Hilbert Morales EL OBSERVADOR All political parties, especially Democratic, Independent, and Republican, would be well advised to examine how their 'Leadership' is selected and appointed. The traditional reliance on norms which may be defined as unwritten rules, standards of behavior, and traditional expectations of our social and business interactions process. An analogy is the “unwritten English Law” which exists and is practiced even though it remains unwritten. Current issues are adjudicated in courts which are traditionally the non-political third branch of governance (Legislative; executive, and judicial). The least understood is the Judicial system which settles 'in a court having jurisdiction' issues such as divorces, contract disputes, personal injury disputes, property rights and inheritance issues, tax appeals, etc. This nation's current 'elected president' was enabled by the existing reliance on many norms which Mr. D.J. Trump could ignore. When challenged, Trump could respond “Who says so” since the violated norm is understood that it will be followed even though several definitions apply and individuals each have their own opinion. But when an individual is amoral, unethical, and willing to do anything and everything 'to win', the reality is that many unwritten norms are easy to set aside and do what is advantageous. Some sort of push back by interested and affected parties is required. One important unwritten

norm is that America has ideals which enable many cultures, races, nationalities and religions to live together in peace and harmony. Men (and women) are all equal (under the laws of this land). A major current issue is that the administration, practice, and implementation of the 'law of this land' is not even handed nor fair. Essential to Democracy is having individuals who are informed, educated and religious. The influence of religions has diminished over the years by the misunderstanding of “the separation of church and state”, even though the Constitution's First Amendment ensure the freedom of religion; one of our personal choices' is a personal freedom and civil right. This separation of church and state standard was intended to prevent high church officials from meddling with the affairs of the State (formation of and application of 'public policy' adopted after debates and negotiation by elected officials. The laity is free to continue to be involved in affairs of the state, especially as voters. However, it is during 'personal religious training and indoctrination' that we learn the Decalogue (10 Commandments). The first four have to do with one's relationship to GOD and the following six Commandments, beginning with “Honor your father and mother” and ending with “You shall not covet your neighbor's property.” All religious faiths have some version of these rules which are the basis of civil behavior. Today, the following commandments are being violated by too many of our leaders: You shall not steal; kill (do no murder), be a false witness; and covet your neighbor's property.

Other teachings learned during religious studies were “be a good Samaritan practicing stewardship”, and “deal with others as you would have them deal with you.”

and why it matters for our Democracy's survival. She is of Philippine heritage and was appointed by Governor Jerry Brown. She is the embodiment of the diversity and of women's ability to be professional leaders.

The current investigations by Mueller reveals several instances wherein individuals were 'false witnesses' who communicated fabrications (lies, propaganda), but not what actually happened. An appointed Special Counsel Mueller will soon give his report to the U.S. Congress and American Public.

During her presentation a recurring theme was that 'face-to-face' communication is essential to learning about one another; to understanding the common issues being faced by all of us, and to establishment of the trust in each other essential to negotiations, understanding, acceptance, and compromises needed for the existence of a 'civil society'. She has organized 'groups of experts' in civics (can you believe over 2,000 of them?). These experts go to high schools and civic groups to communicate: 1) Why civics is important; 2) What are the basic rules one must know; and 3) Why it matters. I would add: 4) Why our judicial court system must always remain non-political and be reasonably underwritten (i.e., always have adequate budget support, even during State Budget shortfalls, because 'life in the community goes on even during recessions. All kinds of disputes and issues need to be addressed and resolved (adjudicated); receive due process all the time. All sorts of disputes, property rights, personal injuries, elder abuse, spousal abuse, etc. In addition, the entire court system's facilities must become totally updated with regard to digital communications systems, record systems, and possess an electronic capability to take the 'court's judicial proceedings to the people.

CA's Supreme Court's Chief Justice, Tani Gorre CantilSakauye was the featured speaker at the Rotary Club of San Jose. Her topic could not be more relevant: Restoring Civics and Civility,

My daughter, Mrs. Mary Morales Rustia, a bio-tech science teacher, asked the Chief Justice “What are you doing to deal with the 'School infractions which send youth to prisons

These standards of behavior, when practiced, result in having 'a civil society' wherein individuals, communities and nations may thrive. Today, it does not take much effort to find egregious violations of one or more of the above standards. Examples are: Bank officials who had employees establish accounts without authorization of the individual client involved. These accounts in great numbers inflated the 'market value of the firm'. When discovered by the Securities & Exchange Commission (SEC), the banking firm was fined millions of dollars, however not one of the banking officials involved ended up serving prison sentences 'for stealing' and 'false witness'. Auto firms have quietly found ways for their engineers to get around 'air pollution/emission' standards. And when discovered were fined millions of dollars. Again, no individual experienced 'legal due process' and was given a prison sentence.

(another pipeline)?” Mary was referred to an aide who provided contact information to those dealing with these issues. We, who are persons of color, need to become able to stand up and push back 'in our courts' because we are the victims who can best, from experience, formulate the questions, which lead to the research that resolves or mitigates the issue addressed. We know that there are many issues, but that is no reason to stand on the sidelines. CA has a very diverse population by any measure applied (social, economics, culture, and political ideology amongst other 'metrics'). Collectively ad in solidarity, our efforts result in having CA become the 5thlargest economy on this globe; we should not be governed and guided by Washington, D.C., but rather continue to be the leader the other 49 states check out to see where the cutting edge of 'change' is today. Our California Supreme Court Chief Justice, Tani Gorre Cantil-Sakauye is the first Asian-Filipino American and the second woman to serve as this State's Chief Justice. She has emerged as one of America's leading advocates for equal access to justice, transparency, and reform of state court funding models which unfairly impact the poor. It was a unique opportunity to see and listen to the current leader of California's Judicial Courts. Millennial youth of color would be well advised to learn their civics and use this woman as their role model. And to consider learning to become expert 'knowledge workers' in a field of their choice. Just consider the impact this woman has on improvements needed to create accessible justice in CA.

If you, or the gift recipient, doesn’t like the item or realizes it doesn’t fit, how long do you have to return it? What happens if your watch breaks or a stone on your ring comes loose? If the store advertises a “lifetime guarantee” policy, ask for the details. • Keep the receipt. Just in case something goes wrong, ask for and make sure to keep a receipt. You can also ask for a certificate of replacement cost or an appraisal listing the qualities of your gemstones or precious metals to accompany your receipt. bbb.org – you want to be able to make the best informed decision. If you’re considering a pawnbroker, make sure they have a “secondhand dealers” license with their local licensing agency. Take your time, and consider it a red flag if you’re being pressured to rush into a transaction. Get four or five estimates to determine the market value of your piece. • Be careful using a mail-away service. Understand all of the terms and conditions before you mail your jewelry. Take photos and make a list of your items and insure them before sending. Know how long it takes to receive an offer and how long you have to accept or reject that offer. It’s also important to track your packages. Keep all records of package notifications and shipping updates. • Know your worth. Keep in mind that jewelers and pawnbrokers intend to resell your piece. You may be able to make more by selling to the public, but it comes with additional risk. Don’t let your jewelry of different karat value be weighed together. Separate your jewelry by karat value before selling and be wary of dealers who weigh all jewelry together and pay you the lowest karat value. Ask the buyer what the melt value of your items is so you can make an informed decision. If you have an issue with a jewelry buyer or seller, your BBB is here to help. You can easily file a complaint online at bbb.org/complain. You can reach your BBB at info@bbbemail. org or (510) 844-2000, or by visiting bbb.org

• Compre alrededor. New cholesterol guidelines from the American Heart Association emphasize a personalized approach to preventing and treating high cholesterol and cardiovascular disease. What Cholesterol Is Cholesterol is a waxy substance that your body makes to build cells. Too much can pose a problem. Extra cholesterol comes from foods including meat, poultry, dairy and tropical oils. Why Cholesterol Matters Cholesterol can slowly build up in your arteries and form a thick, hard deposit that narrows them and makes them less flexible. If a blood clot blocks a narrowed artery, a heart attack or stroke can result. What To Do Ask your doctor such questions as: Q. What do cholesterol numbers mean? A. Studies suggest optimal cholesterol levels are about 150 mg/dL and about 100 mg/dL for low-density lipoprotein cholesterol (LDL-C). Levels in this range are linked to lower rates of heart disease and stroke. There’s no ideal target for LDL-C but “lower is better.” Assessment with a risk calculator helps your doctor determine your personal risk and treatment options. A coronary artery calcium test may also help with your assessment. Q. How can I lower my risk for heart disease? A. A healthy lifestyle is critical. Also, while

statins are still the first choice of medication for lowering cholesterol, new drugs are available for people who have had a heart attack or stroke and are at risk for another. Your doctor will monitor your progress.

CRITICS SPEAK OUT ON 9-YEAR ANNIVERSARY MANY HELPING HANDS FOR FEDERAL EMPLOYEES WORKING AT SILICON VALLEY’S AIRPORT OF CITIZEN’S UNITED DECISION Mineta San José International Airport

San Jose, Calif. – Mineta San Jose International Airport (SJC) teamed up with Second Harvest Food Bank (SHFB) today to distribute food and goods to federal employees working at SJC who are impacted by the partial government shutdown. SHFB distributed hearty produce and non-perishable foods, and SJC staff donated personal hygiene items to support up to 175 federal employees and their families. See photos here. Approximately 500 federal employees support SJC’s operation, with the Transportation Security Administration (TSA) employing 400 people while Customs and Border Protection (CBP) and the Federal Aviation Administration (FAA) each have 50 employees. These essential, highly-skilled employees continue to report for duty to serve SJC travelers and keep the Airport operating safely and securely despite not receiving a paycheck due to being furloughed, but required to be on the job.

Suzanne Potter California News Service SACRAMENTO, Calif. Goodgovernment groups are speaking out on this ninth anniversary of the Citizens United decision by the U.S. Supreme Court. In 2010, the court upheld the idea that corporations have the same rights as individuals, and that money they spend on political campaigns is a form of protected free speech. That opened the door for political action committees to take in millions without having to report the donors. Sheila Krumholz, executive director at the Center for Responsive Politics, said the current system means billionaires, corporations, unions and even foreign interests can secretly funnel money into elections. "The voters will not have critical information to help them judge the credibility of the messages that they're being barraged with," Krumholz said. "And of course, a candidate will know who to be beholden to." According to the website OpenSecrets.org, spending by outside groups not affiliated

with the candidates or campaigns rose from 9 percent in 2010 to about 22 percent in 2016. Another group, Move to Amend, backs a constitutional amendment to, in effect, reverse the Citizens United decision. So far, 19 state legislatures have passed resolutions in support of such a move, including California. But that's far short of the twothirds of states that would be necessary. The California Legislature did pass a bill in 2017 requiring greater disclosure of donors. Krumholz added some national groups are now making some of their donors public. "The growth in partially-disclosing groups was a big theme this past cycle, which is just as, if not more, troubling," she said. "Because these groups have the facade of transparency but, in the case of many of their biggest donors, we still don't know the original source of the money." According to a 2018 report from Issue One, which calls itself a "cross-partisan political reform group," political action committees that don't disclose all their donors spent more than $800 million on campaigns between 2010 and 2016. Just 15 groups spent 75 percent of that money - in most cases, to support conservative causes.

“Our federal employees continue to report for duty and are a key reason why SJC has continued to operate safely, securely and efficiently since the partial government shutdown began on Dec. 22, 2018, during the peak-travel holiday period,” said Judy Ross, Assistant Director of Aviation for Mineta San Jose International Airport. “It’s important that we collaborate with Second Harvest Food Bank and other community partners and demonstrate how much we care about our fellow employees, so they can feed their

“We’ve heard from a number of federal workers in the community who have been struggling during the shutdown, so we are pleased that San Jose is taking such a proactive stance to support its airport staff who are affected by the furlough,” said Leslie Bacho CEO of Second Harvest Food Bank. “We are pleased to partner with the San Jose Airport to provide healthy food and support to employees, and to make the process as easy and as welcoming as possible as they go through this challenging time.” Some 150 federal employees visited the distribution location at SJC’s loading dock today between noon and 3 p.m. They stocked up on boxed cereals and pastas, canned vegetables and fruits, fresh produce such as carrots, celery, onions, apples and oranges, and beans and frozen sauces. Toilet paper and feminine hygiene products were also available. Airport Department employees staffed the food and goods tables, while SHFB employees were on hand to coordinate the overall program and to register federal employees for the California state-funded CalFresh program and to educate workers on access to other resources. Anyone in need of food assistance or who would like to donate to Second Harvest Food Bank can get more information at SHFB.org. Furloughed workers or community members in need can also call Second Harvest’s multilingual hotline at 800-984-3663.

we’re smarter, we do it because we suspect that future generations are smarter than us. That they’re going to know more about the depletion of our resources than we will. More about the effects of climate change that we do.” District 2 Councilmember Sergio Jimenez let know the crowd in front of City Hall that the money from Measure T could be used to not only reinforce and protect the region but to buy out any land adjacent to it to expand the Coyote Valley public lands. “I’ve come to believe that when you protect and preserve our lands they protect us. It’s never about the money, but it always is about the money. So now, the landowners know that we’re not looking for handouts, if we come with money in tow, 50 million dollars supported by all the residents in San Jose. If you

JANUARY 25 - 31, 2019 combine that with other resources tied to other organizations I feel confident that the landowners can be made whole.” Mike Honda talked about the histor y of the land and the importance of protecting it as well. “ The name of Coyote Valley used to be Matalan, after wards the Spaniards came, and we called it Coyote. But the valley, no matter how you pronounce it is a corridor between the Santa Cruz Mountains and Diablo foothills for the wild life. We don’ t want to make Coyote Valley a constriction, but an expansive corridor for wildlife. So, all those things we have to do to understand so that we are multitasking for one purpose: preser ve and protect Coyote Valley.” Talks between the city and various organizations will continue for the following few months.

Arturo Hilario El Obser vador On Tuesday Januar y 22, 2019, just one day after Martin Luther King Jr. Day, supporters of the efforts to protect the Coyote Valley region of the city gathered at San Jose City Hall alongside local government figure who are also determined to invest into protections for the corridor that lies 20 miles south of downtown. After the November special elections and the passing of Measure T, which allocated $650 million in funds towards emergency preparedness and general repairs to infrastructure. Among the guest speakers at the rally just outside City Hall were Mayor Sam Liccardo, Councilmember Sergio Jimenez, Mike Honda and League of Women Voters’ First Vice President and Board Member Gloria Chun Hoo. Many of the speakers emphasized the determination and support for Measure T and a continuing goal of protecting and investing into the Coyote Valley. Chun Hoo remarked, “We supported significantly Measure T because of the commitment it made to saving Coyote Valley and the commitment and acknowledgment at that time

of both the economic and the environmental benefits of this Coyote Valley that is so important to us because it provides to us natural infrastructure - not only for the city of San Jose, but for the region.” According to the group putting on the rally, Protect Coyote Valley, there have been more than 5,000 signatures calling for protections for the land south of San Jose, which is a corridor connecting the Santa Cruz Mountains and the Diablo Range to the valley. Sam Liccardo recalled the histor y of previous stewards of the environment in San Jose, particularly Janet Gray Hayes, the mayor of San Jose from 1975 to 1983.

“It was under Janet Gray Hayes that San Joseans first understood that San Jose could be better, not necessarily bigger. It was [her] leadership that helped us begin the first steps to protecting open space and preventing development from sprawling.” Mayor Liccardo continued, “We don’ t do this because we think we’re smarter than anyone else, that is we don’t preser ve open space, protect our hillsides, protect beautiful natural environments like Coyote Valley because we think

“SOMETHING ROTTEN” THIS WAY COMES Actor Danny Lopez gives us the 4-1-1 on the funfilled, Shakespeare influenced Broadway show coming to San Jose January 29 – February 3

Doing it for four years, I think I’ve got the hang of things. I’m very used to living out of my suitcase, I don't mind the travel at all. Sometimes it can be a little hard on the body, traveling because we travel a lot by bus and it could be a little grueling traveling by bus for however many hours we’re on there. But I’ve gotten used to it, I don’t mind going from hotel to hotel. I like getting out there and seeing the world and seeing the cities because I’ve been on tour for so long I’ve pretty much been to every state in the country. The only one I have left is Hawaii. So hopefully I’m going to take a vacation there someday! Now, could you tell me a bit about the background of “Something Rotten!” and what’s going on in this story? “Something Rotten!” takes place during the renaissance, the 1590s, and there are these two writers, Nick and Nigel Bottom and they’re kind of in the shadow of Shakespeare, who is seen as kind of this Rockstar, a la Mick Jagger. One of the brothers, Nick, hires a soothsayer to find out what the next big thing in theater is going to be, and he tells him it’s musicals. So, the two brothers set out to write the first musical ever, and hilarity ensues. It’s so fun, so funny. The show is written so clever, and so smart, it’s pretty much, I think, like a love letter for Broadway. It’s such a good time and gut busting laughter.

Danny Lopez is a theater performer who hails from Stamford, Connecticut. Of Puerto Rican background, Lopez was born and raised in Stamford, about a 30-mile drive from the iconic Broadway area of New York City. Currently, he is on tour with one of Broadway’s newest and most acclaimed shows, “Something Rotten!”, as a dance captain and swing. Interestingly, his path to the stage is an unlikely one, as evident by his graphic design degree and schooling. While Lopez did pursue theater as a fun hobby while going to school, that hobby has now blossomed into his main focus. And what is “Something Rotten!”? It follows two brothers during the renaissance trying to write the first ever musical, after advice from a soothsayer telling them it’s the next big thing in entertainment. All the while they are trying to outdo a much more popular competitor in the arts - Shakespeare himself. With odes to the history of Broadway shows, the self-referential comedy driven production is something that’s actually not so rotten at all, according to Lopez. The following is a Q&A session with Lopez about the show, his own background in theater, and what moments are the most memorable this tour. Danny, could you give us a rundown of how it is you ended up pursuing theater? What was your inspiration? Growing up I was always a very shy kid, the thought of getting up and speaking to a group of people kind of terrified me. So, theater was never anything that was kind of on the horizon for me, but during high school and middle school one of my cousins was always involved in the school plays and musicals and I kind of liked watching the shows, I found them interesting and very entertaining. During my senior year of high school, she was involved in the high school musical revue, I wasn’t really involved in many after school activities or anything like that,

so I would go and sit in on her rehearsals from time to time. One of the cast members of the show kind of stopped showing up to rehearsals and one day they asked me if I could just fill in for that day and read some of the lines while they were going through it, and I did that, and then the director asked me if wanted to be in the show. I had never done a show before, I had never really sung anything, I had never danced, I had never done anything. So, this was all new territory for me, and I became part of the show. I was taught choreography which I picked up really well, and the choreographer started putting me in the front of the dance numbers and had me join the dance troupe at the high school. From then, that was the start of my love affair with theater. I started auditioning for community theater, going to New York City to take dance classes. I started taking voice lessons. All the while going to school for graphic design. Once I got my associates of graphic design I transferred to SUNY Purchase which is a huge school for arts, more so fine arts. While I was there I decided that I wanted to pursue acting and I started going out for it and then I started landing jobs regionally and it was great, I was having the time of my life. I kind of went back to graphic design after about three years, I was in a relationship and I kind of wanted a “normal” schedule, a normal life. I was kind of missing that part of things, so I left theater for about three years, I went back to graphic design, I had a job doing graphic design in New York. All the while, seeing all of my friends posting that they booked national tours, that they booked Broadway, booking this and that. I started to miss it a lot. So, I decided to leave graphic design once again and go back to performing. About a year later, I ended up booking the national tour of “Mamma Mia!”, which was probably the biggest thing that I had booked until then. I toured with them for four years, and I ended up getting this, a year after that, and now I’m on the road again. Do you feel like your well versed in the travel aspect now because of your previous experience with touring?

You are a swing and a dance captain for this production. Could you expand on what your day to day duties are and your roles on and off the stage? As a swing I cover eight of the ensemble members and I also cover one of the featured roles in the show. We also have another male swing who covers the eight ensemble members as well. Depending on who calls out, either one of us will jump in to those tracks in the show. It’s a very tough position to have, not everyone is built to swing a show. You have to kind of have the right mindset for it because you have to be able to mirror choreography, remember every track there is. There’re so many tracks in this show that are featured so you have to be able to just change your mindset and switch. It has to be like a switch in your brain to just go from one character to the next. We just had our female swing go on for three different characters, just back to back. When you find someone like that you hold onto them because they become kind of necessary and important. I swung for “Mamma Mia!” for four years so I kind of already had the swing of things, if you will, but in addition to knowing all of the tracks I’m also the dance captain, so I kind of have to know the entire show. I'm in charge of maintaining the

choreography while the choreographer is not there, like the eyes of the choreographer, while we’re on the road. I help teach understudy rehearsals, so I teach all of the understudies all of the choreography for the parts that they cover. It’s a daunting job, but it’s a lot of fun and it definitely keeps me on my toes. What would you say is your favorite performance or moment in the show? Without a doubt that would be the number called “A Musical”, that one has a lot of different references to Broadway and it’s a very big production number and at the end of that number we always get lots of applause. There’s so much laughter, so much energy, so much excitement on stage, there’s nothing like that. At the end of that number you feel like you’re a Rockstar. Like if people came to see Beyoncé. Sometimes that’s the type of reaction we get after that number. It’s incredible. Even just watching that from the wings, seeing the faces light up on the cast members because they see how happy and excited the audience is, there’s definitely nothing like it. You don’t have to get musical theater to get those references. You’ll get the jokes because it touches on big staple moments in those big staple musicals that everyone knows, that have become part of pop culture. Okay my last question: Do you have any memorable stories of being on tour thus far you could share? On this tour probably one of my favorite moments was I had to swing on for one of the tracks, one of the leads called out so one of the ensemble members as his understudy has to go in for that role and I went on for that ensemble member. I had pretty much lost my voice, so I went on for one of the feature roles as [a] judge in act II. The only way that I could speak was with a very deep, deep sounding voice because I had nothing in my upper register. I tried to warn some of the cast members to let them know this was the type of sound I was going to be using on stage that day. Unfortunately, that wasn’t enough to keep them from kind of laughing a little bit on stage. It just became something that we’re always going to remember. People still talk about it to this day. Its live theater, things happen all the time, and that just happens to be one of the moments that I think we’re never going to forget. And they always remind me, “We want that judge to come back to the show, it was so much fun!” “Something Rotten!” takes place at the San Jose Center for the Performing Arts January 29 – February 3, 2019. IMMIGRATION GROUPS PRESS FOR FULL REFORM AS SENATE VOTES ON SHUTDOWN, DACA

Suzanne Potter California News Service SACRAMENTO, Calif. - Groups that advocate for the socalled Dreamers are pushing for comprehensive immigration reform as the U.S. Senate is set to vote Thursday on President Donald Trump's plan to reopen the government with funds for a border wall and a concession on DACA tacked on. His plan includes three years of protection from deportation for the Dreamers and for people with temporary protected status. Nicole Svajlenka, a policy analyst at the Center for American Progress, says that proposal is a nonstarter. "It's obvious that Trump ended DACA in September of 2017, and the offer that is on the table now is just a three-year extension," she points out. "It is nothing akin to a path to citizenship or a permanent protection for Dreamers."

Earlier this week, the U.S. Supreme Court rejected the administration's request to fast-track an appeal of a case that questions his decision to terminate the DACA program.

However, the high court could take the case in its next term, which begins in October.

Svajlenka says that means anyone who is eligible to renew his or her DACA should get it done as soon as possible. She worries that people will hesitate - afraid the government might use Dreamers' contact information to round them up if the program comes to an end.

SALUDABLE POR LA GENTE, DE LA GENTE

"You know, there's just so much confusion going on that people could choose not to renew their DACA," Svajlenka states. "Why would people want to provide updated information to a government that is actively trying to shut this program down?

There are 200,000 Deferred Action for Childhood Arrivals recipients in California.

"So people are rightfully fearful of providing that information of themselves to the federal government right now."

Statistics show that since a court restarted renewals in January of last year, nationwide 323,000 Dreamers applied to renew their status, and

On Tuesday, 19 senators, including , cosponsored a bill to keep Dreamers' addresses and telephone numbers confidential.
