These autumnal days are the favourite ones for several companies and institutions to make their annual summary and assessment of the year in order to draw up and outline strategies and plans to follow ahead of the next financial year. There are very few corporations that are not thinking of new expansion projects, internal remodelling, changes to segments, new windows of business or simply: sweeping up and cleaning ahead of the next adventure. Sotogrande is not unfamiliar to this systematic procedure of the last quarter of the year. This is certainly the case at Grupo HCP, and over the last few weeks we have taken substantial steps forward within the heart of the company and in
relation to its structure in order to tackle 2017 with the greatest dynamism and continue to offer the best information that proven, measured and quality to you, our loyal readers. To that end, especially over the last period of the year, there is a special mention and review of all of the issues linked with this environment, whether of an administrative, institutional, logistical or infrastructural profile, which into a new calendar year, often cause the same recurrent problems as in previous years or dates, or problems that have still not had an efficient and effective solution over time. It is necessary to highlight that many of them have managed to cover at least partially issues regarding support
for tourism and beach services, or the cursed utopia of finding car parking spaces in Torreguadiaro. Many of them have provided more or less convincing solutions. On the contrary, there are others where it is necessary to keep reporting and complaining about them, as we do in the report pages of this edition of El Periódico de Sotogrande. We will also find out the concerns of the property market and how it has evolved over the last twelve months and we are beginning to count down to the celebration of a new Grupo HCP Business Forum, the eight edition, in order to gauge the situation in Sotogrande and learn about the future. We have a beautiful autumn ahead of us, there is still life left in 2016.

Full speed ahead Brexit is a worry, and a big one, in Campo de Gibraltar. This is not surprising, if to give one example, you take into account the fact that each day almost 10,000 cross the border in order to go to work in Gibraltar. The upcoming exit of Great Britain from the European Union opens up an endless list of questions not only about what will happen with relations between the member countries with the islands, but also, with what will happen with the Rock… The issue is of such importance that this week the Association of Municipalities of Campo de Gibraltar received a visit from the Acting Minister for Foreign Affairs and Cooperation with Spain, José Manuel García Margallo. From his involvement, it was made clear that it is crucial to look for a solution that is suitable for both parties, as once Brexit is carried out, it will be impossible to maintain the current situation. Co-sovereignty is the proposal of Margallo, who had no doubts about warning Gibraltar that if it ends up outside the EU, the fence would become an outside border, with all that involved.
This is the situation that we are facing ladies and gentlemen. This is very complicated and historic situation, which has a real effect on Sotogrande. There are lots of business people, architects, lawyers, engineers, etc., who constantly express their concern about how all of this Brexit issue will affect not only their bank balances, but also the future of the area in general. The value of the Pound, projects underway in Gibraltar, property operations…All of this is currently up in the air. Therefore, this year, we have decided that the traditional Grupo HCP Business Forum will revolve around this issue, while also dealing with different urban development and property projects and investments planned in Sotogrande that have recently emerged. To make it even more interesting, we are repeating the idea of last autumn (when we were lucky to listen to our beloved Carlos Rodriguez Braun) of having an interesting speaker. We will be informing you soon about all of the details…
Meanwhile, the engines continue full speed ahead. This week we concluded the 4th edition of the Sotogrande Magazine Golf Circuit with an incredible day of golf at Valderrama, which will be followed with a great party planned for Friday 21 October, at the recently opened Casino Admiral San Roque. Moving from a golf event to a luxury event. Sotogrande Magazine is the media partner of the third edition of the annual Luxomony congress, one of the most outstanding events in Spain´s luxury sector which will take place on 3 November at the Madrid hotel The Westin Palace. We have a lot of plans and we will gradually reveal them. As you can see, we have not stopped working. As the popular saying goes, it is better to do more than needed than to be found lacking… I would like to remind you that you can inform me of any matters of interest, either directly or @ JLGarciaSG.

The Town Council is planning to expand the official 2017 bathing period from 80 to 100 days, encompassing Semana Santa and mid-September, although services will only be provided if the weather is good. This was announced by Mayor Juan Carlos Ruiz Boix and deputy councillor for Public Safety, Mercedes Serrano. The mayor congratulated Serrano and the deputy for Works and Services, José Antonio Rojas, for their “excellent” work on the beaches during summer, and he extended his congratulations to “all the municipal employees who played a part in this success. As regards the lifeguarding service, the summer has ended without a single fatality. Lifeguards still had to attend to many jellyfish stings, reaching 874 in total, the vast majority during July. According to data supplied by the contracted company, Socoservis, during the official bathing period there were 91 sea rescues, 16 transfers of
patients to health centres, and 1,465 other incidents of medical assistance for various reasons, particularly jellyfish stings, though also other problems such as bruises, sea urchin injuries, fainting, heat stroke, sun stroke, sun burns...
duties defending the interests of Spain. After the official part, events continued in a more relaxed manner, with the traditional lunch which the organisation gives to various personalities in the local community; this year it was held at the Hotel Almenara in Sotogrande. The lieutenant of the Guardia Civil headquarters in Guadiaro, Carlos Molina, opened the event with a welcome speech. Molina praised the “capacity for sacrifice,
constitutional loyalty and solidarity” of the Spanish people, which “we see reflected every day in their fight for a better future.” He also thanked “all those veterans who have served for the interests of Spain,” as well as “our spouses, families and colleagues, for staying by our sides at every moment.” He also wished to praise the work of “the Town Hall, the local police, and all those entities and institutions who help so much in the exercising of our duties.”
Finally, he made special mention of the residents of Valle del Guadiaro, who he thanked for “the huge good will they have shown me since my arrival, and whom I thank for their support and collaboration,” said Molina, who was promoted earlier this year from second lieutenant to lieutenant. He added that he hopes to stay in this location until “I become captain, which won’t happen for at least seven or eight years,” he said.
Guardia Civil pays homage to their patron saint Guardia Civil agents at the Guadiaro headquarters commemorate this years saint day of the Virgen del Pilar with a day of official events Once again, the Guardia Civil celebrated with great honours their patron saint’s day, the Virgen del Pilar, with a 12 October filled with official events all over the country. At Valle del Guadiaro, as is traditional during Spanish National Day, officials and agents from the Guadiaro Guardia Civil headquarters celebrated the Eucharist in honour of the Virgen del Pilar at Pueblo Nuevo church in Guadiaro. In attendance at the official cer-
emony were numerous figures from the military, politics, and the local population, as a large number of residents come out each autumn in Valle del Guadiaro to see the Guardia Civil detachment on this date. It was an emotional mass, in which there was no shortage of praise for an institution so highly valued by the Spanish, the Guardia Civil, and remembrance of their labour and service, as well as those who died while performing their

commercial activity that was compatible. After completion of the procedure, management of the service was awarded to the owner of the well-known Torreguadiaro establishment, Mi Punto Ex-
press. The launch of this service is a response to the request from residents that had existed for a long time without being met. This meant that residents had to go to other urban areas in
order to participate in the famous State bets. From now on, the tickets will be “around the corner”. Who knows if this year, the Christmas “Gordo” (the big lottery prize) will come in Torreguadiaro. The die is cast.

Council will act on mouth of Guadiaro River if Coastal Department does not The deputy mayor for the Environment, Juan Manuel Ordóñez, has called on the Coastal Department to reopen the mouth of the Guadiaro River, faced with the risk of the death of thousands of fish from asphyxia. He added that the ecological association Verdemar requested support from the Council in order to open up a channel in the mouth, like the one in August, and it stated that “if the Coastal department does not act soon, we will have to do it ourselves in order to avoid an environmental catastrophe”. Ordóñez stated “Coastal Demar-
cation are the ones responsible for reopening the river, as they did in August following initial intervention of the Council, for which they have indeed opened a file on us. It is clear that they did not do their work correctly, because a month later the river mouth closed up again”. He stated that “we have received a written document from the ecological association Verdemar, requesting support from us in order to take action on the river mouth, although the same document also demands that the Coastal Department assumes their role of responsibility. We
are going to request authorization from the Environmental Department of the Regional Government of Andalusia in order to act, therefore if the Coastal Department does not do their work in a week and a half or two weeks, we will have to reopen the river mouth with our own resources”, he concluded. It is worth remembering that last week the mayor, Juan Carlos Ruiz Boix, sent a document to the sub-delegate of the Central Government in Cadiz, Javier de Torre, in which he insisted on requesting urgent action on the mouth of the Guadiaro
River. In fact he pointed to the fact that on 7 October the Council of Ministers approved the “agreement recording emergency work corresponding to the opening of the estuary” amounting to 60,500 Euros. He also warned that a “large number of dead fish” are beginning to appear in the area. The document, sent on Tuesday 11 October, reiterates the arguments of previous requests sent to De Torre in relation to the matter, while outlining the declarations made on that same day by the delegate of the Government in Andalusia, Antonio
Sanz. The delegate indicated that “environmental questions are the responsibility of the Regional Government of Andalusia”, and that if in August the Coastal Demarcation of the Environmental Department removed 10,000 cubic metres of sand from the mouth of the Guadiaro River (a day after the Council acted) “was an exceptional event that cannot become the norm”.

Ourselves a year later A year ago, parliament was dissolved and there was concern about the elections on 20 December. The “new politics” of Podemos seemed unstoppable. Europe was a mess: in the Greek referendum, the “no” vote had won by a percentage far higher than all the polls predicted. The economy was showing signs of slowing down, and a young new leader of PSOE was elected. A year later, politics seems to have cleared up a little, following the most uncertain period in our democracy. The prestige of Podemos began to weaken, probably because people had begun to see them govern. Europe is still a mess, but not because of Greece, where populism prevailed, and they then did the opposite of everything they had promised, but because of the UK,
where once again a referendum defied all the polls. The young leader of the PSOE dragged his party through an unprecedented crisis, though a crisis which did not seem to benefit the most radical left. Meanwhile, the PP’s corruption scandal did not hinder them, and they achieved a remarkable victory with an absolute majority in Galicia. The prospect of a third set of elections is fading. And the economy that seemed not to be going up... what happened with that? A year ago the eurozone was growing, not much, but more than the previous year. In 2015 GDP rose by 1.9 %, whereas in 2014 it had grown by 1.1 %. It is expected to grow 1.7 % in 2016, with very reduced inflation at 0.2 %. In Spain, the economy did well in the past year: it grew
by 3.2 %, whereas in 2014 this was 1.4 %. And now in 2016, when so many predicted a significant slowdown, it could grow by 3.1 %, a vigorous pace compared with the rest of Europe, and with a very low level of inflation: according to Universidad Carlos III they’re expecting a negative average rate of 0.3 %; remember that this was a negative rate of 0.5 % in 2015 and 0.2 % in 2014. Economic activity has progressed fairly well in important sectors, in Sotogrande also, and there’s a clear recovery in the real estate sector. In summary, in one year we have once again learned the old lesson which we tend to forget: things change, though we can never predict exactly what, or which, or when, or how, or why.

García Margallo advocates co-sovereignty of Gibraltar during visit to Province The acting Minister for Foreign Affairs, José Manuel García Margallo, visited Campo de Gibraltar for a meeting with the seven regional mayors and to discuss the issue of Brexit. In his public declarations, in the press conference at the Association of Municipalities as well as the Joly Forum held at Hotel Guadacorte, the acting minister stressed that we face “an historic change”, because “the colony of Gibraltar with the United Kingdom in the European Union is not the same as the colony of Gibraltar with the United Kingdom outside of the European Union”. In his opinion, the best outcome is co-sovereignty of the Rock between Spain and the United Kingdom, which would put an end to a contentious 300 years between both countries and make it possible for Gibraltar to stay in the EU. The acting minister maintains that it is “absolutely unimagi-
nable that a state outside of the Europe Union could keep a colony within the EU”, therefore it is necessary to “look for a formula that satisfies the wishes and interests of everyone affected on either side of the border fence. This is about looking for a formula so that Gibraltar´s citizens can maintain their traditions, spirit and customs, their nationality…and at the same time form part of the European Union which would enable them to keep up a situation of economic development that is highly enviable”. The Foreign Affairs stated that “Firstly, co-sovereignty between the United Kingdom and Spain, which working together would take charge of foreign relations, is exactly the condition required for Gibraltar to enter the European Union, in accordance with article 355. In terms of defence we have to resolve the problem of the Gibraltar base, where both
parties would continue to form part of the Atlantic Alliance, which would allow for a relatively easy solution”. “Thirdly – stated García Margallo – there should be a personal statue modifying the civic code so that Gibraltar´s citizens can have double nationality, keeping their British identity and acquiring Spanish nationality, a privilege that until now Spanish legislation has only afforded to the Sephardic people”. “Fourthly, there should be a regime of self-governance that is already provided for in the Spanish Constitution of 1978 in article 144-b, which talks about autonomy for territories not integrated into provincial organization. And fifth, we need an economic model that is compatible with community legislation but which makes it possible to keep carrying out activities in Gibraltar as we have done up until now”, he stressed.

Valle del Guadiaro retains share of claims in infrastructure Facing a new political season means various acts and projects which were in the pipeline under the previous administration and are still under demand from residents of Valle del Guadiaro. Many of these projects have dragged on for years, and lack a definitive and effective long term solution The beginning of a new school year also means the beginning of political activity for 2016/2017. With a view to this new season, and with improvements and projects which are still in the pipeline in Valle del Guadiaro, here is a brief review of several of the most demanded requests (many of which have dragged on for years, and been delayed by various institutional mandates, both at a regional and national level), and which are still lacking a long term solution. There are several demands from various neighbourhood and resident collectives, who have particularly demonstrated in recent times the need to find an important improvement in projects which sort out and meet the demands of citizens in this area. One of the main issues, due to its topicality, is a definitive, long term solution to the mouth of the Guadiaro river. Aside from the problem of clogging which occurs where it meets the sea, caused by a natural process in the absence of rain for long periods of times, people are now demanding a full clarification of the institutional jurisdictions and responsibilities in the future. The San Roque town council maintains that it comes under the jurisdiction of the Coastal Department of the Province of Cadiz and the Ministry for the Environment, both part of the national government; meanwhile, the state entity has emphasised repeatedly that these powers were transfered at the time, through a concession, to San Roque Town Council (who
argues that they were then transferred again after the execution of the project to the Government); even the state administration has pointed towards the Andalucian Regional Government and the Environmental Department, since river mouths fall under their jurisdiction. Whatever the legal guidelines which need to be taken into account when tackling this conflict, a long term solution for this situation is required, as it has repeated three times in just one year. With these branches, it is a matter of priority that they clarify once and for all which body is responsible, and if it is more than one, that they coordinate to work effectively together. On another issue, the arrival of
autumn is usually accompanied by the first rains in the season, in some cases (as happened in 2015) great intensity; a phenomenon which year after year creates countless problems in the region, by not having a forecast in line with the needs of the environment. One of the main focal points, probably the most important, is the fisherman’s area in Torreguadiaro, just at the foot of the beach. This is one of the most localised problem hot spots when the first rains appear, creating real issues for residents. Since there is no paved or gravel street to fill this gap, as the lane is a simple earth one, when it rains continuously for several hours the area becomes a swamp of mud, making the street impos-
sible to access, leaving vehicles isolated and allowing the level of water to rise to the doors of houses. For many years, residents of this area have demanded action at a municipal or state level, whoever is appropriate, to install safer paving which withstands the arrival of the rains. A problem which worsens with each new day of water. This phenomenon, though not as severe, also occurs in various streets in Pueblo Nuevo, with blockages in drains and manholes (as happened with the first rains last year), or some streets in the centre of Sotogrande, where it was necessary to use machinery to remove the water and clear escape and supply routes. Not forgetting Torreguadiaro, where there are many issues which arise in another of its areas, in Calle de la Iglesia. On this point in particular, with complaints from the residents’ platform, their demands are growing. The residents collective of Calle de la Iglesia in Torreguadiaro are calling for a greater degree of attention to the care and maintenance of the area, regarding a number of local issues. The groups questions the “responsibility” of the occasional fumigation of the plot of “El Vigia”,
of which it is claimed that they respect the borders of properties to avoid any consequences with, among others, pets. They are also asking for greater traffic control on this street, the correct installation of speed bumps and improvement to pavements, many of which are unusable due to fencing and vegetation. They also ask for better and more effective cleaning of the whole area, as well as environmental control of the lagoon in Torreguadiaro. On another side, there is the absence, of several months now, of a traffic mirror, by both the entrance and the exit to the tunnel from Sotogrande Marina to the Av. Mar del Sur in Torreguadiaro. On numerous occasions, this paper has echoed this urgent demand, altering people to the danger of the lack of mirrors as it leaves the final section of the tunnel blind. A similar situation occurs on the Pueblo Nuevo service road, at the exit of the car park of the two large commercial areas, where, in addition to the poor state of the traffic mirror, cars parked on both sides of the roads means that it is impossible for those joining the motorway to get a safe view of it. However, a historic demand such as the scarcity of parking spaces

at Torreguadiaro and areas adjacent to the beach, managed to find a valuable solution this summer through San Roque town council, of a simpler nature than one might imagine. Using a municipal plot of land at the upper section of the road which crosses the Av. Mar del Sur (just above the usual parking spaces for Torreguadiaro beach), greatly helped to relieve the vehicle congestion which this area suffers every summer season. The parking problem has not yet been resolved in Sierra Bermeja, in Pueblo Nuevo, though there have been various alternatives and ideas in operation to help solve this scheme. After many months of complaints and demands from residents and business owners in Sierra Bermeja, the town council decided to act, putting forward a series of alternatives for the benefit of businesses and their customers. On the one hand, marking out part of the area with a maximum parking time which would be monitered by the local police (something which ultimately did not convince the commercial side), and alternatively, the creation and clearing up of new parking areas. There’s the traffic island located between the access road to Pueblo Nuevo (from the motorway) and the ascent to the service road from the roundabout (an area which was already being used spontaneously for parking, though now more officially), and the area with trees just in front of the sports facilities; in a similar situation to the island. One of the major innovations to come, with the asphalting and exterior refurbishment of the Pueblo Nuevo Sports Centre practically already completed, will be the use of another parking area, with more than fifty spaces available.
The goal is to solve, one way or another, the urgent parking issues in the area, which directly affect businesses and restaurants in the area, one of the main commercial lungs in Valle del Guadiaro. Very close to this point are the two service roads at Pueblo Nuevo de Guadiaro, both with evident problems in the asphalt and paving of the road, which are undoubtedly two of the most common complaints in this area.
21 Informe
While the road closest to Pueblo Nuevo is very much in need of improvement, with various highly bumpy stretches, the other road (which passes in front of Sotomarket) takes the prize. The section leading from the end of the two major commercial areas to the road which leads to the A-7 to Malaga is the worst in the whole region. So poor is the asphalt that the vast majority of drivers who take this
route choose to drive in the left lane (until practically the start of the acceleration lane the service road has a double use), creating an alarming danger for traffic. It is the connection of these two service roads, at a pedestrian level, which made up a complaint heralded by the paper after numerous residential complaints this summer. The only route which connects both points (either side having the largest commercial
area arround) is through a narrow passage under the A-7 tunnel. A pedestrian path which is poorly signposted, lit, and with little visibility, making it a real risk for the continuous passage of pedestrians. Complaints reached the Plenary session of the San Roque Board, thanks to a motion presented in part by the Valle del Guadiaro Independent Party (PIVG), in which they demanded that the government provide a solution for this pedestrian path, either an elevated pathway (a very common measure in similar situations, though one which requires state approval), or an underground pathway. Under these circumstances, the government stated that they were already aware of this demand from residents and were studying various alternatives. What is certain is that so far there has still been no action taken in this regard, nor are there any known projects in the medium term. Finally, of the many others we could mention here (clearing up of green spaces, better security, repaving streets... all of which residents have submitted to this paper), we will mention a request at the regional level, the renovation of many sections of Carretera de Las Arenillas. This road, which links Castellar and the entrance to Sotogrande, is used daily by numerous workers and commercial vehicles who travel in both destinations for work purposes. Less than a year ago, a request was already made to renovate this road to the Provincial Department of Development. This department stated that in the medium term they had only planned to invest to rebuild parts of the bike path which had severely deteriorated. A greater investment in the road, even moreso at the beginning of the rainy period, should be a priority in this area.

“The property market continued to recover strongly” “The Sotogrande property market continued to recover strongly through 2015 with increased demand and a significantly increased volume of sales and supply beginning to dwindle. We have seen demand for high value property return and modest increases in sales price for the most desirable property. During the 1st ¼ of 2016 this trend continued until the British government announced the EU Referendum. Whilst fundamental demand still remains strong and sales are still being agreed and completed there is evidence and the feeling is that some of the momentum in the market has, understandably, been lost with some buyers choosing to pause their planned purchases until after the Referendum. This loss of momentum was born out of the fact that the announcement of the Referendum led to an immediate devaluation of the Pound Sterling against the Euro, which was widely expected to recover after a remain vote, which was seen as the most likely outcome. Other concerns about the world markets and freedom of movement and dual taxation have not been of concern to would be purchasers. With the BREXIT vote of the 23rd June the pound has fallen further in value. In my view the non-British, Euro and Dollar based buyers would make a strong showing this summer as they did, and surprisingly the British market has not pulled back as much as we expected. This is probably because British buyers expect the prices in Sotogrande to rise over the coming years, faster than the value of the British Pound will recover. Also as a result of the devaluation of the pound, stock market rises, particularly the FTSE 100, have mitigated some of the lost value of the British Pound. We expect a busy Autumn ahead”.

“We have suffered large highs and lows in Sotogrande” “Over the past twelve months we have probably had the most highs and lows this since Sotogrande first evolved. On the high side, we can count the announcement of La Reserva de Sotogrande masterplan. Money is being invested, the new infrastructure is rolling out. A second high would be the sale of Valderrama to La Zagaletta. Although this has not materialized in much on the ground as yet, it clearly sends a strong signal to potential buyers that the resort continues to grow, and is worth investing in. Thirdly we have seen the return of cranes to Sotogrande. New properties are being built on the costa side as well as many properties being modernised or refurbished either by new generation of established owners or new owners. The year 2015 ended positively with many estate agencies showing their best results since the beginning of the property crisis. On the low side, was the announcement of the Brexit referendum in February, followed by the result, which had a negative impact. Many potential sterling based buyers held off completion of sales. The fall of the pound against the euro is the immediate reality of Brexit. In addition to this but with less of a direct impact is the absence of a Spanish Government. Also uncertain is the future relationship with Gibraltar. This could have an obvious impact on the Sotogrande real estate market. Sotogrande continues to attract holiday and full time residents. The International School, Santa Maria Polo Club, and Sotogrande SA in particular are developing, each offering more and better services and events. All good for the resort. Still missing however is a proper five star Hotel.
James Stewart James Stewart Savills
“The property market in Sotogrande is worse than last year” There is no doubt that the property market in Sotogrande is considerably worse than this time last year. 2015 saw the first real increase in transactions since 2008 but then a big slow down occurred when the UK Brexit referendum was announced and then activity virtually stopped immediately following the vote to leave. Brexit has created uncertainty throughout Europe and uncertainty is the enemy of all markets. We have noticed an increase in inquiries in the last few weeks but it remains very hard to close deals particularly with UK buyers who are watching the exchange rate all the time. At the same time, Sotogrande, S.A. are advancing with their exciting investment programme and this is going to attract more and more people to Sotogrande as potential buyers are reminded once again of everything Sotogrande has to offer. We had become something of a forgotten destination and this is slowly being put right.

Alongside the PSOE, in this pact we again include the investment in the budget, but first we had to negotiate with the Ministry to lower the price, owing to the fall in prices due to the crisis, and once the new price was set which went from
450,000 euros to 350,000, from the 2013 it is included in the investment budget, but for various reasons on more than one occasion it was discussed leaving this behind,” added Mayoral. He explains that provisionally, “this site has been used as public parking, to provide a better service and solve a problem for many beach users during the summer, but we should provide municipal public equipment for multiple purposes and municipal facilities in a place where, what little does exist, is in rented spaces which doesn’t meet the right condi-
tions which residents deserve,” he said. “We hope that in the budget for next year there will be the necessary amount pledged so that, in one way or another, the public facilities which Torreguadiaro residents are demanding can be developed, if not through direct investment, then through the urban development of the site,” he said.

Plenary of Association of Municipalities approves water rates for Sotogrande The appointment of Cruz Herrera as an Honorary Citizen, the claim from the Regional Council of Andalusia for a better MOT service in the Province, along with institutional support for the commemoration of Mental Health Day, the approval of the water rate for Sotogrande and the proposal from the Council of Los Barrios about the consequences of Brexit obtained votes in favour from
all the members of the Provincial Council at the Plenary Session of the Association of Municipalities of Campo de Gibraltar. This session approved the rejection of claims made against the approval of the Ordinance for the provision of the Drinking Water Supply Service in the Sotogrande National Centre for Touristic Interest. This denial of claims will mean definitive approval of the
ordinance that contains the water rate for Sotogrande and Pueblo Nuevo de Guadiaro. The members of the Corporation also transferred the ruling of the Supreme Court which stressed that it had to be a rate and not a public price which was applied to the service. The point covered had 27 votes in favour, from PP, PSOE, the Andalusian Party, and the votes corresponding to the “La Lin-
ea 100 x 100” party and IU. The only abstention was from the representative of Algeciras Sí Se Puede. Despite the favourable vote from the socialist group, Ruiz Boix, wanted to remind people that a report has been opened in order to go ahead with the recovery of the service in the municipality of San Roque, requesting that aspects were taken into account such as the logical
implementation of a new rate from the moment it comes into force following its publication, checks that it is applied correctly up until that time at the CINT deSotogrande. He also called for auditing action on the public company Aguas y Residuos del Campo de Gibraltar S.A. The vice-president of Services David Gil was responsible for defending that proposal.

tion from representatives of the municipal syndicates: José Porras Naranjo (UGT), Miguel Alberto Díaz (CCOO) and Miguel Tineo (SPPME). In summary, they claimed that syndicates were made to sign a document outside the negotiations commission of the agreement and they requested that this point was left on the table for discussion. Following the vote, members of the Staff Committee and the company committee that had been present, left the room. The point was approved with the vote in favour of the PSOE and the vote against of the opposition. At the mayor´s insistence, there is an insistence to rectify those errors taking into account the agreement and the regulation
agreement that were approved in 2005 and that were extended until 2011, as they were approved in said plenary session, and should also be published in the Official Bulletin of the Province. In 2015 the mayor outlined that a surplus of 13 million euros had been achieved and a treasury remainder of more than 20 million, which has been used to pay debt. He explained that the Council currently owes less than five million euros, and he explained that it will be possible to bring the debt down to 0 by the end of 2016. The point was approved with the vote in favour of the Government Team, the vote against of the PP and SRSSP and the abstention of PA and PIVG.

San Roque Vivo files complaint with Transparency Council on silence regarding school canteen in Guadiaro
Town Council demands improvements to Valle del Guadiaro schools Education councillor Belén Jiménez, raised with the Andalusian Regional Government deputy councillor for Campo de Gibraltar, Ángel Gavino, various urgent matters relating to the schools in the municipality, in the hopes that he would convey these matters to the Territorial Education Department. “We’re insisting on specific measures for our schools, which we’ve found to be necessary. Our ultimate goal is the optimum upkeep of our schools, so that the quality of teaching imparted is as high as we all want it to be.” The councillor said that “the deputy councillor had seemed very receptive to our requests.”
Jiménez mentioned various questions that “had been brought up during the previous Education Department, and which we are awaiting their start.” For example, CEIP Barbésula (San Enrique) “is still waiting to get a new dining hall. The councillor, Juan Luis Belizón, told us that they were aware of this need, and recommended that the school apply for it again this term.” As for CEIP Gloria Fuertes (Guadiaro), “we know that Andalusian Regional Government,” said the councillor, “wants to end the use of prefab units. In fact, two classrooms on the lower floor of the former teachers houses have been used to relocate students. There are another
four classrooms on the upper floor, so we would like this to be part of the budget for next year.” “Finally, Escuela Infantil Puente de Hierro (Guadiaro) has a substantial waiting list,” said Belén Jiménez. There are two rooms in the building which are being used as storerooms, and could be made as one to turn into a classroom. Our request is for the Regional Government to increase the number of places to fit in the boys and girls on the waiting list,” she concluded. Lee más en:

Neighbourhood platform San Roque Vivo has stated that after requesting last month from the Territorial Education Department the report on available places for the school canteen in Guadiaro, the administration “has not responded, nor even answered the phone lines of the representatives in the area, so the Association has filed a complaint with the Andalucia Transparency Council,” they said. The report, they stated, began after the education administration assigned “only two school canteen for the Instituto Sierra Almenara de Pueblo Nuevo de Guadiaro, meaning that most requests had no options.” As a result, besides the actions taken by the affected families, probably “along the contentious-administrative route, an explanation is also
being sought from the Association for what is considered to be blatant discrimination of the Instituto.” “Legally they have a right to this service from kindergarten to secondary school, so we believe that the number of places ought to be proportional to the number of students. However, we are surprised that only two remain in secondary, while in primary there could be hundreds, which is why we wish to see the report and understand what criteria it is based on,” the San Roque Vivo Association said. This is not the first time that the administration has refused to respond, so the SRV aren’t ruling out other routes in addition to the Transparency Board, such as lodging a complaint with the Andalucia Ombudsman.

A week of contrasts at SIS This week Sotogrande International School celebrated Poetry Day. Activities started at the school gates with parents, children and teachers being encouraged to write a line of poetry that would later be used to form two enchanting community poems. Over the course of the day lessons were infused and uplifted with poetry both from the teachers and secondary students, who toured the school classrooms, playgrounds and
library in costume reciting poetry for all to enjoy. Friday had a very different, exhilarating, feel to it. Amazingly over 120 students and nearly 50 teachers took part in the SIS triathlon. The atmosphere was amazing as students cheered on their friends around the beautiful course in La Reserva. The stunning setting helped to inspire SIS students to complete the 250m swim, 4km cycle and 1.6km run in the 30° heat. Tri-
athletes demonstrated both passion and determination, some competing for the fastest time, and others for the thrill and pride of completing their first triathlon. Both inspiring days, focused on embracing opportunities and encouraging students to develop new and exciting passions and talents. With special thanks to La Reserva for the use of their outstanding urbanisation for the SIS Triathlon.

Podrá concertarse a tiempo
completo o a tiempo parcial.
What you should know about temporary employment contract due to production circumstances Temporary contracts due to production circumstances are designed for situations where there is an increase in unforeseen and temporary activity at companies where the normal workforce is not sufficient. It is different from permanent seasonal contracts due to the fact that the temporary contract is about responding to situations that could not have been foreseen, that is to say, they are cyclical. However, there are inspection risks and conflicts with Courts about this
type of contract when companies use them improperly, instead of a permanent season contract or indefinite contract. Temporary contracts due to production circumstances are devised in order to meet temporary market circumstances, the accumulation of tasks or excess orders, even when dealing with normal company activity. These contracts can also be used for initial professional experience, first youth employment, with an unemployed person under the age of 30, who
does not have professional experience or if it is less than three months. The contract can be made for a full-time or part-time basis. In the case of first youth employment, the part-time working day will have to at least 75% of the working day comparable to a full-time worker. The maximum duration of this contract will be six months within a period of twelve months. In the case of first youth employment it shall have a minimum duration of
three months. However, owning to the seasonal nature of the activity under which the aforementioned circumstances, a nationwide sectoral collective agreement or, in the absence thereof, by a sectoral collective agreement of a more limited scope can modify the maximum duration of the contract and the period within which it can take place. These contracts shall be formalised in writing when their duration surpasses four cases and in cases where they are made out
part-time, and it is necessary to precisely and clearly note the cause or circumstances that justify it and furthermore, among other things, the duration and work to be carried out. At Contasult and Sotogrande Legal Services we have excellent professionals who are up to date with all the new legislative developments in order to offer you the best advice, so have no doubts about getting in touch with us about any work, tax, accounting or legal services that you need.

Quirónsalud Campo de Gibraltar warns on uptick of autumn allergies A return to everyday activities and lower temperatures are two key factors. Specialists advise beginning treatment at this stage The fall in temperatures and the arrival of autumn mean that everyone should be alert and prepared for the return of allergic symptoms. Doctor Ignacio Núñez, a specialist in allergy treatment at Hospital Quirónsalud Campo de Gibraltar, explains that there are two key factors leading to the uptick in allergies. “On one hand,
there’s the return to normality: work, school, etc, meaning places with a high concentration of people where the transmission of respiratory illnesses is much more easy and common; and on the other hand there’s the fall in temperatures, which has various consequences: one of which is the rise in the level of dust mites in
the environment, since these creatures need, among other things, a temperature between 10-30 degrees and a moderate to high level of humidity to develop. Another consequence is the rise in viral repository infections, which brings with it an imbalance in the full respiratory pathology.” The season also brings with it a
resurgence in skin diseases, such as atopic dermatitis, caused by the rise in the levels of dust mites and fungi in the atmosphere. Specialists advise that at the end of summer and beginning of autumn, you should resume treatment of allergic illnesses, many of which may have been abandoned during summer, or
prepared for for next spring. If a patient felt worse last year in comparison to previous years, no is the time to visit an allergy specialist for a diagnosis, so the patient can begin a treatment of shots to mitigate their symptoms and, in a not insignificant amount of patients, eliminate them entirely.

Ruíz Mateos It was five o’clock in the morning on 24 February 1983 when I received a call from the Director General (the boss of all of the State Lawyers) at my home. Memories of the coup that had taken place just two years prior at the Spanish House of Commons, made me startle in bed and wake up immediately. On the phone the Director General himself was talking and, with a nervous and extremely tired voice, he told me to immediately go to the Tax Authorities in Jerez de la Frontera. Although I asked him several times for the reason behind the call and my urgent trip there, he provided no details. He simply kept repeating that I should go directly to the teleprinter that we had operating at the State Lawyers Office and carefully read what was being transmitted and take the material received to the Tax Office. That day I was sleeping in Algeciras because I was attending a service board in the city and I took a few hours to get to the Office. By that point (seven in the morning) the Office looked like a fairground. Official Guardia Civil, National Police and Customs vehicles were parked in a disorganised manner at the entrance to the building, which was completely lit up despite the fact that the officials still had not arrived. The scene simply increased my panic. Following the instructions I had received, I entered my personal office at the State Law-yers Office and went to the teleprinter room. I quickly became aware of two things. Firstly, it was not possible to get into the room because the roll of paper coming out of the teleprinter covered the floor like a giant serpent. Secondly, the device had run out of paper. I tried, without much success, to order the immense mound of paper where I im-agined the instructions would appear. Therefore, I asked several Guardia Civil officers for help and they carried out the task with great efficiency. That also allowed me to put paper into the teleprinter, and it continued to churn out more
information. What that immense roll of paper was transmitting was the Decree Law 2/1983 of 23 February regarding the expropriation, for reasons of public utility and social interest, of the Banks and other Societies that comprise the group Rumasa S.A. As the Guardia Civ-il officers kept trying to order what was being churned out at a crazy rate by the device, I went to the Office in the building where all of the authorities were gathered. There, they informed me that the expropriation had gone ahead, and that I had been named State Administrator of the companies owned by the Rumasa group in Jerez and that I should inform them of the content of the Decree Law in order to find out how to pro-ceed. The Decree was short and concise as, after declaring the forced expropriation of a series of companies that were listed in an annex, it outlined that the State would take immedi-ate possession of those companies. The Decree Law also stated that all of the adminis-trative powers and the regulation of social bodies of the expropriated companies had been suspended. This moment, the decline of the Rumasa Group’s companies and the personal torment of its founder José Maríá Ruíz Mateos, marked the beginning of an unforgettable expe-rience for a young 28 year old State Lawyer. Given that the teleprinter did not stop transmitting information to correct errors in the Decree and increasing the list of companies expropriated, the actual taking over and intervention of the Jerez headquarters could not take place until one in the afternoon. By that point, everyone involved knew what was happening, and the faces that I found when I entered the facilities accompanied by public forces, were those of terror faced with the uncertainty of what was going to happen. From that point onwards, the story is well-known although
my role as Administrator did not continue beyond the end of the year. However, I played a part in very human stories that will probably never be told. Among them, one comes to mind of a request to keep making transfers to the mother of José María Ruíz Mateos to ensure that there was always a minimum amount of money in her account. I also remember another request to authorize smuggling two containers of a well-known brandy into Venezuela. I could continue recounting my experiences that year but space limitations force me to restrict myself. I only want to make observations about my legal view of what took place. From my point of view, the unique expropriation that took place was clearly a legal ab-erration to the point that the President of the Constitutional Court had to cast the “quality vote” in order to settle the tie. It is worth remembering that this President resigned from his role after passing the ruling, left Spain, and died soon afterwards, from disgust and sorrow I believe. Afterwards, the European Courts offered their judgement of the injustice of the expropriation that had taken place although Ruíz Mateos did not receive any type of compensation. I stated at the time, and I still have the same belief, that it would have sufficed to inter-vene with the group’s banks in order to control the risks that it posed. The Rumasa group would barely have lasted a week without the banks. That intervention would have been a perfectly normal control mechanism and one that is traditionally regulated in our legal system, and would not have troubled anyone’s conscience. Controlling the banks would mean controlling the entire group. By controlling the banks, the Government would have been able to know the companies’ real situation and adopt more reasonable and fitting measures for the existing situation.

‘Norauto’ flies to victory in Sotogrande The French crew performed brilliantly, taking victory after four exciting days of competition in the La Reserva de Sotogrande G32 Cup The GC32 Racing Tour, the European Circuit in which the so-called “flying catamarans”, bid farewell to Sotogrande after four days of emotion, speed and spectacle. The La Reserve de Sotogrande G32 Cup ended with victory for the NORAUTO team, their third of the season. Second and third place went to Team Tilt and ENGIE, while Malizia of Pierre Casiraghi, son of Princess Caroline of Monaco, finished sixth (second last) in the general rankings, although it received the trophy in the owner-driver category and currently leads the world rankings in this category.
The waters of this area of the Mediterranean provided great conditions for this race, which was held in Andalusia for the first time after its opening event at last year´s Sailing King´s Cup. The exclusive environment of Sotogrande, with its light, beauty and glamour, helped to further exalt the spectacle of the flying GC32 in action, when they manage to rise above the water thanks to their distinctive foils under their hulls, at speeds that can reach 40 knots (70 km/h). NORAUTO dominated the final day of competition and took victory in the La Reserva
de Sotogrande GC32 Cup. On a day with a gentle eastern wind, Adam Minoprio´s decision to occupy the leeward side on the starting line placed his team out in front of the three heats held yesterday, with victory in two of them. Minoprio was satisfied because really putting on pressure at the start worked. “If you come out on top at the start you put yourself in a good position to win the heat. Today we want to be on the side of the buoy, which is quite risky. If you do it well, it works, but it can be a real error because other boats can overwhelm you”.

United States regain control of the Ryder Cup with solid victory at Hazeltine
Sotogrande, a trazos: Fernando Corella
Despite the defeat Sergio García and Rafael Cabrera-Bello stood out with good performances. The scoreboard finished with a 17-11 American victory Europe was unable to earn its fourth consecutive victory and lost (17-11) the Ryder Cup held at the Hazeltine National course, in Minnesota, where the United States starred in three days of dominance that brought their first win in years. The nineteenth edition since 1979 when the competition first involved the participation of players from continental Europe, at least provided a good performance from the two Spanish golfers: Sergio García and Rafael Cabrera-Bello. Sunday required a new feat in the individual matches, just like the so-called “Miracle in Medinah”, however those feats are achieved on very few occasions. Rafael Cabrera-Bello won quite comfortable against Jimmy Walker (3/2), and Sergio García made things very difficult for Phil Mickelson in what was a simply marvellous clash. The players from Castellon and Califor-
nia provided a masterclass of birdies to both finish -9. Such a great spectacle needed the rewards to be evenly split, which is what happened with two good putts at 18. Half a point for each player. At that point, the battle was almost decided. The wins of Patrick Reed against Rory McIlroy (1up), Rickie Fowler against Justin Rose (1up), Ryan Moore against Lee Westwood (1up), Brandt Snedeker against Andy Sullivan (3-1) and Dustin Johnson against Chris Wood (1up) ended a triumphant Sunday for the passionate American fans. Despite the defeat, this edition provided some positive elements for the European team, including the enormous growth of Thomas Pieters who was spectacular and a good performance from the two Spanish players, with a special mention for the debutant Rafael Cabrera-Bello.

María Parra reaches third place in Women’s European Gold Ranking The now pro-golfer has jumped onto the continental podium in the last season Asturian Iván Cantero and Guadiaro native María Parra - now a professional player - ended the season in second and third place in the Men’s and Women’s Rankings respectively, for which they will be awarded by the European Golf Association. The Men’s Top 3 was also made up of English player Sam Hors-
field in first place and Austrian Sam Horsfield in second. Mario Galiano, thirteenth, also achieved a notable position, in a ranking which in 2015 was dominated by Jon Rahm. Tesorillo native Mario Galiano led this ranking in 2014. The situation of María Parra, a player for SIGA Sotogrande, is
even more notable, taking into account that, while her move to professional player is a recent one, this season she has focused on gaining experience in the LET Access Series. And she hasn’t done badly: victories in the Halmstad Ladies Open and the Drøbak Ladies Open, with provisional second place in the
Order of Merit. In spite of the fact that her amateur calendar was limited, the Cadiz native also won plaudits in this field: she held on to her title at the Copa de Andalucía, triumphed in the Portugal International, reached the semi-finals of the British Ladies Amateur Championship and came sixth
in the European Individuals. María Parra was also second in 2015 in this same ranking, which was then led, as it is now, by budding Irish player Leona Maguire. English plater Bronte Law came in second, while Ana Peláez, eleventh, and Fátima Fernández, twelfth, also made it into the Top 25.

“Gesta Real Estate” notch up first win of 6th Sotogrande Marina J80 Circuit Close victory from Bassadone and Martínez Doreste over the defender of the title, “Marbella Team” with Orbaneja and Páez
John Bassadone´s “Gesta Real Estate” boat took victory in the opening victory of the Sotogrande Marina 6th Circuit for J80 monotypes. The boat skippered by Gustavo Martínez Martínez Doreste manged a very close but sufficient lead to take victory in this edition of the circuit. Two days and six heats, to begin drawing up the overall rankings. The first day ended with a draw at the top of the rankings between “Gesta Real Estate” and the title defender “Marbella Team” with Pepequín Orbaneja and Juan Luis Páez, led by the latter with two 1sts and a 4th place and three 2nd places from the CN Sevilla vessel, the draw was settled in favour of the former for having the best last partial. On Sunday there were three new events to complete the first event of the 6th Sotogrande Marina J80 Circuit, and the definitive first win of the season went to “Gesta Real Estate” with Bassadone and Doreste. They, along with their team, managed to take a one-point lead over “Marbella Team” with Orbaneja and Páez, thanks to another
victory, two seconds and the ruling out of the fourth place of Saturday, as opposed to two firsts and a third from the title defenders. Third place in the overall rankings went to the Norwegian Vidar Hansson with “High Seas”, whose performance finished with two thirds and a second. Fourth place went to “Pas Team” with Caine and Zabell, followed by “Montajes Aguilera” with Rafael Fortes, who despite being the first winner on this new edition of the circuit, was not able to keep up the good rhythm on the second day, taking three sixths; “Marina Sotogrande” with Miguel Ángel Díaz and Gozalo Pérezde Guzmán, was sixth. These three were separated by a mere three points. “PF Sailing Team” with Peter Fjellstad, was seventh, having only earned points in two events. It was very close between the fleet at the opening event of the season, which bodes for an exciting and equally difficult championship. Now, everyone will be getting ready for the second event, which will take place on the weekend of 5 and 6 November.
