Proyecto de ley en Iowa exigiría el uso de “E-Verify” para comprobar el estatus migratorio de los trabajadores Los legisladores de Iowa presentaron una propuesta para tipificar como delito la contratación de trabajadores indocumentados y obligar a los empleadores a utilizar el sistema federal E-Verify.

Veterano fotógrafo de los Quad-Cities reflexiona sobre sus 35 años de carrera profesional Por Stephen Elliott, Hola Iowa Davenport, IA - Una combinación de humildad y orgullo viene a la mente al hablar y observar las fotografías de José Murillo, residente de Davenport desde hace mucho tiempo y fotógrafo profesional.

En una reciente tarde de invierno, Murillo me recibió en su casa de Vine Street, en Davenport, Iowa. La calle de ladrillo de enfrente es larga y empinada, una colina que ese día tenía sus problemas con la nieve y el hielo. Me abre la puerta del

porche y, con una sonrisa y un gesto de bienvenida, me invita a entrar en su casa.

Al entrar en la casa de Murillo, uno gira a la izquierda y una pequeña habitación está cubierta de imágenes. Las paredes están repletas de fotografías. Eventos y personas son capturados permanentemente por un momento en el tiempo - bodas, bautizos, reuniones familiares, eventos deportivos.

“Siéntate, siéntate”, me dice Murillo, de 74 años, mientras se sienta frente a mí.

No puedo evitar mirar las fotos, por

tanta gente sonriendo desde donde quiera que estuvieran en ese momento, y por lo que estaban haciendo. Además, hay álbumes de fotos de Murillo con famosos atletas y celebridades, como el campeón mundial de boxeo Michael Nunn, Mr. T, el famoso corredor de Davenport y de los San Francisco 49ers Roger Craig, y el ex campeón de los pesos pesados James “Buster” Douglas.

También hay políticos, como el ex presidente Barack Obama y el senador por Vermont Bernie Sanders. En su habitación cuelgan de la pared pases de prensa, muchos, de acontecimientos deportivos pasados y presentes, como el combate Michael Nunn-Lonnie Horn, o el Bix 7, por citar sólo algunos.

El difunto Antwun Echols, ex aspirante mundial de peso medio de Davenport, reside en las paredes de Murillo, fotos del prometedor peso medio de joven en el ring, una foto firmada por Echols a Murillo. Murillo entabló una relación con Echols, al igual que con Alvino Peña, leyenda del boxeo de los Quad-Cities y entrenador.

Murillo es un tipo de su comunidad, y da la sensación de que en cualquier barrio en el que se encuentre se sentiria como en casa. Parte del atractivo de sus fotos es la sensación de la identidad de esa persona, esa sensación de comunidad a veces, que se muestra en los rostros de sus retratados.

“Con mis fotos, decidí que podía ayudar a esta gente y hacer mejores fotos por menos dinero, mucho menos dinero”, dice. “Esa fue una de las cosas que me impulsó a ser fotógrafo”.

Resulta que el boxeo es una de sus principales formas de expresión Es una cara conocida en los clubes de boxeo y los espectáculos de peleas, tanto amateurs como profesionales, de los Quad-Cities. “Me gusta hacerlo. Tengo 74 años y puedo ir al ring de aquí para allá, tomando fotos, porque, es algo que en tu corazón te gusta hacer.”

Su carrera de 35 años como fotógrafo Murillo se jubiló hace unos 14 años tras el cierre de Black Hawk Foundry & Machining Co. en Davenport, donde trabajó durante 33 años.

Su verdadera vocación durante la mayor parte de su vida adulta ha sido el arte, su ojo para la cámara. Originario de la Ciudad de México, se mudó a Estados Unidos en 1969.

Su mujer, Luz, está cocinando en la cocina esta tarde invernal mientras él habla de su pasión por la fotografía. Han criado a tres hijos, y ahora tienen nietos y bisnietos. Conoció a su mujer cuando estaba en Texas recogiendo tomates a principios de los años setenta. Volvieron a Iowa, Murillo fue al Muscatine Community College, donde se certificó en soldadura, y empezó a trabajar en la fundición.

Antes de venir a América, trabajó para un periódico en México tomando fotos cuando era adolescente, pero nunca tuvo cámara propia. El mismo año que llegó a Estados Unidos y a Iowa City, visitó a una prima en Chicago. La visita sirvió para mantener vivo su interés por la cámara cuando le cambió a su prima una pequeña televisión por una cámara Ricoh de 35 mm.

“Le dije: ‘Te cambio mi televisor por esa cámara”, recuerda Murillo. “Y, a mi prima, le gustó la tele y a mí la cámara”.

Siguió trabajando con sus cámaras mientras formaba una familia con su mujer. Estaba el trabajo en la fábrica que pagaba las facturas y llevaba comida a la mesa, y luego, estaban las fotografías.

segundo trabajo”, dice. “Y, empecé a hacer fotografía aquí y allá”.

Murillo ha hecho muchas de sus fotos gratis, retratando a muchos jóvenes púgiles aficionados durante sus espectáculos de boxeo, y regalándoles después las fotografías de sus combates.

Los asistentes a las próximas peleas de boxeo profesional en los Quad-Cities, el sábado 10 de febrero en el RiverCenter de Davenport, podrán ver una cara familiar junto al ring, un hombre con sus cámaras, un artista creando su propio lienzo desde el ring de boxeo.

Murillo ha colaborado con el periodico Hola America desde el comienzo en el 2000.

“Me da mucho orgullo el formar parte del equipo de Hola America por casi 24 años. Estimo mucho a Tar y Erika Macias y a todos los lectores que todos estos años han apreciado mis fotografías” nos compartió Murillo.

“Una cosa que nadie puede negar es la pasión y compromiso que Don Murillo a demostrado por 35 años con la comunidad del boxeo y el fútbol local.

Y formando parte de los momentos especiales de cada familia capturando, no solo imágenes, sino bonitos recuerdos” Murillo reflexiona ahora sobre su propia carrera, y dice que hacer fotos es similar a la vida.

“Intento hacerlo bien”, dice Murillo.

“Eso es lo más importante. Que lo intentes. Mucha gente no lo hace. Sólo así puedes mejorar”.

Murillo dice que aún tiene ganas de intentarlo, y de alcanzar esa fotografía que siempre le da la satisfacción de lo que deseaba.

“Tomas una foto porque te encanta hacerlo”, dice. “Y, cuando amas hacerlo, te sale del corazón. No hay nada comparable a eso”.

LULAC Davenport celebra 65 años de servico de la comunidad latina de los Quad Cities y más allá Historia del Concilio 10 en Davenport, Iowa En 1959 Henry Vargas concibió la idea de organizar a los mexicano-americanos locales de Davenport con la esperanza de lograr fuerza política con un frente unido. Su hermano Jesse convenció al grupo de unir fuerzas con un grupo al que ya estaba afiliado, los Jóvenes Demócratas del Condado de Scott.

Poco después, Chai Vasquez, originario de Fort Madison, informó al grupo sobre LULAC y su propósito de mejorar las condiciones sociales y económicas de los hispanos. En una reunión organizada por Vargas y Ernest Rodríguez, Vásquez presentó al grupo a Jesse Mosqueda, de Des Moines. Mosqueda era entonces el Director Regional de LULAC. Como resultado de esa reunión, el Concilio 10 de LULAC fue fundado el 16 de febrero de 1959.

En ese momento, había otros cuatro concilios de LULAC en el estado de Iowa: #304 en Fort Madison el primero del estado, #306 en Des Moines, Concilio de Damas #308 en West Des Moines, y #319 en Mason City.

La mayoría de los miembros originales del Concilio 10 eran mexicano-americanos de segunda y tercera generación cuyos padres llegaron a la zona para trabajar en

el ferrocarril o en fundiciones como The Bettendorf Car Company. Algunos también fueron contratados en International Harvester o John Deere.

Tras su formación, el concilio tuvo un impacto inmediato en la comunidad, desde representar con éxito a Gilbert Fernández, un empresario local implicado en una controversia con la ciudad, hasta recaudar fondos para la Fundación del Corazón, pasando por participar activamente en el concilio municipal y en el distrito escolar de Davenport.

Al principio, el Concilio 10 se reunía donde podía: en la YMCA y en varias tabernas. En 1961, el concilio alquiló un local en Perry Street, en el centro de Davenport, y abrió un establecimiento conocido como The LULAC Club.

Allí se celebraron reuniones, otros asuntos del concilio y muchos actos sociales hasta 1969.

Fue entonces cuando el concilio se trasladó a su ubicación actual en el extremo oeste de Davenport. Esta propiedad fue adquirida a través de un proceso de licitación del Distrito Escolar de Davenport a un costo de 12,500 dólares.

A lo largo de los años, el edificio y los terrenos han visto muchas mejoras, bailes, recaudaciones de fondos, eventos políticos... y bingo. De hecho, el bingo ha sido el pilar de las instalaciones desde que el concilio se trasladó allí en

1969. El poder de permanencia del bingo semanal se debe en gran parte a Salvador López, quien, por cierto, fue uno de los miembros de la segunda generación que fundó este concilio en 1959.

A lo largo de las décadas de 1970 y 1980, el concilio defendió una y otra vez “La Causa de La Raza”, el grito de guerra de la época. El Grupo de Trabajo de Habla Hispana en 1974, el Concilio de Migrantes de Illinois y el Comité de Boicot a la Uva son sólo algunos de los desafíos en los que el Concilio 10 hizo sentir su presencia.

Historia reciente Las últimas tres décadas del siglo XX fueron una época en la que los miembros del Concilio 10 tuvieron un impacto inconmensurable en la experiencia hispana en el área de los Quad Cities. Pero otro reto se cernía sobre el horizonte del concilio. En 2006, los guerreros que libraron tantas batallas en nombre de la justicia social para sus hermanos y hermanas latinos ye eran mayores y se estaban cansando.

Y su número también disminuía. En 2008, el número de miembros se había reducido a 46.

Al año siguiente, Michael Reyes fue elegido presidente del concilio y las cosas empezaron a cambiar de inmediato. Comenzó la remontada del Concilio 10 buscando y recibiendo fondos muy necesarios para mejorar las instalaciones. Al mismo tiempo, Reyes mejoró radicalmente el emblemático programa de becas del concilio. La cantidad concedida a estudiantes universitarios merecedores ha aumentado en un 500% desde 2007. Hasta la fecha, el Concilio 10 de LULAC ha concedido más de 750,000 dólares en becas a unos 1,200 estudiantes.

A medida que mejoraba el dinamismo del concilio, también lo hacía su número de miembros. Para 2023, el Concilio 10 tenía 184 miembros activos que pagaban sus cuotas y se espera pasar los 200 miembros este año. El futuro del Concilio 10 de LULAC parece tan brillante como siempre lo ha sido en este momento.

En la cena de becas del año pasado, la Presidente de LULAC Council 10, Toni Robertson, tuvo un mensaje alentador para los becarios.

“Necesitamos que se conviertan en líderes en sus comunidades y continúen construyendo sobre la base que fue establecida por aquellos que vinieron antes que ustedes.

Con la ayuda de ustedes, LULAC seguirá creciendo y ayudando a todos los que vendrán después”, dijo Robertson.

Con ese mensaje, encarna el lema nacional de LULAC “Uno para todos y todos para uno” (A.Dumas).

Des Moines, IA - Héctor Salamanca Arroyo atribuye sus éxitos educativos y oportunidades de servir al público al costo de la colegiatura estatal para la que calificó como residente de Iowa. Le permitió estudiar justicia penal en Des Moines Area Community College, lo que lo llevó a la Universidad Drake después de calificar para la Acción Diferida para los Llegados en la Infancia (DACA) y eventualmente servir en las fuerzas del orden y en el ejército.

Ahora, ciudadano estadounidense de pleno derecho, Arroyo habló el lunes ante miembros de la Cámara de Representantes de Iowa instándolos a oponerse a un proyecto de ley que impediría que los estudiantes tuvieran las mismas oportunidades educativas que él tuvo. Iowa Bill would require use of ‘E-Verify’ to check workers’ immigration status Iowa lawmakers moved forward a proposal to make hiring undocumented workers a crime and require employers to use the federal E-Verify system.

By Robin Opsahl, Iowa Capital Dispatch Des Moines, IA - Advocates for businesses and immigrants spoke Wednesday in opposition to a bill in the Iowa Senate that would require employers use the federal E-Verify program to ensure they are not hiring undocumented immigrants.

Republican senators on a subcommittee voted to advance Senate File 108, legislation prohibiting Iowa employers from knowingly hiring a worker who is not authorized to live or work in the country.

The bill is a holdover from the 2023 legislative session, when it advanced through the committee process but was not brought to the Senate floor. Similar bills have been considered in previous legislative sessions but ultimately have not advanced.

While lobbyists speaking on behalf of Iowa business groups said employers want to ensure they are not hiring undocumented workers, many brought forward concerns

with the legislation requiring use of E-Verify. The federal web-based system shares a potential hire’s I-9 employment eligibility verification form with the federal Social Security Administration and Department of Homeland Security to ensure they are legally able to work in the country.

Dustin Miller, representing multiple business groups including the Iowa Grocery Industry Association, Iowa Chamber Alliance and Greater Des Moines Partnership, said the concern is that “the system doesn’t work.” He said there are currently 70,000 false positives each year among employers that use the system — many of those being workers under age 18 because they’re not yet in federal databases.

“I can’t stress enough: no one wants to employ unauthorized aliens,” Miller said. “If the system worked and it was simple, employers will not have a problem. But tied to a system that is broken causes these problems.”

Sen. Julian Garrett, R-Indianola, defended the system, saying that he has talked to many employers already using the system who say it is working as intended.

“You send it in, 99% of the time or more, you get right back, you get confirmation that it’s fine,” Garrett said. “…

It doesn’t delay them, for the most part. Once in a while, something happens. What I do hear on a lot, is from just average citizens, not coming up here to lobby or whatever … who say, ‘we need to stop this illegal immigration, we need to stop people undercutting our wages.’”

The legislation would make it a crime to knowingly employ an “unauthorized alien employee,” and would allow law enforcement, county attorneys and members of the public to file complaints with Iowa Workforce Development. If the employer is found in violation, IWD would be required to bring action in district court.

A first offense would require businesses fire all undocumented employees, serve three years probation filing quarterly reports on new hires and must sign a sworn affidavit to not hire undocumented workers. If a business does not file the sworn affidavit, the state would have the ability to

suspend their business license. Subsequent offenses could mean the permanent loss of the employer’s business license.

Tom Chapman with the Iowa Catholic Conference said while the legislation allows for the court to consider whether a business made a “good faith” effort to comply with the requirements, he criticized the lack of options available for employees who are incorrectly labeled as undocumented workers under the E-Verify system.

“You know, when the E-Verify system comes back with a false positive, they’re not going to be able to get a job unless they can get that fixed, And that is a time-consuming, and can be a scary process if you’re trying to get a job.”

Chuck Hurley, an advocate with The Family Leader, spoke as a matter of personal interest in support of the bill, saying that mandating the E-Verify system for employers will help with efforts to improve security and stop illegal immigration at the U.S-Mexico border.

“I don’t want to see any businesses harmed,” Hurley said.

“But we’re at a crisis point, basically have an invasion.

And everybody’s gonna have to do their part.”

Sen. Tony Bisignano, D-Des Moines, voted against advancing the bill, saying the number of businesses opposed to the measure should “give pause” to the lawmakers seeking to advance the measure. He criticized Hurley’s statement that there was an “invasion” happening along the U.S. southern border, saying that the characterization does not describe the “human tragedy that we’re seeing in real time” with migrants attempting to enter the country. He said the bill will not address concerns about the border.

“Every ugly thing that’s coming with what’s happening — Iowa’s not going to resolve it,” Bisignano said. “Iowa’s not going to resolve it with E-Verify. The nation hasn’t been able to resolve it, period, but E-Verify hasn’t solved that problem.”

Iowa Sen. Tom Shipley, R-Nodaway, supported advancing the bill, saying that it needs work to address the concerns brought up during the subcommittee meeting.

La ley tipificaría como delito la contratación a sabiendas de un “empleado extranjero no autorizado”, y permitiría a las fuerzas del orden, a los fiscales del condado y a los ciudadanos presentar denuncias ante el Iowa Workforce Development. Si se descubre que el empleador ha cometido una infracción, el IWD deberá emprender acciones legales ante un tribunal de distrito.

Una primera infracción exigiría a las empresas despedir a todos los empleados indocumentados, cumplir un periodo de prueba de tres años presentando informes trimestrales sobre las nuevas contrataciones y firmar una declaración jurada de no contratar a trabajadores indocumentados.

DES MOINES Iowa LULAC councils, labor unions, and migrant agencies marched in Des Moines to press for passage of migrant worker bills pending in the Iowa legislature, 19169. 1,500 activists marched in Des Moines in February, 1969.

In 1959 Henry Vargas conceived the idea of organizing local Mexican Americans of Davenport with the hope of achieving political strength with a united front. His brother Jesse persuaded the group to join forces with a group he was already affiliated with, the Scott County Young Democrats.

Shortly thereafter, Chai Vasquez, originally from Fort Madison, informed the group of LULAC and its purpose of improving the social and economic conditions of Hispanics.

At a meeting organized by Vargas and Ernest Rodriguez, Vasquez introduced Jesse Mosquada of Des Moines to the group. Mosquada was the LULAC Regional Director at the time. As a result of that meeting, LULAC Council 10 was chartered on February 16, 1959.

At that time, there were four other LULAC councils in the state of Iowa: #304 in Fort Madison the state’s first, #306 in Des Moines, Ladies’ Council #308 in West Des Moines, and #319 in Mason City.

Most of the original members of Council 10 were second and third-generation Mexican Americans whose parents came to the area to work on the railroad or at foundries such as The Bettendorf Car Company. Some were also hired at International Harvester or John Deere.

Upon its formation, the council had an immediate impact on the community, from successfully representing Gilbert Fernandez, a local businessman involved in a dispute with the city, to raising funds for the Heart Foundation to becoming active participants in the city council and the Davenport School District.

In the early days, Council 10 met wherever they could – at the YMCA, and various taverns. In 1961 the council leased a storefront on Perry Street in downtown Davenport and opened an establishment known as The LULAC Club. Meetings, other council business, and many social events were held there until 1969.

It was then that the council made the move to its present location at the west end of Davenport. This property was acquired through a bidding process from the Davenport School District at a cost of $12,500. Over the years, the building and grounds have seen many improvements, dances, fundraisers, political events – and bingo. In fact, the ongoing bingo operation has been the steady mainstay of the facility since the council moved there in 1969. The staying power of the weekly bingo operation is owed largely to Salvador Lopez, who, incidentally, was one of those second-generation members who started this council in 1959.

Throughout the 1970s and 1980s, the council stood up time and again for “La Causa de La Raza” – the rallying cry at the time. The Spanish Speaking Task Force in 1974, the Illinois Migrant Council, and the Grape Boycott Committee are but a few challenges where Council 10 made its presence felt.

Recent History The last three decades of the 20th Century were a time when the members of Council 10 had an immeasurable impact on the Hispanic experience in the Quad-City area. But another challenge was looming on the council’s horizon. By 2006 the warriors who fought so many battles in the name of social justice for their Latino brothers and sisters were getting tired.

And their numbers were dwindling as well. By 2008 membership was down to 46 members.

The following year Michael Reyes was elected president of the council, and things immediately began to change.

He began the Council 10 comeback by seeking out and receiving badly needed funding to upgrade the facility. At the same time, Reyes dramatically improved the council’s flagship scholarship program. The amount awarded to deserving college-bound students has increased by 500% since 2007.

To date, LULAC Council 10 has awarded over $750,000 in scholarships to approximately 1,200 students.

As the momentum of the council improved, so did its membership. By 2023, Council 10 had 184 due-paying active members. The future of LULAC Council 10 looks as bright as it ever has at this point.

At last years scholarship dinner LULAC Council 10 President, Toni Robertson, had an encouraging message to the scholarship recipients.

“We need you to become leaders in your communities and continue to build on the foundation that was laid by those who came before you. With your help, LULAC will continue to grow and assist all those that will follow.” said Robertson.

With that message, she embodies LULAC’s national motto “One for All and All for One” (A.Dumas).

Long-time Quad-Cities’ photographer reflects on professional career of 35 years

By Stephen Elliott, Hola Iowa Davenport, IA - A combination of humility and pride comes to mind when speaking and observing the works of long-time Davenport resident and professional photographer Jose Murillo.

On a recent winter afternoon, Murillo welcomed me into his home on Vine Street in Davenport. The brick street out front ascends steep and long, a hill on this day that had its challenges with snow and ice.

He opens his gate to the front porch and with a smile and welcoming nod, he invites me into his residence.

Upon entering Murillo’s home, you turn to the left and a small room is covered in images. Photographs line his walls. Events and people are permanently captured for a moment in time – weddings, baptisms, family gatherings, sporting events.

“Sit down, sit down,” Murillo, 74, says, as he sits across from me.

I can’t help but look at the pictures, because of so many people smiling from wherever they were at

that time, and what they were doing. There are photo albums in addition, photos of Murillo with famous athletes and celebrities, such as world boxing champion Michael Nunn, Mr. T, famed Davenport and San Francisco 49ers running back Roger Craig, and former heavyweight champion James “Buster” Douglas.

There are politicians, such as former President Barack Obama and Vermont Senator Bernie Sanders.

His room has press passes hanging from the wall, lots of them, from athletic events past and present, such as the Michael Nunn-Lonnie Horn fight, or the Bix 7, just to name a few.

The late Antwun Echols, former world middleweight contender from Davenport, resides on Murillo’s walls, photos of the promising middleweight as a young man in the ring, one picture signed by Echols to Murillo. He developed a relationship with Echols, as he did with the late Quad-Cities’ boxing legend and trainer Alvino Peña.

Murillo is a neighborhood guy, and you get the sense that whatever neighborhood he is in, he would

feel at home. Part of the appeal of his pictures is the feel of that person’s identity, that neighborhood feel sometimes, that shows in the faces of his subjects.

“With my pictures, I decided I could help these people, and I could take better pictures for less money, a lot less money,” he says. “That was one of the things for me being a photographer.”

Boxing happens to be one of his main forms of expression.

He’s a familiar face at the fight clubs and shows, both amateur and professional, in the Quad-Cities.

Prior to that, he worked for years taking pictures for Chicago Boxing Magazine, working the Chicago fight shows.

“This is what I do,” Murillo says. “I like to do it. I’m 74 years old and I can go to the ring back and forth, taking pictures, because, it’s something in your heart that you like to do.”

His 35-year career as a photographer Murillo retired roughly 14 years ago after the closing of the Black Hawk Foundry & Machining Co. in Davenport, where he worked for 33 years.

His true calling throughout most of his adult life has been art, his eye for the camera. Originally from Mexico City, he moved to the United States in 1969.

His wife, Luz, is cooking in the kitchen on this wintry afternoon as he speaks about his passion for pictures. They have raised three children, and now have grandchildren and great-grandchildren. He met his wife while he was in Texas picking tomatoes in the early 70s. They came back to Iowa, Murillo went to Muscatine Community College where he received a degree in welding, and he started work at the foundry.

Prior to coming to America, he worked for a newspaper in Mexico taking photos as a teenager, but never owned his own camera. The same year he came to America and Iowa City, he visited a cousin in Chicago. The visit proved to keep his camera interests alive when he traded a small television to his cousin for a Ricoh 35 mm camera.

“I said, ‘I trade you my TV for that camera,” Murillo remembers. “And, my cousin, she liked the TV and I liked the camera.”

He just kept working with his cameras while raising a family with his wife. There was the factory job that paid the bills and put food on the table, and then, there were photographs.

“When I worked at the foundry, I started to buy some of my camera equipment because I knew when I was going to retire, taking photographs was going to be my second job,” he says.

“And, I started doing photography here and there.”

Murillo has done many of his photos for free, taking pictures of a lot of young amateur fighters during their boxing shows, and giving them the photographs of their fights afterwards.

For those attending the latest boxing show in the Quad-Cities on Saturday, Feb. 10, at the RiverCenter in Davenport, they may see a familiar face ringside, a man with his cameras, an artist creating his own canvas from the boxing ring.

Murillo has collaborated with the newspaper Hola America since its beginning in 2000.

“It gives me great pride to be part of the Hola America team for almost 24 years. I greatly appreciate Tar and Erika Macias and all the readers who have appreciated my photographs all these

years” Tar Macias, the publisher of Hola America, spoke about the legacy of José Murillo in the community.

“One thing that no one can deny is the passion and commitment that Murillo has shown for 35 years for the local boxing and Latino soccer communities.

And being part of the special family celebrations, capturing not only images but heartful memories.”

Murillo reflects on his own career now, and says taking photos is similar to life.

“I try to do it right,” Murillo says.

“That’s the most important thing. That you try. A lot of people don’t do that.

That’s the only way you can get better.”

Murillo says he still has the desire to try and to reach that photograph that always gives him the satisfaction of what he wants.

“You take the picture because you love to do it,” he says. “And, when you love to do it, it’s coming from your heart.

There’s nothing that compares to that.”

Bill advances to require citizenship proof for in-state tuition

By Brooklyn Draisey, Iowa Capital Dispatch Legislation that would require students to show proof of citizenship or lawful residence in Iowa to qualify for instate tuition passed out of subcommittee Monday.

same educational opportunities he did. House File 2128 would require students to show proof of citizenship to receive in-state tuition.

“Education is supposed to be the mechanism that levels the playing field, and if an Iowa student is trying to continue their education, we shouldn’t punish them by putting higher education out of reach,” Arroyo said. “Whether you acknowledge it or not, these are Iowans who aspire to further their education in their home state. Iowans who aspire to be future Cyclones, Panthers and Hawks in the same way as I did in 2012. They deserve to be treated as Iowans and qualify for in-state tuition.”

Despite concerns expressed by community members and representatives of Iowa’s higher education systems that it could be discriminatory and burdensome, the bill passed a three-member subcommittee in the Iowa House.

The bill would require the Iowa Board of Regents and community college boards to adopt policies to prohibit schools from classifying a student as an Iowa resident, which would allow them to receive lower tuition and fees, without proof that the student is either a U.S. citizen or “lawfully present in the United States,” according to the bill.

Rep. Taylor Collins, R-Mediapolis, heard statements from the public alongside Rep. Sami Scheetz, D-Cedar Rapids, and Rep. Skyler Wheeler, R-Hull.

Other Iowans, many immigrants who later became U.S. citizens themselves, echoed Arroyo’s statement and spoke out against the bill for others like them, trying to seek an education while navigating barriers their peers don’t have to handle.

Joe Henry of the League of United Latin American Citizens (LULAC) said this legislation would also negatively impact the immigrant workers who work in different areas of agriculture, from the fields to processing to serving food. If they and their families were not able to receive the education they need to continue in the workforce, Henry said the agriculture sector would “shut down.”

Gabriel Saldana, a community organizer for Iowa Migrant Movement for Justice, said that in addition to limiting the workforce, this bill would also cause graduation rates and interest in higher education to drop. It would also be a blow to the families and educators working to support students.

States that have enacted legislation that provides tuition equity, rather than restrictions based on citizenship status, have seen more students graduate high school and attend post-secondary schooling, Saldana said, as well as other economic and social benefits. According to the National Immigration Law Center, 24 states and the District of Columbia have tuition equity laws in place, which ensure all state residents receive in-state tuition no matter their citizenship status.

“This is an attack upon the immigrant community,” Henry said. “Immigrants pay taxes, they pay their bills, they take care of things. They need to make sure that their kids can have a good education. They should not be charged out-of-state tuition.”

If passed, this bill would burden institutions as well as students, said Iowa Board of Regents lobbyist Keith Saunders.

The board currently determines who qualifies for in-state tuition by residency, not citizenship, generally based on where the student graduated from high school. Enacting this legislation would require students to provide more documentation that, depending on their situation, they might not even have access to, and then place the responsibility on the institutions of verifying and keeping secure these documents.

“I would ask that you not put the universities in the position of judging the veracity of legal documents, or necessitate us having to create another bureaucracy on campus to both collect documentation that … all Iowa students right now are not required to show, and then force us to store that information as well,” Saunders said.

Jeff Smith, representing Community Colleges for Iowa, echoed Saunders’s statement and said the addition of more administrative rules for applicants would burden the community colleges already working hard to follow the policies put in place by the Legislature.

In showing his support for the bill, Collins said 7 million people have entered the U.S. illegally under President Joe Biden’s tenure, and the issue will need to be addressed at some point.

“This is a very simple issue,” Collins said. “If you come to this country illegally, we’re not going to subsidize your college education.”

Wheeler also spoke in favor of the legislation, calling it “common sense” and saying taxpayer money shouldn’t be used to fund the education of those who aren’t living in the U.S. legally.

Scheetz said he struggled to find the point of it in the larger context of problems facing higher education today.

Why focus on the citizenship status of every Iowa-residing student hoping to attend one of the state’s public colleges or universities, he asked, when issues like stagnant funding for higher education paired with higher costs exist?

If signed into law, Scheetz said the bill would turn the Board of Regents into an immigration service and place undue burdens on prospective students without actually fixing anything.

“This is a bill in search of a problem, and for that reason I’m going to be voting against it today,” Scheetz said.

The bill moves the full House Judiciary Committee for further consideration.
