DOH Preps Full Slate of EPS Rebasing Cuts at Odds with Legislative Process HCA has raised strong objections to the state Department of Health (DOH) based on word that it is preparing a Dear Administrator Letter (DAL) which would implement a full rebasing cut under the Medicaid CHHA episodic payment system (EPS), contrary to EPS-related legislation awaiting the Governor’s signature. DOH indicates that it is preparing the DAL for release next week. As previously reported, the Department is required to rebase the system at least every three years, per the 2011 Medicaid Redesign Team (MRT) legislation enacting EPS. Update on NAHC F2F Lawsuit Counsel for the National Association for Home Care & Hospice (NAHC) presented oral argument before U.S. District Court Judge Christopher Cooper on August 6, 2015, regarding NAHC’s lawsuit challenging the validity of the physician narrative requirement in the face-to-face (F2F) encounter rule. While the U.S. Centers for Medicare and Medicaid Services (CMS) rescinded the narrative requirement from its rule after HCA, NAHC and others expressed strong concerns, and after NAHC filed its lawsuit last year, CMS has not provided nearly $200 million in retroactive payments to home health agencies that were wrongfully denied claims because of the now-rescinded narrative requirement. NAHC brought litigation on the validity of the narrative requirement so that home health agencies that provided care to patients in good faith are paid for their inappropriately disallowed claims.
