Medicare Open Enrollment Means More To Boomers Than Ever

ach year, Medicare Open Enrollment begins on October 15 and ends on December 7. It’s an important opportunity for eligible individuals to select a Medicare plan that best meets their current and potential health needs, and also offers crucial protection for unexpected costs.
Today, boomers expect to carry more debt into retirement; only 34 percent expect to retire debt-free. One of the main drivers of debt for this demographic is the nationwide increase in health care costs. Boomers—an estimated 74.9 million Americans aged 53 to 71 in 2017—will likely live to around age 85, on average, according to the Social Security Administration, and unexpected health issues associated with age can drain savings and increase the risk of added debt. During Medicare Open Enrollment, middle-income boomers can identify health care savings opportunities and prepare for unexpected costs related to illness or injury, with the goal of achieving a more personally satisfying retirement. Here are four tips to consider as you plan for Medicare Open Enrollment: 1. Create a monthly budget to assist in managing your debt. Boomers are realizing they will not be as financially independent in retirement as they once expected. Examine your monthly financial obligations and create an achievable budget to manage your income and pay down debt. 2. Determine which Medicare coverage plan is right for you. Although it’s been 10 years since the worst financial crisis since the Great Depression hit the U.S., most middle-income boomers say they still don’t feel their finances have fully recovered. Martinez, purchased from Defendant Philip Hubbell and Philip Hubbell’s spouse, the following described property in Bernalillo County, New Mexico by General Warranty Deed (hereinafter the “Property”): The Southern one-half (S ½) of Lot numbered 17-B of the Dora A. Williams First Addition to the City of Albuquerque, New
Mexico , as shown on the Plat of said Addition filed for record February 12, 1941, in the records of the Bernalillo County Clerk, Bernalillo County, New Mexico. 14. Upon information and belief, a warranty deed was completed conveying the Property from Defendant Hubbell to Robert Martinez and Mary Adele Martinez, husband and wife as joint tenants but such deed was not recorded with the Bernalillo County Clerk’s Office and has since been lost. 15. The last deed in the chain of title which is of record with the Bernalillo County Clerk’s office is dated June 23, 1958 and shows Mr. & Mrs. Philip Hubbell as owners. See Exhibit A attached hereto. 16. From the time the Property was purchased from Defendants Hubbell, Robert Martinez and Mary Adele Martinez as husband and wife exercised all rights of ownership and possession over the property to the exclusion of all others. Such actions included but were not limited to the constructed of a garage which is situate on the Property and an adjoining property identified as Lot 17A, also owned by Robert Martinez and Mary Adele Martinez. See Exhibit B attached hereto. 17. From the time of purchase to present, Robert Martinez and Mary Adele Martinez have been the assessed owners of the Property and have paid all property taxes associated with the Property. See Exhibit C attached hereto. 18. Upon information and belief, there exist certain Unknown Claimants of Interest that may claim an interest in the Property that is adverse to Plaintiff. QUIET TITLE 19. Plaintiff re-alleges all allegations set forth in Paragraphs 1 through 23 above as if fully restated herein. 20. Plaintiff is unable to discover the location of Defendant Hubbell, his spouse or their heirs, successor and assigns. Due search and inquiry has been made to ascertain the names, residences, or whereabouts of such claimants, but such information is unknown and cannot be ascertained by Plaintiff and constructive service of process can only be obtained upon them. 21. The names of other possible claimants adverse to Plaintiffs’ aforesaid title and estate are unknown and cannot be ascertained. Plaintiff is credibly informed and believes that there are other persons who may make claims adverse to Plaintiff’s title and estate in and to the Property, and Plaintiff therefore makes all such claimants parties defendant hereto under the style The Unknown Claimants of Interest in the Premises Adverse to Plaintiff. The Nature Conservancy upon the Decedent’s death. 4. A representative of The Nature Conservancy went to the house and learned that the Decedent’s personal possessions and a vehicle are in the house and garage. 5. The TODD entitles The Nature Conservancy to possession and ownership of the house, but it does not convey ownership of any of the Decedent’s personal possessions. 6. It does not appear that a probate proceeding has been initiated for the Decedent’s estate. The Nature Conservancy does not know if the Decedent executed a Will. 7. The Nature Conservancy is not aware of any of the Decedent’s heirs. The lawyer who prepared the TODD, John Lieuwen, is deceased. The Personal Representative of John Lieuwen’s estate has been contacted and he is unaware of any of the Decedent’s heirs. 8. Pursuant to Section 44-6-4 NMSA 1978, The Nature Conservancy petitions this Court to construe its rights under the TODD. Good Options For Funding Your Long-Term Care
M
ost Americans over the age of 65 will require long-term care at some point in their lives, with today’s average senior likely to incur $138,000 in future long-term care costs, according to the U.S. Department of Health & Human Services. This is different from medical care and includes personal help with daily living activities such as bathing and dressing. These services are typically not covered by Medicare or other traditional private health insurance. Unfortunately, the cost of long-term care insurance has risen significantly in the past decade and the number of carriers selling coverage has shrunk from roughly 100 to only a dozen or so now. That leaves Medicaid as the primary insurance coverage source for long-term care needs, but qualifying for Medicaid requires the virtual depletion of all personal assets. Faced with this dilemma, American seniors must get creative about how to pay for long-term care or risk a major hit to their retirement funds. The National Association of Insurance Commissioners (NAIC), the U.S. regulatory support organization created by the chief insurance regulators from all 50 states, formed a Long-Term Care Innovations Subgroup to study this issue. The group recently issued a report that endorsed some viable options for privately funding long-term care costs. Four specific options they laid out included the following: • Single Premium Permanent Life Insurance Policies • Annuity Long-Term Care Hybrid Policies • Impaired-Risk Payout Annuities • Life Settlements.
Of these recommended longterm care financing options, a life settlement is the only one that does not involve seniors buying anything or spending any money out of their own pockets. A life settlement is a proven strategy for generating cash from an unwanted or unaffordable life insurance policy. In a life settlement transaction, a senior sells his or her life insurance policy to a third-party investor for an immediate cash payment. The investor then takes over the premiums on the policy and collects the death benefit when the insured passes away. Consumers who sell their policies receive a lump sum payment that is generally four or more times greater than if they lapsed or surrendered their policy, according to the NAIC, and these funds can then be used to pay for long-term care expenses without depleting other retirement assets. The NAIC report also notes that seniors “in immediate need of long-term care can sell their life insurance policies and receive the proceeds of the sale free from federal tax (Internal Revenue Code §101(g)). “Some elder care providers and professional advisors recommend that their clients consider using life settlement proceeds to fund an account with a bank and trust company to make monthly payments directly to a designated longterm care provider,” says the NAIC report. “Upon death, in addition to a modest reserve to defray final expenses, any remaining balance in the account is paid to a designated beneficiary.” For more information or to find a life settlement professional who can help you look into this option and see if it makes sense for you, call (800) 6649024 or visit the LISA website at www.lisa.org. -NAPSI

First Artifacts in Place at National Army Museum
T
he National Museum of the United States Army is under construction, and four artifacts are already in place. These unique pieces of Army history are so large that crews pre-positioned them early in the construction process so the Museum’s walls could be built around them. The first two artifacts were the M3 Bradley Cavalry Fighting Vehicle that led the 2003 charge from Kuwait to Baghdad, and the M4A3E2 Sherman “Jumbo” Tank, known as “Cobra King,” which was the first tank to break through German lines during World War II’s Battle of the Bulge. Crews then installed an LCVP, one of the few remaining Higgins boats certified to have carried troops ashore at Normandy on D-Day. The fourth artifact, a Renault FT-17 Tank known as “5 of Hearts,” made history in World War I when it led an attack on enemy lines near Exermont, France. It is the only known surviving Renault FT-17 Tank used in combat by U.S. personnel.
A World War I Liberty Truck, Korean War-vintage Jeep, and Huey helicopter will be added on later dates. The Museum’s construction is being funded privately through a campaign led by the Army Historical Foundation, with nearly 158,000 Founding Sponsors to date. The Foundation is also raising funds through the Army Brick Program, which allows individuals and groups to order personalized bricks that will line the Museum’s outdoor pathways. The U.S. Army has preserved and restored the artifacts that will be displayed in the Museum, which is being built at Fort Belvoir, just south of Washington, D.C. If a warranty claim arises, these records will provide proof that maintenance has been performed in accordance with the manufacturer’s recommendations and requirements. “It’s a common misconception that only car dealers can perform the routine maintenance and repairs on a newer vehicle that is under warranty,” said Rich White, executive director, Car Care Council. “The truth is that consumers can have routine repairs performed by their local independent repair shop or do the work themselves without affecting the warranty.”
By law, independent repair shops can also provide services to maintain your new-car warranty. Consumers are protected by the Magnuson-Moss Warranty Act, enforced by the Federal Trade Commission (FTC), which prohibits a manufacturer from voiding the vehicle warranty because service was done by a nondealer. According to the FTC, “It’s illegal for a dealer to deny your warranty coverage simply because you had routine maintenance or repairs performed by someone else. Routine maintenance often includes oil changes, tire rotations, belt replacement, fluid checks and flushes, new brake pads and inspections.” It’s also important to note that the “Magnuson-Moss Warranty Act makes it illegal for companies to void your warranty or deny coverage under the warranty simply because you used an aftermarket or recycled part.” When using a nondealer, independent aftermarket shop to maintain your vehicle, the council strongly recommends you keep records and receipts for all maintenance done to the vehicle and adhere to scheduled maintenance re 63¢ / line for first week
