DonaldTrump this week became the first former US president to be criminally indicted on federal charges.

These are thirty-seven serious charges related to violations of the national espionage law, false statements and obstruction of justice.

The classified documents Trump stored inside boxes, some of which were found in a bathroom at his Mar-A-Lago residence, included:

• National defense information.

• Weapons capabilities of the United States and allied countries.

• Details of the United States nuclear program.

• Potential vulnerabilities in the event of a military attack on the United States and its allies.

The 49-page criminal indictment contends that “unauthorized disclosure of these classified documents could jeopardize the national security of the United States, its foreign relations, the security of the United States military, human sources of information, and the feasibility of intelligence gathering methods.”

The former president's main defense is that it is a political "witch hunt" and that the justice department applies a double standard, since classified documents have appeared in the possession of Joe Biden and Mike Pence, in addition to the infamous scandal where emails were stored on servers at Hillary Clinton's home.

It seems legitimate to me to wonder if the Justice Department is applying a different standard for Biden, Pence or Clinton than it is for Trump, especially since his indictment comes in the middle of a run for the US presidency.

Independent experts agree that there is no comparison between these cases and that of Trump, since he deliberately stole a significant number of documents, he kept them at his house and allegedly lied when they were requested by the National Archives Office.

Furthermore, the criminal indictment shows that the FBI obtained video in which Trump boasts to guests at his residence with classified documents in hand about an attack on Iran and acknowledges that the documents were not declassified. None of his guests had a national security certification to know those facts.

In another section, the accusation maintains that the former president and his lawyers carried out actions to obstruct justice and prevent the full recovery of the documents once they were identified by federal authorities.

Even for Trump’s former Attorney General Bill Barr, the idea that Trump is the victim of a witch hunt is ludicrous, since in his opinion the evidence is damning enough to support the criminal charge.

Unsurprisingly, the former president has pleaded not guilty and maintains that under no circumstances will he stop campaigning for him, even if he had to do it from behind bars.

Polls show that nearly five in ten Americans believe the criminal charge against Trump is admissible, while just over three in ten think otherwise.

Undoubtedly, at this level of political polarization, the acid test falls on the US justice system.

Trump is an innocent man until proven guilty and it will be up to prosecutors to prove to a jury that these allegations constitute a crime. To prove his case, like anyone else, Trump deserves the full weight of the law.

REPORT: CA FAMILIES STRUGGLE TO FIND AFFORDABLE CHILD CARE

State Ranks 35th for Child Well-Being

Californiafamilies are paying way too much for child care, according to the 2023 Kids Count Data Book out this week from the Annie E. Casey Foundation.

The new report showed single mothers in California pay 31% of the average median income for family-based child care, and couples pay 10%, the third-highest rates in the country.

Kelly Hardy, senior managing director of health and research at the nonprofit Children Now, said hundreds of thousands of California families need subsidized child care, but cannot find it. She hopes the new state budget, being finalized this week, will address the issue.

“What we’re really looking for is a 25% rate increase for all subsidized child care, so that those providers can earn a living wage,” Hardy explained. “And that the 20,000 child care spaces that are scheduled to be released in 2023-24, be released today.”

The research ranked the Golden State 35th for children’s overall well-being and 43rd for economic well-being, issues linked to the high cost of housing. The report also found nationwide, educational indicators worsened over the past few years, with fewer 3- and 4-year-olds in preschool, and drops in the percentage of fourth graders proficient in reading and eighth graders working at grade level in math.

Leslie Boissiere, vice president of external affairs for the Annie E. Casey Foundation, said Congress was on the right track when it expanded the Child Tax Credit during

the pandemic, and started sending families extra checks.

“It was the largest one-time reduction in child poverty in a single year that we’ve seen,” Boissiere pointed out. “And making permanent the expansion of the Child Tax Credit could have a significant impact on the number of children and families who are living in poverty.”

There is some good news: Teen births have continued to fall, and California has one of the highest rates of health insurance for kids in the country.

Q&A: EVA LONGORIA TALKS ABOUT THE LATINO HERO OF THE HOT CHEETO

Richard Montañez is not a name most grew up with, but a name that people might recall from now on, and possibly attach it to a popular snack name that everyone most definitely knows.

Montañez’s incredible story is one of perseverance, and gritty self-determination. From a janitor at Frito-Lay in Southern California to an Executive of Multicultural Marketing at PepsiCo, Montanez’s journey reflects the feelgood Latino stories that are lacking in the mainstream American media, his story is one where there is more heart and hope than there is tragedy and despair. Now his story has been brought to life by Eva Longoria with Flamin’ Hot.

Born in Corpus Christi, TX, Longoria is most known for her work as Gabrielle Solis on Desperate Housewives, a role that captivated audiences worldwide. From there she has continued acting as well as working behind the scenes, as a producer and director of projects like John Wick, Gordita Chronicles, and her recent TV series Eva Longoria: Searching for Mexico.

Flamin’ Hot, now streaming on both Hulu and Disney+, is Longoria’s feature film debut, and with 10 years of experience behind the camera, with TV shows and a documentary under her belt, the experience shows. There are also some firsts with the cast as well, with Jesse Garcia playing Richard Montañez in his first feature role, and Annie Gonzalez (Judy Montañez) in her first movie role. The veteran presence of Dennis Haysbert and Tony Shalhoub help bolster the film.

As evident by her more recent projects, Longoria has been delving more into her own culture, last year she directed La Guerra Civil, the documentary which recalls the Mexican versus MexicanAmerican rivalry that was spurred by one of the most iconic boxing matchups of the 90s, between Mexican boxer Julio César Chávez and Mexican-

American boxer Oscar De La Hoya. Recently she was in San Francisco while promoting Flamin’ Hot when she sat down to talk about how she became obsessed with making this movie, how Martin Scorsese and Ron

munity; and that in spite of racism and classism Montañez’s achievements are some to be held up for people to see.

To start out, what was it about Richard Montañez’s story that attracted you to this project?

was sad that I didn't know this story. If I'm from this community, why don't we know who our heroes are?

And so I became obsessed with wanting to direct this film. And I went in and tried to get the job, had to pitch Searchlight four or five times, had to keep going back in and sharing my vision with them about the film I wanted to make. And then when I read the story, too, I was like, "I am Richard Montañez". I've been told “no.” I've been told, "opportunities are not for people who look like you" and "you're a girl. Maybe you shouldn't do that job." So I felt like the lesson that Richard teaches us is to ask, "Why not me? Why can't I do something great? Why can't I be great?" And so I got the job and was able to share the vision and my version of Richard's really true, compelling story.

Did you have any inspirations you could talk about in terms of what you wanted the vibe of this movie to represent?

I had a lot, when you do a director's presentation, you gotta present to them the movie you want to shoot. And I was trying to look at comparables to explain my vision to the studio, and there were none. I couldn't find a movie from our community to point to that this was similar to.

So my inspirations were Scorsese, Adam McKay, Steven Spielberg, Ron Howard. And I really pulled references from those movies of, like, look what Scorsese did for the Italian American community's knowledge of what that experience was in a period piece, in present day, in the 70s in Casino and Goodfellas. I was like, "oh, man. I love how he had an authentic point of view about that community."

Howard influenced her, what she feels is her superpower as a director, and why Richard Montañez’s story is one that needed to be told.

And despite the premise, Longoria makes sure to say that this is not simply the story of a chip, but the story of a man and his family, about his com-

Well, I read this script. This story was set up at Searchlight Pictures. They really believed in Richard's story, and they sent me the script, and I read it, and I was like, "oh, my God." I was blown away by his journey and his resilience. And then I was like, "Wait, he's Mexican American. I'm Mexican American. How do I not know this story?!" Then I

Ava DuVernay, she has a very specific point of view about the stories she wants to tell. And Ron Howard really directs movies with heart and that explore thematics on a different level. And he's one of my mentors, and he said, "what is the movie about? Because it cannot be about the Cheeto."

My North Star was authenticity, and I knew that was going to be my superpower. I know this community. This is my community. I know how to portray it. And this is why this movie is such a beautiful love letter to the Mexican American community, to the Chicano community, to the Cholo community. You've never seen them painted with a brush of so many colors.
-Eva Longoria

And so I wanted to thematically explore what it means when opportunity is not distributed equally. Talent is, ambition is. But we all don't get that opportunity to be great, to shine.

And so that's what interested me, that's the movie I wanted to make, was the journey of this man, and how, in spite of racism and classism and all the obstacles, he dealt with it with not only resilience, but he was resilient with dignity and grace. And I thought, wow, we could all learn from him.

Now, as this being your first feature film, I was wondering how that compares to your work directing Television. Are there any differences that you were surprised by in the process of directing?

No, this was a very ambitious schedule. So it was thanks to my ten years of directing TV that we went at the pace we went at, because I was used to it. I was like, no, we're going to shoot this on a TV schedule, fast, scrappy. I slowed down when things needed scale and scope, but for the most part, it was an ambitious schedule to get, and I was really lucky I had the actors I had that came along, trusted me, moved at the pace we needed to move at, were totally prepared.

I had an amazing crew, almost all Latino department head crew that served my vision and improved it. They just delivered my vision times ten. And so for me, filmmaking is such a collaborative process, and my motto is, "best idea wins." So

ten brains are better than one. And I would present to them, "what do you guys think about this shot? What do you think about this sequence?" We had to build this entire factory. Everything you see is built by our production designers. And so to have those problem solvers on your team is really necessary and a blessing.

I was wondering why you think it's important to bring to life these stories of people from our community, from Latinos?

My North Star was authenticity, and I knew that was going to be my superpower. I know this community. This is my community. I know how to portray it. And this is why this movie is such a beautiful love letter to the Mexican American community, to the Chicano community, to the Cholo community. You've never seen them painted with a brush of so many colors.

And so for me, I'm like,

this is who we are. We're hardworking, we're ambitious, we're faith based, we're family oriented. We contribute a lot to our communities and our country. And so I wanted people to see what I know about our community and to see our worth

on screen.

I also took to heart heavily the idea that Hollywood defines what heroes look like, and they never look like Richard, and they never look like us. And so to take this opportunity and create a hero that

our community could look up at the big screen and see themselves reflected back at them was very important.

Could you touch on what it was like working with and directing the leads Jesse Garcia and Annie Gonzalez? And for them, I feel like it's a big step being in the spotlight, being featured.

Well, I've always been a fan of Jesse's. He's been in the business 20 years, since Quinceañera. He's been doing amazing work, but this is the first role he has had that shows the spectrum of his talent. We don't get roles like this. We don't get to play three different decades of a period piece, vulnerable, funny, dramatic, humorous, dangerous, kind.

He played all these amazing characters because he was different people at different points of his life, and he just knocked it out of the park. And I'm so happy for the world to

finally see Jesse, for the talent that he is. He's a force. He's our movie star. He's our Latino movie star. How many do we have? He's in two movies right now. One with J-Lo and this one. That's rare.

And Annie, I'm so excited for the world to be introduced to the talent that is Annie. She is a beautiful human being, but, wow, is she an amazing actress. And it wasn't until we were doing this press tour where she said, "for this being my first movie," and I was like, "wait, this was your first film?!" I didn't even know that when we were shooting because she was such a pro and she was so skilled. And anything I said and anything I did, she was like, "yep, got it, great."

She took direction insanely well. She made every scene better. Every scene that she was in, she made it better. And so I'm excited to introduce the world to Annie Gonzalez.

Last question. Now that Flamin’ Hot is out to stream on Hulu and Disney+, now it's out for the world to see, what do you hope people take away from watching it?

Oh, man, I hope they're inspired. I really love a feel-good movie, and you leave this movie feeling so good about life, so good about the possibilities, so good about dreaming big. And I want you to look at Richard's life and go, “wow, if that guy survived all that and is thriving in spite of it, I can do anything.”

Aportamos mucho a nuestras comunidades y a nuestro país.

UNIONS, ENVIRONMENTAL ADVOCATES PRESS TO REFORM CA REFERENDUM PROCESS

Suzanne Potter California News Service

Unions, environmental groups and other progressive organizations are leading the charge to reform California's referendum process, which allows voters to repeal laws passed by the legislature.

Assembly Bill 421 came about after the oil industry gathered signatures to repeal a law blocking new drilling in neighborhoods.

Assemblymember Isaac Bryan, D-Los Angeles, who introduced the bill, said the current system incentivizes signature gatherers to mislead voters.

"The oil companies then spent nearly $25 million in 90 days to gather the signatures to pause the law, so they could apply for new drilling permits and put it on the referendum," Bryan recounted. "And there was hours of documented video evidence that many of the signature gatherers were just outright lying to people."

Currently, it is legal to word a referendum in a confusing way, in which a "yes" vote would overturn the law in question. Under the proposed bill, voters would simply decide whether to keep or repeal the law. The California Chamber of Commerce opposes the measure, arguing it would make signature gathering more expensive and should require a constitutional amendment.

Bryan added the bill would require signature gatherers to wear a badge with their name, identification number and photo.

"Folks should have to have adequate training and also be registered," Bryan contended. "So that it's clear that, if they are violating the ethics of signature

gathering, that can be reported in a way that's accountable."

The bill would require petitions to identify the referendum's top three donors and mandates at least 10% of signature gatherers be community-based volunteers. The bill has already passed the State Assembly. Its next stop is the State Senate Elections Committee.

Support for this reporting was provided by The Carnegie Corporation of New York.

THREE VOICES ON WHAT IT TAKES TO HEAL FROM HATE

Across the country acts of hate are on the rise, targeting minority and historically marginalized groups and leaving lasting scars on victims, their families, and their communities. Addressing that trauma is key to healing for individuals and society.

But advocates say documenting the hate impacting diverse communities is a crucial first step.

“We have to be able to show these stories and reach as many communities as possible, because that’s where the healing will begin and it also means empowerment,” says veteran journalist and community organizer Helen Zia, founder of the Vincent Chin Institute, which commemorates the 1982 murder of Chin in Detroit.

Chin, who was Chinese American, was beaten to death by two white unemployed autoworkers who mistook him for being Japanese at a time when Japanese automakers began to make inroads into the US market. Despite numerous witnesses, the judge in the case sentenced the attackers to probation.

Zia, who spent time as an autoworker in the 1980s, says the ruling marked the birth of a “new civil rights movement” among Asian Americans.

“So these two killers actually never spent a single day in jail. But the trauma also triggered a great sense of inequality, of injustice,” Zia said, noting many Asian Americans began to draw connections to the experience of African Americans and other communities of color.

“What made a difference was a community coming together… to tell the world this is something that happens to Asian Americans. This was a terrible thing that happened to Lily Chen’s son, Vincent, and to then begin to do something about it,” said Zia, who spoke during a national press briefing organized by EMS.

Today groups like Stop AAPI Hate have taken up that cause, compiling the alarming spike in hate incidents targeting the Asian American and Pacific Islander communities since the start of the COVID-19 pandemic. In the first two years of its existence Stop AAPI Hate documented nearly 11,500

such incidents.

For victims and their families, the trauma inflicted by these attacks often leaves a lasting sense of vulnerability. In Zia’s experience it was when different communities rallied together to denounce the hate that things began to change, and that change is what promotes healing.

Zia says Vincent Chin’s mother, Lily Chin, “became like a Mamie Till for the Asian American community,” comparing the former to the bereaved mother of Emmett Till, who was tortured and lynched by racist whites in Mississippi in 1955.

“And so what happened was that she and the Asian American community were able to channel their grief through action to make a difference, and not just

Asian Americans coming together, but reaching out and joining with the Black community – Black, brown, red, white –and coming together,” Zia said.

Helen Zia, author and founder of The Vincent Chin Institute, shares how Vincent Chin’s mother Lily and the Asian American community came together in the aftermath of Vincent’s murder to fight for justice.

“The state can judge, only the individual can forgive”

Still, healing does not mean forgetting.

“There is a huge percentage of people who came to America as a result of war, conflict, and genocide that occurred in their homelands,” says Julian Do, a Vietnamese refugee whose family immigrated to the U.S. after the Vietnam

War.

Do is co-director of Ethnic Media Services and moderated the Friday panel, which brought together experts including Zia to look at whether and how communities can heal from the experience of hate.

“It’s been well-documented that many immigrants who have been exposed to war and imprisonment are still living with this trauma even decades later,” Do said.

One of those people is Nestor Fantini, who was a 22-year-old student at the University of Cordoba in 1976 when the Argentine military staged a coup d’état. Fantini, who today serves as editor of the Spanish-language news site Hispanic LA, was arrested and tortured but never charged with a crime. He spent four years in prison during Argentina’s “Dirty War” from 1976-1983.

“That was pure state terrorism. These victims were kidnapped. They were taken to more than 360 concentration camps and they were systematically tortured and as many as 30,000 disappeared. I mean they were executed. Prisoners were dragged and thrown from planes into the Atlantic Ocean,” Fantini said.

Eventually, more than 900 members of the junta were tried and convicted, including 26 military officers who were convicted of crimes against humanity. “The state can judge but only the individual can forgive,” Fantini said.

The offender needs to acknowledge the harm that he or she has caused, and should provide material restitution and symbolic reparations, Fantini added.

Nestor Fantini speaks on the elements of reconciliation and what reconciliation must include in order to honor human rights and make amends for harm done.

“Fix what you broke”

Reparation, not integration, was the first demand of emancipated slaves, according to James Taylor, a professor of politics and African American Studies at the University of San Francisco and a member of the San Francisco African American Reparations Committee.

“The idea of reparations goes back to Callie House,” says Taylor.

House sued the United States Treasury for $68 million dollars arguing that former slaves were owed a pension from the government. After the Civil War, a federal tax on Southern cotton was used as a retirement fund for Union soldiers. “So, she sued over the right to that taxed cotton that was Confederate cotton that black folks picked,” Taylor said. The Supreme Court ruled against the founder of the U.S. reparations movement.

That bit of history has been largely forgotten and today a new reparations movement is spreading. “But it’s just shown that time has not healed the pain that Black folk had in the 1890s. Here we are in the 2020s, still talking about the same issue,” Taylor says.

Civil rights, affirmative action, welfare are piecemeal efforts that haven’t fixed the fundamental gross economic disparity of African Americans, he says, noting that the Japanese American and Jewish communities in San Francisco are among the leading supporters of reparations.

“They know what it is to be targeted,” Taylor said, adding, “It’s not just Black America, and it’s not asking for a handout. It’s saying ‘fix what you broke’, and it’s actually a global movement.”

There are 14 countries and seven states talking about reparations now. New York, Boston, Detroit, Oakland, San Francisco, St. Paul, Detroit, Amherst and Evanston, Illinois have created funds or formed reparation task forces.

California became the first state in the country to form a statewide taskforce in 2020. New York and five other states are also considering reparation programs.

James Taylor, Professor of Politics and African American Studies, University of San Francisco, explains some of the misunderstood points of reparations and says they are key to healing the injury done to Black Americans.

“They say time heals all wounds,” said Zia. “But time is not enough. There must be action, there must be learning. We must know the past… and try to change the past so we don’t repeat it in the future.”

Oración a Santo Tomás Moro
