Rule with PDGM Expected This Week HCA expects the U.S. Centers for Medicare and Medicaid Services (CMS) will post a final home health payment rule this week, including the Patient Driven Groupings Model (PDGM). Given the required 60-day period before implementation on January 1, the rule would ostensibly need to be posted by Friday. HCA will immediately notify the membership via e-mail alert of any news related to the rule or PDGM this week followed by our analysis to help you get ready for 2020.

2018 LHCSA Statistical Report Due in 3 Weeks HCA reminds Licensed Home Care Services Agencies (LHCSAs) that they have only three weeks left to submit the 2018 LHCSA Statistical Report. The state Department of Health (DOH) says that only 6 percent of all LHCSAs have submitted the reports so far. (HCA has a list of those LHCSAs that have done so.)

Agencies that wait until the last week may encounter system delays and wait times for support. Support personnel will not be available on the deadline date of November 16, 2019.

We again stress that the report includes the required registration process. All LHCSAs must complete this process

by November 16 – via the Statistical Report submission – or else face fines and not be allowed to operate in 2020 until the registration is completed. Repeat violations may result in your license getting revoked. Reports and registration are required of all LHCSAs – even those that don’t bill Medicaid – including LHCSAs which are exclusively Fiscal Intermediaries.

MOA Required for Medicare Payments To participate in Medicare, home care and hospice providers must submit a Memorandum of Agreement (MOA) with Livanta, Medicare’s Beneficiary and Family Centered Care Quality Improvement Organization (BFCC-QIO) for New York State.

Livanta indicates that 92 percent of home health agencies and 95 percent of hospices have not submitted this form, and HCA encourages all providers to submit the MOA as soon as possible.

A new MOA must be signed at the beginning of each new BFCC-QIO contract cycle. The current MOA was required as of June 8, 2019. According to Livanta, a provider that does not submit a signed copy of the MOA will be reported to the U.S. Centers for Medicare and Medicaid Services (CMS) as violating the Conditions of Participation (CoPs).

BFCC-QIOs review patient medical records to determine whether services delivered to beneficiaries meet professionally recognized standards of care, are medically necessary, and are delivered in the most appropriate setting. In addition, they conduct Medicare beneficiary-requested reviews. These may include appeals related to notices of discharge and/or service terminations, and actions taken in response to written complaints about service quality.

Senator Schumer Singles Out HCA Sepsis Award, Initiative This past week, we received the following letter from U.S. Senator Charles Schumer congratulating HCA for our receipt of a “Sepsis Heroes” award. (The award was presented by Sepsis Alliance for HCA’s Stop Sepsis at Home NY initiative.) HCA greatly appreciates this thoughtful and gracious letter from Senator Schumer, singling out HCA’s work amid many crucial issues of state and national importance that now occupy the Senator in his position as the Senate’s Minority Leader and as the senior Senator from New York.

Annual DDE Logon Re-Certification Coming November 4 National Government Services (NGS), New York’s Medicare Administrative Contractor (MAC), will designate one state at a time for a user recertification process related to the Direct Data Entry (DDE) system. New York’s recertification process begins Monday, November 4.

As part of this process, NGS will e-mail an access code to the current authorized e-mail address on file with Electric Data Interchange (EDI). All logon IDs must complete the recertification process within ten business days to prevent losing access.

Any user who has access to the Part A Fiscal Intermediary Standard System (FISS)/DDE system on October 28, 2019 will be required to complete the recertification process by November 17, 2019 to continue access without additional steps.

Any new or reinstated ID after October 28 will not be required to recertify until the following year’s recertification.

Revised Notice on Reporting of Cybersecurity Incidents The state Department of Health (DOH) has revised its letter and Frequently Asked Questions (FAQs) on the process for providers to report a cybersecurity event.

According to this notice, providers who have experienced a cybersecurity incident are required to apprise their DOH Regional Office.

Reportable cybersecurity incidents include any event that affects patient care or represents a serious threat to patient safety, such as intrusions aimed at theft of protected health records. Examples include: information technology intrusions, ransomware attacks, as well as attacks on file transfer systems or data

reporting interfaces that can spread through established connections with other networks or government systems.

Provider staff should follow their established internal policies and procedures for alerting their central IT/information security staff or IT vendor. The incident should be validated before reporting to the DOH Regional Office within 24 hours of confirming that a credible incident has occurred.

Home Health Quality Reporting Updates The U.S. Centers for Medicare and Medicaid Services (CMS) has recently provided the following Home Health Quality Reporting Program (HHQRP) updates. 

Non-Compliance Notification and Reconsiderations: Certified Home Health Agencies (CHHAs) not meeting the HHQRP requirements for the 2020 Annual Payment Update (APU) should have received, or will soon be receiving, a letter from National Government Services (NGS) regarding their 2 percent APU penalty. (The notifications are also in the agency CASPER folders.) CHHAs may submit a request for reconsideration to CMS via e-mail no later than November 1, 2019. HHQRP Technical Expert Panel Report: CMS posted the HHQRP Technical Expert Panel Summary Report on Development of Home Health Within-Stay Potentially Preventable Hospitalization Measure for Home Health Agencies. This report summarizes the feedback of a technical expert panel in reviewing work by Abt Associates to develop potentially preventable hospitalization measures over three meetings in 2018.

Nov. 5 CMS Webcast: Submitting Cost Report Electronically The U.S. Centers for Medicare and Medicaid Services (CMS) is hosting another webcast for Medicare Part A providers on how to use the new Medicare Cost Report e-Filing (MCReF) system. The webcast is on November 5 (1 to 2:30 p.m.). Registration is at https://blh.ier.intercall.com/.

MCReF can be used for fiscal year cost reports ending on or after December 31, 2017. Mailing or handdelivery options are still available, yet MCReF is the only option for electronic delivery.

CMS Lists Hospices Meeting Quality Reporting Requirements The U.S. Centers for Medicare and Medicaid Services (CMS) recently posted the annual list of hospices that have successfully met the quality reporting requirement. (See https://www.cms.gov/Medicare/ Quality-Initiatives-Patient-Assessment-Instruments/Hospice-Quality-Reporting/Downloads/PACHospice-FY2020-APU-Compliant-List.pdf.)

Hospices on the list have submitted at least 90 percent of their Hospice Item Set (HIS) records within 30 days of the qualifying event (admission or discharge) and must have had their third-party vendor submit hospice Consumer Assessment of Healthcare Providers and Systems (HCAHPS) survey data quarterly.

A 2 percent payment penalty applies in fiscal year 2020 for hospices not meeting these reporting criteria for the calendar year 2018 reporting period.

Effective October 1, 2019, the CMS policy for HIS patient record submission will be changed to 24 months from the target date. The policy change applies to new, modified and inactivated records.

Revised Private Duty Nursing (PDN) Manual on eMedNY The state Department of Health (DOH) eMedNY system recently issued a revised Private Duty Nursing (PDN) Manual that is effective November 25, 2019. See https://www.emedny.org/ProviderManuals/ NursingServices/index.aspx.

The manual makes some clarifications or streamlining to the current PDN prior-approval (PA) process or documentation for certain PA submissions (Section 6). Separate PAs are no longer required for agencies and independent providers (Section 6.6). Also clarified are: assessment requirements (Section 6.10); PDN in school settings (Section 11.2); replacement PAs and the Change Request process (Section 9); and required information for third party insurance (Section 6.16).

DOH will hold a November 4 webinar (10 to 11:30 a.m.) on the changes for PDN-servicing providers, physicians, or others who provide services or assist in submission of prior approvals. Registration is at https://www.emedny.org/training/index.aspx.

CMS Reschedules Review Choice Demo in FL, NC and TX The U.S. Centers for Medicare and Medicaid Services (CMS) is delaying the Review Choice Demonstration (RCD) start date in Texas – to March 2, 2020 – followed by North Carolina and Florida’s start date on May 4, 2020. HCA is closely watching this development, as the demo, previously summarized for members, could at some point be extended to other states.

RCD was originally scheduled to begin in Texas at the beginning of December – right before the January start date of the Patient Driven Groupings Model (PDGM). This timing prompted the National Association for Home Care and Hospice, as well as affected state associations, to press for a delay.

RCD includes a choice of three options for providers: pre-claim review; post-payment review; or minimal post-payment review with a 25 percent payment reduction. Agencies that do not make a choice selection of the above within certain time periods (i.e., between January 15 and February 13, 2020 for the Texas initiative) will be automatically placed in “choice 2,” which is 100 percent post-payment review

Are You Ready for EVV? Steve Pellito, Senior Vice President, Provider Sales, Sandata Technologies

New York is moving on implementation of Electronic Visit Verification (EVV) with a series of recent milestones, including the new release of a fact-finding RFI for potential EVV vendors.

EVV is required by the federal 21st Century CURES Act for both personal care and home health care in 2020 and 2023 respectively. The requirement will have major implications for providers, workers and consumers alike in terms of data accessibility, operational implementation, and recoupment or appeal process. This session will highlight the key EVV design models under consideration by state policymakers – including critical areas specifically outlined in New York’s recent RFI – as well as experiences from other states where EVV has already gone into effect. Participants will also learn how the new EVV requirement will impact early-adopting providers seeking to enhance their quality of patient care.

Enhancing Health Information Exchange and Interoperability through SHIN-NY Elizabeth Amato, Vice President, SHIN-NY Programs, New York eHealth Collaborative (NYeC) New York State’s “network of networks,” the Statewide Health Information Network for New York (SHIN-NY), was created to allow for the electronic exchange of clinical information, connecting health care professionals statewide. To foster this exchange to the fullest extent possible, the Data Exchange Incentive Program (DEIP) was established to increase provider adoption of electronic health interconnectedness. The federal government has committed to an extension of DEIP – to September 30, 2020 or until funding is exhausted. Infection Prevention in Home Health Care: A National Study, Lessons Learned Ashley Chastain, DrPH, MPH, Project Manager, InHOME Study, Columbia University School of Nursing As the number of chronically ill older Americans continues to grow, so too does the role of home care in improving care transitions for this segment of the population, with increased focus on prevention of infectious disease. This national priority intervention area has spurred the development of several value-based purchasing (VBP) initiatives, changes in the federal home health Conditions of Participation and The Joint Commission’s focus on infection prevention as a national patient safety goal. Examining a national study of home care providers, Columbia University’s Dr. Ashley Chastain will describe the challenges to infection prevention and quality improvement in the home care practice setting as well as lessons learned from her team’s research project “Infection Prevention in Home Health Care” (InHOME).

Dr. Chastain is a Project Manager at the Columbia University School of Nursing, working on a nationwide study funded by the NIH and Alliance for Home Health Quality and Innovation that explores infection prevention and quality improvement in the home care environment. Her research interests are infection prevention & control in long-term care settings, as well as patientprovider communication.

The Evolution of MLTC Quality Metrics Raina Josberger, Deputy Director, Division of Quality Measurement, Office of Quality and Patient Safety, NYS Department of Health This session will feature Raina Josberger of the NYS Department of Health, Office of Quality and Patient Safety, who will present the latest in quality measures for managed long term care plans and home care provider partners. The session will address the metrics, methodology, anticipated changes, and other facets of the approaches used by NYS to track for quality outcomes, potential avoidable hospitalizations, and key areas of compliance that drive state quality pool funding to MLTCs and that form the basis for value based payment (VBP) performance measures. This is a MUST session for MLTCs and providers, offering a unique opportunity to discuss concerns, ideas and recommendations on MLTC-homecare quality partnership, VBP, and related progressive work with the Department.

Introduction to Motivational Interviewing Cheryl Martin, MA, RN, Master CASAC, Integrated Health Trainer and Clinical Consultant, Coordinated Care Services, Inc. “All change is self-change, to which clinicians are sometimes privileged witnesses and facilitators” From Motivational Interviewing, Helping People Change, 2013 Over the past few years there has been increased attention on Motivational Interviewing (MI) as an evidenced-based practice that supports engagement and change. MI is a “way of being with others” that can strengthen relationships and open the door to personal growth. MI is collaborative and compassionate, while recognizing and honoring the autonomy of every individual. When the spirit and skills of MI are fully embraced, safety and trust can grow. Each person is understood to be the expert about themselves and it is the MI clinician’s responsibility to evoke and deeply listen to their ideas and beliefs; it is that person’s perspective and values that will support any desired change. As health care providers who work in the privacy of a patient’s home, home care clinicians are among the best positioned to use these skills with meaningful effect.

During this training, participants will explore the key elements of MI as a “way of being”/skills that support a safe and trusting environment. At a deeper level, we will look at how the compassionate “way of being” of Motivational Interviewing engages others and can guide them towards the changes/goals they are seeking to support their health and wellness.
