About Mahmoud
Mahmoud Abougabal is an architectural engineer with 15 years of construction industry experience. He has been appointed as a delay expert on six occasions.
Mahmoud has been cross-examined in litigation on more than 30 occasions in both English and Arabic. He has acted as the expert for disputes with individual values in excess of $100 million including an international airport, landmark museum, power plant, and residential towers. He has also been involved in an arbitration at the Dubai International Arbitration Centre and in DAB proceedings.
Mahmoud began his career working on the design, planning and delivery stages of major construction and infrastructure projects. David Stapleton is a quantity surveyor with over 40 years of construction and engineering industry experience. He has acted as a quantum expert on five occasions as well as assisting the named expert.
David has been cross-examined in arbitration and has acted as the quantum expert for disputed projects with values in excess of $2 billion. He proactively seeks resolution to contentious contractual issues, providing quantum and claims services, and has experience as a party appointed expert.
David has a varied project background with roles ranging from quantity surveyor and project manager to consulting and claims management. Timothy Whealy is a Chartered Quantity Surveyor and has over 30 years’ experience in the construction industry. Starting his career in contracting he moved to private practice where he was responsible for a wide variety of new build and refurbishment schemes. While in private practice, he represented clients on a range of quantum-based disputes. Thereafter he became involved in the preparation, analysis and submission of expert witness reports and in the preparation and defence of contractual claims.
Tim has acted as quantum expert on multiple occasions and has given evidence in court and adjudications. Paul Jolly is a Chartered Architect with over 20 years of construction industry experience. He has been appointed as a technical expert nine times.
Paul has assisted the named expert on numerous occasions in report writing and undertaking forensic analysis on professional negligence claims involving external cladding, fire safety compliance, and construction defects. He has acted as a named expert in adjudication proceedings and has produced expert reports for disputed projects with values in excess of £200 million.
During his 20 years in architectural practice, Paul worked across all stages of project delivery. This included client briefing, concept design, planning applications, technical specifications, regulatory compliance, and technical reviews. He has been responsible for the delivery of several national award-winning schemes across a variety of sectors including performing arts venues, education facilities, commercial offices and mixed-use developments on sensitive urban sites. Paul has extensive experience of site inspections, client handovers and post occupancy surveys. Paul specialises in the forensic analysis of design and construction defects, including those relating to fire safety. He is also well versed in opining on disputes concerning design responsibility, scope splits and coordination issues involving multiple parties on complex projects.
Paul is registered with the Architect’s Registration Board and is a member of the Royal Institute of British Architects, the Chartered Institute of Arbitrators, the Society of Construction Law and the King’s College Construction Law Association. He is also an associate member with the Academy of Experts. Paul holds a master’s in construction law and dispute resolution and has completed an advanced professional award in expert witness evidence (APAEWE). Catherine Joshi is a Chartered Civil Engineer with more than 25 years of construction industry experience. She has been appointed as a technical expert on five occasions.
Catherine has been instructed on high-value arbitration cases involving structural, civil, architectural, fit-out and procedural disputes. She has provided input, as part of an expert team, regarding the design and construction a wide variety of building types and uses and has acted as named expert on an infrastructure project valued in excess of US$200 billion.
Catherine has an extensive background in both the design and project management of high-profile and large-scale, complex projects across the Middle East, Europe, North America and Asia; ranging from buildings and utilities to immersed tube tunnels and causeways. David has undertaken peer reviews as the architect expert and advised on a range of matters from design process and delivery, change management, project management and contract administration to workmanship, health and safety, fire codes, and technical and regulatory compliance (cladding, insulation, fire stopping, etc.). Jeff Poole is a Chartered Engineer with forty years of experience in civil and structural engineering. He has been appointed as a technical expert on eight occasions.
Jeff has been cross-examined as a factual witness in the Technology and Construction Court (TCC) in London and in mediation and pre-action protocol proceedings. Jeff has 38 years of experience in design consultancy, including six years in site-based contracting, ensuring build quality to time and budget. These included refurbishment in both the public and commercial sectors ranging from residential, healthcare, education, defence and justice to industrial, rail, roads and aviation projects.
