“No importa lo que decidan los tribunales, estas personas no se verán afectadas directamente por ese potencial cambio en las reglas de Carga Pública”, dijo Allison Davenport, abogada supervisora de ILRC. La ley actual de Carga Pública, vigente desde 1999, solo toman en cuenta dos tipos de beneficios para los solicitantes de tarjetas verdes y visas: cuidado de largo plazo (long term care) y asistencia en efectivo, por ejemplo cobros de “welfare” o bienestar social.

El nuevo reglamento que están en suspenso por el momento añade varios más a esa lista: asistencia para subsidios de vivienda o Section 8, cupones de alimento y Medicaid. Sin embargo, esto no incluye el Medicaid recibido por menores de 21 años o por mujeres embarazadas y durante 60 días después del parto.

Programas que NO están incluidos ni en el viejo ni en el nuevo reglamento (aún no en vigencia) incluyen: WIC, CHIP (Healthy Families en CA), Asistencia Alimentaria o almuerzos escolares, Head Start, cualquier tipo de beneficio ganado como Seguro Social o Discapacidad, créditos de impuestos o ciertos beneficios a familias militares.

Los expertos indicaron que nadie debe de suspender su uso de estos servicios e incluso de aquellos que sí están incluidos en la nueva regla, sin consultar a una organización comunitaria especializada o a un abogado de inmigración.

Históricamente, la regla de carga pública no ha afectado a mucha gente: Los expertos estiman que el efecto real del reglamento, si es que llega a entrar en vigencia, podría ser más limitado de lo que se teme, ya que la mayoría de los solicitantes de beneficios tiene factores atenuantes que también deben ser tomados en cuenta por los agentes que toman la decisión.

“Nuestro análisis nos dice que 69% de los que recientemente recibieron tarjetas verdes tienen al menos un factor negativo en contra, pero la mayoría tienen también características positivas que pueden hacer contrapeso”.

Por ejemplo, si la persona que so-

licita la tarjeta verde ha usado cupones de alimentos pero habla bien inglés, tiene un trabajo estable o algún otro factor positivo, estos pueden compensar la marca negativa, explicaron.

Un reciente análisis del Migration Policy Institute (MPI) reveló que si bien el gobierno de Trump ha negado más visas que en el pasado, porque ya el Departamento de Estado está aplicando medidas más estrictas en sus consulados y embajadas, muchos de los rechazados logran eventualmente superar el escollo.

“En 2016 negaron 1000 visas de residente y ese número subió hasta 12000 este pasado año. Sin embargo, la mitad de esos lograron apelar y ser aprobados”, dijo Jeanne Batalova, investigadora de MPI. “Al final, solo 1% de las tarjetas de residencia resultaron afectadas”.

Augustana College will host an inspiring FREE lecture

by José Hernández, former migrant farmworker turned engineer and award-winning NASA astronaut

Jose Hernandez, a former migrant worker turned engineer and NASA astronaut, traveled more than 5.7 million miles in under two weeks on the Space Shuttle Mission STS-128. Now, he’s traveling to Augustana with the hope of promoting STEM and inspiring the next generation of explorers.

“Augustana is so pleased Mr. Hernandez will share his inspiring story with the community,” said Dr. Lee Carkner, physics professor and director of the John Deere Planetarium. “This year marks not only the 50th anniversary of the Apollo moon landing, but also the 50th anniversary of Augustana’s John Deere Planetarium.

Welcoming Mr. Hernandez to hear him talk about the incredible engineering feats on his space shuttle mission is very timely and exciting.”

The free lecture will be on Tuesday November 5, 2019 at 7 pm at Olin Auditorium located at 733 35th St., Rock Island, Augustana College Hernandez will tell his story of growing up as a migrant farm worker and the challenges he overcame to become part of the 19th class of NASA astronauts.

“We’ve met Mr. Hernandez at the LULAC National conferences in prior years and I’m very happy that Augustana is bringing this opportunity here to the Quad Cities to see him speak” said Erika Macias of Hola America News.

“Mr. Hernandez is a great role model especially for young Latinos that might see themselves reflected in him.

He is a great example of the great contributions immigrants can make in this country.” she added.

Hernandez oversaw the transfer of more than 18,000 pounds of equipment between the shuttle and International Space Station, and helped with robotics operations.

Earlier in his career, he co-developed the first full-field digital mammography imaging system at the Livermore National Laboratory.

Hernandez is the author of “Reaching for the Stars” and a bilingual children’s book “The Boy Who Touched the Stars, El Niño Que Alcanzó las Estrellas”.

Roys Endowment at Augustana College honors the memory of Lawrence Roys as an engineer, businessman and nationally acclaimed natural scientist. Programa Diocesano de Inmigración y la Iniciativa de Recién Llegados DJ Kane performing at VIVA QC

No es fácil entender las leyes y reglas de inmigración. Un simple error puede descalificar toda la solicitud. Es por eso por lo que es importante contar con la ayuda de expertos bien informados cuando se trata de casos de inmigración. La Diócesis de Davenport cuenta con un programa especial de inmigración en el que personal acreditado y bien informado asesora a los clientes.

El Programa Diocesano de Inmigración proporciona ayuda a las familias para que puedan pasar por el proceso de inmigración de la manera más exitosa posible.

Entre otros servicios, ayudan con solicitudes familiares, ajuste de estatus, renuncias provisionales, ciudadanía, renovación de tarjetas de Residente Permanente Legal, permisos de trabajo, DACA, y otros. Lo único que no pueden hacer es representar a los clientes en la corte de inmigración. El 28 de abril de 1995, el Programa Diocesano de Inmigración obtuvo la acreditación del Departamento de Justicia.

“Una condición para que el Departamento de Justicia reconozca la práctica de la ley de inmigración familiar es que nuestros honorarios sean simbólicos”, explicó Gricelda Garnica, una de las consejeras de inmigración del programa. “Aunque nuestras cuotas ayudan a mantener el programa, también dependemos de las donaciones de la diócesis y de otros. Servimos aproximadamente de 200 a 300 nuevos clientes al año”.

En pocas palabras, el Programa Diocesano de Inmigración es una oficina legal de inmigración que se especializa en la ley de inmigración familiar. Dos consejeras que proporcionan asesoramiento jurídico están acreditadas por el Departamento de Justicia. Además, este programa es parte de la Red Católica Legal de Inmigración.

“Somos parte de la Red Católica Legal de Inmigración, que nos da acceso a apoyo legal y capacitación para asegurarnos de que estamos al día con los frecuentes cambios en las reglas”, aclaró Garnica.

Además del asesoramiento legal, recientemente, el Programa Diocesano de Inmigración también se ha asociado con Ascentra Credit Union como parte de la Iniciativa de Recién Llegados. Los costos legales de inmigración son muy altos y muchas personas no tienen los recursos para pagarlos, pero gracias a esta sociedad especial los clientes pueden ser referidos a Ascentra para obtener financiamiento especial de bajo costo que les ayude a pagar los honorarios requeridos.

“Hay casos en los que un cliente consulta con un proveedor de servicios de inmigración y una vez que evalúa los costos reales de su caso, tiene que esperar hasta que ahorre la cantidad necesaria, o esperar hasta la temporada de devolución de impuestos para comenzar su tan necesario caso”, dice Álvaro Macías, Vicepresidente de Desarrollo de Negocio de Ascentra.

senta a muchos a una institución financiera sin fines de lucro en la que se confía y que tiene presente lo que más les conviene”.

“Los préstamos no sólo hacen posible que las cuotas se puedan pagar a través del tiempo en lugar de todas a la vez, lo que no solo hace que se ajusten más fácilmente a un presupuesto, sino que también empiezan a establecer su historial de crédito”, comentó Garnica, quien explicó los beneficios de trabajar con Ascentra Credit Union.

Además, aunque todavía es posible solicitar al gobierno una exención de las tasas de inmigración, hacerlo puede considerarse un factor negativo a la hora de determinar si es probable que una persona se convierta en una ‘carga pública’”. Esta regla de “carga pública” fue introducida por la administración actual y ha creado mucha confusión y malentendidos entre las comunidades inmigrantes. Garnica quería transmitir dos noticias importantes sobre esta regla en particular y otra más a cualquiera que se sienta confundido sobre lo que significa todo esto.

Señaló que es cierto que el proceso de inmigración se ha vuelto muy difícil en comparación con el anterior. Y quería hacer hincapié en dos cambios importantes y específicos. La primera es la Notificación para Comparecer en la Corte de Inmigración. Este es un documento importante que puede llevar a la deportación debido a una solicitud mal presentada. La segunda es la regla de la “carga pública” que está causando mucho miedo e intensa confusión entre los inmigrantes.

“La regla de ‘carga pública’, de unas 400 páginas, que analiza las solicitudes individuales para determinar si el solicitante ha sido o podría convertirse en una ‘carga pública’. Los nuevos requisitos incorporados en esta norma están causando mucha

confusión y temor, lo que hace que las personas no reciban los beneficios a los que tienen derecho por temor a que esto les impida convertirse en residentes permanentes legales”, explica Garnica. “Hay muchas situaciones de inmigración en las que la regla no se aplica en absoluto, y en algún lugar puede convertirse en un problema.

Nos gustaría eliminar parte de la confusión y el miedo”.

Esta regla de “carga pública” debía tener lugar el 15 de octubre de 2019, pero cinco tribunales federales de distrito han ordenado que el DHS no pueda implementar y hacer cumplir la regla final sobre la base de la acusación pública de inadmisibilidad bajo la sección 212(a)(4) de la Ley de Inmigración y Nacionalidad. Las órdenes judiciales también posponen la fecha de entrada en vigor de la regla final hasta que haya una resolución final en los casos. La mayoría de los mandatos judiciales son a nivel nacional, e impiden que el USCIS implemente la regla en cualquier parte de los Estados Unidos.

“Nos gustaría ofrecer una idea de cuándo un individuo realmente necesita consultar a un especialista en inmigración antes de tomar medidas, y quién no debe preocuparse”, agregó Garnica.

El proceso de inmigración es cada día más difícil y por eso es importante contar con el asesoramiento de expertos que sepan de lo que están hablando y que puedan guiar a los inmigrantes a través de este arduo proceso.

También ayuda saber que hay opciones financieras a través de la asociación con la Iniciativa para Recién Llegados que ayudan a aquellos que pueden retrasar su proceso de inmigración debido al costo.

Diocesan Immigration Program and the Newcomers Initiative

By Anastassia Zvoryguina It is not easy to navigate immigration laws and rules. One simple mistake can disqualify the whole application. That is why it is important to have help from knowledgeable experts when dealing with immigration cases. The Diocese of Davenport offers a special immigration program where advice is given to clients by accredited well-informed staff.

The Diocesan Immigration Program provides help to families to go through the immigration process as successfully as possible. Among other services, they help with family petitions, adjustment of status, provisional waivers, citizenship, renewal of Legal Permanent Resident cards, work permits, DACA, and others. The only thing they cannot do is represent clients in immigration court. On April 28, 1995, the Diocesan Immigration Program obtained accreditation by the Department of Justice.

“A condition of recognition by the Department of Justice to practice family immigration law is that our fees must be nominal,” Gricelda Garnica, one of the Immigration

counselors from the program, explained.

“While our fees help to maintain the program we also depend on donations from the diocese and others. We serve approximately 200 to 300 new clients per year.”

Simply put the Diocesan Immigration Program is an immigration legal office that specializes in family immigration law. Two counselors that provide legal advice are accredited by the Department of Justice. In addition, this program is part of the Catholic Legal Immigration Network “We are part of the Catholic Legal Immigration Network which gives us access to legal support and training to assure we are up to date with the now all too frequent changes in the rules,” Garnica made clear.

In addition to legal advice, recently, the Diocesan Immigration Program has also partnered with Ascentra Credit Union as part of the Newcomers Initiative. Immigration legal fees can run very high and many people do not have the savings to pay the fees, but thanks to this special partnership clients may be referred to Ascentra for special low-cost financing to help them pay the required fees.

“There’s instances where a client consults with an immigration services provider and once they asses the actual costs of their case, they have to wait until they save up the amount needed, or wait until tax return season to start their much needed case,” says Alvaro Macias, Vice President of Business Development for Ascentra.

“This is a way to help people proceed with their casework in a very affordable fashion while introducing many to a trusted notfor-profit financial institution that has their best interest in mind.”

Bilingual Loan officers from Ascentra Credit Union can schedule a time to do these loans or depending on the time of day, can proceed with the financing the same day of the referral.

“The loans not only make it possible to pay fees over time instead of all at once, making them fit more easily into a budget, but also begin to establish their credit history,” Garnica explained the benefits of working with Ascentra Credit Union.

“In addition, while it is still possible to request a waiver of immigration fees from the government, doing so may be considered a negative factor in determining if a person is likely to become a ‘public charge.’ A loan eliminates the need for a waiver request which may be beneficial in such cases.”

This rule of “public charge” was introduced by the current administration and has created a lot of confusion and misunderstanding among immigrant communities. Everyone talks about the rule, but no one is sure about the meaning of it. Garnica wanted to relay two pieces of important information about this particular rule and another one to anyone who is confused about what all of these means.

She pointed out that it is true that the immigration process has become very difficult in comparison to the past. And she wanted to emphasize two important and specific changes. The first one is Notice to Appear in Immigration Court. This is an important document that can lead to deportation because of a misfiled application. The second one is the “public charge” rule that is causing a lot of fear and immense confusion among immigrants.

“The ‘public charge’ rule, some 400 pages, that looks at individual applications to determine if the applicant has been or might become a ‘public charge’. The new requirements built into this rule are causing a lot of confusion and fear, resulting in people not receiving benefits they are entitled to out of fear this will prevent them from becoming a legal permanent resident,” Garnica explains. “There are many immigration situations to which the rule does not apply at all, and somewhere it might become a problem. We would like to help eliminate some of the confusion and fear.”

This “public charge” rule was to take place on Oct. 15, 2019 but five Federal District Courts have ordered that DHS cannot implement and enforce the final rule on the public charge ground of inadmissibility under section 212(a)(4) of the Immigration and Nationality Act. The court orders also postpone the effective date of the final rule until there is final resolution in the cases.

Most of the injunctions are nationwide, and prevent USCIS from implementing the rule anywhere in the United States.

“We would like to provide an idea of when an individual really needs to consult an immigration professional before taking action, and who needs not be concerned,” Garnica added.

The immigration process is becoming more difficult each day and that is why it is important to have the advice of experts who know what they are talking about and who can guide immigrants through this arduous process.

Services will be 10:00 a.m. Monday, October 28, 2019, at Sullivan-Ellis Mortuary, Ltd., 1902-3rd Avenue East Moline. The Rev. Antonio Dittmer will be the officiant. The visitation will be from 2:00-5:00 p.m. Sunday, October 27, 2019 at the funeral home. Cremation will be accorded after services. Memorials may be made to the family.

Victor was born February 26, 1964 in Salvatierra, GTO, Mexico; the son of Luis Barrera Martinez and Juana Guadalupe Matehuala Munoz. Victor worked as a painter and laborer last working in 2010. He enjoyed grilling out and being with family. He loved bird watching especially eagles. He was a big Chicago Cubs fan and just loved watching sports in general.

Five Things You Need to know After Court Rulings on “Public Charge”

By Pilar Marrero Ethnic Media Services/ImpreMedia Five federal courts have banned the United States government in the last few days from changing the rules on the use of public benefits for applicants seeking permanent residency or a nonimmigrant visa, leaving things as they have been for more than 20 years.

“There is now a nationwide injunction and it means that the Public Charge rule is not in effect while the litigation continues and …it may never take effect.” said attorney Madison Allen, of the Center for Law and Social Policy.

“The plaintiffs had to show that they had a likelihood of winning on the merits and that they could prove imminent harm.”

But fear in the community of the consequences of asking for public benefits fueled by misinformation threatens to have dire consequences for families.

estimate that “millions of immigrants will stop asking for help with health, nutrition and social services,” and social service organizations continue to report cases of people needlessly giving up benefits they need with the belief they are now banned from using them.

According to experts and attorneys that held a national teleconference on Thursday, many of those immigrants aren’t even in danger of having a future visa being denied because of use of public services. Many are not in the categories included in the rule, aren’t using the benefits that would affect them, or have other factors in their favor that could be taken into account.

During a teleconference co-sponsored by the National Immigration Law Center (NILC), the Immigrant Legal Resource Center (ILRC) and Ethnic Media Services (EMS), the following was emphasized: Many immigrants are NOT and will

NOT be affected by that rule.

There are several categories of immigrants that do not fall under the new “Public Charge” regulation that was issued by the U.S. Department of Homeland Security (DHS) last August and is now paused by court orders.

Refugees or asylum seekers, those who apply for or have U visas for victims of crime, T visas for victims of human trafficking, WAVA cases of domestic violence, SIJS for abandoned minors, renewal of Temporary Protected Status TPS or DACA, and most permanent residents or citizens will NOT be affected by this rule.

“No matter what the courts decide, these people will not be directly affected by that potential change in the Public Charge rules,” said Allison Davenport, ILRC’s supervising attorney.

The Public Charge Rule would only affect certain immigration benefits Fear in the community primarily comes from confusion about who

would be affected by the Public Charge rule should the federal courts give the go-ahead, Davenport said.

“The concept of public charge has been part of immigration law for 100 years. What is changed is how DHS now wants to interpret it. They want to apply a stricter standard,” said Davenport.

Nor is it a ban on obtaining services, many of which undocumented immigrants aren’t entitled to anyway.

“It will only be applied on two occasions: when a person asks for a visa to enter or stay in this country or when they ask for permanent residence,” she added.

Moreover, those who fear their use of benefits will affect their chances of obtaining such visas in the future should understand that this rule is not retroactive.

Not all public benefits are listed in the new rule, only a few specific ones.

The current Public Charge law, in effect since 1999, only limits visa applications for people who use two types of benefits: long term care and cash assistance, such as welfare payments.

The new regulations that are currently on hold add several more to that list: assistance for housing subsidies or Section 8, food stamps and Medicaid. However, this does not include Medicaid received by children under the age of 21 or by pregnant women for 60 days after delivery.

Programs that are NOT included in either the old or new regulations (not yet in effect) include: WIC, CHIP (Healthy Families in CA), Food Assistance or school lunches, Head Start, any type of earned benefit such as Social Security or Disability, tax credits, or certain military family benefits.

Historically, the public charge rule has had limited impact If the courts give the green light, the actual effect of the regulation may be more limited than feared, since most benefit applicants have other factors that may tilt the scales in their favor.

“Our analysis tells us that 69% of those who recently received green cards have used at least one of the listed benefits, but most also have positive characteristics that can counterbalance that and result in a favorable decision”, said Jeanne Batalova, a Migration Policy Institute (MPI) researcher who has studied the issue.

As an example, if the person applying for the green card has used food stamps but speaks English and currently has a stable job, those may counterbalance the use of benefits.

A recent analysis by MPI revealed that while the Trump government has denied more visas than in the past due to the State Department applying stricter measures at its consulates and embassies, many of those rejected eventually manage to overcome the hurdle.

“In 2016 they denied 1,000 resident visas and that number rose to 12,000

this past year. However, half of those managed to appeal and be approved,” said Batalova. “In the end, only 1% of the green cards were affected.”

Benefits received by family members don’t count.

The fear of what might happen is proving more serious than reality, said Mayra Alvarez, president of Children´s Partnership, who urged the community not to rush into giving up benefits for which they qualify. The new rule does not penalize a person for benefits received by a family member, only those which they themselves may use.”

“Families should continue to use the services they need,” Alvarez said. “People should feel safe using those benefits even if the injunction is lifted. This rule was not meant to be retroactive. It would only count benefits received after the date the new regulation goes into effect, if that ever happens and there is likely to be a grace period. The injunction is clear, that benefits received before that would not be considered.”

The new “Public Charge” rule was to go into effect this week (October 15), but judges in New York, California and Washington State blocked it the Friday before. On the same day, two other judges in Maryland and Illinois joined the order.
