The Situation Report: the Home Care Association of New York State JOACHIM from p. 1 Perhaps the most interesting feature of this group is that nearly 75 percent of the 27 HCA Board seats are currently held by women leaders in health care.

When I look around the Board table, I am struck by the fact that, joining me, are 19 exceptional women leaders who represent every region of the state: Long Island, New York City, the Hudson Valley, the Southern Tier, Western New York, Central New York, the North Country, and the Capital Region. These women join seven incredible men leaders who form one of the most effective governing organizations I have had the privilege to work with, and I appreciate the dedication, intelligence and sacrifices of every one of them.

Not only do women have strong representation on the HCA Board, but every single one of the Board leadership posts is held by a woman. As Board Chair, I am in the company of some incredibly talented peers: Board Vice Chair Sue Brett, COO/Senior Vice President of People Care; Board Secretary Laurie Neander, CEO of Bassett Healthcare Network: At Home Care, Inc.; and Board Treasurer Sue Larman, CEO of VNA Home Health.

In addition to HCA’s policy and advocacy priorities, the women and men on HCA’s Board offer enthusiastic input and direction on the many conferences and seminars that HCA produces throughout the year. When the HCA Education team asked the Board for our thoughts on a proposed Women in Healthcare Leadership Summit, we all thrilled at the idea, knowing that this is exactly the kind of training which can inspire and foster the strong leadership function we find on HCA’s Board.

As Chair of HCA’s Board of Directors, I strongly urge you to attend HCA’s first-of-its kind Women in Healthcare Leadership Summit, on September 28-29 in Saratoga Springs, or encourage a peer to do so.

HCA is pleased to announce that the state OMIG’s chief, Medicaid Inspector General Dennis Rosen, and a lead counsel in the federal Office of the Inspector General’s (OIG) office, Nancy W. Brown, will speak at the symposium. HCA Offers Oct. 20 Bootcamp: Federal, State Wage & Hour Rules If you attended our recent Senior and Financial Manager’s Retreat or Annual Conference, you know that the attorneys from Hodgson Russ are in-demand experts on all areas of home care labor law. Their sessions have garnered rave reviews, and now HCA has invited them to provide an even deeper look at labor law issues during an October 20 Bootcamp in New York City entitled “Understanding the Federal and State Wage & Hour Rules for Home Care Providers and Rising Above the Challenges.”

Hodgson Russ Attorneys Peter Godfrey, John Godwin and Emina Poricanin specialize in wage and hour laws for the home care industry.

They’ll discuss the key federal and state compensation requirements for home care providers, also covering topics such as: accurate computation of the regular rate of pay; properly paying overtime; accurately tracking work time, including travel time; spread of hours and split-shift pay; call-in pay regulations; the Domestic Workers’ Bill of Rights; and the Wage Parity Law. All Home Care Providers Urged to Participate in Sept. 30 Statewide Webinar Launching Home Care Sepsis Screening Tool Webinar to be presented by HCA, IPRO, CDC, DOH, and National Sepsis Alliance – the first of 3 programs to guide provider adoption and integration of first-in-nation home care sepsis tool All home care providers are asked to attend a September 30 webinar launching HCA’s home care screening tool and protocol for sepsis awareness, early recognition and intervention.

The webinar is being hosted by IPRO, and jointly presented with HCA and other key organizations. The webinar will be the first in a sequence of three must-attend sessions, the goal of which is to present and guide home care providers on the adoption, integration and use of this sepsis tool in patient care. The U.S. Centers for Disease Control and Prevention (CDC) has recently proclaimed sepsis as a health emergency, and cited 80 percent of cases originating in the community.

The HCA Quality Committee and its subgroup on sepsis have worked for the past two years to create, vet and refine this home care sepsis screening tool. The tool is a national first for home care, and a national first for sepsis. The HCA workgroup was comprised of home care clinicians, supplemented by prominent sepsis physicians, the National Sepsis Alliance, and other key experts. The U.S. Centers for Medicare and Medicaid Services (CMS) has approved use of the HCA tool as part of a CMS-sponsored sepsis project currently being implemented by IPRO in two major regions of the state. Earlier this week, the tool was featured as a potential national blueprint at a National “New Ideas” Forum on Sepsis sponsored by the Rory Staunton Foundation, and HCA is in discussions with other states and key New York stakeholders about the tool’s promise.

Sepsis is among the most under-recognized and misunderstood conditions among providers and the general public. It is a leading state and national health care cost driver, and cause of mortality, hospitalizations and rehospitalizations. The etiology, nature and scope of sepsis make prevention, early identification, swift intervention, and community health engagement a public health imperative. Home care providers armed with this new tool can also bring this resource to bear in the Delivery System Reform Incentive Payment (DSRIP) program, value-based payments, as well as with hospitals, physicians and other collaborative models.

The August 26, 2016 CDC Report Vital Signs: Epidemiology of Sepsis: Prevalence of Health Care Factors and Opportunities for Prevention (http://www.cdc.gov/mmwr/volumes/65/wr/mm6533e1.htm) emphasizes sepsis as a medical emergency that begins outside of the hospital in nearly 80 percent of all sepsis cases.

The home care population embodies the high risks for sepsis. Home care provides a ready, statewide infrastructure of agencies and nurse clinicians with the unique community and in-home expertise to conduct essential screening, evaluation, education and intervention with critical health system partners.

The sequence of webinars will be held on the following dates and times: 

HCA Participates in National Sepsis Forums HCA Executive Vice President Al Cardillo presented at a National “New Ideas” in Sepsis Forum, organized by the Rory Staunton Foundation on September 12 in New York City.

Mr. Cardillo was invited to present HCA’s home care sepsis screen and protocol, developed by the HCA Quality Committee and subgroup on sepsis. The HCA initiative was invited as a potential blueprint for other states and the nation on harnessing home care in a community-based approach to early sepsis recognition and swift, life-saving intervention. (See related page 5 story). HCA’s initiative was a feature in the forum as a first-of-a kind effort.

Dr. Doerfler was honored for his significant work in implementing new practices, training and service models at Northwell which produced a dramatic reduction in sepsis mortality, as well as his contributions to HCA’s groundbreaking home care sepsis initiative. Dr. Doerfler has worked with HCA to lay out and reinforce the imperative for prehospital/community-based awareness, screening and intervention. He also provided regular input in HCA’s work to medically fine-tune our drafts of the tool, and joined us in briefings of the state Department of Health and others. HCA thanks and congratulates Dr. Doerfler and Northwell Health.

F2F a Heavy Focus of MSSNY-HCA Physician-Homecare Task Force This week HCA and the Medical Society of the State of New York (MSSNY) launched a joint task force on physician-homecare engagement.

The Task Force is comprised of prominent MSSNY physicians, including the chair and members of the MSSNY Long Term Care Committee and MSSNY’s past-president, and several members of the HCA Board and membership.

The Task Force was recommended by MSSNY leadership and HCA following a presentation to the MSSNY Long Term Care Committee by HCA and members of HCA’s MLTC Forum on opportunities and challenges in physician-homecare/MLTC engagement.

The Task Force provides an excellent opportunity for HCA and organized medicine to discuss critical issues and partnerships between physicians and home care. The Task Force devoted the vast majority of its first meeting to federal and state requirements for physician-patient Face-to-Face (F2F) visits for home care authorization. Task Force members explored core solutions and simultaneous practical means of mitigating the F2F visitation and documentation burden.

The task force will focus on overall promotion and strengthening of physician-home care engagement, and partnerships, as well as obstacles and adversities which detract from and interfere with physician-home care engagement. This includes:       

Physician Face-to-Face authorization requirements Overbearing regulations, forms and documentation requirements for certifying patient eligibility and services (orders, renewals, revised orders, etc.)

A lack of shared electronic health records Insufficient understanding of home care Barriers to physician house-calls Physician hesitancy or over-use of/involvement in home care Effect of these issues on home care or physician provider costs/reimbursement

HCA and MSSNY will be following up by identifying actionable steps to address these areas.

State Updates on Value Based Payment, DSRIP Initiatives The state Department of Health (DOH) has posted the Value Based Payment (VBP) Clinical Advisory Groups (CAGs) Recommendation Reports for Chronic Heart Disease; Pulmonary; and Diabetes.

These CAG reports have been posted for public comment at http://www.health.ny.gov/health_care/medicaid/ redesign/dsrip/vbp_library/vbp_final_cag_reports.htm. The comment period begins September 14, 2016 and ends on October 14, 2016. Comments should be sent to dsrip@health.ny.gov.

The CAG Recommendation Report provides definition and associated quality measures for each VBP arrangement. The CAG reports inform providers and payors of the details of each arrangement, further supporting their transition to VBP. Each report represents the final output from each respective CAG for that specific arrangement. Recommendations from the CAG will be further explored throughout the early phases of VBP implementation. Based on lessons learned through VBP implementation, each CAG may be reconvened to continue discussions of VBP arrangement definition and quality measures.

The Managed Long Term Care VBP CAG Report is expected to be posted very soon, at which time HCA will notify members.

Mid-Point Assessment of PPSs The federal Standard Terms and Conditions (STCs) that govern the Delivery System Reform Incentive Payment (DSRIP) program require Mid-Point Assessment of all 25 Performing Provider Systems (PPS) around the state.

On October 7, 2016, the Department and Public Consulting Group (PCG) will brief the Project Approval and Oversight Panel (PAOP) on the mid-point assessment process and PPS progress.

The meeting will be in Albany at the Empire State Plaza, meeting room No. 1, from 10:30 a.m. to 3:30 p.m. It will be open to the public; however, there will be no opportunity for public comment. An agenda for the meeting will be sent out when it becomes available.

Deadline Extended for Health Care Facility Transformation Program The state has extended the deadline, from September 16 to September 28, 2016, to apply for funding under the Health Care Facility Transformation Program.

The state has posted Addendum no. 3 that includes this new deadline and a clarification on how to complete the Capital Budget and associated financial information (Attachment 3) sections on the application.

Continued from previous page HCA and community health provider representatives worked in partnership to push for this transformation funding during budget negotiations, convincing the Legislature and Governor to dedicate a portion of these funds for home and community-based providers specifically.

While a $30 million minimum is dedicated to home and community-based providers (including home care agencies), specifically, these entities are also eligible for funding in the remainder of the pool as well.

The goal of this program is to provide grants that primarily support capital projects (but it may include noncapital expenses) “for the purpose of strengthening and protecting continued access to health care services in communities throughout New York State and associated with a merger, consolidation or significant corporate restructuring activity that is part of an overall transformation plan intended to create a financially sustainable system of care.”

Non-capital projects, in addition to debt restructuring, may be eligible for funding, and they include general operating expenses directly connected to the eligible project for which funding is sought as well as non-capital expenses in cases where the RFA does not explicitly mention them as excluded. Those excluded are general operating expenses applicable to day-to-day operations and unconnected to the eligible project for which funding is being sought.

At an August 8 webinar, the state said that proposals will be judged on how well they achieve an entity’s financial sustainability and are associated with a merger, consolidation, or corporate restructuring, but restructuring will be interpreted broadly. The project must also preserve essential health services (and be aligned with Delivery System Reform Incentive Payment program principles).

Revalidation Required for Some Providers Providers who were notified about the need to revalidate their Medicaid program enrollment are reminded to do so by the September 25, 2016 deadline.

The Affordable Care Act requires that all Medicaid and Medicare providers must be revalidated every five years. Revalidation includes providing information on the provider’s ownership, managing employees, agents, persons with a control interest, as well as providing current addresses, specialties, etc.

Failure to revalidate can result in your agency’s termination from Medicaid.

UAS Changes Announced The state Department of Health (DOH) has announced a new enhanced security procedure for all who access the Uniform Assessment System of New York (UASNY).

DOH intends to implement a Multi-factor Authentication (MFA) security process effective mid-October 2016 for all users of the UAS-NY. MFA requires a user to provide two pieces of information to access an application each time the user logs in: one piece is a password and the second piece is an authentication code.

Q&As Posted for Nonprofit Infrastructure Capital Investment Program The state has posted Questions and Answers (Q&As) related to the Nonprofit Infrastructure Capital Investment Program (NICIP).

The Q&As, along with the Request for Applications, are on the Grants Gateway at https:// grantsgateway.ny.gov/IntelliGrants_NYSGG/module/nysgg/goportal.aspx?NavItem1=2.

The Q&As cover: allowable number of applications; application materials; eligible technology costs; eligible entities; and more.

As described in previous stories, NICIP will make targeted investments throughout the state in capital projects that will improve or maintain the quality, efficiency, accessibility, and reach of nonprofit human services organizations. Qualified organizations include those that provide direct services to New Yorkers through state contracts, state payment rates, or state authorized payments which represent funding appropriated by the state and passed through to a local government which then provides that money directly to the nonprofit organization.

Home care and hospice providers may be eligible for funding if they meet all of the eligibility criteria in the RFA. Nonprofit organizations are eligible to apply for a NICIP grant if they meet all of the following criteria: 

They are registered with Grants Gateway and are Prequalified at the time and date that the application is due. Applicants are strongly encouraged to review their document vaults prior to the application deadline to ensure that their documents are up to date.



They are a human services organization.



They provide direct services in New York State to individuals and families residing in New York.



They currently receive funding from New York State for providing direct human services in the form of a: state contract; state payment rate; or state authorized payment.



They have annual revenue, as reported on line 12 of their most recently filed IRS form 990, of at least $100,000. Please see the RFA for additional information for entities that are not required to file an IRS form 990, or where another organization files an IRS form 990 on behalf of the applicant.

Applications are due by September 29 and must be submitted through the Grants Gateway; awards will be announced by November 1.

New Website for Nonprofits Established This week, the New York State Division of the Budget announced the launch of a new website – www.ny.gov/ nonprofits – which will “enhance the relationship between New York State government and nonprofit organizations.”

The website will serve as New York’s source for information impacting the nonprofit sector and as a portal to streamline the myriad interactions between the state and its nonprofit partners. Features of www.ny.gov/ nonprofits include: 

A step-by-step guide to help New Yorkers establish a nonprofit organization, including how to file for tax exemptions and links to the appropriate forms and instructions.



Instructions for nonprofits to prequalify for state grants. The Grants Gateway system allows nonprofits to complete many of the administrative tasks prior to the application process.



Information on new state initiatives, such as the $100 million in total funding for the Nonprofit Infrastructure Capital Investment Program. (See p. 12 story.)



A news portal where nonprofits can find the latest updates and guidance on issues of vital importance.

CMS Posts HHCCN with New Date The U.S. Centers for Medicare and Medicaid Services (CMS) has posted the Home Health Change of Care Notice (HHCCN) with a June 2016 date.

According to its August 2016 announcement (below), the only change is in the expiration date: The Home Health Change of Care Notice (HHCCN), Form CMS-10289 (should be CMS-10280), and form instructions have been approved by the Office of Management and Budget (OMB) for renewal. While there are no changes to the form itself, providers should take note of the newly incorporated expiration date in the form instructions.

The HHCCN is used to notify beneficiaries of plan-of-care changes under fee-for-service or original Medicare. Home health agencies must provide the HHCCN whenever they plan to reduce or terminate a beneficiary’s home health services due to a physician-ordered change in the plan of care, a lack of orders to continue the care, or limitation of the home health agency in providing the specific service (i.e. staffing shortages or safety concerns in a beneficiary’s home).

Bethany Gilboard is Chief Executive Officer of both the Innovative Health Alliance of New York LLC, a Medicare Shared Savings Program ACO and a Clinically Integrated Network in Albany, NY and the Alliance for Better Health Care, LLC a performing provider system participating in the New York State DSRIP program. The goal of the DSRIP program is to redesign the New York State Medicaid program and in doing so transform the current payment systems to reward value, quality and patient outcomes Ms. Gilboard has been on the forefront of population health management.

She has a proven track record of developing successful ACOs and building statewide and local collaborations with physicians, hospitals, health plans and key constituents in Massachusetts and now New York. Ms. Gilboard was also the former Director of the Massachusetts Regional Extension Center, a program to help support small physician practices in their adoption of electronic health record technology.

The Federal program was funded under the Affordable Care Act. Nancy Miriam Hawley is CEO of Enlignment®, Inc. Dr. Jacqueline Hornor Plumez has received both the Distinguished Psychologist and Distinguished Service award from The Westchester County Psychological Association.

Dr. Plumez is a practicing psychologist and career counselor in Larchmont, New York.
