President’s message Life is slowly returning to normal Slowly but surely we are seeing confidence return to the economy and people starting to go about their normal way of life.

T

he fact is that 2020 was an unprecedented year in modern times for everyone around the world and we sincerely hope that we never suffer another pandemic like that again.

Many businesses were stretched to the line last year and as various vaccines get rolled out across Australia, combined with respective state governments significantly easing restrictions, confidence returns to the business sector, and more poignantly the hiring industry.

With some states returning full crowds to professional sport and others lifting restrictions on the amount of wedding guests and other prominent big functions, the hiring industry will start to see business grow and hopefully either reach pre COVID-19 levels or even better, exceed revenue targets altogether.

No doubt in the next few months there will be little hiccups along the way, with outbreaks here and there, but we can only hope that the respective state government and territory leaders have had enough experience with contract tracing and incident management, to keep it under control and not start locking down borders again.

A vibrant open economy where trust is thrust upon the general community to be sensible and look after themselves and their neighbours is the essence of Australian society and what we need to regain a sense of normality.

Come one, come all Everyone is super excited about the annual HRIA event on the Gold Coast on May 12-13 this year. I really think it is important that as many members attend as possible in order to reconnect with your fellow colleagues.

Last year was a prolonged period of 4

isolation for most of the country and the world for that matter. Human beings are not meant to be alone, we are meant to mingle and share our thoughts and beliefs with each other, to bond over common ground and to impart knowledge wherever possible.

The Gold Coast conference is the ideal scenario for everyone to show their support for the industry and each other. Everyone has grown tired of zoom meetings and staring at their computer screens for longer than they should and meeting face-to-face will help restore confidence in the industry.

From our buyers to our suppliers, we have all faced our challenges in the past 12 months, so let us get together and look forward to the future. I cannot wait to see you all in the Gold Coast.

The chain of responsibility HRIA are once again rolling out Chain of Responsibility courses around the country.

The HRIA have secured funding from the National Heavy Vehicle Regulator under the Heavy Vehicle Safety Initiative to undertake courses throughout the country to members and interested stakeholders.

These courses deliver safety benefits for the heavy vehicle industry and other road users. The courses have been designed for operational staff and are relevant to both those with good Chain of Responsibility knowledge, as well as those who may not be across all the details of the legislation. I sent our management staff to the South Australian course and all returned with positive feedback, which I am sure will help the way we do business. I strongly recommend if the opportunity arises in your area you have a look at this course.

Passing over the baton It may surprise you to know that according to the Australian Small Business and Family Enterprise Ombudsman, 70% of Australian businesses are family businesses, which employ approximately half of the workforce in this country.

Handing over the business to either family members or other suitable candidates is a tricky affair, which often requires expert help.

Succession planning is one of the more difficult transitions in business. Not only do you have to get the right person or people in place to ensure the continued smooth running of the business and to grasp future business opportunities but you have to also ensure that the right systems and protocols are in place too.

This is easier said than done.

Most people are too busy with the day-today management to take the time out to think years, and in some cases, up to a decade ahead.

It is time consuming and not easy to do.

A change in regulations will allow members to remove groundwater and overland flows while undertaking urgent works required in response to an emergency event.

Regulatory change is a victory for commonsense The HRIA executive has secured a win for its NSW members with a change in regulations to allow members to remove groundwater and overland flows while undertaking urgent works required in response to an emergency event.

T

he regulation change means that there is no longer a need to hold the relevant licences and approvals in the event of an emergency to perform the above tasks.

The regulation amends the Water Management (General) Amendment (Emergency Works Exemption) Regulation 2021 and will apply to all public and private entities.

“It is a win for commonsense,” James Oxenham, HRIA CEO said. “It is an important change that we lobbied hard for in order for our members to be able to perform emergency works when needed.

“You can’t wait for 12 weeks for a licence to clear sewerage. In an emergency situation the work needs to be done and thankfully the change to the regulation recognises that, which will not only benefit our members but the general public as well.”

The Department of Planning, Industry and Environment’s Executive Director of Policy & Planning, Vanessa O’Keefe, said HIRE & RENTAL MAGAZINE MAY 2021

the regulation applies to works required to respond to an emergency event or prevent an imminent emergency event from occurring.

“It would include, for example, the removal of water from an excavation that had to be dug to fix a burst water supply pipe or sewer pipe,” Ms O’Keefe said.

“What the regulation does is allow public or private sector entities to immediately deal with the emergency situations that could put public health, the environment or infrastructure at risk, without having to wait for approval.”

Before this amendment, the requirement to hold a water access licence or one of the various approvals for dewatering activities applied even if such activities were to rectify emergency situations that that could put public health and safety, the environment or infrastructure at risk.

“The situation affected state-owned corporations, local councils and private sector providers who offered dewatering services to both government agencies and other private entities in an emergency event,” Ms O’Keefe said.

“In the past, these organisations would have had to act to address an emergency but were doing so without the actual licences and approvals in place to authorise the work. This regulation protects these entities from any prosecution for doing the essential emergency work they do.”

The exemptions have been developed in close consultation with the Natural Resources Access Regulator (NRAR) so that compliance and enforcement can be effective.

It includes strong safeguards to ensure that NRAR is notified before or as soon as possible once emergency works commence and within 14 days of the completion of the work along with declaration of the volume of water taken under the exemption.

The changes are now in effect.

Onboarding apprentices The Commonwealth Government has extended its economic stimulus package by $1.2 billion to encourage employers to take on new apprentices and trainees.

T

he Boosting Apprenticeship Commencements wage subsidy supports businesses and group training organisations to take on new apprentices and trainees to build a pipeline of skilled workers to support sustained economic recovery.

This wage subsidy is in addition to the existing $2.8 billion Supporting Apprentices and Trainees wage subsidy.

Through the Boosting Apprenticeship Commencements wage subsidy, any business or group training organisation that engages an Australian apprentice up until 30 September 2021 may be eligible for a subsidy of 50 per cent of wages paid to a new or recommencing apprentice or trainee for a 12-month period from the date of commencement, to a maximum of $7,000 per quarter. There is no cap on the number of

eligible trainees/apprentices.

Employers of any size, or industry, Australia-wide who commence an Australian Apprentice between up until 30 September 2021 may be eligible under this program.

“To be eligible as a trainee the employee must be a new employee or have moved from casual to perm,” Aileen Hiskins, owner, Strategic Alignment Training, said. “They must be an Australian citizen or permanent resident. It doesn’t matter if they hold previous qualifications.

“Employers may also attract additional federal traineeship funding of up to $4,000 per person for new employees - eligibility to this funding does depend on new employees previous qualifications.”

Strategic Alignment Training is the preferred training partner for HRIA and facilitates programs such as Women in Hire

and Access Program, Young Professional Network and mate2Manager.

“We also keep abreast of all state and federal funding opportunities that become available, and for which HRIA/EWPA members may be eligible,” Hiskins said.

“We manage the relationship with the registered training organisations who offer the courses and where applicable such as with the HATS program, contextualises these courses to the Industry. We can also offer members a full management service.”

“Furthermore, we will notify HRIA of all funding opportunities as they are launched.

SAT also offers an end to end management service to members, which includes working on their behalf with the RTO, Apprenticeship Centres (ACCNs), who facilitate funding, and the individual trainee.”

Take responsibility for your actions The need to continually improve safety and develop training for members has resulted in 27 Chain of Responsibility (CoR) courses being subsided across the country.

T

he HRIA has secured funding from the National Heavy Vehicle Regulator (NHVR) with courses running now.

“The Chain of Responsibility courses are important for everyone in the hire industry because the legislation that went live in October 2018 clearly outlined the responsibilities across a broad scope of roles in our industry,” James Oxenham, HRIA CEO, said. “If a driver has a crash whilst delivering hire equipment with a gross vehicle mass in excess of 4.5 tonne, it is not just the driver the investigation will focus on.

“As an executive, employer or contractor, you should be ensuring that safety systems and controls are in place to prevent breaches.

In a prosecution, the courts may consider the actions of each party in the supply chain.

This includes what measures that have in place to prevent breaches of the Heavy Vehicle National Law regulation occurring.

“Each party in the chain must demonstrate that they took all reasonable steps to prevent the breach or show the court that there were no steps they could reasonably be expected to have taken to prevent the breach.”

The NHVR and was successful in obtaining funding to issue 27 courses across Australia.

There is no fee to attend and the courses are open to members and non-members. The HRIA is encouraging its members to invite the transport providers they work with.

courses has been developed specifically for the hire industry. The course has been designed for those with CoR knowledge as well as those who may not be across all the details of the legislation.

“The HRIA works with the team who are delivering the course by sourcing venues, organising catering, sending out communications, managing attendee lists and sending out certificates,” Linda Papendieck, HRIA senior administrative officer, said.

“We have scheduled the courses all around Australia with a mix of regional areas and city centres and the course can be completed in a day.”

The course is being presented by our specialist load restraint engineers, each with extensive experience in transport safety across a variety of industries. Their experience includes designing load restraint systems; incident investigations, development of chain of responsibility documentation and training organisations across a broad variety of industries in CoR and load restraint.

“The HRIA has submitted a further application to the NHVR to build on the CoR courses we are currently rolling out,” Oxenham said.

“Our intention is to offer online training and load restraint resources to the industry and sub-contracting transport companies. This will be the third offering from the HRIA since October 2018 when we launched the CoR awareness online course, followed by face to face courses launched in December 2020.”

As an executive, employer or contractor, you should be ensuring that safety systems and controls are in place to prevent breaches.

The practical aspect of the CoR courses can’t be underestimated.

“The training is broken into two parts,” Warwick Brown, Engistics, senior logistics engineer, said. “Part one involves explaining the CoR law, what is covered and how this relates to themselves and the hire and rental industry.

“Part two centres around load restraint and giving the group the fundamental tools to transport their equipment safely, including loading and unloading. We have developed a range of case studies, relating to the industry, that are used throughout the session.

Applications now open for Women in Hire & Access Program HRIA are continuing with the Women in Hire & Access Program in 2021.

“Launched in 2018, the HRIA is pleased to open applications in June for the next cohort of the Women in Hire & Access program,” Dee Delaurier, HRIA executive officer, said.

“Delivery of the course will entail a combination of online and face-to-face sessions. We are looking forward to panel discussions with industry experts.”

There will be smaller groups for 2021 with milestones to be met along the way culminating with Women in Hire and Access Mentee of the Year to be presented in the last session of the program.

Fighting for a worthy cause to make life easier HRIA executives have been busy working behind the scenes to try to get some important amendments in current legislation to make your life easier.

J

ames Oxenham, HRIA CEO, Garry Kerr, Oliver Shtein and Tim Nuttall have been lobbying the Assistant Minister to the Attorney General, Senator Amanda Stoker, to have the hire industry removed from Personal Property Securities Act (PPSA). The Act is briefly explained in the article on the next page.

HRIA executives also met with Senator Bridget McKenzie and Senator Matt Canavan.

The good news is that to have the hire industry removed it doesn’t require a change to an Act of Parliament but a change to the regulations. This means it is a simpler and quicker process.

“The PPSA is really a law about finance and security but the hire industry was originally dragged into the PPSA because the government thought that people might be misled when hired assets are left in the hands of customers especially for extended periods,” Oliver Shtein, Bartier Perry consultant, said.

“The purported rationale is that buyers or financiers dealing with the customer might be confused and think that the equipment is really owned by the customer and not the hire business.

“We think this is a flawed rationale and that hire businesses, which are not really engaging in finance, should be outside the PPSA. The risks to hire businesses obviously outweigh the supposed rationale.

“We want to see ordinary hire business transactions out of the PPSA even if the hire goes for more than two years. By ‘ordinary hire business’ we mean hires that are a normal part of a business where the same equipment is typically hired out to more than one customer over the useful life of the equipment.”

The benefit to businesses in the hire industry is simple.

Hire businesses that don’t really offer finance or finance-equivalents would not have to worry about losing their equipment under the PPSA. There would be no need to register or worry about all of the complexities that go with learning how to make a PPSA registration so that it can’t be challenged if the customer goes into insolvency.

But there is still one caveat.

“However a hire business that is engaging in substance in finance, for example offering rent to buy, hire purchase or long-term hires

similar to finance leases where the customer is really looking to the hire business as a substitute for obtaining finance and buying the equipment, would still be caught by the PPSA,” Shtein said.

HRIA are pleased that this matter will be resolved in the not too distant future.

“The impact for businesses where hires exceed 24 months, will be time saved on complex PPS registrations,” Oxenham said.

“Hire companies will also be able to go about business without worrying about the risk of losing assets due to the PPS Act. “Even where hires do not exceed 24 months, there is a chance that the contract could be extended or a verbal agreement might be made that the hire can continue, putting them into the realm of PPS leases and therefore exposing these hires to the PPS Act.”

HRIA have been working on changes to the PPSA since 2017.

“If it was not for the HRIA, indefinite hires would still be in the Act, meaning the minute equipment left a hire yard it became a PPS lease and needed to be registered on the PPS Register,” Oxenham said. “The HRIA was successful in fast tracking an amendment to the Act in May 2017, which took indefinite hire out of the Act and extended the timeframe before a hire became a PPS lease from 12 months to 24 months.

“I would like to personally thank Gary Kerr, Tim Nuttall and Oliver Shtein who have been members of our small but committed team, for their perseverance and commitment to the cause, without whom we would not be where we are today.”

The PPSA explained The Personal Property Securities Act (PPSA) is federal legislation which came into effect on 30 January 2012, changing the way security interests in personal property assets is governed.

A

security interest is an interest in an asset, that in substance secures payment of a debt or obligation.

The PPSA introduced the Personal Property Securities Register (PPSR).

This is a national register which acts as a noticeboard, showing all registered security interests in personal property. This allows businesses and consumers to deal in a more transparent way. For example, a search of the PPSR can be conducted against a business and the register will display all the registered security interests in that business.

How does PPSA work?

A security interest arises when an exchange of goods has taken place and a security contract exists (this could be as simple as having a retention of title clause listed in the sale terms). At this point in time, the security interest needs to be registered on PPSR.

In the event of insolvency or bankruptcy the PPSA regulates how Trustees or liquidators prioritise the distribution of assets to creditors.

Creditors with registered security interests in property held by a bankrupt or insolvent company will have a greater priority in the recourse to the title of the secured property over that of unsecured (and unregistered) creditors under the new PPSA provisions.

The advantage in registering an interest is that registration “perfects” your security interest which allows you a level of recourse to claim your interest in the event of bankruptcy or insolvency. Where a security interest is not registered and the business in possession of the asset becomes bankrupt, you will be classed as an unsecured creditor hence, the importance of evaluating the risks/benefits of registering.

When does the PPSA apply?

The PPSA applies where a party has an ownership interest in an asset, which is in the possession of a third party. Examples are:

Load sensing continuously checks the weight in the platform and adjusts the operating envelope, according to the load chart. Fleet managers will appreciate reduced maintenance and increased uptime in a load sense system that has no springs or moving parts and offers zero load calibration.

The XC boom lift from Genie continues to be a popular industry favourite.

In addition, an expanded working zone made possible with a unique chassis tilt sensor gives operators access to different ranges of motion based on the chassis angle.

It automatically cuts out certain lift and drive functions of the machines when the tilt activation setting is reached.

“Genie XC booms not only carry more load than ever before but can also access hard-to-reach work areas on challenging jobsites,” Kinder said. “The extra capacity and maximum working envelope of XC boom lifts enables structural, electrical or plumbing contractors, for example, to do more with a single unit. At the same time, Genie E-drive scissor lifts deliver the performance customers need most, with real-world 25% gradeability.

Combined with two times the tire tread depth as previous designs, Genie E-drive scissors also have the torque and traction for climbing dovetail ramps, even if one wheel slips.

“A 14° breakover angle enables these scissor lifts to crest the top of the ramp without bottoming out, eliminating the need to winch machines onto trailers or raise dovetails after partial loading,” Flanagan aid.

New side forklift pockets on Genie E-drive scissors, in addition to the industry standard rear pockets, simplify logistics, allowing for either driving on and lifting off, or lifting on and driving off the transport vehicle.

The plan outlines several significant and clear targets for the company, including increasing Aboriginal and Torres Strait Islander apprenticeship participation rates to 10% by 2025; and increasing its overall employee participation rate to 2.5% by 2025 and educating employees on cultural awareness by June 2021. In addition, the company has pledged to increase its Aboriginal and Torres Strait Islander business procurement to 5% of suppliers engaged in a tender, and 1% of total supplier spend contracted to Aboriginal and Torres Strait Islander-owned businesses by 2022.

he three companies are bringing the revolutionary 3D Avoidance Zone System to Australia, developed

by SITECH WA, which prevents machinery entering a restricted area in real-time through the creation of a digital 3D barrier which shuts down connected machinery in the event that any part ‘touches’ the digital barrier.

The technology promises to dramatically reduce accidents and increase safety in construction areas which are being undertaken within tight areas or nearby critical infrastructure, such as rail lines or mine sites. Downer and Coates Hire will deliver the technology as required to construction sites across the country.

Revolutionary zone system “The system will be used as further mitigation against potential to ‘foul’ the rail danger zone, over and above to those physical barriers already in place,” said Cormac Brady, General Manager, Western Australia Infrastructure Projects, Downer. “Following a successful trial of the 3D Avoidance Zone System, Downer will be able to apply it to our wider rail and civil projects, thus ensuring safety is at the heart of everything we do.”

The technology will be trialled by Downer and Coates Hire for the first time in Australia, with Western Australia chosen as the ideal location for the trial to take place.

The location of the trial will not be disclosed.

“Construction sites near rail lines and other critical infrastructure are both necessary and fraught with hazards, as excavators increasingly work within tight areas and nearby fast-moving transport,” James Naylor, executive general manager, west, Coates Hire, said. “Thankfully technology is emerging to ensure these work spaces are safer than ever before, with Western Australia the first Australian state to benefit through this trial.

“This offering is the next stage in our Internet of Things strategy. Once completed, Coates Hire customers will benefit from enhanced safety, productivity and monitoring capabilities.”

How the 3D Zone protects workers and public transport users An excavator’s position is provided by SITECH WA’s next generation Trimble Machine Control System; Earthworks.

Utilising dual Global Navigation Satellite System (GNSS) technology, the position of the whole of the machine is passed to the Trimble Marine Construction software (TMC) which compares the machine’s position with the exclusion zone.

The TMC evaluates the current position of the machine against a pre-defined threedimensional model of the restricted area. If

any part of the excavator ‘touches’ the invisible barrier, TMC sends a signal to the machine to stop by disabling all operator inputs, ensuring the operator is no longer able to continue on their current path of movement.

This barrier can be set by site managers, but once the barrier is set there is no need to update the barrier, as the GPS system is always aware of the location of the machine, even if it moves beyond its original location.

“Many ‘2D’ height and slew-limiting systems exist on the market today, but they aren’t nearly as effective and can be prone to more human error,” said Brady. “The operator sets the limits manually by putting the machine up to the limit – this increases risk as these ‘2D’ systems are relative. Once the tracks of the excavator move the system needs resetting.

“With the SITECH WA’s 3D avoidance zone system the restricted area is absolute, and the machine position is always known.”

Traffic light system The technology works on a “Traffic Light” system. A green alert advises workers and managers that the excavator is all clear to proceed operation; an amber alert advises the worker and site manager that the excavator is approaching the avoidance zone, typically usually 0.5 metres as defined within the TMC software; and a red alert means the excavator has entered the avoidance zone and triggers the machine interlock, which overrides the machine’s operation and halts it immediately.

Developed by SITECH in New Zealand, the technology has been deployed successfully

by KiwiRail to ensure the safety of construction workers as well as train passengers and drivers.

T

he federal treasury announced as part of the 2020-21 federal budget that businesses with an aggregated turnover of less than $5 billion can immediately deduct the cost of eligible new depreciating assets in the first year they are used.

As is often the case with tax laws, the final legislation is complex, and it is important for taxpayers to obtain tailored advice. The following is a broad general overview of the new opportunity provided in the Federal Budget.

Full expensing in the year of first use or installation ready for use applies to the following: • New depreciating assets; • The cost of improvements to existing eligible assets; and • Second-hand assets acquired (only for eligible businesses with an aggregated annual turnover of less than $50 million.

This temporary measure applies to the business portion of assets acquired, or the cost of improvements to eligible depreciating assets, from 7.30pm AEDT on 6 October 2020 to 30 June 2022.

Eligible assets under new full expensing measures New depreciating assets New assets acquired and used in Australia that directly relate to the business earning assessable income, first held ready for use by the business between 7.30pm AEDT on 6 October 2020 and 30 June 2022.

The cost of improvements to existing eligible assets For existing assets you can claim an immediate deduction for the business portion

of the cost of improvements incurred between 7.30pm AEDT on 6 October 2020 and 30 June 2022.

If costs are incurred to improve an existing asset in an income year the costs of improvements in that income year can be deducted if you: • Start to use the asset or had it installed ready for use for a taxable purpose in that income year; or • Started to use the asset or had it installed ready for use for a taxable purpose in an earlier income year.

If you deducted the existing asset cost under the Instant Asset Write Off (IAWO) method in an earlier income year, you can still deduct the improvement costs in a later year under the new temporary full expensing measures.

Second-hand assets acquired If your business’ aggregated turnover is less than $50 million and you start to hold and use an eligible second-hand asset, the business portion of the cost of that asset can be deducted in full under the new temporary full expensing measures. The cost of the asset includes improvements to second-hand assets incurred in the same income year.

plants, or fodder storage assets), unless you are a small business entity who choose to apply the simplified depreciation rules to these assets; • Buildings and other capital works for which you can deduct amounts under Division 43; • Assets subject to exclusion for preexisting commitments (before 7.30pm on 6 October 2020 – aggregated turnover >$50 million); and • Assets that will never be located in Australia or will not be used principally in Australia for the principal purpose of carrying on a business.

Disposal and termination of eligible assets expensed in full under FEDA Consideration received for disposal of asset Where an asset has been deducted in full under FEDA and then subsequently disposed, the termination value is included in the entity’s assessable income for that financial year. Where an eligible asset is disposed of during the financial year that it has been fully expensed, then a deduction is only allowed for the difference between the initial asset cost and termination value.

Disposal of asset – ceases to be used for any purpose Where an asset has been deducted in full under FEDA and ceases to be used for any purpose, the termination value is the market value of that asset at that time. Where an asset is considered worthless at the end of its effective life, then the termination value may be nil. Clients should be wary when making a determination that an asset is worthless, as market value substitution rules can apply, for example, when assets that are no longer of use to the business are taken for personal use.

Business related cars The ATO defines a car as a passenger vehicle, van or tractor designed to carry a load of less than one tonne and fewer than nine passengers. The maximum value you can use for calculating the depreciation claim, depends on the year in which you first used or leased the car.

consequences and such changes can include the adding and removal of beneficiaries so long as the amendments are made pursuant to a valid exercise of the power of amendment found in the trust deed.

Having a wide capacity to amend the trust deed is important because it gives the trustee power to upgrade the trust deed from time to time to reflect changes to the law, including tax law.

If your turnover is less than $10m, and you want to change your business structure from a company to a trust (or vice versa) then you may be eligible for CGT roll-over relief.

One key pre-requisite is that there be no change in the ultimate economic ownership of the new structure.

Protection against trust creditors Weigh up whether a trust structure is right for your business circumstances.

T

rusts have been an accepted part of English law since the Crusades and although companies are more common in business, trusts have substantial benefits over companies in a business environment. Some of the benefits and drawbacks are discussed below.

There are many. However, the discretionary trust is probably the most common. Discretionary trusts will have discretionary beneficiaries – those individuals (and possibly companies) who will take income and capital out of the trust subject to the exercise by the trustee of a discretion in their favour.

Tax minimisation The benefit of discretionary trusts is that income and capital can be distributed to individual beneficiaries in accordance with their own needs from time to time. This minimises tax for all involved.

For the past few years, you have been able to stream capital gains and franked dividend to nominated beneficiaries. This further enhances the tax benefits of discretionary trusts.

Capital Gain Tax benefits Another significant benefit of discretionary trusts is that the 50% CGT discount will apply to individuals who are beneficiaries where the asset has been held by the trustee for at least 12 months. However this benefit does not apply 22

to companies which are beneficiaries.

Undistributed income is generally taxed in the hands of the trustee at the rate of 45%.

Accordingly the trustee has a good reason to distribute income in each financial year unless there is a good reason to accumulate it.

You can protect capital The benefits of a discretionary trust extend to protecting the income and capital of the trust against the divorce claims of the ex-spouse of a beneficiary.

The entitlement to income and capital of such a beneficiary can be discontinued for the duration of the family law proceedings and whilst the Family Court may consider the potential entitlement to a distribution as a financial resource, the capital of the trust is generally preserved.

The capital of the discretionary trust is protected against the bankruptcy of a discretionary beneficiary. The trustee simply refrains from distributing to that beneficiary until the end of the bankruptcy.

Having a trusted appointor whose consent is needed for key management decisions can prevent directors of the trustee company turning feral against other stakeholders.

Trusts can change with the times Trusts are enormously flexible. Since about 2011, amendments to trust deeds can now generally be made without stamp duty

In some states, trust deeds can prevent a trustee from being indemnified against trade creditor claims out of the trust assets. This can be an important asset protection mechanism.

However, the cases in New South Wales generally indicate that such a try-on does not work in that state.

Trusts can be created with a stamp duty implication of as little as $500.

But if down the track, amendments to a trust deed are made which are too farreaching and cause a change to the ‘charter of rights’ then stamp duty on the full value of the trust assets can be imposed.

What does trust splitting entail?

A hot topic for trusts at the moment is trust splitting whereby within the power given to the trustee by the trust deed, the trustee establishes a sub-trust within the original existing trust such that there is still only (arguably) one trust but different trustees are appointed for different assets.

The splitting of the trust does not generally involve a change to the beneficiaries or to the power conferred on the trustee.

Whether a trust can be split will largely depend on the powers provided in the trust deed to appoint a separate trustee in respect of particular trust assets.

Trust-splitting can be of great assistance from the point of view of asset protection and estate planning.

No one-size fits all, but a close review of the options available is highly recommended when you are starting up a business or considering whether you should change it.

amily businesses account for 70% of all businesses in Australia and employ half of the country’s workforce.

They form an integral part of the economy and many family business owners hope to pass their business onto the next generation.

Despite this, research shows that only 40% of established family businesses survive the transition to the second generation. Past that point, 13% will survive to a third generation and only 3% to a fourth generation and beyond. A lot of family business owners really do go from shirt sleeves to shirt sleeves in three generations.

Why is that the case?

It might surprise you to know that only one in four family businesses formally consider their approach to succession. It’s no wonder then that so many fail.

Why succession planning is difficult Succession can be an emotionally charged topic that is difficult for families to discuss.

While it can be an awkward topic to bring up, the reality is that succession is one of the biggest risks to the ongoing viability of a family business. The proof is in the pudding.

Whatever the vision that you have for your business and your family, it’s important to know and understand if this vision is shared with your successors.

So, what can be done about it?

Unfortunately, there is no silver bullet when it comes to succession. Every family is different, and every transition is unique.

However, by going through due process and tackling these issues head on, you can drastically increase the chance of a successful transition. By putting things on the table

ahead of time and creating transparency amongst the family, you can minimise potential conflict down the track. Once the issues are all out in the open, it can also help relieve a lot of the pressure that family members may be feeling. With that in mind, the best thing that can be done in terms of succession is actually getting started.

This article outlines some practical tips for you to consider in planning your succession.

Start with the end in mind As a starting point you need to understand where you’re going.

What does success look like for your family and your business? What is your timeframe for getting there? Who do you want to be your successors? What do you want for your family and your business?

You may wish to transition the management and ownership to some or all your children over a specific period.

You may wish to transition the management of the business to your employees, separating the running of the business from its owners.

You may want to build some of your wealth outside your business for your family who is not involved in the running of the business.

You may want to secure the future of the business to support your employees.

practical tips for succession planning shared with your successors.

Knowing exactly what you want can often be difficult and can take time, but the sooner you start thinking about it the clearer it will become.

Know where you are in the journey The next step is to understand where you are in the journey and what obstacles and challenges you face.

Have you made any progress to date?

Are you ready for succession? Do your children want to take over the business?

Do your future successors have the right skills and leadership capabilities? Do your successors have authority, credibility and your endorsement to make the business a success?

To answer these questions, you need to understand the different perspectives and motivations of each individual that the succession impacts. The only way to gain this understanding is through communication.

An advisor is a valuable resource in facilitating these discussions as they can look at your situation independently and taking the emotion out of the conversation. Advisors will help you get an understanding of where you, your business and your family stand so you can create alignment.

Work backwards

Once you understand the vision for the future, and where you and your family are on the journey, you can then start to design a plan.

The plan should address the challenges you are facing now those you potentially will face along the way. It should take care of the three subsystems that make up a family business – the family, the business and the owners. It should support the business and the family and it needs to set clear roles and responsibilities for how the plan should be executed.

Take action At the end of the day, you create a succession plan to move forward and to take action. The plan should detail the actions you will take including the steps involved with both the management and ownership succession.

Importantly, businesses and families change over time, so a succession plan also needs to change. To support this, you will need to create a governance structure that ensures the plan is executed and evolves over time. These structures may include;

A family constitution (the rule book) Regular and structured family meetings Advisory boards Strategic planning sessions for both the family and the business.

The process has many moving parts – many of which you will not know about or have the expertise in – and what you don’t know can hurt you. That’s why it’s important to get advice along the way.

A family business advisor can help you with the process and ensure you are engaging with the right advisors at the right time so your legal, tax, estate planning, training and development needs are taken care of.

The goal At the end of the day, the goal should be to have a succession plan and a succession planning process that is transparent, understanding and creates alignment. It should create greater certainty for the future, collaboration and openness so that you can address issues or challenges before they arrive.

Remember, ‘succession is a process and not an event.’ It takes time, and the more time you invest, the better.

Don’t be casual in your approach

by James Sanders, Senior Associate, MST Lawyers On 18 March 2021, Federal Parliament passed the Fair Work Amendment (Supporting Australia’s Jobs and Economic Recovery) Bill 2020 (the Bill) which introduces a number of changes to the Fair Work Act 2009.

T

he Bill received Royal Assent on 26 March 2021 which means that these changes have now taken effect as of 27 March 2021.

The first reading version of the Bill initially proposed significant reform of existing industrial relations law, including provisions relating to wage theft offences and enforcement, increased part-time flexibility, flexible work directions, changes to enterprise agreement making, sunsetting of pre-2010 workplace agreement, revised transfer of business rules, and the lifting of the small claims jurisdictional limit. These provisions were proposed on the basis of assisting Australia’s economic recovery from COVID-19, creating greater certainty and increased flexibility for both employers and employees.

After a passage of debates and amendments, all the abovementioned provisions were axed from the final version of the Bill as passed by Parliament, leaving only the amendments relating to casual employees.

These new laws apply to both existing and new casual employees.

New statutory definition of casual employee The Bill introduces a new section in the Fair Work Act which defines a person as a “casual employee” if an offer of employment was made and accepted on the basis that there is “no firm advance commitment to continuing and indefinite work according to an agreed pattern of work”.

This closes off the ability for courts to determine that a casual employee could be a permanent employee by the conduct of the employer and employee. A casual employee will retain their status as a casual until either they convert to full-time or part-time employment or accept an alternative offer of employment by the employer.

Casual conversion entitlement in the national employment standards Employers who employ 15 or more employees now have a positive obligation to make an offer to convert a ‘regular casual employee’ to a permanent employee unless 26

there are reasonable grounds not to do so.

A ‘regular casual employee’ is an employee who has been employed for a period of 12 months and has worked a regular pattern of hours on an ongoing basis for at least the last six months of that period.

Requirements of the offer and acceptance procedure are set out in the amended Fair Work Act. An employer must, within 21 days after the end of the employee’s 12 month anniversary, either make an offer to a ‘regular casual employee’ or provide written notice to

Casual employment information statement A casual employment information statement which contains information about casual employment and casual conversion has been prepared by the Fair Work Ombudsman.

This statement can be found on the Fair Work Ombudsman website.

Employers must provide all casual employees with a casual employment information statement before, or as soon as practicable after, the employee starts employment as a casual employee.

Employers must also provide this statement to any existing casual employees by 27 September 2021.

Employers who employ 15 or more employees now have a positive obligation to make an offer to convert a ‘regular casual employee’ to a permanent employee unless there are reasonable grounds not to do so.

In some circumstances, casual employees also retain a residual right to request conversion to full-time or part-time employment.

If there are any existing casual employees employed as at 27 March 2021, employers are required to make an offer of permanent employment to the existing casual employees before 27 September 2021 or within 21 days after the casual employee’s 12 month anniversary, whichever is later, or provide written reasons for not making the offer.

Employers should note that this casual conversion entitlement operates in addition to any casual conversion clause under any industrial instrument.

Casual loading set-off

The new laws now also require that a court sets-off an identified casual loading amount paid to a casual employee against any permanent employee entitlements claimed by that employee relating to paid annual leave; paid personal/carer’s leave; paid compassionate leave; payment for absence on a public holiday; payment in lieu of notice of termination; and/or redundancy pay.

It is important that all current and future employers of casual employees understand the implications of the new laws on their employer obligations. Employers should look to updating their casual employment contract templates and implementing a standard casual conversion procedure which involves a suite of draft employee correspondence.

President’s message Looking forward to a healthy future

F

rom an operational perspective, members have been kept busy these last few months and we hope this continues through to the end of the financial year and beyond. If your business was affected by the floods in March, on behalf of the association, we hope that the recovery and clean-up operations went well and you are all back in business once more.

It has certainly been a challenging 18 months when we look back on the natural and man-made disasters - bush fires, floods, COVID-19 and now more floods. The Association offers support to members when times are hard and we hope that our resources and social connections have provided some level of assistance with the challenges faced.

The EWPA obviously has a strong safety focus and whilst most people’s thoughts go to operating machines, it is also important that we also keep the data we manage safe. It’s been said in the past, “It’s not a question of ‘if ’ you will be the victim of a cyber-attack, but ‘when’.”

Cyber security is very important The national office had an external expert perform a cyber audit and provide recommendations for handling data.

Without giving away our various methods of protection, I can say that we go to great lengths to maintain the integrity of our IT systems. We also have in place a disaster management plan.

Cyber-security is a subject that is addressed during our IT update at each Board meeting. Finally, if the worst should happen, the Association has a comprehensive insurance policy in place. Remember, it’s not always the high profile corporates who are attacked, so be prepared and seek expert advice if you haven’t already done so.

Take care when transporting Transporting equipment has its risks that if managed well should not cause us any 30

problems. Load restraint is critical for scissors, booms and other MEWPs being transported from hire companies to their customers. The HRIA recognised the importance of this and applied for government funding to assist in getting the message out via face to face training courses.

HIRE21 has an excellent line up of keynote speakers including Ben Crowe and Glenn McGrath and industry focussed workshops At the end of 2020 and for six months of 2021, Chain of Responsibility courses have – and will be – held across the country. I would encourage anyone involved in the hire and transportation of MEWPs to take up this free option of NHVR funded training. This applies to the sub-contractors and transport companies you engage as the program is open to all. Please contact the national office for information on the last two months of courses.

See you at the Gold Coast As we near the half way mark in 2021, it feels like the country is gaining the upper hand over the pandemic. Without tempting fate, I think it’s a positive sign to see more people travelling and meeting customers face

to face once more. With increased confidence and a return to more normal levels of travel, I hope to see many of you at HIRE21 on the Gold Coast this month. The event has already grown in size with very strong support from exhibitors after a forced 24-month gap between conventions.

HIRE21 has an excellent line up of keynote speakers including Ben Crowe and Glenn McGrath and industry focussed workshops, plus a program on social events so that we can finally connect with each other in person.

On the Tuesday afternoon (prior to the exhibition opening) the EWPA is hosting its annual “Global Access Meeting” at the Gold Coast. This is a chance to hear industry experts and their thoughts on the future of the access industry. With more original equipment manufacturers joining the EWPA from overseas, our global connections and presence is going from strength to strength.

The EWPA is also sponsoring its first ever “Access Night” and our keynote speaker is the very entertaining Mick Colliss – a evening not to be missed on Wednesday 12 May.

Training is essential The access industry is booming and with low unemployment around the country this puts added pressure on our members to be resourced enough for the extra work load.

I would encourage members to look at the training and funding that the EWPA has established a link to through our training partners Strategic Alignment Training and VERTO. Last year association members benefited through funding and subsidies to the tune of $1.8m. For more information on this please contact the national office.

Once again, I look forward to seeing many of you on the Gold Coast at HIRE21 for the EWPA’s Global Access meeting, our ‘Access Night’, a full program of events and a chance to connect in person.

President’s message Safety always comes first

F

It is important to always remember the safety element whenever you undertake a new project. Telescopic handlers are machines that require expertise in their operation and it is imperative that everyone abides to safety requirements at all times.

In conjunction with the EWPA, we supply an array of safety information relating to the operation and regulations regarding telescopic handlers, which is available through the TSHA Operator Licence Training Program – the TSHA Gold Card – as well as industry advice lines, online safety resources, guidance notes and specialised stationary.

The safety of everyone involved in telescopic handlers is non-negotiable and we can’t emphasis enough to abide by all regulations at all times.

Working in unity In 2020 we worked closely with the Victorian Farmers Federation in lobbying the Victorian Government regarding telehandlers licence requirements.

In Victoria the rules are different to other states and we strive to achieve unity in conformity across Australia.

In Victoria, non-slewing telehandlers that are over three tonne rated capacity (3001kg or more) require a high risk work licence – CN Class. For the other states, competency/industry based training such as TSHA Gold Card or Statement of Attainment is acceptable.

The CN Class is the minimum HRW licence where applicable, but any mobile slewing crane class (C2/C6/C1/CO) is acceptable.

We are continuing to work closely with 32

the Victorian Farmers Federation and talk with the Victorian Government to strive to attain consistency across the six states and two territories in Australia.

Work is picking up Every industry, besides supermarkets, suffered greatly from the 2020 pandemic. Even now as we see jobs return and people move about more freely, there is still the occasional COVID-19 scare that sees state governments close borders faster than a speeding bullet.

Members need to abide by all regulations...

When this happens, it causes businesses to stop planning for the future and work halts in that particular state or territory.

Despite this, we are seeing an increase in the demand for telehandlers and we are hopeful that the second half of 2021 will continue to see our members busier than last year, while we are hopeful that 2022 will see business returning to pre-pandemic levels.

Time to get together It just wasn’t the same last year holding the annual HIRE conference via zoom. No chance to mingle, swap stories and understand the challenges and complexities of each business.

The good news is that the preparation and organisation of HIRE21 is in full swing thanks to the efforts of the national office and it looks as though it is going to be bigger and

better than ever.

I would encourage all members to attend and re-connect with each other. There is nothing better than meeting face-to-face as it takes away all unintended misperceptions that can occur through electronic participation.

The Gold Coast conference in May is shaping as the best HRIA event yet and you can be assured that everyone will be welcoming and full of energy to once again discuss business in person.

Gold Card reminder From 1July 2021 you will no longer be able to order a replacement for Gold Cards issued prior to 31 January 2014 (with no photo ID or expiry date).

The TSHA operator training program or “Gold Card” was created as the result of the TSHA working with industry, helping them to comply with the WHS/OHS Acts and regulation. This Gold Card program was designed to ensure that the Gold Card holder is trained in the safe use and operation of telescopic handlers.

The overall intention of the Gold Card program is to assist operators, employers, equipment owners and manufacturers to more easily be able to comply with the WHS/ OHS regulation.

Current WHS/OHS regulations require that operators of plant equipment must undergo activity-based instruction and training.

As a result, as of 1 July 2021 old Gold Cards will not be replaced/reissued by the TSHA, and the TSHA encourages holders of these old cards to update their Gold Card and receive current telescopic handler operator training.

Remember Gold Card training is based on assessing the operator’s competency in safely operating a telescopic handler. It includes a classroom component as well as practical assessment. The training includes any safety messages that may help operators avoid taking risks when working at height.

A guide for good practice is a world first The Telescopic Handler Association (TSHA) is pleased to announce the release of its Good Practice Guide. The production of this document is a world-first and for Australian users of telescopic handlers, it provides one-stop online guidance that is easy to navigate and updated with the latest information on a regular basis.

“In making this freely available, by hosting the guide online at www.tsha. com.au, the TSHA hopes that owners, supervisors and operators will improve their knowledge and decision-making relating to the safe operation of these machines,” James Oxenham, HRIA CEO, said.

“Telescopic handlers are versatile pieces of equipment used across a number of industries, including construction, agriculture and mining and they can be used

with a number of different attachments.

“Understanding load charts, load management systems, training and legislative requirements is a complex process. The TSHA Good Practice Guide brings together all the relevant information so that operators can make informed decisions prior to using telescopic handlers.”

One of the main contributors to the guide was Robbie Wilkinson, an engineer at Wenn Wilkinson.

“It is an important document to put together to assist in the safety and operation of telescopic handlers,” Wilkinson said.

“There was great input from may people, especially Andrew Delahunt, and I think what we have produced it is an excellent guide for those who need to use a telescopic handler.”

The TSHA would like to thank Robbie Wilkinson and Andrew Delahunt for their input and its OEM members for their support of this project.

Zero emission scissor lift powering on lithium-ion batteries Ahern have launched a new zero emission new Snorkel S2755RTE narrow rough terrain scissor lift, which is maintenance free and powered by lithium-ion batteries.

D

esigned for working in confined spaces, the S2755RTE can reach heights of up to 10.1m, yet measures just 1.45m wide, and weighs 2,750kg, meaning that it can be towed on a tandem trailer between jobs.

Based on the popular diesel-powered Snorkel S2755RT, this electric version simply replaces the diesel engine with two 5.75kWh lithium-ion battery systems, that deliver up to eight hours of normal driving and elevation usage on a single charge.

The S2755RTE has an on-board charger and can be fully recharged within five to eight hours. It can also be easily top-up charged throughout the day, such as between shifts or during break periods.

With higher torque and speeds, the S2755RTE retains powerful 4-wheel drive capabilities and has high grip non-marking tyres for indoor and outdoor use. When compared to the diesel equivalent, the S2755RTE delivers 100% reduction in emissions, a 62% noise reduction, and a 93% reduction in service costs.

The narrow Ruthmann Bluelift SA18HB tracked spider lift has a simple three-section boom design which delivers up to 17.8m working height, and up to a 9.3 metres lateral outreach (230kg platform capacity) yet has a stowed width of just 0.84 metres and a stowed height of less than 2 metres.

This model is fitted with a BlueHybrid package, the first-ever full hybrid solution that meets industry needs for zero emission equipment. Three energy-efficient operating modes offer versatility by switching between battery power and combustion engine.

A green solution for diesel generators Makinex Hybrid Power System (HPS) delivers clean green power combining a solar panel system, a battery bank to store energy, an integrated backup diesel generator and an inverter to act as an interface between the different inputs. All elements of the power system are combined on a compact mobile solution that takes minutes to setup on site.

T

he Makinex HPS can replace a standard diesel generator when being used for providing power to events, construction site offices, pumps, remote powering of communities and disaster recovery power. The use of the batteries at times of low power consumption creates a huge advantage in protecting generator damage and waste in fuel.

Makinex HPS overcomes traditional power challenges including managing power supply without access to electricity grid in remote areas; high maintenance costs of poles/wires for electricity providers to supply power to remote areas.

It also means challenges where traditional long lengths of poles/wires are much more likely to get affected by bushfires and lightning strikes are no longer an issue. Major benefits of HPS means events and site users will have lower vulnerability to weather events and will ensure reliability issues are localized.

Makinex Hybrid Power System (HPS).

“HPS will reduce electricity outage rimes for customers and costs for network businesses,” Rory Kennard, Makinex CEO, said. “Plus, the status of the HPS can be easily monitored and controlled locally or remotely.”

Kennard describes the system as a steelframed, standalone power system with fold out solar panels with generator, batteries, and inverter in an all-in-one rapid deployment skid unit. The Makinex HPS model range consists of a 10, 20 and 45 kVA units, replacing the equivalent generator models.

“It takes about five minutes to deploy on site,” Kennard said. “The solar panels provide power for day use and at night, the generator kicks in to boost the batteries when needed.

Once the batteries are charged, the generator turns off.”

HPS targets a reduction in fuel consumption between 80-95% while offering a reliable and more flexible power solution.

The reduced costs of fuel, servicing and onsite truck movements pays for the extra upfront expense of the innovative Makinex HPS. The return of investment for this product ranges from between 36 months on a 10–15 year asset.

JLG delivers a booming versatile range

J

LG’s Compact Crawler Boom range has expanded with the addition of the X13J Plus model, which joins the larger existing X17J Plus and X20J Plus variants.

The X13J Plus model’s narrow chassis, tracked wheel carriage (0.75 metres unretracted width) and light weight makes it easy to manoeuvre around work sites, through gates, yards and even through standard doorways. The non-marking rubber tracks also make it suitable for use on delicate surfaces, further increasing its appeal.

As well as being versatile and userfriendly, the X13J Plus still provides a generous platform height of 11.30 m (13.30 m working height), and a working reach of 7.08 m, while platform capacity extends to 230 kg, which should be sufficient for a twoperson work crew plus tools.

For added safety on the platform, the X13J Plus features SkyGuard as standard, while auto levelling outriggers with integrated lifting lugs increase stability and ease of setup, allowing the model to be safely operated on slopes of up to 16° and to climb grades of up to 28 per cent.

Further safety features include auto cut-out when the machine is out of level, emergency descent systems and envelope management load-sensing system.

Depending on operator preference or application requirements, the X13J Plus can be specified with a 11.7 kW petrol or 7.5 kW diesel engine; alternatively a Lithiumion option is also available. A further benefit of Lithium-ion power is its quite operation, meaning this machine is more suitable for use in noise sensitive areas.

“By adding the X13J Plus to the lineup, we can now offer platform heights from 11.30 to 18.05 metres and provide all the many benefits of the larger XJ Plus models in a smaller package,” Arron Cooper, JLG Industries product manager – ANZ, said.

“The X13J Plus lighter weight and compact dimensions – benefits that make it very convenient to manoeuvre on site – also make this model easy to transport, making it ideal for rental applications. Tipping the scales at around 2,185 kg, it may vary slightly depending on accessories fitted, means it is well within the braked towing capacity of utes and even some lighter vehicles.

“Like the larger models in the XJ Plus range, we expect the X13J Plus to also prove popular across a variety of industries from construction and maintenance through to use in parks and gardens, as well as for DIY work.

Always ‘Accessing’ your needs

he Global Access annual meeting, targeting safety and regulations for Mobile Elevating Work Platforms (MEWPs) and telehandlers will focus on technology in safety.

Advances in technology can be disruptive and recently we saw the push to introduce secondary guarding on scissor lifts. So, what comes next? And how does the access industry respond to the next innovation?

The improvements in safety since the early days of access equipment is truly significant.

MEWPs are reliable, robust and safe to use every day.

Now the focus turns towards using technology to address the high risk activities and questions arise including: what is being done to prevent falls? Can powerline detection systems reduce electrocutions? Can specialist tools help prevent overturns? Will next generation LMS on Telehandlers use adaptive technology to permit a dynamic safe working envelope?

The forum will introduce an array of speakers from regulators and auditors, from local access rental companies and from national construction companies.

Topics discussed will include a briefing from Queensland WorkCover on how they investigate a serious incident. There will also be talk and discussion on what information and employer need, as well as information on how a demonstrate that the work activity was reasonable.

Further discussions and presentations will centre around how a specialist travel tower rental company trains and equips their operators to assess ground conditions and safely set-up on outriggers, while a federal safety officer will outline how they audit a worksite to conduct compliance and system reviews.

For those looking to discuss the next steps in safety and sustainability, the Global Access Meeting is Tuesday, May 11 with drinks to follow.

Previously we had the welcome drinks on this night but have moved the welcome drinks back to the evening before the show starts and added this dinner to the Wednesday evening.

The idea is a more casual dinner than the gala dinner where people can relax over a BBQ style meal and listen to an interesting keynote.

Secondary guarding event Recently the EWPA participated in a Commonwealth Government webinar to address the risks of crushing and promote the use of Secondary Guarding on MEWPs. A secondary guarding device is a piece of equipment which can be fitted to a MEWP

in addition to the primary guarding systems and is intended to further reduce the risk of entrapment/crushing and/or provide an alert that an entrapment situation has occurred.

Currently there is no single solution to completely eliminate the risk of entrapment in all working environments. Reducing the number of such incidents requires the combined efforts of management, hirers, rental companies, and operators.

The webinar was delivered by the Office of the Federal Safety Commissioner (OFSC), who hosts the accreditation scheme for construction companies engaged on government projects.

The webinars numbers were very strong.

This was the first webinar as part of Hazard 2020, a safety campaign focussed on two prevalent industry hazards – scaffolding and mobile plant.

According to the OFSC data more than 50% of reported incidents involved the use of either scaffolding or mobile plant.

Kicking off the campaign was the topic Secondary Guarding and the EWPA were happy to share our recently updated information sheet and discuss key ways to reduce crushing accidents.

President’s message Outdoor events are returning You can sense a degree of optimism in the air as restrictions ease across the country and we have a sense of normality returning to our everyday life. Yes, there will be outbreaks from time to time and no doubt the respective state government and territory leaders will act accordingly, but with so many options of vaccines and manufacturing of at least one of them happening on our shores, I am expecting the second half of 2021 to be even stronger for business than the first half.

Let’s continue to be diligent with our health, look out for our neighbours and be positive in our outlook.

Business is coming back It is pleasing to see small events across the country starting to become more prevalent, with the easing of restrictions giving everyone the confidence to start planning ahead. In New South Wales and Western Australia, there are very few restrictions in place at all meaning the knock on effect from small events will soon give assurance to bigger events such as music and arts related festivals, to start planning dates during the year.

We are seeing significant crowds at major sporting events such as the AFL and that naturally is a boost for everyone whose livelihood depends on hosting largescale outdoor events.

We keep our fingers crossed for the industry that the worse of the pandemic is over.

Training wage subsidies extended The Commonwealth Government has extended its economic stimulus package by $1.2 billion to encourage employers to take on new apprentices and trainees.

The Boosting Apprenticeship Commencements wage subsidy supports businesses and Group Training Organisations to take on new apprentices and trainees to build a pipeline of skilled workers to support 44

sustained economic recovery.

This wage subsidy is in addition to the existing $2.8 billion Supporting Apprentices and Trainees wage subsidy.

Through the Boosting Apprenticeship Commencements wage subsidy, any business or Group Training Organisation that engages an Australian Apprentice up until 30 September 2021 may be eligible for a subsidy of 50 per cent of wages paid to a new or recommencing apprentice or trainee for a 12-month period from the date of commencement, to a maximum of $7,000 per quarter. There is no cap on the number of eligible trainees/ apprentices.

Employers of any size, or industry, Australia-wide who commence an Australian Apprentice between up until 30 September 2021 may be eligible under this program.

What are the changes to eligibility for existing workers? Up until 30 September 2021 an employer, or host employer (if using a Group Training Organisation), will be eligible for the subsidy for up to 30 existing worker commencements when: • an existing worker transfers from a casual employment arrangement to either a part-time or full-time Australian Apprenticeship; or • an existing worker transfers from a parttime employment arrangement to a fulltime Australian Apprenticeship. There will be no changes for commencements of existing workers in trade-based Australian Apprenticeships.

Time to share our war stories Very soon we will be gathering on the Gold Coast reflecting on the turmoil of 2020. It was a year like no other. There are many events at the conference including the Young Professional Network and Women in Hire Networking for Success social events; The Future of Hire workshop; The Events Workshop; the SME Business workshop culminating in the Hire Industry Excellence Awards and gala dinner on the Thursday night.

I would encourage all of you to attend this conference and reconnect with each other in person. It is vital for the future of the industry for individuals to bond together and to get a sense of where opportunities, and roadblocks, lie, in order to successfully plan for the remainder of 2021 and beyond.

Come one, come all HIRE21 ready to go The HIRE21 event is just around the corner and we cannot wait to bring everyone together for the excitement of the leading event for the equipment rental market in Australia.

ue to COVID-19 we were forced to cancel the event, which is why we are super excited to be hosting HIRE21 on the Gold Coast over the week of Monday, May 10 to Friday, May 14.

While the two big days are Wednesday, May 12 and Thursday, May 13, culminating in a gala dinner, HRIA representatives will be at the venue for a full week holding meetings and organising networking events.

“Connecting industry members from the rental and supplier sides will see many friends and interstate colleagues re-united, in some instances after a 2 year absence, since HIRE19 in Melbourne,” James Oxenham, HRIA CEO said.

“All the members I have spoken with are looking forward to getting together again on the Gold Coast and we have secured some excellent venues and speakers for the events taking place in May 2021.

“Demand for the Exhibition has grown and with that, the HRIA secured more floor space at the Gold Coast Convention and Exhibition Centre (GCCEC). We have a wide variety of companies exhibiting, from across Australia and overseas, plus several exhibiting for the first time.”

A

word of warning from the lawyers: ACCC prosecutions and heavy fines can result from false or misleading advertising and promotional campaigns.

According to figures published by the Australian Competition and Consumer Commission (ACCC) $198.2 million in penalties were handed down by Courts in relation to consumer protection actions commenced by the ACCC against businesses in the financial year ending 30 June 2020.

In this article we explain some of the key provisions of the Australian Consumer Law that relate to false or misleading advertising and promotional campaigns and the lessons to be learned by businesses, including hire and rental businesses, from recent ACCC prosecutions.

The ACCC and the Australian Consumer Law The Australian Consumer Law (ACL) is a national law for the promotion of fair trading and consumer protection.

Broadly speaking the ACL prohibits a range of dishonourable conduct that may affect consumers and provides consumer guarantees with respect to goods and services. The ACCC regulates the ACL and it has a wide range of enforcement powers to ensure that businesses comply. In a nutshell if you sell goods or services (whether as an individual or a business) to consumers or small businesses then you will most certainly be bound by the provisions of the ACL. Key concepts The ACL affects the supply of good or services to a ‘consumer’ and it affects conduct ‘in trade or commerce’.

• A consumer is a person who acquires: o goods or services for less than $40,000. From 1 July 2021 that threshold is going to increase to $100,000; or o goods or services of a kind ordinarily acquired for personal, domestic or household use; or 50

o a vehicle or trailer for transport of goods on the road.

• Trade or commerce includes any business or professional activity (whether or not carried on for profit).

What sort of conduct is prohibited by the ACL? Misleading or deceptive conduct The ACL provides that “a person must not in trade or commerce, engage in conduct that is misleading or deceptive or is likely to mislead or deceive”. This is one of the most litigated pieces of legislation in Australia.

Conduct can be statements (oral or written), it can be actions or even failing to do or say something. The term ‘misleading or deceptive’ is not defined in the ACL. The threshold test is if the overall impression of the conduct induces or is capable of inducing error. Whether particular conduct is misleading or deceptive is a question of fact to be determined in the context of the circumstances of the alleged conduct as a whole. It does not matter whether or not there was an intention to mislead.

Misleading or deceptive conduct applies across a broad spectrum of conduct – whether directed to the public at large, for example advertising campaigns, or to private negotiations between two parties. Where the public is involved the ‘reasonable person’ test is applied i.e. the ACL is there to protect the ‘reasonable person’.

Statements that have multiple meanings or half truths carry greater risk and even statements that are literally true and accurate may carry with it a misleading impression.

Silence can also be misleading. A failure to correct a true representation which later becomes untrue may be misleading. It is also important to note that correcting a misleading statement does not absolve liability, the conduct is considered at the time that the statement is made.

False or Misleading Representations

The ACL also prohibits false or misleading representations about goods and services including for example, their price, standard, quality, value or grade.

The consequences of getting it wrong The consequences for businesses of breaching the ACL can be severe with the courts imposing damages, compensatory orders and injunctions. For false or misleading representations the court can also impose adverse publicity orders and pecuniary penalties. The maximum penalties per breach of the ACL for making false and misleading representations are the greater of: $10 million; or three times the value of the benefit; or 10% of annual turnover for corporates; or $500,000 for individuals.

Boundaries are often pushed when it comes to advertising goods and services.

After all advertising is all about inducing or enticing consumers to buy your products or services. It is an area where misleading conduct and false or misleading representations easily occurs.

GlaxoSmithKline and Norvatis were involved in marketing and selling ‘Osteo Gel’ and ‘Emulgel’ as different products.

Osteo Gel was sold for a higher price and was represented to be more effective than Emulgel. However, both products were found to be the exact same product as they contained the same active ingredients and were equally effective in treating local pain and inflammation.

The ACCC brought proceedings for misleading and deceptive conduct, false or misleading representations about the gel and misleading conduct as to the nature, manufacturing process and characteristics of the goods. The concern being that consumers were potentially misled in to paying more for an identical product believing that it was more effective.

PENALTY:GlaxoSmithKlinewasorderedtopay $1.5 million and Norvatis was ordered to pay $3 million.

fines can result from false or promotional campaigns The ACCC commenced action against glasses company Oscar Wylee, who had run a ‘buy a pair, give a pair’ promotion that for every pair of glasses purchased, the company would donate a pair glasses to someone in need. However, out of 328,010 pairs of glasses sold, the company only donated 3,181 frames, without lenses, to charity.

The Court found that Oscar Wylee was guilty of engaging in contravening conduct, which took advantage of the charitable nature and goodwill of customers, to induce customers to buy products.

PENALTY: $3.5 million, restraining orders, an order that Oscar Wylee publish corrective notices, orders to review its ACL compliance program, and an order to contribute to ACCC’s costs.

Case Study #3: ACCC v Kogan Australia Pty Ltd Kogan, a well-known online shopping platform in Australia, was found to have misled consumers by advertising that customers could use the code ‘TAXTIME’ to reduce prices by 10% at the checkout.

However, the Court found that the price of 621 products had been increased by 10% immediately before the promotion.

PENALTY: $350,000 and an order to pay ACCC’s costs.

Don’t use deceptive pricing practices. For example, an ‘original price’ must have been the original price for a reasonable time.

Don’t make predictions without reasonable grounds.

Don’t hand out material prepared by others without checking accuracy.

Seek advice if you suspect proposed statements or conduct may be misleading.

Reducing hazardous dust problems

azardous dust is a major issue for busy building, function and commercial sites in general.

It is not only annoying but can cause a serious risk to your health.

Hazardous crystalline dusts such as silica, lead, asbestos and others can be found in many industrial workplaces of many industries such as construction, woodworks, glass, oil, food processing units, pharmaceuticals, automobile and many other such industries.

Governing bodies have implemented many restriction and exposure standards to control such dust in a workplace and noncompliance can lead to heavy fines.

“It is essential to manage dust effectively,” Paul Desani, managing director of Industrial Vacuums & Engineering, says.

Rolling out the kinks – combining new Concrete work is nothing new. Contractors have been perfecting the art of concrete pours for many years, combining new technology with their tried-and true methods.

Roller screeds are easy to use and highly efficient.

B

y relying on their proven, manual methods and simultaneously implementing new products and technology, contractors are able to improve finished product quality, save time and reduce labour costs.

Roller screeds (also known as tube screeds or revolving tubes) are a perfect example of this blending theory. This equipment combines the time-tested process of using something flat to smooth out concrete with the addition of a spinning tube attached to a power source.

Roller screeds have been around for several years but are gaining popularity in the rental market because of their ease of use and achievable investment. Here are some of the most commonly asked questions about roller screeds.

What are roller screeds?

Simply put, a roller screed consists of a power source and a single tube. The tube spins against the concrete as operators pull the unit across forms. Roller screeds are simple to operate and can be customized to fit just about any size pour, including shaped forms for curb and gutter work.

The standard tube screed can complete pours of just a few metres to those 10 metres wide. Roller screeds can run on various power sources – hydraulic, electric, gas, and the newly introduced battery option. The components are easy to set up and tear down.

Perhaps most notably, they offer an upright operating position that’s much easier on the 56

Unlike a vibrating screed, roller screeds offer an effective method for pervious paving and low slump concrete, as well as slope paving. The absence of a vibration source eliminates concrete slumping down the slope and ensures more aggregate stays near the top.

Even if an operator hasn’t used a roller screed before, it’s highly likely that they can create a nearly perfect pour after running the screed. Some manufacturers offer variable speed control on their units, which makes them easier to use than a simple on/ off switch. Moisture and slump levels vary between truckloads, therefore variable speed flexibility allows the spin speed to be adjusted on the fly to accommodate the changing material conditions.

Along with being easy to use, roller screeds reduce the skill that’s often required with concrete labor. The design is intuitive enabling contractors to accomplish a high-quality product with less experienced crews. Because the roller screed rides on predefined rails or forms, it gives the supervisor or foreman on a crew the ability to ensure the job is being done correctly to achieve a flatter finish.

Electric and battery-powered screeds require virtually no maintenance. There’s also minimal maintenance required with hydraulic machines, besides cleaning and occasional greasing. A gas-powered machine needs just a bit more maintenance, but still relatively little compared to other pieces of equipment. Roller screeds are reliable and don’t generally have service issues.

If anything, users might have an issue with the power sources – either an extension cord for an electric model, a bad battery or a problem with the hydraulic source. These issues are usually easy to troubleshoot and don’t require an onsite visit from an expert or rental company employee.

Getting the lift you require This new version of the 160 ATJ+, of one of Manitou’s best sellers in the mobile elevating work platform range, has been developed with performance and reduced total cost of ownership in mind thanks to the use of new technologies and a new motorisation.

he first difference you will notice before opening the hood of the 160 ATJ+ is its new design. The new MEWP showcases a fully redesigned Manitou red counterweight and matching turret hoods made out of new more resistant material. Its boom has changed from grey to a full black look, giving the 160 ATJ+ a more modern appearance in tune with the most recent design approach of Manitou Group products.
