Broad Coalition, Including HCA, Urges NY Delegation to Reject Latest Federal Health Care Proposal Cutting Billions from Medicaid A coalition of 30 New York State health care, labor and consumer advocates, including HCA, has united again to advocate against federal health care legislation, this time targeting a new Obamacare repeal-and-replace measure, known as the Cassidy-Graham bill, which would have disastrous consequences for home care and Medicaid in general.

In a letter sent to New York’s Congressional Delegation last week, the coalition referenced an analysis by the Center on Budget and Policy Priorities which found that the measure would cut federal spending to New York State by an astonishing $18.9 billion.

The Situation Report: the Home Care Association of New York State SEPSIS from p. 1 The notification from Health Foundation President and CEO David Sandman awards nearly $150,000 to “support HCA’s work on this important and energizing” initiative.

HCA deeply thanks Mr. Sandman, the Foundation Board and program directors for this vital investment and confidence in the HCA home care sepsis initiative and our capacity to make an impact.

The grant will support an expansion of the effort launched by HCA in life-and-health-saving sepsis screening, prevention, patient education, early recognition and treatment. It will substantially infuse our work in making our home care sepsis tool available to home care agencies and other applicable care providers statewide, conducting outreach, providing technical support for agency/clinician use and adoption, and promoting effective integration and coordination of home care with the broader continuum response to sepsis.

Reminder: HCA-Member Call Tomorrow, Sept. 26, on 24-Hour, Live-In Court Cases

The grant comes amidst continuing developments regarding the HCA sepsis initiative both within New York State and nationally.

HCA reminds members that tomorrow, September 26, from 1 to 2 p.m., HCA has scheduled a members-only statewide call to provide updates and next steps on the recent court cases concerning 24-hour, live-in services. The call will be led by legal experts at Jackson Lewis, the firm for HCA’s legal counsel. This Friday, September 29, the state Department of Health will be hosting a statewide webinar presenting the HCA sepsis tool to all managed care and managed long term care plan chief medical officers, quality directors and program directors. One of the primary webinar themes for the health plans will be the connection between the tool and both value based payment and DSRIP, as well as underscoring sepsis’s number-one role in driving Medicare hospital readmissions and Medicaid expenses for potentially avoidable hospitalizations. Managed care feedback in reaction to the webinar announcement has included the recommendation that the webinar be expanded or repeated for health plans in all of the other states.

As reported in last week’s newsletter, the Second Department, Appellate Division on September 13 issued decisions in Andreyeyeva v. New York Health Care, Inc. and Moreno v. Future Care Health Services, Inc. In these decisions, the court held that, to the extent that aides were not “residential” employees (who “lived” on the premises of their employer), the aides were entitled to be paid the minimum wage for all 24 hours of their shifts, regardless of whether they were afforded 8 hours for sleep (including 5 hours of uninterrupted sleep time) and three hours for meals (also known as the so-called “13-hour rule”).

The decisions followed the precedent recently established by the First Department, Appellate Division, in Tokhtaman v. Human Care, LLC, which ruled similarly.

Meanwhile, in other news this week: a multihospital health system in Wisconsin contacted HCA with plans for adoption of the HCA tool within its system; the U.S. Centers for Disease Control and Prevention’s chief sepsis advisor will serve on the HCA grant project steering committee; CMS has extended its New York State pilots (conducted

by IPRO) using this tool for another year; and similar other developments continue.

HCA filed an amicus brief in the Andreyeyeva case and, related to all of these cases, has engaged with both the state Department of Health (DOH) and state Department of Labor (DOL) to stress the gravity of this issue.

In the latest developments, the defense counsels for the Andreyeyeva and Moreno cases plan to make a motion to the Second Department to grant them permission to appeal the cases to the State Court of Appeals and there will be an opportunity for HCA to submit an amicus brief in support of this motion.

COALITION from p. 1 “Our coalition of New York State consumers, health care and human service workers, and providers and insurers urge you to strongly oppose the new Cassidy-Graham bill to repeal the Affordable Care Act (ACA), which could be voted on in the Senate in the coming days,” the coalition writes. (Please see the full letter at http://hca-nys.org/wp-content/uploads/2017/09/Graham-Cassidy-Letter.pdf.) “If the bill clears the Senate, it would be sent to the House for your consideration. Your opposition to the bill is critical, as its implementation would catastrophically cut Federal funding to New York’s health care system and severely compromise your constituents’ access to health care coverage and services.”

Governor Cuomo has also lambasted the bill, saying in recent remarks picked up by the media that “there is no way the state can pick up this cost … the state is already facing a $4 billion deficit going into next year.”

This latest federal health care effort emerged over the past week after a period of inactivity on the GOP’s aims to repeal and/or replace ACA. (HCA members may have seen the uptick in news on this bill in recent editions of HCA’s biweekly “Home Care in the News” clips distributions.) The bill was introduced on September 13 by sponsors Lindsey Graham of South Carolina and Bill Cassidy of Louisiana.

Similar to prior repeal-and-replace efforts, this legislation would end ACA’s Medicaid expansions, and cut hundreds of billions of dollars from Medicaid by shifting to a program of block grants and eliminating the open-ended entitlement. The bill has not yet been scored by the Congressional Budget Office, but similar, prior versions of legislation were found to cut as much as $800 billion in Medicaid funding over ten years.

Several news reports have referred to this latest bill as a “last-ditch” effort following the Senate’s rejection of a prior repeal-and-replace iteration in June. That measure failed by a tight voting margin of 49-to-51, with Senator John McCain of Arizona casting the decisive ‘no’ vote following his recent diagnosis of cancer. Senator McCain has voiced opposition to this current bill, as well, and its prospects remain uncertain given opposition or concerns raised by some other Republican Senators.

HCA will keep the membership informed of further developments and advocacy initiatives with Congress. HCA recently met with members of the Delegation on home care priorities, including the need to protect the Medicaid program, as reflected in our advocacy paper “Why Medicaid Works – and Why AHCA Cuts are Wrong” at http://hca-nys.org/wp-content/ uploads/2017/09/Why-Medicaid-Works.pdf.

Minimum Wage Survey Open for Completion Due on Monday, October 2; Clarifications Issued On September 18, the state Department of Health (DOH) posted the new “Home Care Provider Minimum Wage Survey” as a follow up to a webinar it held that day on the survey.

The survey must be completed and submitted by Monday, October 2. HCA has requested that this date be extended and will notify members if an extension is granted.

In order to complete the survey, agencies must first complete a registration process with the state Office of Pool Administration (OPA). The “Home Care Provider Minimum Wage Survey” will be used to determine minimum wage payments and is a requirement to be completed by home care providers for minimum wage funding apportionments. Agencies required to submit the survey include Certified Home Health Agencies (CHHAs), Licensed Home Care Services Agencies

(LHCSAs), Long Term Home Health Care Programs (LTHHCPs) and Consumer Directed Personal Assistance program (CDPAP) Fiscal Intermediaries (FIs). DOH has confirmed that even home care providers who don’t employ aides but contract for such services are required to complete the survey.

The survey will capture worker wage details, the number of employees impacted by title grouping, contractual relationships between home care agencies and managed care plans, as well as contractual relationships among the home care agencies.

In its communication to home care providers, DOH stated that the purpose of the survey is to “reconcile actual Medicaid minimum wage costs to actual Medicaid minimum wage funding distributions. While minimum wage projections have been included in current rates, effective 12/31/16, those figures will be reconciled using data from the survey. Data from the survey will also be used to assist in determining funding to include in future Medicaid Managed Care and Fee-for-Service rates.”

Webinar On September 18, DOH held a webinar on the new survey. The webinar was recorded and is available, along with Frequently Asked Questions (FAQs), on the OPA website. Some points made during the webinar and in the FAQs include:

The survey requests information for two time periods (1/1/16 to 12/31/16 and 1/1/17 to 3/31/17) and one survey must be submitted for each time period.



The survey asks for data for New York City, downstate (Long Island and Westchester) and rest of state and it should reflect where the service was provided, not where the agency is located or where the aide lives.



If a LHCSA has multiple offices with different license numbers for each of these offices, it has to file a survey for each license number.



All LHCSAs, CHHAs, LTHHCP,s and CDPAP FIs need to complete the survey, even if they don’t provide home care services or bill Medicaid.



Assisted Living Programs (ALPs) that have completed the ALP Minimum Wage survey have to complete this survey which will pertain to their LHCSA services.



Many of the questions include a “help” button or “pop-ups” (if you scroll on certain terms) with more information that will assist the survey user.



For the purposes of this survey, Personal Assistants paid by CDPAP FIs would be considered ‘employed staff’ in questions 2b, 3b, and 4b. CDPAP FIs should select “Yes” for the appropriate regions for these questions and enter the appropriate data for wage hours paid to a Personal Assistant.



Medicaid fee-for-service (FFS) pertains to all Medicaid payments outside of the two managed care types (Mainstream and Managed Long Term Care plans). The Medicaid Episodic Payment System

should be in the FFS line. Traumatic Brain Injury/Nursing Home Transition and Diversion hours for Home and Community Support Services workers should also be reported under the FFS line. 

In questions 2b/3b/4b, the user should include all hours paid to employees, including wage hours and non-billed hours.



In question 6, Fair Labor Standards Act (FLSA) revenue should not be included.



Users can enter data, save it and leave the survey and return to complete it at a later time.



After completing the survey, users will be able to print it out, along with an attestation/ certification statement that must be signed and scanned and uploaded back onto the webpage. The attestation/certification statement is expected to be posted very soon.

Additional Information Some additional clarifications issued by DOH in response to HCA and member questions, as well as our review of the survey, are as follows: 

Question 1a asks for the hours that the provider billed to the separate revenue sources, not the total hours paid.



Billable hours can be entered as a whole number or quarter-hour units.



When reporting the paid hours in questions 2b/3b/4b, these refer to hours paid to direct employees, not the hours billed to revenue sources.



Wage hours must be entered in full hour units.



The first column in questions 2b/3b/4b asks for hours paid at the base wage for the employee. This does not include fringe benefits or additional pay due to differentials/ overtime.



Questions 2d, 3d and 4d ask for the percentage of hours paid at overtime.



Employed staff (questions 2b, 3b and 4b) should include direct full and part-time employees on payroll, including direct care and administrative staff.

NGS Provides Update on Targeted Probe and Educate Initiative National Government Services (NGS), New York’s home health Medicare Administrative Contractor (MAC), posted the following update to its website regarding the upcoming Targeted Probe and Educate Initiative.

Beginning October 1, 2017, the U.S. Centers for Medicare and Medicaid Services (CMS) is expanding the existing Targeted Probe and Educate (TPE) pilot to include all Medicare Administrative Contractors (MACs). As previously reported, TPE will include targeted medical review. It will also include an option for potential elevated action, such as referral to other Medicare contractors, including the Zone Program Integrity Contractor (ZPIC), Unified Program Integrity Contractor (UPIC), Recovery Audit Contractor (RAC), etc.

The following are key elements of the TPE: 

All current MAC medical record reviews are replaced with three rounds of pre-payment or postpayment TPE. If the provider’s error rate remains high upon completion of the first round, then the provider is retained for the second and, potentially, a third round of review. Automated reviews and prior authorization directed by CMS are outside of the TPE strategy. (Note that any reviews or pilots otherwise mandated by CMS are excluded from this change. Providers with a continued high error rate after three rounds of TPE will be referred to CMS for additional action.)



MACs will select the topics for review based upon existing data analysis procedures.



The claim sample size for each round of probe review is limited to a minimum of 20 and a maximum of 40 claims. Note that the sample is per provider, per topic, and per round.



The TPE process includes provider-specific education that will focus on improving specific issues without allowing other problems to develop, along with an opportunity for the provider to ask questions. Education will be offered after each round of 20 to 40 claims reviewed.



In addition, there is an opportunity for “intra-round” education as well if the nurse reviewer identifies a common theme that can be easily corrected during the review phase.

Additional Information for Home Health Agencies 

Providers targeted for TPE will receive a notification letter about the upcoming review. Additional development requests (ADRs) will be used for the specific claims selected for review.



Providers should ensure that medical records are submitted promptly upon request. Reminder: ADRs must be responded to within the 45-day deadline (based on the date of the ADR) for each claim selected.



Providers are highly encouraged to respond to the ADR by sending all applicable medical records prior to day 45.



Provider nonresponse to medical records requests will count as an error.



MACs may conduct a “related claim review” of services related to a denied claim and such reviews may be conducted outside of the TPE process.



The TPE process does not replace or change appeal rights.



The educational sessions are not an appeals forum nor do the result letters and/or the educational sessions extend the appeal period.

Post-Acute Group Continues Discussions on Regulatory Framework The state Department of Health’s (DOH) post-acute care management workgroup met last week at the New York Academy of medicine in New York City to continue its discussions of barriers and recommendations to support the post-acute-to-homecare continuum.

Work group chairs Mark Kissinger of DOH and Sara Butterfield of IPRO (an HCA member) conducted an agenda supplementing the input from the first (August 9) meeting of the workgroup stakeholders. These stakeholders included HCA, other leading state associations, representatives of the state Office of Mental Health, and representatives of the hospital and physician communities.

HCA offered strategic ideas for addressing financial, regulatory and infrastructure support goals as well as guidance clarification to support the operation of a patient-centered, integrated system. HCA emphasized that the focus of support should be in the primary, pre-acute and post-acute contexts.

Hospital and physician representatives provided additional ideas advanced at the initial workgroup meeting regarding acute-to-homecare continuum models. These included hospital-at-home programs, other models of intensive post-acute transitional or complex medical care, and community-based primary care and medical management programs incorporating an in-home care component. In presenting these ideas and models, hospital and physician representatives sought consideration for ways in which they may be permitted to extend their current service jurisdictions to directly provide care in the home.

Currently, public health law article 36 restricts in-home health care (e.g., nursing, home health aide, personal care) to agencies licensed or certified to provide in-home services. Facilities, as well as other licensed providers, practitioners or entities, must develop or utilize an article 36-licensed or certified entity to provide in-home care.

HCA Executive Vice President Al Cardillo stressed the need and benefit of collaboration with home care agencies and hospices in ways that not only embody the statewide infrastructure for services, but which master the expertise for the delivery of in-home services, community health navigation and care management.

He also stressed that use of these agencies ensures uniform and high standards for service delivery and regulation.

Mr. Cardillo explained that fundamental precepts of article 36 are to ensure uniform regulation and standards for in-home care for all New York consumers. He underscored that article 36 is not just for regulation of types of home care, but that it establishes the common standards that any entity in New York State must meet to provide in-home care. Licensure and certification are the state’s mechanisms for ensuring standards and enforcement. He further emphasized that every other service under the respective articles of the public health law (e.g., emergency medical services, clinic services, hospice, laboratories, etc.) must be specifically licensed for those categories and that home care should be no exception.

Mr. Cardillo reviewed new laws and other proactive initiatives developed by HCA which provide the basis for the state and for hospitals, physicians and home care agencies to move forward in a collaborative fashion to support the pre and post-acute care of patients, and to promote innovation, matching financing and other needs for a more integrated system.

HCA Board members Russell Lusak of Selfhelp and Susan Brett of People Care addressed the public input portion of the workgroup meeting, stressing the collaboration route among home care, hospitals and

physicians, and the importance of utilizing the home care infrastructure while also maximizing the workgroup opportunity to streamline home care/collaboration procedures and regulations.

The Department of Health will continue to compile workgroup comments and recommendations, as well as public input in the coming weeks. HCA conducted a statewide member call on September 20 to review the workgroup proceedings, issues and next steps. HCA will be conducting a statewide member survey to garner further input and recommendations that we will assimilate into our next comments into the process.

DOH to Send Letter to GuildNet Members Affected by Recent Plan Withdrawal In guidance issued to managed long term care (MLTC) plans last week, the state Department of Health (DOH) indicated that it plans to send letters to GuildNet members who were affected by the recent withdrawal of GuildNet’s Partial Cap plan from Nassau, Suffolk and Westchester counties.

DOH reports that New York Medicaid Choice (NYMC) will be verifying the members’ enrollment in GuildNet during March 2017, and will be requesting information on the members’ plan of care from GuildNet at the time of disenrollment, as well as the receiving plan’s currently approved plan of care.

DOH is requiring continuity of the plan of care (authorized while at GuildNet) for at least 120 days, unless an assessment determines otherwise and the patient agrees to the change in plan. DOH will review members’ information from NYMC and, as needed, direct any changes to the receiving MLTC’s plan of care.

NYMC will be distributing letters dated September 29, 2017 to impacted members, instructing them to contact NYMC by December 29, 2017 if they wish to request reinstatement of their previous level of service.

In the guidance, DOH indicates that it has developed a Continuity of Care Policy which, going forward, will address transfer to new plans with the withdrawal or termination of any plan, and direct the receiving plan to provide 120 days continuity of care.

HCA has commented extensively on the draft of this policy to urge timely reimbursement adjustments for plans receiving these cases, as well as for the servicing providers. We have also sought the elimination of administrative/regulatory components which add extra burden to the plans and providers, among other improvements. The continuity of care policy is anticipated to be issued

by DOH imminently and HCA will inform members when finalized.

Oct. 19 HCA Program to Help Plans, Providers Navigate Audit Issues, Including OIG Report Questioning $1.4B in NY Medicaid Payments Conference Hotel Deadline is Today, Monday, Sept. 25 OIG and OMIG audits have been in the news recently, including in recent editions of The Situation Report. Our upcoming Corporate Compliance Symposium, on October 19, will address them, along with insights to help home care providers and MLTC plans respond in the areas of: eligibility assessments; documentation issues; plan-of-care adherence; and required written policies and procedures.

As reported to you in last week’s newsletter, OIG used an extrapolation technique questioning communitybased service payments to the tune of $1.4 billion, a figure that the state has disputed. Such extrapolations, based on a small sample of 100 payments (in this case), have historically been used to generate broad-brush conclusions.

Rosemary McKenna, Principal at Jackson Lewis, will highlight this audit and others during her session on ”NYS Auditing Priorities: The Home Care Impact.” The Symposium will also offer an opportunity for plans and providers to communicate concerns for HCA’s follow-up efforts with the Department of Health on any next steps, including potential contract amendments that may be under consideration as the Department responds to the audit.

Ms. McKenna will also highlight other priority compliance and integrity areas targeted by both OMIG and OIG, including a new OMIG “Compliance Program Assessment” which found that 24% of providers do not have sufficient written policies and procedures for dealing with potential compliance issues among employees and other associates. The assessment also found that 55% of providers do not offer periodic training and education on compliance issues, expectations and operations to all necessary individuals, according to OMIG. These and other reports are an important resource for self-assessing your adherence to compliance requirements, and to determine audit risks and vulnerabilities.

CMS Innovation Center Issues RFI Last week, the U.S. Centers for Medicare and Medicaid Services (CMS) Innovation Center issued a Request for Information (RFI) seeking feedback on a “new direction to promote patient-centered care and test marketdriven reforms that empower beneficiaries as consumers, provide price transparency, increase choices and competition to drive quality, reduce costs, and improve outcomes.”

The RFI is at https://survey.max.gov/429625; it is due November 20.

CMS states that “while existing partnerships with healthcare providers, clinicians, states, payers and stakeholders have generated important value and lessons, CMS is setting a new direction for the Innovation Center.”

The Innovation Center is seeking stakeholder input on additional ideas and concepts, and on the future direction of the Innovation Center. In particular, the Innovation Center is interested in testing models in the following eight focus areas: 1. Increased participation in Advanced Alternative Payment Models (APMs); 2. Consumer-Directed Care & Market-Based Innovation Models; 3. Physician Specialty Models; 4. Prescription Drug Models; 5. Medicare Advantage (MA) Innovation Models; 6. State-Based and Local Innovation, including Medicaid-focused Models; 7. Mental and Behavioral Health Models; and 8. Program Integrity.

However, the Innovation Center may also test models in other areas.

Transition to New Medicare Numbers and Cards As part of its campaign to replace all existing Medicare cards by April 2019, the U.S. Centers for Medicare and Medicaid Services (CMS), through the Medicare Administrative Contractors (MACs), recently mailed letters to all Medicare Fee-For-Service providers about the assignment of new numbers (known as Medicare Beneficiary Identifiers, or MBIs) and the issuance of new Medicare cards to all people with Medicare beginning in April 2018.

Providers are advised to review the letter (https://www.cms.gov/Medicare/New-Medicare-Card/ Providers/New-Medicare-Card-Provider-Letter.pdf) and fact sheet (https://www.cms.gov/Outreach-andEducation/Medicare-Learning-Network-MLN/MLNProducts/Downloads/MedicareCard-FactSheetTextOnly-909365.pdf).

Provider systems and business processes must be ready to accept the new Medicare number by April 2018 for transactions, such as billing, claim status, eligibility status, and interactions, with the MACs. There will be a transition period when providers can use either the Health Insurance Claim Number (HICN) or the MBI to exchange data and information with the MACs. The transition period will start April 1, 2018 and run through December 31, 2019. However, systems must be ready to accept the new MBI by April 1, 2018.

Home Health Claims and Requests for Anticipated Payments (RAPs) Home health agencies (HHAs) can use MBIs or HICNs on home health claims and Requests for Anticipated Payments (RAPs) with a “From Date” before January 1, 2020. Because HHAs submit home health claims for a 60-day payment episode, there may be times when an episode ends after the transition period on December 31, 2019. If the “From Date” on the RAP or the final claim date is before December 31, 2019, HHAs may submit either the HICN or the MBI. But, HHAs must submit the MBI for RAPs and final claims when the “From Date” is on or after January 1, 2020.

Further Information CMS also recently unveiled the new Medicare card design (https://www.cms.gov/medicare/newmedicare-card/nmc-home.html). The new Medicare card contains a unique, randomly-assigned number, which includes a combination of numbers and uppercase letters to replace the current Social Securitybased number, and is intended to prevent fraud and identity theft.

Medicare Advantage managed care plans and Medicare Prescription Drug plans will continue to assign and use their own identifiers on their health insurance cards. For patients in these plans, you should continue to ask for and use the plans’ health insurance cards.

OIG Issues Updated Workplan The U.S. Office of Inspector General has issued its monthly update to its Work Plan.

The two new items of interest to home care, hospice and managed long term care providers include: 



Medicaid Health Home Services for Beneficiaries with Chronic Conditions: OIG will review Medicaid health home programs for compliance with relevant federal and state requirements.

HHS Incident Response Capability: will determine whether the Department of Health and Human Services (HHS) has sufficiently implemented incident response capabilities to safeguard HHS’s information technology systems and data.

Previously, OIG updated its workplan once or twice each year; however, “in order to enhance transparency around OIG’s continuous work planning efforts,” effective June 15, 2017, OIG is updating its work plan website monthly.

Last month, OIG updated its work plan to include a review of the appropriateness of Medicare Part D drug claims for individuals who are receiving hospice benefits under Part A and to determine whether Part D continues to pay for prescription drugs that should have been covered under the per diem payments made to hospice organizations.

PHHPC Establishment and Project Review Committee Meets The Public Health and Health Planning Council (PHHPC) Establishment and Project Review Committee met on September 20.

The agenda included applications by: 

25 entities to establish 25 new Licensed Home Care Services Agencies (LHCSAs), including one with an Assisted Living Program; and

Three applications for new LHCSAs were tabled and will be discussed at a special PHHPC committee meeting prior to the next full PHHPC Council meeting on October 11, 2017. The remaining applications for new LHCSAs and changes of ownership were approved and forwarded to the full PHHPC for its review.

Corey Jamison brings more than 25 years of experience partnering with executives and teams around the globe to drive dramatic, sustainable organizational transformation. She has worked with leaders at all levels of some of the largest brands, and offers a level of experience, acumen, partnership, and courage that inspires leaders and teams toward the hard work of taking it to the next level. Corey is a world-class facilitator who can turn even the most challenging teams toward shared accountability and new levels of productivity. She is a dynamic and sought-after speaker and appears frequently at professional conferences and seminars. In addition, Corey has been interviewed and quoted by National Public Radio, Good Morning America, and the New York Times.

Corey received a bachelor’s degree from Vassar College and a master’s degree in education from Fitchburg State College. She is a doctoral candidate in psychology at Walden University.
