From the President Ant Smit
A
fter more than 20 years living in Canterbury, I now get a pretty good view of the Auckland Harbour Bridge from my vehicle most days. Creeping past the temporary strut that was installed in just a few days, caused me to reflect on the importance of having and maintaining the ability within New Zealand to build and repair our critical infrastructure. The temporary repair that I drive past used steel provided, probably overnight by a Taranaki-based specialist steel pipe supplier. It was then fabricated by highly-skilled engineers in South Auckland in order to answer a mayday call from Waka Kotahi New Zealand Transport Agency. From what I saw, HIANZ members also played an essential part in providing access equipment, lighting and probably more, to allow at least the temporary repair work to be completed within a few days. As I write this, Culham Engineering in Whangarei, are working on a permanent replacement strut for the bridge. We should be grateful that we have the trained engineers and expert fabricators available here in New Zealand to undertake this work. There are parallels for hire companies – making sure that your business and our industry are resilient is more important now than ever. Having the right skillset amongst your people to provide that ability to respond is a large part of being prepared for a changing economy and environment. Those skills don’t always “arrive” with people joining our industry, and as owners we need to make sure that we provide opportunities for training and developing our own. That approach will be good for your business, our industry and ultimately for our country. I’ve enjoyed talking with a range of our members across the country over the last month. There’s no doubt that those relying on the Events industry have had their revenues negatively impacted by Covid19 restrictions,
even with some work, aligned to facilities for primary industries as well as testing/isolation facilities. Our thoughts are with those members, their staff and families. The equipment rental sector however has reason for cautious optimism as a commitment to improving infrastructure across New Zealand seems to be a common theme from all political parties leading up to the election. The real challenge and reward for HIANZ members is in growing hire penetration, or the size of the pie, across all construction sites. With an amount of uncertainty still being felt amongst many of those in construction, there may well be opportunity to increase the prevalence of hiring across these sectors. Despite what has been a tough year so far, it remains an exciting time to be in the hire industry. Lastly – I hope that some of you will find time to meet in Taupo on the 4th of November to swing a golf club and perhaps enjoy refreshment afterwards as members take the opportunity to attend one of the few social functions this year. ■ Best Regards. JLG NZ – SERVICE COVERAGE FROM NORTH TO SOUTH
Having a broad range of tough, reliable and technologicallyadvanced equipment to suit the application, is just one component of being able to properly support clients – just as important though, is the ability to provide a high level of after sale service and support.
A
s a leading distributor of Elevated Work Platforms (EWPs) including boom lifts, scissor lifts, vertical lifts, compact crawler booms and low level access, JLG New Zealand recognises that supporting its machines is also a priority. While the JLG branch is based in Mt Wellington, Auckland, where it provides new machine sales, spare parts stock and houses its main workshop, the company has technicians located in major centres throughout the North and South islands, offering coverage to most regions at short notice. The company’s breadth of service and maintenance coverage is facilitated by four Auckland-based technicians, a technician in Wellington, two in Christchurch and one in Central Otago to service the lower half of the South Island. JLG New Zealand Branch Manager, Brian Lund, said that the company’s ability to mobilise technicians to all parts of the country gave JLG equipment customers added peace of mind. “For most of our customers there’s much greater convenience in having their equipment serviced on the job site or at their local depot because there’s less interruption to workflow,” Brian said. “Similarly, we understand that an unforeseen issue could result in

downtime and in a worst case scenario, bring a job to a grinding halt, and this costs money, so it’s reassuring for customers to know that we can dispatch a local technician at short notice to rectify any issues.” Renewed focus on the lower South Island Based in Cromwell in the Central Otago region, JLG team member, Hamish McMurtrie, is an extremely experienced CBIP-accredited technician who prides himself on going to all lengths to assist JLG customers in the area. Hamish’s location sees him wellplaced to service JLG equipment in Cromwell, Wanaka, Queenstown, Dunedin, Gore and Invercargill and sees him working in not only some of the most picturesque regions of New Zealand, but also in some of the most demanding conditions from snow and sleet to high temperatures to support customers. As one of the only permanently based CBIP-accredited technicians in the Otago region, Hamish works to undertake operators’ required EWP six monthly certifications, three monthly routine inspections as well as annual servicing and repairs, ensuring operator safety and machine reliability for JLG customers. A qualified light vehicle technician and experienced auto electrician,
Hamish has worked in the access industry for the past seven years including the last two years with JLG New Zealand, where he has completed a number of product specific training courses on JLG product lines. Hamish also has experience maintaining, diagnosing faults, servicing and repairing other manufacturer machines, which is convenient for customers who operate a variety of machine brands. Being somewhat of a local having spent most of his younger years in Dunedin before moving to Auckland and then Christchurch, Hamish is very familiar with the area and the needs of JLG customers; he’s also a regular participant in motorsport activities in Central Otago. O
ur annual HIANZ networking event recently took place at the beautiful Wairakei Resort in Taupo, offering great facilities amidst the forested slopes of the Wairakei Thermal Valley. Our HIANZ Golf Day took on a new form this year, with the introduction of an option to go Mountain Biking. Some even took the opportunity to truly relax and make use of the hot pools and spa facilities.
The Golfers took on the 9-hole golf course in a social game of Ambrose Style Golf, with the support of Honda and Hansa, who kept our golfers well hydrated by offering “refreshments” on course in a Honda SBS. The Mountain bikers returned to join the Golfers at Wairakei Resort for some much needed “refreshments” provided by Hansa and Honda. These were enjoyed whilst seeing a

The weather was on our side, and we enjoyed a sunny afternoon of golfing and mountain biking. The group of e-bikers and mountain bikers headed off on a scenic loop of fun on a winding, single track, alongside the Waikato River stopping off at viewpoints to take in the aquamarine waters of the Huka Falls and the geothermal streams. The evening started off with a Cocktail Hour “With a Twist” sponsored by Masport. Mixologist Jules demonstrated how to whip up a couple of our favourite cocktails and gave us tips for the best results, before challenging teams of 5 to get creative by concocting their own versions of these classic cocktails. Bryce Swainson, who took part in and won this challenge, walked away with a brand new Masport pressure washer. This was followed by an indulgent dinner before moving onto the Resort Pub for some late-night networking. HIANZ ELECTS NEW PRESIDENT
T
he Hire Industry Association of New Zealand Inc. (HIANZ) has a new President. Antony Smit who is currently the Chief Operating Officer of Hirepool was unanimously voted to the position at a board meeting following the associations AGM. He succeeds Tim Mikkelsen who has stood down as President following 12 years in the role. During his term Tim oversaw rapid growth and changes to the governance of the organisation which is now recognised as one of the strongest industry lobby groups in New Zealand. Tim’s experience and knowledge will not be lost to the hire industry and he will continue to consult to the board in a Past President role.

Ant Smit has an extensive background and brings together more than 20 years of experience in the hire industry including 10 years as Hirepool’s Southern Regional Manager and prior to that experience in the Event Hire industry in the UK and New Zealand.
He has a B.Com majoring in Supply Chain Management from Lincoln University. Ant takes on the position of President following several years of serving on the HIANZ board. Ant is considered a strong leader and is well regarded by competitors, suppliers, and customers alike, qualities that will assist Ant well in his tenure as HIANZ President. Ant takes up the role immediately in conjunction with his senior executive position at Hirepool. ■

WHEN SIZE MATTERS In response to customer demand for a narrower width machine, Snorkel produced two models that created a full line of scissor lifts

For sensitive surfaces or indoor work, non-marking tires leave no trace or marks. Proportional joystick controls and a tight inside turning radius of 2.5m provide excellent manoeuvrability. For more platform space and added reach over low level obstacles, the lift includes a 1.2m (3 ft. 11 in.) roll-out deck extension. HIANZ ESDS SHEET UPDATES HIANZ CEO, Rodney Grant gives his thought on the benefits of the ESDS project and makes a case for why the Equipment Safety Data Sheets should now an essential part of your business.
I
met with a member last week and got talking about the HIANZ ESDS sheets available to them. They responded, “Why do I want to use those?”. I was unsympathetic towards his inability to protect himself, his business and his client from harm, so he got both barrels! Well, that is how it played out in my mind for a very split second. I have learnt a lot in the 6 months so far in my new role, diplomacy is required at all times even in the face of uneducated foolishness. (that is enough of the member blasphemy)

The sheets have taken a team of industry players some time to put together to make sure all bases are covered. We have even reviewed and updated a couple of forms. Putting these together by yourself or using a contractor would be a slow and costly exercise. ESDS sheets provide generic safety information that is enough to cover all the individual brands on equipment types used in the industry. They provide excellent safety controls like PPE to use, exclusion zones and easily identifiable hazards and controls for those hazards. Nothing too heavy, not too light, enough to make your job is easier.

Print these forms off and give them to the hirer when they sign the contract. Even better, put a note on your hire contract saying the hirers signature acknowledges they have been given adequate instruction on safe use of the equipment and where available, an ESDS sheet has been supplied also.
This raises a very good point and an improvement that HIANZ needs to do. We need to assist our members better to understand the fancy acronyms and increased customer safety we promote.

HUMAN RESOURCES UPDATES WHAT YOU NEED TO KNOW
P
RIVACY ACT 2020: Parliament recently passed the Privacy Act 2020. This new Act will replace the current Privacy Act 1993 and will come into effect on 1 December 2020. The Privacy Commissioner has announced that the “new Privacy Act provides a modernised framework to better protect New Zealanders’ privacy rights in today’s environment”. The key reforms in the Privacy Act 2020 include: • Mandatory notification of harmful privacy breaches to both the Privacy Commissioner and affected parties. • The introduction of compliance orders, which will enable the Privacy Commissioner to require compliance with the Privacy Act. Failure to comply with a compliance order could result in a fine of up to $10,000. • Access determinations, which will give the Privacy Commissioner the power to demand release of information if any organisation or business refuses to make personal information available on request. • Controls on the disclosure of information overseas. These will require that, before disclosing personal information overseas, New Zealand organisations or businesses will need to ensure the overseas entities have similar levels of privacy protection to those in New Zealand. • New criminal offences which will make it an offence to mislead an organisation or business in a way that affects someone’s personal information or to destroy personal information if a request has been made for it. Maximum fines will be $10,000 per offence. • Requirement for compliance with the Privacy Act 2020 by international platforms. This will mean that if an international platform is carrying on business in New Zealand, with New Zealanders’ personal information, they will have to comply with the Privacy Act regardless of where they, or their servers, are based.

• Breach of privacy claims can already (ie under the Privacy Act 1993) result in significantly high awards of damages if they are successfully taken to a hearing before the Human Rights Review Tribunal. Under the Privacy Act 2020, damages will be able to be awarded for: • Pecuniary loss suffered; • Expenses reasonably incurred; • Loss of any benefit, whether or not of a monetary kind; • Humiliation, loss of dignity, and injury to the feelings of the aggrieved individual. We expect that breach of privacy claims will continue to be a risk for an employer or previous employer and with the strengthening of the new Privacy Act 2020, may even become a greater risk. A breach of privacy issue we commonly encounter is a previous employer talking to third parties or giving verbal references about an employee or former employee. You cannot do so unless you have been expressly permitted to do so by the employee concerned. This is the case even if you are phoned out of the blue by a prospective employer. If you have not been permitted to speak to that prospective employer, then you must decline to do so on the basis you do not have the employee’s permission. PROOF OF SICKNESS OR INJURY We regularly receive questions from employers about the ability to request a medical certificate from an employee who is absent from work due to claimed sickness or injury. Under section 68 of the Holidays Act 2003, an employer may require an employer to provide proof of sickness or injury in relation to a claim for paid sick leave in the following circumstances: 01. If the sickness of injury is for a period of 3 or more consecutive calendar days (whether or not the days would otherwise be working days for the employee), the employer can require that the proof be provided at the employee’s cost; Note: an employee claiming paid
02. sick leave for a Friday and following Monday can be required to provide proof of the sickness or injury; 03. If the sickness or injury is for a period of less than 3 consecutive calendar days, the employer can require that the proof be provided at the employer’s cost as long as the employer informs the employee as early as possible that proof is required. The above applies even if the sick leave is being claimed due to the employee not working as a result of a spouse/partner or dependent of the employee being sick or injured. In either case, the employer cannot specify who the proof is to be obtained from. Section 68 does not prevent an employer from requiring an employee to provide medical information or to see a medical practitioner of the employer’s choice in certain circumstances if the employee’s employment agreement includes such clauses, or if there are applicable health and safety or medical fitness for work considerations. Dealing with medical issues in employment is becoming increasingly tricky as there is almost always the potential for conflict and competing considerations due to: • The unlawfulness of discriminating on the basis of an employee’s disability (which includes mental or physical illness or impairment) under the Human Rights Act 1993; and • Health and safety considerations; and • Medical fitness for work issues. • If in doubt, we recommend you seek legal advice.

Aaron is already well versed in the Polyjohn range including a good working knowledge of the different models of portable toilets, Polyjohn portable showers, wheelchair accessible toilets, multi station men’s urinals, hand wash stations and the associated cleaning and deodorising treatments.
Aaron graduated from Massey University with a Business degree and has previously held positions in customer service orientated roles. He intends to immediately embark on an extended road trip in the new year and meet the many existing and potential Polyjohn customers throughout the country. Aaron believes in this day and age of faceless electronic communication it is important to be able to ‘put a face to a name’. ecently the NZFIA CEO has been in discussions with Competenz, looking at possible involvement in the management of forklift training not unlike how HIANZ manages Silvercard EWP Trainers and the programme. This is a major step forward for the association and will give the association the boost that it needs. The current system through Competenz lacks moderation and trainee data management for applying a refresher system like the Silvercard programme.
It is the view of the association that the forklift training needs strengthening in credibility and a pathway to proper learning and refreshment of competency. We feel industry is best to manage this and as the peak body for forklifts, we are in the best position to manage it. The NZFIA AGM has suffered at the hands of COVID twice now and has recently gone electronic in its requirement to hold it. An election buddy process has been adopted and an expected close of the AGM is mid-November. Nothing too much is in their

TRIBUTES TO OUR HIRE HEROES It was very remiss of me to leave out the story of Bruce Harrison passing in our last edition of the Hire and Rental magazine We also lost Graeme Riddler recently. Both past members contributed heavily to the industry and made our association what it is today
BRUCE HARRISON Bruce Harrison passed away on the 21st April after a long battle with cancer. Bruce started Hire Master Whanganui in July 1975 and has had a long association with the hire industry. He attended the inaugural meeting hire meeting in New Plymouth along with my father in 1978. His son Grant and daughter in law Kareen now own and operate the business in Wanganui. As a family we have had a long association with the Harrisons as we lived in Palmerston North and would regularly see Bruce and Anne at the zone meetings in Palmerston North. Bruce was one of life’s good buggers and called a spade a spade. He was also a very caring and compassionate man. For 12 years Bruce was part of a volunteer group in Whanganui who would give selflessly of his time and vehicle to ferry cancer patients to Palmerston North and Wellington hospitals for treatment. A few years ago, I attended, along with other invited industry members the black-tie gala dinner celebrating the 40th anniversary of Hire Master Whanganui. This event was attended by hundreds of local and national guests along with friends of the Harrison family such was the respect that Bruce had gained with business associates, industry colleagues and Whanganui locals over the years.

Bruce’s honesty and integrity will always be his greatest strength and he will be sadly missed. Bruce is survived by his wife Anne, sons Grant and John, daughter in law Kareen and his 6 adoring grandchildren. Tim Mikkelsen, Life Member, HIANZ
GRAEME RIDLER Another one of our legends, Graeme Ridler passed away recently after a lengthy battle with cancer. Graeme and Accent Tools have had a long standing and very supportive relationship with HIANZ over many years. Graeme was a supplier representative on the board during our period of turmoil and encouraged the board and CEO to take a business-like approach to running the association. He was a strong and hard-working member of the board and contributed well with his experience of running a successful business. Tim Mikkelsen tells me that his no-nonsense approach, along with his business acumen and a keen eye on cash flow had a very positive influence to the Board at that time. Graeme was awarded an honorary membership to the HIANZ by Bruce Wallace at the 40th anniversary of the association in Rotorua during 2018. HOW THE CREDIT CONTRACTS AND CONSUMER FINANCE ACT AFFECTS THE HIRE INDUSTRY By Geoff Hardy of Auckland law firm Martelli McKegg
I
have mentioned before that the hire industry is remarkably unregulated and free of any specific laws that govern the industry. There is no “Hire Act” or anything like that. You are, of course, bound by the general laws that all businesses are subject to like the Fair Trading Act, the Commerce Act, the Consumer Guarantees Act, the Employment Relations Act, the Companies Act, etc. And there are a couple of Acts of Parliament that do single you out – the Health and Safety at Work Act (which has rules that particularly relate to the hire industry) and the Personal Property Securities Act (which encourages you to register all hires for more than 12 months on the Personal Property Securities Register). But there is one more statute that might occasionally have unintended consequences for you, and that is the Credit Contracts and Consumer Finance Act 2003 (the “CCCFA”). What is the CCCFA all about? Well sometimes the less sophisticated borrowers within our society get taken for a ride by unscrupulous loan sharks and back alley finance companies. Or sometimes they simply get into trouble through their own lack of discipline and unfamiliarity with financial matters. So this Act is designed to protect them. Why should that be relevant to the hire industry? After all, you don’t typically lend money. However, what you frequently do is hire out goods to consumers, and you hire them out on the basis that they pay for those

goods some time after they receive them. That in itself is not a problem because most of the provisions of the CCCFA will only apply to you if your hire contract is a “consumer lease”, or a “consumer credit contract”. But while the criteria for becoming one of those are quite narrow, they can occasionally catch you out.
...the hirer has the right to apply to the courts to review the terms of the hire contract if they are considered to be “oppressive”. Consumer leases Let’s start with a consumer lease. A “lease” means a contract for the hire of goods. But the CCCFA is intended to protect consumers, so your customers only qualify for protection if they are human beings (not a company) and the hire is for personal, domestic or household purposes. Next, you must be in the business of leasing goods, and the term of the lease must be for one year or more, or your customer must have an option to purchase the goods (which is commonly known as hire purchase). Not many of your hires are going to meet those criteria. Nevertheless there will be some situations where you hire out a marquee, a campervan, a car, a digger, a minor dwelling or a portable cabin to human beings for their personal
use, on a long-term basis. If so, you’ve got yourself a consumer lease. That has four implications for you. First, you have to make a whole lot of mandatory disclosures to your customer at three different times – before you enter into the hire, whenever you change the terms of the hire, and whenever the hirer asks for specific information. Second, there is a limit to how much you can charge your customer if they want to terminate the lease early. Third, you can’t unreasonably require the hirer to take out credit-related insurance, an extended warranty or a repayment waiver. And finally, the hirer has the right to apply to the courts to review the terms of the hire contract if they are considered to be “oppressive”. Before you enter into the consumer lease you have to provide a statement telling the hirer that the hire is a consumer lease under the CCCFA. The statement has to say who you are, how long the hire is for, the cash price of the hired goods, whether the hirer has an option to purchase, and if so for how much. You also need to disclose the amount, timing and number of payments the hirer has to make, how much is payable by way of deposit, the total amount the hirer will pay over the term of the hire, what rights the hirer has to prematurely end the hire and what they must pay in that situation, what add-on services the hirer is paying for, and any default fees, charges or enforcement costs that the hirer may have to pay if they breach the hire terms.

Consumer Credit Contracts However it gets much worse if your hire contract is a consumer credit contract instead of a consumer lease. It will be a consumer credit contract if your customers are human beings, they hire the goods for personal, domestic or household purposes, you are in the business of hiring out goods, and either: the amount payable by the customer is the same or more than the “cash price of the goods” or the customer has an option to purchase the goods for way less than their fair market value.The cash price of the goods is defined as the lowest price at which a person could have purchased them from you on the basis of payment in full at the time the hire contract was made, or if there is no such price, the fair market value of those goods at the time the contract was made. This is basically aimed at hire purchase arrangements, but it’s not essential that the hirer has a right to purchase the goods. And there will be many situations where you hire something to a consumer long term, and the total amount they pay in rental will be equivalent to or more than what they could have bought the item for. In those situations you need to observe the following rules.
The disclosure requirements for consumer credit contracts are similar to but more extensive than the consumer lease requirements. Like the consumer lease requirements there is a limit to how much you can charge your customer if they want to terminate the lease early, you can’t unreasonably require the hirer to take out certain add-on products or services, and the hirer has the right to apply to the courts to review the terms of the hire contract if they are considered to be “oppressive”. There are also limits on what interest and fees you can charge, and the hirer has both a “cooling off period” at the outset when they can change their mind, and a right to prematurely bring the hire contract to an end. The hirer can also ask you for temporary relief or relaxation of the contract terms if they suffer an unexpected hardship and are up to date with their payments.
Personal Property Securities Act, you are deemed to hold a security interest in your own goods if you hire them out for an indefinite period of for more than 12 months. Finally, the Financial Service Providers (Registration and Dispute Resolution) Act 2008 also applies to your long-term consumer hire, and that Act (among other things) requires you to register as a financial service provider and join an approved dispute-resolution service.

But wait, there’s more. There are important restrictions on your ability to repossess consumer goods under your consumer credit contract. These apply whenever your contract gives you the right to repossess consumer goods over which you hold a “security interest” or your contract gives you the right to enter premises for any purpose in connection with that security interest. And guess what? Under the

EWPA NEWS Recently the EWPA held it’s AGM by both virtual meeting and electronic voting. The association had a good turnout all things considered. Some of the key points that came out of the AGM were: • Adoption of a EWPA run Trade day. • Moving annual subscription date to 1 April each year to align with the association financial year • Moving AGM date to align with the Trade day
EWPA Registered Inspector Programme The EWPA has a programme in place currently but is doing a major overhaul on it, in an effort to seek approval to be able to register, monitor and audit level 1 inspectors. The current overhaul is in its final stages and is entering the sensitive stage of finding it’s place in the market.
EWPA Trade Day The inaugural Trade Day is going to be held on Wednesday the 17th February 2021 at Hampton Downs Raceway, just south of Auckland and just north of Hamilton. This is a day for OEM’s and distributors, including servicing companies and related products and services to exhibit and promote themselves to EWPA members and EWP users. The day will be open to anyone to attend for a cost yet to be confirmed. Attendees not only get to see the latest and greatest at the trade show but get an all-day lunch and the chance to compete for a special trophy and prize if they are the fastest at the Go Karts (one free attempt). This should be a great day and allow construction companies, tradies and

hire companies to meet with the specialists in EWP’s. The EWPA AGM will also be run at the same time as the Trade Day. Furthermore, an after party is still in the planning back in Auckland for all attendees later in the evening. More to follow on this in the coming month. ■
There has been widespread concern and aggravation in regards to the current inspector programme, more around the prerequisites and delays in getting applications through. This is out the hands of the EWPA but our upgraded programme may be able to offer not only an alternative process but certainly a smoother one. As mentioned, this is entering a sensitive stage of the development and we ask that you bear with us as we push ahead. cbip There is a special meeting being held in Auckland on the 25th November (probably at the time of this magazine going to print). This meeting will be to discuss ways to improve quality of applications for certification, applicants’ behaviours when communicating with CBIP Business and administrations staff, reluctance to abide by CBIP guidelines, and the future of CBIP and the rapidly changing needs of the inspection industry. EWPA will have the CEO and a board member at the meeting and will be voicing the concerns of our members and that of HIANZ also. More dedicated communications will follow together with the RI programme subjects in the near future. ■

SILVERCARD CHANGES Recently the association updated the branding of the Silvercard EWP Training programme. A new design for the card has been introduced and the associated branding is flowing into the printed material and the website.

his new punchy design is about standing out and building the “Silvercard” brand up as a first choice, highly recognised competency training programme available in the market.
The “E” in the Silvercard word represents the rising up in EWP’s, whilst the image is more defined as an EWP. The “Using Elevating Work Platform Safely” booklet front cover has adopted the new branding but the original darker logo is still on the back cover. You will see an increased marketing presence on the “Silvercard” branding in the near future, with the HIANZ branding reducing. The
single strong brand for competency operators won’t be diluted or confused having two strong brands. HIANZ continues to own, support and manage Silvercard training though. Some of the increased marketing is just rolling out with the Board authorising a HIANZ member training subsidy on Silvercard EWP Training. An email rolled out on the 15th October explaining this. CARLTON INVESTS IN MARQUEE FABRIC CLEANING MACHINE
W
ith the continued investment in these skins, it is important that after each hire they are cleaned and dried to ensure they have longevity in the asset base of any business. One of the problems faced is how to clean and dry large fabric pieces in a small area. Auckland based company Carlton Events Ltd has made significant investment in fabric purchases in recent years and in 2017 started looking into the options of an updated automated fabric cleaning system. Although they already owned a cleaning machine, the outdated technology did not allow for large quantities to be washed in a short amount of time, nor did it have the ability to dry. Turning over large volumes of fabric quickly is essential in peak periods, but drying is crucial when storing fabric over quieter periods. Manager Andrew Armstrong says “anyone in the marquee hire sector knows that rolling stock quickly and efficiently in the summer months is essential” he continues “keeping our costs as low as possible, whilst providing quality products and sharp efficient service is an absolute key component to our profitability”. After a lengthy analysis of different

machine types, Carlton Events invested in a UK made machine capable of washing and drying large volumes of fabric quickly. Running at its peak the machine can wash and dry a marquee roof at approximately 2 minutes per lineal metre. Compare this to previous models or hand washing and it is easy to see efficiencies. Andrew says “there are a few machines on the market worldwide, however we selected this model due to its ability to wash quickly and efficiently, whilst being simple to operate. The machine not only had to fit our wash criteria, but impact minimally on the environment. We did not want a water and energy hungry machine or something that used hard chemicals”. Health and Safety management is a huge part of any business and being
able to operate the machine with basic training is something Carlton looked at. All critical moving parts are enclosed within the machine so there is minimal risk to the operator. In the last 3 years Carlton Events has increased its fabric replacement program and this would not have been viable without the ability to maintain it properly. A noticeable improvement to quality has also been noticed by clients. “The feedback has been noticeable” says Andrew “we now have the option of weeding out old or defunct stock and can be selective of how we manage client expectations” Carlton Events also washes fabric for other companies. The fabric is cleaned, dried, folded and packaged ready for collection.

SMART MACHINERY SMART MANAGEMENT The very nature of hire and rental means hundreds of thousands of dollars’ worth of equipment is spread throughout a range of work sites across an entire region or even further. It is imperative to keep track of this gear – both for the hire company and the firm that is using it – and the most effective way to do this is digitally.
T
he technology that enables equipment tracking and monitoring utilises GPS and IoT (Internet of Things), delivered by providers such as Spark. Simply put, IoT is the connection of many different items, including machinery and vehicles, via lowpowered cellular networks, allowing them to be controlled remotely or communicate information back to the user. Over the past few years, Spark has been working on developing this side of its business, pairing with various providers globally to enable IoT technology to be utilised by many different companies. Consequentially, IoT is transforming businesses all over New Zealand. Spark says, by combining IoT with automated systems, businesses can now gather and analyse data like never before, enabling them to reduce costs, improve health and safety, save time on monitoring and reporting, and increase efficiency and return on investment. Almost anything can be transformed into an IoT device, from coffee machines to 300 tonne diggers – all that is needed is a tracker or sensor to be fitted to the item you want information from. Spark has partnered with Digital Matter, global experts when it comes to designing building and delivering GPS devices and IoT solutions for a wide range of applications. Digital Matter’s range includes batterypowered equipment trackers that can be installed on equipment of all shapes and sizes, regardless of manufacturer. For heavier machinery, hardwired devices with more advanced features can be installed.

The beauty of this technology is, however, that IoT can be used to do much more than simply track where a piece of equipment is. You can also see who is using it, how they’re using it, and if it is being used as agreed upon. This information is useful to both the hire company and the business using the equipment. It can ensure the machine is being utilised to its full potential, that it is being serviced regularly and maintained properly. The devices can also track each operator’s working hours – helpful for both health and safety as well as payroll purposes. Some devices even have the ability to remotely and safely immobilise an expensive piece of equipment, a crucial and very helpful tool to fight against theft and vandalism. This feature also enables a hire company to ensure a machine is not being used by a client when they’re not paying for it. For example, a major hire firm has fitted Digital Matter’s G62 hardwired GPS on its excavators in New Zealand and Australia to capture location and utilisation data. The device has an internal battery to ensure it continues to connect in the case of loss of power or tampering, and a number of customisable inputs and outputs that enable remote immobilisation, fuel level monitoring, driver ID, and more. On non-powered equipment, such as rollers, the hire company began using the Oyster2 battery-powered GPS. The small and concealable device monitors an asset’s location and run hours, among other things, and this data ensures an accurate record of use is achieved. Spark says these ‘plug-and-play’
devices can easily be attached and removed from both large and small pieces of equipment. This no-fuss installation makes good sense for rental companies who don’t want or cannot physically wire devices into their rental fleet but still want to be able to track and manage their assets. If the machine moves without approval – in the case of theft or unauthorised use – the tracker will send an alert to the relevant person with the vehicle’s details and location, and they are then able to immediately disable the machine remotely. The trackers also improve stolen vehicle recovery rates, and machines with remote immobilisers may be eligible for lower insurance rates. Spark technology lead Renee Mateparae says IoT is ideal for asset management, and thanks to Spark’s network of global partners, it can provide the right IoT solution for your business. “We have invested heavily in this area, and this has meant we work closely with the industries that could benefit most from it. “On-site construction equipment can be extremely expensive and in high demand, so this technology is ideal to track and manage it. Also, construction machinery use often needs to be recorded for compliance and health and safety reasons. “A number of our clients, such as NZ Strong and Mainfreight, are already using this technology to monitor their trucks and machines.” IoT makes asset tracking and fleet management easy, but also offers a world of opportunity for savvy business owners, as well as a more productive and sustainable future. ■

Texada Software announces the launch of Texada Pay, a fully integrated payment processing platform in Australia and New Zealand.

exada Pay provides Texada’s rental and asset management software customers the ability to process credit cards and direct bank debit payments within their applications, including Texada’s e-commerce store and Customer Portal solution, called Gateway. Texada Pay also offers the ability to properly store credit cards and direct bank debit information so that customers can easily collect payments for cycle-billed rental transactions. HIANZ Reports On The Current PPSR Situation The push from HIANZ to get changes to the PPSA (Personal Property Securities Act 1999) to exclude hire from a requirement to use the register (PPSR) has been a long-winded affair...
A
s with most lobbying and advocacy work, there are many hoops to jump, many minds to win over and many scenario’s that need to play out to get the desired outcome. The change to the PPSA is no different. We are happy to report that we are still making headway and as recent as late October, took a major step forward on getting the requirement for Hire to use the PPSR. There is still a lot of work to do and it may not play out exactly how we want it but it is good progress. Recent discussions had us looking at a few different options. 01. We have an agreement to move the requirement for using the PPSR out to two years from the current one year as described in section 16 of the act. 02. We are investigating a fair an true separated definition of “Hire” from “Lease”. If we can get this clearly drawn up and agreed by many interested parties, we can then have the requirement of “Hire” to be removed from the requirements of the act. Currently we fall into this definition in the act:

03. We have in parallel to the above, Government looking at the options of running a separate register for HIANZ Hire Companies which will in effect be your asset list. This would be something that you manage (once when you add an asset and once when you dispose of the asset) and this register will take priority over the main register. The only sticking point on this is getting the financial sector’s approval and giving them the security they need on the asset against you if you are financing it. This option will take a bit of work. In the mean-time though, it is important that “hires” of any long term nature, that you register your interest in “perfection” (means you fill out the register spot on and in fullness) on the PPSR. It is as even important that any change to the hire contract (swap out of machine, change in hire period, change in hirer) are all updated asap on the register. We have had a recent issue of a company going into receivership, receiver telling the hire company they will take over the hire but the paperwork wasn’t updated and signed by the receiver and the PPSR wasn’t updated. The receiver noted this and took possession of the quite sizeable in value and physical sized equipment. The Hire company has a very lengthy and costly battle to try to get the asset back. Section 16 of the act extract... Lease for a term of more than 1 year― a. means a lease or bailment of goods for a term of more than 1 year; and b. includes— (i) a lease for an indefinite term, including a lease for an indefinite term that is determinable by 1 or both of the parties not later than 1 year after the date of its execution; and (ii) a lease for a term of 1 year or less that is automatically renewable or that is renewable at the option of 1 of the parties for 1 or more terms, where the total of the terms, including the original term, may exceed 1 year; and (iii) a lease for a term of 1 year or less where the lessee, with the consent of the lessor, retains uninterrupted or substantially uninterrupted possession of the leased goods for a period of more than 1 year after the day on which the lessee first acquired possession of them, but the lease does not become a lease for a term of more than 1 year until the lessee’s possession extends for more than 1 year; but c. does not include― (i) a lease by a lessor who is not regularly engaged in the business of leasing goods; or (ii) a lease of household furnishings or appliances as part of a lease of land where the use of the goods is incidental to the use and enjoyment of the land; or (iii) a lease of prescribed goods, regardless of the length of the lease term

TROJAN BATTERY COMPANY AND YHI ENERGY Distribution company YHI started out in tyres and wheels but carved out a bigger niche in energy, proudly the master distributor for Trojan Battery in New Zealand and Pacific Islands.

Six months in Rodney Grant’s Diary
With the gripping intensity and informative, quality writing I provided for my first article in the Hire and Rental magazine (for those who weren’t so moved by it and have re-read it multiple times, page 10 and 11...), it is very hard to put in words further expletives of descriptive English. I will however try my luck.
I
wrote last edition of my time in the seat so far, I even quoted our Prime minister (congratulations maam on your re-election, however it was from no help from me). This edition won’t be full or long winded, but brief and to the point. It’s been a busy six months since I last wrote to you. Lets just recap on my plans as they were in the end of May:
Integrated back end for all three associations – Progressing. Getting everything to line up and find a vendor to do such a thing in the budget constraints we have has proved challenging. We are close and you will see more of this leading into the new year. New website layout feel and operation – in progress. We have moved the “Careers in Hire” website into the HIANZ site and have re-directed the careers in hire web address to point to it there. Silvercard is next on the list and you will see new branding and marketing of this site coming in the nearest of futures. Updating the database – wow! What a job this became!! We had multiple lists, all different slightly and not one single source of truth. Thank you so much for the ones who sent their forms back. Some of you took a bit time and reminding but we have got there. We feel much more confident we know who is who now. Silvercard promotion – As per above, there’s an updated web pages coming along with new brand-
ing and this will assist us in our push out to like minded and related association members. APEX marquee project – Glad to announce, Greg Ward is back on the job and assisting me in getting going on this project. We are just re-engaging with the different groups to lobby for some exemptions etc for our accredited installers. More to come of this also. Note, we are well aware there is a need for further marquee courses, and we will have them running soon. E-learning portals – Some of you will have experience at these and know they are a valuable tool going forward. Along with VR and simulators, the opportunity to provide safe and effective training is getting easier and easier. All comes at a price though so we will be budgeting for next financial year to start pushing ahead on industry training via e-learning portals. Regional meeting and AGM – Our AGM went down very well for those attending. My apologies to those who “dialled into” the live streaming and had only pictures and no sound for the most part. One little switch on the AV board would have fixed that!! We had Karl Budge of ASB Tennis classic speak and what a great insight to the back end of a top NZ event. Luckily, the sound on the livestream was working by then. I thought he would be “too good” for us lot, but he was a very down to earth bloke and though he told some funny stories noting world famous female tennis
players, he wasn’t name dropping all the time. He talked of his passion for the event, his personal drive and why he believed running the ASB Classic in the middle of Auckland at a time in the year when everyone supposedly leaves town would be so successful. We also held just recently the Xmas Golf Day in Taupo. Read its own story in this issue. Plan and carry out a road trip to meet you all – Not as easy as I thought to get away, but I did manage to get a few people in around Christchurch Blenheim and Nelson recently. You will see me out and about more as I really get settled into the role.
So that’s that updated. What else? I have been given a huge boost of support since mid-June when Kylene joined us. Kylene has taken on the role of running all the office functions and is a master at databases now with her time getting our one right and that of the other associations. She’s also very efficient in getting your orders out the door, so thanks Kylene for your work there. It was also her doing on the Xmas function in Taupo, organising a great event for all that turned up. Make sure you diary ahead to come to the next event. I have written a few smaller articles on varying subjects throughout this edition but here is an update on where we are at:

APEX Marquee program – As mentioned earlier in the article, Greg Ward is available to assist us in getting this going again. We are re-igniting our connections and relations with BIONZ (Building Officials Institute of NZ) and FENZ (Fire and Emergency NZ). We will be setting a plan for on-boarding members into the program and carrying out audits into the new year. The main focus though is getting the temporary structure building consent exemption for accredited installers. This is the golden egg of the program. We will also be getting marquee erection training going again after we stopped them through COVID and didn’t give planning of them much thought coming out. Conference 2021 – by the time this magazine hits your hands, it will be well publicised that we have opened the registrations for 2021 conference. I know it sounds like so far away, but it will come round quick- we have run out of November already! Have we put some work into this conference or what! It’s our biggest budget ever and we are working on making sure it’s got the wow factor. Admittedly, it has got a lot more expensive to hold these events now but we have putting a huge amount off effort in to give a great event for the same price as the cancelled 2020 conference and 2019 one for that matter. Please sign up early, so we have good indication of attendees. We only want a 10% deposit to get your skin in the game (fully refundable if we can’t hold the conference), with the balance payable either next April or in portions, see our payment plans on the Registration page for more details. We opened the conference to our Exhibitors and Sponsors a couple of weeks ago and the response has been great. Also, they have just been given scope to provide training on Unit Standard 23229- Use a Safety Harness for Personal fall protection when working at height. That’s 7 different unit standards they can now offer through Silvercard™ Competent Operator training. Silvercard™ Website – We have given this a bit of a freshen up, with new branding and a new “find a trainer page”. Take a look, find a trainer, and let us know how you find it. HIANZ Website changes - The Store locator (find a trainer) setup on the Silvercard website is something we are going to implement onto the HIANZ website. This is to show the general public where they can find a HIANZ member closest to them. If you haven’t updated all your details to us lately, you might miss out, so get it in. The Forklift Association is in heavy talks now with Worksafe and Compentenz about being more involved in Forklift training. The desire is to get Forklift training at a consistent, high level across the country. Read the NZFIA news article for more on this. Member road trip – In the last month, I have made an effort to get out of the office and get out to meet up with a few members across the country. Now, just a quick note before I go further – if I say I have been to a town and I didn’t come see you, it’s nothing against you, I can only fit in what I can when I can and a lot of times, my member catch up’s are around other pre planned meetings. Please don’t get upset, I will get to you one day. Right, that said, In the last month, I have got to some members in Christchurch, Nelson, Blenheim, Wellington, Hutt Valley and Auckland. I have great aspirations of getting around as many as possible in the few months after new year so watch out for me! So far, most memorable visit was to a member who made me get out of bed at 5.45am to go mountain biking. Anyone who is first
to name this member (not including the member) to me, gets a prize. FYI, I have also given out a prize to one member that was proudly advertising their membership with us. They had their current year membership sticker on the front door and had their certificate displayed behind the counter. Will you be next? From Friday night, the 18th December, through to Tuesday the 5th January 2021, we will be closed. From Tuesday the 5th, Kylene will be on deck to send out orders and assist where needed. I will follow back the next week. So, on that very short note…. I bid you well for the December rush, celebratory period and look forward to seeing you real soon in the new year. On the 9th September 2020, https://www.stuff. co.nz/national/122714525 reported a serious injury incident involving a log splitter.
Given the available information and the traumatic nature of many accidents involving log splitters, the HIANZ Board recommends the following to members:
T
he log splitter involved is a single-lever splitter built in New Zealand and hired to a customer by a HIANZ member. HIANZ has been advised by Worksafe New Zealand that a workplace investigation is underway. The HIANZ Board passes on our sympathy to the injured person and wishes the injured person a speedy and full recovery. However, the incident is a timely reminder of the Health & Safety obligations Hire Companies have under the current law. As suppliers of equipment, Hire companies “as far as is reasonably practicable, ensure that the plant… Is without risk to the health and safety of persons…who, at a workplace, use the plant…for a

purpose for which it was designed or manufactured” (Abridged, Section 42, Health & Safety at Work Act, 2015). Recent ACC data obtained by HIANZ indicates log splitters account for around 15 – 20 amputations of fingers and thumbs each year in New Zealand. In June 2015 Worksafe New Zealand issued a ‘log splitter hazard bulletin’, noting two common causes of log splitter accidents: 01. The use of log splitters with only one control lever; and 02. The presence of a second person in the immediate log splitting area.
03. That the hiring of single-lever log splitters for use in a workplace (such as a farm or business using firewood) be immediately curtailed until the machines can either be retrofitted with dual controls or otherwise made safe. 04. That some form of guarding be fitted to reduce the risk of a second person being able to reach into the splitting zone. 05. That all HIANZ Members undertake thorough Health & Safety briefing of all customers when hiri2ng any log splitters, to ensure that all limbs are kept well clear of the splitting zone and that there is never more than one person in the immediate splitting zone.

INTRODUCTION Fourteen incidents involving log splitters have been reported since February 2015. The incidents have resulted in amputations, fractures or serious crush injuries to farm workers, students and volunteers.
THE HAZARDS Log splitters generally utilise a hydraulic ram to force a steel wedge through a log ring against a steel plate and are either vertically or horizontally oriented.

If you are collecting this equipment for someone else please make sure this sheet is given to the equipment user to read. This sheet should be given to the site supervisor if the equipment is being hired for commercial use so that the information is available to all users. ff Before starting, take time to plan and identify the job hazards. RISK OF ENTRAPMENT! Never wear loose fitting clothes or jewellery. Tie back long hair. Take care when operating in wet or slippery conditions. Use correct lifting techniques when lifting logs, such as "Bend your knees". Exposure to noise louder than 85dB can lead to long term hearing loss. Wear ear protection. Fuel is highly flammable. Turn off the engine when refuelling or when machine not in use. Guard against spilling fuel on hot surfaces. Exhaust gases are poisonous. Never run the engine in confined places. FATIGUE WARNING. Do not operate continuously for long periods. Never operate this equipment if you are under the influence of alcohol, drugs, medications or any substances capable of impairing your abilities. Minimum age 18 years.
HIANZ has produced an Equipment Safety Data Sheet for Log Splitters. We strongly recommend you provide a copy to each customer, while explaining the safe operation of the machine and receive verification that they understand the risk. To access this ESDS sheet, you need to have signed our legal agreement for the use of these documents. HIANZ strongly recommends that you are using all the available forms in our library of equipment safety data sheets. Log splitters must meet the requirements of the AS/NZS 4024.1 (series) for safeguarding of machinery or equivalent, or the European EN609-1:2017 standard. However, these standards may not be sufficient to satisfy the ‘reasonably practicable’ requirements of the Act. HIANZ is currently
seeking direction and clarification from Worksafe and other interested parties. Further information concerning log splitters will be provided as it becomes available. In the meantime, we recommend that you take the necessary steps to keep your customers safe. As an association, we are investigating some improvement “retrofit” system to suit most single lever machines. It is possible we can get an improvement for them put together that will save time and effort doing it yourself and cost savings by providing volume through one channel. It is not our intention to have your machines modified to meet the standard as we believe this is impractical and costly, but to provide some improvement to the safety of the machines until such time as you replace it with a machine that does match the standard. ■
