It was during one of these tough periods where Dianne’s endocrinologist suggested that she try something completely new. IT IS FURTHER ORDERED that the Clerk of the District Court shall deposit Petitioner’s offer of just compensation, submitted in a check drawn from the Bernalillo County bank account for the County Treasury, in an interest-bearing account, pursuant to NMRA 1-102 and NMSA 1978, Section 34-6-36, where it shall remain pending either final disposition of this matter or disbursement to Defendants pursuant to NMSA 1978 Section 42-2-6(B).

1. Petitioner is the governing body of the County of Bernalillo, a political subdivision of the State of New Mexico and the proper authority under the Constitution and statutes of the State of New Mexico to institute and prosecute this action in eminent domain.

2. It is necessary for the Petitioner to acquire by condemnation the property sought for the public purpose of constructing a drainage pond, New Mexico Capital Outlay No. C3233283, which project is located within the County of Bernalillo. State of New Mexico.

3. This action is brought pursuant to and under the terms of NMSA 1978, Sections 422-1 to 42-2-24 (2008) NMSA.

4. Petitioner seeks to acquire property rights in fee simple of the land described as: Tract I-A, of Sanchez Redivision, as the same is shown and designated on the map of said addition, filed in the Office of the County Clerk of Bernalillo County, New Mexico, on September 24, 2001, in Plat Book 2001C, Page 267. More particularly described in Exhibit “A” attached hereto and incorporated herein by reference.

5. Petitioner has been unable to agree with one or more of the Defendants having an interest in the subject properties as to just compensation to be paid for the property sought to be acquired. The amount offered by the Petitioner as total just compensation for said property is Eight Hundred Sixty-Four Thousand and Five Hundred and Fifty Dollars, ($864,550.00)

6. The names and addresses of all Defendants who own, have an interest in, or occupy the property or who own the property rights sought to be acquired, as well as any facts of legal disability, deceased owners, unknown owners, and property and property rights held in trust, insofar as they are known to the Petitioner after a search of the county records are: EAIW, LLC, WITH NO

Petitioner also makes application to the Court for a Preliminary Order of Entry, as provided by NMSA 1978 § 422-6 (2008) on the grounds that speedy occupation is required because of the public’s need for the vacant parcel and because of approaching deadlines for the commencement and completion of the Grape Industrial Park Drainage Project. An affidavit attesting to the need for immediate entry is attached hereto as Exhibit “B.”

9. In connection with this application for Preliminary Order of Entry, Petitioner is prepared to deposit with the clerk of the district court the full amount offered as just compensation.

10. Petitioner invokes NMSA 1978 § 42-2-20 (2008) and respectfully requests that the Court exercise its discretion and waive the surety bond otherwise required.

WHEREFORE, Petitioner prays:

(i) For an order and judgment of this Court granting to Petitioner the fee simple title to a portion of the property sought to be acquired for a public purpose, which is described in Exhibit “A.’’ (ii) For an Order of Preliminary Entry allowing Petitioner full and immediate access to the property, and waiver of the surety bond otherwise required.

Today, many adults have elderly parents who live independently. As the number of digital scammers preying on the elderly increases, however, your aging parents are at higher risk of financial fraud.

“You must be ready to safeguard your parents against the growing threat of digital scammers and become their trusted advocate,” says Laura J. LaTourette, CFP.® Not long ago, LaTourette had to come to the aid of her own mother, who had been targeted by scammers pretending to help upgrade her computer.

Here are several tips LaTourette offers for protecting your parents’ finances as they age:

• Talk it over. Sometimes talking about money is tricky, even with close family members. Older adults need to understand that they are at risk for fraud if they don’t have someone to help manage their money as they age. Ask about spending, saving and philanthropic habits, and know who has access to your parents’ account information.

• Form a team. Enlist other family members if needed, and identify other trusted contacts with whom your parents feel comfortable discussing money matters. If your parents work with a CERTIFIED FINANCIAL PLANNER™ professional, set up a meeting to talk about fraud protection and create an elder care plan for your parents.

• Make safety simple. Set up online account information, and show your parents how they and you can monitor account activity. Set up automatic withdrawals for monthly bills. If your parents still like to review and balance their checking accounts each month, use that as an opportunity to identify anything that looks out of the ordinary.

• Establish power of attorney. As parents age, they may need someone else to communicate with financial institutions or health care providers. Make sure your parents have an updated power of attorney that lists you and/or any other trusted contacts. The same goes for a medical power of attorney.

• Shred what you can. Many older adults have financial documents that don’t need to be kept, but because of sensitive information cannot simply be thrown out or recycled. Once you identify old financial documents, either shred them yourself at home or gather boxes of material to take to a community shredding event, which occur periodically in most communities.

• Check their credit. Be sure to monitor your parents’ credit reports at least once a year; this helps ensure that no one is opening any false accounts using their identities.

Youth Take Down Tobacco

Advocates of all ages across the country join forces on April 1, Take Down Tobacco National Day of Action, to stand up and speak out against the tobacco industry.

Demonstrations, rallies and educational events are scheduled to expose how the tobacco industry targets kids with flavored, nicotine-filled products. Youth and adults are calling on federal, state and local officials to end the sale of all flavored tobacco products.

“When I finally realized that it wasn’t just cancer that killed my grandma, tobacco did, I started my tobacco prevention journey because I never wanted to see another person lose a loved one to tobacco,” says Neveah, a National Youth Ambassador with the Campaign for Tobacco-Free Kids, which sponsors Take Down Tobacco.

The tobacco industry has a long history of using flavored products including e-cigarettes, menthol cigarettes and flavored cigars to appeal to children and other vulnerable groups. These flavors mask the harshness of tobacco products, making it easier for kids to start and ultimately become addicted.

“I’m shocked by the number of teens I see vaping who are vaping daily or even continuously. All of them are using minty, fruit flavors,” says Dr. Deepa Camenga, an addiction specialist with the American Academy of Pediatrics. “The products that are on the market have extremely high levels of nicotine and young people’s brains are particularly susceptible.”

A report of the U.S. Surgeon General found that, in addition to being highly addictive, nicotine can be harmful to child and adolescent brain development, especially the areas of the brain involved in learning, memory and attention.

Although tobacco use among U.S. teens has decreased in recent years, the latest survey shows that 2.8 million middle and high school students still use tobacco products, including 2.1 million users of e-cigarettes.

“We’ve made tremendous progress in reducing youth tobacco use, but the
