The West Virginia Energy Plan

The West Virginia Division of Energy is in the process of updating the West Virginia Energy Plan.

The original five-year plan was published in 2012 and runs through 2017. During the initial five years of the Plan, the state’s energy sector experienced significant change.

Coal production fell by more than forty percent (40%) during the last five years, while natural gas production more than quadrupled during the same period. This trend was consistent with the what is happening across our country. In 2016, natural gas was the largest source of power generation in the United States at thirty-four percent (34%), while coal dropped to under thirty percent (30%).

The Energy Plan is comprised of three essential parts: Fossil Fuels, Energy Efficiency and Renewable Energy. Each part of the plan contains policy issues, a report on the previous five-year recommendations, energy opportunities and a summary of the recommendations for the next five years. The bulk of the research was conducted by the West Virginia University Bureau of Business & Economic Research and Marshall University Center for Business and Economic Research.

The West Virginia Division of Energy is coordinating the completion and implementation of the Energy Plan.

While we all realize that each part of the plan is critical to the future success of West Virginia and the United States, this article is going to focus on the Fossil Fuel part of the Energy Plan. The Energy Plan provides that: “The State of West

Virginia’s 2018-2022 State Energy Plan will provide analysis and make policy recommendations to guide the state in reliably meeting its future energy needs in a cost-effective and sustainable manner while fostering an innovative clean energy economy.” Clearly, natural gas is the most cost-effective and sustainable energy source we have in West Virginia.

More importantly, the natural gas industry offers the best hope for job creation and economic diversification in West Virginia.

We are so fortunate to sit on top of the largest natural gas field in the nation and one of the largest natural gas fields in the world. The drilling of additional natural gas wells, the development of pipeline infrastructure and support for the Appalachian Ethane Storage Hub are essential in realizing our state’s potential. Therefore, recommended policy initiatives that should be included in the Energy Plan should include the following: • Updating our outdated mineral development laws utilizing the concept of cotenancy. West Virginia is one of only three states that does not have some type of mineral efficiency statute that applies to all oil and gas bearing formations.

• Encouraging and supporting pipeline infrastructure projects.

• Implementing property tax reform measures that allow for the deduction of actual expenses incurred in the production of oil and gas, and severance tax reform measures that encourage the development of

wells in distressed natural gas service areas.

Updating the deep well spacing laws. Current law was promulgated in 1972 and is applicable to vertical wells. When drafted in 1972, deep well spacing laws did not contemplate the drilling of horizontal wells.

Key Oil Company - It’s In the Family Blood Editor’s Note: This interview involved Key Oil Company President Jan Chapman.

How and when did your company get started in this industry?

Key Oil Company was founded in 1978 by Joe McLaughlin. After college graduation, I had worked one year for Carl E. Smith pipeline construction and another for Consolidated Gas Supply Corporation.

Joe offered me a job as a well tender, landman, etc. in December of 1978 and I accepted. I was the first full-time employee hired by Key. How many wells do you operate?

In 1978, Key was one of the first companies to drill the Alexander formation (5600’) in Doddridge Co., WV. Over the next 14 years, we continued to drill wells in WV to various depths.

Joe McLaughlin passed away in 1992. His partner, Midge Taylor, enabled me to get started on my own by placing Key’s assets on a 10-year note. At the time, the assets consisted of a blanket drilling bond, three vehicles, some office equipment and the operation of 104 wells.

From 1992 to the present, I was able to acquire the drilling acreage, raise the capital and, with the help of many good employees and

I feel that IOGAWV does an excellent job serving its members.

What are the biggest changes you’ve seen in the industry in your career?

The biggest change I have seen in my career is seeing the majority of drilling in WV switch from vertical to horizontal.

What are the three biggest challenges you see today?

The biggest challenges over the last few years have been adjusting to the largest drop in gas prices I had ever experienced and living with firm transportation and the negative basis in the northeast.

From the Burd’s Nest: Real Hope For the Future On August 22, 2017, your association was asked to speak before the West Virginia Legislature’s newly formed Joint Committee on Natural Gas Development. Phil Reale, Chief Lobbyist for IOGAWV, gave an outstanding presentation on the state of the industry in terms of drilling efficiencies and increased production; the investment of billions of dollars from drilling, pipeline construction, natural gas processing facilities and leases; the contribution of millions of dollars in payroll, severance and property taxes; the payment of royalties; and of course, the value of those high-paying retained and newly created jobs for hard-working West Virginia workers.

The message was very clearly articulated: “Natural gas is West Virginia’s one best single HOPE for the future.” And, if West Virginia is to achieve its highest potential, decision makers must embrace oil and natural gas as not a narrow path — but as an interstate highway, and to facilitate this growth and realize its true potential, they must adopt sound public policy that allows the West Virginia oil and natural gas industry to compete with neighboring states. By comparison, last year West Virginia natural gas production increased by 4.3 percent while Pennsylvania saw a 9.37 percent increase.

This five percent deficit represents the loss of opportunity for West Virginia to realize tremendous investments in wells and accompanying infrastructure and in the creation of much needed, high-paying new jobs for hard-working West Virginians.

Not long ago, West Virginia House of Delegates member, John Kelly, while addressing a group, told the at-

tendees that, in his opinion, the cure to the State’s financial woes could be found just a mile or so from where they sat. After a moment of perplexed looks and murmurs, Delegate Kelly pointed straight down and told the crowd he was referring to the Marcellus and Utica Shale formations some six thousand feet below.

John gets it!! But others, too, need to get on board.

West Virginia producers drilling for oil and natural gas currently encounter a variety of hurdles that hinder their ability to remain competitive with Pennsylvania and Ohio.

If the Marcellus and Utica Shales are to be fully harvested, it will take policy reforms and progressive legislation that provide for regula-

tory surety and fair expectations.

Our State’s decision makers have the opportunity to embrace the potential that lies before them which can create greater financial impacts through the continued expansion of downstream opportunities and a dramatic increase of jobs in West Virginia and across the entire Appalachian Basin Your IOGAWV lobbying team is working diligently with the Governor, his staff, West Virginia’s legislative leadership and legislators to educate them on how and why oil and natural gas development represents the single best opportunity for resolving the financial issues which plague our state and to give HOPE to all West Virginians.

More Support for Electric Generation Using Natural Gas As we all know, the combination of horizontal drilling and hydraulic fracturing have helped unlock vast volumes of natural gas in shale formations ("shale gas"). The boom in shale gas production led some to have concerns about potential contamination of drinking water and possible human health impacts related to the hydraulic fracturing completion process. Concerns by some members of the public coupled with the ongoing shift to natural gas for electricity generation led researchers to believe it important to place into proper context the potential human health impacts of shale gas relative to coal in the electricity generation context.

In a study published last month in the journal Environmental Science & Technology, representatives of the University of Michigan compared the toxicity associated with coal-fired electricity generation to electricity generation using shale gas. The authors are Shelie Miller, an environmental engineer and an associate professor at the University of Michigan School for Environment and Sustainability's Center for Sustainable Systems, Brian Ellis, Department of Civil and Environmental Engineering, and Lu Chen, a recent graduate of the School of Environment and Sustainability. The headline is that the lifetime toxic chemical releases associated with coal-generated electricity are 10 to 100 times greater than those from electricity generated with shale gas.

Thus, a continuing shift from coal to shale gas will reduce the overall "toxicity burden" of electricity generation thereby benefiting human health and the environment.

The study represents a comparative analysis of the health effects of electricity produced from shale gas and coal in the form of a life cycle impact assessment. The study evaluates the amount of toxic chemicals released into the air, soil and water during both the resource extraction and electricity generation phases of coal and shale gas. The study concludes that the potential human health impacts of electricity produced from coal are much higher.

The analysis likewise observed that the particulate matter released into the air from power plants during electricity generation was the dominant toxicity component and significantly exceeded any chemical releases that may occur during the natural resource extraction process.

In addition, it was noted that the harmful air emissions from coal-fired power plants were much worse than emissions from natural gas electric generation facilities.

For the coal life cycle, the study estimated the toxicity associated with air pollutants emitted during power generation, as well as toxic chemical releases during the coal-mining process from acid-mine drainage and coal-ash impoundment. The air pollutants analyzed for the coal system included particulate matter (soot), mercury, volatile organic compounds, nitrogen oxides and sulfur oxides.

For the hydraulic fracturing life cycle, the study estimated the toxicity of the fracturing fluid chemicals used to crack rock and release natural gas, as well as the wastewater associated with shale-gas extraction. The researchers also looked at air pollutants emitted during both shale-gas extraction and electricity generation.

According to the study, even in the highly unlikely event of a release of all of a well's hydraulic fracturing fluid and untreated wastewater into surface waters for the lifetime of the well, shale gas electricity had a lower lifetime human toxicity impact than coal electricity. The authors caution, however, that the results provide a comparison of relative toxicity, but the significant uncertainties and inaccessibility of data, especially concerning hydraulic fracturing chemicals, precluded a full-blown risk assessment. As Miller explained "[t]his analysis does not imply that concerns associated with shale gas production are unfounded, only that the overall toxic load of coal is definitely greater."

The study by Miller and her colleagues is believed to be the first head-to-head comparison of coal and shale gas from the resource extraction phase through electricity generation. Accordingly, in addition to the current economic advantages that natural gas has compared to coal, this study provides academic support for the proposition that natural gas is and will remain a critical component of our nation's energy supply for electricity generation, as well as industrial feedstock, and commercial and residential heating uses. The added benefit is that natural gas provides human health and environmental advantages too.

Supporting the concept of bypass which would allow end users of large volumes of natural gas to buy directly from a natural gas producer or pipeline operator. Bypass would facilitate competition and reduce energy costs for the end user.

Evaluating the state economic development policies for the purpose of assuring that West Virginia is poised to attract ethane crackers; downstream plastics manufacturing; new chemical manufacturing facilities; expansion of existing

chemical industry installations; and capturing the full potential represented by the production of natural gas and the Appalachian Ethane Storage Hub. Developing policies, including drafting and introduction by the Administration, of such legislation as may be beneficial to encourage the development of natural gas-fired power plants in West Virginia consistent with the level of development in our neighboring states of Ohio and Pennsylvania, each having in excess of 20 such gas fired power

plants while West Virginia has but two.

The policies should be included in the Energy Plan and, if enacted, they will result in the drilling of additional gas wells, reduce administrative burdens hampering development, create thousands of jobs and attract manufacturing industries to West Virginia. The obvious benefits are increased tax revenues on both the state and county levels, the cessation of the out-migration of our talented young people and the revitalization of the economy in West Virginia.

The Power of Hope?

Last week at the Global Plastics Summit (GPS) in Chicago was a good week for our region that we now call the Shale Crescent. Our goal was to create awareness for what we have to offer. I talked to the CEO of a service provider from the Netherlands at the conference.

He said, “Americans are so optimistic. You would never see that in my country.” How sad to live in a place that doesn’t have hope or optimism in the future. Remember Henry Ford’s words, “If you think you can or think you can’t, you are right.”

Whether you are playing sports or are in business, our success starts with how we think. Our thoughts determine our actions. I had a friend at WVU who told me that he would probably fail the chemistry test that week. Instead of studying, he went out and drank beer. Later, when I asked how he did, he responded almost proudly, “Failed it just like I told you I would.” Recently, when Lynnda and I were at Disney’s Epcot World Show Case, I visited with a young man from France who was working at Disney and dreaded going home. I asked, “What is the biggest difference between here and France?” He quickly responded, “Here you still believe in your future.” How sad to live in a country where people don’t believe tomorrow can be better than today.

Our thoughts determine our actions. If you believed that you were going to drill a dry hole or an uneconomic well, would you still drill it?

If you believed your business would fail, how hard would you work at it?

How many sales people have this attitude of failure and can’t figure out why people don’t buy from them?

I recall an opposing coach who told me after we had soundly defeated them, “We knew that we couldn’t beat you, so we just tried to keep the score down.” Maybe he accomplished his objective. We won 8-0. He never gave his players a fighting chance. I recall when WVU beat Oklahoma, then ranked 4th in the country, 48-28 in the 2008 Fiesta Bowl under coach Bill Stewart. In a pregame poll, the only state in the country that believed WVU could win was West Virginia.

Our Shale Crescent Team went into GPS with expectations of success and are excited with the results; • Our video on the benefits of the Shale Crescent Region was shown multiple times over three days on the jumbo screen in the exhibit hall. This video also showed before the start of conference on main stage and again at lunch on Thursday. All attendees should have seen it at least once.

• We were interviewed by the editor of Chemical Week Magazine. This video also ran continually on Thursday and Friday in the exhibit hall.

• Attendees could have lunch with us on Thursday to learn more about the Shale Crescent.

We had three full tables instead of just two as anticipated!

Results • Met with key decision makers, CEOs and Company Presidents of multiple companies.

They knew who we were. We have a follow up with a major Asian Company in Houston next week.

• Mexican firm looking for a

manufacturing location in the USA invited to visit.

• Japanese company interested in the Shale Crescent invited to visit.

• CFO and Senior VP for a large US petrochemical company want to meet in the next few weeks.

• We have been asked to speak a large Chemical and Petrochemical Manufacturers conference in India in 2018.

None of this happens by accident.

It takes work, planning and creativity.

We are starting to see growth from firms already located here. Solvay in Pleasants County has a major expansion announced and HINO is expanding in Parkersburg. Ark Resin in Marietta has opened a new warehouse. These are just a few examples.

Others are being planned. There are many reasons why and where a company chooses to expand. Our message to these and other local companies has been to look at all of the advantages they already have, particularly the cheap and abundant energy in the Shale Crescent, and expand here. We are happy that these companies have chosen to do that. If local companies choose to expand here it sends a very positive message to companies outside our region looking for a place to expand.

Expanded local demand for natural gas and liquids is good for the West Virginia oil and gas industry.

Think of what the American oil and gas industry has already accomplished. This country has gone from energy crisis to energy gorilla of the world in less than 10 years, thanks to American ingenuity, hard Power of Hope Continued on page 8

Companies were willing to take risks because they believe in the future.

That has not happened in Europe.

If we believe that we will succeed at any task, and are serious enough to do the required work, we create an opportunity for success. When you asked you spouse to marry you, did you believe they would say “yes”?

Leadership expert John Maxwell said, “If there is hope in the future, there is power in the present.”

My goal is to help you believe in a positive future so that you will take control now and be willing to do whatever it takes to achieve your vision or dream of success.

Since 2008 the antis have been doing all they can to destroy hope in the future. The energy picture they paint with minimal use of natural gas and coal is cold, dark and expensive. The public is looking for hope. Based on the media I have been doing and the people I meet at public forums, the public has begun to realize that they have been lied to and duped by the major media and the “environmental” groups we call the antis. They are looking for truth and hope. We need to do all we can to make sure they get it. Our future may depend on it.

IOGAWV Presents at WV Energy EXPO Hosted by the WV Department of Commerce and WV Economic Development Council, the WV Energy Expo in Morgantown on Oct. 4 was a one-day business event tailored towards growth and opportunity in the energy industry in West Virginia.

IOGAWV Executive Director Charlie Burd and Office Manager Lori Miller Smith staffed a booth at the state’s largest energy-focused trade show showcasing regional products, services and technologies.

IOGAWV Winter Meeting January 23-24, 2018

WeatherBELL is expecting a faststarting winter this year. It will back off for a time, but will likely return with a vengeance.

In the last few months, forecast models that were predicting an El Niño are now expecting a La Niña.

Despite a similar La Niña to what we had last year, other key source regions have completely different patterns this time around. Because La Niña will be on the weak side, these other drivers should be more important this winter.

Overall, expect warmer weather across the South, particularly the Southwest, and colder weather across the North. West Virginia will be in the battleground area, which tends to mean a lot of snow (when it’s cold) or rain (when it’s not).
