Court of Appeals to Hear Case Brought by HCA & Others to Challenge Executive Order 38 The New York State Court of Appeals, the state’s highest appellate court, has granted leave to appeal and established the schedule for hearing the appeal brought by HCA and other associations and providers to challenge the requirements of Executive Order No. 38 (EO 38). MLTC-Home Care QIVAPP Amounts Revised The state Department of Health (DOH) has informed HCA that it has revised the amounts that managed long term care (MLTC) plans will receive to pass on to their home care contractors who are eligible for Quality Incentive Vital Access Provider Pool (QIVAPP) monies. Imminent DOL Impact Statement a Basis for HCA’s Legal, Regulatory & Legislative Next Steps on 24-Hour/‘Live-in’ Relief Strategy discussion planned at HCA Board meeting later this week With the state expected to issue a pivotal regulatory impact statement on Wednesday in the New York State Register, HCA’s Board of Directors is gathering later this week for a welltimed strategy and planning session where it will discuss (among other issues) next steps on the legal, regulatory and legislative fronts to resolve the massive retroactive and prospective liability concerns – as well as ongoing regulatory confusion – regarding the status of 24-hour/‘Livein’ cases.
