HCA Gears Up for Next Week’s State Budget Presentation, Legislative Advocacy on January 26 The state budget and legislative advocacy season are heating up in the coming week, as Governor Cuomo is slated to present both his state of the state address and his proposed 2015-16 fiscal plan, including budget bills, during a speech on Wednesday, January 21. In the lead-up to next week’s budget presentation – and HCA’s State Advocacy Day the following week, on January 26 – HCA has been working, based on priorities of our Board and members, to develop a set of See BUDGET p. 3
Court Vacates Companionship Exemption Rule for Home Care A federal court on Wednesday ruled that the U.S. Department of Labor’s (DOL) changes to the companionship exemption for home care violated the law. This week’s landmark decision effectively invalidates DOL’s rule on the companionship exemption for home care, which was originally slated to go into effect on January 1 but was temporarily suspended under a restraining order on December 31. DOL has not indicated whether it will appeal the decision, though the federal government has vowed to do so in the past. An appeal, if pursued, would go before the U.S. Court of Appeals.
