Final State Budget Agreement Reached As reported in an HCA alert on Saturday, the state budget reached its climax over the weekend. The $175.5 billion spending plan was substantially completed by today’s April 1 deadline. The Legislature stood firm in rejecting many of the health and Medicaid cuts originally proposed in the Governor’s executive budget and 30-day amendments (such as the 0.8percent across-the-board cut and others), as well as new proposed mandates opposed by HCA (like the National Provider Identifier requirement for home care aides). Court of Appeals Upholds 13-Hour Live-in Standard; Yet Class-Action Risks Remain HCA announces April 5 call to brief members about implications of landmark verdict In a landmark decision long anticipated by the home care industry, New York’s Court of Appeals last week issued an opinion in the Andryeyeva and Moreno cases. By a 5-to-2 margin, the court reversed an appellate division’s verdict, which had earlier rejected the 13-hour interpretation of state Department of Labor (DOL) law for compensable hours in 24-hour/live-in cases.
