This cause coming on to be heard on Petitioner’s Second Amended Petition for Condemnation and Application for Preliminary Order of Entry, pursuant to NMSA 1978, Section 42-2-6, permitting the Petitioner to immediately enter and occupy the premises sought to be condemned and to do such work thereon as may be required, and the Court, being sufficiently advised in the premises, FINDS: The grounds for Petitioner’s Application for Preliminary Order of Entry are well taken and a Preliminary Order of Entry should issue upon the deposit with the Clerk of this Court of the sum of $864,550.00.

IT IS THEREFORE, ORDERED AND DECREED the Petitioner’s Application for Preliminary Order of Entry is granted and Petitioner is granted the right to immediately enter and occupy the premises sought to be condemned and to do such work thereon as may be required.

IT IS FURTHER ORDERED AND DECREED in furtherance of the work as may be required, the Petitioner is also granted a license as to the Defendants’ remaining land for the purpose of removing improvements and encroachments, or to protect the portion of the improvements which remain on Defendants’ land.

IT IS FURTHER ORDERED AND DECREED, good cause having been shown, the Petitioner’s motion for service by publication upon the Defendants “All Unknown Owners or Claimants of the Property Involved” for two (2) consecutive weeks of the Notice of Preliminary Order of Entry and Notice of Condemnation is granted.

IT IS FURTHER ORDERED AND DECREED unless objection to this Preliminary Order of Entry is filed within ten (10) days after personal service on Defendants of the Notice hereof, or within three (3) days after the last date of publication of the Notice thereof on those Defendants not personally served, the Court shall proceed to make this Preliminary Order of Entry permanent, shall restrain the Defendants from hindering or interfering with the removal of any and all improvements and encroachments on the rights of way, and the occupancy and control of the premises by Petitioner and from interfering with the work required; all subsequent proceedings shall only affect the amount of compensation allowable for the taking of Defendants’ real property.

1. Petitioner is the governing body of the County of Bernalillo, a political subdivision of the State of New Mexico and the proper authority under the Constitution and statutes of the State of New Mexico to institute and prosecute this action in eminent domain.

2. It is necessary for the Petitioner to acquire by condemnation the property sought for the public purpose of constructing a drainage pond, New Mexico Capital Outlay No. C3233283, which project is located within the County of

Bernalillo. State of New Mexico.

3. This action is brought pursuant to and under the terms of NMSA 1978, Sections 422-1 to 42-2-24 (2008) NMSA.

4. Petitioner seeks to acquire property rights in fee simple of the land described as: Tract I-A, of Sanchez Redivision, as the same is shown and designated on the map of said addition, filed in the Office of the County Clerk of Bernalillo County, New Mexico, on September 24, 2001, in Plat Book 2001C, Page 267. More particularly described in Exhibit “A” attached hereto and incorporated herein by reference.

5. Petitioner has been unable to agree with one or more of the Defendants having an interest in the subject properties as to just compensation to be paid for the property sought to be acquired. The amount offered by the Petitioner as total just compensation for said property is Eight Hundred Sixty-Four Thousand and Five Hundred and Fifty Dollars, ($864,550.00)

The names and addresses of all Defendants who own, have an interest in, or occupy the property or who own the property rights sought to be acquired, as well as any facts of legal disability, deceased owners, unknown owners, and property and property rights held in trust, insofar as they are known to the Petitioner after a search of the county records are: EAIW, LLC, WITH NO REGISTERED AGENT LISTED, c/o The New Mexico Secretary of State, 325 Don Gaspar Ave. Suite 300, Santa Fe, NM8750, as there is no listed, registered agent.

8. Petitioner also makes application to the Court for a Preliminary Order of Entry, as provided by NMSA 1978 § 422-6 (2008) on the grounds that speedy occupation is required because of the public’s need for the vacant parcel and because of approaching deadlines for the commencement and completion of the Grape Industrial Park Drainage Project.

An affidavit attesting to the need for immediate entry is attached hereto as Exhibit “B.”

9. In connection with this application for Preliminary Order of Entry, Petitioner is prepared to deposit with the clerk of the district court the full amount offered as just compensation.

10. Petitioner invokes NMSA 1978 § 42-2-20 (2008) and respectfully requests that the Court exercise its discretion and waive the surety bond otherwise required.

WHEREFORE, Petitioner prays:

(i) For an order and judgment of this Court granting to Petitioner the fee simple title to a portion of the property sought to be acquired for a public purpose, which is described in Exhibit “A.’’

(ii) For an Order of Preliminary Entry allowing Petitioner full and immediate access to the property, and waiver of the surety bond otherwise required.

(iii) That the Court determine the respective interests of the Defendants in the property taken and the amount of just compensation and the damages, if any, which the Defendants may jointly or severally sustain as a consequence of the taking

Why Investors Take a Shine to Silver

Silver is a part of everyday life in more ways than most people realize. Besides the more obvious industrial uses, silver is a key component in many products that people rely on every day. Your electric-powered car, the antibacterial thread in your sports gear, and even your smartphone all use silver.

Pioneering Fast and Affordable Broadband for the Underserved

JoeCostello did not expect to be pioneering the next era of internet equity, but this passionate entrepreneur finds himself on the frontlines of the Digital Divide. With his company Kwikbit, Costello, a successful entrepreneur, is empowering underserved and unserved mobile home communities by deploying cutting-edge internet service through a price model infused with empathy. Costello sees a world where everyone has fast, inexpensive internet - he believes that it’s a utility and should be treated as such.

Kwikbit is doing its part by expanding its impact on communities large and small, including over 20,000 mobile homes across ten states. By the end of 2024, Costello aims to be on the ground with this 1 gigabit symmetrical internet in over 150 parks, adding 10,000 residents to their service. The company will also receive funds from the California Public Utilities Commission to pilot a program to serve hundreds of unserved mobile homes. Kwikbit and Costello are a testament to what it means to be an entrepreneur in the 21st century.

Early in his career, Costello understood a critical problem with rapidly evolving technology: the fastest and best products first reach the most privileged communities. In the 1990s, mainly the wealthy and tech enthusiasts could access the internet through cable or DSL. As search engines emerged and computers became affordable, more people slowly adopted the technology. Luckily, this broadband could be used and supplied through existing infrastructure. The internet story signifies a remarkable transformation. What began as a specialized tool for a select few has become an indispensable part of most people’s lives. This shift has had a profound impact, enriching our experiences and propelling society towards greater productivity and efficiency.

The internet’s exponential growth, particularly the rise of video-heavy applications, has exposed a critical limitation: speed. The infrastructure that fueled the initial internet boom simply can’t handle the demands of today’s data-hungry apps.

The current solution pushed by major internet providers is fiber optic cables. Fiber offers the blazing-fast speeds needed for the next generation of internet, through light transmission. However, widespread fiber deployment presents a significant obstacle: the lack of existing fiber optic cables reaching individual homes. Implementing this technology will require massive investments, posing a complex challenge for the future of internet infrastructure.

“Yes, we want to have the fastest fiber cable in every home and business in America. But what people don’t realize is that it’s going to take decades for fiber to roll out, and they’re going to need something else in the meantime,” said Costello in a recent interview.

Unfortunately, as fiber optic internet is made available, the wealthy communities are receiving the new capability first. This creates an enormous problem for our country because entire communities, particularly lowincome communities, are being left behind.

“You cannot be a functional citizen of the US in the 2020s unless you have high-speed internet,” said Costello. “You will fall behind in every way –opportunities, information, finances, civic engagement, healthcare, and education. And your kids will fall behind even more!”

Costello’s passion for bridging the digital divide catalyzed the founding of Kwikbit Internet. It started with the development of a new super highspeed wireless technology that can provide the same kind of fast internet service as fiber while being able to be deployed much more quickly and economically. This new wireless technology is called WiGig, or 60 GHz WiFi.

During the pandemic, when many people were suffering from a lack of viable internet, Costello decided that the new technology should be utilized to serve the unserved and underserved. There are many communities that need better internet, but mobile home parks represent one very large group. Kwikbit Internet is 100% focused on providing its high-speed internet to mobile home parks with the goal of letting no mobile home park resident go without this critical new utility. If all mobile home residents lived in one state, it would be the third largest in the country.

Thankfully, the government has been stepping in to help bridge the digital divide in a number of ways. One of the most successful programs has been the Affordable Connectivity Program, or ACP, which partially subsidizes internet bills for more than 20 million low-income households, with more than half of recipients being over 50 years old. Ironically, just as the federal government is funding a new program with $42 Billion to bring fiber to more underserved users, Congress is pulling the plug on the ACP. Ted Cruz (R-TX) is one senator advocating for the ACP’s termination, though Texas has the 4th largest number of ACP recipients at 1.67 million households.

As the ACP’s fate remains uncertain, the Digital Divide widens.

Fortunately, some states are working to support broadband expansion. The California Public Utilities Commission (CPUC) is using federal funds to build broadband for all, including over $800,000 to Kwikbit for deploying its fixed wireless internet in unserved mobile home parks in Southern California.

From California to Florida, mobile home parks and hard-to-reach communities have a clear need that has only deepened with rising internet costs.

Kwikbit is blazing a trail toward the promise of the internet for all, one community at a time. Closing the Digital Divide takes tenacity. The time for an all-of-the-above broadband investment strategy is now, one that includes wireless gigabit and fiber technology creating a new era of internet access for those who need it most.

Tips to “Yard Your Way” This Spring

Homeowners can put their own spin on their personal outdoor space this spring by adopting a “yard your way” attitude, advises the TurfMutt Foundation, which is celebrating 15 years of advocating for the care and use of yards, parks and other green spaces.

The act of “backyarding,” which is using yards, parks and other green spaces for activities typically associated with indoor life, such as dining, working, entertaining and more, has gained traction in recent years. Now, as the weather warms, the Foundation encourages people to ratchet up their backyarding activities by identifying their personal style and personality.

“Your yard isn’t just for aesthetics,” reminds Kris Kiser, President and CEO of the TurfMutt Foundation, “It’s purposeful and contributes to our and the planet’s well-being. We encourage you to design your space that shows off your sense of style and supports what is important to your family.”

Here are six ideas to “yard your way” this spring:

Keep business in the front(yard) & party in the back. If you live in a neighborhood with strict homeowner’s association regulations, you may feel hemmed in by what you can do in the public-facing areas of your yard. But you can use the backyard to really highlight your style, whether it’s cozy and family friendly or modern and sleek.

Be sensible & sustainable. What you choose to plant in your yard can affect climate change on a microlevel, and eco-conscious homeowners know selecting native plants is good for the environment. They are more resilient, require less water and promote biodiversity. BONUS: They are also easier to maintain.

Doing budget backyarding is OK. Your yard is full of cost-saving measures that budgetconscious families can take. Skip the fancy restaurant and dine alfresco on your patio. Host a family movie night on a blanket of backyard grass. Or consider trading a pricy weekend getaway for a backyard staycation.

Nurture biodiverse digs. Human-made and synthetic environments have changed the landscape, so pollinators and wildlife rely on yards and community green spaces to bring equilibrium to the ecosystem. Planting for these local critters can turn your backyard into a private nature preserve.

DIY your lawncare…or don’t. If you are a weekend warrior who relishes DIY projects, taking care of your yard yourself can be an excellent choice. But there is no shame in your backyard game if you outsource yardwork so you can spend your time outside just enjoying your yard. You could also have a landscaping crew do the basic mowing and maintenance so you can spend your time enjoying gardening or just enjoying the yard.

Park it for outside time. Community greenspace and neighborhood parks make it possible to “yard your way” even if you don’t have an outdoor space to call your own. Want to sit under a shade tree and read? A community park often offers these kinds of resting spots. Want to do a little hiking but not travel hours out of town? An urban trail system is an excellent opportunity to hoof it close to home. You can even stake a claim to your own patch of nature and try your hand at growing things through community gardening programs.
