Members Elect Four to IOGAWV Board Four members of the Independent Oil and Gas Association of West Virginia, Inc., have been elected to fill three-year terms on the Association’s board of directors beginning immediately after the Summer Meeting.

The new board members are: Maribeth Anderson, Antero Resources; David Haney, D. G. Haney, Inc.; Jon Hildreth, Megan Oil & Gas Co.; and Chris Weikle, Southwestern Energy.

The four new members will replace outgoing IOGAWV board members: Mike McCown, LexCam Enterprises, LLC; Sam McKown, C.

I. McKown & Son, Inc.; and Rick Toothman, Rick Toothman Consulting. Although his term is ending, Brett Loflin, Northeast Natural Energy, LLC, will serve one year as immediate past president.

Maribeth Anderson, a native and lifelong West Virginian, is the Director of Government Relations for Antero Resources. She came to Antero at the

end of 2017, after serving in similar roles for Southwestern Energy and Chesapeake Energy since 2007. Prior to entering the energy sector, she was a consultant for Charles Ryan Associates and the news director for WSAZ Television.

Maribeth is currently on the Executive Committee for the West Virginia Chamber of Commerce, and is the past board chair for the Huntington Regional Chamber of Commerce. She has served in industry leadership roles across four states, having been elected as the New Board Continued on page 20

Second Year of Science Teacher Workshop The Independent Oil and Gas Association of West Virginia (IOGAWV) hosted its second annual Science Teacher Education Workshop June 10 and 11, which was attended by more than 40 science teachers from across the state.

The goal of the workshop, held at the Embassy Suites, was to help foster STEM and energy education by connecting science teachers to the energy industry.

This year, participating teachers were eligible for three hours of

college credit through Marshall University that could be used toward job advancement and pay increases.

Supreme Court Rulings Shared The Supreme Court has been busy in the month of June and issued opinions regarding three cases that directly affect our industry. Opinions were issued in EQT Production Company v. Crowder, Andrew v. Antero Resources Corp. and Hall Drilling, LLC, and the State Tax Department and various county assessors vs. Antero and CNX. The first case EQT v. Crowder is regarding an appeal of a Doddridge County Circuit Court ruling. The Crowders are surface owners of a tract that was utilized to build a pad and drill several horizontal wells from said pad. The Crowders sued EQT claiming that EQT only had the rights to produce minerals from underneath their surface tract. The Doddridge County Circuit court ruled that the surface tract could not be used to produce minerals from neighboring lands without the express agreement of the surface owner. The Supreme Court upheld the Circuit Court ruling. Even though EQT had modified the leases to include pooling rights the court determined an operator would still be required to obtain some type of an agreement from the owner of the surface allowing the production of gas from adjoining mineral tracts. It is possible that the ruling may have been different depending on when the pooling agreement was taken, i.e. before or after the severance of the surface and minerals and obviously if no severance had taken place and if the lease allowed for pooling.

One would assume that operators drilling horizontal wells will review

their surface use agreements and make sure the language allows for producing minerals from all tracts penetrated by the horizontal well bore. I am NOT a lawyer so if you have questions please contact an attorney with expertise in such matters.

The second case involving Antero and Hall drilling dealt with a lawsuit filed by several surface owners that claimed the activities associated with unconventional well development is a private nuisance. The Supreme Court upheld a ruling by the Mass Litigation Panel “MLP” that was in Antero and Halls favor.

The surface tracts owned by the plaintiffs was not utilized/disturbed by any construction activities. The Mass Litigation Panel and the Court based their decision on the fact that Antero had the rights via their contracts/leases with the mineral owners to do what is reasonably necessary to produce the minerals. It is my understanding that the court did not really address any aspect of nuisance law but relied solely on contract and property rights. Even though this is a win for the industry it is a fairly complicated case and I assume it will not stop future nuisance claims from being heard by the courts. Again, if you have specific questions please contact your attorney.

The third case deals with the issue of how the state tax department values oil and gas wells with regard to ad valorem property taxes.

This case actually involved seven consolidated appeals of county business court rulings. IOGA and several of its member companies

have tried to work with the tax department for the past several years to try and convince them that the methodology used to determine the wells value and the allowable deductions for operating expenses was flawed and unconstitutional.

New Rules Coming for Horizontal Deep Well Spacing

As the development of the shallow Marcellus shale formations through horizontal wells and completion techniques have continued for well over a decade now, oil and gas operators are more frequently expanding into deeper shale formations, such as the Utica. However, as is too often the case regulatory reform to accommodate the oil and gas industry’s rapid technological advances has lagged behind. Specifically, the spacing requirements between deep wells (completed below the top of the Onondaga formation) was originally established at 3,000 feet. Of course, that spacing requirement was created about 40 years ago and has not been updated since.

In response to the growing need for deep well spacing rules that promote rather than impede development of deep formations, the West Virginia Oil and Gas Conservation Commission (“OGCC”) held a public hearing on April 23, 2019, to address updating deep well spacing requirements particularly in the context of horizontal deep wells. The OGCC heard input from industry representatives, including IOGA, as well as from other interested persons.

On June 14, 2019, the OGCC filed two proposed rules. The first was an Emergency Rule, 39 C.S.R. 1, addressing horizontal deep well spacing. The Emergency Rule is not subject to public comment and will become effective on the earlier of approval by the West Virginia Secretary of State and July 26, 2019 (42 days after the filing date). The OGCC included a fairly detailed

statutorily required statement of the facts and circumstances constituting the emergency. The Emergency Rule can remain in force for no more than 15 months which normally provides enough time to have a legislative rule approved and effective.

The second was a Legislative Rule (containing the same terms as the Emergency Rule) which is subject to the public comment and legislative approval process. The deadline for written public comments is 8:00 a.m., July 15, 2019, followed by a public hearing at 2:00 p.m., July 16, 2019.

Both rules add definitions for “conventional deep well,” “horizontal unconventional deep well,” “heel” and “toe.” A new section 4.2.1 addresses conventional deep well spacing without making any substantive changes, including retaining the 3,000 ft. spacing requirement. The new section 4.2.2 contains the meat of the revisions to 39 C.S.R. 1 regarding horizontal unconventional deep wells and provides for an administrative process to obtain an “operational order” for a geographic area establishing well spacing requirements. The rules still provide for exceptions to operational orders following public notice and a hearing. However, neither rule establishes a default spacing requirement for horizontal unconventional deep wells in the absence of special field rules or an operational order. Thus, it is possible that once the Emergency Rule takes effect, no horizontal unconventional deep wells may be approved until an operational order is issued, or such

well is subject to an existing special field rule.

The rules do not establish any specific spacing for Utica or other deep formation. Rather, the rules authorize the OGCC upon a request from an operator, or upon its own initiative to prevent substantial harm to the public interest, to enter an operational order establishing “a geographic area by formation for horizontal unconventional deep wells.” An application for an operational order shall include “a request for public hearing along with the application which shall include the applicant’s name, address, description of the area, map generally depicting the area to be covered by the request, and the geological formation or other formations to be considered for the operational order.”

The topics that the OGCC shall address in an operations order include: (a) define the area to be covered by the order, (b) establish minimum well spacing, to include distances between laterals which will be controlled by the same operator, (c) establish minimum distances between wells adjacent to other operators, (d) establish minimum lease or unit boundary set backs parallel to the lateral, toe to toe, heel to heel, or toe to heel setbacks for units of the same operator and (e) establish minimum lease or unit boundary setbacks parallel to the lateral, toe to toe, heel to New Rules Continued on page 6

From the Burd’s Nest: The Ultimate Secret in Great Meetings, Events When I first joined IOGWV eighteen years ago, I had just completed a 29-year career with Hope Gas. Along the way I held several different jobs and worked in a variety of locations and met lots of individuals who were the best at what they did. Admittedly, when I walked through the IOGAWV office door on July 2, 2002, that “deer in the headlights” look must have been something to see.

At that first moment I had little to no comprehension just what IOGAWV was or the good it did for those oil and gas producers operating here in West Virginia. I soon learned that IOGAWV was wonderfully equal to the sum of its leadership, staff and members—and that stands true to this day. Lori Miller Smith was my right hand then and is today. She is phenomenally well-versed in all her duties, knows everyone in the industry and rarely takes “no” for an answer. This tenacious spirit serves IOGAWV well because she is responsible to assist in the planning, then execution, of our Association meetings and events—meetings and events that showcase important topics and industry activities.

One major and key element to all successful meetings is the involvement of meeting sponsors—those that see the benefit in contributing financially to the meeting or activity’s success. As I reflect on 18 years of meetings and activities, it is obvious that YOU - our many wonderful and dedicated sponsors - have greatly contributed to IOGAWV being

recognized by elected officials and business and trade association allies for its exceptional success in being THE voice of all producers.

It is apparent this well-established liaison between IOGAWV and its sponsors has, over time, built trust, solidified relationships and led to a commonality of purpose in achieving goals that is second to none across the oil and natural gas producing states.

You would be surprised at how many times I get calls inquiring as to why IOGAWV is so successful and can we share our secret!!

Take a Real Risk; Talk to a Millennial

Earlier this week we were the VOGA Summer Meeting in Virginia Beach, VA. My oldest grandson, CJ, lives there. He graduated last year with his engineering degree from Virginia Tech and is working for an engineering firm in the area. We had dinner with CJ and his girlfriend on Monday night. After dinner, he asked me if I wanted to play soccer on Tuesday for his adult rec league indoor team. They were going to be short players. I still play on an outdoor team in the over 35 League.

CJ knows this but I protested, “You guys are a lot faster and quicker than me.” I’m thinking; First- I could get hurt playing with these guys. SecondI could cost them a win.

I had to make a decision. Was I willing to risk pain and possible embarrassment in order to play a game with my grandson and his girlfriend. CJ added, “Grampa we have some old players in our league.”

I thought about the risks. Then I thought about the rewards. With CJ living 9 hours away we get very few chances to do things like this together. It would be quality time with CJ. This was a rare opportunity that may never happen again. I said, “Yes” and went out the next day to buy shin guards.

When I got to the field Tuesday night, I learned that “old” didn’t mean the same thing to CJ as it did to me. There was one other “old” player and he was about 40. I got a lot of playing time as a sub and found that I could be competitive and contribute. I also got a lot of support from CJ and his teammates.

The rules also authorize adjacent operators to enter into written agreements for spacing as long as the agreement conforms to the operational order. Such agreements must be submitted to the Commission with well work applications.

Procedurally, once an application is filed with the OGCC requesting minimum spacing distances between wells, the OGCC is required schedule a public hearing “to be not less than twenty (20) days but no more than forty-five (45) days (presumably from date the application is filed).

The OGCC is required to publish a Class II legal advertisement in the

county affected by the Operational Order providing notice of the public hearing and the opportunity to appear or file written comments. The evidence presented is proposed to be technical in nature and define characteristics of the reservoir to be covered. Finally, within 20 days of the evidentiary hearing, the OGCC “may issue an Operational Order for the defined area, after considering all of the evidence presented.�

The operational order concept is not what IOGAWV was seeking in its comments at the public hearing or in its subsequent letter to the

OGCC. However, the operational order process will likely be available by late July which would allow one or more operators to test the procedure to determine whether it may provide the sufficient benefit toward development of deep formation.

This is good news for the oil and gas industry although the details of the proposed Legislative Rule is subject to further revision through the public comment and legislative review process. IOGAWV will be filing comments to the Legislative Rule, so please share any issues you may identify. They don’t read newspapers or watch the evening news. We need to be communicating with Millennials. It may be uncomfortable at first but it is essential for our industry and the USA. Based on the work I have done with high school and college students and other young adults, they are reachable. They think and consider facts.

The University of Colorado Student Radio station understood. They call me, “The realist.” You can have the same success.

Here are some ideas to consider before taking this risk. Only you can decide how much risk is acceptable

to you.

• Will this activity move me closer to my goal?

• What is the best thing that can happen?

• What is the worst thing that can happen?

• How likely is success?

• What can I do to lower the risk and increase the probability of success? Educate yourself.

If the activity will move you closer to your goal and you can live with the worst outcome, then go for it.

Even if you fail or come up short you will learn in the process helping you for future success.

Millennials Don’t Bite. They are looking for truth and will be our future leaders. Will YOU tell them our incredible story? You can do it.

Cold weather has persisted in the Plains and Rockies, and this should continue this summer.

Areas farther to the east will have much hotter weather. It looks like a combination of dry soil and very warm waters off the Southeast Coast will set the table for a very hot summer from the Southeast into the southern Mid-Atlantic.

Areas to the west in the Ohio Valley may see some hot days and many warm nights. In the Northeast, New England will be less vulnerable to extended heat waves thanks to cooler water temperatures, but the northern Mid-Atlantic states should see warm to hot weather, thanks to warm, humid nights there, too.

Atlantic Coast Pipeline Developer Intends to Fight and Win! The developer of the Atlantic Coast Pipeline, Dominion Energy, says it’s just begun to fight and intends to win and win soon in its bid to complete it.

Jim Willis, over at the invaluable Marcellus Drilling News, reported yesterday on some highly encouraging remarks made by Donald Raikes, a Senior Vice President with Dominion Energy’s Gas Infrastructure Group. Dominion Energy is the developer of the Atlantic Coast Pipeline that will help move Appalachian shale gas to market, crossing much of Virginia and, in the process, the Appalachian Trail.

Forest Service permits issued for a crossing of the trail were undone in a stupendously stupid decision by three highly political judges on the Fourth Circuit Court of Appeals.

Another separate Fourth Circuit decision threw up other obstacles. Dominion, though, expects to dispense with all this nonsense in court.

author, Judge Stephanie Dawn Thacker, who actually delivered these not-so-legal remarks as part of her rationale: We trust the United States Forest Service to “speak for the trees, for the trees have no tongues.” Dr. Seuss, The Lorax (1971).

Yes, Judge Thacker trusts the Forest Service; except, of course, when they do something that disagrees with her own aesthetic values and “scenic integrity objectives.”

This is the kind of elitist view of the world found inside that part of it occupied by too much of our ruling class. The Forest Service describes its mission as follows and there is no mention of “speaking for the trees,” but Thacker has inartfully projected her own childish Lorax views onto the mission.

The agency’s mission is to sustain the health, diversity, and productivity of the nation’s forests and grasslands to meet the needs of present and future generations.

How do you fight this crap? Well, you get in the arena and fight it out and that’s what the Atlantic Coast folks are doing. Here’s some of what Dominion’s folks are promising, according to an article from S&P Global Platts: Dominion Energy expects to win one of two legal challenges its Atlantic Coast Pipeline faces within the next four to six weeks and be able to resume construction on a portion of the 600-mile route after that, an executive said Tuesday.

Group, added that he believes the US Supreme Court will agree to hear the second legal challenge, involving a permit to cross the Appalachian Trail, and ultimately rule in the operator’s favor, allowing it to complete the project.

The optimism comes as Dominion holds to its current timeline to begin partial service in late 2020 and full service in early 2021. The up-to-$7.5 billion project has been beset by delays and cost increases, largely because of opposition from environmental groups that has resulted in the legal challenges. Atlantic Coast Pipeline is among several Northeast gas infrastructure projects designed to boost takeaway capacity from the Appalachian Basin that have been delayed or stalled because of regulatory and legal hurdles.

“This is not about Duke, or Dominion or Southern,” Raikes said at the LDC Gas Forums conference in Boston. “This is about the industry.

This is about all of us.” …The federal government is expected to back with its own appeal Dominion’s Supreme Court appeal of a 4th US Circuit Court of Appeals decision that invalidated US Forest Service authorizations for the project to cross the Appalachian Trail…

During a separate presentation at the conference, Dan Diefenbach, manager of facility planning and design for Dominion Energy Transmission, said 35 miles of the pipeline are now in the ground in West Virginia and North Carolina.

Babst Calland Releases 2019 Industry Report The law firm of Babst Calland today released its annual energy industry report: The 2019 Babst Calland Report – The U.S. Oil and Gas Industry: Federal, State and Local Challenges & Opportunities; Legal and Regulatory Perspective for Producers and Midstream Operators.

In this Report, Babst Calland energy attorneys provide perspective on issues, challenges, opportunities and recent developments in the oil and gas industry that are relevant to producers and midstream operators.

According to the International Energy Agency, “the second wave of the U.S. shale revolution is coming” and the United States will account for a 70 percent increase in global oil production and a 75 percent expansion in LNG trade in the next five years.

On a year-over-year basis, natural gas production continues to increase in each of the seven largest shale basins in the United States. Most notably, oil and natural gas production is being driven by three of the largest producing basins including Appalachia in Pennsylvania, West Virginia and Ohio, the Permian Basin in Texas and New Mexico, and the Haynesville Basin in southwestern Arkansas, northwest Louisiana, and east Texas.

Joseph K. Reinhart, shareholder and co-chair of Babst Calland’s Energy and Natural Resources Group, said, “Domestic shale producers and operators continue to face myriad legal and regulatory challenges by regulatory agencies, the courts, activists, and the market. This annual review is a snapshot of the issues and trends on the federal, state and local level in the oil and gas industry over the past year.”

The 92-page Babst Calland Report covers a range of topics from the

industry’s business outlook, regulatory enforcement and rulemaking to developments in pipeline safety and litigation trends. A few of the Report’s highlights include: • The U.S. Department of Energy’s Energy Information Administration (EIA) reports both oil and dry natural gas production set U.S. records this year. Oil production hit 12.4 million barrels per day in May, and natural gas soared above 90 billion cubic feet per day. U.S. production of gas liquids also set records and now account for over a quarter of U.S. petroleum product output.

• This year, the oil and gas industry received mixed messages regarding environmental matters.

On the federal level, the Trump administration generally loosened regulatory and/or statutory constraints, such as narrowing the Clean Water Act definition of “Waters of the United States.” In contrast, at the state level, some agencies introduced or considered more rigorous standards, including Pennsylvania’s proposed cap-and-trade program.

• Public interest in pipeline safety has grown significantly in recent years. Consequently, operators’ installation of new pipeline infrastructure to transport energy products from the nation’s shale plays to domestic and foreign markets has resulted in increased scrutiny.

• In Pennsylvania, the contours of the Robinson Township II decision continue to be litigated and legislated by local governing bodies, while the Commonwealth Court provided clarity concerning a municipality’s right to deter-

mine the location of oil and gas operations. In West Virginia, the extent of a county government’s ability to investigate alleged nuisances is being considered in the state’s highest court. In Colorado, new legislation has empowered local governments to take a much more active role in regulating oil and gas development.

• Significant title issues concerning oil and gas property rights continue to be addressed in states in shale plays throughout the country. The desire to improve efficiencies has resulted in the use of allocation wells and cross unit drilling, particularly in Texas and Oklahoma.

• Nuisance claims, alleging that excessive noise, traffic, dust, light, air pollution and impaired water quality interfere with the use and enjoyment of private property, continue to be asserted across the shale plays.

• An increasing number of oil and gas companies recognize the advancements in commercial unmanned aircraft systems (UAS) technology and the utility and cost savings associated with using UAS to inspect and monitor assets such as pipelines and infrastructure.

After more than a decade, the shale gas industry continues to expand its reach and impact on our country’s energy supply and independence. WVU Extension Service Junior Firefighter Camp Draws 100+ Teens to Jackson’s Mill Now in its 12th year, Junior Firefighter Camp took place in late June at the WV State Fire Academy in Jackson’s Mill. More than a hundred teens between the ages of 14 and 17 attended camp this year.

The camp gives teenagers from across the country first-hand experience in live fire simulations, search and rescue, vehicle and airplane rescue and first aid, according to Mark Lambert, training director for the State Fire Academy.

Lambert added that the WVU Extension Service Junior Firefighter Camp allows a true firefighter experience under supervision of industry professionals, while inspiring teens to be community volunteers and leaders.

“Campers can earn certifications in CPR and first aid, which helps prepare them for roles within emergency services, as well as other jobs.

But they also learn about teamwork, discipline and being leaders with their peers,” said Lambert. “Our goal is to develop long-term community leaders who can serve in many capacities.”

While there are camps in other locations across the country, the West Virginia camp is the only week-long, overnight camp for junior firefighters in the mid-Atlantic region. This year, junior firefighters represented nine states, and the camp has consistently drawn attendees from other states.

Instructors from West Virginia and several other states volunteer their time to teach the next generation of firefighters. “A lot of them use personal time to come to the camp,” said Mark Lambert, training

director for the State Fire Academy.

New Fuel Facility to Bring Jobs and Development to Mason County Domestic Synthetic Fuels (DS Fuels), a West Virginia-owned company that will convert the state’s abundant coal and natural gas to gasoline and other fuels, will soon break ground on a coal to liquids facility in Mason County.

The West Virginia Department of Environmental Protection (DEP) recently approved the draft construction permit for the project.

Company officials plan a series of community meetings to explain the project and its benefits to the community.

Company officials encourage the public to learn more about the project – which is based on proven science and the latest technology.

The facility will be the first of its kind in the country.

“We want to be as transparent as possible in explaining this project to our neighbors,” said Kevin Whited, president of the development company that is building the facility. “We hope the DEP will host a public meeting, so we share information with the public about the exciting opportunities this facility will bring to the region.”

According to Whited, the coal to liquids facility is expected to create 130 full-time jobs, including management, mining and construction, and boost the local, state and regional economy. “We plan to host a series of open houses in the community to help explain the project.

“I’m from West Virginia,” Whited said. “We have West Virginians unemployed, and the coal industry has been decimated. We’re not the solution to revive it, but we’re going to be part of it.”

The direct coal to liquids process to be utilized in Mason County mixes coal with a catalyst and hydrogen derived from natural gas and subjects the mixture to heat and pressure to produce ultra-low-sulfur diesel fuel, gasoline and other liquids. A similar facility in China has been operating since 2008.

The resulting fuels burn cleaner than those refined from petroleum and are just as effective in vehicles.

Whited said the Mason County facility will differ from previous coal to liquids projects proposed for the state. The technology is more advanced, and the direct method used does not actually burn coal, but subjects it to heat and pressure, making the process much greener.

“This is environmentally sound,” Whited said. “We’re excited to bring a $1.2 billion project to the Mountain State.”

“The facility serves a vital role,” said Chris Hamilton, senior vice president of the West Virginia Coal Association. “For decades, we've been looking at ways to expand the coal usage, coal development, activities and how we can expand the overall fossil fuel portfolio.

“Any type of domestic homegrown, synthetic fuel particularly manufactured from coal accelerates those objectives,” Hamilton said.

“Domestic Synthetic Fuels is unique for West Virginia and the United States as being a one-of-akind facility utilizing two of our biggest natural resources here in West Virginia,” said Rebecca McPhail, president of the West Virginia Manufacturers Association.

“DS Fuels is a good fit in West Virginia because of the natural resources that we have here,” she said.

“The two primary ingredients for its manufacturing process, coal and natural gas, are in abundance here.

So, it makes us the perfect location for this type of facility.”

Whited said he chose Mason County for the fuel plant because the area has easy barge access and is close to plentiful supplies of coal and natural gas. He said he also wants to bring jobs and economic development to the region.

“We’re looking forward to getting it going,” he said. Funding has been secured for the project, which includes international investors.

“Unlike prior coal to liquids projects proposed in the Mountain State, this is going to happen,” Whited explained. “We have the money, we have the technology and we have the expertise.”

Whited said DS Fuels will bring coal from nearby Kanawha County to feed the coal to liquids facility.

The project is expected to create more than 100 mining jobs to supply the facility.

Thousands of construction jobs also will be created, he added.

Day one of the workshop started with an oil and gas presentation by Trip Showen of Triana Energy. The presentation was followed by a field trip to TC Energy. Topics discussed

by TC Energy employees were: an introduction to natural gas pipelines; a day in the life of a gas controller, Gas Control Supervisor Rene Norman, Supervisor; a tour TC Energy’s new gas control room and monitoring center by Operations Support Analyst John Segsworth; highlights of storage 101 with Senior Engineer Zachary Evans; and the commercial side of natural gas with Customer Services Account Representative Tyler King.

The full afternoon was followed by a reception and dinner for teachers at Embassy Suites. The evening concluded with presentations by Steve Hedrick, COO of MATRIC, Inc. and Mike McCown, chair of the Communication and Education Committee. The workshop began Tuesday morning, where educators participated in a variety of STEM-related activities.

The workshop is modeled after the Ohio Oil and Gas Energy Education Program (OOGEEP), which hosts teacher workshops throughout the year in Ohio, as well as other educational and public outreach events.

“I’m so excited to see IOGAWV continue this education program in West Virginia,” Rhonda Reda, executive director of OOGEEP, said. “It’s important for teachers to engage their students about STEM, and these workshops help incorporate energy-related lessons and activities in their classrooms.”

The workshop consisted of seven learning stations, related curriculum and hands-on STEM activities regarding the natural gas and crude oil industry. These stations included everything from the formation of these biotic materials to the creation of more than 6,000 petrochemical products used every day.

In addition to the workshop, an industry panel provided the opportunity for teachers to interact with local oil and gas industry professionals. Panelists were: Jeff Isner, IOGAWV Communications and Education Co-chair; Don Supcoe, Greylock Energy; Kathy Hill, Ergon Oil Purchasing; and Drew Waggener, Triana Energy.

The event closed with a Q&A session, and each teacher received an IOGAWV material kit with supplies to conduct experiments learned during the seminar with their stu-

dents in the upcoming school year.

“This turned out to be a wonderful event, and we know teachers walked away with valuable tools and information for their students,” Mike McCown, communications and education chair for IOGAWV’s board of directors, said. “I’d like to thank everyone who made this possible, including IOGAWV, OOGEEP, our panelists and generous sponsors, and especially our great West Virginia teachers.”

Jon manages the coordination of these entities including lease and royalty acquisition, drilling and plugging permits, completion, production and product marketing.

Jon is a native of Spencer, W. Va. He received his BS in Finance and Accounting from Glenville State College, continued his technical education with courses and programs on gas measurement, pipeline safety, lands, taxes and environmental matters. Jon served as past president and four years on the IOGAWV board. He is very concerned about the future of the industry and desires to be an active participant in shaping the progress of the development of fossil fuels.

Jon is an avid instrument-rated pilot with 5,000 hours. He resides in Spencer with his wife of 34 years, Rebecca, their 20-year-old twin sons Jordan attending Fairmont University and Jerrod attending WVU (both licensed pilots at age 17) and their daughter, Katlynn, a WVU graduate.

Chris Weikle is an almost-lifetime West Virginian. Born in Charleston in 1981 to wonderful parents Phil Weikle and

Debbie Phillips, Chris went on to grow up in Teays Valley. Chris lumbered through the Putnam County school system graduating from Winfield in 1999. Chris then spent eight great years in Morgantown attending West Virginia University. While eight years seems like a lot, he did go on to graduate in 2003 with a B.S. in Political Science and in 2007 with a J.D. from West Virginia University.

After graduating law school, Chris left West Virginia for a year to live in the coastal Charleston. He quickly realized the error of his ways and returned to West Virginia to work in the legislature for the Joint Committee on Government and Finance.

After that Chris was proud to serve in Governor Earl Ray Tomblin’s administration as Deputy Director of Public Policy. While in the Governor’s office, Chris dedicated himself to education, energy and government efficiency.

Chris reluctantly left the Governor’s office to join LGCR Government Solutions as the Deputy Director of Government Relations and Advocacy. At this firm he represented clients ranging from Fortune 500 companies to small non-profits.

Chris is now the Senior Manager of West Virginia Government Relations for Southwestern Energy, a vertically integrated oil and natural gas exploration and production company operating in West Virginia and Pennsylvania. He has been married to his wife Kelly Matheney Weikle for six wonderful years. Kelly and Chris have been blessed with two magnificent kids, Ainsley and Landon who keep Kelly and Chris on their toes.

Court Cases Continued from page 2 by improperly imposing a cap on the amount of operating expenses which may be deducted and was likewise in violation of the “equal and uniform” provision and equal protection provisions of the U.S. and WV Constitutions. The business court also found that the tax department should have allowed the deduction of post-production expenses in their formula for calculating average operating expenses, which they do not currently allow. The business court ruling also allowed the use of a percentage deduction instead of an actual monetary average of expenses (which IOGA has also argued for an actual monetary deduction instead of a percentage). The short version of the Supreme Court opinion is: • The Supreme Court ruled that the tax department rule does not permit a cap to be placed on operating expense deductions. A win for industry.

• The Supreme Court did not agree with the business court regarding use of a percentage deduction versus an actual monetary average as a uniform deduction. The court remanded this issue back to the business court to fix the assessments and issue an order consistent with the Supreme Court opinion. A win for industry.
