget and levy, hopes to be able to keep the tax capacity rate near or just slightly above last year’s level.

Mr. Finken introduced Resolution No. 2012-46, Resolution Adopting Proposed Tax Levy Approving 2012 Tax Levy, Collectible in 2013 and Setting Hearing Dates. (See attached resolution). The motion was seconded by Mr. Klasen with a roll call vote recorded as follows: For: Council Members Finken, Klasen, Christenson, and Mayor Vogel; Against: None; Absent: Council Member Mayers.

The Council, at its August 30 Special Meeting, received presentations from WSB, Bolton & Menk, SEH, and Stantec. At the conclusion of the RFQ presentations, the Council requested that each firm provide:

a summary, a list of grants and a fee schedule.

Mr. Klasen: Believes it was best to review other engineering firms to ensure that the City is receiving quality service at a reasonable price. Mr. Finken: Believes the City has been considering this for some time and believes that issues have presented themselves on some past projects overseen by Stantec. He also noted that he believes they have not aggressively sought after grant money as other firms tend to. Mr. Christenson: SEH works with the water wastewater treatment facility and believes that perhaps fresh eyes would be beneficial. City Administrator Brethorst stated that he had received input from Council Member Mayers recommending WSB. A motion was made by Mr. Finken, seconded by Mr. Klasen and unanimously carried retaining WSB as the City’s Engineering firm.

The Council, at its August 30 Special Meeting, accepted the resignation of Police Officer Chris Swanson. The Council continued discussions on the Police Department

staffing levels and whether or not to replace Mr. Swanson. Sandy Imdieke remarked that the Police Department also serve as first responders who are often first at the scene and without them are compromising the safety and the overall welfare of the residents. Tom Budde noted that in addition to providing backup and medical assistance, the fact that the call volume is decreasing would indicate that the Police Officers doing their job in protecting and serving the community.

Mrs. Shawn Swanson spoke asking the Council to replace Police Officer Chris Swanson and requested that the Council consider looking at what the City will forgo by not replacing the officer. Council Member Klasen asked if a part-time Officer would be feasible. Police Chief Jensen noted that the City would not realize any cost savings. Wayne Senst noted that perhaps other cuts can be made. Mayor Vogel noted that he would prefer the item be tabled.

It was the consensus of the Council to table the item until the October Meeting.

New penalties for deer baiting

Participants in Minnesota’s firearm deer season will be greeted with new penalties for baiting violations when they go afield Nov. 3.

“It seems that every year our officers are spending more and more time responding to complaints about baiting or discovering it while on patrol,” said Lt. Col. Rodmen Smith, Minnesota DNR Enforcement Division assistant director. “We hope these new penalties curb what has become an all too common violation.”

Deer baiting is placing food near deer stands or clearings with the intent of luring a deer into close shooting range. It has been illegal to bait deer in Minnesota since 1991.

DNR conservation officers issued 144 citations, gave 24 warnings and seized 134 firearms/bows in baiting related investigations during the 2011 bow, firearms and muzzleloader seasons. It’s the highest number of baiting citations issued during the deer hunting seasons since the DNR began tracking these violations in 1991.

The Minnesota Legislature recognized the negative impact of baiting deer and recently passed legislation to increase the penalties for those convicted of baiting deer.

“It was apparent that a fine and forfeiture of a firearm or bow was not enough to curtail the activity,” said Smith. “In order to show the seriousness of the offense hunters will be subject to license revocation when convicted of baiting deer.”

The new penalties for baiting: • A person may not obtain any deer license or take deer under a lifetime license for one year after the person is convicted of hunting deer with the aid or use of bait. The DNR’s Electronic Licensing System (ELS) will also block a person’s ability to purchase a license.

A second conviction within three years would result in a three-year revocation.

• The revocation period doubles if the conviction is for a deer that is a trophy deer scoring higher than 170 inches.

The fine for illegal baiting is $300, plus $80 or so in court costs. Another $500 can be tagged on for restitution if a deer is seized.

Guns may be confiscated as well.

Smith said he is hopeful the new penalties, in addition to fines, restitution and confiscation of guns sends a message that Minnesota values it natural resources and there is a price for engaging in this illegal activity.

Drought conditions straining state’s water resources; DNR urges conservation Drought conditions are straining Minnesota’s water resources. The Minnesota Department of Natural Resources (DNR) is urging everyone to adopt water conservation measures.

“Water is essential to our economy, our natural resources, and our quality of life,” said Tom Landwehr, DNR commissioner.

“We are in the second year of a drought, and it is time for all of us to take water conservation more seriously.”

DNR is asking agricultural, commercial and industrial water users to stop outdoor irrigation and to implement conservation measures. Everyone who holds a DNR permit for water appropriation should review and abide by their permit conditions and begin conserving water as soon as possible.

“The drought conditions are sobering and call for a collaborative response,” Landwehr said. “At a time that per capita water consumption is decreasing nationwide, Minnesota’s water use per resident is actually increasing. We will need to work together to meet these challenges.”

Public water suppliers have been contacted by the DNR and reminded to implement appropriate conservation measures contained in their water supply plans. These could include water audits, leak detection, and promoting water conservation to their customers.

• Nearly one-half of the state is in severe drought or worse; severe drought is considered a one in 10-year event; extreme drought is considered a one in 20-year event.

• The extent and geographic distribution of the current drought is rivaling the extreme drought event of the late 1980s.

• Large areas of Minnesota have missed the equivalent of two summertime month’s worth of rain.

• Soil moisture levels are at or below all-time low values for the end of September.

October 15, 2012: At 4:11 p.m. the Todd County Sheriff’s Office received a call of a residential burglary that occurred at a cabin on Hunter Trail in Bruce Township, Sect. 10. October 21, 2012: At approximately 8:50 p.m. Dan Meyer reported he struck a deer on State 28, near CO 99. Dan’s truck received moderate damage to it’s front and driver’s side. The truck was able to be driven from the scene and Dan was not injured.

Dan was issued a permit for the deer.
