Recently retired from radio, Coby Mach was the Corporate Operations Manager for 34 radio stations in four states. He was a talk show host on two Lincoln radio stations for over 15 years including the #1 afternoon radio show, Drive Time Lincoln. For the last 8 years, Coby has been the President and CEO of the Lincoln Independent Business Association (LIBA) which he helped grow from 700 to over 1,100 members today. He has accompanied elected officials on various trips, including a trade mission to Cuba with Governor Heineman.

President’s Message Dan Klein, Sr., HBAL President What’s your vision for the future regarding the building industry? Specifically HBAL? There are many predictions relating to our industry. If you were to combine most of them, you would probably find something along the lines of modest growth in the short term and potentially more rigorous growth in future years. Since housing starts have continued to improve here in Lincoln, we have a brighter future ahead than what it looked like six months ago.

Though the world continues to change around us and we can not change many things out there, we can make an impact right here at home. There are many unimaginable opportunities waiting for us as we move forward and make a difference where we are.

This has been a very interesting year serving as your President, but I am more encouraged about our future each and every day. The future of membership with HBAL will soon include a new website with greater efficiency, transparency and marketing of our members to their potential clients.

September 21, 2012 Dear Member: The ongoing reconciliation efforts with the Nebraska State Home Builders Association (NSHBA) has resulted in the surrender of the HBAL’s National Association of Home Builders (NAHB) Charter. Efforts to re-affiliate with the NAHB are underway. Each individual member will continue to be a member of the NAHB/NSHBA until their renewal date. If you wish to continue your NAHB/NSHBA affiliation, directions to renew can be found in the October issue of the Lincoln Business Builder, or you may call the HBAL office.

The Home Builders Association of Lincoln will continue to serve its members and the community with a high level of service and commitment. The vast majority of our members will not notice the changes made from the charter surrender. The advocacy for our industry will continue and a lobbyist will be hired directly by the HBAL for the 2013 Nebraska Legislative session. The Nebraska Builders Home & Garden Show is continuing to grow and the Spring and Fall Parade of Homes are well advertised and produced. The Fall Parade of Homes flipbook is now available online.

The world continues to change around us including the regulations in which we have to operate our business within. For the latest information which affects you, stay engaged with the HBAL and make a difference in your business, industry and community.

Is Hoarding a Problem in Lincoln?

Is Hoarding a Problem in Lincoln?

When a person was described as a “pack rat” or a “collector” twenty years ago, these terms conjured up an image of a person who was an eccentric. These terms now have been replaced, in some cases, with the person who has a hoarding behavior.

An analysis of this behavior has more recently been refined by doctors, health professionals, and caseworkers who believe there is a connection with Obsessive Compulsive Disorder (OCD) and Diogenes Syndrome. OCD criteria that are exhibited by hoarding include the acquisition of and inability to discard a large number of possessions with a relatively small value. These acquisitions can be animals as well as other items. When the living space is reduced by these acquisitions, code enforcement issues come into play with the exiting pathways being restricted for emergency situations, flammable materials being packed around fuel burning appliances and other issues. Health Code considerations also come into play with the breakdown of sanitation and the harborage present for rodents and insects.

Diogenes Syndrome is characterized as severe self-neglect and squalor and sometimes a tendency to hoard rubbish.

This information can aid code enforcement, health and emergency responders in dealing with these situations.

Some estimates of hoarding reach as high as 8% of the adult population. There also appears to be a connection between advanced age and the higher percentage of hoarding in that group. Increased longevity, with medical developments may actually cause an increase in the number of hoarding situations over time.

Offensive odors, accumulation of clutter and in some cases hoarding of a large number of animals can create unsanitary

conditions. A common theme in the most severe cases is a pattern where the dysfunctional lifestyle is hidden through a conscious effort to screen the conditions from the public.

There have been a number of cases, in Lincoln, where the hoarding was discovered only during an emergency call for service. In these cases the resolution to the cleanout can be the start of a very long and involved process to reach a resolution. It can require relatives, care providers, private services and/or the State protective services to work toward a resolution of the aftermath that occurs. The people in this situation put a special significance on the individual items they acquire in a way most individuals would not. The result can create a confrontational situation that is not easily resolved. In some cases the whole residence can become unlivable due to the sanitation problems. The Lincoln Property Maintenance Code prohibits occupancy when these conditions exist.

The risks to the individual are very real as illustrated by the example of the famous 1947 Manhattan case where the Collyer brothers were found dead among 136 tons of garbage. Police discovered 14 grand pianos, the chassis of a Model T Ford among other items. A network of tunnels had been carved out of the garbage in the residence. Fearing intruders, booby traps were rigged out of trash and, one of which triggered accidentally, entombed them. A more recent case in Las Vegas that occurred in 2010 involved a woman who had been missing for four months and was found buried beneath a mountain of garbage in her house. The husband reported to officials he found his wife missing after a nap.

The collected trash, clothes and other debris was so vast a sniffer dog did not discover her corpse in the house. The husband eventually discovered her body in the debris of their residence four months after her disappearance. Of course these are not the typical hoarding situations, but in most cases we have been involved with there have been various hazards to the occupants.

The Housing Code Section of the Building and Safety Department has been involved with many cases of hoarding over the years and work with other departments of the City, State, and private agencies to help resolve the code violations that exist. In answer to the question: (Does Lincoln have a hoarding problem?), it would be more accurate to say it exists here as well as everywhere.

The Benefits of Tax-Advantaged Savings Vehicles Provided by Brian Willet, Waddell & Reed Taxes can take a big bite out of your total investment returns, so it’s helpful to look for tax-advantaged strategies when building a portfolio.

But keep in mind that investment decisions shouldn’t be driven solely by tax considerations; other factors to consider include the potential risk, the expected rate of return, and the quality of the investment.

Tax-deferred and tax-free investments

Tax deferral is the process of delaying (but not necessarily eliminating) until a future year the payment of income taxes on income you earn in the current year. For example, the money you put into your 401(k) retirement account isn’t taxed until you withdraw it, which might be 30 or 40 years down the road!

Tax deferral can be beneficial because: • The money you would have spent on taxes remains invested • You may be in a lower tax bracket when you make withdrawals from your accounts (for example, when you’re retired), and • You can accumulate more dollars in your accounts due to compounding Compounding means that your earnings become part of your underlying investment, and they in turn earn interest. In the early years of an investment, the benefit of compounding may not be that significant. But as the years go by, the long-term boost to your total return can be dramatic.

Keep in mind that tax deferred is not the same as tax free. “Tax deferred” means that the payment of taxes is delayed, while “tax free” means that no income taxes are due at all. Some savings vehicles, like Roth IRAs, can generate tax-free income.

Taxes make a big difference

Let’s assume two people have $5,000 to invest every year for a period of 30 years.

One person invests in a tax-free account like a Roth 401(k) that earns 6% per year, and the other person invests in a taxable account that also earns 6% each year.

Assuming a tax rate of 28%, in 30 years the tax-free account will be worth $395,291, while the taxable account will be worth $295,896. That’s a difference of $99,395.

This hypothetical example is for illustrative purposes only, and its results are not representative of any specific investment or mix of investments. Actual results will vary. The taxable account balance assumes that earnings are taxed as ordinary income and does not reflect possible lower maximum tax rates on capital gains and dividends which would make the taxable investment return more favorable, thereby reducing the difference in performance between the accounts shown.

Investment fees and expenses have not been deducted. If they had been, the results would have been lower. You should consider your personal investment horizon and income tax brackets, both current and anticipated, when making an investment decision as these may further impact the results of the comparison.

This illustration assumes a fixed annual rate of return; the rate of return on your actual investment portfolio will be different, and will vary over time, according to actual market performance. This is particularly true for long-term investments.

It is important to note that investments offering the potential for higher rates of return also involve a higher degree of risk to principal.

and the issuer promises to pay principal and earnings back to you or your named beneficiary in the future. Annuities generally allow you to elect to receive an income stream for life (subject to the claims-paying ability of the issuer). There’s no limit to how much you can invest, and your contributions grow tax deferred. However, you’ll owe income taxes on the earnings when you start receiving distributions.

Tax-advantaged savings vehicles for college

For college, tax-advantaged savings vehicles include: • 529 plans --College savings plans and prepaid tuition plans let you set aside money for college that will grow tax deferred and be tax free at withdrawal at the federal level if the funds are used for qualified education expenses.

These plans are open to anyone regardless of income level. Contribution limits are high--typically over $300,000--but vary by plan.

• Coverdell education savings accounts --Coverdell accounts are open only to individuals with incomes below certain limits, but if you qualify, you can contribute up to $2,000 per year, per beneficiary. Your contributions will grow tax deferred and be tax free at withdrawal at the federal level if the funds are used for qualified education expenses.

• Series EE bonds --The interest earned on Series EE savings bonds grows tax deferred. But if you meet income limits (and a few other requirements) at the time you redeem the bonds for college, the interest will be free from federal income tax too (it’s always exempt from state tax).

Note: Investors should consider the investment objectives, risks, charges, and expenses associated with 529 plans. More information about specific 529 plans is available in each issuer’s official statement, which should be read carefully before investing.

Bottom line

Though tax considerations shouldn’t be your only investing concern, by putting your money in tax-advantaged savings vehicles and investments when appropriate, you’ll keep more money in your own pocket and put less in Uncle Sam’s.

Tax-advantaged savings vehicles for retirement

One of the best ways to accumulate funds for retirement or any other investment objective is to use tax-advantaged (i.e., tax-deferred or tax-free) savings vehicles when appropriate.

• Traditional IRAs --Anyone under age 70½ who earns income or is married to someone with earned income can contribute to an IRA. Depending upon your income and whether you’re covered by an employer-sponsored retirement plan, you may or may not be able to deduct your contributions to a traditional IRA, but your contributions always grow tax deferred. However, you’ll owe income taxes when you make a withdrawal (and a 10% additional penalty tax if you’re under age 59½, unless an exception applies). In 2012, you can contribute up to $5,000 to an IRA, and individuals age 50 and older can contribute an additional $1,000.

• Roth IRAs --Roth IRAs are open only to individuals with incomes below certain limits. Your contributions are made with after-tax dollars, but they will grow tax-deferred and qualified distributions will be tax free when you withdraw them. The amount you can contribute is the same as for traditional IRAs. Total combined contributions to Roth and traditional IRAs can’t exceed $5,000 each year for individuals under age 50.

• SIMPLE IRAs and SIMPLE 401(k)s --These plans are generally associated with small businesses. As with traditional IRAs, your contributions grow tax deferred, but you’ll owe income taxes when you make a withdrawal. For 2012, you can contribute up to $11,500 to one of these plans; individuals age 50 and older can contribute an additional $2,500. (SIMPLE 401(k) plans can also allow Roth contributions.)

• Employer-sponsored plans (401(k)s, 403(b)s, 457 plans) --Contributions to these types of plans grow tax deferred, but you’ll owe income taxes when you make a withdrawal. For 2012, you can contribute up to $17,000 (up from $16,500 in 2011) to one of these plans; individuals age 50 and older can contribute an additional $5,500. Employers can generally allow employees to make after-tax Roth contributions, in which case qualifying distributions will be tax free.

• Annuities --You pay money to an annuity issuer (an insurance company),

HBAL has committed to once again build a home for Habitat for Humanity. We need to get your commitment with this project.

We are looking for new volunteers and the continued support and assistance of those who have helped in the past. The benefits of helping with this project cannot always be measured. However, we do know we will be providing a safe and decent home for a family whose whole life will change once they have a place to call their own. Everyone needs a place to call home.

Remember, you don’t have to be an “expert” to assist with this project.

We also need people to wash windows, paint, clean and many other tasks that don’t require a certification. Our goal is to complete the home in a two to three week build. It’s a great feeling to work on a Habitat house.

Typically, the 30 year loan requires monthly payments of about $450$500 with approximately $250 being applied to tax and insurance escrow. Award Nominations

Associate of the Year Award Send in your nomination by November 1 Purpose The purpose of the “Associate of the Year” program is to recognize an outstanding Associate member of the association who has conducted themselves in an exemplary manner so as to bring credit to the building industry, community and HBAL.

Eligibility Each nominee shall be an active Associate member of HBAL and must have been a member for a minimum of three years on January 1, 2012.

Deadline Submit your nomination by filling out the form and returning it to HBAL before November 1. If you need additional space, please attach a separate sheet of paper to the nominating form. From the nominations received, the winner of the award will be chosen by the selection committee.

Selection Committee The committee will have a minimum of five members.

The committee shall consist of the President, President Elect, First Vice President, Immediate Past President and the 2011 “Associate of the Year,” Greg Shinaut.

Basis of Selection The basis for selection shall include the following criteria: 1. Business conduct and experience (25 percent) 2. HBAL activities/involvement (50 percent) 3. Civic and volunteer activity (25 percent)
