IN THIS ISSUE

W

hen I last wrote to you all in June, I had attended networking meetings in Christchurch and Auckland and was looking forward to our highly enjoyable HIANZ Conference held in Rotorua in early August. That does now seems like a distant memory after 100 days or so of restrictive alert levels in Auckland. Which is why I have been pleasantly surprised in my conversations with equipment hire members recently to find that confidence levels seem to be holding up, and that is translating to high activity levels for many. I have been impressed by the way members have adapted and been willing to invest in finding innovative ways to continue to trade during this fast-changing Covid Alert Level environment. My observation has been that in many cases the customer experience may have actually improved. Reservations placed ahead of time allow for equipment to be prepared and ready to go. If anything, wait times for customers have reduced, and in some cases the customers don’t even need to get out of their vehicles. Mask wearing, especially in Auckland has become the norm and many have adapted to wearing them more quickly than I ever imagined. Contactless payment systems have been introduced, often directly into computerised hire systems. There may well be lessons to be learned from the challenging times that we find ourselves in. I’ve learned that we may have been previously guilty of travelling too much. There is no doubt that face to face contact is vital for building relationships. Zoom or Teams meetings however can be a cost and time effective way of keeping in contact and conducting some aspects of business. The importance of having a digital presence and the ability to conduct business on-line has also proven to be essential. Vaccination is a topic that has dominated the media over the last couple of months. Vaccination is one of the few real tools that we have to reduce harm in the community and to enable the economy to make a sustained recovery, across all sectors. The conflicted and contradictory

legal framework that currently exists is a real challenge – and not just for our industry. Our obligations under the Health and Safety at Work Act to take all practicable steps to ensure safety, is in direct conflict with the Privacy Act and the Employment Relations Act. This has been one of the most challenging aspects of the last few months, and one which the government does need to provide leadership and take action to resolve. If vaccination was made mandatory for those working in the construction sector, that would make the legal mine field that we currently face less difficult. There is no doubt that the Hire Industry is an essential part of the supply chain for construction in New Zealand and should be included, if that were the case. If the government does not act soon, I expect that some members may choose to go down the risk-assessment path and consult with their teams on that basis. I do know that HIANZ has already put considerable effort into providing up to date information and advice to members regarding the impacts of Covid-19. I expect that it won’t be long before Rodney is able to offer some sort of basic framework for those members wanting to take a risk assessment approach to trading in the pandemic. Despite the obvious challenges over the last year or so, we can probably all think of businesses that we have had great experiences with. Continuing to work on improving the customer experience in our own places of work is an opportunity that we all have. Not taking customers for granted and working hard to reduce friction wherever possible is the key. Doing this will ensure success, no matter what alert level or restrictions are in place. On behalf of the HIANZ Board of Directors I extend season’s greetings to you, your family and staff. Although this Christmas break and holiday season may be a little different from what we are used to, It is still a good time to relax, reflect on the year that was, recharge the batteries and get ready to take advantage of opportunities in 2022. SILVERCARD

SILVERCARD IS GROWING

On 8 October 2021, The NZ Forklift Association announced it was starting a forklift training programme in conjunction with HIANZ. NZFIA are using the branding of Silvercard™ to promote their Forklift Competent Operator training product. The programme started in earnest in Mid-November to get trainer/ assessors up to speed on the presentation and resources.

T

he association has had constant calls about the quality of training in the industry for many years. There is a very large inconsistency in the quality delivered and it isn’t postcode related. It seems that there has for many years been a race to the bottom on the price of training and this has driven the quality down. Not to be overlooked is the fact the industry has a guidance document still in force, written by the then Department of Labour and people still provide training to that level under the auspices of an “OSH” certificate. All forklift trainers are required to be registered by Competenz who were authorised to manage training by Worksafe. Competenz has at times struggled with the industry and now they are breaking up into the new vocational education streams the government has seen fit to bring in (a completely separate and page filling subject). The association has in the past been unable to provide support or put in

place a measurement of quality that can be used right across the country, until now. Silvercard™ Forklift Competent Operator training provides a high-quality training programme and furthermore, assesses all trainees to the NZQA Unit standards for forklifts. This measurement is how the programme creates consistency. The delivery through experienced, well managed trainers provides the quality. Silvercard™ Competent Operator provides both Elevating Work Platform and Forklift training and assessment. These two disciplines are closely aligned, and employers can be rest assured that staff who carry the Silvercard™ in either or both disciplines has been provided the best training and assessment available. Forklift users get the added benefit of holding a nationally recognised competency card for forklift operation and the added benefit of holding NZQA unit standards in forklifts, that may be used toward gaining a qualification.

New branding of the Silvercard™ Competent Operator card With the expansion of the training and assessment provided under the Silvercard™ banner, with Forklift training joining EWP training, the branding of Silvercard™ has changed to include the expansion of training available. Silvercard™ Competent Operator is the new name of the training programme and the card face shows both a forklift, or an EWP silhouette dependent on the competency held. The new branding is a further freshen up and provides the same look and feel across the two training programmes. Furthermore, development on a QR code on the card allows employers, site managers or anyone shown the card, to access the competency details of the holder. Giving further confidence that the person operating has been trained at the highest levels. ■

Welcome back to our latest edition of the Hire and Rental Magazine It’s been interesting times since my last story to you all The words “nimble and adaptable” are now firmly entrenched into the vocabulary of a business owner. Being able to quickly change your business operations to fit the health requirements of the country is now kind of second nature. As much of a pain it is and it hurts us significantly in the pocket, our ability to bounce back out of that is the very reason you are a business owner. Your ability and measured risk taking is supposed to provide a return on that risk. Sadly, that is in the control of others at times, so your ability to be nimble and adapt is what will get you through. I am really amazed at some of our member’s tenacity. Especially in the Events sector. A sector that completely tanks every time we go into lockdown. Funnily enough, they don’t just roll over and die, they adapt and make it through. Some businesses are diversifying which is cool to see. I heard one member is contracting out their staff to scaffold businesses, another has gone into furniture deliveries etcetera with his covered trucks. Recently I visited a member promoting the “American retail sales driver of Halloween” by selling balloons and other paraphernalia, something they said was certainly helping the bottom line. Adapting and being nimble has to be the way forward now Geez, didn’t we dodge a bullet! We got our conference away on the second week of August, just four days before lockdown. This was our team’s first conference to organise, and I gather from the survey and the feedback from members I got to catch up with, that we did ok. We learnt a lot and there are definitely things we have put into the mind bank of what not to do next time, but overall we got through it. A big thanks to everyone who came PAGE 6

– Suppliers that filled our trade hall up, our speakers and presenters were amazing, and the delegates came with their cheque books and dancing shoes (and drinking gizzards according to the bar tab!). Though our attendee numbers were down, which hits us in the pocket and has cost us a bit this year, we had some great suppliers step up and support the association, none more so than our event sponsors of Youngman Richardson, Baytex, Synergy Hirebotics, ICIB, NZI, Point of Rental, Trackunit, Brent Smith Trailers, OMC Power Equipment, BE Pressure and TVH. Their financial support is what allowed us to do the cool things we do at conference. You have to come to see! Good Segue Rodney Engagement is the buzz words in associations. Now, I am no rocket scientist or the most knowledgeable at running associations but what I have worked out is this: Membership organisations are always trying to lift engagement with their members. I get it, they want a pat on the back and want to do more for members, they can’t think what’s best for their industry and so want the membership to tell them. I have been told by the circles I mix in for running associations (can you believe it, there’s an association for association executives!) that the key to growth is getting more members engaged. Engaged members give you the mandate to advocate on their behalf, to create wealth for their industry by getting more involved. Hhmmmmm… I see it this way. I’m not saying they are doing it wrong, if it works for them, all good. What I’m saying and this is where you can correct me if you want – There are 3 types of members 1. The highly engaged members (those probably reading this magazine) that value the support and contact we have with them. They look to partner with us because it works for their business and they like the idea of being able to turn to us regularly for support, ideas, networking and to just bend an ear.

2. Others want to have their say whenever it pleases or fall back and use our support when the hole, they have dug is very deep. 3. And then there are the businesses that just want to put the sticker on the door and say they are part of the industry professional association so that they can tick a box for prequalification’s and marketing. So, why do I have to push to get No.’s 2 and 3 to engage more? They pay their subscription, they get the magazine and the sticker, they are content? Force feeding them my snake oil is not going to get them more engaged. Am I just right to continue along the direction the board and highly engaged members want me to take the association and not worry about their opinions? At the end of the day, they are getting their perceived value from Hianz. Back to my number 1’s. You hold the key to our successes going forward. Your highly valued opinions will direct and carve our path. Thanks for calling the shots right so far, you make me look like I know what I’m doing!! What have I just said? If you want to help shape the future of the association and the direction it drives the industry, give me a bell. If you are content to follow along and think we are doing ok, fine. I’m not going to be a preacher or make this into a “Party Political Agenda Broadcast (PPAB)”. I’m here when you need me (infill with the tune of “Lady” by Little River Band). 1100 words already, crikey I waffle. Couple of things and projects to update you all (if you are still reading this) on: Duty of Care statements – As an industry we need to make sure we are managing safety well and this includes both upstream and downstream duties. I said last magazine and at conference I want to get a team together to help create an industry statement of intent. This is the call for interested people to provide a hand on this.

The HIANZ board of Ant Smit, Dale Lilley, Paul Harrison, Paul Raymer, Martin Vogel, and Amy Gillies get together in December (via Zoom) to put together a strategic plan for the next few years for the association. If you want to provide some input, drop me a line. Our website has had further tidy ups. Thanks to Kylene for the work going on here. Go have a look at some of the changes and get ready to see more before Christmas. Social media, I’m not a fan of it but we are putting more effort into communicating out through these avenues. Find, follow and like HIANZ, EWPA, NZFIA and Silvercard on Facebook and LinkedIn. The more people we are “liked” by, the wider our audience on certain matters, like finding your stolen trailers. Did you know 30% of our revenue in the association (taking conference and Silvercard out of the equation) comes from stationery sales. It is a massive help to our cashflow. Please, please, please, buy off us. I am fairly confident the pricing is good, and the sales really help our

bottom line. Don’t give your stationery orders to others, support your little old association with them!! Webinars, we ran a series of Webinars over lockdown and have stopped now as the numbers of watchers had dropped. Feel free to go onto our website and watch the recordings. Some really good content there and as this was our first go at it, we have learnt a few tricks and have had some feedback on how to make them better. Let me know what you think. We will do a new round next year. Talking of the new year, we are going to be working on a range of pre-hire and post hire checks for our equipment ranges. This is to provide guidance around a minimum standard we should be operating at and tie into the duty of care statement. The last thing I wanted to rant on about is your staff. I can’t stress enough the importance of your team and having them in the boat with you to help steer through these troubled waters. Communication is the most valuable tool here. Not you telling them everything but getting 2-way

conversations going with them. Let them know you want to hear from them and as much as you might think they have nothing to offer, they are the ones who will be the most affected by your decisions, so having them play a part in talking about it is a good move. The Government has not provided clear guidelines on the vaccination topic which requires some of us to be jabbed. This runs you into an employment relations minefield particularly when there are no laws in place to help you to comply. I suspect there will be many more times that we will be put in a no-win situation by this government. So work with your team and get them of your side. We are currently developing some guidance and support information to help you through this minefield. That’s it from me. No more PPAB (my new acronym of the month, Party Political Agenda Broadcast). All the best as the country gets double jabbed (or not) and starts opening up so we can all get through the festive season without too much drama. ■ Good chat.

RESPOND, RETHINK, RECOVER CONFERENCE 2021 REVIEW It’s fair to say that this was a conference like no other. So close were we to a countrywide lockdown that once again it nearly didn’t happen. But fortunately we dodged a bullet and were able to get together before everything closed down.

ther organisations have not been so lucky. We know of other associations whose conferences were planned in the weeks following ours and it cost them dearly. Food has to be ordered 2 weeks out and setups were well underway. The bulk of non-refundable costs are realised so if you cancelled last minute and paid back attendees money, you’d still have the bear the majority of the costs. We were just so lucky to have got it done and dusted.

according to our judges Angie Williams, Mark Bacon and Tim Mikkleson each presented first class operations that they could be rightly proud of. We are going to re-invent the Hire Excellence Awards and will be running learning and support webinar classes on this in the new year. We are also considering incentives as part of the review.

This year saw a change to the exhibition floor plan in the form of a wagon wheel shape. Instead of the normal layout, exhibitors were setup around an outer ring, with “spokes” of stands extending back to a centre stage to provide a more inclusive environment.

Our big name key presenters at the conference included MC and a very pregnant and due anytime Antonia Prebble of ‘Outrageous Fortune’ and ‘Westside’ fame. She was ably assisted by Madeline Sami, NZ comedian and star of Sione’s Wedding who, as a key presenter agreed given the circumstances to also MC the Hire Excellence Awards.

This year’s conference was capped off with the Hire Excellence Awards which recognise and reward performance within hire companies. This year’s winners were Hirepool North Shore, Royal Wolf Auckland and Kennards Hire Dunedin. All of the entrants were awarded Gold Awards and

On top of this we had the most moving keynote presentation from Wiremu and Marsella Edmonds. This presentation was both amazing and thought provoking. Others to speak were, motorcycling legend, Andrew Stroud who bought with him a special show piece – a Britten motorcycle

in the flesh! Business advisor Hannah McQueen, and Mike Allsop, Air New Zealand pilot and adventurer, rounded off the list. Our breakout speakers included Paul Harrison on ESDS sheets, APEX programme with Greg Ward, Andrew Messent of Downer, National Association of Woman in Construction programme representative Lynette Oxford, Silvercard training by Rodney Grant, Angie Williams on Hire Excellence Awards, Andrea Leighton of Ezicheq on paperless checklists, Geoff Hardy from Martelli McKegg on repossessions, Fleet disposal options with Josh Olsen from Olsen Commercial, Mark Walker of Worksafe on machine guarding and finally Gareth Kieran of Infometrics with an economic forecast construction sector report. It was a great week had by all and I think/hope the outcome proved beneficial for all concerned. Planning is already underway for the 2022 conference, watch this space! ■

ClearSky™ now within easier reach JLG Industries has recently increased accessibility to its innovative ClearSky telematics solution, by offering the technology as standard fitment on all new engine-powered boom lifts.

A

s part of the initiative, new JLG engine-powered boom lift orders also receive a complementary three-year data subscription, allowing customers to access the JLG ClearSky Portal or API, enabling them to closely monitor machine parameters, equipment movements and other functionality. Since JLG ClearSky was introduced in New Zealand approximately three years ago, uptake of the technology has steadily increased, according to JLG Technical Services Manager, Luke Schubert. “More and more access equipment users are realising the benefits that ClearSky can deliver for their businesses,” Luke said. “In offering the technology as standard on selected equipment, we’re providing JLG owners with added value by making machine ownership more efficient and easier to manage.” Benefits of ClearSky ClearSky’s efficiencies provides can be broadly placed into three categories: increasing uptime/utilisation, enhancing safety/security and boosting productivity and performance. The technology allows the owner to know when, where and how the equipment is being used. It also provides automated performance

reports and can send immediate notification if a problem with the machine arises. Furthermore, ClearSky will proactively schedule maintenance to reduce unnecessary service calls. To improve safety and security, ClearSky also allows the user to set-up geofences and time fences to protect the equipment from authorised operation, and saves time by immediately locating assets in the field. Machine performance is easily monitored via a portal that analyses each data point and is accessible via desktop PC, tablet or mobile device. This information when used in conjunction with the JLG BIM (Building Information Modelling) library, helps deliver the most suitable machines to the job site depending on the application. Luke said that initially clients were using ClearSky mainly for tracking, but increasingly were developing telematics strategies to help them take advantage of the extra capabilities available. “Aside from tracking, you can monitor how machines are being used – if they’re being underutilised and just sitting on site and not being productive, this is valuable insight,” he said. According to Luke, at its most functional, the ClearSky telematics data – which can be securely shared between the owner and JLG – also

allows technicians to more efficiently maintain equipment. “Being able to respond to an unexpected issue and resolve it as quickly as possible to reduce downtime is a key priority for JLG,” he said “We receive a maintenance or breakdown notification and in many cases can diagnose the issue without being on site. We can then despatch the closest mobile technician and ensure they have the appropriate parts on board to rectify the problem. “En route to the machine, the technician will already have a good idea of the issue and what’s needed to sort it out. The more efficiently you can action the repairs, the lower the costs and ClearSky can really help in this regard.” Access Control For additional functionality, JLG offers the intelligent ‘Access Control’ for its ClearSky telematics at an extra cost. By providing operators with a unique ‘smart card’, Access Control can restrict users who may not have the correct credentials or training from using a machine, thereby increasing work site safety. It can also provide check in/check out tracking and reporting to aid decision making based on usage and operator performance. ■

THE DANGERS OF ANGLE GRINDERS Angle grinders are common in many Hire Companies workshops and showrooms. Their versatility, along with the recent addition of batterypowered grinders, has made these nifty little power tools very popular. Unfortunately, their versatility comes with an impressive number of hazards.

T

he recent death of a construction worker in Brisbane highlighted the dangers of using angle grinders. According to the reports the man, believed to be in his 50s, suffered a fatal injury when a small metal shard spun off from the 230mm grinder and struck him in the neck. Worksafe Australia noted that he was using the grinder to cut the base of a structural steel member and that no safety guard was reportedly fitted to the grinder at the time (https://bit.ly/HIANZ_230921). When hiring angle grinders, Hire Companies have responsibilities under the Health & Safety Act to reduce risk to the user. Here’s a couple of proactive steps you might want to consider: Is an angle grinder the best tool for the job? Angle grinders are grinders. They work by abrasion. They are not cutting saws. If cutting is required, then a reciprocating saw may be a better choice. Pick the best tool for the job. Do I have the correct disc? It’s vitally important to select the correct disc for the intended job. It needs to be rated at or above the speed of the grinder, free of any cracks or defects (including water damage) and suitable for the material that is

It’s not known who removed the safety guard, something that is relatively easy on many powertools. You may want to look at changing the screw from a Philips head to perhaps a hex design or burring the end of the thread to make removal of the safety guard just a bit more difficult. Any new equipment purchase should also consider safety design, especially the ease of removal of the guard or ability to override the ‘dead mans switch’ or ‘hold-to-run’ features. HIANZ has reviewed the current ESDS and will shortly be issuing an update. ARE YOUR STANDARD HIRE TERMS FAIR? By Andrew Skinner of Auckland law firm Martelli McKegg

On 16 August 2021 changes were passed to the Fair Trading Act 1986 (Act), which will extend the existing protections against unfair contract terms in standard consumer contracts to also apply to small trade contracts.

T

his change will be relevant for all hire companies who engage with other businesses on their standard rental terms and conditions. This article examines the background to the law and explains why it will be important for all hire companies to review the standard terms prior to the new law coming into effect in August 2022.

Background to extending the unfair contract term regime The unfair contract term regime came into force in 2015 and the purpose of the regime was to provide protections to consumers when entering into standard form contracts by prohibiting unfair contract terms. Since then, questions have been raised about whether this regime will extend to business contracts as the existing legislation had significant gaps in the protections for small businesses against unfair contract terms. In order to alleviate the negative impacts for individual businesses as well as broader economic impacts such as lower levels of competition, innovation and productivity, the regime has now been extended to include business contracts with effect from August 2022. Determining whether the unfair contract term provisions apply There are certain prerequisites that need to met before the unfair contract terms provisions will apply to business contracts. First, the contract PAGE 18

must be a standard form contract. Secondly, the contract must be characterised as a small trade contract. Are hire contracts considered Standard Form Contracts? A number of factors must be considered before deciding whether a contract is a standard form contract. These include: • whether one party has most or all of the bargaining power • whether the contract was prepared prior to any contractual discussions • the extent to which parties are able to negotiate terms; or • whether the contract is presented as part of a “take it or leave it” situation. Having regard to these factors, it seems fairly clear that many contracts for the hire and rental of goods will be considered standard form contracts. The contracts are often prepared by the rental company with little negotiation between the parties. To the extent that a hire company rents goods to a consumer, the unfair contract term regime will already apply. The next question becomes, what business customers will now be covered by the regime? Small trade contracts Having decided that your terms qualify as a standard form contract, the unfair contract terms regime will apply to consumers and certain business customers if it is also a “small trade contract”.

A small trade contract is where: • the parties are engaged in trade; • it is not a consumer contract; and • it does not comprise or form part of a trading relationship that exceeds an annual value threshold of $250,000 (to be assessed when the relationship first arises). So the new regime will apply to many contracts with businesses in the hire industry if the trading relationship is valued at less than $250,000 per year. As you can see from these factors, it doesn’t matter how big the customer is but rather the likely annual sales revenue. By way of example, if you rented some perimeter fencing to a large construction company for 6 months for $50,000, the regime would apply. What is an “unfair contract term”? A term in standard terms will be considered unfair if it: • would cause significant imbalance in the contractual parties’ right and obligations arising under the contract; • is not reasonably necessary in order to protect the legitimate interests of the party who would be advantaged by the term; and • would cause detriment to a party if it were applied, enforced or relied on. It is worth noting that certain key terms which describe the subject matter of the contract, set the upfront price payable under the contract, or are required or expressly permitted

by law cannot be considered unfair under the Act. The Act outlines some examples of terms included in contracts that may be considered unfair. Generally speaking, terms that permit one party (but not another) to vary, renew, avoid liability or terminate the contract may be considered unfair. In a lease agreement between a lessor and a small business, an unfair term may arise when dealing with the obligations surrounding defective goods. A term may provide that the lessor is not responsible for any inherent faults with the goods, but the small business must continue to make payments until the end of the lease term, regardless of whether the goods operate as intended. This is likely to be unfair due to creating an imbalance between the parties’ rights while also causing detriment to the small business. An unfair term can also appear when one party has the ability to

unilaterally vary the contract. For example, a term may permit the hirer of goods to unilaterally change the price of goods if they give the customer ten days’ notice in writing. However, if the contract does not give the customer a reasonable opportunity to either resist the price increase or exit the contract without a penalty then this would be considered unfair. What should I do now? If a customer complains that a term in your contract is unfair then you need to take the complaint seriously. The customer could complain to the Commerce Commission and the onus will be on you to prove that the term is fair and protects your legitimate interests. You will incur considerable legal and management time dealing with the Commerce Commission. If the Commerce Commission disagrees with you, the Commission can apply to the Court for a declaration that the term is unfair (which may cause significant reputational

damage for your business). If a Court declares that a term is unfair, it is an offence for any person to include, apply, enforce or rely on the declared term in a small trade contract. The offence is punishable by a fine of up to $200,000 for an individual or up to $600,000 for a body corporate. In order to feel confident that your terms cannot be challenged by an unhappy customer, businesses should review their standard terms now to ensure that they do not include any unfair contract terms before the regime is extended to business customers in August 2022. ■ Andrew Skinner has over 20 years of experience as a commercial lawyer and is a partner in the Auckland firm Martelli McKegg. The EWPA is working on better ways to report on the NZ environment and improve/maintain our relatively good safety record around MEWP use. Also being investigated is a reporting process and tool for capturing incidents and machine issues so that we can report to the industry on areas needing awareness in safe operation and maintenance. More to come on this in the new year.

The EWPA has been toiling away through the new Plant and Structures Regulations that were published recently. There is much to take in and a lot that affects MEWP’s (Mobile Elevating Work Platforms) going forward.

J

ust on that, the word reasoning around the use of MEWP over EWP is a worldwide factor more than anything. There seems to be a growing use of MEWP in most countries now. I tend to look at it that an elevating work platform could be potentially inbuilt or fixed whereas a MEWP describes a self-powered, mobile machine. The Best Practice Guidelines produced by Worksafe use the term MEWP, so seems to be the way we are going. “EWP” rolls off the tongue better to be fair. Play it your way… What does this mean for MEWP’s in New Zealand going forward? Well, the EWPA recently ran a webinar on this for HIANZ members and it is recorded for future watching. We can tell you that they will become high risk items in the eyes of the regulator, meaning more controls than currently.

Recently the board lost the services of Brian Lund, ex JLG Industries and even more recently Paul Robinson of Hire Knowledge who is retiring at the end of the year. HIANZ showed its appreciation to Paul at their conference in August. New board nominations have been sought and I am sure by the time this goes to print, two new board members will be in place. ■

Why are they high risk you ask? Inherently they are perceived to be dangerous equipment. They elevate people and allow them to move whilst elevated, increasing the risk of being hurt vs. staying on the ground. There is a worldwide trend to treat MEWP’s in this fashion. Sadly, we are dictated by high numbers in incident reports of MEWP involvement, and typically, when it goes wrong, it is serious or fatal. The EWPA is working on better ways to report on the NZ environment and improve/maintain our relatively good safety record around MEWP use. The association has recently published a draft programme called Register Inspector. This is a programme to accredit, develop and monitor MEWP Inspectors. Since 2017, Brendan Walker and his Access Specialities team have been quietly getting on with becoming one of the most comprehensively skilled EWP and telehandler equipment repair, service, and certification providers in the country.

H

aving doubled the Access Specialties team in the last four years from 21 to 40 staff members, managing director Brendan Walker says that inevitably this busy company has also now had to double the size of its workshop space. “We’ve just moved into a new 2,700 square foot building at 104 Carbine Road, Mount Wellington which gives us nine bays inside the workshop – double what we had before,” he says. “We also now have one of the biggest paint booths in the EWP repair industry and more room to look after the specialised gear we service and repair, such as the truck-mounted Aichi booms used by power companies on which we undertake high voltage testing, or some of the larger EWPs the construction industry utilises, like the two 43m Genies we’re servicing at the moment.” With Access Specs also stocking and selling parts for a variety of well-known brands, and with many

But while the new larger premises take shape in Mount Wellington, Access Specs is by no means tethered to just one location. With customers spread far and wide, the team also includes four field service technicians in the Waikato, and more personnel covering, Northland, the Bay of Plenty, Hawke’s Bay, and the Lower North Island. Beyond the industry itself, Brendan says he loves

getting involved in local community initiatives: Access Specs is a supporter of the United North Piha Surf Lifesaving Club on Auckland’s West Coast, for example. “We’re all for both town and country. A big part of our business is getting out on site to where the equipment is based, rather than what you see in our workshop,” continues Brendan. “I’d say probably 50% of our maintenance business revolves around going to remote locations in the provinces and getting our customers’ back up and running out there. We have contracts for national entities such as Fonterra, and we look after anything aerial for Fire & Emergency New Zealand, which means we need expertise all over the country. We have two full-time service coordinators logging jobs, so while things look busy in the workshop there’s an equal amount of

What Laws Govern the Hire Industry? By Geoff Hardy Partner at Martelli McKegg

T

he hire industry is an integral part of our economy and serves a very important function. It simply wouldn’t be economic to purchase a trailer simply to assist your daughter to move into a new flat once every few years, or to buy a marquee for that once-in-a-lifetime party in the back yard. It makes much more sense to pay someone else for the use of their jackhammer or their campervan for the short period of time you plan to use it. But what laws can the hirer turn to if the digger doesn’t perform as promised, and what can the hire company do if their customer absconds with the rental car and sells it to someone else? The starting point is that there is no “Hire Act” or anything like that. The relationship between the hire company and the hirer is governed by the basic law of contract. So it is the hire agreement that is the first port of call when determining what the parties’ respective rights and obligations are. Of course the law of contract is supplemented by the general laws that all businesses are subject to like the Fair Trading Act, the Commerce Act, the Consumer Guarantees Act, the Employment Relations Act, and the Companies Act. And there are a couple of Acts of Parliament that do single hire companies out – the Health and Safety at Work Act 2015 (which has rules that particularly relate to the hire industry) and the Personal Property Securities Act 1999. It often comes as a surprise to hire companies to learn that if they hire

anything out for more than one year, they can lose their goods under the Personal Property Securities Act. This was first made clear in the NDG Pine/ HSBC/Portacom case. The principle applies not only to hires of more than one year, but also hires for an indefinite period, and any renewable or “carry over” hires. In that case it is essential that the hire company

Otherwise if the customer goes bust, another creditor like a bank who has registered, can jump in ahead of the hire company and take the hired goods. Registration can be done on-line relatively cheaply and easily, but it pays to know what you are doing, otherwise you could make a fatal mistake. If you happen to be a consumer hirer (as distinct from a business hirer), it may not matter what the hire contract says. That is because you will probably be covered by the Consumer Guarantees Act 1993. This

Act gives hirers certain guarantees they can enforce against the hire company, and remedies they can insist upon, regardless of what the hire contract says. And the hire company can’t hide the fact that these rights apply, because that would be a breach of the Fair Trading Act 1986. Finally, both hire companies and consumer hirers need to be aware that the Credit Contracts and Consumer Finance Act 2003 (the “CCCFA”) may have some application. Why should that Act be relevant to the hire industry? After all, hire companies don’t typically lend money. However, what they frequently do is hire out goods to consumers, on a long-term basis. And in those circumstances the hire contract may well constitute a “consumer lease” (in which case the hire company has to disclose a lot of information to the hirer), or a “consumer credit contract” (in which case the same disclosure requirements apply but a whole lot of additional constraints as well, including limitations on the right to repossess the goods). ■

Following some prudent stewardship by the HIANZ Board over the last few years, HIANZ has been able to build an investment fund to ensure financial capability and produce a modest revenue stream to fund membership projects. At the first Board meeting following the HIANZ conference in August 2021, the Board was tasked with identifying and evaluating initiatives that would add significant benefit to members using the interest from this investment. One such project proposed at the

October Board meeting was that of providing resources for the induction of new hire company employees. The rationale for this concept relates to the resource pressures that face most hire companies, especially those with less than 10 employees. I’m sure we’re all aware of a new employee often starting with a company, yet not getting all the training required in the first few weeks and months due them (ironically) being short staffed. The proposal to the board consists of a number of short training videos

covering customer service, pre- and post-hire checking & servicing, basic mechanical training, and Health& Safety. The concept would aim to deliver general competency-based training rather than specialised training, so that the employee gains confidence and ability as quickly as possible. ■ The HIANZ Board will consider options in the early 2022 but feedback is sought from members. ased on the chatter D’Gnome listened into at this year’s HIANZ conference, things seem to be pretty positive in our industry. We got through the worst part of Covid okay (spare a thought for the event people) and most construction-related activity has bounced nicely. Most are looking to add a staff member of two. Problem is, where to find the good ones. In the hire industry we’re handicapped by a couple of factors. We’re constrained by how much we can afford to pay new employees. You’d be hard pressed to find any hire company paying todays astronomical tradesman rates for non-tradesman roles. Rates have gone up and they make up a major chunk of the expenses in our P&L. There’s a limit to what we can pay. And potential employees are like car parks: all the good ones are taken. We can bemoan the current lack of suitable employee prospects but take a good hard look at your own business from a prospective employee’s perspective. Consider your Employer

Brand, especially what current and potential employees think about your business. It’s not just about the money. 1. The Ultimate Man Cave. Does your place look awesome? Working in a hire business should be like walking into Santa’s grotto, akin to the ultimate Mancave or Fairy Palace. Most hire companies are continually adding such great gear that it should take your breath away. D’Gnome was chatting to a business owner at conference who argued the concept of ‘workshop’ versus ‘showroom’ and he’s right; you should be walking into a showroom, not someone’s crappy workshop. Party hire aside, few of us give much thought to merchandising. Much of it looks ‘ordinary’, with no ‘point of sale’ information. Where would you rather work? 2. The Team Look at the team and the work environment. Is it fun? Is there goodnatured banter? Are there any toxic dickheads who should have got the sack yonks ago? Think about your team and how welcoming they would be. Seriously would I want to work here?

We’ll always struggle to compete against the pay rates of many other industries, but we do have some unique perks. Never underestimate the prestige of a crapped-out Ute, especially getting your Millennials or Generation Z to and from work. If your staff need gear for a DIY project, let them use if free of charge as part of their training. They’ll be much more knowledgeable when it comes to dealing with customers. It’ll cost you buggar all but have far greater value to the individual. 5. Job Ads The HIANZ website talks about ‘Escape from Planet Dull’ and it’s true. There are some many exciting things happening in the hire industry, yet we seem to write the most boring job ads in creation. Think about describing the variety and fun we encounter, and put that in your ad. Good Companies only become great companies by employing great people. The good news is they’re out there. MARQUEE RIGGERS TRAINING RUNS ITS COURSE Through the month of October, HIANZ ran a series of Marquee Riggers training courses in Christchurch and Taupo.

T

he events sector is a very seasonal affair made even more challenging over the past two years with the presence of COVID. This time of the year is when the seasonally hired staff come on board and in most cases, these are people who have little or no rigging experience, especially around marquees. Therefore, there is a requirement to support events businesses by providing a training and development pathway for their existing staff. Also, there is a need to continually train staff and educate them on the Industry Best Practice Guidelines. The APEX Marquee Accreditation programme, is designed to ensure that marquee companies are consistently offering high levels of value for money for their customers. Our marquee riggers courses provide an opportunity to develop basic

fundamentals of marquee rigging through our level 1 course. Our level 2 advanced riggers course takes more senior and experienced staff on a journey towards increasing those skill levels. Christchurch had a full course of 11 willing participants for a Level 1 fundamentals course, although sadly, the weather was not so obliging. The first part of the day covered theory, learning the components and types of a marquees, health and safety and how to plan and execute the building process. Although the weather got worse after lunch those hardy South Islanders were undeterred and managed to build a marquee anyway. Admittedly, all of us were very happy once the walls were up and we were able to shelter inside for the rest of the practical session. Originally arranged for Hamilton,

but because of the Waikato being in level three, we decided to move the North Island courses to Taupo, a more central spot for all the attendees as it turned out. The Taupo courses were both level 1 and 2 and both days were run in milder conditions than seen in Christchurch. The level one course was the same format whilst the next day saw us run the first level two course of the year. It was great to help these trainees develop into advanced riggers and grow their supervision skills.


PARTY and EVENTS

One of the highlights of all the courses was the testing of the different styles of pegs holding power in the ground. HIANZ owns a peg pulling tester device and it gives really good insight into the holding power of different pegs and installation techniques. This included the Baytex Earth Anchor system which out-performed most pegging techniques. A big thanks goes to Andy Youngman for presenting the courses and Continental Hirepool and Get Set Events Taupo for the venues and equipment. Also, a big thanks to Hamish of X-Site

Events for assisting with the planning of the Hamilton courses that had to be shifted. We look forward to coming to you once the levels change. The association has put a lot of resources into the APEX Best Practice Guidelines and accreditation programme. The idea is to provide a pedestal for event businesses to place themselves above their competitors by providing the best in industry product and services. We have had a very good uptake from members on entering the programme, which is a bit scary for some as we don’t

know the future of the industry – as it is affected highly by the restrictions of gatherings. Event businesses are really struggling right now and having to commit to spending a bit more to enter an improvement programme can be seen by some as not the most important thing to do right now. However, now is the time to get into it, get your systems, processes and delivery in place, measure your improvements so that when it all does come back, your business is well-placed to take advantage. ■

The NZ Forklift Industry Association is on the cusp of becoming a large organisation as it grows its support to its members and the wider industry.

I

n the Silvercard Training article, you will read that NZFIA is now providing a training programme like the EWP product but for forklift operation. This is a big step towards improving the quality and consistency of training in the marketplace.

Since our last newsletter, the association has been very busy. There is much going on in the forklift space and the association is being involved in a lot of

It would be fair to say that the sleeping giant of forklifts is starting to stir, and the association is really starting to add value to the industry through its members. The last six months has seen the association get a few projects under way or completed. These included the WorkSafe Forklift Operator Safety Workshops, where

We have also started the project of putting together an Industry Good Practice Guideline for all things forklifts. This reference document is going to cover everything you need to know about forklift ownership, fit for use, maintenance, operation plus many more topics. Why “Good Practice” and not “Best Practice”? Simple really, this is an Industry written document that creates a standard for the industry. We are describing what good practices looks like and leaving an opportunity for industry to improve potentially to a better standard. If our document was called “Best”, we couldn’t improve once we hit that mark. We don’t want to restrict our ability to continually seek safer, better ways to do things. We can measure good practices but because we will never know what best looks like, we can never measure ourselves against it. “Good” is a great start! The plan is to have this document live in early 2022, with WorkSafe pointing to it as a document of reference soon after, which would then allow the ACOP from 1995 to be revoked. “For Industry, By Industry”, we as a collective will be able to grow the standards around forklifts, making forklifts and their use safer going forward. The association held it’s AGM in early October. As part of the proceedings, we had two board members stepping down – Michael Biddick (Forklift Solutions, Auckland) and Jonny Orr (Forklift Hire Services, Blenheim) who we thank for their input since the association’s inception. Two new nominations were received and voted onto the board. Des Walsh of Central Group, Wellington and Jamie TeRangi of the Independent forklift Company, Christchurch are the new appointees. They both bring new ideas and energy to the table as we grow as an association. ■ Watch this space for new initiatives and other developments as we work towards building a stronger association.

ince donning my HIANZ shirt in early August it has certainly been an interesting ride!

After a brief set up period it was straight into conference and then straight into lockdown. The conference was a great opportunity for me to meet a large percentage of our members and to get a better appreciation for the scope of equipment and operations you all manage on the day to day. Some of you I had met previously, but for most It was a great opportunity for me to get a feel for who our members actually are and what they do. I must admit, I felt a little bad enjoying the fruits of what must have been a huge undertaking by both our members and the HIANZ team to produce a conference of that calibre without contributing myself.

In my previous role, I managed to paint the exterior of my house as well as complete a few unfinished projects around my home during the first lockdown in April 2020. This lockdown however was very different. This period proved very busy for us but also allowed me to get a good look into the back of house of HIANZ. My background is in Adult Education,

Formal writing, Operations and Fleet Management. This enabled me to get stuck into both the Forklift Good Practice Guideline (GPG) for the NZFIA and the APEX level one and two Riggers course development and production as well as the APEX accreditation framework.

The GPG is well underway with a diverse team of subject matter experts contributing to its production. We have opted to run with a GPG over the Current Approved Code Of Practice (ACOP) format for multiple reasons. the current ACOP is in need of modernization, being issued and approved by the minister of labour in May 1995. We as an industry are keen for a reference guide that is;

While leaning on the experience and knowledge of Greg Ward, Andy Youngman and Rodney, we have together produced the course content and successfully held two Level 1 and one Level 2 Marquee Riggers courses In Christchurch and Taupo. One great aspect of building a training package is that you become well versed in the guidance and regulations for that particular industry. I now have a good technical grasp on the industry and its processes and am now looking forward to getting more hands-on experience putting up Marquees to close that loop. I have now chalked up three installations … So have a wee way to go.
