“Since the launch of the Genie SX-135 Xtra Capacity (XC) interest in this type of boom lift has increased appreciably,” says Youngman Richardson & Co Ltd Sales Director, Phil Fairfield. “Feedback from customers over recent years has directed Genie’s engineering efforts toward allowing for more people and equipment to fit in the platform. The Genie SX-135 XC boom’s innovative design means that it offers a 3m greater outreach than any other self-propelled boom on the market. Designed with transportability in mind, the Genie SX-135 XC boom features the new Genie mini XChassis axle design, which extends and retracts the axles. EDITORIAL

From the President TIM MIKKELSEN Welcome to another promising year

I trust your summer was full of rest, recuperation and resolutions for an even brighter 2019. It’s a privilege to find each column I write a challenge - sounds ironic, doesn’t it? It comes to having a wealth of news to update on and not nearly enough space to do it in. We are thankful to be at the heart of an ever-thriving and growing, pan-sector industry.

Here are just some of the highlights

ARA Conference Hire Industry Association of New Zealand (HIANZ) CEO Phil Tindle and I have just returned from a whirlwind trip to the American Rental Association (ARA) Conference and Trade Show in Anaheim, California. It was fast-paced but a brilliant source of enriching knowledge that we are excited to apply on home soil. A positive mood to the ARA meeting, led by the ARA CEO Tony Conant, set the tone for robust and productive discussions. Key takeaways included the rise and rise of digital innovation and the role e-commerce platforms will increasingly play in our future and how big data is informing valuable business decisions and Customer Relationship Management (CRM). The European Hire Association’s (HAE) new Managing Director, Rupert Douglas-Jones, updated us on the UK’s foray into Virtual Reality (VR) use. Companies across the UK are now using VR in their safety training; participants don VR goggles and can navigate and identify hazards in simulated settings like working on scaffolding, so they can develop and refine essential skills. The future is full of promise, and we are excited to embrace change in New Zealand. Board Activities I’m thrilled to report that our brand new Association website is near completion. The presentation of the website is synonymous with what

HIANZ and its members stand for - professionalism, great attention-to-detail, and excellent communication. A members’ area will be incorporated into the site. This forum will host useful information as well as an e-commerce platform to order stationery. Our website should be up and running by the conference. Speaking of which… Conference and Trade Show Anticipation is growing as we head towards one of our major annual initiatives - our 2019 Conference and Trade Show. This year’s theme is People & Profit. The conference provides an excellent opportunity to take time away from the grind, and mix with likeminded people. This neutral backdrop is perfect for networking and being part of a great sharing environment. This year’s event will be at Claudelands Event Centre in Hamilton. We are looking forward to a positive conference with our loyal suppliers and a core theme of wellbeing which should be a priority for us all. Valuable progress As ever, progress is ramping up on all fronts. Four of our Equipment Safety Data Sheets have been completed and are presently being trialed ahead of hitting the market. We are looking forward to delivering these at the conference. The New Zealand Forklift Industry Association (NZFIA) is gathering momentum, and at HIANZ, our membership is already on a positive growth trajectory for 2019. We are proud to see a net gain in our membership year-on-year. On behalf of HIANZ, we wish you all a positive few months ahead, and I will check back in with more updates in my next column. Kind Regards TIM MIKKELSEN President | HIANZ

HIRE COMPANY NEWS

HIRE BUSINESS EXPANSION KNOWS NO LIMITS

If winning a silver Hire Excellence Award at last year’s conference wasn’t enough, brother and sister duo Mark & Carla Bacon have recently gone one step further by becoming the majority shareholders in Party Warehouse and Hire King.

M

ark and Carla with their previous business partner started Party Warehouse in 2001 and in 2014 the three of them branched out into general hire with the launch of Hire King. Since buying out the other business partner last year Mark and Carla have set about strengthening their long term position in the market. After a number of years working across both companies, Operations Manager for Party Warehouse, Liam Ambrose and Fabian Kulpe, General Manager of Hire King have retained their respective positions and have recently been appointed shareholders.

On the back of a record summer for both Party Warehouse & Hire King the businesses are looking to 2019 to further expand their product range and geographical reach The Hire King Cromwell branch set up in the Central Lakes region in 2016 has recently moved into fantastic new premises and at the same time taken over a small local hire company and

merged it into the operation. “It’s great to see these kind of initiatives happening in our industry, particularly within our next generation of hire company owners,” says HIANZ CEO, Phil Tindle. “As the future leaders we can only wish them every success and look forward to watching their progress over the next few years.” ◘

With a Party Warehouse and Hire King firmly established in Christchurch the group has been introducing new initiatives to take the operation of both companies to the next level. In 2018 Party Warehouse went through a well thought out and long overdue rebrand. With the new brand and tagline, “Make It Epic” setting it apart from its competitors. The group have also recently begun a new hire venture called Premier Hire. Specialising in kitchen and catering equipment this separate division nicely compliments their current hire proposition. People and profit are the two most important and inextricably linked elements of any organisation; capable of making or breaking a business and the key to unlocking its true potential

NEW LOCATION, NEW INITIATIVES HAMILTON CONFERENCE 2019

T

hey are also the all-important focus of the 2019 Hire Association of New Zealand (HIANZ) Conference.

From 2-4 July, Claudelands Event Centre in Hamilton will play host to an event where networking and knowledge powerfully intersect. ‘People & Profit’ will provide a framework for robust discussion, education and the formation of new strategic partnerships. It is a theme that represents the unwavering commitment HIANZ has to helping its members and their suppliers build a brighter future for themselves and their industry. The purpose-built Claudelands complex was selected this year as a gamechanger for the event, all in the aim of opening new doors for delegates. This includes welcoming the Elevating Work Platform of New Zealand (EWPA) industry and New Zealand Forklift Industry Association (NZFIA) industry to the party, diversifying the overall attendance. The action-packed two-day agenda will leave no stone unturned in terms of opportunities to educate and engage - a compelling lineup of speakers, including critically-acclaimed change agents and thought

leaders in the disciplines of both people and profit, will take the stage. Clinical psychologist Nigel Latta, 2019 New Zealander of the Year Mike King, Westpac Chief Economist Dominick Stephens and best-selling author Debbie Mayo-Smith - to name just a few - promise to intrigue, inspire and inform. The highly-anticipated speakers will present in the mornings and during lunch, so there is no overlap with trade time, where suppliers can showcase

refreshing disregard for political correctness, is a bona fide expert in people. His tongue-in-cheek style has won admiration and helped to remove the intimidation factor that often goes hand-in-hand with academics thus enabling more people to readily connect with ideas that can positively transform their lives.

Nigel Latta Celebrated author, TV host, and veteran clinical psychologist Nigel Latta, perhaps best known for his shrewd take on the human psyche and

their cutting-edge infrastructure and delegates can immerse themselves in the latest products, services, and equipment. With the decision taken to open the forum to exhibitors’ guests from outside the hire and rental industry this year, there will be even more positive exposure for the event, and in turn, the industry and its constituents. Festivities will include happy hour, the ever-popular fancy dress networking function and the Hire Excellence Awards Dinner & Show. This awards dinner has a sophistication and formality that is warranted for a oncea-year opportunity to showcase and celebrate business excellence in the hire and rental industry.

Latta’s life’s work has been dedicated to psychology working in a number of agencies including Child Youth and Family. He continues to work as a clinical psychologist in private practice consulting with organisations and agencies from throughout the country and has lectured on a number of senior courses at the New Zealand Police College. ◘

Mike King Capable of prying a smile from anyone, Mike King’s quintessentially Kiwi humour and life as an entertainer saw him find favour with millions early in his career. However, it was ultimately his candid admission about personal battles with mental illness and addiction that cemented King’s special relationship with New Zealand. His wildly popular radio show ‘The Nutters Club’ is on a mission to destigmatize mental illness in society. The show evolved from Mike’s own experience of mental illness, and it aims to ‘forever change the way people feel, think, talk and behave in relation to mental health.’

The purpose-built Claudelands complex was selected this year as a gamechanger for the event...

”

Mike also works with all levels within an organisation to help with mental health and safety in the workplace. His message tells of how he overcame drug and alcohol addiction, and his continued battle against depression. It is accessible and pertinent to all staff and often helps companies identify anyone who may be struggling and in need of further assistance. ◘

Weary heads, brimming with new ideas, will enjoy rest and comfort at the Novotel Tainui and Ibis Hotel - details can be found at www. hireconference.nz The HIANZ membership is growing and continues to support thriving members who in turn help their organisations be the best they can be. SINOBOOM

The Chinese Brand Shaking Up Nz’s Ewp Market “Customer feedback on how well the products are performing over time, with years of trouble-free use, made it clear that the time was right to formally bring the brand back into New Zealand and to forge an alliance between Elevated Access NZ and Sinoboom,” says Terry Tibbitts, National Sales Manager for Elevated Access. Already New Zealand’s biggest distributor of Skyjacks, this partnership is a strategic move that will allow Elevated Access to offer huge benefits to local hire companies looking to add robust, reliable and affordable machines to their fleet.

EWP specialist Elevated Access NZ Ltd is proud to have signed an exclusive agreement to distribute Sinoboom products in New Zealand. “We are very excited about this new opportunity with Sinoboom as it will enable us to offer hire companies solid, reliable scissor lifts at an affordable price. Being able to expand their fleets gives the added bonus of helping our clients avoid the need to cross hire from a local competitor. This can often result in invoicing issues for hire companies, as well as the potential risk of losing their customer to a competitor,” explains Tibbitts. “Many brands build to a price, rather than to a standard,” says Karen Williams, Director of Elevated Access NZ. “With Sinoboom, it’s clear that their priority is excellence. Over the years, they have not only listened to our feedback but have actually, changed their products in accordance with our suggestions. This commitment to continuous improvement has resulted in machines which are surpassing all our expectations.” This has been borne out by the remarkable performance of Sinoboom EWP’s in the tough conditions of New Zealand’s climate, and the demanding requirements of hire companies. “We have seen first-hand how well Sinoboom machines last, and their exceptional performance over the years,” says Terry Tibbitts. “Whereas clients might once have favoured products built elsewhere, the quality PAGE 12

- HIANZ HIRE & RENTAL 2019

of these Chinese-made Sinobooms is undeniable. Chinese made machines are now the norm rather than the exception. Of course, not all Chinese-made machines are created equal. Our customer feedback speaks for itself and we know that the Sinoboom brand is one of the best in the world. “When we unpacked the very first shipment of the new machines, we were absolutely blown away with the improvements which have been made. The paintwork on them is beautiful. You can see that giving them three coats with the new Beckers paint makes a huge difference, and means that the machines are going to stay looking nicer for longer which is of real importance to our hire company customers. The welds are top notch, and the whole look and feel of the machines is just excellent.” In fact, so impressive is Sinoboom’s excellent reputation for manufacturing that they have recently been manufacturing access equipment under licence for one of the world’s

largest and most respected construction equipment brands. The official partnership with Sinoboom is a strategic decision that will play a role in the continued growth of Elevated Access NZ, which is one of New Zealand’s leading EWP suppliers. “Putting more of our energy and focus into the sales and distribution of Sinoboom products is going to have obvious benefits to our clients, as a cheaper, more reliable machine results in higher profit for our customers, but it’s also a very important business decision for our company,” says Terry Tibbitts. “Sinoboom scissor lifts now pose a huge threat to other scissor lift brands out there and we’d rather be supplying them, than trying to sell against them. There are very exciting times ahead.” ◘ For more information, please contact: Terry Tibbitts - National Sales Manager, Elevated Access NZ Ltd Email: terry@elevatedaccess.co.nz Ph: 021 500 486

INDUSTRY NEWS

Hire industry intelligence set to increase It’s been said more than once that data is the new oil. Why? Because it is capable of creating significant wealth, particularly of the intellectual kind.

T

he Hire Association of New Zealand (HIANZ) is playing an integral role in catalysing the evolution and sharing of big data. Data that is accessible and most importantly insightful, holds enormous potential. It enables the creation of consumer-centric solutions and can accelerate business growth, market share and strategic diversification.

HIANZ is leading the charge with data-driven business through a revolutionary concept, POWERSTATS, a 100 percent cloud-based, turn-key industry data solution. The online benchmarking platform generates competitive insight in real time. One of its major strengths lies in its simple functionality. Participating businesses enter key financial data each month, after which a number of up-to-date reports and graphs are generated along with KPI’s so businesses can analyse and use the results to drive improvement and greater efficiency. In an industry that spans over 400 product catergories, HIANZ’s leadership in bringing new ideas and technology like POWERSTATS to the membership is consequential to many rental markets across New Zealand. The idea was first presented to members of the Party and Event Sector at their recent meeting in May where it was collectively embraced and will be an opportunity to pilot the program for the wider hire industry. HIANZ CEO Phil Tindle says the innovation could be a gamechanger for many other sectors involved with the hire and rental industry. “Users will be able to gain access to live, anonymised industry statistics and can

present key findings to their stakeholders. Having an indisputable evidence base allows clarity with decision-making and improves responsiveness to areas of concerns.” “Our role as a membership organisation is to lead by example, and software like POWERSTATS means we can be a true change agent by identifying problematic areas for the industry and responding with training opportunities. When it comes to performance ranking and award selection, it gives our decision-making an even greater degree of credibility as this can be informed and verified by POWERSTATS as a reliable third party.” Collectively, members of the hire industry can harness the potential of POWERSTATS to work together, lobbying on matters that members are passionate about while enjoying clearer and more accurate representation at industry level. Following the party and events sector piloting the programme, an industry-wide rollout is potentially on the horizon. ◘

HIRE COMPANY focus

Bay Of Plenty Hire Adds Display Company To Mix James Mollison and John Culpitt first met in the mid-1990s when James set up ‘The New Zealand Convenience Company’ with the first luxurious mobile loos in the country and John was at Carlton Party Hire. James’ business was purchased by Carlton and James worked for Carlton with John for a few months.

J

ames purchased Tauranga Party Hire in 2013 enticing John to work with him there for 18 months. In August 2017 John and James set up BOP Event Hire, initially wholly owned by Tauranga Party Hire becoming an agent for Peek Displays. Within weeks it became apparent that running the two businesses together was confusing and not sustainable. Tauranga Party Hire with all Marquees and Party Hire stock was sold to excellent new

owners, Nathan and Amy Dolman at the end of 2018. They have retained all key staff and run the business extremely proficiently with great energy. In February 2019 John Culpitt and James Mollison jointly purchased Alpha Displays Ltd in Rotorua to focus on panels and furniture for displays, exhibitions and conferences in the wider Bay of Plenty area. James and John have hit the ground running and are excited about the opportunities for growth. They are refining the business systems with the intention that all interactions with BOP Event Hire are easy, pleasant, professional and fun. Initially the company will trade as BOP Event Hire Ltd incorporating Alpha Displays. Once BOP Event Hire has become well established the company will drop the Alpha name. BOP Event Hire now has a comprehensive and growing stock of high-quality, well maintained panels

MARKETING OPPORTUNITY

MAKING SURE YOU HAVE THE RIGHT POWER WHEN YOUR CUSTOMERS NEED IT A consistent source of power is no longer a given in today’s modern society. The ageing and ailing power infrastructure in New Zealand is by no means a guaranteed power supply and every year it fails – especially during the extreme weather conditions in winter. With the constant threat of power cuts, people need to have a place to turn when the power goes out.

B

ut which type of Honda generators do you need? Ten years ago, most hire companies would have had a few large industrial generators, putting out 5KvA – 10KvA, needing a crane to lift, and making a heck of a racket. Ideal for the job site, but not so much for the everyday consumer. Household back up power needs are quite different to the power needs of your average tradie. Power that comes from the grid is ‘clean’ power

and it’s a consistent level of electricity, without spikes, ensuring modern sensitive household electronics don’t get damaged. Hooking your laptop or phone up to a job site generator is a recipe for disaster, this is why Honda developed the very best in inverter generator technology. Honda Inverter generators use microcomputer controlled sinewave PAGE 20

- HIANZ HIRE & RENTAL 2019

inverters to guarantee grid quality power making them ideal for any sensitive electronics – and making them perfect for household users that come to your hire centre when the power fails. Inverter generators are lighter, quieter, and ideal for domestic use. Honda’s hire range starts with the super popular and perhaps the most recognised inverter generator in the world, the flagship EU22. This unit produces 2.2KvA of power and lends itself to a myriad of applications. Finally there are two versions of Honda’s 3KvA generator, the EU30iK and the EU30iS. The EU30iK is ideal for one person who needs more power and complete portability. The EU30iS delivers the same power, but with a bigger engine and fuel capacity the end user will get that extra power for longer. Honda also produces a 7KvA inverter generator, the EU70 that is ideal for food trucks, coffee carts or other caterers that find themselves off site temporarily and need power. The same EU70 is also well suited to construction as it comes with wheels and can be easily moved around the job site. The Honda EU70, a 7KvA unit, can also be fitted with a 32 amp plug to cover all aspects of remote power for tradies. If your tradies are after the good old site genny, from 5.5KvA to a massive 10KvA, Honda also has you covered. The Honda EG5500CX and EM10000

are rugged units that deliver a stable level of electrical output using a digital auto voltage regulator that allows precise output voltage at all times. This means less load on the items being driven by the generator so they can give 100% performance at all times. All of the above generators contain proven technology from the largest engine manufacturer in the world meaning that Honda generators are exceptionally reliable and incredibly hard working. These are the two things that every hire company needs from the products they invest in. Elb Provides Platform For Future Growth

Following on from the opening of its new purpose-built premises in Auckland last year and prior to that a service centre in the Bay of Plenty, ELB Equipment has now established its own service centre in Christchurch. “The new South Island service centre will continue to operate from the premises of Heavy, Diesel Parts & Service with a sizeable warehousing facility that will stock a full range of our products,” says ELB Equipment General Manager, John Grant. “In addition to this we have appointed David Revell who will be responsible for after sales support and will have an extensive inventory of parts and consumables at his disposal.” “With the company firmly on growth we are looking in future towards providing further sales support for the South Island and throughout the country and to ‘beef up’ our service and parts teams. In the meantime, we have appointed Damon Kelly to cover Ditch Witch sales in the Lower North Island allowing Carl Shepherd to concentrate his efforts in the Upper North Island, north of Taupo.” The Ditch Witch Mini Skid Steers continue to be popular with hire companies particularly the SK600. Small on size, big on power this machine with its narrow frame provides greater manoeuvrability in tight spaces which makes it ideal for a wide variety of small- scale landscaping PAGE 22

and irrigation jobs. A redesigned ergonomic operator’s station is also proving beneficial by providing more comfort resulting in greater productivity. If you’re looking for a little more grunt, then the Ditch Witch SK755 is a proven performer and lacks nothing when it comes to power and durability which means that it won’t stop working until you do. Increased ground clearance, more lift capacity, faster ground speed, longer track life and more operator comfort sets the SK755 apart. Completing the Ditch Witch Mini range is the SK1050 and the SK1550. Both models are built for the daily grind of larger construction sites. All Ditch

Witch Mini Skid Steer models come with a wide variety of attachments and in all cases provide more versatility and productivity by directing more power to the attachment itself. At this year’s Hire conference look out for two products that are beginning to transform the industry. First up is the CX Series of Walk-Behind Trenchers. These models provide a great return on investment by delivering better traction and manoeuvrability in a compact design, which is ideal for tight job sites. The other product is the FX20 Vacuum Excavator which is second to none when it comes to multiple daily short run jobs. Very transportable, most are mounted on specially designed trailers for maximum use which makes them ideal for municipal projects such as valve box clean outs, commercial and residential debris clean ups, exposing utility lines, post hole digging and many other tasks “Ditch Witch models are consistently strong because the equipment is used by so many different types of customers,” says John Grant. “With so many potential applications it makes sense for rental companies to stock the most durable and easy to maintain machines on the market.” ◘ For further information contact John Grant on 09 570 8841 or jgrant@elbquip.com

IF YOU MAKE A MISTAKE IN A HIRE CONTRACT, CAN YOU FIX IT UP LATER? By Geoff Hardy of Auckland law firm Martelli McKegg

I

t is reasonably common to make mistakes when completing a hire contract. For example, you could insert the wrong hireage rates, or make them GST-inclusive rather than GST-exclusive. Or you might overstate the number or quality of the items being hired, with the result that the hirer can insist on receiving something much more valuable than you are entitled to charge him for. You may have been persuaded by a debt collector to attach terms and conditions of trade to your hire contract, which turn out to be totally at odds with what the hire contract says. Or you may have done a side deal that never got recorded in the contract at all. But potentially the costliest mistake is if you forget to insert the duration or a hire period in the contract, which means it is for an indefinite term. Then you run the risk that the hirer might go bust, and the hirer’s bank confiscates your asset because you didn’t register your right of repossession on the Personal Property Securities Register in time. When you discover the mistake, your clients might be understanding enough to let you change the contract. But I have seen many cases where they haven’t, particularly when the change is going to cost them a lot more money. After all, when they committed to the hire they might have completely spent their budget, and it might not have occurred to them that the hire company had made a blunder when writing up the terms of the contract. Consequently, even if they accept there was a mistake, they are likely to take the view that if anyone is going to suffer the financial pain then it ought to be the hire company. And of course, if by the time you discover the mistake you are in dispute with your clients, they are likely to strenuously deny that there was any mistake at all. Where your clients aren’t willing to let you change the contract, can

PAGE 24

- HIANZ HIRE & RENTAL 2019

you do it anyway? The answer is, not easily. You can understand why. If everyone who later regretted the deal they had entered into, could simply argue that the contract doesn’t reflect their true intention and the terms ought to be changed, then no contract would ever be worth the paper it was written on. So very early on, the law adopted the approach that whatever the contract says is what you intended it to say, and it is up to you to read it carefully and get legal advice if necessary, to ensure that it does reflect your true intention. However, humans are not infallible, and there are some situations where the strict application of that rule would be unfair. So occasionally the rule is relaxed. Our law allowing you to correct mistakes in contracts goes back a long way, but in 1977 Parliament decided to tidy it all up by passing the Contractual Mistakes Act which is now known as Part 2 Subpart 2 of the Contract and Commercial Law Act 2017. That Act allows any court or tribunal to make any order that it thinks is just, including an order modifying the contract or an order that the other party pays you compensation. That doesn’t mean that you can ask the Judge to annul your marriage on the grounds that you didn’t realise she would nag you incessantly and watch soap operas all day, nor does it allow you to reverse that $50,000 bet you put on the All Blacks when Namibia pulled off the upset of the century. It only applies when what you believed was the true situation, turns out not to have been true at all. Like when you thought that the only excavator you have in your inventory would become available by the end of the week – or in fact both you and your customer thought that – but it turns out that you had double-booked it. Unfortunately for hire companies, the contractual mistakes legislation isn’t the get out of jail free card you

might have thought. For a start, you have to apply to a court or tribunal - and that means significant costs, interminable delays, strenuous opposition by the other side, and no guarantee of success. Furthermore, the fact that you are the one who made the mistake counts against you. But most importantly, the Act says the court or tribunal can’t do anything for you if your mistake was a mistake about the interpretation of your contract. And if your contract doesn’t say what you thought it said, that is a mistake about its interpretation. For example, in a 2002 High Court decision (Clements v Singh) the Judge ruled that a mistaken belief that a contract price was exclusive of GST when in fact it was inclusive of GST, was a mistake about the interpretation of the contract, and the contractual mistakes legislation could not assist. All is not lost, however. There is another law called the “equitable doctrine of rectification of contract” which is not subject to the same limitations as the Contract and Commercial Law Act 2017, and it can assist when your mistake related to the interpretation of the contract. To get the contract corrected under the equitable doctrine, you have to prove that both parties had agreed on something – for example that the promoters of the music festival who you had hired the marquee to would reimburse you for the cost of the building consent – but when the contract was drawn up the parties had forgotten to record that arrangement. If the promoters later deny they were liable for the Council’s fees, and your hire contract doesn’t back you up, the equitable doctrine might just help you out. The equitable doctrine won’t help you, however, where the written contract correctly records both parties’ understanding, even though that understanding was mistaken. For example, if both the party hire company and the parents of the

LEGAL

“When you discover the mistake, your clients might be understanding enough to let you change the contract. But I have seen many cases where they haven’t...” bride thought that the wedding was booked for the 14th of May, but the venue has them booked for the 24th, even though they were ignorant of the mistake at the time. Or the car rental company and the backpackers believed that a campervan would be able to get them to their destination, but unbeknown to them, DOC rules state that only 4 wheel drives can access that road. If in actual fact the contract doesn’t record what the parties had agreed on and you can use the equitable doctrine, you face similar disadvantages to those you face with the Contract and Commercial Law Act 2017 – you have to apply to a court or a tribunal, and it is a bit of a gamble. Rectification of the contract isn’t automatic, so if they think it would be unfair to the other party, they won’t grant it.

Fortunately, there is another way you can get some relief from the consequences of a contractual mistake, which isn’t subject to the same strict rules, and is quick and economical. The only hitch is that the other party to the contract must dispute your claim, and the loss it has caused you must be $15,000 or less. What you can do is apply to the Disputes Tribunal, which is our small claims court. It costs you very little to file a claim and the case gets disposed of within a few months. It doesn’t cost much in legal fees because at the hearing (which is quite informal) you argue your case yourself. Your lawyer can help you to put your claim together, but not to argue your case on the day. The Disputes Tribunals do have power to resolve disputes relating to contracts. Not only can they order that one party pays a sum of money

to another, but they can make changes to a contract. They can make those changes where a term of the contract is “harsh or unconscionable”, or a party was induced to enter into it by a mistake, or it doesn’t reflect their true agreement. So if you have become the victim of a mistake in a contract, don’t give up hope – get in touch with us, and find out what can be done. ◘ Geoff Hardy has 43 years’ experience as a commercial lawyer and is a partner in the Auckland firm “Martelli McKegg”. HEALTH & SAFETY

Hianz Update On Customer Health & Safety Information The Associations project to provide simplified Health and Safety information to hire industry customers is well underway, with five Equipment Safety Data Sheets (ESDS) now completed.

T

he ESDS’s follow a defined template, to assess and identify the key Health and Safety risks, and to present the critical information to customers in a simple one-page format. The project team, comprising of Rob Stewart (Hirepool), Paul Harrison (Upper Hutt Hire Ltd), Ross Barnett (Brainstorm Communications) and Graphic Designer Chris Leake has completed ESDS’s for five high-risk pieces of equipment:

• Chainsaws (petrol-powered)

Upper Hutt Hire, with customers being asked for their feedback. HIANZ members will have the opportunity to download data ❙ EQUIPMENT SAFETY DATA SHEET

• Excavators • Log Splitters While using a risk analysis template to identify the important hazards for each piece of equipment, the templates also make use of an “exclusion zone” principle, to restrict the number operators within the immediate vicinity of the equipment when in use. The ESDS also requires customers to plan and assess all job hazards prior to using the equipment. The challenge has been to condense all the information and provide it in a format that a customer can read and understand. To achieve this, Chris Leake’s graphic design skills have been tested, and he has thankfully developed some simple but effective graphics. The ESDS’s are continually being refined and data sheets for the first five items should be available to HIANZ members upon the launch of the new Association website. These data sheets are currently being trialled at PAGE 26

Youngman Richardson & Co Ltd Launches New Product Initiative

YR Connect Asset and Security is a new cloud-based product recently introduced by Youngman Richardson & Co Ltd to assist its customers with the servicing, maintenance and security of its construction equipment assets, all from their computer or mobile device.

S

ales Director, Phil Fairfield believes this is a big step forward for the company and will provide not only another level of service but add to the company’s reputation for outstanding customer support. “There has been a lot of time and effort involved in developing YR Connect and I would like to thank all those who made a contribution to this project,” says Phil. “This has been massive for us and I am delighted to see that we have a product that will assist with the longevity of our client’s equipment and will stand up to the highest scrutiny. Again, the beauty of this system is that all the information can be accessed from a customer’s computer or mobile.” YR Connect Asset and Security uses cloud-based GPS tracking software to help locate in real time asset locations, regardless of size whether it is a large excavator or small plate compactor, and provide protection against the possibility of theft.

Essentially this means the equipment is actively monitored and should the vehicle be stolen it can be immobilized for quicker recovery. Another security benefit is the ability of YR Connect to provide automatic alert messages when a machine crosses over a preset virtual boundary line.

For more information on YR Connect contact Youngman Richardson & Co Ltd 09 443 2436 or for South Island enquiries, 03 341 6923 or see us at the Hianz Trade Show in July.

YR Connect also sends real time scheduled and automated service reminders. Alerts are set to service milestones for each machine many of which are required to meet warranty conditions. This in turn means that our qualified workshop or on-site service teams are aware of these needs and can provide the scheduled maintenance as required to minimise downtime. ◘

NZFIA NEWS

TAKING THE FORKLIFT INDUSTRY TO NEW HEIGHTS The New Zealand Forklift Industry Association (NZFIA) has made good progress in its first 12 months. The association has strong support and continues to focus on building, developing and deploying member benefits to support existing members and to attract new members.

I

n today’s complex and busy business environment, the value of trade associations has never been more significant. Whilst the NZFIA is here to promote the best and safest practices for those involved in operating and maintaining forklifts in New Zealand, our primary objective is to provide good advice, support and value to member businesses.

The NZFIA membership base is very similar to that of HIANZ, whose membership consists of a high percentage of rental companies providing hire and lease options to various industries throughout New Zealand as well as a supporting supplier membership base consisting of manufacturers, ancillary companies, and training organisations, to name a few. The most recently introduced benefit, now available to members of the NZFIA, is a Terms & Conditions of Trade Package. These are formal agreements between you and your customer and must be acknowledged PAGE 32

GREATER SAFETY FOR OPERATOR, MACHINE AND WAREHOUSE a central control unit. Also, there is no need to construct a separate server network. Each individual radio beacon can be configured easily and individually. rowing dynamics and complexity of warehouse processes increase the hazard potential. Jungheinrich has set itself the goal of reducing the number of accidents in intralogistics and places the issue of safety for staff and warehouse permanently in the forefront. Assistance systems can help to identify critical situations in advance and minimise the risk of accidents. With zoneCONTROL and addedVIEW, Jungheinrich offers two assistance systems that both increase safety in the warehouse and improve the efficient operation of warehouse processes.

zoneCONTROL The assistance system zoneCONTROL consists of a stationary radio beacon and a mobile component on the truck including a display and a module for operators. As well as providing warnings of trucks and people in congested areas, it is also possible to regulate traffic junctions so that when truck PAGE 34

volumes are high in this area, the maximum speed is reduced to crawl speed. The same radio beacon can also be connected to the control module of a hall gate so that it opens when an authorised truck approaches and remains closed to unauthorised trucks. The driver of the truck in question receives a message on the assistance display of the truck, but the truck can also be automatically reduced to crawl speed. In addition, traffic lights or warning lights can be connected to the radio beacon to provide information to the surrounding area. zoneCONTROL can be flexibly adapted to the specific needs of the warehouse and is highly scalable. The system can also be used manufacturer-independently for existing trucks. All functions of zoneCONTROL can be covered with the same components. For the first time, this makes it possible to easily adapt it to changes in the warehouse or an expansion of the fleet. zoneCONTROL does not require

addedVIEW is a digital camera allround vision system. It is suitable as an assistance system, specifically for counterbalanced trucks. Digital camera technology is especially good at responding to difficult lighting conditions by dynamically adjusting the exposure parameters. Excessively overexposed or underexposed image reproduction, for example in lightdark transitions between the outer and inner regions of the warehouse, is thereby avoided and the driver always gets a brilliant picture of his/ her surroundings. In addition, the use of digital cameras allows the image streams of the four individual cameras to convert into a common image in real time and in such a way that the driver can see his/her truck from a bird‘s eye view. In particular, the fork tips and the tail weight are precisely inserted into the seamless image. Thanks to addedVIEW, the driver can navigate safely and quickly even in tight, congested situations with this all-round view. ◘ Please send press inquiries to: enquiries@jungheinrich.com.au

EWPA NEWS

Who services and inspects your EWP’s? Inspection of EWPs requires a high level of relevant equipment and industry knowledge and experience. EWP’s are considered high risk equipment, and the safety of operators and persons nearby is largely dependent on the overall integrity of the EWP.

M

aintenance schedules are recommended and set by the equipment manufacturer and WorkSafe NZ. In New Zealand, amongst various maintenance requirements, the schedule requires EWPs to undergo a Safety Inspection every 6-months (L1) and Major Inspection when the EWP is 10 years old and every subsequent 5 years thereafter (L2). All maintenance and inspections are required to be completed by competent persons ONLY and are to be recorded in the EWP equipment logbook.

The EWPA has encountered numerous instances where 6-month certs and major inspections have been and are being carried out by persons or companies who are not necessarily competent and experienced, have little or no understanding of EWP operation, safety envelopes & management systems, access to the service and maintenance manuals or knowledge of service and safety bulletins. In a lot of instances and often, these are engineering companies who believe there is only a need to visually check the structural integrity of the EWP, which could not be any further from reality. There have been many instances where safety devices have been bypassed or disconnected rather than repaired, with no knowledge by the owner which has placed the safety of operators in serious jeopardy and has places the EWP owner in serious breach of HSWA Act.

PAGE 40

- HIANZ HIRE & RENTAL 2019

Considering these serious matters, the EWPA released the “Registered Inspector” program in 2018, with the aim to provide EWP owners with access to a register of companies who prove competency, technical training, industry experience and are moderated by the EWPA. These registered inspectors and their companies can be trusted and relied upon to complete the required safety inspections to industry standards and in line with the equipment manufacturers recommendations. Legally, it is the duty of the EWP owner, to ensure that any person or company who services or inspects

the EWP is suitability experienced and qualified AND completes the work to the recommended standards. Choosing an EWPA registered inspector will ensure you meet this duty of care. Owners of EWP fleets are strongly encouraged to support this initiative by engaging the services of ONLY EWPA registered inspector companies. If you are not using an EWPA registered inspector, then you could well be exposing your business, staff and customers to extreme risk. ◘ The register can be found at www.ewpa.org.nz/RIC

Hire Friends Reunion 2019 The Hire Friends group recently held their annual get together in New Plymouth ably organised and MC’d by Max Rutherford. A starting registration of 31 unfortunately slipped down to 25 attendees due to health issues. We also missed a few other regular attendees who were unable to make the trip.

W

e started off on Thursday 11th April with drinks and a catch-up and talking and as everyone knows hire people know how to talk. For those of you who know Harvey Bryant, he still has a repertoire of jokes. An early night was had after travelling through the diabolical weather on the way to New Plymouth.

Friday 12th was a bus trip around Taranaki with stops at an amazing taxidermy museum, lunch at The Mountain House (where we couldn’t see anything due to the weather) and then to the famous Tawhiti Museum near Hawera. If you are in Taranaki you should not miss going to this museum and allow yourself plenty of time. Drinks and dinner that night at the Auto Lodge was thoroughly enjoyable with a relatively early night due to the advancing age of the participants. Saturday 13th, nothing organised for the morning so each to their own devices. In the afternoon a bus trip around New Plymouth viewing historical sites and places of interest with a commentary from Max and our driver, a walk over the famous Te Rewa Rewa Bridge and afternoon tea at the golf club by which time the weather was beautiful and we got a good view of Mt Taranaki. Drinks and dinner at the Plymouth Hotel with a great meal, a few speeches and a discussion of where to meet next year, probably Dunedin in March. Sunday 14th breakfast together at the Plymouth and then the majority of us headed home. A great few days was had by all thanks to Max and his team. For those who don’t know HIRE FRIENDS is made up of people who have been involved in the Hire Assoc who have retired or sold their businesses but would like to remain in touch. If you would like to be on the mailing list for our next function contacts are as follows. ◘ Bruce Wallace bruwal@xtra.co.nz Anne Lane annelane@xtra.co.nz Max Rutherford cmr.mtr91@gmail.com PAGE 42

PARTY & EVENTS

‘INSTA’ PERFECT KID’S PARTIES: FROM THE YUM TO YOUR...SEAT. Gone are the simple days of pass the parcel, pin the tail on the donkey and a sugary feast of fairy bread and home-made cake. Kids parties are bigger, brighter and simply…beautiful. Parents are now outsourcing these magical moments for a (smarter) stress-free Instagram-worth party. Cue opportunity for party rental and hire companies.

A

ny successful party is built on the foundation of great furniture. The tables that carefully and responsibly support all of that magical food, the seats that hold the little darlings safely. Everyone will remember the party where the table legs buckled and cake tumbled to the floor. No-one wants to be that parent. Quality chairs and tables specifically designed for kids are a sound investment for any Rental and Event company.

Top 6 features to look for in event seating for kids... #1: Stylish and easy to theme Kids chairs that are easy to decorate but also look sophisticated allow parents to choose how much they decorate without compromising on style. With bright colours trending, white chairs that go with any colour are a sure-fire hit. The options are endless, we’ve seen fairy wings, superhero capes, floral headpieces, and balloons adorn the backs of kids chairs, creating a stunning look at the party table.

PAGE 44

- HIANZ HIRE & RENTAL 2019

#2: Safe and sturdy Safety is paramount and seating that has no dangerous parts or sharp edges is a must. Kids chairs need to be sturdy enough to handle the wriggliest of bods. Look for a kid-friendly finish to your seating solution – no splinters, no screws? No worries!

#3: Kid-sized – they’re little people, remember! Appropriately-sized furniture signals to kids that this is for them. They don’t have to struggle with climbing up onto an adult-sized chair or attempt to eat their meal with their head barely above the table. A comfortable guest = a happy guest.

#4: Easy to clean Children. Are. Messy. FACT. Anyone who has children, or has seen a child eat will realise that furniture will get dirty. Kids chairs that will be used many times over need to have a fuss-free design (no grooves, nooks or crannies) and be super easy to clean to avoid the next customer receiving a hidden present of a week old piece of cake.

#5: Durable yet lightweight Kids are tough. Their furniture needs to be tougher. Seats need to be able to withstand being stood on, wriggled

on, painted with ketchup and pushed over when it suddenly turns into a ‘boat’. This strength needs to be built into a lightweight design ensuring small guests can easily move their seat. With an increase in outdoor themed events, UV resistant seating will help protect your investment as this trend evolves.

#6: Stackable and foldable Event seating must be easy and efficient to transport, simple to set up, and either stackable or foldable in order to maximise space during transportation and storage when not in use. Investing in style, quality and durability will see your inventory last beyond the current trends. Offer your customers a sophisticated, yet practical, seating solution for their next big event with little bods and make their day #insta-perfect from top to bottom! Check out Alloyfold’s children’s event chairs and tables: the popular Junior Chiavari (or Tiffany) and Junior Bella designed for Rental and Hire companies. ◘ For more information visit: www.cranesales.co.nz

Party & Events Sector Embraces New Direction

Members from around New Zealand met at the Party & Events Networking Meeting in Hamilton earlier this month

T

he meeting focused primarily on a proposed marquee industry standard, best practice and guidance document. Attendees were presented with a draft copy to review, discuss and consider as the new benchmark and standard for the industry. “Industry consultation is vital to the successful outcome and stakeholder buy-in. These forums provide an opportunity for stakeholders to be involved and to have a positive impact for the Marquee sector” said Phil Tindle, HIANZ CEO. The meeting also included an exercise where members appraised a new device to measure the peak holding force of stakes, a forum for general business and social evening function. Objectives relating to the development and implementation of these Guidelines include; setting the standards of industry best practices; provision of templates and tools to members that bring consistency nationwide; providing a greater knowledge for key stakeholders with

a primary focus on Territory Authorities (local Councils) so they see our members as the benchmark for compliance and delivery; provide creditability to member companies who are aligned to the BPG; grow event sector membership of HIANZ; foster Best Practices to make it safer for the people erecting and using Marquees.

The best practice guide is linked to the current APEX Marquee training and includes an accreditation program that enforces various standards of professionalism, safety and compliance practices for member companies. The aim of the guidelines is to provide continued up to date and accurate information to assist

and educate territorial authorities (councils), marquee owners, installers, event organisers and end users. The guide covers areas such as; information relating to structures; Fire & Emergency Exits; Capacity & Public Access; Consenting; Code of Compliance and Exemptions; Site Safety and Competency; Personal Protection Equipment; Client Awareness; Reporting of Incidents or Injuries; Inspections; Non-compliance and Accreditation. Appendices include various checklists that will standardise processes within the industry. The Association has contracted Greg Ward (former owner of Continental Event Hire) to assist with development and to work alongside the Marquee Working Group. Further consultation with industry stakeholders will take place in June. The program is expected to be rollout in effect in July-August beginning with a workshop in July at Conference in Hamilton. ◘

KENNARDS EMPLOYEES DOWN TOOLS FOR KIDSCAN

With a history of supporting children’s charities and local communities, employees from the family-owned equipment hire business, Kennards Hire, downed tools in-branch and have shown first-hand their ‘One Family’ value at work. Having partnered up with New Zealand charity, KidsCan, Kennards Hire employees recently lent a hand packing supplies for the KidsCan’s Food for Kids programme.

M

ore than 135,000 children in New Zealand are living in hardship, and since 2005, KidsCan have been helping Kiwi kids in need meet their physical and nutritional needs. One of these programmes includes the provision of a range of staple foods and snacks such as bread, yoghurt, baked beans, marmite, fruit pottles and scroggin mix to 30,000 students in low decile schools in 16 regions across the country. At the beginning of the school term, the local Kennards Hire team headed to the KidsCan warehouse in Albany, Auckland to muck in and pack more than 130 pallets of food and supplies, setting them up for delivery to some of KidsCan’s 732 partner schools. Nigel Annear, New Zealand Area Manager, said that working with KidsCan was an honour, emphasising how important supporting local community projects are to Kennards Hire.

PAGE 50

“

Proper nutrition is absolutely integral for young children...

”

“It is extremely important to Kennards Hire and our team to help the wider community, especially when it comes to initiatives as meaningful as this. Giving some of these kids a decent meal at school is sometimes the only meal they get that day,” said Nigel. “Proper nutrition is absolutely integral for young children. The programme has had a remarkable effect on improving student’s learning ability and concentration levels at school, and it’s great that our team have the opportunity to help the future of our country be in the best possible position to succeed.” Julie Chapman, CEO of KidsCan, said the organisation is very grateful

for Kennards Hire’s support and to be working with a business that shares similar values. “At KidsCan, it’s our mission to provide food, clothing and basic healthcare in schools to enable children in need the opportunity to be more engaged in their education and reach their full potential. Having Kennards Hire support our cause means that we can continue working to prevent children in hardship from becoming adults in hardship, giving them the start in life they deserve,” said Julie. Kennards Hire is proud to be partnering with KidsCan, one of the charities supported through the Kennards Hire Foundation, and the family-owned business is excited about a brand new local schools programme to be launched early 2019. ◘
